This lecture was originally given at the Einstein Forum in Berlin. It contains a summary of some of the themes in my book The Construction of Social Reality and continues the line of argument I presented there.

This comment deals with some basic elements Searle uses in order to construct social reality, i.e. togetherness, we-intentionality and the distinction between institutional and brute facts. The commentator argues that Searle’s theory tends to a partial biologism because lacking a sufficient concept of embodiment. Consequently ‘pre-institutional facts’ such as eating, copulating, working or torturing are systematically underdetermined. On the deontic level the theory relies on natural processes of conventional power. So the distinction between factual acceptance and acceptability is blurred by (...) a sort of conformism, and one neglects the status of dissidents and victims whose belonging to the predominant ‘we’ remains highly dubious. Nicholas Rescher presents a critical reaction against two currently influential tendencies of thought. On the one hand, he rejects the facile relativism that pervades contemporary social and academic life. On the other hand, he opposes the rationalism inherent in neo-contractarian theory--both in the idealized communicative-contract version promoted in continental European political philosophy by J;urgen Habermas, and in the idealized social contract version of the theory of political justice promoted in the Anglo-American context by John Rawls. Against such tendencies, Rescher's pluralist (...) approach takes a more realistic and pragmatic line, eschewing the convenient recourse of idealization in cognitive and practical matters. Instead of a utopianism that looks to a uniquely perfect order that would prevail under ideal conditions, he advocates incremental improvements within the framework of arrangements that none of us will deem perfect but that all of us "can live with." Such an approach replaces the yearning for an unattainable consensus with the institution of pragmatic arrangements in which the community will acquiesce--not through agreeing on their optimality, but through a shared recognition among the dissonant parties that the available options are even worse. _ Convention_ was immediately recognized as a major contribution to the subject and its significance has remained undiminished since its first publication in 1969. Lewis analyzes social conventions as regularities in the resolution of recurring coordination problems-situations characterized by interdependent decision processes in which common interests are at stake. Conventions are contrasted with other kinds of regularity, and conventions governing systems of communication are given special attention.

John Searle began to discuss his recently published book `The Construction of Social Reality' with Anthony Freeman, and they ended up talking about God. The book itself and part of their conversation are introduced and briefly reflected upon by Anthony Freeman. Many familiar social facts -- like money and marriage and monarchy -- are only facts by human agreement. They exist only because we believe them to exist.
