In analyzing oppressive systems like racism, social theorists have articulated accounts of the dynamic interaction and mutual dependence between psychological components, such as individuals’ patterns of thought and action, and social components, such as formal institutions and informal interactions. We argue for the further inclusion of physical components, such as material artifacts and spatial environments. Drawing on socially situated and ecologically embedded approaches in the cognitive sciences, we argue that physical components of racism are not only shaped by, but also (...) shape psychological and social components of racism. Indeed, while our initial focus is on racism and racist things, we contend that our framework is also applicable to other oppressive systems, including sexism, classism, and ableism. This is because racist things are part of a broader class of oppressive things, which are material artifacts and spatial environments that are in congruence with an oppressive system. (shrink)

We welcome Mikhalevich & Powell’s (2020) (M&P) call for a more “‘inclusive”’ animal ethics, but we think their proposed shift toward a moral framework that privileges false positives over false negatives will require radically revising the paradigm assumption in animal research: that there is a clear line to be drawn between sentient beings that are part of our moral community and nonsentient beings that are not.

John Rawls’ “reflective equilibrium” ranges amongst the most popular conceptions in contemporary ethics when it comes to the basic methodological question of how to justify and trade off different normative positions and attitudes. Even where Rawls’ specific contractualist account is not adhered to, “reflective equilibrium” is readily adopted as the guiding idea of coherentist approaches, seeking moral justification not in a purely deductive or inductive manner, but in some balancing procedure that will eventually procure a stable adjustment of relevant doctrines (...) and standpoints. However, it appears that the widespread use of this idea has led to some considerable deviations from its meaning within Rawls’ original framework and to a critical loss of conceptual cogency as an ethico-hermeneutical tool. This contribution identifies three kinds of “balancing” constellations that are frequently, but inadequately brought forth under the heading of Rawlsian “reflective equilibrium”: (a) balancing theoretical accounts against intuitive convictions; (b) balancing general principles against particular judgements; (c) balancing opposite ethical conceptions or divergent moral statements, respectively. It is argued that each of these applications departs from Rawls’ original construction of “reflective equilibrium” and also deprives the idea of its reliability in clarifying and weighing moral stances. Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. Natürlichkeitsargumente haben allgemein in der Bioethik und speziell in der Debatte um Enhancement und Anthropotechnik keinen guten Ruf. Neben dem formalen Vorwurf, einen naturalistischen Fehlschluss zu begehen, werden sie mit dem inhaltli-chen Einwand konfrontiert, eine falsche Auffassung von menschlicher Natur zugrunde zu legen: Recht verstanden definiere sich diese menschliche Natur nicht durch eine biologische Substanz, die durch biotechnische Eingriffe korrumpiert werden könnte, sondern durch kulturelle Vollzüge, zu denen gerade auch der Einsatz biotechnischer Verfahren zähle und die daher durch biotechnische Manipulationen (...) am Menschen keineswegs beeinträchtigt, sondern eher noch bestätigt würden. Der vorliegende Beitrag unterzieht diese Argumentation einer kritischen Prüfung. Dabei zeigt sich, dass der Ansatz, den Menschen von seiner ‚Kultürlichkeit‘ statt von seiner ‚Natürlichkeit‘ her zu begreifen, tatsächlich keine glaubhafte Rechtfertigung von Anthropotechniken liefert, sondern im Gegenteil ein neues Argument gegen sie begründet: Anthropotechniken untergraben bei genauerem Hinsehen auch und gerade den Status des Menschen als Kulturwesen. Since J. McTaggart’s paper on “The Unreality of Time” the opposition of “A-theorists” and “B-theorists” establishes a focal point in the modern debate on the metaphysics of time: While “A-theorists” claim the existence of an objective present, moving along time positions, “B-theorists” maintain that time is just a set of ontologically equivalent coordinates, “now” being merely the indexical of the speaker’s position. Contemporary attempts to resolve the issue by resorting to the analysis of language or to the theory of science (...) seem to deliver no definite results. By contrast, practical and existential aspects of the two models promise to be more univocal guides in deciding between them. Particularly, C. D. Broad’s hybrid conception of a “growing block theory” attains special attractiveness in this regard. (shrink)

The concept of power is not restricted to the usual idea of domination, as mainly implemented in the governmental structures of society. Rather, power also occurs at other places of a com-munity, adopting highly divergent forms. This plurality often impedes its reliable identification and precise labeling. However, the classical concepts of power, potestas and auctoritas, can be widened to more comprehensive perspectives that eventually promise to embrace modern societal places of power such as the market or the media in their (...) respective peculiarities. Norenzayan and colleagues suggest that Big Gods can be replaced by Big Governments. We examine forms of social and self-monitoring and ritual practice that emerged in Classical China, heterarchical societies like those that emerged in pre-Columbian Mesoamerica, and the contemporary Zapatista movement of Chiapas, and we recommend widening the hypothesis space to include these alternative forms of social organization.

Many people believe that the research-based pharmaceutical industry has a ‘special’ moral obligation to provide lifesaving medications to the needy, either free-ofcharge or at a reduced rate relative to the cost of manufacture. In this essay, I argue that we can explain the ubiquitous notion of a special moral obligation as an expression of emotionally charged intuitions involving sacred or protected values and an aversive response to betrayal in an asymmetric trust relationship. I then review the most common arguments used (...) to justify the claim that the pharmaceutical industry has a special moral obligation and show why these justifications fail. Taken together, these conclusions call into question the conventional ideologies that have traditionally animated the debate on whether the pharmaceutical industry has special duties of beneficence and distributive justice with respect to the impoverished in dire need of their products. Das Wiskott-Aldrich-Syndrom (WAS), ein genetisch bedingter Immundefekt mit klinischer Manifestation im Kleinkindalter, wird voraussichtlich in näherer Zukunft erstmals versuchsweise durch eine somatische Gentherapie behandelt werden. Im vor- liegenden Beitrag werden die wichtigsten medizinisch-naturwissenschaftlichen Fakten dieses Krankheitsbildes sowie die bisherigen Erfahrungen mit somatischen Gentherapien bei anderen Immunmangelsyndromen ausführlich dargestellt. Sodann erfolgt eine ethische Analyse eines möglichen gentherapeutischen Eingriffs bei WAS-Patienten, bei der die spezifischen Aspekte des Wiskott-Aldrich-Syndroms – insbesondere die fast ausschließliche Betroffenheit von Kindern sowie die unterschiedlich aussichtsreiche Alter- nativoption einer (...) allogenen Knochenmarktransplantation–wesentliche Aspekte der Beurteilung sind. Im Ergebnis zeigt sich, dass ein gentherapeutischer Eingriff im vorliegenden Fall nicht im Rahmen einer Forschungsstudie, d.h. als Humanexperiment, gerechtfertigt werden kann, sondern allein als individueller Heilversuch. Gleichwohl las- sen die besonderen Risiken und die Innovativität eines solchen Eingriffs es notwendig erscheinen, diesen Heilversuch – anders als andere Heilbehandlungen mit bislang unerprobten Mitteln – in streng kontrollierter Form durchzuführen. Der neuartige Gedanke eines kontrollierten individuellen Heilversuchs zeichnet sich daher für den vorliegenden Fall, und womöglich auch für vergleichbare risikoreiche Behandlungsansätze namentlich im Bereich der Gentherapie, als geeignetes Instrument der Konzeption und Beurteilung ab. Dietmar Hübner and Lucie White question the ethical justification of employing risky neurosurgical interventions to treat imprisoned psychopaths. They argue that (1) such interventions would confer no medical benefit on the psychopath as there is no “subjective suffering” involved in psychopathy and (2) psychopaths could not voluntarily consent to such procedures because they could have no “internal motivation” for doing so. In the course of their discussion, the authors insightfully show that certain aspects of the psychopath’s personality structure (...) are especially relevant to assessing the ethics of risky treatment options. As I argue, however, the particular conclusions that the authors draw are too strong. A deeper look at the psychopathic profile casts doubt on (1) and (2). In some cases, psychopaths can be plausibly construed as experiencing subjective suffering on account of their disorder and as appropriately motivated to voluntarily consent to neurosurgical treatment. After arguing for this view, I suggest that the psychopath’s consent to neurosurgical intervention might nonetheless be problematic, as their emotional incapacities might preclude their abilities to adequately appreciate the relevant risks. Judith Jarvis Thomson has recently proposed a new argument for the thesis that killing the one in the Trolley Problem is not permissible. Her argument relies on the introduction of a new scenario, in which the bystander may also sacrifice herself to save the five. Thomson argues that those not willing to sacrifice themselves if they could may not kill the one to save the five. Bryce Huebner and Marc Hauser have recently put Thomson's argument to empirical test by asking (...) people what they should do in the new trilemma case, in which they may also sacrifice themselves. They found that the majority judge that they should either kill the one or sacrifice themselves; Huebner and Hauser argue that those numbers speak against Thomson's argument. But Thomson's argument was about the dialectical effect of the new trilemma on the traditional dilemma, rather than about the trilemma itself. Here I present the results of a study in which I asked subjects first what they should do in the trilemma and then what they should do in the traditional Trolley Problem. I found that, if asked first about the trilemma, subjects then have the intuition that killing the one in the traditional Bystander at the Switch is not permissible?exactly what Thomson's argument had predicted. Cognitive scaffolding refers to external structures that change the cognitive demands of tasks. This dissertation begins by reviewing the literature around scaffolding—discussing key thinkers such as Hutchins (1995a), Clark (1997) and Sterelny (2003, 2010). I then develop the above scaffolding characterisation by drawing a distinction between shallow and deep scaffolding. Shallow scaffolding primarily involves cues, whereas deep scaffolding involves the significant offloading of cognitive work. By appealing to the complementarity thesis, I show that deep scaffolds can be explained through a (...) model of cognitive extension (Menary, 2006; Sutton, 2010). Most crucially, despite the abundance of benign/ neutral examples in the literature, I argue that scaffolding can also be ‘hostile’ to agents’ interests—benefitting one agent while undermining another. I draw on Sterelny (2003) to clarify my use of the word ‘hostile’ and also specify what I mean by ‘interests’. I then review authors with similar concerns to my own—i.e., the lack of discussion around external structures that negatively impact agents (Aagaard, 2020; Liao & Huebner, 2020; Slaby, 2016). Despite these authors’ concerns, the idea of ‘hostile scaffolding’ is not quite reached. I then present examples of shallow hostile scaffolding by reviewing how sunglasses (Viola, 2022) and casino interior design and ambience (Friedman, 2000; Schüll, 2012) can be hostile. Most importantly, I show that deep hostile scaffolding is a genuine concern (and not only a theoretical one) by reviewing gambling machines that use player tracking systems and virtual reel mapping (Schüll, 2012), as well as Twitter’s use of gamification (Nguyen, 2021). I close the dissertation by discussing avenues for future hostile scaffolding research. This includes the ethical implications deep hostile scaffolding, scaffolding’s role in forming addictive behavior, other instance of gamification, ‘racist scaffolding’, and hostile scaffolding in developing technologies (such as VR, dark patterns and AI).
