How could a philosopher who insists on the exclusion of women from citizenship and state office by virtue of their insuperable weakness be an inspiration for feminism? The puzzles over Spinoza’s egalitarian credentials pose a problem particularly if one understands feminism primarily or exclusively as a demand for equality with men. When feminism is seen as a subcategory of Enlightenment commitments, one may choose to see Spinoza’s misogyny as superficial and as a betrayal of the radical potential of the egalitarianism (...) yielded by his metaphysics. But if feminism is not understood exclusively as one strand of late modern orthodoxy, we might better understand the surprising companionship of Spinoza and feminism. Indeed, Moira Gatens finds the heterodoxy of Spinoza’s thinking with respect to the ruling ideas today to be what is most valuable for feminism. Feminist Spinozism does not add to the chorus of praise for egalitarianism, secular politics, or the authority of reason in contrast to power. The Spinozist feminism pioneered by Moira Gatens and Genevieve Lloyd finds resources precisely in Spinoza’s challenges to late modern common sense, including perhaps especially an ethics and politics grounded in the givenness of human equality. In his Bipartitum in morali philosophia, the Scottish philosopher William of Manderston, a pupil of John Mair, and an Ockhamist philosopher, is quoting a text of Antonin of Padua who distinguishes the factum opened to a juridical qualification from the inner belief, known by God alone. Quoting the same text, the authors of the Malleus maleficarum try hard to distinguish three distinct fields, the inner beliefs which belongs to God, the exterior acts, the facts, which are relevant for the judges, (...) and the third field, which establishes a relation between the fact and the beliefs. This third field is proper to the inquisitors. Against this ethics of imputability, Manderston, relying on Ockham’s ethics, advocates an intentionalist ethics which depends on a sharp separation between interiority and exteriority. The soteriological dimension of the question entirely belongs to the inner life, whereas the exteriority is strictly disciplinary. By his radicality, Manderston appears as a paradigm of the modern dichotomy between conscience and law, Paolo Prodi once pointed out as a cornerstone of the religious modernity. (shrink)

‘Judgment’ is Brentano’s terms for any mental state liable to be true or false. This includes not only the products of conceptual thought, such as belief, but also perceptual experiences, such as seeing that the window was left open. ‘Every perception counts as a judgment,’ writes Brentano (1874: II, 50/1973a: 209). Accordingly, his theory of judgment is not exactly a theory of the same phenomenon we call today ‘judgment,’ but of a larger class of phenomena one (perhaps the main) species (...) of which is what we call judgment. Even if we keep this in mind, though, the profound heterodoxy of Brentano’s theory of judgment is still striking. Brentano develops this heterodox theory in some detail already in the Psychology from Empirical Standpoint (Brentano 1874/1973a). But he continued to work out its details, and various aspects of it, until his death. Many of the relevant articles, notes, and fragments of relevance have been collected by Oskar Kraus in 1930 and published under the title Truth and Evidence (Brentano 1930/1966b). Kraus prefaces this volume with an elaborate reconstruction, of dubious plausibility, according to which Brentano’s accounts of judgment and truth have gone through four distinct stages. In reality, there is a unified underlying conviction underwriting Brentano’s work both on judgment and on truth (see CHAP. 20 on the latter). Here I present this unified core of this highly original theory of judgment, which can be captured in terms of three main theses. The first is that contrary to appearances, all judgments are existential judgments (§1). The second is that the existential force of judgment is indeed a force, or mode, or attitude – it does not come from the judgment’s content (§2). The third is that judgment is not a propositional attitude but an ‘objectual’ attitude (§3). (shrink)

Ludwig Wittgenstein has often been called a quietist. His work has inspired a rich and varied array of theories in moral philosophy. Some prominent meta-ethicists have also been called quietists, or ‘relaxed’ as opposed to ‘robust’ realists, sometimes with explicit reference to Wittgenstein in attempts to clarify their views. In this chapter, I compare and contrast these groups of theories and draw out their importance for contemporary meta-ethical debate. They represent countercultures to contemporary meta-ethics. That is, they reject in different (...) ways one or more of the common assumptions that, whilst not universally shared, shape how to understand and engage in contemporary meta-ethical debate. Despite striking similarities, I argue that the ‘quietist’ label has obscured the views it is used to describe, the crucial differences between them, and the challenge that they offer to the predominant culture of meta-ethical enquiry. That challenge is this: there are plausible different ways of understanding and doing meta-ethics to those of the meta-ethical orthodoxy. We ignore such heterodoxy at our own peril. (shrink)

Hobbes's religious beliefs ultimately remain a mystery, as perhaps they were meant to: the private views of someone concerned to conform outwardly to what his church required of him, and thereby avoid to heresy, while maintaining intellectual autonomy. The hazard of Hobbes's particular catechism is that he and his supporters (...) could never avoid the suspicion of insincerity. His preparedness to believe whatever the prince demanded of him smacked of heresy in the more usual sense, despite elaborate biblical exegesis designed to prove his orthdoxy. Undoubtedly he realized it even as he wrote the last lines of Leviathan, expressing the hope that "I cannot think it will be condemned at this time, either by the Publique Judge of Doctrine, or by any that desires the continuance of Publique Peace/7 Indicating an intention to return to science, he continued, "I hope the Novelty will as much please, as in the Doctrine of this Artificiall Body it useth to offend" (Lev, Rev. and Conclusion, 491). Representationalism (aka intentionalism) has been the most significant weapon in the late twentieth century defence of direct realism. However, although the representationalist objection to the Phenomenal Principle might provide an effective response to the arguments from illusion and hallucination, plausible representationalist theories of perception are, when fleshed-out, incompatible with metaphysical direct realism’s directness-claim. Indeed within cognitive science, direct perception is the avowedly-radical anti-representationalist heterodoxy. Drawing on both the philosophy and cognitive science, we develop a robust argument against representationalist direct realism (...) which does not rest on illusory cases or the notion of an object of immediate awareness. None of the representations so far posited, or in prospect, can supply the content required of a representation in a direct realist theory of veridical perception. (shrink)

V rámci filosofie věd panuje široká shoda na tom, že druhá polovina 20. století složila „labutí píseň" pozitivismu. Milton Friedman a Paul Samuelson, dva klíčoví autoři k metodologii ekonomie v daném časovém období, přitom tento vývoj ve filosofii vědy prý nikdy nereflektovali. Pozitivistická východiska - v prvé řadě v podobě redukcioni- stického přístupu - jsou tudíž stále přítomna ve vlivných teoretických konceptech rozvinutých ekonomy hlavního proudu. Značný počet autorů však v současnosti sdílí náhled, že tyto koncepty v nezanedbatelné míře přispěly (...) k vývoji, jenž ústil ve finanční krizi, vrcholící v letech 2008 a 2009. Předkládaný článek se proto táže, zda to byla právě krize - v níž mnozí spatřují empirické zamítnutí řady pozitivistických konceptů - která napsala „labutí píseň" pozitivismu v ekonomii hlavního proudu. Why, at a certain point in history, did the regulation of human relations acquire jurisdictional status? Why did class rule take the form of an official state power? What, in the complexity of social relationships, did the formal application of norms correspond to? But above all, why did the law, here meant as a system of legal norms, turn out particularly suited to social and economic capitalist developments? From an explicitly Marxist point of view, the author explores Evgenij Bronislavovic Pashukanis's (...) "Theory of Law and Marxism" (1924), which is the first theoretical and organic attempt to define the structural goal of the law, not in terms of pure form, but in those of a system with systematic organization of production, thus revealing that the development of bourgeois law was not at all accidental but indeed essential to the functioning and existence of the capitalist production relationships. Towards this precise direction, “law, as a constituent element of production relations, is no longer defined by the traditional scheme of a mere ideological superstructure, but it is itself the very structure, already inherent in capitalist socialization, which is entirely immanent to society”. This captures the innovative specificity of Pashukanis's heterodoxy, certainly the greatest Marxist jurist of all time. (shrink)

His legacy includes a valuable poetic work. These pages are interested in the theological spirit of one of his most critically admired English sonnets, Night and Death. However, in order to know that own faithful way in which (...) the author expresses in his poem the human questioning for hope in the face of the experience of darkness and death, it is necessary to first penetrate, even if only in a synthetic way, in his understanding and experiencing of the relationship between religion and church, instinct of reason and truth of faith. This leads us to better meet with the background that encourages the poetic expression of his sensitivity towards the beauty of the world and the way in which man can discover in it the call of divine transcendence.
