Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

Many philosophers have pointed out that statistical evidence, or at least some forms of it, lack desirable epistemic or non-epistemic properties, and that this should make us wary of litigations in which the case against the defendant rests in whole or in part on statistical evidence. Others have responded that such broad reservations about statistical evidence are overly restrictive since appellate courts have expressed nuanced views about statistical evidence. In an effort to clarify and reconcile, I put forward an interpretive (...) analysis of why statistical evidence should raise concerns in some cases but not others. I argue that when there is a mismatch between the specificity of the evidence and the expected specificity of the accusation, statistical evidence—as any other kind of evidence—should be considered insufficient to sustain a conviction. According to the principle of epistemic closure, knowledge is closed under known implication. The principle is intuitive but it is problematic in some cases. Suppose you know you have hands and you know that ‘I have hands’ implies ‘I am not a brain-in-a-vat’. Does it follow that you know you are not a brain-in-a-vat? It seems not; it should not be so easy to refute skepticism. In this and similar cases, we are confronted with a puzzle: epistemic closure is an (...) intuitive principle, but at times, it does not seem that we know by implication. In response to this puzzle, the literature has been mostly polarized between those who are willing to do away with epistemic closure and those who think we cannot live without it. But there is a third way. Here I formulate a restricted version of the principle of epistemic closure. In the standard version, the principle can range over any proposition; in the restricted version, it can only range over those propositions that are within the limits of a given epistemic inquiry and that do not constitute the underlying assumptions of the inquiry. If we adopt the restricted version, I argue, we can preserve the advantages associated with closure, while at the same time avoiding the puzzle I’ve described. My discussion also yields an insight into the nature of knowledge. I argue that knowledge is best understood as a topic-restricted notion, and that such a conception is a natural one given our limited cognitive resources. (shrink)

The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. There is an extensive scholarly literature on these topics, and it is a secondary aim of the chapter to provide readers the means to find their way in historical and ongoing debates.

This note discusses three issues that Allen and Pardo believe to be especially problematic for a probabilistic interpretation of standards of proof: (1) the subjectivity of probability assignments; (2) the conjunction paradox; and (3) the non-comparative nature of probabilistic standards. I offer a reading of probabilistic standards that avoids these criticisms.

I comment on two analyses of the Simonshaven case: one by Prakken (2019), based on arguments, and the other by van Koppen and Mackor (2019), based on scenarios (or stories, narratives). I argue that both analyses lack a clear account of proof beyond a reasonable doubt because they lack a clear account of the notion of plausibility. Epistemic closure under known implication is the principle that knowledge of "p" and knowledge of "p implies q", together, imply knowledge of "q". This principle is intuitive, yet several putative counterexamples have been formulated against it. This paper addresses the question, why is epistemic closure both intuitive and prone to counterexamples? In particular, the paper examines whether probability theory can offer an answer to this question based on four strategies. The first probability-based strategy rests on the accumulation of risks. The (...) problem with this strategy is that risk accumulation cannot accommodate certain counterexamples to epistemic closure. The second strategy is based on the idea of evidential support, that is, a piece of evidence supports a proposition whenever it increases the probability of the proposition. This strategy makes progress and can accommodate certain putative counterexamples to closure. However, this strategy also gives rise to a number of counterintuitive results. Finally, there are two broadly probabilistic strategies, one based on the idea of resilient probability and the other on the idea of assumptions that are taken for granted. These strategies are promising but are prone to some of the shortcomings of the second strategy. All in all, I conclude that each strategy fails. Nel campo delle scienze cognitive molti oggi condividono l’ipotesi che siano necessari differenti tipi di rappresentazioni per modellare i sistemi cognitivi sia naturali, sia artificiali. Si considerino le rappresentazioni basate su reti neurali, i formalismi simbolici e rappresentazioni analogiche quali rappresentazioni diagrammatiche o modelli mentali. Tutti questi metodi hanno successo nello spiegare e modellare alcune classi di fenomeni cognitivi, ma nessuno è in grado di rendere conto di tutti gli aspetti della cognizione. A partire da queste considerazioni, riteniamo che sistemi (...) intelligenti e architetture cognitive possano trarre vantaggio dalla combinazione di sistemi di rappresentazione diversi. Si pone allora il problema di fare interagire rappresentazioni di natura differente in maniera cognitivamente e teoricamente fondata. La nostra ipotesi è che gli spazi concettuali possano offrire una sorta di lingua comune, che consentirebbe di integrare e generalizzare molti aspetti delle impostazioni sopra menzionate, superando i limiti delle varie proposte intese singolarmente. La definizione di un’etica professionale dell’insegnante e l’adozione di un codice di condotta specifico sono due elementi rilevanti del processo di professionalizzazione dell’insegnamento. Una professione si differenzia infatti da una mera occupazione per certi valori che la caratterizzano. Essi si distinguono in valori interni (determinati dalle caratteristiche intrinseche della professione) e in valori esterni (ricavati da un’interpretazione appropriata del contesto sociale e politico entro cui si esercita la professione). La relazione identifica due valori fondamentali della professione insegnante: l’uno interno, la (...) credibilità dell’insegnante; l’altro esterno, la neutralità dell’insegnante. La credibilità è ricavata dal rapporto di dipendenza epistemica che caratterizza la relazione tra insegnante e allievo. La neutralità si fonda su un’interpretazione appropriata della funzione pubblica nel contesto pluralistico della società contemporanea. In recent years, a trend in AI research has started to pursue human-level, general artificial intelli-gence (AGI). Although the AGI framework is characterised by different viewpoints on what intelligence is and how to implement it in artificial systems, it conceptualises intelligence as flexible, general-purposed, and capable of self-adapting to different contexts and tasks. Two important ques-tions remain open: a) should AGI projects simu-late the biological, neural, and cognitive mecha-nisms realising the human intelligent behaviour? and b) what is the relationship, if (...) any, between the concept of general intelligence adopted by AGI and that adopted by psychometricians, i.e., the g factor? In this paper, we address these ques-tions and invite researchers in AI to open a dis-cussion on the theoretical conceptions and practi-cal purposes of the AGI approach. (shrink)

Recently the educational task of the public school has been repeatedly challenged. Citizenship has not been spared from criticism and its legitimacy has been questioned. The article discusses the issue of the legitimacy of citizenship education in public schools, specifying the meaning of neutrality of which it proposes a narrow interpretation. On this basis the article examines four philosophical models of citizenship education (communitarianism, civic humanism, liberalism, republicanism). The analysis suggests that the republican model of citizenship education is the most (...) appropriate; it needs however a liberal adaptation. Questo aspetto rappresenta un problema per la pro- gettazione di ontologie in informatica, poiché i formalismi adottati per la rap- presentazione della conoscenza (a partire da OWL – Web Ontology Langua- ge) non sono in grado di rendere conto dei concetti nei (...) termini dei loro tratti prototipici. Nel presente articolo ci concentriamo sulla classe dei disordini mentali facendo riferimento alle descrizioni che ne vengono date nel DSM-5. The editor's introduction discusses Clarence I. Lewis's conceptual pragmatism when compared with post-empiricist epistemology and argues that several Cartesian assumptions play a major role in the work, not unlike those of Logical Positivism. The suggestion is made that the Cartesian legacy still hidden in Logical Positivism turns out to be a rather heavy ballast for Lewis’s project of restructuring epistemology in a pragmatist key. More in detail, the sore point is the nature of inter-subjectivity. For Lewis, no less than for (...) the Logical Positivists at the time of the Protocols Controversy and Husserl in the Cartesian Meditations, this is a problem without a solution. The reason is that all these philosophers are apparently unable to realize that the existence of a plurality of knowing subjects cannot be treated at once both as a speculative problem and a methodological one. Lewis, thanks to his pragmatist approach both comes closer to the right answer and offers an even more naïve unsatisfactory solution to the pseudo-problem under discussion. The fact that he has clear in mind that inter-subjectivity means not only a plurality of linguistic utterances but also a co-existence of different kinds of practical behaviour. Eventually, the very idea of mind, the key-idea in the book, suffers from the above mentioned tension. In fact, if inter-subjective communication and action is considered at a methodological level, the very idea of mind would not need an analysis, and no kind of ‘reflexive’ analysis. Methodology might be limited to a ‘naïve’ level where the existence of the world and a plurality of subjects be taken as a bedrock of uncritically accepted evidence. Philosophical reflection on ultimate evidence, instead, would take a different approach, maybe the one Wittgenstein was putting into practice in the same years when Mind and the world order was written, namely it would be bound to question the very meaning of the idea of ‘mind’ as an undue fiction – the same carried out by Descartes – when he assumed the Cogito to be at once a body of self-evident truths and a thing or substance, the familiar Platonic idea of psyche or soul. I argue that the difference between the 17th century new moral science and Scholastic Natural Law Theory derived primarily from the skeptical challenge the former had to face. Pufendorf's project of a 'scientia practica universalis' was the paramount expression of an anti-skeptical moral science, a «science» both explanatory and normative, but also anti-dogmatic in so far as it tried to base its laws on those basic phenomena of human life that supposedly were outside the scope of skeptical doubt. Of the (...) Scholastic legacy to the new moral science, a dichotomy between an «intellettualistic» and a «voluntaristic» view of natural law (or between lex immanens and lex imposita). Voluntarism lays at the root both of theological views such as those of Calvinism and of political views such as those of Hobbes and Locke. A need to counterbalance undesirable implications of estreme voluntarism may account for much of 17th and 18th centuries developments in ethics and politics. Scottish natural jurisprudence, an expression of such quest for a third way between scepticism and extreme voluntarism, is less secular and more empirical than received wisdom admits of. One of its side-effects, namely a systematic, self-contained, and empirical economic theory, results from the search for a normative theory of social life on an empirical basis. The main tool for building such a theory, namely a view of societal laws as embedded in trans-individual mechanisms, derives from the voluntarist view of natural law as «imposed» law. Subsequent discussions of social issues based on the opposition of economic and ethical reasons originated partly from gross misreading of the Scottish natural jurisprudential framework for economic theory. A short discussion of the origin of the notion of mode of subsistence in the eighteenth-century discussion and particularly in the Scottish Enlightenment and its legacy n the Marxist theory of modes of production or social economic formations.

I reconstruct the discussion originated with publication of A Theory of Justice in 1971. I argue that criticism and counter-criticism has modified in a remarkable way the original points of view with which both alignments joined the discussion.

In this paper I argue that applied ethics is a phenomenon spontaneously emerged between the Sixties and the Seventies and resulting from interbreeding of theoretical discussion in ethics and public discourse of liberal-democratic societies. I contend that the phenomenon’s novelty is in a peculiar relationship it has helped in establishing between ethical theories and real-world issues, and besides that the true nature of applied ethics is that of deliberation, whose tool is the faculty of judgment, or casuistry, understood the Kantian (...) way. The paper reconstructs Beauvoir's interpretation of the Marxist and the Freudian contributions to our understanding of the feminine condition. A number of epistemological assumptions derived from Sartre's philosophy are pointed out. Beauvoir's reading of Marx, Engels, and Freud is discussed claiming that her reading is biased by humanistic and historicist assumptions.

1. The most original discovery in Beauvoir’s book is one more Columbus’s egg, namely that it is far from evident that a woman is a woman. That is, she discovers that a woman is the result of a process that made so that she is like she is. The paper discusses two aspects of the so-to-say ‘ideology’ inspiring the work. The first is its ideology in the proper, Marxian sense. My claim is that the work still pays a heavy price (...) to the dominating ideology. It leaves still too much unquestionedof what was assumed at the time to be obvious, necessary, and unchanging. This ballast depends firstly on the inherited prevailing climate of opinion, corresponding to a situation of alienation, producing two distorted views of the male and female gender. On the other hand, it depends on an unquestioned legacy from the modern episteme (in Foucault’s sense of the word) carrying presupposed Cartesian dualism. The other side of the work’s ideology, that is, the positive program presented or better the utopia it formulates is less innovative than it could be, In a few passages, where she seems to make use of suggestions from Merleau-Ponty, she points at a view where the bodily and emotional dimension is rescued from its negation in the male-dominated Capitalist society. Still, these suggestions are forgotten in the bulk of the work. -/- 2. The making of a philosophical work does not depend just on the kind of philosophical influences behind it. A book is also the product of an author with a story living in one society at a given time of social history. In this case, the book was written in the afterwar time when women were pushed back home again from the wartime labor market and when several of the goals reached by the first phase of feminist movements had gone lost in several European countries under Fascist or semi-fascist regimes and were being eroded in America by the reactionary climate of McCarthyism. It was a book written by an intellectual young woman in almost total isolation. These circumstances account for some more naïve suggestions from work: for ex., the idea that the alternative to the strategy once adopted by nineteenth-century emancipationist movements should be an individual inner process of transformation confined within the boundaries of one woman’s consciousness, or also, the idea that the goal of women’s liberation should be to bring all women to a condition similar of Simone de Beauvoir herself who, as an educated woman, earning her life by her work, and living in an allegedly equal state with an enlightened man (Jean-Paul Sartre!) in a relationship free from constraints (an unmarried couple!), was already exemplifying what a liberated woman’s life would be. -/- 3. The reconstruction of the idea of femininity is still the most fruitful part of the work. It rejects the notion of femininity as an essence depending on biology or other factors and explores the making of this image as a result of a condition made of the social and economic state of affairs but as revived and actively mirrored through and by the consciousness of the very subjects suffering an oppressive situation. And the main novelty is the ‘discovery’ of asymmetry between the self-image of the male and the (self)-image of the woman, an asymmetry depending on the fact that the woman sees herself through the other’s eyes. -/- 4. Later feminist writers such as Shulamit Firestone remarked that 'The Second Sex' heavily depended on several key-ideas from Sartre existential ontology. One crucial aspect is accepting the mind-body dualistic framework without any suspicion that such dualism could have been itself a projection of the basic experience of the male-female duality. I suggest that the philosophical legacy inherited from Sartre is on occasion an asset for Beauvoir’s innovative existential analysis of the feminine ‘condition,’ but on several occasions, it creates unnecessary obstacles for her project of a new comprehension of the feminine ‘situation,’ aimed at rescuing women from an 'inauthentic' self-definition. -/- 5. The first among these poisoned gifts is Sartre’s idea of the individual as pure freedom and project. Merleau-Ponty’s criticism is well-known: Sartre draws a picture of the world as containing no more than ‘human beings and things,’ thus denying any substance to social relations, institutions, and culture. -/- 6. The second is Sartre’s reconstruction of dialectics, understood as dialectics without synthesis. This is an enlightening tool when used to describe conflicts, in so far as it accounts for the emergence of the ‘other’ as what is excluded. But it becomes a boomerang when used to interpret any kind of relationship, leading to equate inter-subjectivity with conflict. -/- 7. Suggestions coming from Merleau-Ponty’s phenomenological approach of positive value of the bodily dimension as such, and hence of the feminine body, are evoked here and there but never fully spelled out. The most shocking consequence of acceptance of the Cartesian or Sartrean dualist view is an almost total de-evaluation of sexuality, understood as an activity involving just one tiny part of the human body, going with the idea that overcoming the oppression of women implies de-empathizing biological differences that are after all tiny and devoid of value. Besides, Beauvoir falls back into the trap of grounding claims of equality between men and women on the assumption that biological differences are of limited relevance. A discussion of the economic work of Genovesi, the first professor of political economy in Europe. Genovesi supports a physiocratic theory of value as the net produce of agricultural work; a theory of interest as the motive of human action, intermediate between the extreme poles of excessive self-love and benevolence; a doctrine of innate rights as a limit to the sovereign's action; a commercial policy that limits dependence on foreign countries. He also took a position in the eighteenth-century debate on (...) "luxury", taking a firm stance in favour of moderate luxury, considered not vice but virtue as the right means between excessive parsimony and prodigality. He also discusses the function of the classes not dedicated to "mechanical arts" and not producing "rents" but nevertheless useful to society (Adam Smith's "unproductive" workers) in which he includes the proprietary classes which he defends against Rousseau's radical criticism, limiting himself to advocating the abolition of inalienable properties. I clarify that Sidgwick was not a moral relativist; on the contrary he was heavily conditioned by ethnocentric prejudice: I add that Sidgwick did not believe a reform of common-sense morality to be viable; on the contrary he concluded that it was impossible and, besides, that there were important utilitarian reasons against the viability of any reform strategy.

I reconstruct a plot in the twentieth-century Anglo-Saxon ethical discussion. I discuss first the reasons why in the first half of the twentieth century the claim of a neutral character of metaethics vis-a-vis normative ethics was generally accepted; then I discuss the reasons for a U-turn that took place in 1958, which brought back to the forefront two traditional schools of normative ethics, Kantian and Utilitarian, and the reasons for criticism from the new school of virtue ethics. The novelty in Smith’s way of looking at the economy is the discovery of a social character of wealth, something new in comparison with its definition in physical terms by the Physiocrats. The possibility of carrying out such an idealization was a result of the adoption of a Newtonian, as opposed to a Cartesian, epistemology, where an intermediate and provisional character of theoretical entities is explicitly accepted, dropping Cartesian strong epistemological realism.

I try to reconstruct the hidden agenda of nineteenth-century British controversy between Utilitarianism and Intuitionism, going beyond the image, successfully created by the two Mills, of a battle between Prejudice and Reason. When examined in depth, competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. Controversies, the propelling devices of research programs, (...) are real-words affairs, and philosophers do not engage in them just for the sake of the argument, but in order to win, and alignments are defined on the basis of strategic and tactical requirements that cross the boundaries of disciplines. I suggest that good objections and counter-objections, and most of all amendments of doctrines, were incidentally produced in the course of the fight, and they were no less valuable because of their being more side-effects than sought-for discoveries. I argue that the idea of virtue has become central after the Fifties in both Anglo-Saxon and German moral philosophy and that this revival has come together with recognition of the legitimacy of discussion of issues in normative ethics, something that philosophers both on the Continent and in the Anglo-Saxon world used to overlook in the first half of the twentieth-century. I point at examples such as Stuart Hampshire and Elizabeth Anscombe as proof of the centrality of virtue ethics in (...) the first phase of the normative turn. I also argue that, far from being a radical alternative to ‘modern moral philosophy’ as its proponents believe, virtue ethics is precisely moral argument of the kind both Kantian ethics at its best and less dogmatic versions of utilitarianism have brought to the fore of philosophical discussion. A short presentation of Rawl's theory of justice and its revision in 'Political Liberalism' with an overview of criticism by Ronald Dworkin, Robert Nozick, Alan Buchanan, Amartya Sen and John Harsanyi.

I discuss how criticism of social sciences taken up in Sartre's ‘Critique of Dialectical Reason’ is conditioned by Sartre’s own assumptions concerning nature, the mind-matter relationship, human beings’ bodily dimension. Although he looked at Husserl’s ‘Crisis of the European Sciences’ as a model for his own criticism of the social sciences, he didn't consider the criticism of the concept of nature undertaken by Husserl himself. Such criticism eventually leads to overcome Cartesian dualism. Sartre, on the contrary, superposes phenomenological ways of (...) thinking to an unavowed Cartesian ontology which he never challenged. The consequence is that he looks at the subject and the object, or mind and matter, as radically opposite. Sartre's own vindication of methodological dualism between natural and social sciences – closely following Lukacs – is flawed by heavily relying on an uncritically presupposed ontological dualism. The article sets out to reconstruct the ongoing re-discussion of role of morality in the economic subsystem. Traditional dichotomies between selfishness and benevolence, individual and collective interest, equality and efficiency have been shown to need more cautious reformulation. The claim is that, rather than taking sides for or against the reasons of ‘man’ or ‘solidarity’ against alleged reasons of the economy or the market, what is required is better understanding of the ways economies and markets work.

One of the points of interest of A Theory of Justice was that it tied so tightly together efficiency and equity; however, this link was entrusted to the "principle of difference" and the related maximin rule, the very point that is dropped in this book. Now society as a cooperative enterprise becomes part of the shared concept of the just society and it is no longer the reason for its justification; on this basis, however, Rawls lucidly asks the question about (...) the justification for solidarity with those suffering from such severe handicaps to prevent then from making a contribution to this cooperative enterprise. His answer is that for the problems to which justice such as equity does not give an answer there are several possibilities: one is that the idea of political justice cannot cover everything and that we should not expect it to; or the problem may be a problem of political justice, but justice as fairness does not would be the correct conception in this case, though it may be in other cases.
