Kracauer’s rehabilitation in the 1990s sidelined his Marxist framework of the middle-to-late Weimar era in favour of the then still dominant if decaying paradigms of poststructuralism and postmodernism. It was also silent on the relationship between Kant and Marxism in Kracauer’s work. This essay addresses these weaknesses by arguing that Kracauer transcoded the structure of Kant’s ‘problematic’ around reification into a Marxist framework in the middle-to-late Weimar period. The essay considers how Kracauer conceived the mass ornament as a site of (...) reification and critical pedagogy. It explores his strategies of de-reification and their overlap with Walter Benjamin and the ruptures and continuities between the radical Weimar work and his later Theory of Film. The essay argues that the Theory of Film can be better understood as a transcoding of Kant’s philosophy of the aesthetic in the third Critique into the film camera itself, although the Marxian framework of the Weimar period is now considerably attenuated. Feelings not only have a place, they also have a time. Today, one can speak of a multifaceted renaissance of feelings. This concerns philosophy itself, particularly, ethics. Every law-based morality comes up against its limits when morals cease to be only a question of legitimation and begin to be a question of motivation, since motives get no foothold without the feeling of self and feeling of the alien. As it is treated by various social theories and psychoanalysis, the self is (...) not formed through the mere acquisition or change of roles, but rather through a process that is susceptible to crises, a process shaped by affective bonds and separations. Learning, which is the theme of pedagogy, loses its hold whenever it is confronted by disinterest and listlessness. In neurobiology, the increased significance of those zones of the brain that are connected with the realization of feelings makes the brain, accordingly, no mere apparatus that processes data, but a living organ that selects and “evaluates” what is “important.” Finally, cross-cultural comparison shows the extent to which the one-sided preference for understanding and willing, which is the mark of Western rationalism, arises from a typical, not to mention a highly masculine attitude toward the world and life, as many different studies on gender difference stress (In reference to this perspective, see Seethaler, Gefühle und Urteilskraft. Ein Plädoyer für die emotionale Vernunft, 1997). The following reflections provide a historical orientation directed toward a new determination of feelings. Este trabajo intenta mostrar en primer lugar que las diversas interpretaciones de la identidad proporcionadas por tendencias recientes en la fenomenología pueden ser reunidas en dos grupos diferentes. De un lado, se ha proporcionado una descripción de los movimientos, estructuras u órdenes en que supuestamente se dispersa o descentra la subjetividad (J. Patocka,H. Rombach, B. Waldenfels). Del otro, se ha sostenido que la subjetividad se desarrolla sobre la base de una dimensión emocional originaria como una respuesta a la exigencia de (...) responsabilidad por los otros (M. Henry, E. Levinas, P. Ricoeur). En segundo lugar, el artículo procura poner en claro que las fenomenologías posthusserlianas no pueden eludir el sentido primario de la identidad que Husserl ha designado con el nombre de polo-yo a fin de poner de relieve dentro de la mónada un momento de centralización y unidad por el cual "el ego mismo es existente para sí mismo en una evidencia continua" (Hua. I, 1 00). Lo cual significa que el ego se percata de sí mismo de un modo radical y peculiar invariablemente involucrado en toda experiencia. Este análisis sugiere además que Husserl anticipa algunas posiciones de la segunda tendencia cuando indaga retrospectivamente un horizonte indiferenciado o descubre un modo de impatía que escapa a la objetivación. En el presente artículo se arriesga una nueva interpretación del concepto kantiano de autonomía, abordándolo desde una perspectiva “heterónoma”. En efecto, sin soslayar la interpretación ya clásica de aquél se indaga sobre la posibilidad de pensarlo como tributario de una heteronomía que señala de alguna manera a la autonomía una dignidad sobre la cual ésta no puede tener prácticamente ninguna injerencia. Se pone de relieve así pues el hecho de que esta dignidad inviolable marca una diferencia práctica más radical que (...) la identidad lógica sobre la que se basa la autonomía y sobre la que descansa la ontología en cuanto tal. No constitucionalismo contemporâneo ou neoconstitucionalismo os princípios constitucionais acolhem, normativamente, os principais valores e opções morais e políticas da comunidade. Os direitos fundamentais, muitas vezes são erigidos sob a forma de princípios normativos, que por sua vez encontram abrigo nos Textos Constitucionais atuais. A compreensão mais extensa de Dworkin sobre o que é o Direito, em uma perspectiva interpretativa, não se explica e nem se compreende sob a visão do positivismo jurídico. Não é despiciendo lembrar que um dos pressupostos metodológicos (...) que acode a toda a doutrina positivista é a separação entre Direito e Moral. Assim, a compreensão dos princípios normativos, com a sua potencial recorrência a valores e opções políticas fundamentais, quebra esta suposta separação, ainda mais quando se encontram estes princípios em uma Constituição que se estabelece no centro de importância e significado de toda a ordem jurídica, irradiando os seus princípios constitucionais na compreensão e interpretação do sistema jurídico e consequentemente, rematerializando e ressubstancializando todo o Direito. Portanto, na perspectiva mais extensa do Direito, ressignificada pelo neoconstitucionalismo, uma Constituição que não abrigue direitos humanos fundamentais, sob a forma de princípios normativos e em caráter emancipatório, não pode ser reconhecida como uma verdadeira Constituição. É o que se pretende refletir e demonstrar no presente artigo, com o emprego de pesquisa bibliográfica em autores autorizados sobre o tema. (shrink)

In his 2009 monograph, Darwinian Populations and Natural Selection, Peter Godfrey-Smith accuses biologists of demonstrating ‘Darwinian Paranoia’ when they engage in what he dubs ‘agential thinking’. But as Daniel Dennett points out, he offers neither an illuminating set of examples nor an extended argument for this assertion, deeming it to be a brilliant propaganda stroke against what is actually a useful way of thinking. Compared to the dangers of teleological thinking in biology, the dangers of agential thinking have unfortunately rarely (...) been discussed. Drawing on recent work by Samir Okasha, I attempt to remedy this omission, through analyzing the nature of agential thinking, and providing a philosophical treatment of the unexamined dangers in this peculiar, yet tempting way of thinking. Kant’s teleology as presented in the Critique of Judgment is commonly interpreted in relation to the late eighteenth-century biological research of Johann Friedrich Blumenbach. In the present paper, I show that this interpretative perspective is incomplete. Understanding Kant’s views on teleology and biology requires a consideration of the teleological and biological views of Christian Wolff and his rationalist successors. By reconstructing the Wolffian roots of Kant’s teleology, I identify several little known sources of Kant’s views on biology. I argue that (...) one of Kant’s main contributions to eighteenth-century debates on biology consisted in demarcating biology from metaphysics. Kant rejected Wolffian views on the hierarchy of sciences, according to which propositions specifying the functions of organisms are derived from theological truths. In addition, Kant argued that organic self-organization necessitates a teleological description in order to show that self-organization does not support materialism. By demarcating biology and metaphysics, Kant made a small yet important contribution to establishing biology as a science. (shrink)

In this essay, I discuss Kant’s views on the “American race.” Robert Bernasconi has pointed out that more research on the sources of Kant’s ideas on non-white races is needed in order to have a better understanding of his racism. This essay responds to that call in order to show how Kant contributed to on-going discussions on the causes and meaning of human differences. However, I will also focus on his influence on his contemporaries. The reason for doing so is (...) two-fold. Firstly, I will question Irene Tucker’s recent attempt to show that skin color was considered a racial sign because of its supposed self-evidence and immediate legibility. By way of a presentation of Kant’s views on the “American race,” I will show that race mixing formed the core of Kant’s racial theory and not the alleged immediacy of racial sight. Secondly, I will focus on his influence in order to question the popular idea that Kant had in his late work developed second thoughts on his racial hierarchy. His appraisal of the work of one of his contemporaries clearly shows that the matter is far more complicated than suggested in these interpretations of Kant’s racial work. (shrink)

Although much attention has already been paid to Kant’s ideas on race, more research is needed to determine the sources that he used to support his portrayal of non-white races. A comprehension of the intellectual context gives us the opportunity to see the way in which Kant wished to contribute to discussions on inheritable human characteristics and the inferiority of certain races. This article will emphasize the relevance of the views of Joseph Priestley and Alexander Wilson for Kant’s hypothesis on (...) the relation between phlogiston and the black race. This allows us to comprehend the methodology that Kant prescribed for natural history and its consequences for his understanding of the inferiority of the black race. (shrink)

Los textos de Ernst Tugendhat sobre mística están acompañados de una serie de referencias a la experiencia estética. Dadas estas referencias y la importancia que puede atribuirse a ellas en el propósito de Tugendhat de aclarar el sentido de lo místico, en este trabajo exploro la posibilidad de responder positivamente a esta pregunta: ¿Puede la experiencia estética comportar algunos de los rasgos de la experiencia mística? El punto de partida en mi propósito será atender a la reflexión de Tugendhat en (...) torno al término "asombro" en el contexto de la experiencia estética. A continuación doy las razones por las cuales, según el autor, la expresión "¡qué asombroso que exista el mundo!" tiene, en efecto, el sentido que Wittgenstein negó para ella. Concluyo mostrando que quien, con este tipo de expresiones, afirma la belleza del mundo no solo expresa la emoción que comporta el asombro; expresa también una disposición para asumir una actitud mística. Ernst Tugendhat's works on mysticism are provided of a series of references to the aesthetic experience. Based on these references, and the significance they may be attributed in Tugendhat's purpose to clarify the sense of mysticism, in this paper I explore the possibility to answer affirmatively the question: Can the aesthetic experience imply some of the traits attributed to the mystical experience? My starting point to get the answer is to focus on Tugendhat's reflections on the term "astonishment" in the context of the mystical experience. i then give the reasons that, according to Tugendhat and opposed to Wittgenstein, may make us think that the expression 'How astonishing that the world exists!' has indeed a sense. Finally, i conclude showing that anyone using expressions like this to affirm the beauty of the world, not only expresses the emotion implied by his astonishment: he also expresses a disposition to assume a mystical attitude. Some ideas expressed in the collective monograph Universality in Morality (2020), edited by Ruben Apressyan, are here critically examined. The book is based on the results of a large-scale study by professional ethical philosophers devoted to the question of the nature of universality in morality and the mechanisms of universalisation of individual maxims and norms from antiquity to modern ethical theories, represented above all by the analytical tradition in philosophy. Of great interest is the analysis of related phenomena in morality, (...) which makes it possible to determine the causes and nature of the transformation of morality in different eras and the accompanying change in the terminological apparatus of absolute ethical universalism, considered to be the starting point in the analysis of key modern concepts of moral universality. The article also suggests possible avenues for continued research in this area which could prompt modifications not only to the history of the concept of universality in morality, but also to our assessment of the contribution of individual authors and entire eras to the progress of human civilisation. This concerns above all the moral theory of contractarianism and the Enlightenment. Focus on their ideas goes a long way to determining the direction of current historical-philosophical research that reconstructs the history of ethical teachings and individual concepts. The importance attached today to a new view of the theory of the social contract, considered not only from socio-political but also from moral positions, forces us to approach in a new way the question concerning the universality of the key philosophical categories developed within this theory throughout its history. Elaborating the ideas set forth in the monograph, the author also stresses the relevance of the problem of justifying the thesis about the moral law as an analogue of the universal law of nature in the modern context. Altruism and cynicism are two fundamental algorithms of moral decision-making. This derives from the evolution of cooperative behavior and reciprocal altruism and the need to avoid being taken advantage of. Rushton (1986) developed a self-report scale to measure altruism, however no scale to measure cynicism has been developed for use in ethics research. Following a discussion of reciprocal altruism and cynicism, this article presents an 11-item self-report scale to measure cynicism, developed and validated using a sample of 271 customer-service and (...) sales personnel. The Dutch biologist C J. van der Klaauw (1893–1972) structuralized the epistemology of oecology using concepts which exceeded the limits of a strictly teleological interpretation of nature. This article relates to his theory of holistic oecology which van der Klaauw formulated departing from a critical confrontation with Kant's teleological view on nature. He substituted this extra-scientifically heuristic maxim by the holistic notion of network-like associations between organisms within a community. The analogous similarities between the organization of individual organisms and communities (...) drawn up by van der Klaauw, merely remained propaedeutics for a genuine holistic oecology, which would only employ epistemological principles specifically referring to the organization of supra-individual communities of organisms. This article discusses the process of structuralizing the theory of holistic oecology by van der Klaauw in his dialogue with Kantian philosophy. (shrink)

Entretanto, somente a purificação da vontade ainda não será suficiente para permitir a identificação entre vontade e razão. (...) En este artículo se presenta un análisis epistemológico de las contribuciones de la lógica argumentativa y la lógica proposicional, basado en estructuras proposicionales que componen los argumentos lógicos, como modelos para la construcción de argumentos en los textos científicos y filosóficos. El objetivo de la investigación fue identificar las perspectivas comunes teóricos de la lógica argumentativa y la lógica proposicional, que contribuyen a los procesos cognitivosde razonamiento lógico y su transposición al lenguaje lógico, que muestran cómo utilizar la estructura proposicional (...) y argumentativa en la construcción de textos científicos y filosóficos, para comunicar sus ideas con coherencia, claridad, objetividad y la cohesión. Las razones para el estudio se derivan de la práctica de las obras de terminación de la orientación de los cursos de graduación, en los que era posible percibir las dificultades de los estudiantes de educación superior para construir textos con coherencia lógica necesaria y suficiente para la comprensión del lector.La base teórica de la investigación fue reflejada por los conceptos, las ideas y las teorías de filósofos, matemáticos e investigadores dedicados al estudio de la lógica, especialmente Aristóteles, Kant, Frege, Copi y Weston. El enfoque metodológico se guio por las reglas de la investigación cualitativa, lo que permite la interpretación de los procesos lógicosque pueden contribuir a la construcción de argumentos en el texto enfoque científico-filosófica de la investigación se basó en el método deductivo, con la composición de argumentos lógicos e informales el uso de los procedimientos de observación y la literatura. Los resultados indicaron que la estructura proposicional de los argumentos deductivos se puede utilizar para construir argumentos lógicos informales, siendo útil para sintetizar la información y comunicar ideas y teorías, textos científicos y filosóficos con niveles de mayor comprensión para el lector. O objetivo deste artigo é examinar a hipótese de que a teoria kantiana do direito público seja estruturalmente antinômica, a despeito de que Kant só lhe tenha admitido o aspecto paradoxal. Com efeito, a teoria kantiana do direito público simultaneamente sustenta: (i) que o ingresso dos homens em um estado juridicamente organizado depende da obediência ao comando da razão que nos ordena celebrar o pactum unionis civilis e aceitar a submissão a uma ordem constitucional civil; (ii) que devemos aceitar como (...) nosso legítimo soberano a quem quer que tenha condições de efetivamente impor seu poder sobre nós. Bons intérpretes como Bouterwek e Hermann Cohen pensaram, contudo, que a verdadeira dificuldade dessa análise é uma desconcertante confusão dos conceitos de soberano e de soberania. A hipótese que procuramos explorar neste artigo é a de que se obterá um melhor entendimento da posição de Kant se admitirmos que os dois planos de análise e as teses conflitantes a que se acaba de aludir estão em uma posição reciprocamente equivalente à que se encontram tese e antítese nas antinomias dinâmicas analisadas na "Crítica da razão pura". The aim of this paper is to examine the hypothesis that Kantian theory of public rights is founded on an antinomic conceptual structure, even though Kant only admitted the paradoxical character of his doctrine. Kant's theory on public right states, at the same time, that: (i) the access to a rightful condition is dependent on our compliance to the command of reason to celebrate the pactum unionis civilis and the corresponding submission of the citizens under a civil constitution; (ii) we shall accept as our legitimate sovereign whoever is able to impose his power over us. Good interpreters, as Bouterwek and Hermann Cohen thought, however, that the true difficulty with his analysis is that it contains an astonishing confusion of the concepts of sovereign and sovereignty. The hypothesis I would like to explore in this paper is that perhaps a better understanding of Kant's position on this theme can be obtained by admitting that the two levels of analysis and the conflicting thesis we found in his doctrine of public rights are in a position reciprocally analogous to that occupied by thesis and antithesis in the dynamical antinomies assessed in the Critique of Pure Reason. In this paper, I develop an ontological position according to which substances such as you and I have no substantial parts. The claim is not that we are immaterial souls. Nor is the claim that we are “human atoms” co-located with human organisms. It is, rather, that we are macrophysical objects that are, in the relevant sense, simple. According to Bocheński’s description of the history of formal logic, there clearly is some objective development, though far from being cumulative or linear. The history of logic throughout the world consists of three relatively short pinnacles preceded by also short periods of awakening and followed by periods of extensive commentary running into long periods of standstill and decadence, when nearly all achievements are consigned to oblivion.

This paper deals with forms of communication aiming at a better informed public or publics. The main idea is that democratic societies are dependent on toleration of a plurality of publics, and simultaneously there is a need for communication between the different publics. The ethos underlying this assumption is that democracy requires a transcendence of subjective conditions in order for the public(s) to gain legitimacy and recognition of opinions. Validity of opinions presupposes a public aspect that is available through communication. (...) More specifically, the validity in question is obtained through its claim on universality – i.e. the transcendence of purely private subjective conditions. This kind of validity is found in reflective judgment or enlarged thinking, as displayed in Kant’s third critique. In the last part of the paper it is discussed how new information technologies and the internet may contribute positively to facilitate modes of communication that are associated with the particularity at work in reflective thinking. Storytelling technologies and virtual realities are of particular interest in envisaging how this might work. (shrink)

ABSTRACTThis essay introduces paternalism—a concept widely discussed in political philosophy and applied ethics—into media ethics, given that the concept is frequently mentioned but rarely explicated. The purpose of the essay is to defend paternalism as a normatively positive concept. The essay defines paternalism, outlines normative objections to paternalism grounded in autonomy and rationality, and applies the concept of paternalism to journalism. Theoretical connections to virtue ethics and implications for the practice of journalism are also discussed.

It then critically examines David Bell's account of the role of aesthetic judgement, or experience, in Kant and Wittgenstein, in shedding light on empirical judgement. Bell's suggestion that a Wittgensteinian account of aesthetic experience can guide the application of empirical concepts is criticised: neither the discussion of aesthetic judgement nor aesthetic experience helps underpin empirical judgement. Os grandes filósofos metafísicos que precederam Schopenhauer identificaram o objetivo maior do espírito com a realização de sua plenitude. Esta é indicada, paralelamente, no campo religioso, a partir da aproximação do homem com Deus. A novidade que este texto pretende apontar é que, diferentemente da tradição filosófica e religiosa do Ocidente, Schopenhauer realizou em sua metafísica um caminho para o espírito humano no qual (...) a sua “libertação” não coincide com a plenitude do espírito. Para este filósofo a libertação é atingida a partir de uma ascese radical, na medida em que propõe a mortificação/ aniquilação do ser como um todo. Many of Hannah Arendt's readers argue that differences between her earlier and later work on judgment are significant enough to constitute an actual break or rupture. Of Arendt's completed works, the 'Postscriptum' to Thinking , the first volume of The Life of the Mind , and her Lectures on Kant's Political Philosophy are widely considered to be her definitive remarks on judgment. These texts are privileged for two primary reasons. First, they were written after Arendt's controversial text, Eichmann in Jerusalem (...) . It was Arendt's recognition of the role that Eichmann's inability to think played in his war crimes which motivated her to analyse more fully not only the 'mental activity' of thinking, but those of willing, and judging as well. Second, in The Life of the Mind and the Kant Lectures , Arendt treats judgment as a distinct mental activity; in her earlier work judgment is connected to both politics and thought. In this essay I argue that while Arendt does indeed reformulate her notion of judgment, she does not depoliticize it. I begin by calling into question Ronald Beiner's claim that Arendt's later work on judgment can stand in for the unwritten third volume of The Life of the Mind . I then consider two more specific claims, the first of which is that judgment is relevant only in 'rare' times of 'crisis'. I argue that a crisis as Arendt understands it is not necessarily and merely a 'rare' and short-lived phenomenon. The effects of what Arendt refers to as 'dark times' are long-term and pervasive and, moreover, the function of making judgments within such an expanded context is politically germane. Second, I problematize the idea that conceiving of judgment as a distinct mental faculty necessarily disconnects it from politics. I examine the nature of Arendt's relationship to Kant and argue that she appropriates and reconceptualizes his work in such a way that judgment, while a distinct faculty, nonetheless retains its political relevance. I conclude by suggesting that the impulse to systematize Arendt's unsystematic treatment of judgment ought to be resisted. (shrink)

Kant divides moral duties into duties of virtue and duties of justice. Duties of virtue are imperfect duties, the fulfillment of which is left to agent discretion and so cannot be externally demanded of one. Duties of justice, while perfect, seem to be restricted to negative duties (of nondeception and noncoercion). It may seem then that Kant's moral philosophy cannot meet the demands of global justice. I argue, however, that Kantian justice when applied to the social and historical realities of (...) the world can generate positive duties to promote and provide for the well being of others. With the aim of showing that creativity is not an obscure power owned by only few individuals and free from constraints, authors working at the intersection field between philosophy and cognitive science have notably focused on the structure and evolution of cognitive mechanisms underlying our creative capacities. While taking up the suggestion that we should try not to mystify creativity, this article argues (...) that what is required for such demystification is primarily a transcendental and phenomenological inquiry. Kant’s and Merleau-Ponty’s works are here discussed in order to develop such a transcendental inquiry into creativity. Both Kant and Merleau-Ponty bring to the fore the conditions of possibility for creative acts, and highlight fundamental role of creativity itself in the formation of meaningfulness. The keystone of both philosophers’ inquiries is the emphasis on the interdependence between creativity and rules. Yet, due to the different approaches to the transcendental, Kant’s and Merleau-Ponty’s accounts do not fully converge, but should rather be considered as complementary. (shrink)

Historically, Western philosophy has struggled to accommodate, or has simply denied, the moral value of spontaneous, non-reflective action. One important exception is in the work of K.E. Løgstrup, whose phenomenological ethics involves a claim that the ‘ethical demand’ of care for the other can only be realized through spontaneous assent to ‘sovereign expressions of life’ such as trust and mercy. Løgstrup attacks Kierkegaard for devaluing spontaneous moral action, but as I argue, Kierkegaard too offers an implicit view of spontaneous moral (...) response as a regulative ideal. In attempting to articulate the model of character-formation that such an ethics requires, we can see both Løgstrup and Kierkegaard as engaging with an ancient problematic, running from Classical Daoism to medieval mysticism, of achieving spontaneity through purgation rather than edification—not building the subject up, but demolishing personality in order to become a conduit for a transcendent normativity. The ancient problem of whether our asymmetrical attitudes towards time are justified remains a live one in contemporary philosophy. Drawing on themes in the work of McTaggart, Parfit, and Heidegger, I argue that this problem is also a key concern of Kierkegaard’s Either/Or. Part I of Either/Or presents the “aesthete” as living a temporally volatilized form of life, devoid of temporal location, sequence and direction. Like Parfit’s character “Timeless,” these aesthetes are indifferent to the direction of time and seemingly do (...) not experience McTaggart’s “A-Series” mode of temporality. The “ethical” conception of time that Judge William offers in Part II contains an attempt to normativize the direction of time, by re-orienting the aesthete towards an awareness of time ’s finitude. However, the form of life Judge William articulates gives time sequentiality but not necessarily the robust directionality necessary to justify our asymmetrical attitudes to time. Hence while Either/Or raises this problem it remains unanswered until The Concept of Anxiety. Only with the eschatological understanding of time developed in The Concept of Anxiety does Kierkegaard answer the question of why directional and asymmetrical conative and affective attitudes towards time are normative. In death penalty debates, advocates on both sides have advanced a staggering number of arguments to defend their positions. Many of those arguments fail to support retaining or abolishing the death penalty, and often this is due to advocates pursuing a line of reasoning where the conclusion, even if correctly established, will not ultimately prove decisive. Many of these issues are also interconnected and shouldn’t be treated separately. The goal of this paper is to provide some clarity about which specific (...) issues really determine whether the institution of capital punishment is morally permissible. The issues can be broadly grouped into three categories: substantive; procedural (comparative); and procedural (noncomparative). Substantive debates regard the inherent moral status of the death penalty, while procedural debates regard how the death penalty is applied in practice, with two types of injustice that can result. Substantive issues have the potential to be the most decisive, for if the death penalty is inherently immoral there’s no need to even raise procedural questions. However, it appears difficult for either side to make a clearly compelling argument on substantive grounds. In regards to the procedural arguments, the concerns of noncomparative justice lead to stronger arguments than the comparative concerns, for the irrevocable nature of the death penalty can play a role in the former but not the later. Overall, abolitionists have a clear advantage in this debate, as they only have to make their case on one of these fronts, while supporters must defend themselves on all three fronts. (shrink)

The presumption of innocence has often been understood as a doctrine that can be explained primarily by instrumental concerns relating to accurate fact-finding in the criminal trial and that has few if any implications outside the trial itself. In this paper, I argue, in contrast, that in a liberal legal order everyone has a right to be presumed innocent simply in virtue of being a person. Every person has a right not to be subjected to criminal punishment unless and until (...) he or she has done something that is criminally wrong. Since disagreements about allegations of criminal wrongdoing are inevitable, the liberal legal order requires a process for determining whether wrongdoing has occurred. In order to preserve the right not to be punished without wrongdoing, the accused person must be presumed innocent throughout this process. The presumption of innocence is therefore as much a basic human right as, for example, the right to bodily integrity or the right to freedom of expression. Specifications of and limitations on the right should therefore be justified not primarily in terms of their instrumental effectiveness in fact-finding or crime control but in terms of the role of the criminal process in a liberal legal order. I consider some implications of this view of the presumption of innocence for the pre-trial process and for substantive criminal law. I argue that the presumption of innocence, understood as a basic human right, should condition the entire pre-trial process; it has, however, minimal implications for the definition of offences. In the process of scientific discovery, knowledge ampliation is pursued by means of non-deductive inferences. When ampliative reasoning is performed, probabilities cannot be assigned objectively. One of the reasons is that we face the problem of the unconceived alternatives: we are unable to explore the space of all the possible alternatives to a given hypothesis, because we do not know how this space is shaped. So, if we want to adequately account for the process of knowledge ampliation, we need to (...) develop an account of the process of scientific discovery which is not exclusively based on probability calculus. We argue that the analytic view of the method of science advocated by Cellucci is interestingly suited to this goal, since it rests on the concept of plausibility. In this perspective, in order to account for how probabilities are in fact assigned in uncertain contexts and knowledge ampliation is really pursued, we have to take into account plausibility-based considerations. A god is a cosmic designer-creator. Atheism says the number of gods is 0. But it is hard to defeat the minimal thesis that some possible universe is actualized by some possible god. Monotheists say the number of gods is 1. Yet no degree of perfection can be coherently assigned to any unique god. Lewis says the number of gods is at least the second beth number. Yet polytheists cannot defend an arbitrary plural number of gods. An alternative is that, (...) for every ordinal, there is a god whose perfection is proportional to it. The n -th god actualizes the best universe(s) in the n -th level of an axiological hierarchy of possible universes. Despite its unorthodoxy, ordinal polytheism has many metaphysically attractive features and merits more serious study. (shrink)

The aim of this article is twofold. First, it is argued that while the principle of ‘ought implies can’ is certainly plausible in some form, it is tempting to misconstrue it, and that this has happened in the way it has been taken up in some of the current literature. Second, Kant's understanding of the principle is considered. Here it is argued that these problematic conceptions put the principle to work in a way that Kant does not, so that there (...) is an important divergence here which can easily be overlooked. IntroductionAll states routinely inflict punishment, often quite harsh punishment, for criminal offences committed by persons who are subject to their laws; but it is remarkably difficult to provide a satisfactory normative justification for this practice.This paper is a review essay of Tadros . References to the book will be by way of parentheses in the text. Non-consequentialist accounts, such as retributivism, can readily explain why some kinds of wrongs are punishable, but find it difficult to accommodate the intuition that deterrence (...) can justify punishment. Consequentialist theories can easily explain why harmful conduct is punishable, but struggle to account for the intuition that only the factually guilty should be punished or for the criminal jurist’s obsession with questions of fault and responsibility. This introductory essay discusses how the trope of “religious violence” is operative in contemporary discussions concerning the so-called “return of religion” and the “post-secular constellation.” The author argues that the development of a genuine phenomenology of “religious violence” calls on us to critically reconsider the modern discourses that all too unambiguously tie religion and violence together. In a first part, the paper fleshes out the fault lines of a secularist modernity spinning out of control. In a second part, it demonstrates (...) how the “liberal imaginary” revolves around individualist conceptions of freedom and sovereignty that, on their part, become parasitic upon imaginations of disorder, otherness and violence. In a third part, the author demonstrates how these insights call for developing a transformed phenomenological framework in order to give a more sensible account of “religious violence.” Finally, in presenting the articles gathered in this “special issue” of Continental Philosophy Review, some pathways into such a sensibilized phenomenology of “religious violence” are outlined. This article offers a new interpretation of Adorno’s new categorical imperative : it suggests that the new imperative is an important element of Adorno’s moral philosophy and at the same time runs counter to some of its essential features. It is suggested that Adorno’s moral philosophy leads to two aporiae, which create an impasse that the new categorical imperative attempts to circumvent. The first aporia results from the tension between Adorno’s acknowledgement that praxis is an essential part of moral philosophy, (...) and his view according to which existing social conditions make it impossible for moral knowledge to be translated into right action. The second aporia results from the tension between the uncompromising sensitivity to suffering that underlies Adorno’s moral thought, and his analysis of the culture industry mechanisms which turn people into happy, satisfied customers—an incompatibility which threatens to pull the rug out from under Adorno’s moral philosophy. My interpretation of the new categorical imperative focuses on two characteristics it inherits from the old, Kantian one—self-evidence and unconditionality—in order to present the new imperative as a response to these two aporiae. Can any being worthy of worship make others worship it? I think not. By way of an analogy to love, I argue that it is perfectly coherent to think that one could be made to worship. However, forcing someone to worship violates their autonomy, not because worship must be freely given, but because forced worship would be inauthentic—much like love earned through potions. For this reason, I argue that one cannot be made to worship properly; forced worship would be unfitting. (...) My principal claim is that no being worthy of worship could exercise the power to make others worship it, since the act of making another worship would necessarily make one unworthy of worship. In this paper I first aim to identify, from a perspective mindful of both analytic and Continental traditions, the central normative issues at stake in the various debates concerning commodification in law. Although there now exists a wealth of thoughtful literature in this area, I often find myself disoriented within the webs of moral criteria used to analyze the increasingly ubiquitous practice of converting legal goods into monetary values. I therefore attempt to distinguish and organize these often conflated conceptual distinctions (...) across several registers of moral analysis. Second, I formulate what I consider the most illuminating questions regarding the criteria used to evaluate commodification in law. Critiques of commodification in law face what I call problems of ideology, intractability, and hyperbole, and identifying these issues helps to explain the momentum of the law and economics movement. De produto da razão, a lei moral será examinada como efeito sobre o ânimo, numa dialética de desprazer e prazer, da qual surge o sentimento moral. O presente artigo visa problematizar este aspecto da ética do filósofo à luz da Crítica da faculdade do juízo e dos conceitos princípio do prazer e princípio da realidade de Sigmund Freud. Partindo da proposta ontológica de Leibniz, a ideia de perfeição dá origem à discussão estética germânica. O grande questionamento é se o gosto está ligado a uma concepção de perfeição inerente à realidade ou se é o resultado da dinâmica dos sentidos, responsáveis pelas sensações. Reformulando a concepção estética moderna, Kant não concebe nenhuma validade de coisa-em-si para o gosto, ele não está nas coisas nelas mesmas, mas antes na maneira de operar da faculdade de julgar reflexiva. Reconhecendo esta nova (...) perspectiva, e encontrando nela lacunas no que diz respeito à aproximação entre razão e sensibilidade, Schiller propõe uma nova criação da estética como modelo de formação do homem.
