Mais dans la sphère de la Tradition juridique rentraient aussi le « dépôt légal », c’est-à-dire l’ensemble de toutes les lois, même des lois ainsi dites « ordinaires », c’est-à-dire celles qui avaient été produites par la simple manifestation de volonté souveraine d’un roi prédécesseur « car tel avait été son plaisir » (moderne formulation du brocarde de droit romain : « quidquid principi placuit legis habet vigorem »). Ainsi la juridiction parlementaire donnait lieu à un jugement de constitutionnalité qui était normalement exercé de manière très flexible par le corps de la magistrature, dépendant des circonstances et des intérêts politiques momentanés des situations juridiques qu’elle voulait protéger. La hiérarchie des normes était ainsi un formidable instrument de protection de cet ordre juridique dont les legum doctores se sentaient les tuteurs. My paper argues that the Nicomachean Ethics endorses kingship (basileia) as the best regime (aristê politeia). In order to justify such a claim, I look at Aristotle’s discussion and rankings of regimes throughout the Ethics, specifically, the discussions of regime division in EN VIII.10, the inculcation of virtue in II.1, ethical habituation in X.9, and the “one regime which is best everywhere according to nature” in V.7.

Once again the decision and court opinion are an element within the general understanding of law at least in the common law countries. A lawyerly way has implications in shaping the pattern of public administration, but in differing extent of public attraction or normative impact. -/- First, while the Constitution of United States had brought a popular democracy and Constitution-based structure of government, the Ancient Regime had been overhauled in new land. The “nobility” as a basis of government was (...) dispelled, and people arose as a main class or pillar of nation. As we take a precept of chaotic years from the Articles of Confederation thorough the Constitution, the earlier ambition was mixed between the diplomatic unity and one strong national government. This context implicates much over the centuries and can also be illustrated with a residue of classic and present practice of international politics. The characteristics as temporal for the years would more properly be sensible with the kinds of description, for example, “atmosphere of war, interstate comity or discredit, chaos from the heterogeneous regional power and social incongruence nationally.” A threat from the mainland Europe had been constant at considerable period of time upon the independence. For the nation, it is more urgent to make it clear who will decide the will of nation, how to effectively consolidate the function of government, or how to manage the least of nation with the subjects than active interaction with the people, although the people are one distinct element of new Constitution and ideologically pronounced in the preamble of Constitution. This generally led to recognition that the role of Constitution and Supreme Court were minimal in terms of public policy making and that their policy contained in the opinion often is sheer of internal issues among the public power other than those of people. The kind of Kantian ambition for the universal justice on liberty and equality, hence, should wait for more prosperous time afterwards that people tend to be conscious of their basic rights or public good from the arbitrary rule of majority, given our concocted recognition from the kind of public policy ideals from Bentham, “the greatest happiness of greatest number,” and “revolutionary spirit on people.” It perhaps would not be irrelevant, in understanding of the impact of judicial rulings on public policy, that the US is other than unitary system of government. Oftentimes the kind of rulings on criminalization of adultery or right to privacy would surprise the people, but the kind of oxymoron or public debate, as likely persistent over the decades and diverse reaction, would normally not be present in the jurisdictions of unitary system. The people of such jurisdictions would be more than receptive, and be readily marshaled to adapt with the public guidelines elucidated by the court ruling. We also chat on the multiculturalism in the society and workplace. Given the judicial activism, the Supreme Court justices might be clairvoyant, who would be equipped with goodwill, wisdom and almighty intelligence to assuage an untreatable scope of interests and state specificities. Foreign lawyers would find such ample source of laws in surprise, who might envy a wide coverage of judicial interests. They perhaps would take the US context as the kind of insightful classroom and learn the lessons from their case laws. (shrink)

Ancient Chinese history holds a quality which has syncretized traditional thought with its cultural wealth unified of mystical and mythological figures in the background. Such that classical documents, which had begun to be written before Common Era, has directly influenced the political regime, education system and status of society in China. One of the most prominent features of these works is to propound collective knowledge about perception of cosmology, attitudes to earthiness, community standards, policy and morality. Among Five Classics (...) works of these masterpieces of Chinese philosophy, Book of Changes which stands closest to metaphysical narrative, mainly consists of the texts about prophecy. While this piece of work had been referred as a divination guide in Western Zhou Dynasty (1046-771 BC), it turned into a cosmological text that included a range of philosophical commentary during Warring States Period (475-221 BC). The mainstay of this remarkable change is the direct correlation of all the concepts and terms that characterize the worldly beyond along with the relevant text, especially yin-yang dualism, which symbolizes an extraordinary harmony in early Chinese thought. Traditional idea suggests reciprocity in which heaven, earth and man are interconnected to maintain natural order. However, the superiority attributed to human beings also brings compulsive responsibilities to idealize a compatible society. This paper aims to discuss influences of cosmological and anthropological items on human behaviors explained in prescriptive perspective. (shrink)

Seeing how the idea of the ‘ruler cult’ and the necessary ‘myth-making’ to establish it exists to this day, as seen with the regime of a 21st century dictator like Kim Jong-il, it would be most interesting to see what parallels exist between cases of divine leadership and what we might learn about our contemporary cult rulers when looking at the dynamics of the two-millennia-old cult of the deified Emperor Augustus. As such, I have formulated a central question that focuses (...) on the reign of Divus Augustus, and in doing so provides opportunity to extrapolate from it new insights in similar but contemporary figures of leadership. With the 21st century, we are witnessing the mass spread of the communication technologies and social media revolution. Interactive networks built on a global scale have led to the formation of a virtual world of reality that is connecting the whole world. With the global spread of communication networks, the question of whether social media points to a new public sphere has been raised. Social media applications such as Facebook, Twitter and Instagram are nowadays seen as a place where political (...) campaigns are carried out, causing the destruction of authoritarian regimes, organizing global protests and innovation culture, and discussing political, social and cultural changes. What gives social media a similar quality to the agora of Ancient Greek city-states is the characteristic of been a place where citizens come together and talk about issues that are considered to be public, eventhough in a virtual reality. This work, following the Arendtian sense, discusses whether social media really is a place where public issues are discussed, common ideas are produced and transparency prevails. In her work "The Human Condition", Arendt makes a fundamental distinction between private and public sphere based on human activities. By conceiving the activities that she describes as labour and work in relation to the private sphere, Arendt tackles the activity of action through linking it to public sphere. Arendt defines the public sphere as a sphere of freedom and a political sphere. The public sphere consists of equal people without hierarchy, who come together with their completely free will. According to Arendt, the condition for the public sphere to be possible is transparency and commonality. Firstly; it has a wide transparency in the sense that something have to be seen and heard by others, and the second is that it points to a common world that belongs to everyone, except for the part that is privately owned. Considering the public sphere in relation to the transparency not a direct transfer of things that happen in the private or intimate sphere. It is precisely related to the fact that something pertaining to the private exhibits a presence within the world of public and the fact that the private acquires a public chatacter. This does not mean that the public sphere is a sphere in which the private and intimate are directly transferred. According to Arendt, leading a private life as a whole will lead to the lack of what is necessary to be a true person. It also leads to the lack of a common world that unites and separates them. Arendt thinks that with the modern period, what belongs to the purely private and intimate sphere expands and causes the collapse of the public. The collapse of the public sphere in the modern period; It has caused both the loss of difference and interaction and the emergence of individuals who are increasingly alike, unable to think and act. In this kind of society, action has left its place to behavior, difference to standartization and thought to obedience. Arendt sees the public sphere as a sphere where public affairs are discussed, while the private sphere is a sphere where intimate and private activities take place. Arendt argues that with modern society the distinction between public and private has became indistinct , and as a third sphere, the social sphere has swallowed up both the public and the private. The social sphere has removed the distinction between the public transparency and commonality of the public and the privacy of the private sphere and activities. This study considers social media as a sphere where public issues are discussed. It also dıscusses the private sphere events and the most intimate issues. It claims that social media is not a new public sphere as it is cosidered, but it is a social sphere in which the distinction between private and public in the Arendtian sense is become indistinct. In this context, the study seeks to answer the following questions: How does the distinction between public and private spheres, which is central in Arendt's thought, look like in today’s world? Is it possible to talk about a public sphere in the modern age? Can social media be considered as a public sphere? Or is social media a sphere of freedom and a political sphere? Does social media allow discussions on public issues? Is social media a non-hierarchical nature open to the free participation of everyone, difference and plurality? (shrink)

This physics note entails a summary of an extended form of Eccles-Cartesian Interactive Dualism mind-body-multiverse paradigm called Noetic Field Theory: The Quantization of Mind (NFT), distinguished as a paradigm because it is comprehensive and empirically testable. NFT posits not only that the brain is not the seat of awareness but also that neither classical nor quantum mechanics are sufficient to describe mind as the required regime entails the new physics associated with Unified Field, UF Mechanics. This means that the brain (...) is merely a transducer (form of quantum computer) mediating mentation, sensory data and metabolic function. The so-called ‘Hard Problem’ of cognitive science arises as a category error in philosophy of mind, i.e. an incorrect posit of the question “what processes in the brain give rise to awareness” which instead should simply be queried “what processes give rise to awareness”. In the history of science whenever a hard problem has arisen it has later been shown that the underlying principles had not been understood. NFT posits these underlying principles in a comprehensive empirically testable manner solving the ancient mind-body problem in a manner that enables breaking the 1st person 3rd person barrier able to explain Psi-phenomena. The premise is that the mind-body is a naturally occurring form of ‘conscious quantum computer’ (QC), not that the QC is conscious but that it is modelled after those principles. The rise of constitutional self-government in early modern Europe, I argue, owes much to a nationalist liberation narrative pioneered by French Huguenot François Hotman in Francogallia (1573). In response to appeals by absolutist thinkers to Ro- man law, which put the power of the king beyond legal or constitutional restraint, Hotman wove together tales of the heroism of ancient Gauls and Franks wresting their native liberties back from the Romans with a theory of constitutionally limited government grounded in the (...) common law of France. This type of narrative was adapted by Dutch and English thinkers who sought to defend constitutionalism in their respective countries. Through this examination of early modern liberation narratives, I argue we can gain insight on the relationship between nationalism and resistance to autocratic governments and the formation of regimes consistent with the principles of constitutional self-government. The essay concerns the negative end of the political argument of the Republic, that injustice—the rule of unreason—is both widespread and undesirable, and that whatever shadows of virtue or order might be found in its midst are corrupt and unstable. This claim is explained in detail in Republic 8 and 9. These passages explain recognizable faults in recognizable regimes in terms of the failure of the rule of reason and the corresponding success of the rule of non-rational forms of motivation. (...) I will first look at degenerate regimes as they appear in a less systematic way in the Ship of State passage in Republic 6 and in the discussion with Thrasymachus in book 1. I then give a general overview of the system of degenerate regimes in book 8 to examine what exactly goes wrong with them and why, and explain how the process of degeneration ought be understood as the progressive decay of the rule of reason. Finally, I argue that a close look at this decay reveals something surprising: that degenerate regimes and characters feature weak versions of virtue, shadow-virtues that are based on appearances and held in place by force. Thus in the end the whole process of degeneration ought be understood as an extended conflict between reason and appetite. (shrink)

Is there grounding in ancient philosophy? To ask a related but different question: is grounding a useful tool for the scholar of ancient philosophy? These questions are difficult, and my goal in this paper is not so much to give definitive answers as to clarify the questions. I hope to direct the student of contemporary metaphysics towards passages where it may be fruitful to look for historical precedent. But I also hope to offer the student of ancient (...) philosophy some guidance on when drawing on the contemporary discussion of grounding may be beneficial. (shrink)

This book treats ancient logic: the logic that originated in Greece by Aristotle and the Stoics, mainly in the hundred year period beginning about 350 BCE. Ancient logic was never completely ignored by modern logic from its Boolean origin in the middle 1800s: it was prominent in Boole’s writings and it was mentioned by Frege and by Hilbert. Nevertheless, the first century of mathematical logic did not take it seriously enough to study the ancient logic texts. A (...) renaissance in ancient logic studies occurred in the early 1950s with the publication of the landmark Aristotle’s Syllogistic by Jan Łukasiewicz, Oxford UP 1951, 2nd ed. 1957. Despite its title, it treats the logic of the Stoics as well as that of Aristotle. Łukasiewicz was a distinguished mathematical logician. He had created many-valued logic and the parenthesis-free prefix notation known as Polish notation. He co-authored with Alfred Tarski’s an important paper on metatheory of propositional logic and he was one of Tarski’s the three main teachers at the University of Warsaw. Łukasiewicz’s stature was just short of that of the giants: Aristotle, Boole, Frege, Tarski and Gödel. No mathematical logician of his caliber had ever before quoted the actual teachings of ancient logicians. -/- Not only did Łukasiewicz inject fresh hypotheses, new concepts, and imaginative modern perspectives into the field, his enormous prestige and that of the Warsaw School of Logic reflected on the whole field of ancient logic studies. Suddenly, this previously somewhat dormant and obscure field became active and gained in respectability and importance in the eyes of logicians, mathematicians, linguists, analytic philosophers, and historians. Next to Aristotle himself and perhaps the Stoic logician Chrysippus, Łukasiewicz is the most prominent figure in ancient logic studies. A huge literature traces its origins to Łukasiewicz. -/- This Ancient Logic and Its Modern Interpretations, is based on the 1973 Buffalo Symposium on Modernist Interpretations of Ancient Logic, the first conference devoted entirely to critical assessment of the state of ancient logic studies. Section III of part IV of Book I of Hume's Treatise entitled “Of the ancient philosophy” has been virtually ignored by most Hume scholars. Although philosophers seem to concentrate on sections II and VI of part IV and pay little or no attention to section III, the latter section is paramount in showing how serious Hume's skepticism is, and how Hume's philosophy, contrary to his intention, is far removed from "the sentiments of the vulgar". In this paper I shall (...) first explore Hume's view on ancient philosophy as it is presented in section III, and I shall particularly focus on his discussion of identity and simplicity of bodies. Second, I shall argue that Hume's account of identity and simplicity in terms of qualities is at best unsatisfactory. Finally, I shall try to show that Hume's advice to hold a "moderate" skepticism cannot be taken seriously. On the contrary, Hume seems to hold an "extravagant" skepticism, since he claims that there is a contradiction between our most fundamental natural beliefs, as well as between our natural beliefs and philosophical reasoning. The radical mean suggested by Socrates in order to carry out the program of the Republic - the relegation to the fields of all inhabitants over the age of 10 - has perplexed modern commentators who have seen in it an ironical remark, a reductio ad absurdum presented in order to establish the very impossibility of Kallipolis or, on the contrary, a sign of the totalitarian and criminal character of the Platonic city. But it is far from evident, in view (...) of political or military events prior and contemporary with the redaction of the Republic, that this solution could offend the moral conscience of fourth-century Greeks. This practice even seems to be the logical consequence of a certain oligarchic or aristocratic ideology, common by the end of the 5th c. and at the beginning of the 4th c., which associated, on the one hand, rural organization with the ‘best regime’ and, on the other, urban centralisation with democracy. The actual practices of the Lacedaemonian city, which maintained its primitive organization in komai, and even tried to impose it to other cities, could also serve as a model for the opponents of Athenian democracy. All of Plato's political models, from the Republic to the Laws, present cities whose essential, if not exclusive, productive activity is agriculture. Recently the role of ideology and hegemony has received increased attention to explain varying dynamics of diffusion and autocratic cooperation. As a result, patterns of interaction in clusters from regions without hegemony or ideology have been overlooked because their autocracy-toautocracy transitions are no threat to the global status of democracy, even when active regime promotion is very common. This article will apply insights from economic cluster theory to political regimes and introduce a typology to differentiate among clusters. Regime Cluster Theory (...) is the first framework that presents three ideal-types of ideological, hegemonic and biotopical regime clusters. With a new concept of ‘biotopical clusters’ the paper explains the dynamics of clusters in often omitted regions, like in Sub Saharan Africa, Latin America during the Cold War, or Central Asia during the 1990s. RCT offers a dynamic approach to recognize and assess patterns of forcible regime promotion per cluster as well as distinguish between their different diffusion patterns (coercive, voluntary, bounded learning, contagion) in four arenas: institutions, ideas, policy and administrative practices. RCT advances the comparative study of regime promotion and diffusion in various regions of the world and hopes to shed new light on related theories of alliance formation, regional institutionalization, and (conflict) spill-over effects. Our present day knowledge in the area of medicine in Ancient Egypt has been severally sourced from medical papyri several of which have been deduced and analyzed by different scholars. For educational purposes it is always imperative to consult different literature or sources in the teaching of ancient Egypt and medicine in particular. To avoid subjectivity the author has found the need to re-engage the efforts made by several scholars in adducing evidences from medical papyri. In the quest (...) to re-engage the efforts of earlier writers and commentaries on the medical papyri, we are afforded the opportunity to be informed about the need to ask further questions to enable us to construct or reconstruct both past and modern views on ancient Egyptian medical knowledge. It is this vocation the author sought to pursue in the interim, through a preliminary review, to highlight, comment and reinvigorate in the reader or researcher the need for a continuous engagement of some pertinent documentary sources on Ancient Egyptian medical knowledge for educational and research purposes. The study is based on qualitative review of published literature. The selection of those articles as sources was based on the focus of the review, in order to purposively select and comment on articles that were published based either on information from a medical papyrus or focused on medical specialization among the ancient Egyptians as well as ancient Egyptian knowledge on diseases and medicine. It was found that the Egyptians developed relatively sophisticated medical practices covering significant medical fields such as herbal medicine, gynecology and obstetrics, anatomy and physiology, mummification and even the preliminary form of surgery. These practices, perhaps, were developed as remedies for the prevailing diseases and the accidents that might have occurred during the construction of their giant pyramids. It must be stated that they were not without flaws. Also, the key issues raised from these literatures are but a few among the Egyptian medical corpus across the academic and publishing world. It should therefore afford researchers, students and readers the opportunity to continue the educational dialogue on the medical practices of the Ancient Egyptians. (shrink)

Powerful, technically complex international compliance regimes have developed recently in certain professions that deal with risk: banking (the Basel II regime), accountancy (IFRS) and the actuarial profession. The need to deal with major risks has acted as a strong driver of international co-operation to create enforceable international semilegal systems, as happened earlier in such fields as international health regulations. This regulation in technical fields contrasts with the failure of an international general-purpose political and legal regime to develop. We survey the (...) new global regulatory systems in the actuarial, banking and accounting fields, with a view to showing how the need to deal reasonably with risk has resulted in an international de facto law solidly based on correct abstract principles of probability. At a time when professional art criticism is on the wane, the ancient quarrel between art and philosophy demands fresh answers. Professional art criticism provided a basis upon which to distinguish apt experiences of art from the idiosyncratic. However, currently the kind of narratives from which critics once drew are underplayed or discarded in contemporary exhibition design where the visual arts are concerned. This leaves open the possibility that art operates either as mere stimulant to private reverie or, in (...) the more contentful cases, as propaganda. The ancient quarrel between art and philosophy is that art influences surreptitiously while philosophy presents reasons that invite rational scrutiny. As such, in contrast to philosophy, art would undermine our agency. In July 2017, a group of philosophers gathered at the Art Gallery of NSW (AGNSW), in Sydney, Australia, in the presence of two AGNSW curators to explore the basis of their own experiences of selected artworks. Here, those commentaries are reproduced. Each reveal that objective grounds for an experience of art can be based in the community from which one draws one’s terms of reference. In our commentaries we see the expertise of the respective philosophical communities but other communities of culture or expertise might serve the same purpose and hence resolve the ancient quarrel. Before hearing these commentaries, I explain what is at stake when the ancient quarrel between art and philosophy is understood in contemporary terms. This Issue of the Curator also includes an article on the community-based art criticism that emerges from these commentaries followed by an exhibition review which reveals the incorrigible impulse (also demonstrated in the commentaries) to find the basis for the most apt experience of an artwork. Ancient Greek Psychology and the Modern Mind-Body Debate offers an overview of Platonic-Aristotelian thought on man with a view to considering what its alternative conceptual framework may contribute to the modern debate which is dominated by the scepticism confronting modern reductionism. The mind-body problem is central to the modern philosophical and cultural debate because we cannot understand what man is until we understand what consciousness is and how it interacts with the body. Although many suggestions have been offered, no (...) convincing account has as yet appeared. Perhaps it was all mistaken ideology from the start? A crucial (and fatal?) distinction was made by modern natural science in the 17th century between the subjective/qualitative and the objective/quantitative. The ancient Greeks, notably Plato and Aristotle, focused not on consciousness and experience, but on goal-directed reason/form, and the contrast was not mechanical matter, but the particular. The latter owed its intelligibility and being to reason and form and did not, therefore, constitute a realm of its own. Hence the ancient picture of man did not fall apart either: the soul is conceived of as a dynamic-telic aspect of the human organism. Considering the problems and consequent scepticism that confronts modern reductionism and the recent appearance of holistic ideology in many areas it is suggested that we take a fresh look at the alternative conceptual framework of our ancient Greek ancestors. With regard to the importance of interrelations and interplays of topos and logos in ancient theory and practices, here I will appropriate Aristotle philosophizing of topos and logos and apply it for the ancient persian Empire as reflected in related inscriptions.

Though there is no international government, there are many international regimes that enact binding regulations on particular matters. They include the Basel II regime in banking, IFRS in accountancy, the FIRST computer incident response system, the WHO’s system for containing global epidemics and many others. They form in effect a very powerful international public sector based on technical expertise. Unlike the public services of nation states, they are almost free of accountability to any democratically elected body or to any legal (...) system. Although by and large they have acted for good, the dangers of long-term unaccountability are illustrated by the travesties of justice perpetrated by the International Labour Organisation Administrative Tribunal. Apontamos a obra de um colecionador como ponto de partida para a observação de seu papel como mediador linguístico e cultural. A escolha das obras que compõem seu catálogo de objetos artísticos fornece uma descrição cronológica da arte chinesa e das (...) suas principais produções em cada dinastia. Ademais, analisaremos as obras de um pintor atuante em Macau na época em que Jorge escrevera suas Notas. Assim, veremos de que maneira a obra pictórica de Fausto Sampaio insere-se na tradição naturalista de pintura que, desde meados do século XIX, procura fixar em telas a diversidade dos costumes nacionais. Sampaio vem a ser testemunha ocular do Império ultramarino português. Estudaremos como suas imagens foram instrumentalizadas com fins políticos, desempenhando um papel na construção de uma identidade nacional continuamente evocada pela propaganda do Estado Novo. As much as reality itself, its reflections and appearances have taken a significant place in philosophical discussions. While Plato's Allegory of the Cave is one of the first of these discussions, the philosophy of the virtual shows the final state of these discussions today. The virtual cave is the modern-day version of Plato's cave. Appearances in Plato's cave have their own mode of existence, and likewise, virtual objects in the virtual cave have their own mode of existence. There are many (...) philosophical similarities between the ancient cave and the virtual cave. So much so that, according to the first, the shadows in the cave are a different view of reality, while according to the second, the virtual images in the virtual cave are another view of reality. The philosophy of the ancient cave and virtual cave essentially point to the debates about what the nature of reality is. The ontological and epistemic dimensions of appearance and virtual image lead us to the discussion about the nature and whatness of reality. The most common and advanced virtual cave today is the metaverse. Metaverse consists of virtual communities that combine the reality of the physical world with the reality of the virtual world and are open to all kinds of manipulations. (shrink)

At least since Socrates, philosophy has been understood as the desire for acquiring a special kind of knowledge, namely wisdom, a kind of knowledge that human beings ordinarily do not possess. According to ancient thinkers this desire may result from a variety of causes: wonder or astonishment, the bothersome or even painful realization that one lacks wisdom, or encountering certain hard perplexities or aporiai. As a result of this basic understanding of philosophy, Greek thinkers tended to regard philosophy as (...) an activity of inquiry (zētēsis) rather than as a specific discipline. Discussions concerning the right manner of engaging in philosophical inquiry – what methodoi or routes of inquiry were best suited to lead one to wisdom – became an integral part of ancient philosophy, as did the question how such manners or modes of inquiry are related to, and differ from, other types of inquiry, for instance medical or mathematical. This essay examines the quantitative aspects of Greco-Roman science, represented by a group of established disci¬plines, which since the fourth century BC were called mathēmata or mathē¬ma¬tikai epistē¬mai. In the group of mathēmata that in Antiquity normally comprised mathematics, mathematical astronomy, harmonics, mechanics and optics, we have also included geography. Using a dataset based on The Encyclopaedia of Ancient Natural Scientists, our essay considers a community of mathēmatikoi (as they called themselves), or ancient scientists (as they are defined (...) for the purposes of the present paper) from a sociological point of view, focusing on the size of the scientific population known to us and its disciplinary, temporal and geographical distribution. A diachronic comparison of neighboring and partly overlapping communities, ancient scientists and philosophers, allows the pattern of their interrelationship to be traced. An examination of centers of science throughout ancient history reveals that there were five major centers – Athens, Alexandria, Rhodes, Rome and Byzantium/Constantinople – that appear and replace one another in succession as leaders. These conclusions serve to reopen the issue of the place of mathēmata and mathēmatikoi in ancient society. (shrink)

The recent political developments in the Philippines require a reevaluation of the nature of the State under the Rodrigo Duterte regime. Just years ago, scholars illustrated the regime of Duterte to be a populist, illiberal, or authoritarian one. But since then, and especially during the pandemic, a lot of things have changed. In this paper, I will argue that Duterte’s regime is a fascist one. Unlike how Walden Bello characterized Duterte as a fascist original, a characterization laden with theoretical inconsistencies (...) and practical difficulties, I will develop a concept of fascism proper to the neoliberal and semi-colonial conditions of the Philippines. I will likewise trace the rise, development, and stabilization of the regime’s fascism. The discussion will be supported and illuminated by some illustrative examples taken from the experience of the mass movement in Cebu. (shrink)

In this thesis we have examined the complex interaction between intellectual property rights, life sciences and global justice. Science and the innovations developed in its wake have an enormous effect on our daily lives, providing countless opportunities but also raising numerous problems of justice. The complexity of a problem however does not liberate society as a whole from moral responsibilities. Our intellectual property regimes clash at various points with human rights law and commonly held notions of justice.

Jaegwon Kim has argued (Kim 2006a) that the two key issues for emergentism are to give a positive characterization of the emergence relation and to explain the possibility of downward causation. This paper proposes an account of emergence which provides new answers to these two key issues. It is argued that an appropriate emergence relation is characterized by a notion of ‘transformation’, and that the real key issue for emergentism is located elsewhere than the places Kim identifies. The paper builds (...) on Victor Caston’s important work on ancient philosophy of mind (Caston 1997, 2001), but appeals to sources he has not considered. (shrink)

Jordan made substantial market access commitments as part of its WTO membership negotiations. Jordan has low average tariffs with single or two digits rate and ad valorem-only duties with some exceptions where specific duties apply. Customs standards in Jordan were streamlined in accordance with WTO rules. Jordan confirmed in its accession to the WTO that free zones or export processing zones would be fully subject to the coverage of the commitments taken in the protocol of accession. Pyrrhonism was one of the two main ancient skeptical traditions. In this second paper of the three‐part series devoted to ancient skepticism, I present and discuss some of the issues on Pyrrhonian skepticism which have been the focus of much attention in the recent literature. The topics to be addressed concern the outlooks of Pyrrho, Aenesidemus, and Sextus Empiricus.

In this paper, I will deal with the issue of the relationship between trust, authoritarian democratic regimes and crises. I will pay special attention to the issue of the relationship between personal trust and trust in institutions. I will try to point out the way in which distrust in institutions develops in authoritarian regimes, as well as the populist way of diminishing the importance of institutions and trust in them, which are seen as obstacles to an efficient relationship between the (...) leader and the people. The question on the essence of man and his relationship to nature is certainly one of the most important themes in the philosophy of Hans Jonas. One of the ways by which Jonas approaches the issue consists in a comparison between the contemporary interpretation of man and forms of wisdom such as those conveyed by ancient Greek philosophy and the Jewish tradition. The reconstruction and discussion of these frameworks play a fundamental role in Jonas’s critique of the modern mind. (...) In the first section I introduce the anthropological problem in Hans Jonas’s oeuvre. Moreover, I clarify why it becomes essential for Jonas to resort to different forms of traditional wisdom. In the second and third sections I try to give an account (as complete as possible) of the two generalisations which Jonas shapes in order to criticise the modern concepts of man and nature. In the last section I show how Jonas links these generalisations to his own philosophical assessment of modernity. Finally, I focus on his methodology, which exemplifies how critical thinking may arise from a reconsideration of traditional contents. (shrink)

Having an adequate and extensively recognized resource governance system is essential for the conservation and sustainable use of crop genetic resources in a highly populated planet. Despite the widely accepted importance of agrobiodiversity for future plant breeding and thus food security, there is still pervasive disagreement at the individual level on who should own genetic resources. The aim of the article is to provide conceptual clarification on the following concepts and their relation to agrobiodiversity stewardship: open access, commons, private property, (...) state property and common heritage of humankind. After presenting each property regime, we will examine whether and how these incentivize the conservation, improvement and sharing of crop genetic resources, and conclude by defending a mixed property regime. Leo Strauss presents at least two distinct accounts of the idea that the authors in the political-philosophical canon have often masked their true teachings. A weaker account of esotericism, dependent on the contingent fact of presecution, is attributed to the moderns, while a stronger account, stemming from a necessary conflict between philosophy and society, is attributed to the ancients. Although most interpreters agree that Strauss here sides with the ancients, this view fails to consider the possibility that Strauss's writings on (...) esotericism may themselves be composed esoterically. A reevaluation of Straussian hermeneutics in light of this possibility suggests that the elitism and secrecy often associated with "Straussianism" may stem, not from Strauss's true account of esotericism, but instead from an exoteric doctrine designed to seduce students into a life of philosophy. Ancient philosophy knew two main skeptical traditions: the Pyrrhonian and the Academic. In this final paper of the three‐part series devoted to ancient skepticism, I present some of the topics about Academic skepticism which have recently been much debated in the specialist literature. I will be concerned with the outlooks of Arcesilaus, Carneades, and Philo of Larissa.

In this paper I discuss in some detail my experience teaching women philosophers in the context of a survey course in ancient Greek philosophy at a small liberal arts college. My aim is to share the peculiar difficulties one may encounter when teaching this topic in a lower-level undergraduate course, difficulties stemming from a multiplicity of methodological hurdles that do not arise when teaching women philosophers in other periods, such as the modern era. In the first section, I briefly (...) review some of what we know about ancient Greek women philosophers, which is not only very little but frustratingly uncertain and highly debated. I devote the second section to some of the scholarly debates surrounding these philosophers’ doctrines, the details of their biographies, and their very existence. The third section is about the corresponding pedagogical challenges, and the fourth and final section describes the strategies I implemented to face those challenges. (shrink)

Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. The article deals with currents and tides. We look at the history of their observation in antiquity as well as alternative theories, designed to explain their nature. Major theories accessed are those by Aristotle, Posidonius and Seneca. Special attention is given to ancient explanation of the phenomenon of the periodical change of the stream in Euripus’ channel. Throughout we refl ect on an analogy between natural phenomena and the processes occurring in living organisms, common to our philosophers of nature, (...) as well as the peculiarities of their interpretation of the theory of mutual transformation of the elements. The information regime is mediated by the culture of the electronic device. It is characterized by the control of the deluded citizen through the deployment of freedom, thereby nullifying the core issue of human life: freedom. Through phenomenological-hermeneutic methodology (Heidegger, 2002), this work starts from the world of digital life to direct the interpretation towards digital governance, all of which appears as a hermeneutic horizon the information regime. It is concluded that in this new social order the political and all (...) other orders that arise from interaction are governed by a capitalism of emotions. (shrink)

Scholarly attempts to analyze the history of science sometime suffer from an imprecise use of terms. In order to understand accurately how science has developed and from where it draws its roots, researchers should be careful to recognize that epistemic regimes change over time and acceptable forms of knowledge production are contingent upon the hegemonic discourse informing the epistemic regime of any given period. In order to understand the importance of this point, I apply the techniques of historical epistemology to (...) an analysis of the place of the study of astrology in the medieval and early modern periods alongside a discussion of the “language games” of these period as well as the role of the “archeology of knowledge” in uncovering meaning in our study of the past. In sum, I argue that the term “science” should never be used when studying approaches to knowledge formation prior to the seventeenth century. (shrink)

B.K.Matilal, and earlier J.F.Staal, have suggested a reading of the `Nyaya five limb schema' (also sometimes referred to as the Indian Schema or Hindu Syllogism) from Gotama's Nyaya-Sutra in terms of a binary occurrence relation. In this paper we provide a rational justification of a version of this reading as Analogical Reasoning within the framework of Polyadic Pure Inductive Logic.

This paper is about the history of a question in ancient Greek philosophy and medicine: what holds the parts of a whole together? The idea that there is a single cause responsible for cohesion is usually associated with the Stoics. They refer to it as the synectic cause (αἴτιον συνεκτικόν), a term variously translated as ‘cohesive cause,’ ‘containing cause’ or ‘sustaining cause.’ The Stoics, however, are neither the first nor the only thinkers to raise this question or to propose (...) a single answer. Many earlier thinkers offer their own candidates for what actively binds parts together, with differing implications not only for why we are wholes rather than heaps, but also why our bodies inevitably become diseased and fall apart. This paper assembles, up to the time of the Stoics, one part of the history of such a cause: what is called ‘the synechon’ (τὸ συνέχον) – that which holds things together. Starting with our earliest evidence from Anaximenes (sixth century BCE), the paper looks at different candidates and especially the models and metaphors for thinking about causes of cohesion which were proposed by different philosophers and doctors including Empedocles, early Greek doctors, Diogenes of Apollonia, Plato and Aristotle. My goal is to explore why these candidates and models were proposed and how later philosophical objections to them led to changes in how causes of cohesion were understood. (shrink)

Cannabis in the Ancient Greek and Roman World explores the use of cannabis and hemp in medicine, religion, and recreation in the classical period. This work surveys the plant in Greek and Roman literature and provides a compendium of primary sources discussing hemp through the Middle Ages.

Scholarship on ancient skepticism has undergone a remarkable renaissance in the last three decades. Specialists in ancient philosophy have explored the complex history of the Greco‐Roman skeptical traditions and discussed difficult philological and exegetical issues. But they have also assessed the philosophical significance of the various ancient skeptical outlooks. In this first paper, I provide a general presentation of this area of study, while in the two subsequent articles I will focus on some of the topics that (...) have been the object of much attention in the recent literature on ancient skepticism. John Rawls’s difference principle says that we should change our economy if doing so is better for the worst-off group, on the condition that certain basic rights are secured. This paper presents a kind of case that challenges the principle. If we modify the principle to cope with the challenge, we open the way to a Sorites paradox.

The netherworld marriage or the wedding for dead persons is a folk religious ritual in ancientChina. It is based on ancient Chinese folk belief of afterlife in the netherworld. Through a textual research and investigation based on relevant historical records and other ancient documents, as well as some archeological discoveries, this paper tries to give a brief account of the origin and development of netherworld marriage and its cultural and ideological background in ancient China. It finds that (...) netherworld marriage might originate from human sacrifice in early ancient times, and its name varies in different periods. It has gone through its prevailing in the Tang Dynasty, declining in the Song and Yuan Dynasties, and reviving again in the Ming and Qing Dynasties. During the long history, this custom was generally criticized and condemned by orthodoxy Confucian intellectuals, yet it was practiced and sometimes even prevailed among both noble class and common people, due to its deep root in the folk belief. The paper also intends to clarify some misconceptions and misunderstandings concerning the study of this unique cultural phenomenon. (shrink)
