Die Cartesianischen Meditationen sind aus Vorträgen hervorgegangen, die Edmund Husserl Mitte Februar 1929 an der Sorbonne gehalten hat. Bei der Grundfragestellung Descartes’ einsetzend, entfaltet Husserl die transzendentale Phänomenologie als »Umbildung und Neu­bildung« des Cartesischen Programms der prima philosophia im Sinne einer Reform der Philosophie zu einer absoluten Wissenschaft aus absoluter Begründung. Eine französische Ausgabe, in der Übersetzung von Emmanuel Levinas und Gabrielle Pfeiffer, erschien 1931 bei A. Colin in Paris. Husserls Arbeiten an dem Manuskript für die deutsche Ausgabe, die gegenüber (...) der französischen erheblich erweitert werden sollte, blieben, nicht zuletzt wegen der 1933 veränderten politischen Situation, unvollendet. So erschien die erste deutschsprachige Ausgabe der Cartesianischen Meditationen erst postum in dem von Stephan Strasser herausgegebenen Band 1 der Husserliana , Den Haag 1950.Die Studienausgabe basiert auf dem Text der zweiten Auflage des Bandes in den Husserliana von 1963, hg. von Rudolf Boehm. Human attitudes to animals have changed as non-humans have become more widely incorporated in the category of moral agents who deserve some respect. Parallels between the functioning of humans and non-humans have been made for thousands of years but the idea that the animals that we keep can suffer has spread recently. An improved understanding of motivation, cognition and the complexity of social behaviour in animals has led in the last 30 years to the rapid development of animal welfare science. (...) Early attempts to define welfare referred to individuals being in harmony with nature but the first usable definition incorporated feelings and health as part of attempts to cope with the environment. Others considered that welfare is only about feelings but it is argued that as feelings are mechanisms that have evolved they are a part of welfare rather than all of it. Most reviews of welfare now start with listing the needs of the animal, including needs to show certain behaviours. This approach has used sophisticated studies of what is important to animals and has replaced the earlier general guidelines described as freedoms. Many measures of welfare are now used and indicate how good or how poor the welfare is. Naturalness is not a part of the definition of welfare but explains why some needs exist. In recent years, welfare has become established as one of various criteria used to decide on whether a system is sustainable because members of the public will not accept systems that cause poor welfare. The study of welfare has become part of the scientific basis upon which important political decisions are made. (shrink)

This chapter discusses the application of the capabilities approach to the question of animal rights. It explains that this approach provides better theoretical guidance on the issue of animal entitlements over contractarian and utilitarian approaches because it is capable of recognising a wide range of types of animal dignity and of corresponding needs for flourishing. Sie eignet sich daher als Einführung in Kants Ethik, enthält aber zugleich als Grundlegung alle wesentlichen Gedanken seiner praktischen Philosophie. Auf der Grundlage der Originalausgabe von 1785/86 wurde der Text völlig neu erstellt. This chapter presents an alternative to the standard view that at least some of the evaluations that the so-called “thick” terms and concepts in ethics may be used to convey belong to their sense or semantic meaning. After introducing the topic and making some methodological remarks, the chapter presents a wide variety of linguistic data that are well explained by the alternative view that at least a very wide range of thick terms and concepts are such that even the evaluations (...) that are most closely connected to them are only a certain kind of defeasible implications of their utterances which can be given a conversational explanation. The chapter then describes some reasons to think that this explanation of the data presented is superior to the standard view, although a fuller assessment must await further work. The chapter closes by explaining the largely deflationary consequences of this account for claims that thick terms and concepts have deep and distinctive significance to evaluative thought and judgment. I examine the process and outcomes of animal genetic manipulation (‘transgenesis’) with reference to its morally salient features. I consider several objections to transgenesis. I examine and reject the alleged intrinsic wrongness of ‘deliberate genetic sequence alteration’, as I do the notion that transgenesis may lead to human genetic manipulation. I examine the alleged wrongness of killing inherent in transgenesis, and suggest that the concept of ‘replaceability’ successfully justifies such killing, although not for entities deemed to possess ‘personhood’. I examine (...) ‘significant suffering’ associated with transgenesis and propose the radical conclusion that, although it would be wrong to prohibit animal genetic manipulation per se, utilitarians ought to support a ‘default prohibition’ on transgenic experiments that entail significant suffering. I begin with Kant's notion of a maxim and consider the role which this notion plays in Kant's formulations of the fundamental categorical imperative. This raises the question of what a maxim is, and why there is not the same requirement for resolutions of other kinds to be universalizable. Drawing on Bernard Williams' notion of a thick ethical concept, I proffer an answer to this question which is intended neither in a spirit of simple exegesis nor as a straightforward exercise (...) in moral philosophy but as something that is poised somewhere between the two. My aim is to provide a kind of rational reconstruction of Kant. In the final section of the essay, I argue that this reconstruction, while it manages to salvage something distinctively Kantian, also does justice to the relativism involved in what J. L. Mackie calls 'people's adherence to and participation in different ways of life'. (shrink)

We live in an age of great scientific and technological innovation, and what seemed out of the question or at least very doubtful only a few years ago, today lies almost within our grasp. In no area is this more true than that of human health care, where lifesaving and life-enhancing technologies have given, or have the enormous potential in the not so distant future to give, relief from some of the most terrible human illnesses. On two fronts in particular, (...) xenograft or cross-species transplantation and genetic engineering of animals on behalf of gene therapy in humans, such relief appears very promising, if not actually on the horizon. This article provides an empirically based, interdisciplinary approach to the following two questions: Do animals possess behavioral and cognitive characteristics such as culture, language, and a theory of mind? And if so, what are the implications, when long-standing criteria used to justify differences in moral consideration between humans and animals are no longer considered indisputable? One basic implication is that the psychological needs of captive animals should be adequately catered for. However, for species such as great apes and dolphins with (...) whom we share major characteristics of personhood, welfare considerations alone may not suffice, and consideration of basic rights may be morally warranted—as for humans. Although characteristics supporting the status of personhood are present to differing degrees among the diverse array of animal species, this is a barrier to moral consideration only if anthropocentric, exclusive, and monolithic viewpoints about the necessary prerequisites for personhood are applied. We examine the flaws inherent within such positions and argue for inalienable species-appropriate rights. (shrink)
