Moral realists often disagree about the nature of moral properties. These properties can be natural (as per naturalistic moral realism) or non-natural. But it is unclear how we should understand the notion of naturalness employed in these discussions. In this paper I propose a novel account of moral naturalness. I suggest that a property F is natural iff F falls within the scope of a natural law. In turn, a law is natural when it figures in a nomic nexus involving (...) the laws of physics. (shrink)

In this essay, I propose a functionalist theory of grounding (functionalist-grounding). Specifically, I argue that grounding is a second-order phenomenon that is realized by relations that play the noncausal explanatoriness role. I also show that functionalist-grounding can deal with a powerful challenge. Appeals to explanatory unificationism have been made to argue that the success of noncausal explanations does not depend on the existence of grounding relations. Against this, I argue that a systematization involving functionalist-grounding is superior to its anti-relational counterpart.

In this paper I develop a genealogical approach for investigating and evaluating conspiracy theories. I argue that conspiracy theories with an epistemically problematic genealogy are (in virtue of that fact) epistemically undermined. I propose that a plausible type of candidate for such conspiracy theories involves what I call ‘second-order conspiracies’ (i.e. conspiracies that aim to create conspiracy theories). Then, I identify two examples involving such conspiracies: the antivaccination industry and the industry behind climate change denialism. After fleshing out the mechanisms (...) by which these industries systematically create and disseminate specific types of conspiracy theories, I examine the implications of my proposal concerning the particularism/generalism debate and I consider the possibility of what I call local generalism. Finally, I tackle three objections. It could be objected that a problematic genealogy for T merely creates what Dentith (2022) calls ‘type-1’ (or ‘weak’) suspicion for T. I also consider a challenge according to which the genealogical method is meta-undermined, as well as an objection from epistemic laundering. (shrink)

In this paper, I show how realist moral naturalists can provide an intra-theoretic explanation of the epistemic possibility of wholesale moral error. This is a requirement on metaethical theories that has been recently defended by Akhlaghi (2021). After clarifying Akhlaghi’s argument and responding to Evers’s (2021) recent rebuttal, I argue that even under the assumption that moral facts are grounded in an appropriate subset of natural facts (N-facts), there is still a non-zero probability of wholesale moral error. This is demonstrated (...) by considering three types of epistemically possible scenarios: specifically, it could either be that N-facts do not actually exist, or that N-facts exist in a way that entails wholesale moral error, or that N-facts exist in a non-error theoretic way, but their existence is temporally restricted. Separatists about grounding take explanations to be separate from their corresponding grounding-facts. Grounding-facts are supposed to underlie, or back, such explanations. However, the backing relation hasn’t received much attention in the literature. The aim of this paper is to provide an informative definition of backing. First, I examine two prominent proposals: backing as explaining (Kovacs 2017; 2019a) and backing as grounding (see Sjölin Wirling 2020). Finally, I put forward my own proposal. I argue that under plausible assumptions about the role (...) of backing and the nature of explanation, backing should be understood as a form of truthmaking, minimally construed. (shrink)

ABSTRACT If acting morally can be viewed as acting consistently with a moral principle or rule, then being a person with moral integrity can be viewed as consistently applying moral principles or rules across different types of situations. We advance a view of moral integrity that incorporates three distinct, but interrelated, types of moral consistency: cognitive, emotional and motivational moral consistency. Our approach is based on Self-Determination Theory, a motivational theory that can explain when a moral rule becomes the primary (...) motive for behavior. We argue that moral integrity is achieved when a person acts on the basis of an internal moral system of principles, emotions and motives and provide an account of the way that it develops during a person’s interaction with the environment. Self-determination theory, like other psychological theories that study eudaimomia, focuses on general processes of growth and self-realization. An aspect that tends to be sidelined in the relevant literature is virtue. We propose that special focus needs to be placed on moral virtue and its development. We review different types of moral motivation and argue that morally virtuous behavior is regulated through integrated regulation. We describe the process of moral integration and how it relates to the development of moral virtue. We (...) then discuss what morally virtuous individuals are like, what shape their internal moral system is expected to take and introduce moral self-concordance. We consider why morally virtuous individuals are expected to experience eudaimonic well-being. Finally, we address the current gap in self-determination theory research on eudaimonia. (shrink)

Kantian ethics is based on a metaphysical conception of autonomy that may seem difficult to reconcile with the empirically-based science of psychology. I argue that, although not formally developed, a Self-Determination Theory (SDT) perspective of ethics can broaden the field of Kantian-based moral psychology and specify what it means, motivationally, to have autonomy in the application of a moral norm. More specifically, I argue that this is possible when a moral norm is fully endorsed by the self through a process (...) of internalization that is energized by intrinsic motivation and is facilitated by the fulfillment of the basic needs for autonomy, competence and relatedness. The conditions of the fulfillment of these needs may even implicitly reveal which norms will be integrated and treated as moral norms. I conclude that SDT offers a motivational approach that is useful in understanding the development of moral norms. (shrink)

Negotiation research primarily focuses on negotiators? interests in order to understand negotiation and offer advice about the prospective outcome. Win-win outcomes, i.e., outcomes that serve the interests of all negotiating parties, have been established and promoted as the ultimate goal for any negotiation situation. We offer a perspective that draws on Aristotle's philosophical program and discuss how the outcome is not defined by the parties? interests, but by the intersubjective validity of claims, which can essentially be treated as representative of (...) the ?truth.? Essentialism is often criticized for producing biased behavior. Because it is a view through which people attempt to grasp the essence of things, it appears contradictory that essentialism might result in distortions of reality. Somewhere within essentialist cognitive processes there must be mistakes or omissions that fail to capture reality correctly. In this paper, I treat essentialization as an abductive reasoning process, as a hypothesis, that explains particular characteristics of people on the basis of category membership alone. Besides essentialization, essentialist (...) reasoning can also include deductive and inductive processes that aim at elaborating and testing initial hypotheses. Therefore, essentialist beliefs can be built by essentialization and hypotheses alone or they can be the product of more elaborate reasoning. The relationship of essentialization and general essentialist reasoning to truth and knowledge is discussed. (shrink)

Negotiation is mainly treated as a process through which counterparts try to satisfy their conflicting interests. This traditional, subjective approach focuses on the interests-based relation between subjects and the resources which are on the bargaining table; negotiation is viewed as a series of joint decisions regarding the relation of each subject to the negotiated resources. In this paper, we will attempt to outline an intersubjective perspective that focuses on the communication-based relation among subjects, a relation that is founded upon communicative (...) rationality mechanisms which are inherent in social activity. Much in contrast to the concept of interests which describe the relationship of each subject alone to the resources, we will use the concept of ?claim-rights? which are properly formed and validated only vis-à-vis negotiating partners and on the basis of the communication that develops among them. We will offer a step-by-step account of the creation of claim-rights and argue that their validation does not necessarily lie in the parties? interests, but in the communication mechanisms that induce consensus and result in mutually acceptable outcomes. Self-authorship has been established as the basis of an influential liberal principle of legislation and public policy. Being the author of one’s own life is a significant component of one’s own well-being, and therefore is better understood from the viewpoint of the person whose life it is. However, most philosophical accounts, including Raz’s conception of self-authorship, rely on general and abstract principles rather than specific, individual psychological properties of the person whose life it is. We elaborate on the principles of (...) self-authorship on the basis of self-determination theory, an empirically based psychological theory that has been at the forefront of the study of autonomy and self-authorship for more than 45 years. Our account transcends distinctions between positive and negative freedom and attempts to pinpoint the exact properties of self-authorship within the psychological processes of intrinsic motivation and internalization. If a primary objective of public policy is to support self-authorship, then it should be devised on the basis of how intrinsic motivation and internalization can be properly supported. Self-determination theory identifies three basic psychological needs: autonomy, competence, and relatedness. The satisfaction of these needs is associated with the support and growth of intrinsic tendencies and the advancement of well-being. Through this analysis, we can properly evaluate the significance of rationality, basic goods, and the availability of options to self-authorship. Implications for law and policy are discussed with an emphasis on legal paternalism and what many theorists call “liberal perfectionism,” that is, the non-coercive support and promotion of the good life. Negotiation is often treated as an attempt to reconcile conflicting interests. Instead, I define negotiation as an attempt to produce a convergence of will. Based on a distinction initially made by Rawls (1955), I draw attention away from summary rules that are introduced during negotiation, including win-win interest prescriptions, and put the emphasis on the practice rules that are validated by the final agreement. The term convergence of will refers to the co-adoption of practice rules that define the interaction that (...) is the subject of negotiation. It essentially refers to the negotiating parties establishing the normative or “ought” standards of the interaction they are negotiating about. Moving from the subjective view of Kant to the intersubjective view of Habermas, I offer an approach that examines how agreement validates the “ought” requirements of that interaction, going beyond underlying interests. The article examines the conjunction of writing and the Hegelian theory of recognition as it appears in Jean-Paul Sartre's text "Why Write?" The author argues that Sartre's theory of literature is not only a theory of literature as conversation and communication, but also a theory about the relation to a certain silence, and since literature and recognition go together in Sartre's text, the presence of silence has consequences for his theory of recognition.

Menschen verfügen über ein komplexes Vermögen der Selbstlokalisierung in Raum und Zeit. Seine eigene Position festzustellen kann in verschiedenen Kontexten Verschiedenes bedeuten. Nicht jedes unsere raumzeitliche Lokalisierung und Orientierung betreffende Problem ist philosophischer Natur. Fragen wie »Wo ist Norden?«, »Wie weit ist es nach Hause?« oder »In welcher Richtung liegt das Ziel?« sind lebensweltliche und gegebenenfalls navigatorische Fragen. Die kognitiven Mechanismen und Fähigkeiten zu untersuchen, die unseren Lokalisierungs- und Orientierungsleistungen zugrunde liegen, ist eine Aufgabe für die Kognitionswissenschaften. Die Untersuchung der (...) Grundlagen unserer Orientierungsfähigkeit wirft aber auch begriffliche Fragen auf, und diese zu klären ist eine philosophische Aufgabe. Wichtige Beiträge dazu haben Kant, Husserl, Strawson, Tugendhat und Gareth Evans geleistet. Truls Wyller steht in dieser Reihe und hat wie kein anderer den transzendentalphilosophischen Gehalt von Lokalisierungs- und Orientierungsfragen herausgearbeitet. Gegen naturalistische Verkürzungen hat er mit großer Beharrlichkeit dafür argumentiert, dass das Vermögen, seine eigene Position in Raum und Zeit zu bestimmen, Implika-tionen hat, die die Bedingung der Möglichkeit von Erfahrung betreffen. Die folgende Skizze ist ungleich bescheidener angelegt. Ich werde wenig mehr tun, als wesentliche Einsichten der Literatur zur raumzeitlichen Selbstlokalisierung zusammenzutragen, wobei ich einige Akzente anders setze als Wyller. Insbesondere werde ich versuchen, so weit wie möglich ohne Transzendentalen Idealismus auskommen. This study aims to examine the Islamic Theological School that was opened in Nicosia back in 1932 to meet the chaplain needs of the Cypriot Muslims. In this context, how the Islamic Theological School was welcomed among the groupings of the period, its physical structure, teaching staff, and students were all addressed within the framework of the education program and the closure process. The "Foundation Files" in the National Archives and Research Department in the TRNC and the newspaper collections of (...) the period and the "British Colonial Documents" in the Archives of the General Directorate of the Foundations of Cyprus are the main sources of our research. Documentation method, which is one of the qualitative research methods, was used in the study. In this context, the documents that could be accessed in the researches related to the subject of the study are examined and described for the objectives of the study. In conjunction with the madrasas in Cyprus becoming dysfunctional until the end of the 1920s, the wrecked Great Madrasah building in Nicosia, which had the purpose of training personnel such as imams, preachers, chaplains and muezzins for the mosques, was demolished and a school called Islamic Theological School was built instead. The opening of the Islamic Theological School led to important debates between the two opposition groups of the time, the Halkçılar and the Evkafçılar. Halkçılar are the group of people who advocate the adoption of the revolutions and reforms of the newly established Turkish Republic also by Turkish Cypriots. For this reason, they strongly criticized the opening of the Islamic Theological School on the grounds that it would cause reactionism and bigotry. On the other hand, the concept of Evkafçılar is used for people who represent tradition and are close to the current British rulers. Evkafçılar advocated the opening of the Islamic Theological School by stating that it was a social need. Accordingly, both groups used the press effectively as a means of conveying their own thoughts. The halkçı group used the newspapers called "Söz" and "Masum Millet" and the evkafçılar group used the newspaper called "Hakikat" as a means to convey their views to the society. In the shadow of the discussions between the two groups, the Islamic Theological School, which was built in 1932 in place of the wrecked Great Madrasah building in the northeast of Selimiye (Hagia Sofia) Mosque in Nicosia, was built as a single-floor building and a gable roof system was used on its roof. Funds were appropriated by Education (Hatib Ahmed Efendi) Foundation for supplying the school's materials such as tables, chairs, cabinets, sofas, and armchairs. In 1932, when the Islamic Theological School began educating, there were only three professors and one teacher in its teaching staff. Hürremzâde Hakkı Efendi, one of the professors, was both the school director and the Fatwa Emin. One of the other professors was an imam and the other one was a fatwa clerk. And Muallim Ahmed Fehim Efendi undertook the duty of imamate. According to the documents examined, the aforementioned faculty members have taught religious and human sciences-oriented courses in the school. As far as we can identify from the documents open to research in the archives, in the years between 1932 and 1950, when the Islamic Theological School was open, a total of 11 students were educated in this school. In the first year of this school, which started education with three students only, students were given a monthly scholarship of 15 shillings. In addition, the students were both able to practice as assistants to muezzins in the mosques during the month of Ramadan and they were also provided with economic support. After graduation, the students were nominated as imams, muezzins and devirhan. The Islamic Theological School was closed in 1950 because there was no student demand. Despite the fact that 11 people received education in 18 years between the school's opening year 1932 and 1950, and the annual reports published by General Directorate of Foundations stated that the Islamic Theological School continued its services satisfactorily under the upervision of its Fatwa Emin, these statements were unrequited in reality. The Islamic Theological School started to serve in the shadow of the debates between the opposition groups of its time. The parties of the discussions are divided into two groups: Halkçılar and Evkafçılar. The first group opposed the opening of the school by claiming that the financial resources of the General Directorate of Foundations would be spent unnecessarily and that the students to be educated would be raised with reactionism and bigoted ideas. The second group, Evkafçılar, approached the issue with a need-centred approach and defended the necessity of a school to educate religious officials. The mentality of the populist group reflects the ideology of the young Turkish Republic and this is clearly seen in their defence mechanisms. Evkafçılar, on the other hand, did not pay the required attention to the Theological School despite their discourses of necessity. As a result, the power struggle of these two groups aiming to hold the leadership of the Turkish Cypriots caused the Theological School to be adversely affected. Very low salaries of religious officials working in existing mosques and low fees being paid to the graduates of the Theological School who were employed in mosques were other factors that reduced the demand for Theological School. As a result, those who saw low-paid religious officials who had difficulty even getting along did not seek education to become religious officials and their families never pointed such way to them. The fact that a very limited number of students attended Theological School did not lead General Directorate of Foundations to alternative solutions. As the Islamic Theological School was not well organized, the issue of religious officials was felt more and more by the muslim people in the following years in Cyprus where many villages do not even have religious officials. Despite the diversity of perceptions of what postmodernity is, there is a point of convergence between a significant part of the scholars of the theme, which is characterizing this period as a period of bankruptcy and disbelief in totalizing ideas. Through the eyes of Emil Cioran, we see the great ideologies and metanarratives as desired eschatologies, defined by the author as utopias, in which, not only is a possibility of a rationalized end composed, but also an adequate form of end. In this work, we intend to extract concepts for what modernity and post-modernity become, to present characteristics of the conception of this and how these same characteristics are present in the writings of Emil Cioran, specifically in his essays “Genealogy of fanaticism” and “Mechanism of utopia”. Are acids natural kinds? Or are they merely relevant kinds? Although acidity has been one of the oldest and most important concepts in chemistry, surprisingly little ink has been spilled on the natural kind question. I approach the question from the perspective of microstructural essentialism. After explaining why both Brønsted acids and Lewis acids are considered functional kinds, I address the challenges of multiple realization and multiple determination. Contra Manafu and Hendry, I argue that the stereotypical properties of acids are (...) not multiply realized. Instead, given the equivalence between the proton-donating and electron-accepting mechanisms of Brønsted and Lewis, respectively, I show that acidity as a property type can be identified with a unique microstructural property, namely the presence of a LUMO or other low energy empty orbital. In doing so, I defend the view that the Lewis theory encompasses Brønsted--Lowry, and that all Brønsted acids are also Lewis acids. Contra Hacking and Chang, I thus maintain that the different concepts of acidity do not crosscut, and that the hierarchy requirement is met. Finally, by characterizing natural kinds as powerful objects and by adopting a dispositional view of functions, I illustrate how the microessentialist can make sense of the latent and relational character of most acids. In sum, I contend that acids are genuine natural kinds, even for the microstructural essentialist. (shrink)

Hohwy et al.’s (2008) model of binocular rivalry (BR) is taken as a classic illustration of predictive coding’s explanatory power. I revisit the account and show that it cannot explain the role of reward in BR. I then consider a more recent version of Bayesian model averaging, which recasts the role of reward in (BR) in terms of optimism bias. If we accept this account, however, then we must reconsider our conception of perception. On this latter view, I argue, organisms (...) engage in what amounts to policy-driven, motivated perception. For a period of several years the philosopher of science Hasok Chang has promoted various inter-related views including pluralism, pragmatism, and an associated view of natural kinds. He has also argued for what he calls the persistence of everyday terms in the scientific view. Chang claims that terms like phlogiston were never truly abandoned but became transformed into different concepts that remain useful. On the other hand, Chang argues that some scientific terms such as acidity have suffered a form of (...) “rupture”, especially in the case of the modern Lewis definition of acids. Chang also complains that the degree of acidity of a Lewis acid cannot be measured using a pH meter and seems to regard this as a serious problem. The present paper examines some of these views, especially what Chang claims to be a rupture in the definition of acidity. It is suggested that there has been no such rupture but a genuine generalization, on moving from the Brønsted-Lowry theory to the Lewis theory of acidity. It will be shown how the quantification and measurement of Lewis acidity can easily be realized through the use of equilibrium theory and the use of stability constants. (shrink)

One of the open problems in the philosophy of information is whether there is an information logic (IL), different from epistemic (EL) and doxastic logic (DL), which formalises the relation “a is informed that p” (Iap) satisfactorily. In this paper, the problem is solved by arguing that the axiom schemata of the normal modal logic (NML) KTB (also known as B or Br or Brouwer’s system) are well suited to formalise the relation of “being informed”. After having shown that IL (...) can be constructed as an informational reading of KTB, four consequences of a KTB-based IL are explored: information overload; the veridicality thesis (Iap → p); the relation between IL and EL; and the Kp → Bp principle or entailment property, according to which knowledge implies belief. The relationship between topological explanation and mechanistic explanation is unclear. Most philosophers agree that at least some topological explanations are mechanistic explanations. The crucial question is how to make sense of this claim. Zednik (Philos Psychol 32(1):23–51, 2019) argues that topological explanations are mechanistic if they (i) describe mechanism sketches that (ii) pick out organizational properties of mechanisms. While we agree with Zednik’s conclusion, we critically discuss Zednik’s account and show that it fails as a general account of how and (...) when topological explanations are mechanistic. First, if topological explanations were just mechanism sketches, this implies that they could be enriched by replacing topological terms with mechanistic detail. This, however, conflicts how topological explanations are used in scientific practice. Second, Zednik’s account fails to show how topological properties can be organizational properties of mechanisms that have a place in mechanistic explanation. The core issue is that Zednik’s account ignores that topological properties often are _global_ properties while mechanistic explanantia refer to _local_ properties. We demonstrate how these problems can be solved by a recent account of mechanistic completeness (Craver and Kaplan in Br J Philos Sci 71(1):287–319, 2020; Kohár and Krickel in Calzavarini and Viola (eds) Neural mechanisms—new challenges in the philosophy of neuroscience, Springer, New York, 2021) and use a multilayer network model of Alzheimer’s Disease to illustrate this. Examining the status of cacao production, challenges, and prospects of cacao farmersin Zamboanga del Norte province were done in this study. The investigation revealed that cacaofarming was practiced by males (244 or 65.10%) and female cacao farmers (34%) who areprimarily married with secondary educational backgrounds. Most cacao farmers were theirproductive age ranging from 50-59 years old (42.93%), 40-49 years old (34.4%). However,fewer young people engaged in cacao farming aged below 40 years old (7.46%). The primaryoccupation of the respondents was farming (...) (86.13%), tilling their owned land (84.53%), andwith an average annual income below 60,000 pesos (50.40%). The average farm size was at 1-3hectares (80.00%), having a plain (40.27%) to rolling topography (47.47%) planted with UF 18(50.13%) and BR 25 (49.87%) varieties of cacao. Intercropping was observed (99.20%) withcoconut (79.20%) and banana (14.67%) planted along with cacao. Pest infestation of stem borer(59.73%) and bugs (22.67%) were observed at a low level (79.20%) and controlled usingLamdacyhalothrin (86.40%) as a chemical spray. Moreover, cacao diseases in farms were at alow incidence level (74.13%), with vascular streak dieback (53.06%) as the most commondisease among farms, and the method of controlling the spread was using chemicals (53.60%)and synthetic pesticides (100%) as a spray. Farms established 2 years from sowing (90.13%)observed farm management practices such as weeding twice a year (45.33%), fertilizerapplication 4 times a year (88.00%) using 1-3 bags per hectare (85.06%). Cacao trees produced0.50-1.50 (50.00%) of seeds per tree. Cacao products are sold in dried form (60.98%) withprices ranging from 81-100/kilogram through cooperative (100%). Farmers faced numerouschallenges, the most significant of which were the high cost of routine maintenance (such ascleaning/brushing) and shortage of laborers. The accessibility from the farm to the market roadwas also seen as a challenge among them. The province's cacao agricultural stakeholdersextended to support services to farmers such as free planting materials, credit assistance, cacaoproduction seminars, and post-harvest facilities, which were all considered valuable to farmersin addressing the challenges they faced on cacao farming and production. In Beyond Good and Evil, Nietzsche demands that “psychology shall be<br>recognized again as the queen of the sciences.” While one might cast a dubious glance at the “again,” many of Nietzsche’s insights were indeed psychological, and many of his arguments invoke psychological premises. In Genealogy, he criticizes the “English psychologists” for the “inherent psychological absurdity” of their theory of the origin of good and bad, pointing out the implausibility of the claim that the utility of unegoistic<br>actions would be forgotten. Tabling (...) whether this criticism is valid, we see Nietzsche’s methodological naturalism here: moral claims should be grounded in empirical psychological claims. Later in Genealogy, Nietzsche advances his own naturalistic account of the origins of good, bad, and evil.<br>Three cheers for methodological naturalism, but it was not Nietzsche’s innovation, and he did not pioneer its application to morality. The list of moral naturalists who appealed to psychology arguably includes Aristotle, Descartes, Spinoza, Bentham, and Mill, among many others. If Nietzsche’s naturalism is to be worth the candle of contemporary scholarship, it must involve more than the methodological naturalism that predated him by centuries and to which he made no serious contribution. Nietzsche’s key contribution to naturalism is not his adherence to its methodology, but his discovery of certain psychological facts. In particular, he realized that mental states are not ordinary dyadic relations between a subject and an intentional content. Nietzsche discovered the tenacity of intentional states: when an intentional state loses its object (because the subject realizes the object does not exist, because the object is forbidden, or because of something else), a new object replaces the original; the state does not disappear entirely. As Nietzsche puts it Genealogy, “Man would rather will the void than be void of will.” Nietzsche relies on the tenacity thesis in his explanation of the origin of bad conscience: “All instincts that do not discharge themselves outwardly turn inward […. They turn] against [their] possessors.” When hostility towards others becomes impossible, hostility does not disappear; instead, its object is replaced. (shrink)

But there has been little attention to the question of whether such ecosystem types enjoy a degree of objectivity—whether they might be natural kinds. I argue that traditional accounts of natural kinds that emphasize nomic or causal–mechanistic dimensions of “kindhood” are ill-equipped to accommodate presumptive ecosystemic kinds. In particular, unlike many other kinds, ecosystemic kinds are “anchored” to the contingent character of (...) species and higher taxa and their abiotic environments. Within the context of the Quine–Putnam indispensability argument, one discussion about the status of mathematics is concerned with the ‘Enhanced Indispensability Argument’, which makes explicit in what way mathematics is supposed to be indispensable in science, namely explanatory. If there are genuine mathematical explanations of empirical phenomena, an argument for mathematical platonism could be extracted by using inference to the best explanation. The best explanation of the primeness of the life cycles of Periodical Cicadas is genuinely mathematical, according to Baker (...) :223–238, 2005; Br J Philos Sci 60:611–633, 2009). Furthermore, the result is then also used to strengthen the platonist position :779–793, 2017a). We pick up the circularity problem brought up by Leng Mathematical reasoning, heuristics and the development of mathematics, King’s College Publications, London, pp 167–189, 2005) and Bangu :13–20, 2008). We will argue that Baker’s attempt to solve this problem fails, if Hume’s Principle is analytic. We will also provide the opponent of the Enhanced Indispensability Argument with the so-called ‘interpretability strategy’, which can be used to come up with alternative explanations in case Hume’s Principle is non-analytic. In (...) this essay, this assumption is challenged. br /br /Kantrsquo;s interpretation of space and time as a response to Newtonrsquo;s theologically based spatio-temporal emrealism/em is taken as a model of what it is to be a Kantian emidealist/em about God and the self. In turn, Hegelrsquo;s philosophy is taken as a development of this approach that overcomes the limitations of Kantrsquo;s formal approach. Hegelrsquo;s major contribution to Kantrsquo;s revolutionary transformation of the task of philosophy is, it is argued, his recognitive conception of lsquo;spiritrsquo;. While this has been widely appreciated with regard to the relations between lsquo;subjectiversquo; and lsquo;objectiversquo; spirit, it is suggested that a fuller understanding of the nature of Hegelrsquo;s emabsolute/em idealism requires a proper understanding of how this approach also applies to the domain of lsquo;absolute spiritrsquo;. br /br /. Analytic epistemologists agree that, whatever else is true of epistemic justification, it is distinct from knowledge. However, if recent work by Jonathan Sutton is correct, this view is deeply mistaken, for according to Sutton justification is knowledge. That is, a subject is justified in believing that p iff he knows that p. Sutton further claims that there is no concept of epistemic justification distinct from knowledge. Since knowledge is factive, a consequence of Sutton’s view is that there are no false (...) justified beliefs. <br> Following Sutton, I will begin by outlining kinds of beliefs that do not constitute knowledge but that seem to be justified. I will then be in a position to critically evaluate Sutton’s arguments for his position that justification is knowledge, concluding that he fails to establish his bold thesis. Wilson [Dialectica 63:525–554, 2009], Moore [Int Stud Philos Sci 26:359–380, 2012], and Massin [Br J Philos Sci 68:805–846, 2017] identify an overdetermination problem arising from the principle of composition in Newtonian physics. I argue that the principle of composition is a red herring: what’s really at issue are contrasting metaphysical views about how to interpret the science. One of these views—that real forces are to be tied to physical interactions like pushes and pulls—is a superior guide to real forces than (...) the alternative, which demands that real forces are tied to “realized” accelerations. Not only is the former view employed in the actual construction of Newtonian models, the latter is both unmotivated and inconsistent with the foundations and testing of the science. (shrink)

In seinem 2020 erschienen Buch "Moralischer Fortschritt in dunklen Zeiten. Universale Werte für das 21. Jahrhundert" präsentiert Markus Gabriel einen ethischen Ansatz, den er als Neuen Moralischen Realismus bezeichnet. Das zweite Kapitel trägt den Titel _Warum es moralische Tatsachen, aber keine ethischen Dilemmata gibt_ und bildet den Gegenstand des vorliegenden Beitrags. Es wird im Folgenden versucht, die Positionen des Neuen Moralischen Realismus in Bezug auf ethische Dilemmata zu beleuchten. Zu diesem Zweck gilt es deutlich zu machen, wie der Neue Moralische (...) Realismus die Fragen beantwortet, was ethische Dilemmata sind, ob ethische Dilemmata überhaupt vorkommen und wie die entsprechenden Handlungsoptionen moralisch zu beurteilen sind. Von der Absicht geleitet, durch diesen Beitrag einen philosophischen Dialog zu reproduzieren, werden die hier gemachten Deutungsversuche als Fragen präsentiert. (shrink)

We present a rigorous way to evaluate the visual perception of correlation in scatterplots, based on classical psychophysical methods originally developed for simple properties such as brightness. Although scatterplots are graphically complex, the quantity they convey is relatively simple. As such, it may be possible to assess the perception of correlation in a similar way. Scatterplots were each of 5.0 extent, containing 100 points with a bivariate normal distribution. Means were 0.5 of the range of the points, and standard deviations (...) 0.2 of this range. Precision was determined via an adaptive algorithm to find the just noticeable differences (jnds) in correlation, i.e., the difference between two side-by-side scatterplots that could be discriminated 75% of the time. Accuracy was measured by direct estimation, using reference scatterplots with fixed upper and lower values, with a test scatterplot adjusted so that its correlation appeared to be halfway between these. This process was recursively applied to yield several further estimates. Results of the discrimination tests show jnd(r) = k (1/b – r), where r is the Pearson correlation, and parameters 0 < k, b < 1. Integration yields a subjective estimate of correlation g(r) = ln(1 – br) / ln(1– b). The values of b found via discrimination closely match those found via direct estimation. As such, it appears that the perception of correlation in a scatterplot is completely described by two related performance curves, specified by two easily-measured parameters. (shrink)

Biomedical science has been remarkably successful in explaining illness by categorizing diseases and then by identifying localizable lesions such as a virus and neoplasm in the body that cause those diseases. Not surprisingly, researchers have aspired to apply this powerful paradigm to addiction. So, for example, in a review of the neuroscience of addiction literature, Hyman and Malenka (2001, p. 695) acknowledge a general consensus among addiction researchers that “[a]ddiction can appropriately be considered as a chronic medical illness.” Like other (...) diseases, “Once addiction has taken hold, it tends to follow a chronic course.” (Koob and La Moal 2006, p. ?). Working from this perspective, much effort has gone into characterizing the symptomology of addiction and the brain changes that underlie them. Evidence for involvement of dopamine transmission changes in the ventral tegmental area (VTA) and nucleus accumbens (NAc) have received the greatest attention. Kauer and Malenka (2007, p. 844) put it well: “drugs of abuse can co-opt synaptic plasticity mechanisms in brain circuits involved in reinforcement and reward processing”. Our goal in this chapter to provide an explicit description of the assumptions of medical models, the different forms they may take, and the challenges they face in providing explanations with solid evidence of addiction. <br>. Traditional paradigm on marriage equality focused on a humanitarian appeal and was set as a path dependency model on marriage equality for the suppressed regions. However, such gender based focus has largely neglected the multilateral movements underlying the macro- political-economic structures that shaped law as a power political means. Consequentially, LGBTQI existence became marginalized from the public consciousness with structural realist state hierarchies that further undermines the fundamental freedoms of the LGBTQI popula- tion. This makes the question on LGBTQI equal (...) marriage from a simple humanitarian value based discourse to a macro-political-economy question. The article adopts the Maslow’s hier- archy of needs as the analytical framework on the developing country as the People’s Republic of China (PRC) in relation to multilateralism and global economy on the necessity to legalize LGBTQI marriage. An axiological analysis of the basis of the 1997 Constitution of the Republic of Poland, determined mainly in the Preamble, makes it possible to put forward a thesis that this axiology is not, at least in reference to the principle, eclectic. In respect of the meta-axiological settlements, this is a tradition of natural-law type, recognizing the objective grounding of values and law. The accepted solutions are also convergent with the axiology typical of the international protection of human rights. -/- Résumé (...) L’analyse des fondements axiologiques de la Constitution polonaise de 1997, inscrits avant tout dans le préambule, permet de formuler la thèse selon laquelle cette axiologie n’est pas, en principe, éclectique. La réflexion sur les valeurs s’inscrit dans la vision classique des fondements du droit, remontant à l’antiquité. Partant de là, se dégage une tradition juridique appuyée sur le droit naturel, reconnaissant la force objective des valeurs et du droit. Ces conclusions rejoignent l’axiologie classique de la protection internationale des droits de l’Homme. -/- Zusammenfassung Die Analyse der vor allem durch die Präambel definierten axiologischen Grundlagen der Verfassung der Republik Polen von 1997 ermöglicht die Aufstellung der These, dass diese Axiologie nicht eklektisch ist, zumindest nicht prinzipiell. Hier enthüllt sich ein Denken von den Werten, das sich in die klassische, bis in die Antike zurückreichende Reflexion über die Grundlagen des Rechts einfügt. Wegen der metaaxiologischen Entscheidungen ist das eine Tradition naturrechtlichen Typs, die die objektive Begründung der Werte und des Rechts anerkennt. The first aim of this paper is to elucidate Russell’s construction of spatial points, which is to be <br>considered as a paradigmatic case of the "logical constructions" that played a central role in his epistemology and theory of science. Comparing it with parallel endeavours carried out by Carnap and Stone it is argued that Russell’s construction is best understood as a structural representation. It is shown that Russell’s and Carnap’s representational constructions may be considered as incomplete and sketchy harbingers of (...) Stone’s representation theorems. The representational program inaugurated by Stone’s theorems was one of the success stories of 20th century’s mathematics. This suggests that representational constructions à la Stone could also be important for epistemology and philosophy of science. More specifically it is argued that the issues proposed by Russellian definite descriptions, logical constructions, and structural representations still have a place on the agenda of contemporary epistemology and philosophy of science. Finally, the representational interpretation of Russell’s logical constructivism is used to shed some new light on the recently vigorously discussed topic of his structural realism. (shrink)

Das Anliegen der vorliegenden Studie ist der Entwurf eines wirklichkeitstreuen Modells der Kommunikation. Ebenfalls hat uns interessiert, die konstitutiven Regeln der Kommunikation zu bestimmen und einige Wirksamkeitsnormen und moralische Normen, die mit wünschenswerten sozialen Kommunikationsformen assoziierbar sein könnten, zu identifizieren. Die Kommunikation ist ein facettenreiches und zugleich interpretationsoffenes Phänomen, welches zahlreiche unterschiedliche theoretische Modelle erlaubt. Sie kann von den Psychologen als selbstständigen Verhaltenstyp, von den Soziologen als entscheidenden Sozialisierungsfaktor, von den Anthropologen als kulturhervorbringendes und -verbreitendes Mittel, von den Semiologen als (...) Prozess der (Um-)Konfiguration der verschiedenen Bedeutungen von Bedeutungsträgern usw. gedeutet werden. Das vorliegende Interpretationsmodell der Kommunikation ist allgemein, zum Teil auch hermeneutisch, indem es a) den Kommunikationsprozess als solchen und nicht etwa als eine gesonderte Instanz desselben berücksichtigt, b) eine einzige, nämlich die interaktive Perspektive auf die Kommunikation hervorhebt und c) zweckgemäß die Kommunikation in einen normativen, intelligiblen Rahmen überträgt, wobei sich eine empirische Beschreibung der Kommunikationsfakten zwecks Feststellung allgemeingültiger Gesetze von selbst erübrigt. Diesem theoretischen Modell entsprechend ist die Kommunikation eine Interaktion oder eine wechselseitige semiotische Interaktion, innerhalb derer die involvierten Personen mithilfe von Zeichen komplementäre Verhalten manifestieren, die bestimmten (sozialen) Regeln unterworfen sind. Demzufolge ist die Kommunikation kein individuelles Spiel, sondern ein Team-Spiel. Ihre Protagonisten spielen alle genauso wichtige Rollen, und von ihrer Teilnahme hängt beides, Gelingen und Misslingen der Kommunikation, gleichermaßen ab. Nachdem wir den Begriff der Kommunikation im allgemeinen erklärt hatten, galt unser Interesse der Definition und der Klassifizierung der exklusiven Ausführungsmittel des oben beschriebenen Prozesses, das heißt, der Zeichen. Die semiotische Literatur behandelt die Zeichen sowohl als (stoffliche, mentale oder gemischte) Objekte als auch als Funktionen. Für unsere Demarche haben wir es vorgezogen, die Zeichen als in Wirklichkeit existierende Reize zu beschreiben, die auf Grund von sozialen Konventionen stets auf „etwas Anderes” als auf sich selbst hinweisen. Dieses gemeinte „Andere“, die Bedeutung des Zeichens, ist nichts anderes als die Gesamtheit seiner Anwendungen. Die Natur des Verhältnisses von Zeichen und (willkürlicher, notwendiger, durch Analogie oder Ähnlichkeit begründeter) Bedeutung hat uns dann erlaubt, vier Zeichenkategorien auszumachen und zu beschreiben: Wörter, Indizien, Bilder und Sinnbilder. Was die Erläuterung der konstitutiven Faktoren der Kommunikation anbetrifft, haben wir im Einklang mit den Forschungen angesehener Semiotiker mit sechs grundlegenden Parametern gerechnet: Sender, Empfänger, Mitteilung, Code, Kommunikationssituation und Kommunikationskanal. Doch war das wirklich die einzige treffliche Option? Hätte der Kommunikationsprozess nicht ausgehend von anderen – wenigeren oder mehreren – Faktoren analysiert werden können? Gewiss kann die Kommunikation auch mittels weiterer Variablen verstanden werden – und die Fachliteratur ist nicht müde geworden, die Vorzüge anderer Beschreibungsmuster zu zeigen –; von den sechs semiotischen, von Roman Jakobson eingeführten Parametern kann man indes nicht wegsehen. Sie erlauben allemal eine ziemlich genaue Bestimmung der durch die Protragonisten der Kommunikation durchgeführten Handlungen. In Übereinstimmung mit der allgemeinen Methode der Handlungstheorie haben wir jeden konstitutiven Faktor der Kommunikation mit je einem Handlungspaar korreliert, zum einen beim Sender, zum anderen beim Empfänger. Die Berücksichtigung der Sprache und implizite der Kommunikation im Kontext der Handlungstheorie ist keine bahnbrechende Unternehmung, da sie unter anderem schon John Austin, John Searle und Jürgen Habermas als Ausgangspunkt ihrer Analyse der Sprechakte gedient hat. Auch die Korrelation der Kommunikationsparameter mit einer Handlung ist kein Novum, indem sie auf analoge Weise bereits durch die Versuche einiger Semiotiker wie Roman Jakobson und Karl Bühler, die Funktionen der Sprache bzw. des linguistischen Zeichens zu systematisieren, unternommen wurde. Unser origineller Beitrag besteht aus der Korrelation jedes Faktors der Kommunikation mit einer Interaktion, das heißt mit einem Paar von komplementären Handlungen, so dass jeder Handlung des Senders eine Handlung des Empfängers entspricht. In diesem Sinne haben wir Sender, Empfänger, Mitteilung, Code, Kommunikationssituation und Kommunikationskanal in spezifischen Interaktionstypen (Sichentlarven – Nachvollziehen, Einflussnahme – Antwort, Sendung – Empfang, syntaktische Informierung – syntaktisches Verständnis, Bezeichnung – „Mitbezeich-nung“ bzw. Anknüpfung einer soziale Beziehung – Beibehaltung einer soziale Beziehung) inszeniert. Nachdem wir den Kommunikationsprozess als Totalität von sechs Interaktionstypen beschrieben hatten, haben wir auf drei mögliche Ordnungen der Kommunikationsformen verwiesen, wobei die Einteilungskriterien jeweils die verschiedenen gebrauchten Zeichentypen, die Art der Beziehung zwischen Sender und Empfänger bzw. der sich spontan manifestierende soziale Abstand zwischen den Kommunizierenden waren. Indem unsere Demarche darauf abzielte, die Eigentümlichkeiten verbaler vs. nonverbaler, formaler vs. informaler, der individuell, gruppenweise oder öffentlich stattfindenden Kommunikation auszumachen, haben wir die Akzente auf die Pragmatik der Kommunikation gesetzt und somit einige Hinweise auf den Erwerb spezifischer Kommunikationsfähigkeiten geben können. Das von uns vorgeschlagene theoretische Modell hat also nicht nur ein besseres Verständnis der Kommunikation beabsichtigt, sondern auch die Feststellung eines vollständigen Regelwerks der Kommunikation. Diese Regeln wurden als Formen des zu erwartenden sozialen Verhaltens behandelt – sowohl im normativen als auch im antizipativen Sinne – und wurden im Gefolge von John Searle in zwei Hauptklassen eingeteilt: konstitutive und normative Regeln. Die konstitutiven Regeln bestimmen die von ihnen logisch-abhängigen Verhaltensweisen und legen die Bedingungen der Kommunikationsakte fest, während die normativen Regeln die vorgegebenen, unabhängigen Verhaltensweisen berücksichtigen und die wünschenswerten Bedingungen für ihre Vollziehung festlegen. Um die konstitutiven Regeln ausmachen zu können, sind wir davon ausgegangen, dass der Prozess der menschlichen Kommunikation kein naturhafter, sondern ein institutioneller ist. Mit anderen Worten ist die Kommunikation das Ergebnis einer sozialen Vereinbarung und eben kein unabhängiges Phänomen, das nur von außen zu beschreiben wäre. Je nachdem, wie die notwendigen Regeln, welche die soziale Vereinbarung definieren, respektiert oder verletzt werden, haben wir fünf mögliche Situationen identifiziert: die vollkommene Kommunikation, die teilweise geglückte Kommunikation, die Nonkommunikation, die relative und die absolute Antikommunikation, wobei man hinzufügen muss, dass die erste und die letzte Situation Grenzerfahrungen ohne jegliche Referenz darstellen. Die konstitutiven Regeln der Kommunikation wurden mit allen sechs spezifischen Interaktionstypen korreliert (Sichentlarven – Nachvollziehen, Einflussnahme – Antwort, Sendung – Empfang, syntaktische Informierung – syntaktisches Verständnis, Bezeich-nung – „Mitbezeichnung“ bzw. Anknüpfung einer soziale Beziehung – Beibehaltung einer soziale Beziehung), so dass sie wenigstens aus einem bestimmten Gesichtspunkt ein konsistentes und vollständiges System bilden können. Im Unterschied zum System der konstitutiven Regeln sind hier die Kommunikationsnormen nicht erschöpfend behandelt worden. So wurden aus der Vielfalt der Vorschriften, die zu erwünschten Ergebnissen in der Kommunikation führen könnten, nur einige im Rahmen der vorliegenden Studie angegangen. Diese betreffen die Wirksamkeit und die moralischen Aspekte der Kommunikation und wurden ihrerseits mit den oben angeführten sechs Interaktionstypen korreliert. Dabei waren nicht so sehr die unausweichlichen Lücken im Inventarisieren der Normen, welche die Genauigkeit und die Ökonomie der Kommunikation gewähren, am problematischsten, sondern vielmehr der Grad an moralischer Relevanz, den die Kommunikationsakte beanspruchen können. Wir sind fest davon überzeugt, dass die Handlungen der Kommunizierenden eher davon abhängen, inwiefern sie moralische Verpflichtungen eingehen, und eben nicht davon, was für einen Gewinn sie dadurch erzielen, da keine der berücksichtigten Handlungen sich der Moral gänzlich entziehen können. Ob „neutrale Metaregeln“ für den Fall, dass einige moralische Eingrenzungen mit den Wirksamkeitsnormen kollidieren, vonnöten sind, sei dahin gestellt. Ein theoretisches Modell kann nur dann als nützlich bezeichnet werden, wenn es neue Forschungsansätze bringt und neue Forschungswege ermöglicht. Unter diesem Blickwinkel hat die vorliegende Studie zwei mögliche Fortsetzungen: die Ergänzung der Gesamtheit der normativen Regeln der Kommunikation (im allgemeinen), bzw. das Unterteilen des allgemeinen Modells der Kommunikation in stereotypen Mustern wie der politischen oder didaktischen Kommunikation usw. Schließlich hängen Gelingen und Anwendbarkeit der vorliegenden Studie in pragmatischer Sicht eben davon ab, inwiefern sie dem Leser / Benutzer als Wekzeug zur Verbesserung seiner Kommunikationsleistungen dienen kann. Nach Reinhart Koselleck nennen Historiker die Periode der deutschen Geschichte zwischen 1770 und 1830 ‚die Sattelzeit‘. So wird diese Periode mit einem Bergsattel verglichen, der zwei Gipfel miteinander verbindet, die hier für die frühe Neuzeit und die Moderne stehen. Überall in Deutschland ist diese Periode von tiefgreifenden Reformen der Gesetze und der Verwaltung geprägt. Im Folgenden beschränke ich mich in meiner Darlegung auf Preußen, weil das Preußische Allgemeine Landrecht von 1794 wahrscheinlich das wichtigste Dokument war, durch das diese Reformen in (...) historischer Perspektive begriffen werden können. In my first year at the Graduate Theological Union (Berkeley); I was required to read Oscar Cullmann's <b> Immortality of the Soul or the Resurrection of the Dead? </b> (1956). I was shocked and dumbfounded by what I discovered. Giving my religious instruction under the guidance of the Ursuline nuns at Holy Cross Grade School, it never entered my mind that Jesus did not believe that every person had an immortal soul that survived the death of the body. After a (...) single reading, however, I suddenly realized that Jesus never endorsed the immortality of the soul. I suffered a crisis of faith--I realized that my Catholic upbringing had been contaminated by dubious ideas that originated with Socrates.<br> More recently, the international NT scholar and Bishop N.T. Wright has challenged the Christian churches to drop Socratic ideas and to return to the faith of Jesus:<br> <quote>Mention salvation, and almost all Western Christians assume that you mean going to heaven when you die. But a moment’s thought, in the light of all we have said so far, reveals that this simply cannot be right. . . . If God’s good creation—of the world, of life as we know it, or our glorious and remarkable bodies, brains, and bloodstreams—really is good . . . , then to see the death of the body and the escape of the soul as salvation is not simply slightly off course, in need of a few subtle alterations and modifications. It is totally and utterly wrong! </quote> In my article, I use my personal story to illustrate how Socratic doctrines had distorted my faith in Jesus. I use my training in historical theology to illustrate (a) how Socrates became the patron saint of the Church Fathers; (b) how Jesus' mission in Hades expanded during the first three centuries; and (c) how Hades began as a cool place where the souls of saints and sinners resided together and ended up as a hot place where grave sinners were eternally tormented. Along the way, I show how Socrates failed to resolve key issues such as (a) whether the soul survives death; (b) whether communication between souls is even possible after death; and (c) whether souls in the heavenly realm are locked in a permanent coma. Ziel dieses Papiers ist es die Ordnungsethik – einen bereichsethischen Ansatz, der derzeit vor allem für wirtschaftsethische Fragestellungen benutzt wird – als eine universelle Methode zur Analyse von bereichsethischen Fragestellungen vorzustellen. Um das Vorhaben handhabbar zu machen, muss es in zweierlei Hinsicht eingeschränkt werden. Zum einen kann es sich hier natürlich nicht um eine voll ausgearbeitete Methodologie für die Analyse von bereichsethischen Fragestellungen handeln, sondern nur um eine methodische Skizze. Zum anderen soll es in diesem Papier im Wesentlichen um solche (...) bereichsethischen Fragestellungen gehen, deren Lösung die Implementierung von formellen wie informellen Regeln erfordert. In der Korrespondenz mit Clarke ist Leibniz' Standardargument gegen die Annahme, daß Raum und Zeit absolut seien, daß Gott sich bei der Wahl des zu erschaffenden Universums gezwungen sähe, gegen das Prinzip des zureichenden Grundes zu verstoßen, wenn diese Annahme richtig wäre: Bloße Unterschiede in räumlicher und zeitlicher Hinsicht ergeben keinen Vorteilsunterschied, und da Gott nur aus Vorteilsgründen handelt, sind solche Unterschiede nicht möglich. Leibniz stellt dieses Argument als ausschließlich abhängig vom Prinzip des zureichenden Grundes dar, eine gängige Interpretation ist (...) aber, daß dies Prinzip determinierte Objekte göttlicher Wahl nur dann ergibt, wenn ein ergänzendes Prinzip von Kontingenz hinzutritt. Diese Auslegung muß falsch sein, wenn Leibniz hier authentisch bleibt, und insofern wäre doch das Prinzip des zureichenden Grundes eher als irgendein Prinzip des Besten Leibniz' Prinzip der Kontingenz. In this article, it is argued that a significant internal tension exists in John Rawls' political liberalism. He holds the following positions that might plausibly be considered incongruous: (1) a commitment to tolerating a broad right of freedom of political speech, including a right of subversive advocacy; (2) a commitment to restricting this broad right if it is intended to incite and likely to bring about imminent violence; and (3) a commitment to curbing this broad right only if there is (...) a constitutional crisis. By supporting a broad right of freedom of political speech in Political Liberalism, he allows militant intolerant people such as Jihadists, White Supremacists and Neo-Nazis to advocate publicly their dangerously intolerant beliefs. Public advocacy of dangerously intolerant beliefs can be construed as subversive advocacy. As demonstrated by the historical examples of the Weimar Republic and the Second Spanish Republic, militant intolerant groups could use a right of subversive advocacy to threaten the stability of liberal democracies. Hence, by allowing them to exercise a broad right of freedom of political speech, Rawls could jeopardize that which he intends to defend, namely the actual political stability of a liberal democratic order. Lastly, Rawls' conception of ideal constitutional interpretation, which privileges a broad right of freedom of political speech, might be insufficient to deal effectively with the threat posed by militant intolerant groups. Yet a tradition of American constitutional interpretation that balances freedom of speech with other important constitutional and/or political values has overcome a civil war, two world wars, the Cold War and the 9/11 terrorist attacks without abandoning democracy or permanently renouncing those values. Still, Rawls' ideal approach to constitutional interpretation might, in hindsight, help us to understand some of the excesses and deficiencies of American jurisprudence in times of emergency.<br><br><br><br>. Die anhaltende Popularität von juristisch geprägter Literatur zeigt, dass das Ringen um die Gerechtigkeit im Recht ein brisantes Thema ist, das gesellschaftliche Aufmerksamkeit auf sich zieht, provoziert und immer wieder neu zum Nachdenken herausfordert. Zeitgenössisch sind es Autor*innen wie Juli Zeh, Bernhard Schlink, Georg Oswald oder Ferdinand von Schirach (sogenannte Dichterjurist*innen 1 ), die die Frage nach Recht und Gerechtigkeit literarisch verbinden und deren Problemkontexte beleuchten. Juli Zeh lässt ihrem Roman Spieltrieb die Erzählerinstanz sprechen: „Das Recht ist kein Kreißsaal für (...) die Gerechtigkeit […]“ (2013, 518). Auch Ferdinand von Schirach bemüht sich herauszustellen, dass für ihn Recht nicht gleich Gerechtigkeit bedeutet. Als Strafverteidiger sagt er über die Justiz: „[W]ir sprechen […] nicht Gerechtigkeit, sondern Recht“ (Heise 2009).3 In seinen Bestsellern (angefangen von z. B. Der Fall Collini über Terror bis zu seinem neusten Stück Gott) provoziert er das Gerechtigkeitsempfinden seiner Leser*innen und lässt sie am Ende gerne selbst das Urteil fällen. In Terror (2016) soll das Publikum als Jury selbst entscheiden, ob der Kampfpilot das entführte Passagierflugzeug, das auf ein voll besetztes Fußballstadion zugesteuert ist, hätte abschießen dürfen. Hier geraten u. a. die Gewissensentscheidung des Piloten und die Rechtsgrundlage in einen Konflikt. Nicht selten macht er den Leser*innen das Recht schwer erträglich, wenn er z. B. wie im Erzählband Schuld (2017) auf brutale Weise beschreibt, wie eine minderjährige Kellnerin auf einem Volksfest von einer Gruppe von Männern vergewaltigt wird, aber aus Beweismangel letztendlich keiner dieser Männer schuldig gesprochen werden kann. In der Literatur werden vielfältige Zugänge zum Verhältnis von Recht und Gerechtigkeit eröffnet – wie kann sich die christliche Sozialethik positionieren? (shrink)

US military intervention and covert action is a significant contributor to global injustice. Discussion of this contributor to global injustice is relatively common in social justice movements. Yet it has been ignored by the global justice literature in political philosophy. This paper aims to fill this gap by introducing the topic into the global justice debate. While the global justice debate has focused on inter-national and supra-national institutions, I argue that an adequate analysis of US military and covert action must (...) focus on domestic institutions of the US. I describe many such institutions including industry lobbying, the ubiquity of US military bases abroad, US programs for training foreign militaries, secrecy of the intelligence and military agencies, pliant news media and government propaganda.<br>. The Transamazon (Br-230) Highway in the state of Pará has had its image frozen for decades: themuddy road, the cars stopped or tractors tearing down a forest, empty of people, opening the amazonianspace to a project of an authoritarian modernization. Reproduced by and reproductive of the teachingsof geography – including for children and teenagers who live on the edge of the road, in settlements andcommunities on the sideroads (vicinais) – in textbooks and discourses that frame regional scale (astotalizing and explanatory) (...) instead of scales emplaced in situ. The result of such dinamics is not restricted to a gap between what one experiences as a phenomenon and what one learns as a concept,it goes towards the reproducibility of an “unexistance of the creative potential” of the people living onthe sideroads, places of the construction of a geography, as well as mapping, that, from there, push usto rethink the unwavering foundations of such frosen images , of the generalistic maps and theirstandardizing projections, scales and simbology. To do so, we have, along with students and teachersof 2 schools on the sideroads of the municipality of Pacajá (PA), in the period of the beggining of 2016to 2019, done several geocartographic exercises: mind maps developped with students about the past,present and the future of the vicinal (sideroad). That is, an attempt to provoque the body into the mapand the map into the body in a context of a limit situation of existance, given the precarious schoolconditions as well as the diferent challenges lived by students and teachers. Such corporal engagementas an attempt to think the sideroads as a location in construction and, from there, a situated opening tothe world, is what gives meaning to geocartography. It is possible to conclude that: a) facing thesedimentary representations paralysing and overview of the Transamazon in the state of Pará , thephenomenological exercise of reactivation of geocartogrphying provoques the emergence of asubjective significance that does not separate the emotional and symbolic perspectives on creatingmaps; b) the corporal engagement and the situated perspective of students and teachers, not only hasthe value of a totalyzing exemple, but that of an opening to what is new as they bring up a simbologythat reveals the need to build a dialogical bridge between what is lived on the sideroads and the worldthat classifies it as “unexisting”. Die Entwicklung von HeImholtz' Mechanismus ist durch einen Wandel im Geltungsanspruch gekennzeichnet und läßt sich in einer noch sehr groben Übersicht in zwei Perioden einteilen. Auf die erste Periode bis etwa zum Ende der 60er Jahre werde ich im ersten Teil meines Beitrages eingehen. Hier rekonstruiere ich umrißhaft die empiristische Begründung, die Helmholtz für den Wahrheitsanspruch seiner Naturauffassung gegeben hat. Im zweiten Teil werde ich dann die wichtigsten Merkmale der im Verlauf der 70er Jahre hervortretenden Hypothetisierungstendenz charakterisieren. Abschliessend will ich (...) in einem dritten Teil zeigen, wie Helmholtz auf der Grundlage seines gewandelten Wissenschaftsverständnisses das Programm einer mechanistischen Naturerklärung mit großem wirkungsgeschichtlichen Einfluß weiter verfolgt hat. Der Kerngedanke der politischen Theorie des Wilhelm von Humboldt ist äußerst schlicht und übersichtlich: In seinen "Ideen zu einem Versuch, die Gränzen der Wirksamkeit des Staats zu bestimmen" heißt es, dass die Funktion des Staats auf die Erhaltung der inneren und auswärtigen Sicherheit beschränkt werden soll. Diese Staatsauffassung findet ihre Begründung in einer Anthropologie, die dem Menschen das Recht und zugleich die Aufgabe zuweist, durch das spontane Zusammenwirken mit den anderen seine Potenzialitäten zur Entfaltung zu bringen. Schlicht und übersichtlich wie (...) diese Staats- und Menschenlehre auch scheinen mag, ist es an ihr außerordentlich interessant, einerseits welche Leitgedanken ihr zugrunde liegen, und andererseits welche theoretischen Neuigkeiten sie erzielt. Hier möchte ich insbesondere vier Aspekte hervorheben: 1- Individualismus: Der Angelpunkt der gesamten Philosophie Humboldts ist das Individuum, aus dem allerdings nie ein selbstgenügsames Subjekt wird; 2- Liberalismus: Humboldt formuliert als erster den Katalog der Motive des Liberalismus des 19. Jahrhunderts; 3- Gesetzmäßigkeitsprinzip: im Sinne seiner Ausformulierung des Rechts- und Freiheitsbegriffs erarbeitet Humboldt ein Gesetzmäßigkeitsprinzip anthropologischen Charakters; 4- Legitimationsprinzip: in Anlehnung an die Prämissen, aus denen sich das neue Gesetzmäßigkeitsprinzip ergibt, setzt Humboldt ein neues Legitimationsprinzip, das unserem Begriffspaar „materielle Verfassung-formelle Verfassung“ sehr ähnelt. Dieser Artikel enthält eine kritische Diskussion der von Peter Stemmer in seinem Buch "Normativität. Eine ontologische Untersuchung" vorgelegten Analyse von Normativität. Zentraler Kritikpunkt ist der Umstand, dass der für Stemmers Analyse zentrale Begriff des Wollens unanalysiert bleibt, sich dieses jedoch, so das hier vorgestellte Argument, entweder in einer Weise analysieren lassen wird, die, als Tendenz gedeutet, weniger zu leisten vermag als Stemmer für seine Analyse benötigt, oder, als intentionaler Zustand gedeutet, selbst bereits Normativität voraussetzt und somit für Stemmers reduktive Analyse (...) von Normativität nicht geeignet ist. Gegen Ende des Aufsatzes wird eine pragmatistische Fundierung von Normativität angedeutet und verschiedene Ressourcen aufgezeigt, deren sich Stemmer bedienen könnte, um seine Position gegen die vorgebrachten Einwände zu verteidigen. Das Verhältnis von Geschichts- und Naturwissenschaft ist zwischen 1880 und 1945 - dem hier zu betrachtenden Zeitraum - durch einen Differenzierungsprozeß bestimmt, in dem sich die Geschichtswissenschaft gegenüber dem verstärkten Einfuß der naturwissenschaflichen Methode auf die Erfahrungswissenschaften abzugrenzen versucht und die Naturwissenschaft von der Historizität ihrer eigenen Erkennmisse zunehmend absieht. Diese allgemeine Tendenz setzt sich jedoch bei weitem nicht ungebrochen durch. Sie ist in eine komplexe Struktur von thematischen und interdisziplinären Beziehungen eingelassen, in der zahlreiche gegenläufige, kaum einheitlich zu charakterisierende (...) Bewegungen wirksam sind. Will man sich einen Überblick über diese verwickelten Verhältnisse verschaffen, empfiehlt es sich, von einem vereinfachenden Schema auszugehen und zwischen vier disziplinären Kontexten zu unterscheiden:der Geschichtswissenschaft, dem naturalistischen Geschichtsdenken, der Naturwissenschaft und der Wissenschaftsgeschichtsschreibung der Naturwissenschaft. Entlang dieser Einteilung möchte ich thesenartig auf Aspekte der wissenschaftlichen Thematislerung von Natur und Geschichte eingehen, die mir für die geschichtstheoretischen Diskurse besonders relevant zu sein scheinen. In diesem Essay geht es um ein religionsfreundliches Selbst- und Weltverständnis, das die Reichweite der menschlichen Vernunft ebenso wie deren intrinsische Grenzen achtet. In dem weiten Feld wählen wir hier Betrachtungen des mittelalterlichen Philosophen und Theologen Meister Eckhart aus. Eckhart (ca.1260-1338) gilt vielen als Mystiker, anderen als Philosophen des Christentums. Er war wohl Beides. Philosophisch ist seine Lehre, die einzelne menschliche Seele habe einen göttlichen, unvergänglichen (...) Urgrund; eher mystisch die These, dieser Urgrund bedarf einer „Gottesgeburt“ in der Seele, ein Loslassen von allen Bestrebungen, einschließlich dem Bestreben, sich gottgefällig zu verhalten. Mir geht es hier nur um den philosophischen Aspekt mit Betonung auf Erkenntnis. (shrink)
