Individualized customer information is at the heart of on-line commerce. Using increasing amounts of customer-specific data enhances the success and value of one-to-one on-line marketing; but the extensive gathering and use of data specific to individuals also causes alarm over the loss of digital privacy, setting up a confrontation between e-commerce and society. Governments and nations, particularly in Europe, have reacted with a reliance on sweeping laws governing digital privacy protection while other nations such as the U.S. have generally preferred (...) to allow companies and industry associations to regulate themselves. This tenuous balance is under attack from both sides. In this paper, we set up a framework which incorporates the environmental context, ethical perspectives and firm-specific considerations to help firms develop a strategy for handling digital privacy concerns. Using concepts from Ulrich Beck’s Risk Society, this paper argues that as expertise proliferates questions of ethics in decision-making fall through gaps between domains of expertise. As a consequence, unethical outcomes are unattached to actions taken with no one accountable or responsible for these outcomes. Using Actor-Network Theory (ANT), a case study is presented showing how the sale of students’ personal information by the Calgary Board of Education (CBE) escaped questions of ethics. The sale of student information was the product (...) of the convergence of narrowly focussed technology and education expert actions and decisions with an earlier two-stage translation of privacy from a potential ethical issue to an issue of expert rule creation and interpretation. The purpose of this paper is to show, through an example, how questions of ethics are displaced in expert decision-making and to enable the public, managers, individuals and experts to recognize displacements and, through this, create a space for ethics to appear. Drawing on William F. Ogburn's cultural lag thesis, an inherent conflict is proposed between the rapid speed of modern technological advances and the slower speed by which ethical guidelines for utilization of new technologies are developed. Ogburn's cultural lag thesis proposes that material culture advances more rapidly than non-material culture. Technology is viewed as part of material culture and ethical guidelines for technology utilization are viewed as an adaptive aspect of non-material culture. Cultural lag is seen as a critical ethical (...) issue because failure to develop broad social consensus on appropriate applications of modern technology may lead to breakdowns in social solidarity and the rise of social conflict. Reasons for cultural lag between technology and ethics include the social structural and market conditions under which each are developed. The thesis is illustrated by reviews of technological trends involving computer-telecommunications electronics and bio- genetic engineering, and the implications of these and other technologies for privacy rights, electronic commerce, control of essential resources and social definitions of life are discussed.
