The ‘body’ has remained the pivotal and essential mechanism for analysis within disability scholarship. Yet while historically conceptualized as an individual’s fundamental feature, the ‘disabled identity’ has been more recently explained as a function of ‘normalcy’ through social, cultural political, and legal discriminations against difference and deviancy. Disability studies’ established tradition of consultation with philosophical endeavour remains apparently unwilling to exploit or utilize Martin Heidegger’s understanding of ‘Being’ and interpretation of Dasein as a possible framework for unravelling the complexities of (...) contemporary discrimination and oppression of those others. This paper in tracing Heidegger’s explanation of humankind, inspired by arguments proposed by Cerbone (Int J Philos Stud 2:209–230, 2000) and in consultation with Levin (The body: classic and contemporary readings, Blackwell, Malden, 1999), Aho (2009), Malpas (Heidegger’s topology: being place, world, MIT Press, Cambridge, 2008), and Rae (Hum Stud 33:23–39, 2010) among others, will interpret the ‘embodied’ reality of ‘Being,’ of being-disabled-in-the-world as primarily involved within the practical context and structured according to impersonal, normative social norms, rather than detached, theoretical contemplation or observance. In this paper I discuss the four Women and Labour conferences which were held in Australian capital cities over the seven years between 1978 and 1984. I explore the ways in which the history of Australian feminist activism during this period could be written, questioning in particular the claim that the Women and Labour conferences have been central to the history of Australian feminism. I discuss the ways in which a historical sense could be established, using writings about the conferences (...) as historical ‘evidence’, that race and ethnic divisions between women had not been important to the ‘women's movement’ until 1984. In other words, I challenge the construction of this conference as a turning point – not only in the feminist politicization of immigrant and Aboriginal women, but also in the politicization of all feminists about race and ethnic divisions. More broadly, I am interested in how a history would be written if it aimed to get to the ‘truth’ about racism and about the feminist activism of immigrant women. How would the apparent lack of written ‘evidence’ – at least until 1984 – of immigrant women's feminist activism, and of the awareness of Australian feminists about issues of racism, be written into this history? In addition, I suggest that it is important to the writing of feminist history in Australia that published documentation has been mostly produced by anglo women, and is thus partial and mediated by the lived, embodied experiences of anglo women. Finally, my intention is to interrogate commonly understood narratives about Australian feminist history, to challenge their seamlessness, and to suggest the importance of recognizing the tension within feminist discourses between difference as benign diversity and difference as disruption. The question of the transcendent, that which operates above and beyond the material stuff of the world, remains an enduring one for feminism, bound up as it is with the foundations of feminism's corporeal politics and the definition of its political subject. With the specificity of the situated and meaningful body grounding feminist politics, the universal and neutral status of the speaking subject has been diagnosed as masculine, and unable to properly account for sexed differences. On this basis, political community, (...) collectivity forged along the lines of a common identity, is considered important in the realization of feminist political goals, yet is also problematic in view of its reliance upon a universal category of identity through which to motivate for political change. Acknowledging these tensions, this paper revisits Luce Irigaray's essay “Divine Women” to suggest that in her rethinking of the divine as a shared horizon through which women can potentially achieve autonomy, the nature of the transcendent, the universal, and the identity of the feminine are also reconfigured in surprising ways. In a specific address to the dilemma of political community, Irigaray makes available a notion of the divine that is already differently inhabited. (shrink)

Legal judgment writing mobilises a process of story-telling, drawing on existing judicial discourses, precedents and practices to create a narrative relevant to the specific case that is articulated by the presiding judge. In the Feminist Judgments projects feminist scholars and activists have sought to challenge and reinterpret legal judgments that have disadvantaged, discriminated against or denied women’s experiences. This paper reflects on the process of writing as a feminist judge in the Australian Project, in an intimate homicide case, R v (...) Middendorp. Drawing on the work of Judith Butler on intelligibility, iterability and the communality of violence and vulnerability, this article argues that feminist judgments necessarily require some uncomfortable compromises with unjust gendered institutions. While ‘donning the robes’ may be an uncomfortable process, a feminist re-articulation of the law’s carceral power serves to unsettle and challenge some aspects of gendered oppression, even though it cannot unsettle the operation of the institution. The article concludes that effective feminist interventions by members of the judiciary may require donning robes that are not entirely comfortable in order to persuade and advocate for change. Accounts of mothering have both contributed to feminist theory's development and depended on certain of its central concepts. Some of its critics, however, argue that feminist theory is undermined by the problems of exclusion and essentialism. Here I distinguish between these two problems and consider their implications for questions about mothering. I conclude that exclusion and essentialism do not present insurmountable obstacles to theorizing motherhood, but do suggest new directions for such theorizing.
