The study aimed to know the relationship between the nature of the work and the type of communication among the Employees in the Palestinian universities. A comparative study between Al-Azhar University and Al-Aqsa University. The researchers used the analytical descriptive method through a questionnaire that is randomly distributed among the employees of Al-Azhar and Al-Aqsa universities in Gaza Strip. The study was conducted on a sample of (176) administrative employees from the surveyed universities. The response rate was (85.79%). The study (...) reached a number of results, the most important of which is that there is a high degree of satisfaction with the nature of work prevailing in the Palestinian universities in Gaza Strip from the point of view of the administrative staff, where the percentage was (68.15%). There is an Mean level of communication from the point of view of administrative staff, with a percentage of (67.50%). There is a direct correlation between the nature of the work and the prevailing pattern of communication. There is an absence of differences between the sample according to the gender variable in their perception of the nature of work and the prevailing pattern of communication. There is an absence of differences in the perception of Employees nature of work and the pattern of communication prevailing depending on the variables (age, years of service, job level, and university). There are statistically significant differences between Al-Azhar University and Al-Aqsa University in favor of Al-Azhar University. The study reached a number of recommendations, the most important of which is that the interest of the management of the Palestinian universities in Gaza Strip in general, and Al-Aqsa and Al-Azhar Universities in particular should be provided with a good nature of work and communication. There is a need for continuing the management of universities to pay attention and continuous improvement of the performance of employees. There is an importance of solving the problems of Employees and giving them the opportunity to contribute to solving their own problems. The aim of the research is to shed light on the nature of the organizational structure prevailing in Palestinian governmental universities and to identify the most important differences in the perceptions of employees of the organizational structure in the Palestinian governmental universities according to the demographic and organizational variables. The researchers used the descriptive analytical method, through a questionnaire randomly distributed to the sample of the employees of Al-Aqsa University. The study was conducted on a sample of (80) administrative staff (...) from Al-Aqsa University. The study found that there is a moderate degree of satisfaction with the nature of the organizational structure prevailing in the Palestinian governmental universities from the point of view of the administrative staff, with a percentage of (63.11%). The absence of differences between the sample according to the gender variable in their perception of the nature of the organizational structure prevailing at Al-Aqsa University, the absence of differences in their perception of the nature of the organizational structure depending on the age variable. There are statistical significance differences in the perception of the elements of the organizational climate depending on the variable of scientific qualification in their perception of the nature of the organizational structure in favor of holders of a bachelor's degree, the absence of differences in their perception of the nature of the organizational structure depending on the variable years of service, and the absence of differences in their perception of the nature of the organizational structure depending on the variable level of career (Director, Head of Department, and Administrative Officer). The study reached a number of recommendations, the most important of which is that the management of the Palestinian governmental universities in general and Al-Aqsa University in particular should be given special attention to the organizational structure and modified in a way that achieves the goals of the university and the aspirations of the employees. The study aimed to identify the availability of the two focus criteria on human resources and processes as a means of excellence in Palestinian universities according to the European model in the Palestinian universities. The study used the analytical descriptive method. The study was conducted on the university leadership in Al-Azhar and Islamic Universities. The study sample consisted of (135) individuals, (119) of whom responded, and the questionnaire was used in collecting data. The results of the study were as follows: (...) (a) High level of achievement of the criterion of focus on human resources with a percentage of (73.6%). The sub-areas of the HR focus were as follows: (reward, appreciation and attention to human resources at the university, Identify and develop the continuity of knowledge and qualifications of human resources, and finally: planning, management and development of human resources). There is a high standard of emphasis on operations with a percentage of (74.6%). The sub-areas of the Process Focus Standard are as follows: (Process Design and Management Methodology, Process Improvement in Creative Ways to Generate Value Added for Students and Beneficiaries, Design and Development of Academic Programs and Internal Services by Students' need). The study presented a number of recommendations, the most important of which are: Making more efforts in the planning, management and development of human resources in universities, working to identify and develop the continuity of knowledge and qualifications of human resources through training courses and scholarships for the members of the academic body, working to increase the participation and empowerment of human resources in decision making, and work on the design and development of academic programs and internal services according to the needs of students and to meet the labor market. The aim of the research is to identify the role of crowdfunding in boosting the entrepreneurial creativity of university students. The study community consisted of students at Al-Azhar University and Al-Quds Open University. In order to achieve the objectives of the study, the researchers used the analytical descriptive method in which they try to describe the phenomenon studied, analyze its data, and the relationship between its components and the opinions expressed. The researchers used a survey sample of (32) students. The (...) study sample consisted of (120) students from the two universities mentioned equally. The response rate was (87.50%). The research concluded that there is a significant correlation between crowdfunding and entrepreneurial creativity, which means that the regression model is good, where the results of the study showed that entrepreneurial creativity, is fundamentally affected by the statistical function of participatory e-finance. The strong impact of crowdfunding in boosting entrepreneurial creativity was demonstrated. The research reached a number of recommendations, the most important of which is the need to promote awareness of the crowdfunding of Palestinian university students, the importance of supporting entrepreneurial creative ideas among university students. The aim of this study is to identify the support provided by senior management at universities to assist in the transition to electronic management. The study population consists of different administrative levels in the universities, with total of (239) employees. The study sample consisted of (148) individuals from different administrative levels, with a response rate of (84.31%). The researchers used the questionnaire as a tool for the study, the descriptive analytical approach to achieve the objectives of the study, and the (...) SPSS program was used to analyze the study data. The results of the study showed that the university administration supports the transition to electronic management. The concept of e- management is a broad concept that involves several different electronic systems, and the transition to it requires extensive changes from organizational structure to business processes. Computerized information systems are sufficient to initiate a transition to electronic management. The use of e-HRM modules is still very limited and greatly reduces the benefits of an electronic pyramid. Self-service systems are not interrelated with pay and payment systems, and researchers explain this because e-HRM systems are not complete at the universities. Universities also follow the strategy of combining traditional and electronic business, a positive indicator of the transition to e- management. The study reached several recommendations for the purposes of the university managements to take the formal and practical approach to the systems of electronic management. The study aimed to identify the reality of the use of social networks in the technical colleges in Palestine, where the variables of social networks were included. The analytical descriptive method was used in the study. A questionnaire consisting of (12) items was randomly distributed to college workers Technology in the Gaza Strip. The sample of the study consisted of (205) employees of these colleges. The response rate was 74.5%. The results showed a high degree of approval for the dimensions (...) of the social networks and a relative weight (74.15%) according to the perspective of the employees of the technical colleges in the Gaza Strip. The results of the study showed that there is a high level of social networking areas (site management and Website Content) in the technical colleges in the Gaza Strip. The field of site management ranked first with a relative weight of 74.91%, and second and last (Content Site) with a relative weight (73.38%). The results showed that there were differences between colleges in the use of social networks where the results showed that the most common colleges used these networks (UCAS) and the least used is (GTC). The results showed no differences between male and female employees in the use of social networks in technical colleges. The researchers suggest a number of recommendations, including: the need to raise awareness of the importance of Facebook and other social networking sites, through the holding of courses for employees in technical colleges, and to identify the ways to optimize the use of such sites, and the benefits of this use, and reflected positively on technical colleges. And the adoption of dealing with the various social networking sites as a reality, and the Palestinian and Arab technical colleges, use them in accordance with the objectives of technical colleges. Advise the Department of Technical Colleges to devote time to their presence on social networks to follow the public and respond to their queries. There is a need for the attention of decision-makers in technical colleges in social sites, because they are considered an important and effective means of communication, and the link between beneficiaries and decision-makers. The study aimed to identify the reality of the effectiveness of electronic marketing in the technical colleges in Palestine. The analytical descriptive method was used in the study. A questionnaire of 16 items was randomly distributed to the technical colleges in Gaza Strip. The sample of the study consisted of (205) employees of these colleges. The response rate was 74.5%.The results showed that the technical colleges achieved a high level of use of electronic marketing, with a relative weight of 70.24%. (...) There is a high level of e-marketing (Electronic advertising (71.75%), electronic promotion (74.75%), news groups (66.03%), and communication with the student audience (68.73%)). There exists a statistically significant relationship between the organization's smart dimensions and sustainability in the technical colleges in Gaza Strip. The results also confirmed the existence of differences in the application of electronic marketing between faculties investigated in the Gaza Strip. The researchers suggest a number of recommendations, the most important of which are: the need to direct marketing through social networks and use this network to market through them, follow-up of the pages of the colleges and open the door for dialogue and communication and respond to all inquiries. The study aimed to identify the reality of technical education in Palestine. The analytical descriptive method was used in the study. A questionnaire which consisted of 41 paragraphs was distributed randomly to the technical colleges in Gaza Strip. Random sample of (275) employees of these colleges were used, and the response rate was (74.5%). The results showed a high degree of approval for the dimensions of technical education with a relative weight of 76.07%. The ranking and relative weight was as (...) follows: Technical education institutions: 79.51%, graduates of technical education 75.75%, Labor market and local community 72.96%. The researchers propose a number of recommendations, the most important of which is: the need to pay attention to technical education in line with the National Strategic Plan for Higher Education by moving towards technical education. The aim of this study was to identify the performance of the administrative staf in the Palestinian universities in Gaza Strip. The researchers used the analytical descriptive method through a questionnaire distributed randomly to the sample of 320 administrative staf from the three universities. The response rate was (81.87%). The study reached a number of results, the most important of which is that there is a high level of performance from the point of view of the administrative staf , as (...) the percentage reached (81.51%). The results showed that there were no dif erences in the perception of the employees according to the variables “age, years of service, job level (manager, head of department, administrative of icer), place of work”. The results showed that there are dif erences in the perception of employees to perform the function depending on the university variable, where the results indicated that there are statistically significant dif erences between the Islamic University and Al-Aqsa University in the job performance in favor of the Islamic University. The study reached a number of recommendations, the most important of which is that the managements of the three Palestinian universities in Gaza Strip should give special attention to job performance in general and Al-Aqsa University and Al-Azhar University in particular. The Employees of universities should have the opportunity to participate in decision-making. The Management of the three universities should keep interest in continuous improvement of the performance of their employees. Enhancing the periodic evaluation of the job performance, informing employees about their evaluations, and giving them the chance to express their opinion about it. The study aimed at finding out the level of Entrepreneurial creativity among Palestinian university students through a study conducted on students from different disciplines at Al-Azhar and Al-Quds Open Universities in Palestine-Gaza Strip. The sample size was 120 students, which was divided equally between the two universities. A Entrepreneurial innovation scale of (15) paragraphs and (87.50%) was recovered. The study found that there is a good level of Entrepreneurial creativity among Palestinian university students which reached 68.51%. The study recommended the need to implement workshops and various activities to generate new creative ideas, activate the role of universities by guiding students entrepreneurs and contributing to the promotion of products and services of pilot projects and work to link them with large projects to ensure continuity. The study also recommended the importance of awareness of the idea of business entrepreneurship and its mission, the need to introduce some of the educational courses within the teaching plans related to entrepreneurship and creative innovation and the experiences of successful entrepreneurs. The study aimed to identify the level of promotion of entrepreneurship in the technical colleges in Palestine. The analytical descriptive method was used in the study. A questionnaire of 41 items was randomly distributed to the technical colleges in the Gaza Strip. The random sample consisted of (275) employees from the mentioned colleges, and the response rate were (74.5%). The results of the study showed that the technical colleges achieved a high level of promotion of entrepreneurship with a relative weight (...) of 73.45%. The results of the study showed that there is a high level of promotion of entrepreneurship (risk, preparedness, proactive competition, innovation orientation) in the technical colleges in Gaza Strip. The field of competition came in first place with a relative weight of 76.65%. In the second place came the field (the trend towards innovation) and relative weight (74.96%). In the third place came the field of pre-emptive preparedness with a relative weight of 74.07%. In the fourth and last place came the field of risk and a relative weight of 68.39%. The results confirmed that there are statistically significant differences in the promotion of entrepreneurship in the technical colleges in Gaza Strip due to the college variable in favor of UCAS. The results confirmed that there is no statistically significant relationship in the promotion of entrepreneurship in technical colleges in Gaza Strip due to the variable level of employment. The researchers suggest a set of recommendations, the most important of which is to draw the attention of the technical colleges to the importance of promoting entrepreneurship, because of their role in reducing the problem of unemployment, the importance of linking technical education and promoting entrepreneurship to the Palestinian society in general and Gaza Strip in particular. The importance of urging decision-makers in technical colleges to promote interest in leadership and to put their own courses in all technical education programs in these colleges, as well as enhancing the technical, technological and technical capabilities of technical education and keeping pace with the latest international standards by providing the necessary material resources. There is a need to urge researchers to conduct further studies of the future which deal with the same variables of the current study in the field of entrepreneurship and applied to other sectors. The study aimed to identify the creative environment of the technical colleges operating in Gaza Strip. The analytical descriptive method was used through a questionnaire which was randomly distributed to 289 employees of the technical colleges in Gaza Strip with a total number of (1168) employees and a response rate equal to (79.2%) of the sample study. The results confirmed the existence of a high degree of approval for the dimensions of the creative environment with a relative weight of (75.19%) (...) according to the perspective of the employees of the technical colleges in Gaza Strip. The results of the study showed a high level of creative environment (fluency, flexibility, originality, sensitivity to problems) in the technical colleges in Gaza Strip, where the field (fluency) ranked first and relative weight (76.86%), in the second place came the area (sense of problems) and relative weight (74.89%). The field of elasticity came in third place with a relative weight of (74.59%). Finally, the field of originality came in fourth and final rank with a relative weight of (74.41%). The results showed that there are differences between the technical colleges in the principles of the creative environment in all fields and the overall degree except for the field of flexibility. The most available colleges in these principles were the university college of applied sciences, and that was the least of the Faculty of Al-Aqsa Society. The results showed that there were differences according to the age variable in the areas of creative environment only in the sense of problems for age groups (less than 30 years) and (from 40 to 50 years). The researchers suggested a number of recommendations, the need to enhance the dimensions of the creative environment in technical colleges by working to improve the faculties of fluency, flexibility, originality and sensitivity to problems. The need to work on continuity and improve aspects of the creative environment of the colleges and the creation of new and innovative ways to support and develop and support these aspects combined. Necessity of technical colleges to continue to develop the creative environment (fluency, flexibility, originality, sensitivity to problems) for employees by engaging them in specialized training courses for creative thinking and problem solving. Developing work procedures with new innovative methods that will accomplish the various tasks quickly and accurately, and provide the effort, time and costs. The objectives of the study were to identify the reality of sustainability in technical colleges. The variables of sustainability included three main dimensions (innovation, processes, and community environmental aspects). The analytical descriptive method was used in the study. A questionnaire consisting of (39) items was randomly distributed to the technical colleges in the Gaza Strip. The population of the study consists of (289) employees of the colleges mentioned, the response rate was (79.2%). The results showed that the technical colleges achieved (...) a high level of sustainability in their operations with a total weight of 73.33%. where the field (environmental aspects of society) came first and with relative weight (73.97%), in the second place came the field (creativity and innovation) and relative weight (73.10%), finally, the field of operations came in third and last place with relative weight (72.92%). the results confirmed that there were differences between technical colleges in achieving sustainability, with the highest sustainability colleges being UCAS and least sustainable (CCA). The results showed that there were no differences between colleges in achieving sustainability according to the variable number of years of service. The researchers propose a number of recommendations, the most important of which is to increase attention to the dimensions of sustainability because of their role in the development and sustainability of technical education through enhancing and improving operations in technical colleges. Urging senior management and decision-makers to work in technical colleges to create, innovate, reward, and support their creators. The aim of this study was to identify the level of organizational climate prevailing in Palestinian universities from the point of view of the administrative staff. The researchers used the analytical descriptive method by means of a questionnaire randomly distributed among Palestinian university employees in Gaza Strip. The study was conducted on a sample composed of (280) employees. The response rate was (81.87%). The study found that there is a high degree of organizational climate in the Palestinian universities in Gaza (...) Strip from the point of view of the administrative staff. The percentage reached (69.96%). The results showed that there is a high availability for all areas of the organizational climate, with one exception being the extent of the participation of employees in decision-making came medium. The order of the fields was as follows: Technology used: 74.55%, nature of work: 71.80%, communication style: 71.32% Leadership: 68.98%, organizational structure: 68.05%, and finally staff participation of decision-making: 64.91%. The results showed that there were no differences between the samples according to the gender variable in their perception of the organizational climate, with the exception of one field of work, where there were differences in favor of males. The results showed that there are no differences in the perception of employees to the organizational climate depending on the age variable. The study aimed to identify the availability of the resource and partnership standard as one of the possibilities of excellence in Palestinian universities according to the European model. The study used the analytical descriptive method. The study was conducted on the university leadership at Al - Azhar and Islamic Universities, where the study population consisted of (282) individuals. The study sample consisted of (135) individuals, (119) of them responded, and the questionnaire was used in collecting the data. The study has (...) reached a number of results, the most important of which is the existence of a high standard of resources and partnership in the Palestinian public universities operating in the southern governorates. The fields of the resource and partnership criteria were as follows: (79.8%) management of internal and external partnerships; management of technical resources (technology) (76.4%), Buildings, equipment and resources (76%), Finance Management (72.8%). The study presented a number of recommendations, the most important of which is: Increasing the interest of universities in applying the criteria of resources and partnership as one of the criteria of excellence, increasing the interest of universities in managing finance and obtaining funding for their various activities, periodic maintenance of buildings and equipment and ensuring their suitability to the requirements of the educational process. The current study tries to verify the effectiveness of a training program in increasing Crowdfunding awareness. The sample was (50) students in CIS, who were purposively selected and distributed equally into a treatment and control group. The researchers designed the study tools (a training program to increase Crowdfunding awareness). The study findings revealed the existence of statistically significant differences between the treatment and control groups in favor of the former. Furthermore, there were statistically significant differences between the pre and the (...) post measures of the treatment group in favor of the post measures. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study for Crowdfunding training program in Arabic world. (shrink)
La obra de Lévinas propone asumir la ética como Filosofía Primera. Allí convergen dos fuentes de inspiración filosófica, el pensamiento judío y la fenomenología, y la experiencia histórica de persecución, violencia y desconocimiento del otro que exigió a Lévinas criticar el totalitarismo ontológico griego con el propósito de hacer justicia a la Alteridad y dar primacía así a la Responsabilidad para con el Otro sobre la Libertad autónoma del Yo. Luego, el autor retorna la crítica de Lévinas a la fenomenología (...) de la conciencia y a la ontología hermenéutica de Heidegger, con la que Occidente lleva a término su limitada opción por el conocimiento y la manifestación del Ser. Rubio y Lévinas, en tercer lugar, señalan hacia una hermenéutica encarnada de nuestras relaciones con el Otro, a una reivindicación de la antropología filosófica que recupere el Sentido desde el Otro. Finalmente, el autor se refiere al terna de la muerte en Lévinas, y subraya, en relación con la desaparición del maestro Rubio que, nuestro adiós a él, significa el 'ante Dios' de todas nuestras relaciones no tematizables con el Otro y antes que todo. Al final de su libro “La conciencia inexplicada”, Juan Arana señala que la nomología, explicación según las leyes de la naturaleza, requiere de una nomogonía, una consideración del origen de las leyes. Es decir, que el orden que observamos en el mundo natural requiere una instancia previa que ponga ese orden específico. Sabemos que desde la revolución científica la mejor manera de explicar dicha nomología ha sido mediante las matemáticas. Sin embargo, en las últimas décadas se han presentado algunas propuestas (...) basadas en modelos matemáticos que fundamentarían muchos aspectos de la realidad. Dos claros ejemplos provienen de Roger Penrose y Max Tegmark. Esto lleva a pensar en una posición no solo nomológica sino además nomogónica de la matemática. ¿Puede la Naturaleza estar fundada por las matemáticas como señalan algunos físico-matemáticos? Y en ese caso, ¿sería pertinente buscar una nomo-génesis de esta índole en la constitución de la conciencia? -/- At the end of his book “La conciencia inexplicada”, Juan Arana points out that nomology, explanation according to the laws of nature requires a nomogony, an account of the origin of the laws. This means that the order that we can observe in the natural World demands something prior to posit that specific order. Since the scientific revolution we know that the best way to explain that nomology has been through mathematics. Anyway, in recent decades a number of proposals based on mathematical models that found many aspects of reality has been offered. Two clear examples come from Roger Penrose and Max Tegmark. This drives us to think of a position of mathematics as not only nomological but also nomogonical. Can Nature be founded by mathematics as some physicists and mathematicians point out? And, in this case, would be relevant this kind of approach to search a nomo-genesis in the constitution of consciousness? (shrink)
En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. La tesis de la privacidad linguitica nace con el gesto fundador de la filosofía moderna que apoya toda legitimidad en la subjetividad y la conciencia. Ello da origen a dos problemas filos�ficos fundamentales, concernientes al mundo y al solipsismo. El siglo XX creyó encontrar en el lenguaje una salida a estos problemas. Wittgenstein es allí una pieza clave. Sin embargo las interpretaciones más influyentes de Wittgenstein enfocaron la crítica del lenguaje privado de tal modo que la salida debía permanecer en (...) el terreno epistemológico de las garantías o criterio de corrección (Malcolm, Fogelin, Kenny, Canfield, Tugendhat). Sostenemos que la interpretación propuesta por Kripke se apoya un un agudo diagnóstico de la fuente de estas dificultades, dándose cuenta que la refutación del lenguaje privado requería abandonar toda una concepción, la del realismo, que afectaban por igual al lenguaje privado y al público. Su argumentación, centrada en la semántica, irradia consecuencias más allá de la misma. Su "solución escéptica" al establecer que los juicios de corrección, entendidos como básicos y primitivos, sólo poseen sentido en el marco de una comunidad uniforme en sus juicios, coloca al discurso filosófico en un nuevo terreno. The temporality of human action is very peculiar: different from the cosmic time and even paradoxical, inasmuch as it is really a circular time. The aim of this essay is to study this circularity in the sphere of human activity through the relations between the notions of potency and habit in the Aristotelian Ethics, among others structural conditions of the action. These structural conditions are explored by Aristotle as those which make possible to judge the actions.
Esta obra compila los estudios presentados en las I Jornadas de Filosofía del Instituto CEU de Humanidades Ángel Ayala y está prologada por Abelardo Lobato, O. P. Los filósofos tienen el deber de buscar y alcanzar la verdad apelando a las fuerzas de la razón, la cual, por cierto, no impide otras vías genuinas de conocimiento, como la fe. La búsqueda intelectual exige un trabajo de análisis que debe afinarse ante las obcecaciones que a menudo se interponen en el horizonte (...) de la existencia humana. En no pocos momentos de la historia ha habido claudicaciones generalizadas ante esa búsqueda, olvidos más o menos conscientes de que las verdades se alcanzan si se mantiene la esperanza de sabiduría y el amor a ella. El relativismo y el escepticismo se presentan casi como el polo opuesto de esa esperanza y ese amor; como una consecuencia de la “con-fusión” cultural, de las mentiras interesadas y de la desidia moral de algunas sociedades. La nuestra, la europea occidental, es una de ellas. El relativismo afecta al modo de pensar y de comportarse del hombre y es habitual que le lleve por vericuetos que a la postre terminan dañándole a él y a sus congéneres. En este libro se analizan algunos errores que han llevado a suscribir las tesis del relativismo y a rechazar la posibilidad de dar con algunas verdades comunes para todos. La obra tiene dos partes, una histórica y otra temática. Las páginas con enfoque histórico estudian las tesis que sobre el relativismo han mantenido algunos pensadores o corrientes de la filosofía. De su lectura se puede extraer la conclusión de que el fenómeno del relativismo es tan viejo y tan actual como el propio hombre y su apertura inteligente a la verdad. Filósofos de la época antigua de la talla de Protágoras, Pirrón o los “Académicos” coetáneos de San Agustín; modernos como Descartes; contemporáneos como Wittgenstein o Kuhn han dejado huellas que luego abrieron el camino hacia un régimen de pensamiento en que el hombre abandona la posibilidad de admitir verdades universales. Algunos argumentos favorables al relativismo —y, más aún, algunas actitudes “propedéuticas” de él— se han ido instalando culturalmente hasta consolidarse de manera cada vez más indiscutida. La segunda parte analiza el relativismo de forma temática, como un asunto abordable desde las diversas ramas del saber filosófico. Así, se tratan las repercusiones que tiene esta forma de pensamiento en la pragmática, la lógica, la estética o la religión, y se intentan desenmascarar los tópicos y falsos argumentos que justifican un comportamiento ético o religioso “abierto a todas las opciones”. El problema del acceso a los medicamentos no obedece siempre al rol cuestionable de la industria farmacéutica, como sí en gran medida a los Estados, responsables inmediatos por el abandono de millones de pacientes en los países bajo el umbral de pobreza y desarrollo. Para evidenciar esta información se plantean tres escenarios en los que las políticas públicas aún tienen una gran tarea pendiente: la ausencia de regulación y vigilancia, la permisividad con prácticas seudocientíficas y el abandono en regiones apartadas. A lo largo del texto, y a manera de conclusión, se propone un llamado de atención a los gobiernos, para que reorienten sus acciones y hagan presencia en un panorama que usualmente se deja a un lado cuando se aborda el problema del acceso a los medicamentos. El fenómeno de la corrupción es un cáncer que afecta a nuestro país y que es necesario erradicar; éste diluye las oportunidades de desarrollo económico y social, privilegiando la sola conjunción de intereses particulares, de actores políticos en acuerdos no legales en beneficio propio, los cuales derivan en actos de corrupción. Estudios recientes señalan que el nivel de corrupción presente en un sistema político está directamente relacionado con el tipo de estructura institucional que lo defina (Boehm y Lambsdorff, 2009), así (...) como de la ineficacia de los organismos de control (Casar, 2015; Cárdenas, 2010; Rojas, 2010; Carbonell, 2009; Restrepo, 2004), por lo que se requiere de la acción ciudadana para combatir la corrupción (Sandoval, 2010; Villanueva, 2006). Este trabajo, centra nuestra atención en la administración pública federal, presentando como propuesta para empoderar la acción ciudadana en el combate de la corrupción y en el Sistema Nacional Anticorrupción; la figura de Whistleblowers o generador de alerta ciudadana, desde dos principios fundamentales: i) reconociendo la obligación del ciudadano de informar sobre actos de corrupción y ii) el otorgamiento por parte de la autoridad de la protección de testigos. Estas dos acciones derivarán en dos resultados importantes: i) Consolidar la denuncia ciudadana para informar a la sociedad sobre actos de corrupción y ii) y el ejercicio de la libertad de la información a fin de que la sociedad este en posibilidades de ser informada sobre actos de corrupción. Estas acciones permitirán promover y consolidar una cultura de la denuncia de actos de corrupción que pueden ser constitutivos de delito como pilar fundamental en el Sistema Nacional Anticorrupción en México. En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. (shrink)
In this paper I address some aspects of the discussion of Aristotle against materialism. I take as a starting point the inaugural sentence of Phys. 2.4, where Aristotle refers to the endoxon that there are things which are (einai), and things which become or are generated (gignesthai) by chance. In the first place, I show that Aristotle would have ascribed to the materialists (especially Empedocles) the opinion that things like animals and plants can be (and not only become) by chance. (...) I shall argue that, in fact, this thesis implies that it is not only the compound that is generated, but also the form or eidos of the living being. To this extent, I propose that there are strong reasons for Aristotle to reject that living beings may be by chance, and to circumscribe chance to that which becomes or is generated. In other words: chance can occur within processes of generation but has nothing to do with the causes and principles of those processes. Thus, this repositioning of chance within the sole field of what becomes is closely connected to the causal priority of the eidos in the processes of generation. (shrink)
This article analyzes the epistemological legitimation of mathematics in natural philosophy in the seventeenth century. In the Renaissance it was claimed that mathematics does not meet the Aristotelian criteria of scientificity, and that it did not explain the efficient and final causes. So, its critics, inspired by the Aristotelian tradition, rejected the first attempts to mathematize natural philosophy. The epistemological conditions involved in the debate are examined on the scientific nature of mathematics and its relevance to natural philosophy. A historiographical (...) tour of the mathematization of nature is made to provide new weighing elements with respect to a historically and philosophically more conceptual characterization of the emergence of modern science. The article critically develops Nietzsche's presence in Heidegger's second great work, Contributions to Philosophy. Heidegger considers Nietzsche the last metaphysicist. However, being Western Metaphysics' zenith is the greatest thing that can be said of a thinker, since being the one who brings to completion a school of thought makes one, at the same time, the precursor of the ‘other’ begining and thus his concept of God's dead, nihilism and truth really can open the door to a kind of post-metaphysical thought, (...) as Heidegger would say, the thought of the history od being. Therefore, between Nietzsche's "God is dead" and Heidegger's "last God" there exists continuity and parallelism that needs future development. (shrink)

The idea of Culture led by Social Sciences presents emotions as if they were difficult to measure, and consequently, from the point of view of the interpretation of Cultural Practices, bothering. The secondarysation (and even, the marginalisation) of emotions among the interpretaive arguments, is linked to a linear and diachronical perspective on the social fact, more than to a forgotten aspect. The traditional ethnographer’s incapacity on including emotional worlds in their reaserches produces traces of a fake objectivity and it is (...) the source of important inexactitudes (or even falsations). -/- Along three reaserches about Urban Culture, introduced in the context of the Sociocultural Process Workshop of the La Universidad del Zulia (“The Affective Dispositifs of Hugo Chávez’ Phenomenom”, “The Opprobium Laberynth: Sexual Chanceros in Maracaibo” and “Walking Throught the Night, Things Get Confused. Reflections about Transgendered, Body and Power in Maracaibo”), it is possible to see conditions for resolving some aspects obout meaning/sense and emotions/intellect tensions, using the body as an emotional territory and as an ethnographical resource. Those reaserches try to evaluate the affective consistence of the urban territory, from the transgendered’s street fronteers, from chanceros and from the “no deviated” society, until the Chávez’ phenomenom, throught the corporal imago between the subjects and the reaserchers. -/- At the end, it is possible to conclude about some useful principles of the idea of Culture that sees the body as a bridge to the missed subjectivity of knowledge. The legislative activity presents a multiplicity that chance exaggerates, a routine practice that falsifies the unit, or a mixture of both, without a specific art having managed to reduce it to a true unit, by means of a theory making its problems more understandable and its solutions more understandable and realizable. The true art of legislation, that had been lost, is reconstructed here from classical tradition, which conceives laws as wise and eloquent civic speeches and rhetoric, the art of persuading (...) with wise and eloquent civic speeches, as its methodical base recognized for almost two thousand and five hundred years. The above mentioned theoretical hypothesis and its respective methodical base enrich the art to speak well (ars bene dicere) and found the art to legislate well (ars bene legislandi), as it will be proved in this book, in such a way, that the return to ancient rhetoric will be a progress for the art of legislation. Pensar es trabajar en transformar el pensamiento, escribía Meschonnic. La crítica es, ante todo, eso: reflexionar precisamente sobre lo que nuestros saberes nos impiden saber. Un gesto que transforma a partir de la interrogación misma. En diálogo con el Profesor Duncan Kennedy, el presente trabajo pretende repensar la relación entre enseñanza, crítica y acción en el campo jurídico, insistiendo en la necesidad de reinscribir la crítica no como develamiento de una “verdad esencial” oculta sino como una praxis que transforme a (...) partir de los propios límites que el orden simbólico instituye. Asimismo el artículo aborda la pregunta por la interpretación judicial sugiriendo la necesidad de desplazar el significante “trabajo jurídico” hacia la órbita de la “acción” en sentido arendtiano. El trabajo o la fabricación a diferencia de la acción se produce en aislamiento. La acción, en cambio, necesita de otros. Es por ello que se ofrece como cambio y sobre todo: ausencia de cálculo. De acuerdo algunos investigadores el ruido es concebido típicamente como factor perjudicial en el desempeño cognitivo afectando la percepción, toma de decisiones y la función motora. No obstante, en estudios recientes se asocia al ruido blanco con la concentración y la calma, por lo tanto, esta investigación busca establecer el impacto del ruido blanco binaural en el desempeño de la memoria de trabajo y visual a corto plazo, la actividad cerebral alfa – beta y la atención – meditación, mediante el (...) uso de dos estímulos auditivos con rangos de frecuencia de (100 a 450hz) y (100 a 750hz). Este estudio se realizó en la ciudad de Montes Claros, República de Brasil, donde se evaluó a siete participantes (n = 7) con una edad promedio de 36.71±, y dos grupos de edad (GP1) 21 a 30 y (GP2) 41 a 50 de escolaridad media a universitaria. Dentro del proceso experimental se realizaron pruebas de memoria visual a corto plazo mediante el uso de la batería de evaluación cognitiva general CAB de CogniFit™, así como el registro de actividades cerebrales mediante el uso de Electroencefalograma monopolar y los algoritmos eSense™. Con los resultados obtenidos y mediante el uso de pruebas estadísticas podemos inferir que el ruido blanco binaural con oscilaciones de 100 a 750 Hz contribuyeron con el rendimiento de la memoria visual de trabajo a corto plazo. Una de las tesis que tradicionalmente han sido defendidas por la tradición del positivismo jurídico es la tesis coactiva, según la cual el derecho consiste en un conjunto de normas coactivas, en el sentido de impuestas por medio de la fuerza. Pero, sin abandonar esta corriente, ha habido históricamente diversas maneras de entender las relaciones entre derecho y fuerza. Si, pues, hasta comienzos del s. XX era opinión común la idea de que el derecho constituía un conjunto de mandatos o (...) normas de conducta cuya eficacia se garantizaba a través de la amenaza del uso de la fuerza coactiva a los transgresores de aquéllas; a lo largo del siglo pasado, empero, algunos autores muy destacados dieron en sostener la opinión de que la fuerza disponible por jueces y funcionarios venía a constituir sustancialmente el objeto mismo de toda regulación jurídica. Según esta última concepción, el derecho tendría primordialmente la función de articular las condiciones de legitimidad para el uso de la fuerza, designando a los sujetos a los que se encomienda tal uso y determinado los casos y modalidades en los que pueda utilizarse. Entre quienes sustentan la primera tesis, que afirma que la fuerza constituye la garantía del derecho, es lugar común citar a Austin y, a menudo, se cita también a Jhering. Entre los defensores de la segunda tesis común es habitual mencionar a Kelsen, Olivecrona y Ross, habiéndose sustanciado una polémica entre Bobbio y Olivecrona en punto a determinar si fuera menciona Olivecrona o fue Kelsen el primero en adoptarla. Sin embargo, es problemático incluir a Jhering dentro del primer grupo y no dentro del segundo, en cuyo caso habría que atribuirle la primera formulación histórica de la tesis. Este trabajo, de carácter histórico, parte de la citada polémica y trata de verificar la constancia de la segunda tesis en las obras no sólo de Kelsen y Olivecrona, sino sobre todo de Jhering. This article compares the alleged ‘neo-Parmenidian’ philosophy of Severino with the ‘anti-Parmenidean’ philosopher Polo. Following Polo’s view, Severino’s fundamental method is shown to consist in taking on Parmenides’ basic notion of identity and projecting it onto Hegel’s dialectic. On using the principle of non-contradiction, Severino recurs predominately to the mental operation of negation.
Con la finalidad de fundamentar y reforzar su teoría de los bienes primarios, J. Rawls introduce, en el §65 de Una teoría de la justicia, la idea de “principio aristotélico”. Se discuten las dificultades que implica aceptar dicha noción, así como las limitaciones de la idea de bien que subyace en dicho principio. Se busca mostrar que la concepción de bien que Rawls presenta allí padece de “insuficiencia moral” y se defiende la tesis de que su aproximación a la idea (...) de bien opaca la dimensión práctica de la racionalidad. Resumen La pesquisa procura el reconocimiento de los aportes filosóficos de Moisés Vincenzi Pacheco. Específicamente, se analizan los considerandos vincenzianos sobre la no existencia del cambio y de la reducción al absurdo como herramienta metodológica para el estudio de las nociones de cambio y movimiento. Vincenzi logra despuntar al término de su reflexión una mirada contestataria a la concepción de sincronía y presenta un esbozo hacia una filosofía del infinitismo. Moisés Vincenzi, un filósofo imprudente ante la nada y testigo de (...) la eternidad, el filósofo centroamericano más importante de los primeros decenios del siglo XX. Tras analizar sucintamente las consecuencias científicas y filosóficas de la identidad mente-cerebro, se señalan argumentos a favor y en contra de mantener el debate mente-cerebro. En particular se consideran las nuevas técnicas de exploración del cerebro como argumento en contra de tal debate. Las deficiencias e insuficiencias de tales técnicas aconsejan mantener el debate mente-cerebro y no asumir el materialismo.
En el presente texto se aborda la discusión entre economistas y abogados acerca del control judicial en aspectos económicos con el propósito de mostrar el carácter democrático de éste. El análisis contendrá tres partes: (i) contextualización del debate a partir del principio de distribución de poderes; (ii) planteamiento del debate a partir de dos lecturas de la Constitución de 1991, ya sea que se enfatice en el liberalismo clásico contenido en la carta o en lo “social” del Estado Social de (...) Derecho de la misma; (iii) por último, se abordarán algunas de las principales críticas al control constitucional en cuestiones económicas, así como el análisis de la legitimidad y conveniencia de dicho control. En esta última parte se hará especial énfasis en la objeción de que la intervención judicial en la economía sería antidemocrática y la respuesta que a la misma puede plantearse. (shrink)
L'objectiu d'aquest article és oferir un anàlisi dels arguments principals del Tractat sobre els Principis del Coneixement Humà, de G. Berkeley. Aquests arguments -que es troben a I, §4, I, §5-7 i I, §23 de l'obra de Berkeley- tenen como a objectiu demostrar la inconcebibilitat d'un món extern de caràcter físic. Argumentaré que la validesa d'aquests tres arguments depèn del anomenat «principi de semblança». La conclusió a la que arribaré és que l'acceptació del principi de semblança -i, en conseqüència, dels (...) arguments que d'ell en depenen- es problemàtica, però que, en qualsevol cas, el principi es manté com a una bona crítica reductiva al materialisme representacionalista de John Locke, en tant que aquest no pot negar les premisses que duen a la seva justificació i que la seva defensa contra dit principi presenta un seguit de problemes als quals sembla no haver-hi resposta.
