The paper investigates the role played by ethical deliberation and ethical judgment in Wittgenstein's early thought in the light of twentieth?century German legal philosophy. In particular the theories of the phenomenologists Adolf Reinach, Wilhelm Schapp, and Gerhart Husserl are singled out, as resting on ontologies which are structurally similar to that of the Tractatus: in each case it is actual and possible Sachverhalte which constitute the prime ontological category. The study of the relationship between the states of affairs depicted, e.g., (...) in the sentences of a legal trial and prior fact?complexes to which these may correspond suggests one possible connecting link between the logical and ontological sections of the Tractatus and the ethical reflections appearing at the end. It is argued that the latter can best be understood in terms of the idea of a ?last judgment? (with its associated ethical rewards and punishments) which would relate to the world as a whole as a penal trial relates to individual complexes of facts. (shrink)

The discussions which follow rest on a distinction, first expounded by Husserl, between formal logic and formal ontology. The former concerns itself with (formal) meaning-structures; the latter with formal structures amongst objects and their parts. The paper attempts to show how, when formal ontological considerations are brought into play, contemporary extensionalist theories of part and whole, and above all the mereology of Leniewski, can be generalised to embrace not only relations between concrete objects and object-pieces, but also relations between what (...) we shall call dependent parts or moments. A two-dimensional formal language is canvassed for the resultant ontological theory, a language which owes more to the tradition of Euler, Boole and Venn than to the quantifier-centred languages which have predominated amongst analytic philosophers since the time of Frege and Russell. Analytic philosophical arguments against moments, and against the entire project of a formal ontology, are considered and rejected. The paper concludes with a brief account of some applications of the theory presented. (shrink)

A number of logicians and philosophers have turned their attention in recent years to the problem of developing a logic of interrogatives. Their work has thrown a great deal of light on the formal properties of questions and question-sentences and has led also to interesting innovations in our understanding of the structures of performatives in general and, for example, in the theory of presuppositions. When, however, we examine the attempts of logicians such as Belnap or Åqvist to specify what, precisely, (...) a question is, or what it is to ask or raise a question, then what we are offered is somewhat less illuminating. Two alternative reductionist accounts seem in particular to have gained most favor: questions are identified either as special sorts of statements, or as special sorts of requests. As we hope will become clear in what follows, neither of these accounts is even nearly adequate; and matters are not improved if questions are identified, by force majeure, as combinations of statements and requests. A realist theory of truth for a class of sentences holds that there are entities in virtue of which these sentences are true or false. We call such entities ‘truthmakers’ and contend that those for a wide range of sentences about the real world are moments (dependent particulars). Since moments are unfamiliar, we provide a definition and a brief philosophical history, anchoring them in our ontology by showing that they are objects of perception. The core of our theory is the (...) account of truthmaking for atomic sentences, in which we expose a pervasive ‘dogma of logical form’, which says that atomic sentences cannot have more than one truthmaker. In contrast to this, we uphold the mutual independence of logical and ontological complexity, and the authors outline formal principles of truthmaking taking account of both kinds of complexity. Formal ontology as a main branch of metaphysics investigates categories of being. In the formal ontological approach to metaphysics, these ontological categories are analysed by ontological forms. This analysis, which we illustrate by some category systems, provides a tool to assess the clarity, exactness and intelligibility of different category systems or formal ontologies. We discuss critically different accounts of ontological form in the literature. Of ontological form, we propose a character- neutral relational account. In this metatheory, ontological forms of entities (...) are their standings in internal relations whose holding is neutral on the character of their relata. These relations are “formal ontological relations”. Entities belong to ontological categories because they stand in the same formal ontological relations. We hold a nominalist relationalism about ontological categories and forms. We conclude by showing that our metatheory is useful for understanding categorial fundamentality/non- fundamentality, different formal ontologies, and for unifying metaphysical questions. (shrink)

F. H. Bradley’s relation regress poses a difficult problem for metaphysics of relations. In this paper, we reconstruct this regress argument systematically and make its presuppositions explicit in order to see where the possibility of its solution or resolution lies. We show that it cannot be answered by claiming that it is not vicious. Neither is one of the most promising resolutions, the relata-specific answer adequate in its present form. It attempts to explain adherence (relating), which is a crucial component (...) of the explanandum of Bradley’s relation regress, in terms of specific adherence of a relational trope to its relata. Nevertheless, since we do not know the consequences and constituents of a trope adhering to its specific relata, it remains unclear what specific adherence is. It is left as a constitutively inexplicable primitive. The relata-specific answer only asserts against Bradley. This negative conclusion highlights the need for a metaphysical account of the constitution of the holding of adherence. (shrink)

In the paper, being the second part of the work entitled Noema and Noesis, the formal model of the noematic synthesis functions is presented. Together with functions of noetic synthesis, they are understood as components of functions of intentional reference, which are to be, in turn, formalizations of intentional acts of reference performed in the stream of consciousness. Noemata are understood as mental representations associated with mental worlds. The processes of their synthesis in the mind engage the work of many (...) noematic functions: generating predicative senses, producing noematic cores, and locating noemata in mental worlds (mental spaces). The constructed model is not intended as the faithful reconstruction of the Husserlian conception of noemata. Intuitions of the creator of phenomenology are treated as the only source of inspiration. During the realist revival in the early years of this century, philosophers of various persuasions were concerned to investigate the ontology of truth. That is, whether or not they viewed truth as a correspondence, they were interested in the extent to which one needed to assume the existence of entities serving some role in accounting for the truth of sentences. Certain of these entities, such as the Sätze an sich of Bolzano, the Gedanken of Frege, or the propositions of Russell (...) and Moore, were conceived as the bearers of the properties of truth and falsehood. Some thinkers however, such as Russell, Wittgenstein in the Tractatus, and Husserl in the Logische Untersuchungen, argued that instead of, or in addition to, truth-bearers, one must assume the existence of certain entities in virtue of which sentences and/or propositions are true. Various names were used for these entities, notably 'fact', 'Sachverhalt', and 'state of affairs'. (1) In order not to prejudge the suitability of these words we shall initially employ a more neutral terminology, calling any entities which are candidates for this role truth-makers. (shrink)

The aim of this paper is to show that the account of objective truth taken for granted by logicians at least since the publication in 1933 of Tarski’s “The Concept of Truth in Formalized Languages” arose out of a tradition of philosophical thinking initiated by Bolzano and Brentano. The paper shows more specifically that certain investigations of states of affairs and other objectual correlates of judging acts, investigations carried out by Austrian and Polish philosophers around the turn of the century, (...) formed part of the background of views that led to standard current accounts of the objectivity of truth. It thus lends support to speculations on the role of Brentano and his heirs in contemporary logical philosophy advanced by Jan Wolenski in his masterpiece of 1989 on the Logic and philosophy in the Lvov-Warsaw School. The theory of speech acts put forward by Adolf Reinach in his "The A Priori Foundations of the Civil Law" of 1913 rests on a systematic account of the ontological structures associated with various different sorts of language use. One of the most original features of Reinach's account lies in hIs demonstration of how the ontological structure of, say, an action of promising or of commanding, may be modified in different ways, yielding different sorts of non-standard instances of the corresponding (...) speech act varieties. The present paper is an attempt to apply this idea of standard and modified instances of ontological structures to the realm of judgement and cognition, and thereby to develop a Reinachian theory of how intentionality is mediated through language in acts of thinking and speaking. Phenomenologists have no taste for desert landscapes. The early phenomenologists—Edmund Husserl, Max Scheler, and Roman Ingarden—adopt stratified views of reality on which spiritual objects like artifacts and persons are distinct from their underlying matter. Call this view “pluralism.” After describing Scheler, Ingarden, and Husserl's pluralism about goods, literary artworks, and images, respectively, I reconstruct a phenomenological case for pluralism from Husserl's work and defend it against an objection. The phenomenological method reveals a special subset of objects' essential properties: modes of (...) givenness. On Husserl's view, there are necessary correlations between types of objects and the types of intentional acts through which they are given. Spiritual objects, unlike their matter, can only be given in acts belonging to the “personalistic attitude,” which has a motivational and expressive structure. My broader claim is that Husserl's phenomenology is a sophisticated metametaphysical view about the methodology of first‐order metaphysical inquiry. (shrink)

Adolf Reinach was one of the leading figures of the Munich and Göttingen circles of phenomenology, and Husserl's first real co-worker. Although his writings are highly original and remarkably clear, Reinach's tragic death in the First World War prevented him from formulating a definitive statement of his phenomenology, leaving his name virtually unknown to all but a small circle. In his ground-breaking study, Judgment and Sachverhalt, DuBois shows how Reinach succeeds in developing a realist ontology and epistemology based on rigorous (...) argumentation and phenomenological elucidation. Drawing from numerous texts and the developments of Reinach's students and colleagues - Roman Ingarden, Alexander Pfänder and Dietrich von Hildebrand above all - DuBois presents, refines and defends Reinach's `phenomenological realism'. Confrontations of Reinach's theories of states of affairs, concepts and speech acts with the work of contemporary authors like Chisholm and Searle allow readers to evaluate Reinach's philosophy, not only in the light of the later developments of Husserl, but also in the light of certain Anglo-American developments. This article considers the concept of Sachverhalt in the Austrian philosophical tradition of the 19 th century. In particular, we examine the works of Bernard Bolzano, Rudolf Lotze, Julius Bergmann, Franz Brentano, Karl Stumpf, Anton Marty and Alexius Meinong. The emergence of the concept of Sachverhalt, or the state of things, in extensive philosophical discussions is connected with the works of L. Wittgenstein and phenomenologist Adolf Reinach. Reinach criticized previous theories of judgment. He wrote that they were built on the (...) evaluation, affirmation or negation of a particular object. And that is a mistake. Only introduction of the concept of Sachverhalt allows us to solve a number of logical contradictions that faces the theory of judgment. We find this term in the works of Lotze and Stumpf, but what is its position in their theories? Does it solve the problems that mentions Reinach? Therefore, in this study, we answer the question of how fair is Reinach’s criticism. Also we analyze the various theories of judgment in Austrian philosophy to determine whether it is possible to speak of Sachverhalt as a single entity connecting the concepts of all authors in the Austrian tradition.
