Kant's conception of women is complex. Although he struggles to bring his considered view of women into focus, a sympathetic reading shows it not to be anti-feminist and to contain important arguments regarding human nature. Kant believes the traditional male-female distinction is unlikely to disappear, but he never proposes the traditional gender ideal as the moral ideal; he rejects the idea that such considerations of philosophical anthropology can set the framework for morality. This is also why his moral works clarifies (...) that all citizens, including women have the right, and should be encouraged to strive towards an active condition. (shrink)

Kant on sex gives most philosophers the following associations: a lifelong celibate philosopher; a natural teleological view of sexuality; a strange incorporation of this natural teleological account within his freedom-based moral theory; and a stark ethical condemnation of most sexual activity. Although this paper provides an interpretation of Kant’s view on sexuality, it neither defends nor offers an apology for everything Kant says about sexuality. Rather, it aims to show that a reconsidered Kant-based account can utilize his many worthwhile insights (...) and that making Kant’s account of sexuality more consistent with his own basic philosophical commitments results in a compelling approach to the complex and complicated phenomena of sexual love, sexual identity, and sexual orientation. Liberal theories of justice have been rightly criticized for two things by care theorists. First, they have failed to deal with private care relations’ inherent (inter)dependency, asymmetry and particularity. Second, they have been shown unable properly to address the asymmetry and dependency constitutive of care workers’ and care-receivers’ systemic conditions. I apply Kant’s theory of right to show that current care theories unfortunately reproduce similar problems because they also argue on the assumption that good care requires only virtuous private individuals. Recently, a number of Kantians have argued that despite Kant’s own disparaging comments about same-sex intercourse and marriage, his ethical and legal philosophy lacks the resources to show that they are impermissible. I go further by arguing that his framework is in fact more open to same-sex than to different-sex marriage. Central is Kant’s claim that marriage requires equality between spouses. Kant himself thought that men and women are not equal, and some of his more insightful remarks on the issue (...) reveal that he was also aware that, as a matter of fact, women were disenfranchised by society, and suffer legal and other forms of discrimination. Kant, according to his own account, cannot approve of heterosexual marriage. Same-sex couples, by contrast, can satisfy the crucial equality condition. I conclude with a suggestion for refocus with respect to the issues at hand, calling for attention to more complex and insidious forms of inequality than deprivation of rights and full civil participation. Sex raises fundamental philosophical questions about topics such as personal identity and well-being, the relationship between emotion and reason, the nature of autonomy and consent, and the dual nature of persons as individuals but also social beings. This article serves as an overview of the philosophy of sex in the English-speaking philosophical tradition and explicates philosophical debate in several specific areas: sexual objectification, rape and consent, sex work, sexual identities and queer theory, the medicalization of sexuality, and polyamory. It situates (...) these topics in a framework of shifting cultural attitudes and argues for the importance of the philosophy of sex. It ends with some suggestions about future research, particularly with regard to the changing nature of pornography and sexual justice in legal theory. (shrink)

I defend the right to an abortion at any stage of pregnancy by drawing on a Kantian account of consent and innate right. I examine how pregnant women are positioned in moral and legal debates about abortion, and develop a Kanitan account of bodily autonomy in order to pregnant women’s epistemic authority over the experience of pregnancy. Second, I show how Kant's distinction between innate and private right offers an excellent legal framework for embodied rights, including abortion and sexual consent, (...) and I draw on the legal definition of sexual consent in order to show how abortion discourse undermines women's innate right. I then explore Kant’s treatment of the infanticidal mother, and draw out the parallels between this case and contemporary abortion rights in order to develop a distinctly Kantian framework of reproductive rights in non-ideal conditions. Finally, I explore the implications of this non-ideal approach for contemporary abortion discourse, arguing that debates about the legality of abortion should more broadly engage the barbaric conditions of reproductive injustice. Intentar explicar el origen, evolución y violación de un tabú considerado casi universal en las sociedades humanas no es una empresa sencilla dado su carácter polifacético; sin embargo, ello no ha impedido que en muchos ordenamientos jurídicos sea empleado ese sentimiento de repulsión o asco como un elemento para criminalizar una relación sexual aparentemente ofensiva. El artículo sostiene que el matrimonio es la única forma en que las prácticas sexuales entre parientes en condición de igualdad pueden tener lugar. Para ello: (...) I. Presentaremos algunas teorías que ofrecen respuestas a las incógnitas en torno al tabú, II. Veremos por qué para Kant el incesto es un crimina carnis contra naturam en un caso, y secundum naturam en el otro. III. Examinaremos qué es el matrimonio para el filósofo y por qué constituye un ideal regulativo-práctico de las relaciones sexuales humanas.
