In dominant discourses, migrants are mostly perceived as either victims or villains but rarely as political subjects and democratic constituents. Challenging this view, the aim of the article is to rethink democracy with respect to migration struggles. I argue that movements of migration are not only consistent with democracy but also provide a decisive impetus for actualizing democratic principles in the context of debates about the crisis of representation and post-democracy. Drawing on the work of Jacques Rancière, Étienne Balibar and (...) Ernesto Laclau and Chantal Mouffe, I develop a theory of radical democracy as practice, which, starting from the proposed notion of ‘democratic difference’, goes beyond the fixation on democratic regimes and focuses on contentious practices of enacting democratic principles. I articulate these theoretical concepts by analysing how refugees in Germany have managed to break out of a marginalized position and have challenged their denial of rights through a protest march. Superficially, citizenship appears relatively simple: a legal status denoting political membership. However, critical citizenship studies scholars suggest that citizenship is first and foremost a political practice. When non-citizens, such as irregularised migrants, constitute themselves as citizens through their actions, irrespective of legal status, these practices of citizenship have transformational potential because they are extra-legal. Yet, there is an ambivalence here: rights-claiming migrants tend to frame their key demands within the terms of the law often by calling for the regularisation of (...) their status. This article addresses this ambivalence by adopting a ‘deconstructive method’ to investigate the legal dimensions of citizenship as sites of theoretical and political intervention. It is argued that practices of rights-claiming by irregularised migrants are important to grasp because they mobilise the paradoxes inherent to the fact that universal rights are enshrined in the constitutional texts of modern citizenship in order to generate new legal meanings and horizons of justice. This hypothesis is explored through a series of illustrative examples of rights-claiming taking place within and beyond the formal confines of legal orders. In so doing, the article sets out a novel conceptual framework for analysing how migrants’ claims to justice strategically negotiate citizenship in its legal form. (shrink)

In 1992, the Frankfurt scholar Ingeborg Maus launched a polemical attack against then current narratives of democratic protest, objecting to the languages of ‘resistance’ or ‘civil disobedience’ as defensive, servile and insufficiently transformative. This article explores in how far the language of constituent power can be adopted as an alternative justificatory strategy for civil disobedience in transnational protests. In contrast to current approaches that look at states as agents of international civil disobedience-as-constituent power, I suggest we look at political movements. (...) I focus on the example of the Democracy in Europe Movement 2025 which understands itself as a pan-European movement of civil disobedience, at the same time working towards an articulation and exercise of constituent power among the people of Europe. If the instance of human rights cannot ensure the protection of the rightless, as Arendt famously claimed, how can the rightless struggle for freedom and equality? In this essay, I attempt to answer this question by reconsidering Arendt’s influential critique of human rights in light of the two polar responses it evoked from contemporary French philosophers Jacques Rancière and Étienne Balibar. Rancière, who objects to Arendt’s delimiting of the political, finds her argument excluding and dangerous. Balibar, on the other hand, (...) believes that it conveys an immense potential for politics to come, as it points to the dialectical political truth of equaliberty. In the following, I show the problematics of Rancière’s ingenious formulation of rights, and the answer Balibar’s original interpretation of Arendt’s thought might suggest in response. I contend that working through Rancière’s critique of Arendt’s argument and Balibar’s affirmation of it not only highlights the merits of her critical account but also points to the fundamental relation between Arendt’s work on rights and her later discussions of the human condition of non-sovereignty and the power of promises. I believe that such a reading can contribute to our interpretation of Arendt, and pave new routes of action for non-citizens (such as refugees, stateless persons and subjects of military occupation), who cannot employ the authorities’ strength for their protection. Taking the ‘Fridays for Future’ movement as its starting point, this article conceptualizes and defends youth disobedience, understood as principled disobedience by legal minors. The article first argues that the school strike for climate can be viewed as civil disobedience. Then, the article distinguishes between various forms of youth disobedience. Building on the democratic rationale for civil disobedience, the remainder of the article argues that there is a special justification for youth disobedience. To show this, it argues that children are (...) wrongfully excluded from political participation and that principled law-breaking can be an important remedy to this exclusion. The upshot is that adults should engage seriously and leniently with youth disobedience. (shrink)

In recent decades, the boundaries of democratic polities have been increasingly contested in the field of democratic theory. The theoretical discussion has focused on the philosophical norms that should demarcate the boundaries of democratic constituencies. This article defends and explores an alternative approach that, instead of focusing solely on theoretical norms, theorizes democratic processes of boundary-making. This alternative approach addresses the multiplicity of intertwined boundaries bounding demos and agents capable of transforming and democratizing these multiple boundaries. I characterize a category (...) of agents who democratize symbolic everyday boundaries as transboundary associations. The democratization of the symbolic boundaries of everyday interactions is a necessary condition for the democratization of formal boundary-making, since in democratic orders and societies, institutions cannot simply impose boundaries on people. Transboundary associations produce sites for incipient democratic politics that transcend current institutional and symbolic boundaries, producing possibilities for reciprocal boundary-making. Rule is commonly conceptualized with reference to the compliance it invokes. In this article, we propose a conception of rule via the practice of resistance instead. In contrast to liberal approaches, we stress the possibility of illegitimate rule, and, as opposed to critical approaches, the possibility of legitimate authority. In the international realm, forms of rule and the changes they undergo can thus be reconstructed in terms of the resistance they provoke. To this end, we distinguish between two types of (...) resistance—opposition and dissidence—in order to demonstrate how resistance and rule imply each other. We draw on two case studies of resistance in and to international institutions to illustrate the relationship between rule and resistance and close with a discussion of the normative implications of such a conceptualization.
