Realists about group agency, according to whom corporate agents may have mental states and perform actions over and above those of their individual members, think that individual agents may switch between participating in individual and corporate agency. My aim is, however, to argue that the inescapability of individual agency spells out a difficulty for this kind of switching – and, therefore, for realism about corporate agency. To do so, I develop Korsgaard's notion of plight inescapability. On my take, it suggests (...) that individual agents are continuously faced with fully exercising their own individual agency (absent external limits at the time of its exercise). But then individual agents may not switch to acting as members of corporate agents, in the sense of taking on irreducible mental states that differ from their own. As it nevertheless is possible to participate fully in the action of a corporate entity, this incompatibility between individual and corporate mental states suggests a challenge for group agent realism. Critics of social injustice argue that the agent of transformative social change will (or should) be a mass agent; namely, an agent that is large, complex, and geographically dispersed. Traditional theories of collective agency emphasize the presence of shared intentions and common knowledge, but mass agents are too large for such cohesion. To make sense of mass agency, I suggest a new approach. On the solidarity theory of mass agency, a mass agent is composed of (a) organizers who intend to (...) fight for social change and (b) supporters who are in solidarity with organizers. (shrink)

Katherine Hawley was skeptical about group trust. Her main reason for this skepticism was that the distinction between trust and reliance, central to many theories of interpersonal trust, does not apply to trust in groups. Hawley’s skeptical arguments successfully shift the burden of proof to those who wish to continue with a concept of group trust. Nonetheless, I argue that a commitments account of the trust/reliance distinction can shoulder that burden. According to that commitments account, trust is a distinctive kind (...) of reliance grounded in a positive appraisal of features of the trustee’s practical rationality, foremost their commitments and their capacity to act on those commitments. This is one way we can make sense of the difference between trusting and relying on individual people. I argue it is also a way we can make sense of the difference between trusting and relying on groups. (shrink)

Most business ethicists maintain that corporate actors are subject to a variety of moral obligations. However, there is a persistent and underappreciated concern that the competitive pressures of the market somehow provide corporate actors with a far-reaching excuse from meeting these obligations. Here, we assess this concern. Blending resources from the history of philosophy and strategic management, we demonstrate the assumptions required for and limits of this excuse. Applying the idea of ‘the state of nature’ from Thomas Hobbes, we suggest (...) that corporate actors would be excused from duties if complying with them threatened their vital interests. We show how this excuse is not available for most individuals within firms; instead, it is an excuse perhaps available to firms themselves, but only given substantive assumptions about corporate personhood. For those willing to make these assumptions, we apply the competitive advantage construct to delimit the scope of this excuse. We suggest that firms are excused from fulfilling an obligation when complying leads to a competitive disadvantage, as this imperils the firm’s vital interests. After revealing why this excuse does not generalize, we conclude by considering when we should reform the market to avoid the legitimacy of this excuse. (shrink)
