The world is undeniably full of injustice. Many feel that much political philosophy is practically impotent and engaged instead in overly abstract theorising insufficiently sensitive to the realities of the world. One response to this concern is David Miller’s influential model of evidence-based political philosophy, which claims to be sensitive to empirical evidence from the social sciences, takes seriously people’s opinions, and defends the role of facts in grounding normative principles. Using various examples from the field of global justice, one (...) of Miller’s key areas of work, I show that Miller’s method is unconvincing on two levels. His theoretical argument for fact-dependence is flawed, and his practical argument for an opinion-sensitive political theory is either guilty of status quo bias or, in an attempt to escape it, becomes self-defeating. While the paper is primarily critical, I endeavour also to draw out the implications of my critiques for the role of the ‘real world’ in theorising. (shrink)

This special edition brings together (1) the recent methodological worries of the moralism/realism and ideal/non-ideal theory debates with (2) the soaring ambition of work in international or global political theory, as found in, say, theories of global justice. Contributors are as follows: Chris Bertram, Jonathan Floyd, Aaron James, Terry MacDonald, David Miller, Shmulik Nili, Mathias Risse and Matt Sleat.

This article takes a new idea, ‘normative behaviourism’, and applies it to global political theory, in order to address at least one of the problems we might have in mind when accusing that subject of being too ‘unrealistic’. The core of this idea is that political principles can be justified, not just by patterns in our thinking, and in particular our intuitions and considered judgements, but also by patterns in our behaviour, and in particular acts of insurrection and crime. The (...) problem addressed is ‘cultural relativism’, understood here not as a meta-ethical doctrine, but as the apparent ‘fact’ that people around the world have culturally varying intuitions and judgements of a kind that lead them to affirm different political principles. This is a problem because it seems to follow (1) that global agreement on any substantial set of political principles is impossible, and (2) that any political theory in denial of this ‘fact’ would be, for that reason, deeply unrealistic. The solution argued for here is that, if domestic political principles (i.e. principles intended to regulate a single state) could be justified by normative behaviourism, and in reference to culturally invariant behaviour, then an international system supportive of such principles is justifiable by extension. If Alison McQueen is right that there is a broad ‘family’ of realist approaches to political theory, then it follows there are several ways of ‘doing’ realism, as illustrated by this collection. Here, I set out one such way, normative behaviourism, by explaining its realist character on four fronts: Its starting point; its values; its ambitions; and its treatment of a shared problem. This paper attempts to get some critical distance on the increasingly fashionable issue of realism in political theory. Realism has an ambiguous status: it is sometimes presented as a radical challenge to the _status quo_; but it also often appears as a conservative force, aimed at clipping the wings of more ‘idealistic’ political theorists. I suggest that what we might call ‘actually existing realism’ is indeed a conservative presence in political philosophy, and that its ambiguous status plays a part in (...) making it so. But I also argue that there is no necessary connection between realism and conservatism. This paper describes the three contingent and suspiciously quick steps which lead from an initial commitment to being attentive to the real world, via a particular kind of pessimism about political possibilities, to an unnecessarily conservative destination. In the process, I try to show how the ubiquitous trinity of realism, pessimism and conservatism might be pulled apart, thus removing the artificial tension between ‘being realistic’ and the demand for far-reaching social change. In the past few years, calls for integrating ethics modules in engineering curricula have multiplied. Despite this positive trend, a number of issues with these ‘embedded’ programs remains. First, learning goals are underspecified. A second limitation is the conflation of different dimensions under the same banner, in particular confusion between ethics curricula geared towards addressing the ethics of individual conduct and curricula geared towards addressing ethics at the societal level. In this article, we propose a tripartite framework to overcome these (...) difficulties. Our framework analytically decomposes an ethics module into three dimensions. First, there is the ethical dimension, which pertains to the learning goals. Second, there is the moral dimension, which addresses the moral relevance of engineers’ conduct. Finally, there is the political dimension, which scales up issues of moral relevance at the civic level. All in all, our framework has two advantages. First, it provides analytic clarity, i.e. it enables course instructors to locate ethical dilemmas in either the moral or political realm and to make use of the tools and resources from moral and/or political philosophy. Second, it depicts a comprehensive ethical training, which enables students to both reason about moral issues in the abstract, and to socially contextualize potential solutions. (shrink)

In this paper, I revisit Mattias Kumm's work on a ‘cosmopolitan conception of law’. I make two claims: First, I claim that although some criticism can be resisted by Kumm, under closer methodological scrutiny there are flaws in his theory. Second, I claim that these flaws challenge Kumm's approach when reading the Charter of the United Nations (UN Charter) as a ‘global constitution’. This also has pertinent practical implications for the functioning of the United Nations. This contribution does not take (...) a stance on the nature of law but focuses on this conception in the context of politics and law. In a first section, I recount Kumm's cosmopolitan conception of law. In a second section, I claim that implicit monism in the relationship between national and international law and theoretical idealization pose serious difficulties to the cosmopolitan approach. In a third section, I claim that these flaws pose a challenge to the United Nations when considering the UN Charter as a 'global constitution'. I sum up my findings in a final section and reflect on a future outlook for research on global constitutionalism in political philosophy. (shrink)

Political realists have devoted much effort to clarifying the methodological specificity of realist theorising and defending its consistency as an approach to political reasoning. Yet the question of how to justify the realist approach has not received the same attention. In this article, I offer a prudential justification of political realism. To do so, I first characterise realism as anti-moralism. I then outline three possible arguments for the realist approach by availing myself of recent inquiries into the metatheoretical basis of (...) realism: The metaethical, the ethical and the prudential arguments. I explain that the prudential argument offers the most solid basis for political realism because it relies on the least controversial premises. Still, I delve into the metaethical and ethical arguments for two reasons: The prudential argument takes advantage of the theses defended by the rival arguments and elaborating the other arguments shows the comparative strengths of the prudential argument. When interest in political realism started to resurge a few years ago, it was not uncommon to interpret realist political theory as a form of non-ideal theorising. This reading has been subjected to extensive criticism. First, realists have argued that political realism cannot be interpreted as merely a form of applied political theory. Second, realists have explained that political realism can defend a role for unfeasible normative prescriptions in political theory. I explain that these developments, besides allowing us to reject (...) interpretations of political realism as a form of non-ideal theory, have given us reason to think of political realism as a form of ideal theory. Yet, when ideal theory enters the picture, a series of methodological questions arise regarding the proper use of ideals. In this paper, I clarify how the relationship between ideal and non-ideal theory ought to be conceptualised in realist political theory. I examine the two major interpretations of the role of ideals that have been provided so far – the target and benchmark interpretations – and I show that neither is compatible with some of the fundamental theoretical commitments of realist political theory. This both allows me to point out the requirements that an interpretation of the relationship between ideal and non-ideal theory must meet to be defined as properly realist and allows me to emphasise the strengths of the realist approach. Accordingly, I propose a new interpretation of the role of ideals, one consistent with realist theoretical commitments: I suggest that realist political ideals ought to be interpreted as models. :Does social justice lose all application in the condition in which people are morally flawless? The answer, I will argue, is that it does not — justice might still have application. This is one lesson of my broader thesis in this paper, that there is a variety of conditions we would all regard as highly idealistic and unrealistic which are, nevertheless, not beyond justice. The idea of “circumstances of justice” developed especially by Hume and Rawls may seem to point in (...) a more realistic direction, but we can see that this is not so once we distinguish between conditions of need for norms of justice, conditions of their emergence, and conditions of applicability of the standard of justice. Justice, I argue, can have application even in conditions where no mechanism of justice is present or needed, such as the case of internalized motives of justice. (shrink)

The question of what role social and political practices should play in the justification of normative principles has received renewed attention in post-millennium political philosophy. Several current debates express dissatisfaction with the methodology adopted in mainstream political theory, taking the form of a criticism of so-called ‘ideal theory’ from ‘non-ideal’ theory, of ‘practice-independent’ theory from ‘practice-dependent’ theory, and of ‘political moralism’ from ‘political realism’. While the problem of action-guidance lies at the heart of these concerns, the critics also share a (...) number of methodological assumptions. Above all, their methodology is practice-dependent in the sense that an existing practice is assumed to put substantial limitations on the appropriate normative principles for regulating it. In other words, we cannot formulate and justify an appropriate principle without first understanding the practice this principle is supposed to govern. The aim of this paper is to map out and analyze the common denominators of these debates with regard to methodological commitments. We will investigate how this practice-dependent method may be understood and motivated. In particular, we point to challenges that must be met in order for the position to remain both distinct and attractive. (shrink)

Political realists’ rejection of the so-called ‘ethics first’ approach of political moralists, has raised concerns about their own source of normativity. Some realists have responded to such concerns by theorizing a distinctively political normativity. According to this view, politics is seen as an autonomous, independent domain with its own evaluative standards. Therefore, it is in this source, rather than in some moral values ‘outside’ of this domain, that normative justification should be sought when theorizing justice, democracy, political legitimacy, and the (...) like. For realists the question about a distinctively political normativity is important, because they take the fact that politics is a distinct affair to have severe consequences for both how to approach the subject matter as such and for which principles and values can be justified. Still, realists have had a hard time clarifying what this distinctively political normativity consists of and why, more precisely, it matters. The aim of this paper is to take some further steps in answering these questions. We argue that realists have the choice of committing themselves to one of two coherent notions of distinctively political normativity: one that is independent of moral values, where political normativity is taken to be a kind of instrumental normativity; another where the distinctness still retains a justificatory dependence on moral values. We argue that the former notion is unattractive since the costs of commitment will be too high, and that the latter notion is sound but redundant since no moralist would ever reject it. Furthermore, we end the paper by discussing what we see as the most fruitful way of approaching political and moral normativity in political theory. (shrink)

Although the discussion about feasibility in political theory is still in its infancy, some important progress has been made in the last years to advance our understanding. In this paper, we intend to make a contribution to this growing literature by investigating the proper place of feasibility considerations in political theory. A motivating force behind this study is a suspicion that many presumptions made about feasibility in several current debates—such as that between practice-independence and practice-dependence, ideal and non-ideal theory, and (...) political moralism and political realism—are too rigid and underestimate the numerous different ways in which feasibility concerns may enter into our theorizing. To chisel out this feasibility space, our aim is to suggest two metatheoretical constraints on normative political principles as intuitively plausible, the so-called ‘fitness constraint’ and the ‘functional constraint’, through which we elucidate five central aspects for determining proper feasibility constraints of an account in political theory. Political philosophy should focus not on uplifting ideals, but rather, so I argue, on minimizing serious suffering. This is so not because other things do not ultimately matter (they do), but rather because in the political context, the stakes in terms of suffering are usually extremely high, so that any other considerations are almost always outweighed. Put in moderately deontological terms: the high stakes carry most political decisions across the thresholds of the relevant deontological constraints. While the argument is substantive (...) rather than exegetical, I engage in detail Judith Shklar's “Liberalism of Fear”. I share with Shklar her pessimistic starting point, but I also show how a focus on suffering (rather than cruelty and fear) is what plausibly follows from such a starting point. I then pursue the implications of this difference—they are theoretically profound, but perhaps less significant practically. (shrink)

There is a growing recognition that victims of injustice may have privileged access to knowledge about the injustices they experience, and that injustices are perpetuated through silencing victims by taking them to be less credible, and through denying them the platform and capacity to speak. However, these are not ideas that political philosophers tend to engage with in a sustained manner, to the extent that they alter methodological approaches to be systematically attentive to victim testimony. In this article, I provide (...) two arguments in favour of political philosophers attending to victim testimony, one moral, one epistemic, and demonstrate that the moral case has little purchase, but that the epistemic case is more successful. Then, I present the strongest case against including victim testimony in political philosophy, and I argue that it does not hold up to scrutiny. In so doing, I demonstrate how methodological practices in political philosophy could be improved through drawing on feminist social epistemology; attending to victim testimony can enrich political philosophy in epistemically acceptable ways, and it also corrects for a range of potential biases. Populists in the EU often call for restrictions on EU immigrants’ access to welfare rights. These calls are often demagogic and parochial. This paper aims to show what exactly is both distinct and problematic with these populist calls from a normative point of view while not necessarily reducible to demagogy and parochialism. The overall aim of the paper is not to argue that all populists call for such restrictions nor to claim that all calls for such restrictions are populist. The (...) purpose of the paper is rather humble. It only aims to show that populist calls for restrictions on EU immigrants’ access to welfare rights are characterised by two normatively problematic arguments that target two different subsets of the citizenry: what I dub for the purpose of this paper the moralists and the immoralists. It is the way populists address these two subsets of the citizenry, as well as the fact that they could simultaneously appeal to the concerns of both groups, that makes populist approaches to welfare rights both conceptually distinct to other approaches as well as potentially politically appealing to a more diverse population of voters. Thomas Hobbes has recently been cast as one of the forefathers of political realism. This article evaluates his place in the realist tradition by focusing on three key themes: the priority of legitimacy over justice, the relation between ethics and politics, and the place of imagination in politics. The thread uniting these themes is the importance Hobbes placed on achieving a moral consensus around peaceful coexistence, a point which distances him from realists who view the two as competing goals of (...) politics. The article maintains that only a qualified version of the autonomy of the political position can be attributed to Hobbes, while arguing more generally that attending to the relation between ethics and politics is central to assessing his liberal credentials from a realist perspective. Against the prevalent reading of Hobbes as a hypothetical contract theorist, the article proceeds to show that the place of consent in his theory is better understood as part of his wider goal of transforming the imagination of his audience: a goal which is animated by concerns that realists share. In this paper we investigate ways to comply with justice in a liberal democracy. In order to do that, we sketch Rawls’s account of moral-consensus stability and discuss the alternative idea of stability reached through a modus vivendi. We defend modus vivendi as a way to achieve stability backed by a variety of reasons and even by ‘non-reasons’. By ‘non-reasons’ we mean alternative sources of motivation for compliance as a precondition of a stable coexistence. We focus on such sources, which (...) differ from reasons and beliefs, that are practices, shared values, and value experiences, in light of both a theoretical-political and a qualitative social-ontological perspective. We argue that individuals who experience the same values become collectives and even stable ones: the sharing of values creates social unity and makes collectives solid and resistant to individualistically centrifugal tendencies. This article examines the significance of Friedrich Nietzsche to Albert Camus’ concepts of absurdity and revolt. It rests on three related claims. First, that Nietzsche’s critique of metaphysics is the point of departure for Camus’ absurdist inquiries. Second, that Camus’ philosophy of revolt is informed in crucial ways by Nietzsche’s views on the sources of moral and intellectual authority in the modern world. Finally, that Camusian revolt is an attempt to deal with the political crisis of foundationalism in a way (...) that preserves Nietzsche’s anti-essentialism while also avoiding the excesses of absolutist politics. Ultimately, I suggest that the origins and implications of Camus’ project cannot be grasped apart from an account of its engagement with Nietzsche. (shrink)

Following in the footsteps of Bernard Williams, I aim to delineate and advance a more realistic, less moralistic approach to thinking about morals and politics in a liberal culture. To do so, I push back against one framing of what Williams meant in urging greater realism, and in criticizing what he saw as political theory's excessive moralism, which has recently gained traction. According to a number of recent authors, the important issue Williams raised should be understood in terms of whether (...) there are two “kinds” or “sources” of “normativity” found in liberal politics and morality, respectively: Realists are said to accuse their Moralist opponents of countenancing only one normativity, which is moral, when in fact there are two, one of which is “distinctively political.” I show how this now popular framing leads to a number of distortions, particularly insofar as our aim is to understand Williams' moral and political thought. I go on to argue that, once these are sorted out, the term ‘normativity’ itself contributes to the problem—current usages of the term are inextricably bound up with a recognizably moralistic style of thought, of the sort that Williams encouraged us to oppose. Instead, they say, we should begin with the factual existence of CPIs, and ask how they ought to be structured. In holding this view, they adopt a form of political naturalism that is broadly Aristotelian in character. Some realists in political theory deny that the notion of feasibility has any place in realist theory, while others claim that feasibility constraints are essential elements of realist normative theorising. But none have so far clarified what exactly they are referring to when thinking of feasibility and political realism together. In this article, we develop a conception of the realist feasibility frontier based on an appraisal of how political realism should be distinguished from non-ideal theories. In this realist framework, political (...) standards are feasible if they meet three requirements: they are politically intelligible, contextually recognisable as authoritative, and contestable. We conclude by suggesting that our conception of realist feasibility might be compatible with utopian demands, thereby possibly finding favour with realists who otherwise refuse to resort to the notion of feasibility. Political realists claim that politics should be regulated by a distinctive political normativity, one that does not rely on external, pre-political moral standards. It is in this sense that they distinguish political realism from ‘political moralism’, regarded as an approach that understands political theory as applied ethics. Importantly, realists’ anti-moralism is not motivated by the conviction that moral considerations do not play any role in the political realm. Rather, the target is the externalism of the normative resources on which moralist (...) theories typically ground their conceptions of legitimacy. In contrast to moralists, some realists have argued for the need to elaborate internal theories of legitimacy, ones that develop normativity internally – that is, from within the political context under evaluation. This commitment entails the effort to reconnect legitimacy to the beliefs and attitudes of people subjected to the political power. In these accounts of legitimacy, critique is typically exercised internally, by means of self-reflection and ideology critique. Contra some realists, I argue that some forms of externalism are desirable and compatible with internalist accounts of legitimacy, and I show how to accommodate them within internalist theories of legitimacy. They are desirable because they strengthen the emancipatory potential of internal reflection and, in some cases, even stimulate it, as when, because of political circumstances, internal critique cannot be exercised. In addition, they prevent internalist approaches from falling into descriptive accounts of de facto acceptance of power. These forms of external critique can be compatible with internalist accounts of legitimacy, provided that they do not contrast with what I call methodological and substantive internalism. Accordingly, in the article, I discuss which stances of external critique can and should be accommodated within internalist accounts of legitimacy, without renouncing to the realist character of the approach. In 2016, the Five Stars Movement (5SM), one of the parties currently in power in Italy, launched the ‘Rousseau platform’. This is a platform meant to enhance direct democracy, transparency and the real participation of the people in the making of laws, policies and political proposals. Although ennobled with the name of Rousseau, the 5SM’s redemptive promise has been strongly criticised in the public sphere for being irresponsible and ideological. Political realism, I will argue, can perform both a diagnostic and (...) a corrective task, by providing some tools to unveil populist distortions and by offering more solid grounds for political opponents’ critique. Three aspects of realism, in particular, will be pointed out as remedies against populist drifts. First, anti-moralism, complemented by anti-utopianism and contextualism, criticises the populists’ moralistic picture of politics, its anti-pluralistic attitude and its rejection of the role of experts in politics. Second, the Weberian ethic of responsibility offers standards to assess politicians’ actions, instead of embracing the populist aversion towards any professional politician; besides, it contrasts the populist image of politics as a derogatory activity. Finally, realism as ideology critique unveils the distorting narratives underlying populist propaganda and fostering uncritical support. (shrink)

Facilitating access to asylum and other forms of refugee protection for the millions displaced by mass atrocities in Syria and Iraq is essential to the implementation of the international norm of the Responsibility to Protect. This responsibility, however, has been disproportionately shouldered by several states in the Middle East and Europe. This article explores the challenges associated with refugee responsibility-sharing in the context of RtoP and draws on work in climate justice and political realism to articulate a framework for integrating (...) culpability as a key criterion in allocating states’ responsibilities to protect refugees. An empirical and normative assessment of U.S. responsibilities to protect refugees in the cases of conflict-induced displacement in Syria and Iraq outlines several potential paths of culpability. The article ultimately argues for greater attention to culpability, equity, and legitimacy within the discourse surrounding RtoP and refugee protection. The article also advocates linking the benefits of refugee responsibility-sharing with states’ national interests and highlights several such links with regard to U.S. responsibilities in Syria and Iraq. This article argues for a new interpretation of the realist claim that politics is autonomous from morality and involves specific political values. First, this article defends an original normative source: functional normativity. Second, it advocates a substantive functional standard: political institutions ought to be assessed by their capacity to select and implement collective decisions. Drawing from the ‘etiological account’ in philosophy of biology, I will argue that functions yield normative standards, which are independent from morality. For example, a ‘good heart’ (...) is one that pumps blood well, and a good army is one that it is effective at exerting military force. I then interpret realism’s naturalistic conception of politics as an etiological function of social groups: namely making binding collective decisions under persistent disagreement. I conclude that political institutions should be evaluated realistically by how well they perform this task. Finally, I assess trade-offs between this functional political normativity and other moral values. I conclude that justice, fairness, freedom and equality remain obviously important concerns, but only once the basic political function is secured. (shrink)

For political realists, legitimacy is a central requirement for the desirability of political institutions. Their detractors contend that it is either descriptive, and thus devoid of critical potential, or it relies on some moralist value that realists reject. We defend a functionalist reading of realist legitimacy: descriptive legitimacy, that is, the capacity of a political institution to generate beliefs in its right to rule as opposed to commanding through coercion alone, is desirable in virtue of its functional role. First, descriptive (...) legitimacy plays an evaluative role: Institutions can fail to convince citizens that they have a right to rule and can be ranked by how well they do so. Second, descriptive legitimacy plays a normative role, because if an institution fails to convince subjects of its right to rule, this gives them a reason not to comply with its directives, even if it satisfies philosophers’ standards for possessing such right. Order is deemed necessary because individuals need to cooperate to survive, but (...) groups cannot spontaneously secure collective decisions and are prone to conflicts. Particularly, the fact that potentially violent conflicts emerge unilaterally means that order requires coercion. I conclude that mischaracterizing conflict and order leads to undesirable normative principles, and that this criticism can be leveraged not only against Rawlsian liberals who moralize conflicts away, but also against some agonists who underestimate the need for order and some communitarians who underplay both circumstances.
