Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

The theoretical work of European and American structuralism has produced a number of important elements which have resulted in (especially with respect to certain new, fundamental approaches in semantics, philosophy and methodology) essential shifts in the modes of thinking in the humanities, and in the cultural and social sciences. Despite these shifts, Western discourses have still not produced any integral, coherent structural model of epistemology. The present article intends to show that such a model can be found in the pan-structural (...) epistemology of the modern Chinese philosopher Zhang Dongsun (1886?1973), and that the crucial, theoretical underpinnings of such models were developed much earlier in the history of Chinese thought, given that the bases of a structural approach to comprehension had already been established in ancient Chinese philosophy. This paradigmatic foundation (the concept li) was further developed and elaborated by various Chinese philosophers in later centuries as a crucial feature of the classical Chinese logic of binary analogies. The article also points out that the central binary concept of the Neo-Confucian tradition (i.e. the concept of structure and creativity; li and qi) has generally been interpreted as a dualism of idea and matter by Euro-American sinologists. However, such interpretations have overlooked an important feature of traditional, structurally determined Chinese onto-epistemology. (shrink)

Recent accounts of scientific method suggest that a model, or analogy, for an axiomatized theory is another theory, or postulate set, with an identical calculus. The present paper examines five central theses underlying this position. In the light of examples from physical science it seems necessary to distinguish between models and analogies and to recognize the need for important revisions in the position under study, especially in claims involving an emphasis on logical structure and similarity in form between theory and (...) analogy. While formal considerations are often relevant in the employment of an analogy they are neither as extensive as proponents of this viewpoint suggest, nor are they in most cases sufficient for allowing analogies to fulfill the roles imputed to them. Of major importance, and what these authors generally fail to consider, are physical similarities between analogue and theoretical object. Such similarities, which are characteristic in varying degrees of most analogies actually employed, play an important role in affording a better understanding of concepts in the theory and also in the development of the theoretical assumptions. In the last few years, there has been an enormous amount of activity in the study of analogy and metaphor. This is partly because of an interest of artificial intelligence researchers in simulating learning processes using analogy. It also arises from critical examinations of standard theories in the philosophy of language, with their inbuilt literal/meta phoric distinction. This volume consists of recent previously unpub lished work in this area, with a particular emphasis upon the role of analogies in reasoning and, (...) more generally, their role in thought and language. The papers are contributed by philosophers, computer scientists, cognitive scientists and literary critics. Researchers in these fields whose focus is the study of analogy and metaphor will find much of interest in this volume. These essays can also serve as an introduction to some of the major approaches taken in the investigation of analogy. As noted, this volume brings together the work of researchers in several different disciplines. The various approaches taken with respect to the understanding of analogy tend to be rather different, however, the articles suggest a common conclusion. We are pleased to publish this WSIA edition of Trudy’s Govier’s seminal volume, Problems in Argument Analysis and Evaluation. Originally published in 1987 by Foris Publications, this was a pioneering work that played a major role in establishing argumentation theory as a discipline. Today, it is as relevant to the field as when it first appeared, with discussions of questions and issues that remain central to the study of argument. The reasoning process of analogy is characterized by a strict interdependence between a process of abstraction of a common feature and the transfer of an attribute of the Analogue to the Primary Subject. The first reasoning step is regarded as an abstraction of a generic characteristic that is relevant for the attribution of the predicate. The abstracted feature can be considered from a logic-semantic perspective as a functional genus, in the sense that it is contextually essential for the attribution of (...) the predicate, i.e. that is pragmatically fundamental (i.e. relevant) for the predica-tion, or rather the achievement of the communicative intention. While the transfer of the predicate from the Analogue to the analogical genus and from the genus to the Primary Subject is guaranteed by the maxims (or rules of inference) governing the genus-species relation, the connection between the genus and the predicate can be complex, characterized by various types of reasoning patterns. The relevance relation can hide implicit arguments, such as an implicit argument from classification , an evaluation based on values, consequences or rules, a causal relation, or an argument from practical reasoning. The purpose of this paper is to analyze the structure and the defeasibility conditions of argument from analogy, addressing the issues of determining the nature of the comparison underlying the analogy and the types of inferences justifying the conclusion. In the dialectical tradition, different forms of similarity were distinguished and related to the possible inferences that can be drawn from them. The kinds of similarity can be divided into four categories, depending on whether they represent fundamental semantic features of the (...) terms of the comparison or non-semantic ones, indicating possible characteristics of the referents. Such distinct types of similarity characterize different kinds of analogical arguments, all based on a similar general structure, in which a common genus is abstracted. Depending on the nature of the abstracted common feature, different rules of inference will apply, guaranteeing the attribution of the analogical predicate to the genus and to the primary subject. This analysis of similarity and the relationship thereof with the rules of inference allows a deeper investigation of the defeasibility conditions. (shrink)

Metaphorical meaning can be analyzed as triggered by an apparent communicative breach, an incongruity that leads to a default of the presumptive interpretation of a vehicle. This breach can be solved through contextual renegotiations of meaning guided by the communicative intention, or rather the presumed purpose of the metaphorical utterance. This paper addresses the problem of analyzing the complex process of reasoning underlying the reconstruction of metaphorical meaning. This process will be described as a type of abductive argument, aimed at (...) explaining how the vehicle can best contribute to the purpose of the utterance. This type of reasoning involves the analysis of the possible predicates that can be and usually are attributed to the vehicle, and the selection of the one that can support the implicit conclusion constituting the communicative goal of the metaphorical utterance. Metaphorical meaning, in this perspective, becomes the outcome of a complex process of meaning reconstruction aimed at providing the best explanation of the function of the vehicle within a discourse move. Analogies come in several forms that serve distinct functions. Inductive analogy is a common type of analogical argument, but critical thinking texts sometimes treat all analogies as inductive. Such an analysis ignores figurative analogies, which may elucidate but do not argue; and also neglects a priori arguments by analogy, a type of analogical argument prominent in law and ethics. A priori arguments by analogy are distinctive, but--contrary to the claims of Govier and Sunstein-they are best understood as deductive, rather than (...) a special form of non deductive reasoning. A theory of analogy must describe how the meaning of an analogy is derived from the meanings of its parts. In the structure‐mapping theory, the interpretation rules are characterized as implicit rules for mapping knowledge about a base domain into a target domain. Two important features of the theory are (a) the rules depend only on syntactic properties of the knowledge representation, and not on the specific content of the domains; and (b) the theoretical framework allows analogies to be distinguished (...) cleanly from literal similarity statements, applications of abstractions, and other kinds of comparisons.Two mapping principles are described: (a) Relations between objects, rather than attributes of objects, are mapped from base to target; and (b) The particular relations mapped are determined by systematicity, as defined by the existence of higher‐order relations. ABSTRACT: In this essay I characterize arguments by analogy, which have an impor- tant role both in philosophical and everyday reasoning. Arguments by analogy are dif- ferent from ordinary inductive or deductive arguments and have their own distinct features. I try to characterize the structure and function of these arguments. It is further discussed that some arguments, which are not explicit arguments by analogy, nevertheless should be interpreted as such and not as inductive or deductive arguments. Legal Reason describes and explains the process of analogical reasoning, which is the distinctive feature of legal argument. It challenges the prevailing view, urged by Edward Levi, Cass Sunstein, Richard Posner and others, which regards analogical reasoning as logically flawed or as a defective form of deductive reasoning. The authors find East Asians to be holistic, attending to the entire field and assigning causality to it, making relatively little use of categories and formal logic, and relying on "dialectical" reasoning, whereas Westerners, are more analytic, paying attention primarily to the object and the categories to which it belongs and using rules, including formal logic, to understand its behavior. The 2 types of cognitive processes are embedded in different naive metaphysical systems and tacit epistemologies. The authors speculate that the (...) origin of these differences is traceable to markedly different social systems. By Parallel Reasoning is the first comprehensive philosophical examination of analogical reasoning in more than forty years designed to formulate and justify standards for the critical evaluation of analogical arguments. It proposes a normative theory with special focus on the use of analogies in mathematics and science. In recent decades, research on analogy has been dominated by computational theories whose objective has been to model analogical reasoning as a psychological process. These theories have devoted little attention to normative questions. This idea leads to a set of distinct models for the critical analysis of prominent forms of analogical argument. The same core principle makes it possible to relate analogical reasoning to norms and values of scientific practice. Reasoning by analogy is justified because it strikes an optimal balance between conservative values, such as simplicity and coherence, and progressive values, such as fruitfulness and theoretical unification. Analogical arguments are also justified by appeal to symmetry--like cases are to be treated alike. In Rhetoric in Ancient China, Fifth to Third Century B.C.E., Xing Lu examines language art, persuasion, and argumentation in ancient China and offers a detailed and authentic account of ancient Chinese rhetorical theories and practices in the society's philosophical, political, cultural, and linguistic contexts. She focuses on the works of ten well-known Chinese thinkers from Confucius to Han Feizi as well as on the Later Mohists, a group that represents five schools of thought-Mingjia, Confucianism, Daoism, Mohism, and Legalism. Lu identifies (...) seven key Chinese terms pertaining to speech, language, persuasion, and argumentation as they appeared in these original texts, selecting ming bian as the linchpin for the Chinese conceptual term of rhetorical studies. -/- The author shows that ancient Chinese rhetorical practices shifted in emphasis from ritualistic ceremony to political persuasion, from poetic composition to philosophical debate. The rhetorical perspectives were diverse, evolutionary, and contextual and were typically characterized by one of four main elements: the moral, epistemological, dialectical, or psychological. -/- Lu compares Chinese rhetorical perspectives with those of the ancient Greeks. The author contends that the Greeks and the Chinese shared a view of rhetoric as an ethical enterprise and of speech as a rational and psychological activity. The two traditions differed, however, in their rhetorical education, sense of rationality, perceptions of the role of language, approach to the treatment and study of rhetoric, and expression of emotions. -/- The author also links ancient Chinese rhetorical perspectives with contemporary Chinese interpersonal and political communication behavior and offers suggestions for multicultural rhetoric that recognizes both culturally specific and transcultural elements of human communication. Work on analogy has been done from a number of disciplinary perspectives throughout the history of Western thought. This work is a multidisciplinary guide to theorizing about analogy. This paper demonstrates the limits of such a reconstruction and argues for an alternative. non-deductive reconstruction. It will be shown that some analogical arguments do not fit Waller's deductive schema, and that such a schema does not allow for an adequate account of the strengths and weaknesses of an analogical argument. Following a Toulmian account of argument analysis and evaluation, I offer a general unitary schema for, so called, deductive and inductive types of analogical arguments. This schema is able to explain why certain analogical arguments can be said to be deductive, and yet, also defeasible.

This paper discusses the method when an argument is refuted by a parallel argument since the flaw of the parallel argument is clearly displayed. The method is explicated, examined and compared with two other general methods.
