This collection contains twenty-one thought-provoking essays on the controversies surrounding the moral and legal distinctions between euthanasia and "letting die." Since public awareness of this issue has increased this second edition includes nine entirely new essays which bring the treatment of the subject up-to-date. The urgency of this issue can be gauged in recent developments such as the legalization of physician-assisted suicide in the Netherlands, "how-to" manuals topping the bestseller charts in the United States, and the many headlines devoted to (...) Dr. Jack Kevorkian, who has assisted dozens of patients to die. The essays address the range of questions involved in this issue pertaining especially to the fields of medical ethics, public policymaking, and social philosophy. The discussions consider the decisions facing medical and public policymakers, how those decisions will affect the elderly and terminally ill, and the medical and legal ramifications for patients in a permanently vegetative state, as well as issues of parent/infant rights. The book is divided into two sections. The first, "Euthanasia and the Termination of Life-Prolonging Treatment" includes an examination of the 1976 Karen Quinlan Supreme Court decision and selections from the 1990 Supreme Court decision in the case of Nancy Cruzan. In this much-anticipated book, Jonathan Dancy offers the only available full-scale treatment of particularism in ethics, a view with which he has been associated for twenty years. Dancy now presents particularism as the view that the possibility of moral thought and judgement does not in any way depend on an adequate supply of principles. He grounds this claim on a form of reasons-holism, holding that what is a reason in one case need not be any reason in another, and maintaining (...) that moral reasons are no different in this respect from others. Ethics Without Principles offers detailed treatment and criticism of opposing positions of all sorts, with useful summaries. It also contains three chapters on the nature of what Dancy calls 'contributory' reasons, which, though the topic of much interest at the moment, are not often discussed in anything like the detail given here. And it offers a distinctive form of value-holism to go with the holism of reasons. As Dancy's definitive statement on particularism, the book will be required reading for all those working on moral philosophy and ethical theory. (shrink)

Franz Brentano developed an original theory of intrinsic value which he attempted to base on his philosophical psychology. Roderick Chisholm presents here a critical exposition of this theory and its place in Brentano's general philosophical system. He gives a detailed account of Brentano's ontology, showing how Brentano tried to secure objectivity for ethics not through a theory of practical reason, but through his theory of the intentional objects of emotions and desires. Professor Chisholm goes on to develop certain suggestions about (...) intrinsic value made by Brentano and his students, and discusses their relevance to theodicy and the problem of evil. Brentano, as the teacher of Husserl, Meinong, Twardowski, and others, stands at the origin of the phenomenological tradition and of the Polish school of philosophy that developed after World War I. He has also had considerable influence on Anglo-American philosophy. This book will interest those concerned with the origins of phenomenological value theory and more generally with the connections between ethics and philosophical psychology. (shrink)

This paper argues that Moore’s principle of organic unities is false. Advocates of the principle have failed to take note of the distinction between actual intrinsic value and virtual intrinsic value. Purported cases of organic unities, where the actual intrinsic value of a part of a whole is allegedly defeated by the actual intrinsic value of the whole itself, are more plausibly seen as cases where the part in question has no actual intrinsic value but instead a plurality of merely (...) virtual intrinsic values. The aim of this paper is to explain and defend a type of argument common in the doing/allowing literature called a “contrast argument.” I am concerned with defending a particular type of contrast argument that is intended to demonstrate the moral irrelevance of the doing/allowing distinction. This type of argument, referred to in this paper as an “irrelevance argument,” is exemplified by an argument offered by James Rachels (1975) that employs the Smith and Jones bathtub cases. My main contention in (...) this paper is that none of the objections to the use of irrelevance arguments are successful, and that they still pose a genuine challenge to defenders of the moral relevance of the doing/allowing distinction. ABSTRACTI believe that there is no intrinsic moral difference between killing and letting die. That is, there is no difference that depends solely on the distinction between an act and an omission. I also believe that we can reasonably establish this thesis by appeal to the Bare Difference Argument. The form of this argument involves considering two imaginary cases in which there are no morally relevant differences present, save the bare difference that one is a case of killing and one (...) a case of letting die. But in the pair of cases under consideration this bare difference makes no moral difference. Hence it cannot be that the bare difference between killing and letting die is in itself a morally important difference.Winston Nesbitt has recently argued that the Bare Difference Argument fails because “the examples produced typically possess a feature which makes their use in this context illegitimate, and that when modified to remove this feature, they provide support for the view which they were designed to undermine”. I argue that Nesbitt misunderstands the logic of the Bare Difference Argument and that accordingly his objections are mistaken. (shrink)

The paper distinguishes between two rival views about the nature of final value (i.e. the value something has for its own sake) — intrinsicalism and conditionalism. The former view (which is the one adopted by G.E. Moore and several later writers) holds that the final value of any F supervenes solely on features intrinsic to F, while the latter view allows that the final value of F may supervene on features non-intrinsic to F. Conditionalism thus allows the final value of (...) F to vary according to the context in which F appears. Given the plausible assumption that there is an intimate tie between final values and appropriate attitudinal responses, it appears that conditionalism is the better approach for mainly the following three reasons: First, intrinsicalism is too indiscriminate, which makes it subject to what I call ‘location problems’ of final value. I illustrate this problem by discussing alleged examples of Moorean organic unities. Second, intrinsicalism evokes symptoms of ‘evaluative schizophrenia’. Third, considerations of theoretical economy tell in favour of conditionalism. Thereafter I respond to some recent challenges to conditionalism. An appendix surveys some meritorious implications that conditionalism offers for various substantial versions of such structurally different views about value as monism, pluralism, and particularism. Value is either additive or else it is subject to organic unity. In general we have organic unity where a complex whole is not simply the sum of its parts. Value exhibits organic unity if the value of a complex, whether a complex state or complex quality, is greater or less than the sum of the values of its components or parts. Whether or not value is additive might be thought to be of purely metaphysical interest, but it is also (...) connected with important aspects of evaluative reasoning. Additivity is closely connected with principles of bare difference and separability which are often tacitly assumed in value theory. The author spells out these principles and trace their connections with additivity and organic unity. The author then develops an unpleasant paradox of additivity. Additivity apparently entails nihilism: that nothing is more valuable than anything else. Additivity involves a kind of axiological atomism -- that complexes decompose into components or factors; that these factors possess value independently of their role in valuable complexes; and that the factors do not interact in their production of overall value. In order to avoid the paradox it seems as though the factors have to be akin to the metaphysically privileged states of logical atomism -- a doctrine that does not enjoy widespread support. The paradox poses a problem not only for the notions of organic unity and additivity, but also for the closely related bare-difference principles which lie at the heart of value theory and of its application. The author proposes a way of eliminating the paradox, and thereby saving additivity and separability, without presupposing an unpalatable variant of logical atomism. The author closes with the proposal to treat principles of additivity as regulative ideals in our search for intrinsic values. (shrink)

Frances Kamm's aptly titled Intricate Ethics is a tour de force of what Peter Unger calls the ‘preservationist’ approach to ethical theory. Here is some of what she says about her methodology: Consider as many case-based judgments of yours as prove necessary. Do not ignore some case-based judgments, assuming they are errors, just because they conflict with simple or intuitively plausible principles that account for some subset of your case-based judgments. Work on the assumption that a different principle can account (...) for all of the judgments. Be prepared to be surprised at what this principle is . . . . I say, consider your case-based judgments, rather than a survey of everyone's judgments. This is because I believe that much more is accomplished when one person considers her judgments and then tries to analyze and justify their grounds than if we do mere surveys. (shrink)

I defend the view that there are organic unities mainly by presenting examples of organic unities. I also defend the view against two objections. The first objection appeals to the notion of an evaluatively incomplete state of affairs. The second objection holds that the intrinsic value of a state of affairs can be different in different contexts. I argue that neither objection provides a compelling reason for rejecting these examples.

In this essay, I defend the Moorean position on organic unities. I will present some plausible examples of organic unites and consider some objections to them. In particular, I will consider an objection from evaluative inadequacy and an objection from Holism or Conditionalism. I will also examine one line of criticism that claims the Moorean position is incoherent.

Many philosophers, psychologists, and medical practitioners believe that killing is no worse than letting die on the basis of James Rachels's Bare-Difference Argument. I show that his argument is unsound. In particular, a premise of the argument is that his examples are as similar as is consistent with one being a case of killing and the other being a case of letting die. However, the subject who lets die has both the ability to kill and the ability to let die (...) while the subject who kills lacks the ability to let die. Modifying the latter example so that the killer has both abilities yields a pair of cases with morally different acts. The hypothesis that killing is worse than letting die is the best explanation of this difference. (shrink)

The philosophical debate over the moral difference between killing and letting die has obvious relevance for the contemporary public debate over voluntary euthanasia. Winston Nesbitt claims to have shown that killing someone is, other things being equal, always worse than allowing someone to die. But this conclusion is illegitimate. While Nesbitt is correct when he suggests that killing is sometimes worse than letting die, this is not always the case. An attractive admirer of George Bernard Shaw once wrote to him with a not-so modest proposal: ``You have the greatest brain in the world, and I have the most beautiful body; so we ought to produce the most perfect child.'' Shaw replied: ``What if the child inherits my body and your brains?''What if, indeed? Shaw's retort is interesting not because it revealsa grasp of elementary genetics, but rather because it suggests his grasp of an interesting and important principle of axiology. (...) Since the brainy but ugly Shaw and his beautiful but apparently dim admirer both fall short of the ideal, she suggests that the best thing would be to genetically recombine his intelligence with her beauty. But what then would be the value of another genetic possibility: that of recombining his ugliness with her stupidity? Underlining the prompted inference is a fundamental principle of the theory of value which, perhaps surprisingly, has so far gone largely unnoticed in the ethical literature. This introductory article describes the phenomena of incommensurability and incomparability, how they are related, and why they are important. Since incomparability is the more significant phenomenon, the paper takes that as its focus. It gives a detailed account of what incomparability is, investigates the relation between the incomparability of values and the incomparability of alternatives for choice, distinguishes incomparability from the related phenomena of parity, indeterminacy, and noncomparability, and, finally, defends a view about practical justification that vindicates the importance of (...) incomparability — assuming it exists — for practical reason. I compare two kinds of holism about values: G.E. Moore's 'organic unities', and Jonathan Dancy's 'value holism'. I propose a simple formal model for representing evaluations of parts and wholes. I then define two conditions, additivism and invariabilism, which together imply a third, atomism. Since atomism is absurd, we must reject one of the former two conditions. This is where Moore and Dancy part company: whereas Moore rejects additivism, Dancy rejects invariabilism. I argue that Moore's view is more plausible. Invariabilism (...) ought to be retained because (a) it eliminates the needless multiplication of values inherent in variable evaluations, and (b) it preserves a certain necessary connection between values and reasons, which Dancy himself endorses. Many people hold that there is an important moral distinction between passive euthanasia and active euthanasia. Thus, while the AMA maintains that people have a right quote to die with dignity, quote so that it is morally permissible for a doctor to allow someone to die if that person wants to and is suffering from an incurable illness causing pain that cannot be sufficiently alleviated, the MA is unwilling to countenance active euthanasia for a person who is in similar straits, (...) but who has the misfortune not to be suffering from an illness that will result in a speedy death. -/- A similar distinction with respect to infanticide has become a commonplace of medical thinking and practice. If an infant is a mongoloid or a microcephalic, and happens also to have some other defect requiring corrective surgery if the infant is to live, many doctors and hospitals believe that the parents have the right to decide whether the surgery will be performed, and thus whether the infant will survive. But if the child does not have any other defect, it is believed that the parents do not have the right to terminate its life. -/- The rationale underlying these distinctions between active and passive euthanasia, and between active and passive infanticide, is the same: the idea that there is a crucial moral difference between intentionally killing and intentionally letting die. This idea is admittedly very common. But I believe that it can be shown to reflect either confused thinking or a moral point of view unrelated to the interests of individuals. (shrink)
