In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Some Comments on de Melo-Martin and Harris.

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. In the first wave of the COVID-19 pandemic, healthcare workers in some countries were forced to make distressing triaging decisions about which individual patients should receive potentially life-saving treatment. Much of the ethical discussion prompted by the pandemic has concerned which moral principles should ground our response to these individual triage questions. In this paper we aim to broaden the scope of this discussion by considering the ethics of broader structural allocation decisions raised by the COVID-19 pandemic. More specifically, we (...) consider how nations ought to distribute a scarce life-saving resource across healthcare regions in a public health emergency, particularly in view of regional differences in projected need and existing capacity. We call this the regional triage question. Using the case study of ventilators in the COVID-19 pandemic, we show how the moral frameworks that we might adopt in response to individual triage decisions do not translate straightforwardly to this regional-level triage question. Having outlined what we take to be a plausible egalitarian approach to the regional triage question, we go on to propose a novel way of operationalising the ‘save the most lives’ principle in this context. We claim that the latter principle ought to take some precedence in the regional triage question, but also note important limitations to the extent of the influence that it should have in regional allocation decisions. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. In 2015 the United Kingdom (UK) became the first nation to legalize egg and zygotic nuclear transfer procedures using mitochondrial replacement techniques (MRTs) to prevent the maternal transmission of serious mitochondrial DNA diseases to offspring. These techniques are a form of human germline genetic modification and can happen intentionally if female embryos are selected during the MRT clinical process, either through sperm selection or preimplantation genetic diagnosis (PGD). In the same year, an MRT was performed by a United States (U.S.)-based (...) physician team. This experiment involved a cross-border effort: the MRT procedure per se was carried out in the US, and the embryo transfer in Mexico. The authors examine the ethics of MRTs from the standpoint of genetic relatedness and gender implications, in places that lack adequate laws and regulation regarding assisted reproduction. Then, we briefly examine whether MRTs can be justified as a reproductive option in the US and Mexico, after reassessing their legalization in the UK. We contend that morally inadequate and ineffective regulations regarding egg donation, PGD, and germline genetic modifications jeopardize the ethical acceptability of the implementation of MRTs, suggesting that MRTs are currently difficult to justify in the US and Mexico. In addition to relevant regulation, the initiation and appropriate use of MRTs in a country require a child-centered follow-up policy and more evidence for its safety. (shrink)

Esto tiene lugar en el contexto de una nueva comprensión de sí marcada por la importancia (...) de la memoria. Así, la lucha del hombre moderno contra la conciencia de la muerte se desarrolla en los frentes de la acumulación de riquezas, y de la memoria. -/- ENGLISH One of the main features of our time is the presence of a widespread market economy. At the same time, notororious efforts to conceal the presence of death can be easily identified in our society; they are likely driven by an acute perception of finitude originated in Modernity. The rationale behind both aspects is that monetarisation can be regarded as a reaction to the increasing awareness of death. All of this is framed by a new self-understanding, heavily characterized by the relevance of memory. Thus, the fight of the modern man against the awareness of death is led in both fronts of wealth accumulation and memory. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. The recent resurgence of extreme-right movements and the nationalist turn of many governments across the world have reignited the relevance of discussions within educational philosophy about the teaching of national identity in schools. However, the conceptualisation of national identity in previous iterations of these debates have been largely Western and Eurocentric, making the past theoretical literature about these questions less relevant for post-colonial settings. In this paper, I imagine a new approach for teaching national identity in post-colonial contexts, founded on (...) postcolonial conceptions of identity and in particular, the concept of hybridity. I first develop a postcolonial account of national identity by drawing on Homi Bhabha’s thinking about cultural identity, drawing on his concepts of liminality, splitting, and ambivalence. Then, building on Bhabha's notion of hybridity, I propose a distinction between national identity portrayals as either fixed or malleable. Finally, I demonstrate the implications of such a conceptual distinction on the way that national identity is taught in post-colonial schools; by way of an example, I envision a concrete approach to teaching national identity that views national identity as malleable rather than fixed, set in a hypothetical postcolonial school in the Philippines. By beginning from postcolonial assumptions about national identity, I hope to indicate new directions that the debates about the teaching of national identity in schools might proceed. (shrink)

I defend impact-based accounts of institutional racism against the criticism that they are over-inclusive. If having a negative impact on non-whites suffices to make an institution racist, too many institutions (including institutions whose affirmative action policies inadvertently harm its intended beneficiaries) would count as racist. To address this challenge, I consider a further necessary condition for these institutions to count as racist—they must stand in a particular relation to racist ideology. I argue that, on the impact-based model, institutions are racist (...) if they have a negative racial impact AND this impact is legitimized by racist ideology. Racist ideologies limit social criticism of and collective action against institutions that have a negative racial impact, and in so doing, lend stability to systems of racial domination. (shrink)

This paper explores the meaning of ‘decolonization’ in relation to the school curriculum and the role of the philosopher of education in this task. Taking the Philippines as an example, this paper illustrates how coloniality has underpinned not only school curricula, but also entire systems of formal education in the post-colony. Following from this, it argues that decolonization in education must transcend the diversification of curricula and aim at a broader vision of justice. Drawing from the author’s own attempts to (...) reimagine the teaching of national identity, the paper proposes that philosophers of education who wish to participate in the work of decoloniality view their contribution as the three-fold task of historical critique, conceptual retrieval, and creative reimagination. I address the objection that the concept of racism has become overly inflated. Critics of the conceptual inflation of “racism” argue that theories of institutional racism engage in untoward conceptual inflation insofar as they undermine our moral understanding of racial phenomena, hinder our ability to explain the causes of racial inequality, and even undercut struggles for racial justice. I develop an original account of institutional racism and show that it is immune to all three versions of the conceptual inflation challenge.

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. This article develops a diagnostic lens to make sense of the still baffling development of a ‘humanitarian marketplace’. Ambivalently hybrid initiatives such as volunteer tourism, corporate social responsibility or even fair trade do not strictly obey a distributive logic of market exchange, social reciprocity or philanthropic giving. They engender a type of ‘economy’ that must be apprehended in its own terms. The article argues that the large-scale collaborative effects of such a dispersed market can be theorized without resorting to the (...) classical biopolitical move of simplified agency/holistic reification. The argument proceeds counterintuitively, by appropriating the notion of symbiosis as redefined by contemporary biology, contending through historical contextualization and conceptual work that nature itself offers the best example to grasp spontaneous collaboration among unrelated human beings as a non-automatically balanced and intrinsically political affair that calls for critical management through an ex post facto interventionist policy of selective cultivation. Os realistas diretos sobre a memória episódica alegam que um sujeito que lembra está em contato direto com um evento passado. No entanto, como seria possível estar em contato direto com um evento que deixou de existir? Este é o assim-chamado problema da cotemporalidade. A solução padrão para este problema, a qual foi proposta por Sven Bernecker, consiste em distinguir entre, por um lado, a ocorrência de um evento, e, por outro lado, a existência de um evento, de modo que (...) um evento deixa de ocorrer sem deixar de existir – esta é a solução eternista para o problema da cotemporalidade. No entanto, alguns filósofos da memória – notadamente Kourken Michaelian – alegam que a adoção de uma metafísica eternista do tempo seria um preço metafísico muito alto a ser pago para se defender as intuições dos realistas diretos sobre a memória. Ainda que eu concorde com essas críticas, buscarei mostrar duas coisas. Primeiro, que este tipo de “argumento do senso comum” não é decisivo. Segundo, que a proposta de Bernecker permanece sendo a melhor solução para o problema da cotemporalidade. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

En ese sentido, mostraremos los juicios e ideas de Gonzalez Prada referidas a la (...) relación entre saber científico y poder político, enmarcado en un proyecto de emancipación social y cultural. La investigación de la filosofía andina prehispánica, como historia de la filosofía, tiene el propósito descubrir los conceptos de la filosofía en un proceso histórico semejante al de la ciencia presocrática y el idealismo clásico griego, nada distinto de ellas. Esta describe la evolución de las ideas del hombre andino prehispánico, los conceptos que elaboró, manejo y uso en su pensamiento. El concepto de filosofía que asume deviene de Nietzsche, en cuanto pensamiento que se desarrolla con conceptos; la filosofía como (...) el juego de los conceptos, contestando a la pregunta que Engels, planteaba acerca de la relación entre el pensar y el ser, donde nacen los conceptos elementales de la filosofía; ella también sirve para explicar la relación de nuestros pensamientos con el mundo q.ue nos rodea, de si nuestro pensamiento es capaz de conocer el mundo real, de si con nuestras ideas podemos formarnos una imagen refleja exacta del mundo. Es decir, nuestra investigación responde en qué medida el pensamiento andino prehispánico, como indica Hegel, es la teoría del conocimiento de su tiempo, como un pensamiento que se ocupa de sí mismo porque es el objeto de estudio, como pensamiento que “se piensa a sí mismo” respecto sus diferentes determinaciones. En esta investigación se demuestra que no existe oposición antagónica entre la filosofía andina prehispánica y el desarrollo de la filosofía en general, ni con la filosofía occidental griega en particular, salvo en las formas de su temática especial o la profundización del problema filosófico concreto, por cuanto en ningún caso es contraria a la ley del desarrollo filosófico en general, y de ella debemos entender que los nombres, los términos o los vocablos con que designan los conceptos siendo distintos (...) tienen el mismo contenido y sigue igual lógica de desarrollo. Por ejemplo, “Pacha” resulta una formulación más cercana al concepto científico de espacio/tiempo, por cuanto adelanta la imposibilidad de separar el espacio y el tiempo de los objetos o fenómenos de la realidad objetiva, logrado no como un descubrimiento científico sino como una necesidad de formular el pensamiento acerca de dicho fenómeno, tan semejante a la ciencia moderna. O Cay y Camac, los conceptos de “materia” y de “realidad ideal”, perdidos u ocultos en los textos prehispánicos, son categorías que resuelven los problemas fundamentales de la filosofía, como acerca de “¿Cuál es el “verdadero ser”?”, o acerca de la relación ser y pensar. De igual modo consideramos que el idealismo andino prehispánico no difiere antagónicamente del idealismo griego clásico, contrariamente es posible discutir en el mismo nivel con Platón o con cualquier idealista de la filosofía clásica griega. El artículo se concentra en indagar las diferentes declaraciones de Marx sobre la justicia, con la intención de determinar tres cuestiones: en primer lugar, saber si nuestro autor cuenta con una concepción de la justicia; en segundo lugar, establecer si la reflexión acerca de lo que es justo ocupa un lugar privilegiado en su obra; y, en tercer lugar, ver si a partir de ahí puede colegirse la existencia de una teoría marxiana de la justicia. This study presents and develops in detail (a new version of) the argumental conception of meaning. The two basic principles of the argumental conception of meaning are: i) To know (implicitly) the sense of a word is to know (implicitly) all the argumentation rules concerning that word; ii) To know the sense of a sentence is to know the syntactic structure of that sentence and to know the senses of the words occurring in it. The sense of a sentence is (...) called immediate argumental role of that sentence. According to the argumental conception of meaning a theory of meaning for a particular language yields a systematic specification of the understanding of every sentence of the language which consists in a specification of the immediate argumental role of the sentence. The immediate argumental role is a particular aspect of the use of a sentence in arguments. But it is not the whole use in arguments, nor is the whole use in arguments reducible to the immediate argumental role. That is why, by accepting the argumental conception of meaning, we can have epistemological holism without linguistic holism. The argumental conception distinguishes between the understanding and the correctness of a language. Such a distinction makes it possible to account for our understanding of paradoxical languages. Redundancy theory of truth, realistic conceptions of truth or epistemic conceptions of truth are all compatible with an argumental conception of sense. But here it is argued that an epistemic conception of truth is preferrable. Acceptance of the argumental conception of meaning and of an epistemic conception of truth leads to a rejection of the idea of analytic truth. The argumental conception is pluralistic with respect to the understandability of different logics, and neutral with respect to their correctness. (shrink)

The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

The article argues that both these authors grounded their vision on Polybius' theory of “mixed government,” though adapting it in different directions. In examining this difference, the article reaches the conclusion that it concerns far less the degree of popular participation in political decision-making and government than the value that Machiavelli and Guicciardini respectively ascribe (...) to it in comparison with that of safety-liberty. In this respect, their theories may be viewed as anticipating the tensions between democracy and the rule of law, the co-presence of which provides the essential foundation of the structure of present-day constitutional democracies. Environmentalism is an extremely topical movement that does not seem to obtain results in the long or short term. In this text I defend that this "failure" of environmentalism is due to the fact that both he and his public operate with an ontology contrary to their own bases. Faced with this, a new ontology is necessary that adapts to these. Our question, in this paper, is about the plausibility of the expressivist account of one’s self- attribution of mental states. More to the point, we will strictly follow the principle of charity as a mean to show that an expressivist philosopher can have good and reasonable answers to the set of objections put together in so called “Geach’s point”. Using this method, we hope to give enough evidences that an expressivist philosopher has enough resources to build a plausible explanation for (...) one’s attribution of mental states to herself. This paper argues that racism should not only be conceived as a moral concept whose main aim is to condemn severe wrongs in the domain of race. The paper advances a complementary interpretation of racism as an explanatory concept--one that plays a key role in explaining race-based social problems afflicting members of subordinate racialized groups. As an explanatory concept, the term 'racism' is used to diagnose and highlight the causes of race-related social problems. The project of diagnosing race-based social problems (...) contributes to the pragmatic anti-racist end of developing better political and policy strategies for solving these social problems. The paper defends this interpretation of racism as an explanatory concept through a critical engagement with Urquidez's moral-philosophical account of racism. (shrink)

Tanto desde el punto de vista teórico como desde una perspectiva práctica, el fenómeno de la "estetización" no parece ser portador de buenos augurios. En el ámbito teórico, la estetización ha sido vinculada con la crisis de los discursos orientados en términos de verdad, mientras que en el terreno práctico, ella ha sido asociada a ciertos procesos culturales que conducirían a la debacle de los principios normativos. Dejando de lado la problemática teórica, el presente trabajo se concentra en el debate (...) en torno al fenómeno práctico de la estetización de la política. En primer lugar, nos remontamos a la historia de la condena filosófica de la estetización de la esfera política para ocuparnos luego, en un segundo momento, de algunas posiciones esteticistas y antiesteticistas de finales del siglo XX. Posteriormente, procuramos avanzar en una redescripción de esta problemática que nos permita rescatar un sentido productivo de lo estético para el pensamiento político. Para esto último, nuestro trabajo se apoya en las reflexiones de la actual coeditora de la Neue Zeitschrift für Sozialforschung, Juliane Rebentisch. Tomando como parámetro algunos de los supuestos de sus investigaciones, aquí intentaremos demostrar hasta qué punto la estetización de la vida política puede contribuir al desarrollo de una concepción renovada de esta última. Both from a theoretical and from a practical perspective, the phenomenon of "aestheticization" does not seem to anticipate anything particularly good. On a theoretical level, it has been linked to the crisis of discourse-oriented in terms of truth, while in the practical, has been associated with certain cultural processes that lead to the the collapse of the normative principles. Leaving aside the theoretical issues, this paper focuses on the debate on the phenomenon of the aestheticization of the political culture. First, it goes back to the history of philosophical condemnation of the aestheticization of the political sphere. In a second time, he deals with some conceptions of the late twentieth century. Subsequently, the paper seeks to advance a redescription of this problem that allows rescue a productive sense of aesthetics for political thought. For the latter, our article is based on the reflections of Juliane Rebentisch and attempts to show how the aestheticization of political life can help to develop a new concept of the same. (shrink)

Direct realists about episodic memory claim that a rememberer has direct contact with a past event. But how is it possible to be acquainted with an event that ceased to exist? That’s the so-called cotemporality problem. The standard solution, proposed by Sven Bernecker, is to distinguish between the occurrence of an event and the existence of an event: an event ceases to occur without ceasing to exist. That’s the eternalist solution for the cotemporality problem. Nevertheless, some philosophers of memory claim (...) that the adoption of an eternalist metaphysics of time would be too high a metaphysical price to be paid to hold direct realist intuitions about memory. Although I agree with these critics, I will try to show two things. First, that this kind of “common sense argument” is far from decisive. Second, that Bernecker’s proposal remains the best solution to the cotemporality problem. (shrink)

Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. Este trabajo presenta una propuesta biologizada del arte y la Filosofía Indígena desde el pueblo kichwa Saraguro, con el fin de discutir especialmente los fundamentos de los derechos de la naturaleza. Aunque, hay que resaltar que, el sitio de enunciación no es estrictamente el lugar descrito; porque la matriz de discusión es el Sumak Kawsay que involucra a Latinoamérica en general. La metodología que se usa es la transdisciplinar. El orden de desarrollo está enmarcado en una primera parte que desarrolla (...) a modo teórico la presencia del arte y la estética en el mundo indígena. Luego, se presenta un breve análisis de campo, específicamente una discusión con el artista kichwa Saraguro Luis Antonio Lozano. Se concluye que existe un contenido religioso, espiritual o Trascendental en el arte y la estética kichwa Saraguro, que puede aportar para el desarrollo del fundamento filosófico de los derechos de la naturaleza y el Sumak Kawsay. Este trabajo critica la categoría blanquitud, en la corriente iniciada por Bolívar Echeverría. El método que se utiliza es el transdisciplinario, como pretensión de disolución de las parcelas de conocimiento. Se toma tres campos filosóficos: la Teología de la liberación; la Filosofía de la liberación y la Filosofía indígena. En el análisis lingüístico se utiliza como herramienta, la poesía y novela de Rosario Castellanos, Elena Poniatowska, Gioconda Belli y Ernesto Cardenal. El lugar de enunciación es el pueblo kichwa Saraguro. Se (...) postula que el Sumak Kawsay es un más allá de los derechos de la naturaleza; como uno de los antónimos de la blanquitud. Empero, la blanquitud no es solamente el color del capitalismo; es decir, si las personas son las que construyen las instituciones, entonces, son estos sujetos quienes cargan con lo blanco. La blanquitud es también un fenotipo del racismo: complejo de superioridad e inferioridad. Racismo que se traduce en posesión o acaparamiento económico, académico, político, etc. La reversión filosófica o descolonización de lo blanco se postula desde una educación sin dominación, a través de la concreción, cuidado y reproducción de la vida Sumak Kawsay. La educación tradicional concebida en compartimientos estancos que coquetean en torno al árbol de la ciencia, ha formado a un individuo descontextualizado, sin capacidad de respuesta para enfrentar la complejidad del mundo actual. La Multiversidad Mundo Real “Edgar Morin” asume la misión de una enseñanza educativa basada en los postulados del Pensamiento Complejo de Edgar Morin; pero aún quedan pendientes nuevas definiciones que rompan con los esquemas de la educación basada en el paradigma simplificador. La meta es emprender el gran (...) viraje que haga posible que la reforma paradigmática implique también una reforma de las mentes y del lenguaje, porque nombrar lo nuevo con la palabra vieja dificulta a nivel inconsciente detonar el cambio. Superar los bloqueos propios y los adquiridos por la educación que nos ha conducido a ser individuos desarticulados del contexto, ese es el gran reto de la Multiversidad. (shrink)

There are various proposals for a general characterization of holism1. In this paper I propose the following: a variety of holism is the view that every X of an appropriate kind, which is part of a relevant whole W, cannot be legitimately separated or taken in isolation from W. Then, I distinguish two general kinds of holism, depending on two different reasons which can debar us from taking X in isolation from W. One reason can be that separating X from (...) W always amounts to transforming X into something else. Correspondingly, a strong holism is the view that if the whole W is modified anywhere, X ceases to be X and becomes something else. Another reason why it may be illegitimate to consider X in isolation from W can be that if we separate X from W, nothing that we know entitles us to exclude that X might be transformed into something else. Correspondingly, virtual holism is the view that if the whole W is modified anywhere, we can never rule out that X ceases to be X and becomes something else. (shrink)

O Fisicalismo tem sido a posição filosófica monista mais aceita no mainstream do debate contemporâneo sobre a natureza do mental. Mas o que significa dizer que tudo o que existe é “físico”? O presente trabalho busca responder à pergunta: Como as teses fisicalistas contemporâneas têm definido o termo ‘físico’ em suas proposições? Para respondê-la foi realizada uma investigação teórico-filosófica baseada em revisão bibliográfica e análise lógica e conceitual. Quatro categorias gerais de definição do termo ‘físico’ foram identificadas numa revisão da (...) literatura. Existem igualmente fortes críticas às propostas de definição em toda a discussão filosófica. Não temos uma definição incontroversa do que seja uma propriedade física, tampouco consenso sobre qual deveria ser a formulação mais adequada da tese fisicalista. Assim, a questão que se coloca é: Por que estamos discutindo o valor de verdade de uma tese que nem mesmo tem conseguido ser formulada de forma adequada? (shrink)

En aras del universalismo y en contra del totalitarismo, la ética discursiva ha mostrado con Jürgen Habermas un déficit práctico al negar a la filosofía moral la posibilidad de reflexionar sobre las condiciones alienantes del diálogo desde un ethos concreto. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. El artículo analiza el rol que cumple la confianza en la construcción de la realidad social, argumentando que constituye uno de sus componentes esenciales. Lo es porque hace posible el nacimiento, permanencia y reconocimiento colectivo de las instituciones, así como su iteración y organización en subsistemas.

The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

It has been commonplace to equate Foucault’s 1979 series of lectures at the Collège de France with the claim that for neoliberalism, unlike for classical liberalism, the market needs to be artificially constructed. The article expands this claim to its full expression, taking it beyond what otherwise would be a simple divulgation of a basic neoliberal tenet. It zeroes in on Foucault’s own insight: that neoliberal constructivism is not directed at the market as such, but, in principle, at society, arguing (...) that the value of this insight goes beyond the critique of a neoliberal present. The neoliberal rationale rather helps him to reveal a unique historical architecture, a latent approach to the social dissimilar to the one that has long predominated in the human sciences. The inversion of homo œconomicus in neoliberal theory amounted to the unearthing of a ‘social subject of interest’ within civil society. Such a subject, barely recognized by neoliberals who simply instrumentalize it for the sake of the market, demonstrates that the social is not necessarily the natural product of ethical subjects; that society may also need to be constructed.
