This book analyses the impact computerization has had on contemporary science and explains the origins, technical nature and epistemological consequences of the current decisive interplay between technology and science: an intertwining of formalism, computation, data acquisition, data and visualization and how these factors have led to the spread of simulation models since the 1950s. -/- Using historical, comparative and interpretative case studies from a range of disciplines, with a particular emphasis on the case of plant studies, the author shows how (...) and why computers, data treatment devices and programming languages have occasioned a gradual but irresistible and massive shift from mathematical models to computer simulations. -/- . Since the 1990’s, social sciences are living their computational turn. This paper aims to clarify the epistemological meaning of this turn. To do this, we have to discriminate between different epistemic functions of computation among the diverse uses of computers for modeling and simulating in the social sciences. Because of the introduction of a new – and often more user-friendly – way of formalizing and computing, the question of realism of formalisms and of proof value of computational treatments reemerges. Facing (...) the spreading of computational simulations in all disciplines, some enthusiastic observers are claiming that we are entering a new era of unity for social sciences. Finally, the article shows that the conceptual and epistemological distinctions presented in the first sections lead to a more mitigated position: the transdisciplinary computational turn is a great one, but it is of a methodological nature. The credibility of digital computer simulations has always been a problem. Today, through the debate on verification and validation, it has become a key issue. I will review the existing theses on that question. I will show that, due to the role of epistemological beliefs in science, no general agreement can be found on this matter. Hence, the complexity of the construction of sciences must be acknowledged. I illustrate these claims with a recent historical example. Finally I temperate this diversity (...) by insisting on recent trends in environmental sciences and in industrial sciences. (shrink)

Par un procédé d'objections/réponses, nous passons d'abord en revue certains des arguments en faveur ou en défaveur du caractère empirique de la simulation informatique. A l'issue de ce chemin clarificateur, nous proposons des arguments en faveur du caractère concret des objets simulés en science, ce qui légitime le fait que l'on parle à leur sujet d'une expérience, plus spécifiquement d'une expérience concrète du second genre.

This paper proposes an extensionalist analysis of computer simulations (CSs). It puts the emphasis not on languages nor on models, but on symbols, on their extensions, and on their various ways of referring. It shows that chains of reference of symbols in CSs are multiple and of different kinds. As they are distinct and diverse, these chains enable different kinds of remoteness of reference and different kinds of validation for CSs. Although some methodological papers have already underlined the role of (...) these various relationships of reference in CSs and of cross-validations, this diversity is still overlooked in the epistemological literature on CSs. As a consequence, a particular outcome of this analytical view is an ability to classify existing epistemological theses on CSs according to what their authors choose to select and put at the forefront: either the extensions of symbols, or the symbol-types, or the symbol-tokens, or the internal denotational hierarchies of the CS or the reference of these hierarchies to external denotational hierarchies. Through the adoption of this extensionalist view, it also becomes possible to explain more precisely the reasons why some complete reduction of CSs to classical epistemic paradigms such as “experiment” or “theoretical argument” remains doubtful. On this last point, in particular, this paper is in agreement with what many epistemologists already have acknowledged. (shrink)

Currently, the widely used notion of activity is increasingly present in computer science. However, because this notion is used in specific contexts, it becomes vague. Here, the notion of activity is scrutinized in various contexts and, accordingly, put in perspective. It is discussed through four scientific disciplines: computer science, biology, economics, and epistemology. The definition of activity usually used in simulation is extended to new qualitative and quantitative definitions. In computer science, biology and economics disciplines, the new simulation activity definition (...) is first applied critically. Then, activity is discussed generally. In epistemology, activity is discussed, in a prospective way, as a possible framework in models of human beliefs and knowledge. (shrink)

Large sets of elements interacting locally and producing specific architectures reliably form a category that transcends the usual dividing line between biological and engineered systems. We propose to call them morphogenetically architected complex systems (MACS). While taking the emergence of properties seriously, the notion of MACS enables at the same time the design (or “meta-design”) of operational means that allow controlling and even, paradoxically, programming this emergence. To demonstrate our claim, we first show that among all the self-organized systems studied (...) in the field of Artificial Life, the specificity of MACS essentially lies in the close relation between their emergent properties and functional properties. Second, we argue that to be a MACS a system does not need to display more than weak emergent properties. Third, since the notion of weak emergence is based on the possibility of simulation, whether computational or mechanistic via machines, we see MACS as good candidates to help design artificial self-architected systems (such as robotic swarms) but also harness and redesign living ones (such as synthetic bacterial films). In the context of pluralization, sophistication, and combination of formal models, it is becoming difficult to propose uniform – or even comparable – model comparison practices. This paper outlines a broad and classificatory comparative epistemology of models. The aim of this epistemology is to propose applicable, and if necessary rectifiable, conceptual tools that can be useful to modellers as well as to historians and epistemologists. The notion of model characteristic vector – incorporating concepts of function, nature, principle and use of (...) the model – is introduced for this end. This proposal has been developed to serve a better-equipped writing of a comparative and interdisciplinary history of models and simulations. (shrink)

Now that complex Agent-Based Models and computer simulations spread over economics and social sciences - as in most sciences of complex systems -, epistemological puzzles (re)emerge. We introduce new epistemological tools so as to show to what precise extent each author is right when he focuses on some empirical, instrumental or conceptual significance of his model or simulation. By distinguishing between models and simulations, between types of models, between types of computer simulations and between types of empiricity, section 2 gives (...) conceptual tools to explain the rationale of the diverse epistemological positions presented in section 1. Finally, we claim that a careful attention to the real multiplicity of denotational powers of symbols at stake and then to the implicit routes of references operated by models and computer simulations is necessary to determine, in each case, the proper epistemic status and credibility of a given model and/or simulation. The aim of this paper is to describe and analyze the epistemological justification of a proposal initially made by the biomathematician Robert Rosen in 1958. In this theoretical proposal, Rosen suggests using the mathematical concept of “category” and the correlative concept of “natural equivalence” in mathematical modeling applied to living beings. Our questions are the following: According to Rosen, to what extent does the mathematical notion of category give access to more “natural” formalisms in the modeling of living beings? Is (...) the so -called “naturalness” of some kinds of equivalences (which the mathematical notion of category makes it possible to generalize and to put at the forefront) analogous to the naturalness of living systems? Rosen appears to answer “yes” and to ground this transfer of the concept of “natural equivalence” in biology on such an analogy. But this hypothesis, although fertile, remains debatable. Finally, this paper makes a brief account of the later evolution of Rosen’s arguments about this topic. In particular, it sheds light on the new role played by the notion of “category” in his more recent objections to the computational models that have pervaded almost every domain of biology since the 1990s. Architecture often relies on mathematical models, if only to anticipate the physical behavior of structures. Accordingly, mathematical modeling serves to find an optimal form given certain constraints, constraints themselves translated into a language which must be homogeneous to that of the model in order for resolution to be possible. Traditional modeling tied to design and architecture thus appears linked to a topdown vision of creation, of the modernist, voluntarist and uniformly normative type, because usually (mono)functionalist. One available instrument of calculation/representation/prescription (...) orders this conception of architecture: indeed the search for an optimal solution through mathematical calculation of a model itself mathematical, thus homogeneous and simple, is only possible when one or two functions or functional constraints are formulated, never more, and this, on a global level, therefore starting from a unique and homogenizing viewpoint. It is essential to grasp that, even applied to material and its properties or towards a particular esthetic or functional dimension, this viewpoint is thus abstractive and generalizing: disregarding singularity of context, insertion and relationship to the environment or local, social behavior. It leaves aside functional specificity and heterogeneousness – re-contextualized each time – of functions that the object or edifice are required to fulfill and optimize under diverse constraints, in their different parts. The computational turning point today’s digital design and computational architecture embody modifies these instrumental, original prescriptions, rendering them more flexible. Perhaps in light of this turnabout we should retrospectively interpret 20th century calls for modernism, functionalism and even biomorphism as being just as many ex post rationalizations in respect to techniques of strongly prescriptive modeling since our only instrument is a monolithic language, and so being, incites a top-down conception, (naturally weakly reactive to contexts), including forms whose overall appearance resembles in fine a living form. In order to liberate oneself from this and despite everything, emerge as its initiators, one has constructed from ideology and philosophy (of object, habitat, the urban) ex post, even while it is the instrument of modeling and conception that largely determines, normalizes and dictates ex ante, the possibilities and limitations of the creation of forms and living experiments4 in a given time. This chapter elaborates and develops the thesis originally put forward by Mary Morgan (2005) that some mathematical models may surprise us, but that none of them can completely confound us, i.e. let us unable to produce an ex post theoretical understanding of the outcome of the model calculations. This chapter intends to object and demonstrate that what is certainly true of classical mathematical models is however not true of pluri-formalized simulations with multiple axiomatic bases. This chapter thus proposes to show (...) that - and why - some of these computational simulations that are now booming in the sciences not only surprise us but also confound us. To do so, it shows too that it is needed to elaborate and articulate with some new precision the concept of weak emergence initially due, for its part, to Mark A. Bedau (1997). (shrink)

The aim of this paper is to discuss the “Framework for M&S with Agents” (FMSA) proposed by Zeigler et al. [2000, 2009] in regard to the diverse epistemological aims of agent simulations in social sciences. We first show that there surely are great similitudes, hence that the aim to emulate a universal “automated modeler agent” opens new ways of interactions between these two domains of M&S with agents. E.g., it can be shown that the multi-level conception at the core of (...) the FMSA is similar in both contexts: notions of “levels of system specifi cation”, “behavior of models”, “simulator”and “endomorphic agents” can be partially translated in the terms linked to the “denotational hierarchy” (DH) recently introduced in a multi-level centered epistemology of M&S. Second, we suggest considering the question of “credibility” of agent M&S in social sciences when we do not try to emulate but only to simulate target systems. Whereas a stringent and standardized treatment of the heterogeneous internal relations (in the DH) between systems of formalisms is the key problem and the essential challenge in the scope of Agent M&S driven engineering, it is urgent too to address the problem of the external relations (and of the external validity, hence of the epistemic power and credibility) of such levels of formalisms in the specific domains of agent M&S in social sciences, especially when we intend to introduce the concepts of activity tracking. Centré sur la Covid-19 et sur sa diffusion, il s’installe au cœur de questions brûlantes, encore urgentes pour tout un chacun, mais il garde aussi la tête froide, prend du recul, informe, enseigne et questionne, qui plus est de façon pédagogique. Davantage : au-delà du bilan critique, il propose des perspectives inédites, voire quelques suggestions solides. Il nous donne à réfléchir sur des chemins moins balisés. À le lire, on comprendra, par l’exemple, pourquoi (...) un modèle ne peut assurer simultanément toutes les fonctions de connaissance qu’on en peut attendre (décrire, prédire, expliquer, etc.). On comprendra pourquoi il faut souvent des modèles simples mais aussi, dans certains cas, des modèles nécessairement plus compliqués. On comprendra également pourquoi il faut cultiver une pluralité de modèles, toujours dans la collégialité, souvent dans l’interdisciplinarité : non seulement pour que ces modèles prennent en compte plusieurs aspects, mais aussi pour que leurs diverses fonctions puissent entrer en dialogue, et enfin pour qu’ils s’épaulent, convergent ou se rectifient, en particulier là où l’on attend d’eux qu’ils mettent au jour des propriétés structurelles robustes, les seules offrant en retour une prise à l’action et à la décision légitimes. On comprendra enfin que la disponibilité de données à la fois pertinentes et stabilisées est un point d’achoppement majeur, dans les circonstances, tant il est discutable de paramétrer un modèle de diffusion de la Covid-19 avec les paramètres de la grippe simplement parce qu’ils sont mieux connus. Le déficit d’explicabilité des techniques d’apprentissage machine (AM) pose des problèmes opérationnels, juridiques et éthiques. Un des principaux objectifs de notre projet est de fournir des explications éthiques des sorties générées par une application fondée sur de l’AM, considérée comme une boîte noire. La première étape de ce projet, présentée dans cet article, consiste à montrer que la validation de ces boîtes noires diffère épistémologiquement de celle mise en place dans le cadre d’une modélisation mathématique et causale d’un phénomène physique. (...) La différence majeure est qu’une méthode d’AM ne prétend pas représenter une causalité entre les paramètres d’entrées, qui peuvent être de plus de haute dimensionnalité, et ceux de sortie. Nous montrons dans cet article l’intérêt de mettre en œuvre les distinctions épistémologiques entre les différentes fonctions épistémiques d’un modèle, d’une part, et entre la fonction épistémique et l’usage d’un modèle, d’autre part. Enfin, la dernière partie de cet article présente nos travaux en cours sur l’évaluation d’une explication, qui peut être plus persuasive qu’informative, ce qui peut ainsi causer des problèmes d’ordre éthique. Cet article ne se veut pas un commentaire suivi de la réflexion de Wittgenstein sur les règles. Ce ne sera pas non plus un commentaire de l’interprétation que Kripke fait du « suivi de la règle » chez Wittgenstein. Il ne sera pas davantage une application des thèses de Wittgenstein ni une tentative d’application directe d’une interprétation de ces thèses à l’épistémologie de la simulation du vivant ; ce qui serait, en soi, d’ailleurs contestable. Ce travail vise seulement à approfondir (...) la réflexion sur le statut cognitif de la simulation informatique du vivant. À ce titre, qui est donc essentiellement épistémologique et ciblé, il se veut une suggestion d’interprétation conceptuelle de certaines formes de simulation informatique du vivant, suggestion elle-même adossée à une prolongation de certaines distinctions déjà effectuées par Wittgenstein et ses commentateurs au sujet des règles et de leur suivi. L’objectif est de chercher à voir si, par ce moyen, la simulation informatique du vivant, par contraste avec les pratiques plus traditionnelles de modélisation, ne pourrait pas être plus précisément expliquée et légitimée, dans ses apports épistémologiques, comme dans ses limites aussi. Dans un nombre croissant de domaines scientifiques - sciences de la nature, sciences humaines aussi bien que sciences des artefacts -, la simulation ne joue plus le rôle de succédané temporaire d'une théorie encore en gésine parce que non encore élaborée ; c'est-à-dire qu'elle ne joue plus systématiquement le rôle d'un modèle provisoire ou d'un schéma servant à condenser les mesures. C'est qu'elle n'a pas la nature d'un signe graphique, linguistique ou mathématique. Elle joue au contraire de plus en plus (...) le rôle d'une réplication détaillée du réel : elle est une intuition reconstruite avec justesse mais sans abstraction rationnelle et généralisante, donc sans transfiguration iconique. Une des limites de l'épistémologie dialectique de Bachelard tient à ce qu'elle ne donne pas les concepts pour penser assez distinctement ces pratiques contemporaines de simulation. C'est pourquoi l'A. propose de concevoir l'idée que la science contemporaine se développe non plus selon la seule dialectique matérialisme / rationalisme, mais selon la triade rationalisme/computationalisme/matérialisme. Cognitive sciences as an interdisciplinary field, involving scientific disciplines (such as computer science, linguistics, psychology, neuroscience, economics, etc.), philosophical disciplines (philosophy of language, philosophy of mind, analytic philosophy, etc.) and engineering (notably knowledge engineering), have a vast theoretical and practical content, some even conflicting. In this interdisciplinary context and on computational modeling, ontologies play a crucial role in communication between disciplines and also in a process of innovation of theories, models and experiments in cognitive sciences. We propose a model for (...) this process here. An ontological commitment is advocated as the framework of a scientific realism, which leads computational modeling to search for more realistic models, for a complex systems perspective of nature and cognition. In that way multiagent modeling of complex systems has been fulfilling an important role. (shrink)

In the Western tradition, at least since the 14th century, the philosophy of knowledge has been built around the idea of knowledge as a representation [BOU 99]. The question of the evaluation of knowledge refers at the same time (1) to the object represented (which one does one represent?), (2) to the process of knowledge formation, in particular with the role of the knowing subject (which one does one represent and how does one represent it?), and finally (3) to the (...) relationship between the representation and the represented object. Criteria of evaluation such as “validity”, “adequacy” or “truth”, as mentioned in [AMB 07], make sense only with respect to these three dimensions. An evaluation can thus (1) depend on the ontological nature of the object of knowledge, (2) relate to the relationship between subject and object—including the structures (cognitive, social) which organize this relationship, or (3) relate to the relation of similarity between the object and its representation as well. The relevant criteria of evaluation thus depend on the points of view adopted on these questions. As there are indeed a plurality of points of view in this field, the goal of this appendix is to summarize, as briefly as possible, the various positions adopted by the philosophers and to refer to the relevant texts of reference for more information (for a first outline [CHA 76, SCH 01]). The first section 1 introduces useful discussions about the philosophy of theoretical knowledge and general epistemology, from a quasi-historical perspective. Section two 2 discusses the intermediary but central notion of models. Section three 3, more exploratory, introduces an approach to simulation as “concrete experiment”. It suggests that such a frequent claim in the literature, when precisely evaluated, can, to some extent, renew both the representational and the linguistic views on simulation. (shrink)

In this paper we propose a new semantics, based on the notion of a "contextual model", that makes it possible to express and compare — within a unique formal framework — different views on the roles of various notions of context in knowledge ascriptions. We use it to provide a logical analysis of such positions as skeptical and moderate invariantism, contextualism, and subject-sensitive invariantism. A dynamic formalism is also proposed that offers new insights into a classical skeptical puzzle.

The essays collected in this volume are all concerned with the connection between fiction and truth. This question is of utmost importance to metaphysics, philosophy of language, philosophical logic and epistemology, raising in each of these areas and at their intersections a large number of issues related to creation, existence, reference, identity, modality, belief, assertion, imagination, pretense, etc. All these topics and many more are addressed in this collection, which brings together original essays written from various points of view by (...) philosophers of diverse trends. It is usually agreed that the Revelation Thesis about experience – the idea that the knowledge we gain by having an experience somehow “reveals” the essence, or nature, of this experience – only requires that we know the essence of the experience, not that we know, of this essence, that it is the essence of the experience. I contest this agreement. In the light of what I call the “Essentiality of Essence Principle”– the principle that whatever is in the essence (...) of something is also essentially so – I argue that the Revelation Thesis does require that we know, of the essence of an experience, that it is the essence of the experience, and draw some conclusions about the plausibility of that thesis. I defend the assumption that an expression like “for Anna,” as it occurs in a sentence like “Whale meat is tasty for Anna,” is a sentential operator, against two related, albeit opposite worries. The first is that in some cases the putative operator might not be selective enough. The second is that in other cases it might on the contrary be too selective. I argue that these worries have no tendency to cast doubt on the assumption of sententiality for the (...) relevant expressions. (shrink)

According to David Lewis’s contextualist analysis of knowledge, there can be contexts in which a subject counts as knowing a proposition just because every possibility that this proposition might be false is irrelevant in those contexts. In this paper I argue that, in some cases at least, Lewis’ analysis results in granting people non-evidentially based knowledge of ordinary contingent truths which, intuitively, cannot be known but on the basis of appropriate evidence.

In a series of recent papers Stephen Kearns and Daniel Star argue that normative reasons to ϕ simply are evidence that one ought to ϕ, and suggest that “evidence” in this context is best understood in standard Bayesian terms. I contest this suggestion.

In this paper we argue that standard, indexical contextualism about "knows" is unable to account for the factivity of this epistemic expression.

What could be more inert than mathematical objects? Nothing distinguishes them from rocks and yet, if we examine them in their historical perspective, they don't actually seem to be as lifeless as they do at first. Conceived as they are by humans, they offer a glimpse of the breath that brings them to life. Caught in the web of a language, they cannot extricate themselves from the form that the tensive forces constraining them have given them. While they do not (...) serve a specific biological purpose, they are still, above all, possibilities of life, objects imbued with power. Though they know neither pain nor laughter, their mode or style of existence endows them with a special form of life that structures the givenness, the matter of the other entities in which they participate. Because of this, by intervening in the framework of these entities, mathematical objects condition their form of space, enjoining the entities to submit to a structure that they have not chosen. Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

Intellectual historians have rarely attended to the genre of fighting manuals, but these provide a new window on long-debated questions such as the relationship between Scholasticism and Humanism. This article offers a close comparison of the first known fencing manual, the 14-th century Liber de Arte Dimicatoria (Leeds, Royal Armouries FECHT 1, previously and better known as MS I.33), and the corpus of fighting manuals which underwent a remarkable expansion during the 15th and 16th centuries. While the former clearly shows (...) its origins in a scholastic background, the latter is mainly viewed as reflecting its humanist context. To this historiographical division corresponds a linguistic one: MS I.33 is a Latin text, while the rest of the corpus is mainly written in German and Italian. However, exceptions arise, amongst which, Heinrich von Gunterrodt’s Sciomachia et Hoplomachia: sive de Veris Principiis Artis Dimicatoriae (1579), the first text which explicitly refers to I.33. This article will compare these two texts, in order to interrogate their common relation to Scholasticism, namely the traditional frame of the knowledge within the medieval and early modern universities. The intent is to show that (at least some) Renaissance fight books include references to Scholasticism and to provide a better qualification of the nature of such references. The general hypothesis is that a large part of the texts―and products of culture―of the Renaissance that have been read, until recently, exclusively in relation to a humanist intellectual background can valuably be interpreted in the context of a Scholasticism that is still vivid during the period in question. In this scenario, the intimacy of hundreds of children is exposed by their parents or guardians in exchange for audience, fame and fnancial gain. Based on this problem, this article investigates the impacts of child labor through the exploitation of the image and intimacy of the child on digital platforms. Destaca-se a importância da vítima no processo de perfilamento de criminosos, pois é com base na averiguação dos traços físicos e psicológicos deixados na pessoa que sofreu o delito que é possível traçar o perfil criminal do ofensor. Constata-se a estagnação do ensino do criminal profiling no Brasil.

Os autores estudam um caso de linchamento ocorrido na cidade de Guarujá. Formulam sua hipótese a partir da teoria mimética de René Girard, demonstrando, no caso concreto, a presença de sinais vitimários que tornam um indivíduo suscetível a ser tomado como bode expiatório de uma comunidade em crise. Problematizam sobre a questão da mentalidade persecutória, justiça comunitária e sistema judiciário.

RESUMO Versa o presente artigo sobre a regulação do linchamento no Direito Romano do período antigo, em especial sobre o artigo 9º da Tábua III das Leis das XII Tábuas. A partir de uma metodologia de análise qualitativa, revisão bibliográfica e interpretação textual, os autores objetivam ampliar a visão tradicional sobre o linchamento, compreendendo a institucionalização de sua prática no Direito Romano e sua função no contexto de formação da cultura jurídica do período antigo. A hipótese de trabalho é a (...) de que o artigo 9º da Tábua III das Leis das XII Tábuas apresenta, historicamente, uma forma de punição intermediária entre a linchamento popular extralegal e a pena criminal prevista em lei. Do ponto de vista jurídico-antropológico, a comprovação da hipótese permitiria concluir a ideia de que a pena praticada na antiguidade é uma evolução do controle social informal da violência. ABSTRACT The following paper is about the lynching regulation in Roman law in Ancient Era, especially in what comes about the article 9 of Table Three from Twelve Tables. Making use of a methodology based in qualitative analisys, literature review and interpretation, the auctor aim to expande the traditional view about lynching, understanding the institutionalization of their practice in Roman Law and it’s function in the legal culture in Ancient Era. The working hipothesis is that the article 9 of Table Three of Twelve Tables presents, in a historical context, a intermediate form of punishment between extralegal collective lynching and criminal penalty provided by law. From a legal-anthropological point of view, the proof of the hypothesis would allow us to conclude the idea that the penalty practiced in antiquity is an evolution of informal social control of violence. A tragédia de Orestes, escrita pelo tragediógrafo grego Ésquilo, influenciou decisivamente o pensamento ético-político de Hegel. Em seu ensaio sobre o Direito Natural (1802-1803), o filósofo alemão associa seu conceito de absoluto com sua interpretação da tragédia grega, ato com o qual expõe sua concepção da vida ética absoluta, dando continuidade à ideia que havia esboçado, no âmbito teológico, em "O Espírito do cristianismo e seu destino", i.e., a de que o destino e a justiça trágica forneceriam os termos de (...) uma alternativa aos conceitos jurídicos kantianos e cristãos de justiça. Mas, em "Sobre as maneiras de tratar cientificamente o direito natural", Hegel vai além. Ele demonstra que o gênero trágico apresenta uma concepção de ética e política que pode ser uma alternativa às concepções modernas do direito natural, o que permite a Hegel opor a representação trágica da unidade da vida ética absoluta ao dualismo e às dicotomias que estruturam as teorias políticas de seu tempo. Essa intuição da tragédia propiciou ao filósofo compreender a vida ética absoluta como o verdadeiro fundamento da ética e da política. Enquanto tal, ela pressupõe, necessariamente, todas as teorias do Direito Natural. Hegel denomina essa representação da unidade da vida ético-política como "a representação da tragédia da vida ética". A obra emblemática e talvez até mesmo inspiradora dessa compreensão do direito natural é "Eumênides", de Ésquilo, peça que encerra a trilogia "Oresteia". A partir dela, Hegel desenvolve, no capítulo intitulado “a ciência especulativa e o direito natural”, sua concepção trágica da vida ética absoluta. É que a tragédia de Orestes expõe o problema político que Hegel quer resolver: as relações entre o universal e o particular, o todo e as partes, o Estado e o indivíduo, etc. Além de explicitar o problema político, a obra de Ésquilo também expõe a solução do que Hegel considera ser o conflito absoluto, i.e., o jogo das oposições (universal/particular, todo/partes, Estado/indivíduos) que consiste na essência da vida ética e política. Tal solução se dá, na peça, com o julgamento do herói, Orestes, e a consequente pacificação das Erínias, transformadas em Eumênides. Esse movimento é a culminação da trilogia "Oresteia" e ilustra o tipo de reconciliação que Hegel procurava produzir com sua Filosofia do Direito: a (re)organização da totalidade ética. (shrink)

Em sua Filosofia do Direito, Hegel, ao tratar da instituição da família e de seu papel na educação dos filhos, intuiu um traço característico da subjetividade infantil: no coração das crianças haveria um desejo de pertencer ao mundo dos adultos. Trata-se de um desejo que poderíamos qualificar de mimético, no sentido da teoria de René Girard, já que as crianças adotam os pais como seus primeiros modelos. Na teoria hegeliana, esse elemento mimético adquire, junto à educação infantil, uma importante função (...) na formação da personalidade moral. A educação é uma exigência da própria criança, que possui de maneira inata o sentimento de não estar satisfeita em ser aquilo que é e o desejo de pertencer ao mundo adulto. Hegel, por isso, é um crítico da pedagogia que estagna as crianças na subjetividade infantil. Representando-as como perfeitas no estado de imperfeição em que se encontram, essa pedagogia perturba a espontânea carência do estado infantil, traço que impele naturalmente a criança ao autodesenvolvimento. O erro desse tipo de abordagem pedagógica está em não conceber o papel da mediação na formação da personalidade moral. Se o adulto, enquanto modelo, valoriza a criança em seu estado de infantilidade, é natural que ela adote essa mesma estima sobre si mesma, seguindo a opinião exterior. Logo, a valoração subjetiva, que deveria centrar-se no modelo ético, volta-se, pela mediação do modelo adulto, ao próprio Eu vazio da criança, que cresce concebendo- se como realidade autônoma, independente dos demais, gerando nela o desinteresse pelas relações substanciais do “mundo do espírito”. O narcisismo infantil seria, pois, uma decorrência da perda de referência ao modelo ético da vida adulta. Desse vazio “ontológico” da criança surge a necessidade de sua formação por meio do processo pedagógico. Os pais, que constituem o modelo imediato das crianças, não só devem estimular nelas a adoção do comportamento ético, como também punir as suas transgressões morais. A finalidade da punição não é a justiça enquanto tal. Trata-se, antes, de uma intimidação subjetiva e moral exercida contra a liberdade ainda encerrada na natureza, tendo como escopo elevar, na consciência e na vontade, a esfera da universalidade e da razão. Portanto, na educação dos filhos, o ético e o mimético são indissociáveis. Lendo Hegel a partir de René Girard, poder-se-ia usar o termo “mimeticidade” para designar essa unidade entre a imitação natural (subjetividade) e a promoção pedagógica e cultural de modelos comportamentais voltados ao Bem (moral objetiva). Pela adoção de modelos éticos, a criança tem a oportunidade de vivenciar a “eticidade” ainda sem oposição, como seu sentimento mais imediato, mais íntimo e “próprio”, vindo a adquirir, na vida adulta, a autonomia moral concreta de uma personalidade livre e racional, exercida em coerência com as demais. No capítulo 1, “Do escudo de Aquiles à capa do Batman: o heroísmo togado e seus riscos à democracia”, discutimos a ascensão do protagonismo político no Poder Judiciário a partir da categoria antropológica do herói, expondo a delicada relação entre heroísmo e instituições democráticas. Para isso, traçamos um breve histórico do heroísmo e suas características, apresentando, posteriormente, uma analogia entre elas e a atuação do Ministro Joaquim Barbosa no curso da Ação Penal nº 470 do STF (Caso Mensalão). Tecemos também (...) alguns apontamentos sobre o Estado Democrático de Direito, a função do Poder Judiciário e os riscos que a propagação de escândalos públicos e a flexibilização de regras e princípios jurídicos podem trazer às instituições do Estado Democrático de Direito. O tema de fundo dessa análise é a relação simbiótica entre a violência e a produção mítica de heróis, segundo a teoria de Girard. No capítulo 2, “Satã: a violência na fundação da cultura”, analisamos a obra “Vejo Satã cair como um relâmpago”, de René Girard, apresentando sua teoria (mimética) e seu estudo antropológico da Bíblia e dos Evangelhos. O intuito é demonstrar a possibilidade de interpretar racionalmente dados antes percebidos como sobrenaturais, explorando, com Girard, as contribuições da revelação judaico-cristãs para a relação entre o homem, a violência e a organização político-religiosa do mundo antigo. O principal tema exposto na resenha é o da violência fundadora, base da cultura e da sociedade, que Girard identifica na figura bíblica de Satã. Mais do que mero símbolo religioso, Satã é a representação de um mecanismo de pacificação deflagrado em situações de crise social. Seu modus operandi consiste na reunião da sociedade contra um inimigo comum, um bode expiatório contra o qual levantam-se falsas acusações que sustentam sua perseguição e assassinato. Consideramos esse tema fundamental para a moderna e contemporânea compreensão dos processos de perseguição e vitimização político-social. A revelação cristã é a entrada em cena, no campo histórico, de um pensamento que se coloca francamente ao lado da vítima acusada pela comunidade. As ideologias penais da proteção do débil, os direitos individuais e os direitos humanos são efeitos políticos e jurídico do triunfo da cruz sobre a cultura satânica do assassínio de bodes expiatórios. No capítulo 3, “A violência no Direito: confissão e produção de bodes expiatórios”, aplicamos a teoria mimética para compreender o instituto jurídico da confissão do ponto de vista antropológico. Com base no Livro de Jó, investigamos a origem religiosa da extração forçada de confissões e demonstramos sua íntima relação com os rituais religiosos praticados na antiguidade, que usavam da assunção de culpa como um instrumento para legitimar a violência contra seus bodes expiatórios. Com isso, pretendemos apontar para a necessidade de mitigação do valor probatório da assunção de culpa no contexto de um Estado Democrático de Direito. Incorporada às intuições jurídicas, a confissão deve ser tomada como instrumento laico e totalmente desvinculado das práticas expiatórias que lhe deram origem. No capítulo 4, “Direito penal e preocupação pelas vítimas: a renovação dos princípios de ofensividade e proteção de bens jurídicos após a experiência do totalitarismo", analisamos o surgimento e desenvolvimento da ideia de crime como ofensa a bens jurídicos. Trata-se de um ensaio de história das ideias jurídicas em que traçamos a evolução histórica das ideias de ofensividade e proteção de bens jurídicos, desde sua gênese na experiência liberal e iluminista, passando por seu enfraquecimento durante o Direito Penal nacional-socialista, até culminar em seu ressurgimento e renovação nos dias atuais. O intuito desta análise é situar o princípio da ofensividade, enquanto garantia assegurada nas Constituições do Pós-guerra, no quadro histórico da moderna preocupação pelas vítimas, efeito cultural da religião cristã que discutimos no capítulo 2 (“Satã: a violência na fundação da cultura”). Por fim, no quinto e último capítulo, “O Direito após a revelação do mecanismo vitimário”, procuramos rematar a temática do Direito no quadro da antropologia de Girard, explorando o papel desempenhado pela revelação cristã do mecanismo expiatório na cultura ocidental, especialmente no que diz respeito à formação de uma ética de proteção das vítimas, eixo fundamental dos Direitos Humanos. Por isso, demonstramos como o Direito Penal, no ocidente, está dividido entre o sacrifício e o perdão. Resultado da lógica do cristianismo sacrificial, o moderno Direito constitui-se na forma híbrida de um Katéchon: ou seja, como racionalização do mecanismo vitimário, re-direcionado, por meio das instituições jurídicas e políticas, contra atos de perseguição de minorias e vulneráveis . Esta investigação tem por objetivo geral promover uma exposição do estado da arte do conceito de dolo eventual na dogmática penal, e, como objetivo específico, estabelecer bases metodológicas de como esse conceito pode ser construído, sistematizado e delimitado em relação à culpa consciente. A delimitação dos conceitos jurídico-penais é um importante instrumento para o estabelecimento de limites ao exercício do poder punitivo estatal. O conceito de dolo, na medida em que autoriza a aplicação de penas mais rigorosas em comparação à (...) culpa, demanda que a dogmática estabeleça claramente seus limites. Tarefa necessária não apenas para o conceito geral de dolo, mas também para o controverso “dolo eventual”, figura jurídica cuja conceituação e aplicação tem propiciado intensos debates na doutrina especializada, que, há pelo menos 200 anos, discute o problema de sua distinção com relação à outra figura não menos debatida, a da culpa (consciente). Devido à dificuldade de sua resolução, o pai do finalismo, Hans Welzel, considerou a distinção entre dolo eventual e culpa consciente uma das questões mais tormentosas do direito penal. Visando contribuir para o esclarecimento do tema, esta investigação apresenta dialeticamente os principais critérios e argumentos formulados na resolução desse intrincado problema jurídico, abrangendo, para este fim, tanto a discussão do período clássico da dogmática alemã (que legou vários conceitos até hoje debatidos e usados nesta matéria) quanto da moderna dogmática jurídico-penal, que tenta, a partir de novas abordagens, resolver a “tormentosa” questão. Sebastian Franck hat Teile von Agrippas De Vanitate Scientiarum übersetzt und kommentiert. Von daher ist der Einfluss der Philosophie von Agrippa auf Franck bekannt. Es gab allerdings bisher keine ausführlichen Untersuchungen zu den Einflüssen von Agrippa auf Franck. Diese Lücke versucht dieser Aufsatz zu schließen. Beim Vergleich der metaphysischen Systeme von Franck und Agrippa stellt sich heraus, dass es bedeutende Einflüsse im Bereich der Seelenlehre und der Christologie gab. Sowohl Agrippa als auch Franck sind Anhänger (...) der platonischen Lehre der drei Seelenteile. Die Seele besteht nach dieser Lehre aus Geist, Seele und Körper. Der Geist ist der unsterbliche göttliche Teil im Menschen. Der Hauptunterschied zwischen Agrippa und Franck kann darin gesehen werden, dass Agrippas Synkretismus stärker den Neuplatonismus betont und Franck`s Synkretismus die Gnosis. Die Weltseele ergibt im Konzept von Franck nur wenig Sinn, während diese bei Agrippa ganz zentral ist. Franck lehnt den Gedanken ab, die Welt werde durch eine Vernunft geleitet. Sein pessimistisches Bild von der Welt und vom Menschen verträgt sich nicht mit diesem Gedanken. Da es keine Vernunft gibt, ist auch die Astrologie, die Mantik oder die Kabbalistik nicht wichtig für Franck. Daher ist es nicht verwunderlich, dass Franck nirgends die Occulta philosophia zitiert, sondern immer nur De Vantitate Scientiarum Der Synkretismus von Agrippa beinhaltet Astrologie, Mantik, Kabbala und Neuplatonismus. Am ehesten spielt bei Franck noch die Hermetik eine Rolle. Franck meint, Christus habe im Pimander mit Hermes Trismegistos kommuniziert. Diesen Gedanken findet man nicht nur bei Franck, sondern auch bei Agrippa. Die für Franck so wichtige Lehre des inneren Christus ist ebenfalls Teil der Seelenlehre von Agrippa. Wenn der Mensch seinen Geist oder seinen inneren Christus erkennt, dann erkennt er Gott. Die Untersuchung zeigt, dass Franck nur diejenigen Dinge von dem „weisen Agrippa“ übernommen hat, die in sein Konzept passen. (shrink)

Research on Sebastian Franck (1499 – 1543) has so far mainly focused on the topics “Sebastian Franck as a historian” or “Sebastian Franck as a critic of theology,” while Gnosticism in the philosophy of the radical reformer has received less attention. Since the beginning of the new millennium, the interest in a certain movement of Gnosticism, namely Hermeticism, has increased however. This paper examines the question of the parallels in content between Gnostic representatives such as the Carpocratians, (...) the Ebionites, and Sebastian Franck. Irenaeus of Lyon is used as a source for the Carpocratians and the Ebionites. Substantial similarities can be found in the fragmentary reports of Irenaeus on the Carpocratians and Ebionites and the teachings of Franck. The parallels between the Carpocratians and Franck can be identified in the concept of the Divine, the tripartite nature of the soul, and the doctrine of salvation. Unlike orthodox Christianity, both Franck and the Carpocratians believed in the self-salvation of people from their sins. Through the discovery of their spirit, all people can access the abilities that Yeshua had in his incarnation. The rejection of both the doctrine of original sin and the doctrine of grace is what Franck has in common with the Ebionites. However, the doctrine of grace would not make any sense for the Carpocratians either, as, according to their conviction, the soul is redeemed by the enlightenment of the spirit. (shrink)

Sebastian Franck commented and translated parts of Agrippa´s De Vanitate Scientiarum, confirming that Franck knew at least some of this philosopher’s work. However, there is no detailed research on the influence Agrippa had on Franck—a gap this paper tries to fill. In a paper of Keefer, the author advocates that Franck was much influenced by Agrippa. The major claim of this paper is that Agrippa’s influence on Franck should not be overestimated, primarily because Franck (...) deliberately did not cite from the Occulta philosophia. Only De Vanitate Scientiarum and one paragraph of Oratio habita papiae are shown to have had a direct influence on Franck. The influence on Franck`s philosophy has to be analyzed very carefully to avoid such fallacies. In a comparison of the metaphysical belief systems of both Franck and Agrippa, important parallels concerning the soul and Christology can be found. Notably, Agrippa and Franck were both believers in the Platonic doctrine of the tripartite soul. However, Franck did not cite this concept from Agrippa. A difference between Agrippa and Franck was that Agrippa had a cosmological perspective that was strongly influenced by Neoplatonism and Hermeticism. In contrast, the Neoplatonic concept of the world soul did not make sense in Franck’s philosophical system of beliefs because Franck denies the idea that the world is conducted by rationality. His pessimistic view of the world and the human being did not blend with this idea of the world soul. These differences demonstrate that Franck did not agree with many concepts found in the Occulta philosophia. The Corpus Hermeticum was also not as important for Franck as it was for Agrippa. Franck focused primarily on the Pimander and to a certain extent on the thirteenth book (rebirth), whereas for Agrippa many parts were relevant. Research on the influence of the Hermetic books on Franck just began in the 21st century and this paper further contributes to a better understanding of how the Hermetic books affected Franck. Franck used Agrippa to convey his understanding of the Corpus Hermeticum to his readers. However, it remains an open question why Franck integrated only a small part of the Corpus Hermeticum and the writings of Agrippa into his philosophy. (shrink)

Die Sebastian Franck-Forschung hat sich bisher recht ausführlich mit den Themen "Sebastian Franck als Historiker" oder "Sebastian Franck als Kritiker der Theologie" beschäftigt. Weniger Aufmerksamkeit bekam bisher der Gnostizismus im Denken des radikalen Reformers. Seit der Jahrtausendwende ist allerdings ein stärkeres Interesse an einer bestimmten Strömung des Gnostizismus zu erkennen, nämlich der Hermetik. Es gab einige Arbeiten, die den Einfluss von Hermes Trismegistos bzw. der hermetischen Schriften auf Franck aufzeigen konnten. Dieser Aufsatz geht der Frage des (...) Einflusses des christlichen Gnostizismus auf die Metaphysik von Franck nach. Die Ergebnisse zeigen, dass speziell Basilides und Valentinus einen starken Einfluss auf Franck hatten, der bisher nicht gesehen wurde. Eine große Bedeutung kommt dabei der gnostischen Soteriologie zu. Genauso wie Basilides und Valentinus nimmt Franck die platonische Dreiteilung der Seele in Geist, Seele und Körper an. Der Geist ist göttlich und ist weder entstanden noch kann er vergehen. Diesen Geist oder Christus findet man im Inneren von allen Kreaturen. Durch die Erkenntnis des Geistes oder Christus im Menschen, (=Gnosis) kann sich der Mensch von der Welt befreien. Ebenfalls christlich-gnostisch inspiriert ist der Gottesbegriff und die Lehre von Christus. Franck´s Christologie ist stark von der Nous-Christologie von Basilides beeinflußt, wobei er nicht exakt dem gleichen Doketismus folgt wie Basilides. Dass die Welt vom Demiurgen und nicht von Gott erschaffen wurde, wie Valentinus glaubt, sagt Franck nicht explizit. Franck glaubt aber der Teufel (Demiurg oder böser Engel) habe den Tod und damit die Seele erschaffen, während der unsterbliche Geist des Menschen nicht erschaffen wurde. (shrink)

What is the role of attention in the dialectics of memory and communication? How far is attention functioning as a medium? Which role does attention play in the information management practices? Attention is not only fundamental to human existence but also to the process of understanding. If understanding is mediated by memory and communication then attention can be identified with the medium. So whenever you search to explain the role and mechanisms of memory in the information society, the question of (...) attention is asked immediately. Furthermore, attention can be analyzed under the following topics: as cognitive process, as subjective, intersubjective and cultural phenomenon, and as resource and medium within an 'Attention Economy'. Whereas the first aspect has to be seen in the context of empirical studies in psychology and cognitive sciences, the phenomenological, cultural, and economic aspects seem to have common points and similar implications in their theoretical approaches. In the last twenty years, the notion of attention has been the central core of several discourses in German phenomenology, economy and cultural studies. Similar to Georg Franck's theory of mental capitalism, the idea of an attention economy also was followed up in the American discourse. In New Essays on Human Understanding, book II, chapter xxi Leibniz presents an interesting picture of the human mind as not only populated by perceptions, volitions and appetitions, but also by endeavours. The endeavours in question can be divided to entelechy and effort; Leibniz calls entelechy as primitive active forces and efforts as derivative forces. The entelechy, understood as primitive active force is to be equated with a substantial form, as Leibniz says: “When an entelechy – i.e. a primary or (...) substantial endeavour – is accompanied by perception, it is a soul” (NE II, xxi, §1; RB, 170). What about efforts, then? One is certainly the will. In NE, II, xxi, §5 Leibniz argues that volition is the effort (conatus) to move towards what one finds good and away from what one finds bad and that this endeavor arises from the perceptions we are aware of. As an endeavour results in action unless it is prevented, from will (which is always directed to the good) and power together follows action. However, this is not so simple. Leibniz argues that there is also a second class of efforts: “There are other efforts, arising from insensible perceptions, which we are not aware of; I prefer to call these ‘appetitions’ rather than volitions” (NE II, xxi, §5; RB, 173). Although there are appetitions of which one can be aware, usually these appetitions arise from the insensible petite perceptions and are consequently affecting us subconsciously. Now, although all minute perceptions are confused perceptions, they are always related to pleasure and displeasure and also to perfection and imperfection. From this follows that there can be different efforts present in the soul at the same time: the will which is directed to apperceived good and several separate appetitions which lead to different goals, both to those which bring about perfection and pleasure of the mind (joy) and those which bring about displeasure and imperfection (sorrow). These efforts are not only in conflict with each other but may also be in conflict with entelechy. A typical case is perceiving a sensual pleasure. Our entelechy which is always directed to final causes (perfection) may be in conflict with several different appetitions which are related in different ways to the sensual pleasure in question. If our understanding is developed enough, our will resists the temptation posed by the pleasure (agreeing with entelechy), but if the temptation is too strong, the appetitions outweigh the will and the resulting action bring about imperfection and sorrow as it is related to imperfection. In this paper I will argue that deliberation in the human soul is a battle of different endeavors described above: the entelechy in the soul strives according to its law-of-the-series towards its telos (perfection) and the will accompanies it by being automatically directed to the good. This thrust towards the apparent good is aided or hindered by the appetitions which can be thought as derivative forces in the Leibnizian dynamics. Depending on whether the predominant appetitions are related to good or bad desires, the deliberation succeeds or fails in achieving the real good which is the goal of human deliberation. The successs can be facilitated beforehand by developing our understanding so that we are less easily swept away by the derivative forces (NE II, xxi, §19). A central role in this task is played by strong willing. As Martha Bolton has noted in her recent paper, an essential feature of the basic, standing endeavors is that they are continuous – although the power balance in the soul changes from moment to moment, something lingers from our previous volitions. That is why Leibniz argues that we pave way for the future deliberations by our previous voluntary actions (NE II, xxi, §23). In contrast, the appetitions are temporary, fliegende Gedanken as Leibniz says in NE II, xxi, §12. Therefore there is a constant, always changing power balance between two kinds of endeavors in the soul: primitive active force versus derivative forces. I will argue that the behavior of the forces in the soul can be understood with a vectorial model which is related to Leibniz’s early ideas of calculus of variations and which was anticipated by Arnauld and Nicole’s Port-Royal Logic. The central idea in the model is that the options are in tension towards each other and the ratio between them at each moment determines the consequent outcome. The proper relationship between the endeavors is not a simple balance, two options which exhaust each other, but a case where different efforts complement each other: “Since the final result is determined by how things weigh against one another, I should think it could happen that he most pressing disquiet did not prevail; for even If it prevailed over each of the contrary endeavours taken singly, it may be outweighed by all of them together.” Leibniz continues : “Everything which then impinges on us weighs in the balance and contributes to determining a resultant direction, almost as in mechanics” (NE II, xxi, §40; RB, 193). The different endeavors can be understood as vectors leading to different directions and the end result is a certain direction that deliberation takes. The dynamical tension between the different endeavors presents a situation where everything affects everything and the following direction, the resulting volition follows more or less automatically. In Theodicy, §325 Leibniz describes the deliberation as follows: “One might, instead of the balance, compare the soul with a force that puts forth an effort on various sides simultaneously, but which acts only at the spot where action is easiest or there is least resistance” (Huggard, 322) This kind of dynamical tension can be understood in terms of the calculus of variations where there are several possible variations available but where the dynamics of the situation results in the decision taking the “easiest” route which is more or less objectively good depending on the level of the deliberator’s understanding. In his comments to Bayle’s note L of “Rorarius” Leibniz says: “The soul, even though it has no parts, has within it, because of the multitude of representations of external things, or rather because of the representation of the universe lodged within it by the creator, a great number, or rather an infinite number, of variations (Woolhouse & Francks (ed.), ‘New System’ and Associated Texts, 101). This kind of deliberation is comparable to God’s choice of the best world with the difference that God’s understanding is infinite which again results in the fact that the choice is the best possible. Whereas in nature the easiest route taken is always optimal as nature is God’s creation, in men the goodness or badness of men’s actions is dependent on their state of wisdom, that is, how developed their understanding is. The more wise men are, the more metaphysical goodness or perfection follows from their actions. (shrink)
