One of the most common ancient moral teachings of considering oneself as equal with others is called the Golden Rule, which has long been the focus of different schools in time and world. This rule, as an important moral value and norm, by "adopting another perspective" (perspective_taking) causes the mutual understanding of individuals and is the cornerstone of other moral standards. . The implementation of this rule requires accurate knowledge of the needs, good and evil of others with (...) one's own conscience. In fact, to implement this rule, one must imagine oneself in another position, which causes a kind of epistemological-motivational empathy. The golden rule means "treat others as you would like to be treated" and the golden rule "do not like what others do not like for themselves" is explicitly or with different interpretations in Nahj al-Balaghah. This research uses a descriptive and analytical method and through the collection of library information to try to explain the different interpretations of the golden and silver rules in Nahj al-Balagheh. According to the results of this study, fairness, justice, compassion, identification of self-interests with others, forgiveness, meeting with different sections of society and self-discipline are among the conceptual forms of the golden rule in the words of Amir. A large part of Richard Rorty’s works focus on criticizing the received view about philosophy. He argues, in his historical reconstruction of philosophical activity, that there has always been a misconception about philosophy in the history of philosophy. This misconception assumes that philosophy aims to grasp the ultimate knowledge, so it desperately engages in an attempt to achieve “truth”. In this view, which he calls representationalism and points to it by the metaphor of the mirror of nature, knowledge aims to (...) represent something out of mind, and the duty of philosophy is to put forward a theory about the representation. According to Rorty, based on this popular view philosophy is a foundational discipline that aims to evaluate epistemological claims of other disciplines. Rorty attempts to criticize and reject this Cartesian epistemological agenda for philosophy. Rorty’s approach to philosophy is therapeutic; that is, he tries to resolve philosophical problems rather than solve them. By adopting a historical method, Rorty seeks to show that “philosophy as epistemology” is a result of the dominance of what he calls the metaphor of the mirror of nature. From a critical rationalist perspective, the present article intends to critique Rorty’s views on epistemology. In this paper, Rorty’s historiographical approach is criticized in several ways. First, Rorty offers a one-sided and biased reconstruction of the history of philosophy to fit the abovementioned metaphor. Secondly, he treats history as rigid data from which it is possible to draw doctrinal conclusions. Whereas, as critical rationalists have said time and again, history by itself has no meaning. Moreover, Rorty’s justificationism is criticized. Rorty maintains that knowledge needs to be justified, and since it cannot be justified through representation, it must be justified by the consent of society. In other words, agreement in a group of people can provide an epistemic authority. Thus, both Rorty’s view and foundationalism, despite their differences, share justificationism in epistemology. That is, they both believe that knowledge needs to be justified. On the other hand, as critical rationalists have shown, justification in any shape and form, whether internal or external, is neither possible nor necessary. We also attempt to illustrate how Rorty’s epistemological approach results in confusion between epistemology and psychology; moreover, his epistemological behaviorism still suffers from some sort of justifications. In conclusion, Rorty expresses his criticism of epistemology with the metaphor of the mirror of nature. According to him, foundationalism is the result of the conflation of the Platonic conception of knowledge as something unchangeable, with the Cartesian mind that seeks certainty. However, his ignorance of the main crux of the matter in epistemology causes his own suggestion of epistemological behaviorism to suffer from the same problem, that is justificationism, which now appears in another form, i.e., social consensus. While, as critical rationalists repeated time and again, justification is neither possible nor necessary and not even desirable. They have shown that a non-justificationist approach to knowledge aimed at truth as a regulative idea could be a better approach. (shrink)

I argue that Sarah Sawyer's and Herman Cappelen's recent accounts of how speakers talk and think about the same concept or topic even when their understandings of that concept or topic substantially diverge risk multiplying our metasemantic categories unnecessarily and fail to prove explanatory. When we look more closely at our actual practices of samesaying, we find that speakers with seemingly incompatible formulations of a subject matter take one another to samesay when they are attempting to arrive at a correct (...) understanding of that subject matter. These speakers adopt what I call a prospective externalist perspective on the subject matter in question. I then argue that there are contexts where judgments of samesaying are more routinely defeated because speakers are taking up a perspective I call retrospective internalism. From this perspective, speakers are aiming to render maximally intelligible the linguistic behavior of other speakers that appear to them to deviate from their own. Whether or not we count speakers as samesaying with us will therefore depend on the kind of the perspective we adopt. Different perspectives, it will turn out, often yield different verdicts. On my perspective-based approach, there is no need to hypostatize or inflate our metasemantic taxonomies. (shrink)

This essay will explore the reasons behind the creation of the 401(k), its risks, and the implications it has for workers’ financial security in retirement. -/- The Creation of the 401(k) -/- The 401(k) system emerged during a period when traditional pension plans, known as defined benefit plans, were on the decline. In a defined benefit plan, an employer guarantees employees a certain monthly benefit upon retirement, based on their salary and years of service. These plans were a significant financial burden for companies because they required them to make large, long-term financial commitments. As a result, many companies sought alternatives that would shift the responsibility for retirement savings to the employee. -/- The 401(k) plan Is a type of defined contribution plan, where the employee contributes a portion of their pre-tax income to a retirement account, and often, employers match a portion of the contributions. The savings grow tax-deferred until retirement when they are taxed upon withdrawal. This system reduced employers’ financial liabilities and gave them more flexibility in managing their financial resources. -/- From a policy perspective, the creation of the 401(k) system was also aligned with the growing belief in individual responsibility. One of the main criticisms of the 401(k) system is its reliance on the performance of the financial markets. Since the value of a 401(k) account is directly tied to the performance of the investments chosen by the employee, there is inherent risk in market volatility. During times of economic downturn or market crashes, workers’ retirement savings can significantly decrease in value, leaving them with less money in retirement than they had anticipated. -/- Another major risk associated with the 401(k) is that it places the responsibility for retirement savings squarely on the shoulders of individuals, many of whom may not have the financial literacy or expertise to manage their investments effectively. When a person commits a testimonial injustice, the unjust thing they do consists in their reaction to an assertion (theorists diverge on the details; paradigmatically the relevant unjust thing consists in prejudicially refraining from believing the assertion). Whatever reactions to questions are analogous to these reactions to assertions, those things are "interrogative injustices". I explore some models of those things and apply them to some non-ideal cases. One of the models appeals to mental states like curiosity and wonder, telling us (...) that interrogative injustice occurs when hearers prejudicially refrain from adopting those mental states. Other models appeal to common conversational goals – these goals including the answering of questions. On these models, interrogative injustice occurs when a person asks a question, and another person prejudicially blocks the answering of that question from joining the common goals. Or, if they don’t block said answering, perhaps they believe that it should be thus blocked. Or perhaps they merely resist the question, not fully blocking its answering from joining the common goals but instead pushing back against it in some other way. Or perhaps they merely believe that they should resist the question. I endorse a pluralism on which each of these things can be an interrogative injustice. (shrink)

Narrated in the first person, Peter Carey’s novel about the life of Australian bushranger Ned Kelly incorporates other aspects of speech derived both from Carey’s personal experience and from the editorial process. Kelly's voice is toned down to some extent by virtue of the latter, introducing expressions Kelly himself would not have used. Identifying these elements, along with the specific attributes of Kelly’s own speech, enjoins a diversity of cultural and social groupings that intersect and, in some instances, compete with (...) or contradict one another. Shifts in speakers might be signalled by textual markers or by adopting different expressive qualities and speech patterns, which may or may not include a change in grammatical person. In this novel, at one instance, a shift in person is apparent, but I want to argue, not necessarily a shift in the identity of the speaker because, although the grammatical voice shifts, its qualitative features are largely unaltered. The shift nonetheless introduces a significant change. Paradoxically, as far as literary theory is concerned, the subjective qualities produced through voice mean that stylisations of speech may be indicative of character point of view, rather than what is understood to be narrative voice, because they might function in narrative as inflections of speech that do not correspond to the established voice of the grammatically instanced speaker—offering a focalised perspective instead. The shift in True History presents problems in these terms, however: the point of view instanced here is clearly that belonging to the speaker, though the voice is Kelly’s, for the narrator’s point of view determines the generality of the descriptive terms where once these were specific and personal. Had the novel been narrated wholly in third person, an unproblematic reading of Kelly’s point of view, suggested by the use of his voice, would be possible. But the shift undermines this—Kelly’s point of view gives way to another, instanced in the shift that takes place in narrative voice. Carey, in other words, inverts the convention. This is not an instance of free indirect style or discourse, where grammatical mood is at odds with the speaker’s position and tenses align with the implicated subject position of another. The same features of voice that might identify character point of view must, in absence of any disparity of mood or tone, function in respect to narrative voice to convey something of its speaker’s subjectivity, and this seems apparent here: the speaker shares Kelly’s subjective emotional and intellectual perspective, but no longer occupies the subject position. Carey’s voicing of the bushranger therefore complicates distinctions between voice and point of view by revealing qualitative features of voice to be important to the question of who is speaking the narrative. Fisher criticised the Neyman-Pearson approach to hypothesis testing by arguing that it relies on the assumption of “repeated sampling from the same population.” The present article considers the responses to this criticism provided by Pearson and Neyman. Pearson interpreted alpha levels in relation to imaginary replications of the original test. This interpretation is appropriate when test users are sure that their replications will be equivalent to one another. However, by definition, scientific researchers do not possess sufficient knowledge about the relevant (...) and irrelevant aspects of their tests and populations to be sure that their replications will be equivalent to one another. Pearson also interpreted the alpha level as a personal rule that guides researchers’ behavior during hypothesis testing. However, this interpretation fails to acknowledge that the same researcher may use different alpha levels in different testing situations. Addressing this problem, Neyman proposed that the average alpha level adopted by a particular researcher can be viewed as an indicator of that researcher’s typical Type I error rate. Researchers’ average alpha levels may be informative from a metascientific perspective. However, they are not useful from a scientific perspective. Scientists are more concerned with the error rates of specific tests of specific hypotheses, rather than the error rates of their colleagues. It is concluded that neither Neyman nor Pearson adequately rebutted Fisher’s “repeated sampling” criticism. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

The basis of a humane approach to others is the authentic comprehension of another subject. As humans, we can achieve this understanding well, and the reason lies in how we experience the world around us and other subjects in it. The development of robots capable of socially interacting and helping humans is progressing, even though they are still far from reaching an autonomous comprehension of others’ intentions, emotions, and feelings. In this sense, the hu- mane approach may be addressed in (...) robotics through the concept of experience. In a reciprocal exchange of perspectives, the core elements and the structure of human experience are investigated in this chapter together with how the idea of experience has been implemented in robots. The embodied Self and the relationship with other subjects form the pivot of any human experience and are suggested to be the basis for the emergence of a novel cognitive-experiential structure in robots. Conversely, the possibility to develop a robot with a primitive sense of Self raises questions about the nature of human experience and the impact such technologies have on it. (shrink)

Nietzsche’s name has become almost synonymous with militant atheism. Born into a pious Christian family, this son of a Lutheran pastor declared himself the Antichrist. But could this have been yet another of his masks of hardness? Nietzsche rarely revealed his innermost self in the published writings, and this can be gleaned mainly from his private letters and the accounts of friends. These sources bring to light the philosopher’s inner struggle with his own, deeply religious nature.Losing his father at a (...) young age was a calamity from which Nietzsche never recovered, and I argue that his famous thought-image “God is dead” was a transfiguration of the painful memory of this loss. In this essay, I trace Nietzsche’s tortuous path from an ardent devotee of God to a vociferous critic of Christianity, a path that was punctuated with veiled longings for a loving deity. Deep in his heart, he remained faithful to Christian ideals. Rather like Cordelia, the only truly loving daughter of King Lear, Nietzsche refused to utter words of intense affection and reverence, as these had been blatantly devalued and corrupted. Instead, he adopted a mask of a wrongdoer and a blasphemer who took not the punishment but the guilt.Nietzsche’s attitude to religion is discussed from the perspective of his life, his personality, and his mental condition. The discussion draws on psychoanalytical concepts of Freud, Erikson, Winnicott and Kohut. This is not an exclusive reading, but complementary to other studies in this field. (shrink)

The cosmic perspective (or view sub specie aeternitatis) is associated with concerns about the meaning of life, our significance in the universe, and the universe’s indifference. I suggest that there is another important and common, albeit tacit, concern related to the cosmic view. Adopting the cosmic view can justifiably bring about a sense of disconnection from one’s life. Moreover, many of the explicit concerns we have regarding the cosmic view are issues that have a rational bearing upon this (...) sense of disconnection. As I argue, issues concerning our normative reasons (viewed from the cosmic perspective), our cosmic significance, and the universe’s vastness and indifference all warrant a sense of disconnectedness from our lives. At least, such disconnection is warranted for the duration of our attentive engagement with the cosmic view. But in small enough doses, this can be a good thing. The cosmic view and the sense of disconnection it brings about can foster experiences of awe. Awe, in turn, can promote a greater feeling of connection to the world around us and make us, as Bertrand Russell (1935/1973) would put it, less ‘trivial’ and ‘arrogant.’. (shrink)

Empathy is essential in story comprehension as it requires understanding of the emotions and intentions of the characters. We evaluated the sensitivity of an emotional perspective-taking task using Aesop’s Fables in relation to empathy. Participants (N = 301) were presented with 15 short fables and were asked to rate the intensity of the emotions they would feel (anger, sadness, disgust, fear, surprise, joy, trust, and anticipation) by adopting the perspective of one of the characters (offender, victim) or (...) the observer’s perspective. A data-driven approach revealed that participants’ responses were aligned with the characters’ intentions, suggesting successful emotional perspective-taking. Participants sympathized with the victim rather than the offender, demonstrating affective sharing processes. Further, participants with higher empathy scores exhibited stronger negative emotions from the victim’s perspective, independently of their level of distress. Our task was not influenced by gender effects. We suggest that the Aesop’s Fables task could provide an indirect instrument to study empathy. (shrink)

The research aims to identify the trends of Palestinian higher educational institutions in Gaza Strip as learning organizations from the perspective of senior management in the Palestinian universities in Gaza Strip. The researchers used descriptive analytical approach and used the questionnaire as a tool for information gathering. The questionnaires were distributed to senior management in the Palestinian universities. The study population reached (344) employees in senior management is dispersed over (3) Palestinian universities. A stratified random sample of (182) employees (...) from the Palestinian universities was selected and the recovery rate was (69.2%). Statistical analysis (SPSS) program was used for analysis and processing the data. The study found the following results: There is an agreement about: the importance of the focus of "organizational structure" with an average approval, the importance of "technological infrastructure" axis with high approval, and the importance of "strategic" with an average approval. The results concluded that the study sample agree on the importance of "organizational dimension" highly. The results showed that the sample believe that the "strategic leadership" level in the universities got medium-approval. There is a fair level agreement about the axis of interest "teams / committees". There is an agreement about the importance of the "human dimension" moderately. The results showed that the sample is highly agreed about the importance of focus of the "knowledge management", and the focus of the "continuing education". They agreed weakly to somewhat about the importance of the focus of "scientific research", moderately agree about the importance of the center of "institutional culture", agree moderately on the importance of "cognitive dimension". The results showed that the sample largely agree on the importance of the focus of "strategic partnerships and alliances". They agree highly on the axis "keep up with the labor market" and on the focus of the importance of "technology incubators". The results showed that the sample moderately agree about the importance of the theme on "consulting and training", the importance of the focus of "social responsibility", and the focus of the "Community dimension". The study found a group of recommendations including: there is a need to provide suitable environment that achieve learning organizations. There is a need to develop the technological infrastructure (hardware, software, networks, databases, and human skills) because of the great advantages that they offer. The universities need to adopt knowledge management in the academic and administrative departments because knowledge is the core of the work of these departments. The establishment of technology incubators in universities to adopt outstanding university research projects, to protect, to supports, and to market them; furthermore, to develop the capabilities and skills of employees in the field of information technology. In this Master's dissertation, I try to show that the causal theory of memory, which is the only theory developed so far that at first view seems more plausible and that could be integrated with psychological explanations and investigations of memory, shows some conceptual and ontological problems that go beyond the internal inconsistencies that each version can present. On one hand, the memory phenomenon analyzed is very limited: in general it is reduced to the conscious act of remembering expressed in (...) a propositional format: the idea of an agent who can control his memory reports, in contrast to a passive subject who merely retrieve his encoded memories, is not even considered. Furthermore, the representational function of memory is the only function taken into account; and all the diachronic changes that could entail a dynamic conception of memory are ignored, as is the consideration of context in a broad sense of the term. On the other hand, causal theories make some implicit assumptions that are obviously questionable (e.g., the difference between facts and events) and leave some of their key concepts unexplained, like the nature of the causality, the isomorphism between the memory trace and the memory event, etc. Nonetheless, the principal point that we criticized is the idea of a correspondence between a past event or representation of it, the correspondent memory trace and the memory representation of it. Psychological models of memory, with the exception of the spatial analogy, question some of these assumptions and suggest that memory information is organized in a way other than that implied by the causal theory. But it is distributed connectionism that actually challenges the causal theory of memory, not only through some of its basic postulates, like the superpositional conception of memory traces, their mutual influence and constant state of change, but also because it is compatible with a more situated approach to memory phenomena as well as with the idea that memory in reality accomplishes a variety of functions that go beyond the representational one. The explicit and implicit ideas provided by distributed connectionism, together with the previous criticisms that we made to of causal theory, clearly suggest the possibility of developing another kind of philosophical theory of memory, different from existing theories. This task, nonetheless, implies: (a) A much deeper study of connectionism principles and memory models, as well as of the rival candidate, symbolism, plus the evaluation of these models in the light of psychological and neurophysiological empirical research, which unfortunately I have not dealt with in this work. (b) An analysis of the metaphysical nature of events and facts, in order to see if we should decide in favor of a realist or a non-realist account. It is also clear that this decision can’t be taken without an examination of perception studies (and not exclusively philosophical ones) which would be crucial for determining what is encoded in memory, and studies devoted to language, which, I suspect, plays an important role in the segmentation of reality. (c) A clarification of the notion of causality, because we wouldn’t like to deny any kind entail the complete disappearance of boundaries between memory and imagination. And even if I suspect that my future work will question the existence of absolute boundaries between these two capacities, the notion of causality can’t be completely erase from the theory of memory without erasing the memory phenomenon itself. But this causality, as we’ve already showed, can’t consist in the naïve conception adopted by the causal accounts of memory, nor can it be explained in counterfactual terms. If we think of the reconsolidation concept, of the interdependence between all the memory system, and of the deciding influence of context, it’s almost sure that more than one notion of causality will need to be invoked in order to explain memory. (d) Because I do not want to reduce the study of memory exclusively to cases of remembering, it’s essential to analyze how memory intervenes not only in imagination, but also in perception, reasoning and future projection, for example. In this respect, we could quote the interesting articles of Atance & O’Neill (2001) and Bucker & Carroll (2006), the first concerning the relationship between episodic memory and episodic future thinking, the second concerning the relationship between episodic memory and all kinds of self-projection, such as navigation and theory of mind, relations that would also have to be explored from a philosophical perspective, in particular to overcome the tendency to suppose that representation is the only function of memory. I will also mention the necessity of combining the notion of metamemory with that of memory to some extent; as I have already remarked, it is implausible to suppose that a subject who consciously remembers something is unable to exert any kind of control over his memory reports. (e) Finally, in order to integrate a situated conception of memory into a philosophical account, it will also be indispensable to take into consideration what is known as “everyday memory research” as well as studies in social and collective memory. Ethical considerations, including data privacy, (...) algorithmic bias, and the potential displacement of human jobs, are critically discussed to provide a balanced perspective on the adoption of AI technologies in the HR domain. The study aimed to identify the reality of the use of social networks in the technical colleges in Palestine, where the variables of social networks were included. The analytical descriptive method was used in the study. A questionnaire consisting of (12) items was randomly distributed to college workers Technology in the Gaza Strip. The sample of the study consisted of (205) employees of these colleges. The response rate was 74.5%. The results showed a high degree of approval for the dimensions (...) of the social networks and a relative weight (74.15%) according to the perspective of the employees of the technical colleges in the Gaza Strip. The results of the study showed that there is a high level of social networking areas (site management and Website Content) in the technical colleges in the Gaza Strip. The field of site management ranked first with a relative weight of 74.91%, and second and last (Content Site) with a relative weight (73.38%). The results showed that there were differences between colleges in the use of social networks where the results showed that the most common colleges used these networks (UCAS) and the least used is (GTC). The results showed no differences between male and female employees in the use of social networks in technical colleges. The researchers suggest a number of recommendations, including: the need to raise awareness of the importance of Facebook and other social networking sites, through the holding of courses for employees in technical colleges, and to identify the ways to optimize the use of such sites, and the benefits of this use, and reflected positively on technical colleges. And the adoption of dealing with the various social networking sites as a reality, and the Palestinian and Arab technical colleges, use them in accordance with the objectives of technical colleges. The research has three objectives: 1) to study the concept of Heisenberg’s uncertainty principle, 2) to study the concept of reality and knowledge in Buddhist philosophy, and 3) to analyze the concept of Heisenberg’s uncertainty principle in Buddhist philosophical perspective. This is documentary research. In this research, it was found that Heisenberg's uncertainty principle refers to the experiment of thought while studying physical reality on smaller particles than atoms where at the present no theory of Physics can clearly explain (...) such properties. In this respect, the mentioned principle is utilized to predict the pairs of a certain attribute of physics, position, and momentum, for instance. The accuracy of position, however, cannot be precisely yielded in advance by such a principle. In other words, it is impossible to measure the position and momentum of a quantum particle at the same time. In the study of the ultimate reality on the matter in the Buddhist philosophy, it showed that corporeality in nature is conditioned by cause and effect and thereby falling under the three common characteristics: 1) impermanence, 2) state of suffering, and 3) state of non-substantiality. In the study of Heisenberg’s uncertainty principle in the Buddhist philosophical perspective, this research was found that the processes in acquiring certain knowledge of Heisenberg and Buddhist philosophy are by one another in the sense that such knowledge is methodologically acquired through experience, rationality, and intuition because both see the Reality in the same manners, that is, the physical reality is viewed by Heisenberg as the thing that goes under changing state of wave-particle all the times, and the matter is seen by Buddhist philosophy as the impermanence and change depending upon its factors involved and thereby is not-self. However, in the different aspect, on the one hand, Buddhist philosophy utilizes the knowledge on the matter to develop the morality and ethics by which the cessation of suffering could be respectively made, but on the other hand, Heisenberg somehow applies the certain knowledge on physical objects into quantum technology to accommodate the physical comfortability in living life. Suggestions in the application of knowledge gained from this research into benefit were that while Buddhist philosophy can make use of Heisenberg’s uncertainty principle to provide certain help at the time of explanation of three common characteristics being done through the scientific method, science also can utilize knowledge gained from Buddhist philosophy to expand the framework of scientific knowledge which is aimed at studying only the physical objects to be able to study the mental objects through the integration of three epistemological methods as well. Conscientious Sociology is an introductory but essential step towards the recognition of paradigmatic contestations and shifts in the post-1970s Social Sciences. It develops an ideal typology of three major paradigms, i.e. the Foundationalist, the Relativist and the Critical-Conscientious Paradigms by discussing and comparing their principles in four Meta-Theoretical domains: Ontology, Epistemology, Methodology, and Axiology. Hosseini, in his book, shows how the Conscientious paradigm deals with well known dilemmas which are not effectively resolved by two other paradigms; dilemmas like how to (...) create an objective account of reality whereas the subjectivities of actors and investigators are accommodated or what relationship must be set up between quantitative and qualitative methods. The book also further discusses the principles that Conscientious sociologist are expected to consider when engaging in empirical research. It finally, provides its readers with a unique perspective adopted from a radical Iranian social thinker, Ali Shariati whose ideas are portrayed as an insightful exemplar for Iranian critical sociologists. This article examines the possibility of determining the ontological status of the embryo and the moral foundation of the framework on which this status is based. Discussions on the ontological status of the embryo are analyzed within the frameworks of substance and continuity theories. Substance theory posits that the embryo possesses an immutable essence in ontological terms. This theory, being metaphysical in nature, aligns with theistic perspectives, which hold that God grants humans a soul from His own spirit. Consequently, humans (...) are perceived as possessing an unchanging essence or nature. This perspective entails a metaphysical view consistent with substance ontology. Furthermore, in theistic thought, humans are regarded as beings deserving of dignity because they are created by God. Examples supporting this view are presented from Christian and Islamic thought, expressed as the concept of imago Dei and the notion of humanity being elevated above all other creations, respectively. The concept of human dignity found in theistic thought provides a metaphysical foundation supporting substance theory and endows humans with moral status. This notion leads to the conclusion that the thesis of human dignity, which attributes an ontological status to the embryo (viewing it as a potential human), also confers moral status upon the embryo. The idea that humans are ontologically dignified beings implies that every stage of human development, from the earliest biological moment of the embryonic phase to infancy and beyond, holds value in relation to the previous stage, further supporting this concept. The dignity thesis appears closely tied to the species, nature, and potentiality of the embryo. Initially, the relationship between dignity and the speciesist approach is emphasized. However, anti-speciesist perspectives argue for the equality of humans with other living beings, advancing secular critiques of the concept of human dignity. In response, this study seeks to establish a consistent position on the concept of dignity by addressing the points of contention between theistic and secular interpretations. The substance ontology adopted for the discussion of the embryo’s personal identity is further supported by the metaphysical thesis of essentialism. Essentialism asserts that every species has its own immutable essence. It is argued that the essential qualities of natural species emerge at specific stages of embryonic development. In contrast, advocates of continuity theory reject the idea that the embryo possesses an unchanging essence or that there exists a definitive threshold distinguishing one stage of human development from another. They claim that the moral status of the embryo can only be established on a conventional basis, which provides a precarious foundation rather than a robust one for its protection. Therefore, this study argues that providing an ontological foundation of a substantial nature for the embryo is more coherent. In addition, the article addresses criticisms of substance ontology and the thesis of human dignity, offering reasoned responses. While explaining the ontological status of the embryo within the framework of substance theory, it is demonstrated that this theory aligns with concepts such as human dignity, speciesism, and essentialism. The argument from potentiality concerning the embryo's ontology is highlighted as particularly significant. This argument resonates with the theistic notion that the soul or essence given to humans by God bestows dignity by virtue of its potential state. Through these approaches, the article concludes that the ontological status of the embryo determines its moral status. Analytical methods from the field of bioethics are employed to examine metaphysical issues. The significance of this study lies in addressing discussions about the ontological status of the embryo, a topic extensively explored in Western literature from a secular perspective but less frequently analyzed on a metaphysical basis. The purpose of this research is to identify the extent of the efficiency of the internal control environment in the Palestinian higher educational institutions in Gaza Strip from the perspective of employees in the Palestinian universities in Gaza Strip, where researchers used in the study five universities. The researchers adopted in their study the descriptive and analytical approach. The research community consists of administrative employees and academic employees with administrative duties. Senior management or the University Council was excluded. The (...) study population compromises of (392) employees. A stratified random sample was chosen and (197) questionnaires were distributed. (160) questionnaires were received back with a return rate of (81.2%).The researchers used a questionnaire to collect that which then was analyzed using (SPSS) to get the results. The research found the following results: the absence of a fundamental difference between the responses of males and females. The lack of significant difference between the responses of the respondents attributed to the variable age. The lack of significant difference between the responses of the respondents attributed to the variable of years of service. And the existence of a fundamental difference between the responses of the respondents attributed to the university variable. The existence of a fundamental difference between the responses of the respondents attributed to the Qualification variable. The existence of a fundamental difference between the responses of the respondents attributed to the administrative level variable. The research found a group of recommendations including: the need to raise awareness of censorship as the basis for the protection of employees in all administrative levels from making mistake.Updating the systems and instructions of control periodically and parallel with the scientific progress and technology.Benefit from regional and international experiences in the application of internal control standards which commensurate with the administrative system of the institution. We often effortlessly take the perceptual perspective of others: we represent some aspect of the environment that others currently perceive. However, taking someone's perspective can interfere with one's perceptual processing: another person's gaze can spontaneously affect our ability to detect stimuli in a scene. But it is still unclear whether our cognitive evaluation of those judgements is also affected. In this study, we investigated whether social perspective-taking can influence participants' metacognitive judgements about their perceptual responses. Participants performed (...) a contrast detection task with a task-irrelevant avatar oriented either congruently or incongruently to the stimulus location. By “blindfolding” the avatar, we tested the influence of social perspective-taking versus domain-general directional orienting. Participants had higher accuracy and perceptual sensitivity with a congruent avatar regardless of the blindfold, suggesting a directional cueing effect. However, their metacognitive efficiency was modulated only by the congruency of a seeing avatar. These results suggest that perceptual metacognitive ability can be socially enhanced by sharing perception of the same objects with others. (shrink)

According to the Principle of Charity, we ought to interpret each other charitably. That is, we ought to adopt the interpretation that shows the interpreted person in the best light. The Principle of Charity is motivated by appealing to a harm asymmetry: it is worse (the thought goes) to mistakenly criticize someone than to fail to rightfully criticize them. This chapter argues that in oppressive contexts, charity is not enough. First, the Principle of Charity is myopic. Charitable interpretation only considers (...) harm to the person being interpreted and ignores third party harms. Second, under conditions of oppression, our conceptual resources and evidential standards will be systematically biased against marginalized perspectives. So charitable interpretations will overlook harm to marginalized persons. Finally, the chapter give a diagnosis of the Principle of Charity: It misunderstands the interpersonal interpretive aim. The interpersonal interpretive aim is to interpret one another in a way that accurately captures the normative features that are crucial to our interpersonal relationships. What we need is not a Principle of Charity, but an Aim of Justice. The chapter’s conclusion explains what an Aim of Justice would require of us, notably, empathetic engagement and intellectual humility. (shrink)

Natural scientists working at the intersection of virtual reality, psychology, and computer science have recently explored the question of whether Embodied Virtual Reality (EVR) can be employed to train empathy. While for some authors (e.g., Bertrand et el. 2018), EVR can enhance empathy by means of creating a series of perceptual illusions, which lead users to adopt the other’s perspective and resonate with her experience, other authors (e.g., Sora-Domenjó 2022; Sutherland 2016) have been more skeptical about the powers of (...) EVR to increase empathy in its users. This chapter aims at contributing to this recent debate by exploring how perspective-taking contributes to empathy in EVR. After an analysis of perspective-taking in non-virtual and virtual environments, the chapter introduces the distinction between sensual and emotional empathy found in classical and contemporary phenomenology (Stein 1989 ; Sveaneus 2018). While in sensual empathy, the user empathizes with the other’s lived body, in emotional empathy, she apprehends the other’s emotional states and their related values. It is argued that while the perceptual illusions elicited by EVR can lead the user to the impression of a body swap and, in so doing, foster sensual empathy, for the apprehension of the other’s emotions, which is crucial to emotional empathy, EVR must be supplemented with a series of narrative devices which that make the other’s emotions and values accessible to her. In the 1920s, David Hilbert proposed a research program with the aim of providing mathematics with a secure foundation. This was to be accomplished by first formalizing logic and mathematics in their entirety, and then showing---using only so-called finitistic principles---that these formalizations are free of contradictions. ;In the area of logic, the Hilbert school accomplished major advances both in introducing new systems of logic, and in developing central metalogical notions, such as completeness and decidability. The analysis of unpublished material presented (...) in Chapter 2 shows that a completeness proof for propositional logic was found by Hilbert and his assistant Paul Bernays already in 1917--18, and that Bernays's contribution was much greater than is commonly acknowledged. Aside from logic, the main technical contribution of Hilbert's Program are the development of formal mathematical theories and proof-theoretical investigations thereof, in particular, consistency proofs. In this respect Wilhelm Ackermann's 1924 dissertation is a milestone both in the development of the Program and in proof theory in general. Ackermann gives a consistency proof for a second-order version of primitive recursive arithmetic which, surprisingly, explicitly uses a finitistic version of transfinite induction up to www . He also gave a faulty consistency proof for a system of second-order arithmetic based on Hilbert's &egr;-substitution method. Detailed analyses of both proofs in Chapter 3 shed light on the development of finitism and proof theory in the 1920s as practiced in Hilbert's school. ;In a series of papers, Charles Parsons has attempted to map out a notion of mathematical intuition which he also brings to bear on Hilbert's finitism. According to him, mathematical intuition fails to be able to underwrite the kind of intuitive knowledge Hilbert thought was attainable by the finitist. It is argued in Chapter 4 that the extent of finitistic knowledge which intuition can provide is broader than Parsons supposes. According to another influential analysis of finitism due to W. W. Tait, finitist reasoning coincides with primitive recursive reasoning. The acceptance of non-primitive recursive methods in Ackermann's dissertation presented in Chapter 3, together with additional textual evidence presented in Chapter 4, shows that this identification is untenable as far as Hilbert's conception of finitism is concerned. Tait's conception, however, differs from Hilbert's in important respects, yet it is also open to criticisms leading to the conclusion that finitism encompasses more than just primitive recursive reasoning. Adoption may be defined as ‘the legal process through which the state establishes a parental relationship, with all its attendant rights and duties, between a child and a (set of) parent(s) where there exists no previous procreative relationship’ . In adoptions from care, state intervention effectively converts an established, or nascent, adult– child relationship into ‘family’ in the legal sense. From the state’s perspective, adoption thus entails the transfer of parental responsibilities for a child in public care to a (...) private family unit, enabling the state to permanently delegate its duties towards a child to this new unit. This seemingly straightforward legal act raises deeper philosophical questions relating to such state ‘family creation’, particularly when the child’s perspective is taken. Such a child- centric approach normatively regards children as equal moral beings, who ought to be included in actions concerning them, regardless of their capacity to form and express an opinion. Accordingly, adoption from care can be described as a moral decision, aimed at doing what is in the child’s best interests. The purpose of this chapter is to explore a suspicion of a lack of child- centrism in adoption from care practice, and to illustrate how adopted children’s rights are inferior to those of their non- adopted peers. This will shed light on a practice currently lacking transparency and accountability and will increase our understanding of how we fail to treat children as equal moral individuals in decision- making that severely impacts children’s lives. This change can either be seen as a moment of discontinuity with his metaphysics of maturity or as a moment of continuity, such as a passage to the metaphysics from his last years. Between the end of his sejour at Paris and the first part of the Hanover period, Leibniz reformed his dynamics and began to use the theory of corporeal substance. (...) This book explores a very important part of the philosophical work of the young Leibniz. Expertise from around the globe is collated here, including Daniel Garber’s work based on the recent publication of Leibniz's correspondence from the late 1690s, examining how the theory of monads developed during these crucial years. Richard Arthur argues that the introduction of substantial forms, reinterpreted as enduring primitive forces of action in each corporeal substance, allows Leibniz to found the reality of the phenomena of motion in force and thus avoid reducing motion to a mere appearance. Amongst other themes covered in this book, Pauline Phemister’s paper investigates Leibniz’s views on animals and plants, highlighting changes, modifications and elaborations over time of Leibniz’s views and supporting arguments and paying particular attention to his claim that the future is already contained in the seeds of living things. The editor, Adrian Nita, contributes a paper on the continuity or discontinuity of Leibniz’s work on the question of the unity and identity of substance from the perspective of the relation with soul and mind. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

Peer disagreement presents religious believers, agnostics, and skeptics alike with an epistemological problem: how can confidence in any religious claims (including their negations) be epistemically justified? There seem to be rational, well-informed adherents among a variety of mutually incompatible religious and non-religious perspectives, and so the problem of disagreement arises acutely in the religious domain. In this paper, we show that the transformative nature of religious experience and identity poses more than just this traditional, epistemic problem of conflicting religious beliefs. (...) In encountering one another, believers, agnostics, and skeptics confront not just different beliefs, but different ways of being a person. -/- To transition between religious belief and skepticism is not just to adopt a different set of beliefs, but to transform into a different version of oneself. We argue that the transformative nature of religious identity intensifies the problem of pluralism by adding a new dimension to religious disagreement, for there are principled reasons to think we can lack epistemic and affective access to our potential religious, agnostic, or skeptical selves. Yet, access to these selves seems to be required for the purposes of decision-making that is to be both rational and authentic. Finally, we reflect on the relationship between the transformative problem of religious disagreement and what it shows about the epistemic status of religious conversion and de-conversion, in which one disagrees with one’s own (transformed) self. In the Third Antinomy of the Critique of Pure Reason (1781) [Kritik der reinen Vernunft], Immanuel Kant (1724-1804) associates freedom with infinity. According to the definition given in this book, only an infinite being not subject to causality can be defined as free. However, the fact that a finite being, such as a human, is always subject to the laws of nature implies that they are perpetually bound by causality, which hinders their freedom. Freedom devoid of causality cannot be theoretically (...) justified. Another reason for this is Kant’s assertion in the Second Analogy of Critique of Pure Reason, where he states that everything in the phenomenal world is subject to causality. Accordingly, freedom can be conceived not in the phenomenal world but only in the noumenal world. In the First Critique, freedom, defined as a cause without a cause, a cause without being the result of another cause, later be characterized as negative freedom in the third section of the Groundwork of the Metaphysics of Morals (1785) [Grundlegung zur Metaphysik der Sitten]. Such conceptualization of freedom cannot be determined by any other cause than itself. While there may be a theoretical foundation for accepting such a cause as uncaused, we have moral reasons to believe in it. This moral foundation in question guides us toward the notion of positive freedom. Here, unlike negative freedom, we are subject to moral laws, and as long as we comply with these, we can experience freedom as a finite being. This is because adhering to the laws we set for ourselves enables us to be morally the cause of our own actions. Thus, Kant renders freedom through positive freedom. Following this line of argument, negative freedom appears meaningful to us only within the framework of positive freedom. Jean-Luc Nancy (1940-2021) finds a problematic Kantian account of freedom as an uncaused cause in his book The Experience of Freedom (1988) [L’expérience de la liberté]. Because, according to this perspective, humans are not only subject to the laws of nature but also to moral cause-and-effect relationships with others, they exist at the ix limit of freedom. By this means, considering freedom as a duty imposed on the subject leads to ambiguous analyses such as negative/positive freedom in Kantian philosophyーIn post-Kantian philosophy, the ambiguity persists until Friedrich Wilhelm Joseph Schelling (1775-1854)1 , who finds the solution by negating freedom. Therefore, according to Nancy, freedom should be considered not as a Kantian Idea but through its relationship with human finitude and experience. Thus, through the criticism directed at Kant in Martin Heidegger’s (1889-1976) Kant and the Problem of Metaphysics (1929) [Kant und das Problem der Metaphysik], Nancy attempts to resolve the confusion created by the concept of freedom, which despite being associated with infinity in Kant, is made possible in the practical world through respect for the moral law. In this direction, Nancy finds the solution in the freedom that becomes conceptually elusive, transforming it into an act that goes beyond being a mere duty and which permeates all our experiences. In this book, Nancy introduces the initial stages of “community” and “singularity” concepts, which he would later develop further. For this, he begins the book's introductory section by emphasizing Martin Heidegger’s statement in §9 of Being and Time (1927) [Sein und Zeit], where “freedom” is mentioned as another name for existence. As a justification, he refers to the concept of Da-sein [being-there] and states that every being [être] is a being-in-common [être-en-commun], and freedom should be thought of through this. Namely, the problem of freedom is approached not as a political or ethical issue but as an ontological matter. Within the framework of beingin-common, this situation transforms into an ontological “generosity [générosité ontologique].” -/- 1 Philosophical Investigations into the Essence of Human Freedom [Philosophische Untersuchungen über das Wesen der menschlichen Freiheit und die damit zusammenhängenden Gegenstände], Schelling, approaches freedom not through infinity but rather through finitude. While Heidegger and Nancy pursue different paths, they both adhere to the idea of finitude freedom in Schelling. x Despite primarily emphasizing Heidegger’s thought in writing this text as his aggrégation thesis, Jean-Luc Nancy desires to transcend it and maintain a certain distance. This transcendence and distancing include authors from the French Phenomenological tradition, such as Georges Bataille (1897-1962), Maurice Blanchot (1907-2003), and Jean-François Lyotard (1924-1998), and also incorporate the emphasis from Hannah Arendt (1906-1975) that death cannot be thought of independently of life. Referencing many philosophers from the continental philosophy tradition and developing a thematic reading through freedom, this bookーlike Nancy’s other worksーseeks ways to experience philosophy and thought freely in this own writing experience. So much so that this book, unlike Nancy’s other works like The Inoperative Community (1986) [La communauté désoeuvrée] ve Being Singular Plural (1996) [Être Singulier Pluriel], which is not widely discussed in secondary sources, is challenging to follow. Therefore, in examining this book as my Master’s research thesis and addressing the idea of freedom in Nancy, I found it appropriate to adopt a close reading method. Certainly, this research should not be considered independent of works such as The Discourse of Syncope (1976) [Le discours de la syncope], The Categorical Imperative (1983) [L’impératif catégorique], as they serve as examples of while engaging in philosophy, how Nancy refers and relates to the works within the philosophical tradition. We’ll approach the notion of object in Wittgenstein’s Tractatus LogicoPhilosophicus (1921), initially from the so-called “substance argument”. The discourse about necessary conditions for the propositional sense cannot be treated in terms of truth or falsity in the Tractatus without resulting in a infinite regress. Such a situation is avoided by postulating a substance made up of simple objects, thus ensuring the assumed total determination of sense. Passages from the Notebooks (1914-1916) suggest that the idea of simples is given in the (...) ideia of logical analysis and is reached without the necessity of examples for objects. Another early Wittgenstein’s remarks provide examples for objects based on itens of phenomenical nature, such as a point in the visual field. An important analogy for the phenomenical approach for the object, which is found in the aphorisms 2.013-2.0131 of Tractatus, presents a problem for the absolute simplicity. This problem concerns the notion of form, a concept that attributes an ontological dependence to the object given by its essencial capacity of occurrence in atomic facts. The form of the objects results from an appropriation of the Context Principle used by Frege in his Grundlagen der Arithmetik (1884) and differs from the notions of pictorial form and logical form. The dependence assigned to the object through its form contradicts the independent subsistence established by its simplicity. The Tractarian object results from necessary demands for determination of propositional sense, reached by means of an clarificatory analysis which prioritizes the transformative and regressive modes of analysis. Simplicity and Context Principle are, under this perspective, rules of a syntax for a logical or significative use of language, which are reflected in the Tractarian ontology through the ideia that the logico-philosophical investigation of language reveals essencial aspects of the intimate structure of the world. What does it mean for an actor to empathize with the character she is playing? We review different theories of empathy and of acting. We then consider the notion of “twofoldness”, which has been used to characterize the observer or audience perspective on the relation between actor and character. This same kind of twofoldness or double attunement applies from the perspective of the actor herself who must, at certain points of preparation, distinguish between the character portrayed and her (...) own portrayal effected in her craft. We argue that this concept helps us to understand how the actor can empathize with her character. For the actor who must study and rehearse her character, empathy may begin with higher-order processes that provide a contextualized understanding of the character. This understanding eventually integrates with more basic empathic processes in her actual performance. (shrink)

Purpose – With the growing demand for ethical standards in the prevailing business environment, ethical leadership has been under increasingly more focus. Based on the social exchange theory and social learning theory, this study scrutinized the impact of ethical leadership on the presentation of ethical conduct by employees through the ethical climate. Notably, this study scrutinized the moderating function of the person organization fit (P-O fit) in relation to ethical climate and the ethical conduct of employees. -/- Design/methodology/approach – To (...) evaluate the research hypotheses, two-wave data were collected from 295 individuals who are currently employed in various Iraqi organizations (i.e. manufacturing, medical, and insurance industries). -/- Findings – In line with the hypotheses, the outcomes from a sample of 295 workers working in different Iraqi entities exhibited a positive relationship between the ethical behavior of leaders and the ethical conduct of employees in the ethical climate. Moreover, it was observed that the P-O fit of employees moderated the relationship between ethical climate and the ethical conduct of employees such that the relationship was more robust for those with a high P-O fit in comparison to those with a low P-O fit. -/- Research limitations/implications – The primary limitation of this study is in the data, which was obtained from a single source. Although the study conducted two surveys and utilized a mediation and moderation variables model that was less likely to be influenced by common method bias (CMB) (Podsakoff et al., 2012), one cannot completely rule out CMB. Apart from the potential effects of the CMB, the consistency of the empirical findings could have also been compromised since self-reported data were utilized in measuring ethical behavior, which can be a very complex and sensitive issue. For this reason, the social desirability response bias cannot be ruled out completely. When possible, future studies must gather data from multiple sources. Furthermore, supervisors must evaluate the ethical behavior of employees. Another limitation was that the findings of this study were based on a sample in a Middle Eastern cultural context such as in Iraq. Perhaps, the particular cultural features of this context, which encompassed, among other things, strong adherence to religious values (Moaddel, 2010), could have influenced the findings of this study. It is true that the effects of differences (P–O fit) are highly likely to replicate across cultural contexts (Triandis et al., 1988). However, it can be seen that further studies are needed to evaluate the context-sensitivity of these findings (Whetten, 2009) by analyzing other cultures, where the importance of religiosity is on the decline (i.e. in Western countries, Ribberink et al., 2018) or where the cultural features are very much different from those that apply to Iraq. Lastly, other external factors were not taken into account by this study as it tried to explain ethical behavior. Ethics is a highly complex subject and is influenced by numerous variables at the organizational, individual, and external environment levels. Thus, caution must be observed when making inferences from the present study which, to a certain degree, offered a simplified version of ethical behavior by concentrating on a few variables such as the Arab culture’s traditional ideology, which dominates even science (Abu Khalil, 1992). In addition, there are political conflicts in the Middle Eastern cultural context such as what is happening in Iraq (Harff, 2018). Thus, it is important to include such aspects in future researches. -/- Practical implications – In terms of management, the findings send a clear signal to those in the upper echelon that, without ignoring the issue of ethics in organizations, employees are a critical aspect to be taken into account to encourage ethical behavior at the workplace. This study has important practical implications. First, this study determined that ethical leadership (here, of the supervisors) positively influences the behavior of subordinates (refers to the supervisors here); this, in turn, further improves the ethical behavior of employees. It is vital that managers or supervisors are motivated to practice ethical leadership because they directly influence the employees. It has been suggested that top managers, especially chief executive officers, have the ability to shape the ethical climate, which also influences the ethical behavior of employees further. This study offered several feasible ways that managers can apply to achieve that. In particular, top managers may utilize the ethical climate as a way of communicating the ethical values that they have to their subordinates, thereby serving as a motivation for the subordinates to adopt ethical behavior. It was also suggested by this study that ethical climate and the P–O fit may, to some degree, substitute each other as they influence the ethical behavior of employees. Therefore, firms that were identified to have a low level of ethical standards, practices, and policies, at least from the employees’ perspective, are better poised to conduct ethical issues in order to construct the ethical behavior of their subordinates. More importantly, it is highly essential that the value congruence between an organization and its followers be considered. -/- Social implications – This study highlighted the notion of ethics and how it’s essential for society. Ethics refers to the norms, standards, and values that direct the behavior of an individual. Ethical behavior is vital in society because we need to be treated with respect as human beings. -/- Originality/value – This study responds to recent calls for more research to identify factors that may strengthen or mitigate the influence of ethical behavior in the workplace such as ethical leadership, ethical climate, and Person–Organization. The State of Nirvana Explained Through the Universal Formula -/- Nirvana, a concept often associated with Buddhism, represents a state of ultimate peace, liberation, and detachment from suffering. Traditionally, it is understood as the cessation of desires and the end of the cycle of birth and rebirth. However, using my universal formula, Nirvana can be understood more precisely as a state of perfect balance, where the system of human consciousness operates free from defects and external disturbances. This article explores the potential of Bernard Lonergan’s philosophy of subjectivity as objectivity as a grounding for value sensitive design (VSD) and the design turn in applied ethics. The rapid pace of scientific and technological advancement has created a gap between technical abilities and our moral assessments of those abilities, calling for a reflection on the philosophical tools we have for applying ethics. In particular, applied ethics often presents interconnected problems that require a more general framework for ethical reflection. Lonergan’s (...) philosophy, which emphasizes the importance of selfunderstanding and self‐transcendence in achieving objectivity, can provide a valuable perspective on VSD and the design turn in applied ethics. The article examines how Lonergan’s philosophy can be applied to VSD and the design turn, and how scientific knowledge can be integrated into an ethics of science without reducing it to an external reflection. By adopting Lonergan’s perspective, we can address the ethical challenges arising from scientific and technological advancements while promoting a more holistic approach to applied ethics. (shrink)

Benjamin’s essay Toward the Critique of Violence has often irritated readers. This is even more true of his concept of divine violence, which is defined as “law-annihilating” and goes against legally sanctioned state sovereignty. In this paper, I present a new reading of both Benjamin’s essay and divine violence. Against an apocalyptic tendency of Benjamin, I argue that divine violence can only be an instrument of justice if it is understood as violence suffered rather than perpetrated. This is especially the (...) case where people suffer persecution – imprisonment, torture, death – as a result of nonviolent resistance to an oppressive political regime. Only where such resistant suffering occurs, can violence properly be called divine. Only then does it offer a perspective beyond the never-ending atrocities of human history. (shrink)

This article addresses the question of the coherence of enactivism as a research perspective by making a case study of enactivism in mathematics education research. Main theoretical directions in mathematics education are reviewed and the history of adoption of concepts from enactivism is described. It is concluded that enactivism offers a ‘grand theory’ that can be brought to bear on most of the phenomena of interest in mathematics education research, and so it provides a sufficient theoretical framework. It has (...) particular strength in describing interactions between cognitive systems, including human beings, human conversations and larger human social systems. Some apparent incoherencies of enactivism in mathematics education and in other fields come from the adoption of parts of enactivism that are then grafted onto incompatible theories. However, another significant source of incoherence is the inadequacy of Maturana’s definition of a social system and the lack of a generally agreed upon alternative. (shrink)

What is freedom? The contemporary history of humanity is a quest for enduring human freedom over oppression, subjugation and tyranny of many forms. In that pursuit, many wars have been fought, and millions of lives have perished, and many ideologies were born. In simple terms, freedom to the ability to act or change without being constrained. Freedom manifests when obstacles to initiate change or to express free will are removed. From a needs perspective, freedom is when an individual can (...) pursue his or her needs, wants and aspirations freely. However, freedom may not be absolute; some constraints or caveats can manifest from personal ethics and morality, family, cultural, faith systems and governance structures. It may also differ from one society to another. From a religious or philosophical perspective, freedom is often associated with liberty and autonomy, and only exist in a human realm. This type of freedom is also known as political freedom expressed in the forms of human rights and civil liberties, which are often legislated and protected by laws. Nonetheless, the limits and depths of political freedoms such as freedom of choice, assembly, association, and freedom of expression are often debated and sometimes challenged through modern history. My research is a result of accumulated provocation of obsolete and paralyzing education that has been frozen since the middle ages. We have to admit that before the pandemic, education was already in crisis. Governments have been ignoring to adopt any comprehensive plan to reform the educational systems till it has been unprecedently disrupted by COVID-19. I try through this paper to make a global call for governments to immediately start cooperating together for setting international qualifications framework that best suit (...) future competencies. This call should be prioritized on the world agenda. It would be more plausible for governments, UNESCO and other education stakeholders to seize the opportunity of the 2020 disruption of life cycle for the maximum benefit of humanity. For this to happen we need exceptional leaders with extraordinary vision to transform education instead of ensuring children can keep learning and that every single child returns to school after the pandemic. Another challenge to be expected is the reduction in education budgets being under pressure as governments shift spending towards the health and economic response to the pandemic. The impact of schools closing on a generation of children will be immense on the long term. We must act now to save the education and life chances of generations of youth. At this time of unprecedented crisis, the world must come together to protect education and put it at the very heart of the global recovery effort. Recovery, not as before but as convenient and sustainable with the perspective requirements. It is time to expose youth to real life experiences; we need our children to learn about finance from characters like Jef Bezos or Bill Gates or Mukesh Ambani; to learn about psychology from John Anderson, Eliot Aronson and Ahmed Ukasha; to know approaches of math and physics as Elon Musk and Steve Wozniak. We shouldn't settle for less when it comes to building minds and souls of our children. With all due respect to teachers and university professors, they are not the only best option for qualifying and training our youth for tomorrow's challenges. However, those entrepreneurs are not teachers or willing to be, education specialists and strategists are required to set the vision and the procedures required to pave the way for highly practical competencies framework. The idea behind this special theme journal issue was to continue the work we have started with the INBIOSA initiative (www.inbiosa.eu) and our small inter-disciplinary scientific community. The result of this EU funded project was a white paper (Simeonov et al., 2012a) defining a new direction for future research in theoretical biology we called Integral Biomathics and a volume (Simeonov et al., 2012b) with contributions from two workshops and our first international conference in this field in 2011. The initial impulse (...) for this effort was given a year earlier by a publication of one of the guest editors of this issue (Simeonov, 2010) in this journal. This time we wish to provide a broader forum and more space to elaborate in detail some of the most interesting concepts we have encountered in our discussions, as well as to invite some new contributions of particular interest in the field. Another goal we had in mind was to collect and review as many provocative perspectives as possible on the same key topic we are interested before making a decision to follow a more focused notion that would lead to a funded research program. Therefore we welcomed the generous suggestion of Professor Denis Noble, FRS, who is also editor of this journal to prepare a special theme issue entitled: “Can biology create a profoundly new mathematics and computation?” It has taken a while to invite and collect the contributions. Most of them had a couple of revision cycles and adjustments after having been thoroughly discussed with colleagues, incl. the editors of this issue. We think that the result we have obtained at the end is a satisfactory one, since we succeeded to integrate a diversity of original, but sometimes controversial and mutually excluding concepts organized within chapters of a self-contained volume. The task of compiling all this was not easy at all. Despite our efforts to position the articles of different authors and themes in a way allowing their easy comprehension and relation to each other within the individual chapters, some of them still require a sort of introduction to dissolve possible ambiguities. This is what we are going to do in the following few paragraphs with the hope that the reader (and some of the authors) would excuse our failures. (shrink)

Defenders of two Rationality Views of love—the Qualities View and the Personhood View—have drawn on Iris Murdoch's philosophical writings to highlight a connection between love and a “realistic” perspective on the beloved. Murdoch does not inform the basic structure of these views—she is rather introduced as a supplement who shows that in love, we pay accurate, nuanced, unguarded, and unflinching attention to the other. In this paper, I contend that these authors have failed to see that Murdoch offers a (...) distinct view of love and is inappropriate to enlist as an ally. This is in large part because they have missed the full sense of what Murdoch means by connecting love and realism. I contend that for Murdoch, to love someone means seeing them in light of a realistic vision of what it means to be human; this includes an appreciation of the limits of freedom, the formative influence of personal history, and the nature and extent of our differences from one another. This helps us to see why Murdoch variously describes loving attention as realistic, compassionate, tolerant, and extremely difficult. It also sheds light on some important and familiar ways that we criticize one another's grounds for love. (shrink)
