Defenders of intellectual property rights argue that these rights are justified because creators and inventors deserve compensation for their labour, because their ideas and expressions are their personal property and because the total amount of creative work and innovation increases when inventors and creators have a prospect of generating high income through the exploitation of their monopoly rights. This view is not only widely accepted by the general public, but also enforced through a very effective international legal framework. And it (...) is endorsed by most academic researchers and commentators in this field. In this essay, I will show that the classical arguments for the justification of private intellectual property rights can be contested, and that there are many good reasons to abolish intellectual property rights completely in favour of an intellectual commons where every person is allowed to use every cultural expression and invention in whatever way he wishes. I will first give a short overview of the classical arguments for the justification of intellectual property as they are usually stated. We will then discuss the question of whether the creator or inventor deserves his de jure monopoly, by using John Christman’s categories of income and control rights to analyse property rights. The aim here is to show that it does not make sense to create control rights for abstract objects, as they are not scarce, and that there is no logical connection between the surplus which may be generated through income rights and the labour which has been put into a cultural artefact or an invention, and therefore it is not justified to grant monopoly rights on the basis of Lockean natural rights arguments for self-ownership and the just appropriation of worldly resources. As it is possible to reject Christman’s property rights categories, I will then go on to show on the basis of Richard Dawkins’ postulation of the ‘meme’ and Ludwik Fleck’s theory of the ‘thought collective’ that creative processes should be interpreted as interpersonal or collective processes, and therefore it is not justified to grant intellectual property rights to individuals on the basis of the idea that the individual who has put labour into the creative work or the invention should be the one to whom the contents of the work belong exclusively. As it is still possible to postulate the utilitarian argument that intellectual property rights are just because they increase the amount of creative works and inventions, I will argue in the last chapter that, from a libertarian as well as from an egalitarian point of view, the justification of intellectual monopoly rights on utilitarian grounds cannot be maintained. Therefore it is time to abolish the current global intellectual property law regime in favour of an intellectual commons for the good of all human beings and societies. (shrink)

According to Descartes, physics rests on metaphysics. Various possible interpretations of this metaphor are considered. I will show that only a weak interpretation can be brought into accordance with other parts of Descartes' philosophy. According to the weak interpretation, physics has to presuppose metaphysics because the latter shows that contrary to widespread contemporary arguments the concepts of mathematical physics are adequate to describe nature. It is argued for this position by comparing the Regulae, where Descartes did not make use of (...) metaphysical arguments, with the Principia, where he did. (shrink)

Doch nicht für alle Situationen mögen Verlässlichkeitsgründe auch angemessene Gründe sein. Damit eröffnet sich die Idee, die Güte von Gründen von ihrer Angemessenheit zu unterscheiden. Der Aufsatz betrachtet an einem Beispiel, einem KI-Lügendetektor, die Frage, ob eine (zumindest aktuell nicht gegebene) hohe Verlässlichkeit den Einsatz rechtfertigen kann. The paper analyses how knowledge claims can be extrapolated from laboratory situation to more complex situations. It argues that claims by Tetens, Knorr-Cetina and Cartwright that put doubts on extrapolation are unwarrented.

What does it mean to be conservative? What could it mean in the arts? Whoever merely conserves works of art may be a collector but is not an artist. Brahms’s trio op. 40 conserves the hand horn idiom. Yet its aesthetics will not be captured by the opposition of ‘conservative’ versus ‘progressive’. What is superior in terms of technology, Brahms maintained, need not be superior in terms of art.

The study pursues, in a historical as well as in a systematic-analytical way, the reading of Descartes' philosophy as a project of a fundamental critique of theology and transcendence. Besides the exclusion of everything 'theological' from the field of rational discourse and its relegation to the field of fideism, this also involves the reinterpretation of the concept of 'God' as Descartes uses it, in a sense that is to be purified of transcendental, but especially of theistic implications.

Es werden zwei unterschiedliche Modelle vorgestellt: zum einen die Autonomie-Konzeption Kants, die auf dem Begriff des freien Willens gründet, der sich selbst dem Vernunftgesetz unterstellt; zum anderen die von Platon inspirierte Moralphilosophie Iris Murdochs, in der die moralische Sehkraft, die sich an der aufmerksamen Wahrnehmung des konkreten Einzelnen orientiert, im Mittelpunkt des guten Lebens steht. In der Auseinandersetzung mit den beiden Entwürfen werden deren Stärken und (...) Schwächen deutlich. Blumenbergs Paradigmen zu einer Metaphorologie sind bekannt für die Entdeckung absoluter Metaphern. Zahlreiche systematische Fragen mögen dabei offen geblieben sein, etwa die nach verschiedenen Typen1 von Metaphern oder den Methoden ihrer Interpretation, so dass schon bezweifelt wurde, ob es sich überhaupt um eine Metapherntheorie handle.2 Immerhin: Dass es absolute Metaphern gibt, was diese sind und woran sie erkannt werden können, wird von Blumenberg in großer Prägnanz und anhand zahlreicher Beispiele dargestellt. Wenn es eine unangetastete Gewissheit in der Blumenbergrezeption gibt, so (...) scheint sie hierin zu finden zu sein. Dennoch möchte ich erneut die Frage an Blumenbergs Text stellen: In welchem Sinn ist eine Metapher absolut? Auf den ersten Blick mag diese Frage überraschen, da sie einen der offensichtlichsten Gedanken Blumenbergs berührt: Eine absolute Metapher ist nach Blumenberg eine solche, die sich nicht in Begriffe rückübersetzen lässt. In diesem Sinne wird sie von ihm als absolut charakterisiert. Warum halte ich dennoch diese Frage für berechtigt? Das wird am besten anhand einer Alternative verdeutlicht: Ist die absolute Metapher ein Ausdruck in einem fremden Kontext, wie Blumenbergs zahlreiche Exempel nahelegen (die Kraft der Wahrheit, die nackte Wahrheit), oder ist die absolute Metapher gleichsam die jeweilige ganze Theorie, bündelt sich in ihr der gesamte Text? Auf den ersten Blick mag diese Alternative paradox erscheinen. Vorgreifend sei der ihr zugrundeliegende Gedanke erläutert: Blumenbergs Darstellung der Fundstellen legt zunächst die erste Lesart nahe. Demnach wäre die absolute Metapher das Vorkommen eines Ausdrucks (wie »Kraft« oder »nackt«) in einem Kontext, in den sie zunächst nicht passt (Wahrheit). Die Metapher wäre dann zwar nicht ein Ausdruck allein, sondern ein Ausdruck in einem ihm fremden Kontext; sie wiese jedoch Grenzen auf. Wie unbestimmt diese auch verliefen, ob sie weiter oder enger anzusetzen wäre, sie wäre lokalisier- und daher identifizierbar. Die zweite Lesart motiviert sich zunächst dadurch, dass Blumenberg vorführt, dass eine absolute Metapher gegeben sein kann, ohne dass sie als Ausdruck in einem Text vorkommt. Sie bildet dann dessen »implikatives Modell«; das heißt, sie stellt den Hintergrund der Begriffsbildung dar und entwirft das Verhältnis von Selbst und Welt. Was zunächst einen Sonderfall darstellt (Metapher ohne Ausdruck), verweist jedoch auf eine allgemeine Eigenschaft absoluter Metaphern bei Blumenberg: Diese sind Modelle für das Verhältnis von Ich und Welt und erfüllen dadurch theoretische und pragmatische Funktionen. Als solche ist die absolute Metapher nicht auf ein lokales Vorkommen begrenzt, sondern durchdringt den Text als solchen. Beide Möglichkeiten stehen in einem Gegensatz zueinander. Gleichwohl gibt es einen ver- mittelnden Gedanken: Die absolute Metapher (als Strukturzusammenhang des gesamten Textes verstanden) kann sich gleichsam in einem Ausdruck manifestieren, verdichten und selbst bezeichnen. Aber das Vorkommen von absoluten Metaphern wäre an das Vorkommen von Ausdrücken in einem fremden Kontext nicht gebunden. Die Diskussion dieser Frage steht im Zentrum des Beitrags (Abschnitte 1–2), sie hat Konsequenzen für zwei Gedanken (Abschnitte 3–4), die in ihrem Licht vielleicht klarer hervortreten. (shrink)

Nor do we predict that listeners will become sad or joyful when they will listen to a performance of that composition. Musical expression is not a mode of consciousness in those who produce it and it is not an effect of music either. (...) Rather, it is a feature of the music itself. Once we have discarded the psychological reduction of expression, the way may be clear to explore the intricate relation between expression and subjectivity. Theorien von Gerechtigkeit als einer ethischen Tugend spielen eine große Rolle in der protestantischen Ethik vor dem Dreißigjährigen Krieg. Eines der hervorstechenden Merkmale dieser Theorien ist ihr eklektischer Charakter: Sie verbinden Elemente aus verschiedenen Traditionen der antiken Tugendethik, vor allem der platonischen, aristotelischen und stoischen. Die Gerechtigkeitstheorien von protestantischen Philosophen wie Rudolph Goclenius, Clemens Timpler und Bartholomäus Keckermann illustrieren gut dokumentierte Merkmale des frühneuzeitlichen Eklektizismus wie die Rolle der Reinterpretation von ausgewählten Lehrstücken und die konziliatorische Strategie, scheinbare Widersprüche zwischen verschiedenen (...) Traditionen aufzulösen. Darüber hinaus illustrieren sie aber auch ein weniger gut dokumentiertes Merkmal des frühneuzeitlichen Eklektizismus, nämlich seine Funktion als philosophische Problemlösungsstrategie. Dieser Artikel versucht zu zeigen, wie Goclenius, Timpler und Keckermann einerseits Elemente aus den platonischen (und stoischen) Traditionen nutzen, um diagnostizierte Probleme in der aristotelischen Tradition zu beheben und andererseits Elemente aus der aristotelischen Tradition verwenden, um Probleme in der platonischen Tradition zu lösen. Orientierung steht am Anfang von allem, ohne selbst ein greifbarer Anfang zu sein. Als Letzt- und Grundbegriff geht sie jedem Denken und jeder Lebenstätigkeit voraus und ermöglicht sie. Dennoch war sie selbst bislang kaum Gegenstand philosophischer Reflexion. In seiner Philosophie der Orientierung macht Werner Stegmaier – bekannt durch seine Beiträge zu Nietzsche, Dilthey, Luhmann und Levinas – sie zum Ausgangspunkt, um die Philosophie selbst im Hinblick auf ihr praktisches, lebensweltliches Potential hin neu zu denken. Das breite Spektrum des Sich-Orientierens und (...) des Orientiert-Seins im Denken, die Bedingungen und Strategien der Orientierung im Alltag und ihr Ziel, die Ungewissheit, das Grundproblem der Orientierung, zu bewältigen, werden von ihm in die Perspektive der Philosophiegeschichte gestellt und im Blick auf aktuelle philosophische Fragestellungen systematisch untersucht. Die Beiträge des Bandes, abgerundet von einem Nachwort Werner Stegmaiers, eröffnen diesem genuinen Ansatz einen breiten Reflexions- und Diskussionsraum und zeigen so seine Bedeutsamkeit nicht nur für die Philosophie im Ganzen, sondern auch über ihre Grenzen hinaus. Neuere Interpretationen von Leibniz' Notizen zur Metaphysik aus den Jahren 1675-1676 tendieren dazu, diese Texte im Licht eines spinozistischen Substanz-Monismus zu lesen. Obwohl es für eine solche Interpretation überzeugende Anhaltspunkte gibt, vertritt Leibniz jedoch in denselben Texten auch einen Substanzen-Pluralismus in Bezug auf geistige Substanzen. Substanz-Monismus und Substanzen-Pluralismus scheinen miteinander vereinbar zu sein, weil für Leibniz, ähnlich wie für Descartes in den Principia philosophiae, der Terminus ‚Substanz‛ nicht in univoker Weise von Gott und von Gegenständen in der Welt ausgesagt werden (...) kann. In den Elementa juris naturalis behauptet Leibniz, dass es rational ist zu präsumieren, dass eine gegebene Handlung gerecht ist. Diese Behauptung scheint in Widerspruch zu seiner Auffassung zu stehen, dass das, was präsumiert wird, einfacher ist als sein Gegenteil. Nach Leibniz ist einfacher, was weniger Voraussetzungen hat als etwas anderes, wobei er zwischen logischen und ontologischen Voraussetzungen unterscheidet. Dieser Diskussionsbeitrag versucht zu zeigen, dass Voraussetzungen auf der ontologischen Ebene eine oft übersehene Rolle für die Präsumption der Gerechtigkeit einer Handlung spielen (...) und dass sich der scheinbare Widerspruch auf dieser Ebene auflösen lässt. Nach Leibniz ist eine gerechte Handlung eine spezielle Art von Möglichkeit: eine Handlung, die für eine moralische Person möglich ist. Ihm zufolge hat aber ein mögliches Ereignis weniger ontologische Voraussetzungen als ein unmögliches Ereignis, weil die ontologischen Voraussetzungen eines möglichen Ereignisses ein Teil der Voraussetzungen eines unmöglichen Ereignisses sind. Die Präsumption zu Gunsten der Gerechtigkeit einer Handlung lässt sich als Spezialfall der Präsumption zu Gunsten der Möglichkeit eines Ereignisses auffassen. (shrink)

Phänomenologie intendiert allgemein eine Beschreibung und intersubjektiv nachvollziehbare Analyse der in einer konkreten Situation sich erschließenden Phänomene des menschlichen Bewußtseins. Klinische Phänomenologie hat darüber hinaus die therapeutische Situation zu berücksichtigen. Im Folgenden wird die These vertreten, daß die psychische Verfassung eines Menschen niemals allein aufgrund einer rein phänomenologischen Analyse auf alle praktisch und therapeutisch relevanten Konsequenzen hin ergründet werden kann. Das kann insbesondere dann nicht der Fall sein, wenn sich solche Konsequenzen aus einem außerhalb der konkreten Situation gewonnenen, empirisch verallgemeinerbaren (...) psychopathologischen Wissen ergeben. Die Integration wird am ehesten dadurch ermöglicht, dass in einer vorausgehenden Analyse der therapeutischen Situation unterschiedliche "Sinnebenen" beachtet werden. Mit einem solchen klinisch-phänomenologischen Ansatz ist die reine Phänomenologie der Bewußtseinsphänomene überschritten, jedoch ergibt sich eben dadurch die Möglichkeit, die jeder praxisbezogenen Wissenschaft inhärenten "Aporien der praktischen Vernunft" darzulegen. Ohne eine solche vorausgehende Analyse der therapeutischen Situation bleibt die Gefahr einer subjektivitischen oder auch objektivistischen Vereinseitigung der Positionen bestehen, wie wir sie aus der jüngeren Psychiatriegeschichte kennen. Um eine Urteils-, Entscheidungs- und Handlungskompetenz im Bereich der klinischen Psychiatrie zu gewährleisten, bedarf es zusätzlich ethischer Maßstäbe und Kriterien, die sich auf der Grundlage eines von dogmatischen Vorstellungen freien Menschenbildes begründen lassen. Dessa forma, convergindo para a questão que encerra a imagem ortodoxa, dogmática, pré-filosófica, natural e moral do pensamento, o artigo recorre ao filme Instituto Benjamenta (1995) enquanto construção que assinala a intersecção de séries infinitas de imagens de pensamento que escapam ao horizonte da circunscrição da visualidade através de inter-relações ilimitadas que emergem carregadas de complexidade em um processo que defende a superação das imagens dogmáticas do pensamento e da mera exposição do conteúdo do arcabouço histórico do pensamento enquanto objeto que tende à reprodução de ideias e noções e implica a “repetição” de interpretações na relação de ensino e aprendizagem, impedindo o exercício de criação de conceitos, característica da Filosofia, segundo Deleuze, convergindo para a necessidade da instauração de uma experiência capaz de viabilizar a emergência do “novo” através das possibilidades suscitadas no acontecimento da construção do conhecimento. Andrea Cesalpino is an important figure in the history of science. He demonstrated that blood circulates into heart from veins and from the heart to arteries, paving the way to Harvey’s complete description of blood circulation. Moreover, he was the founder of botany as a systematic discipline, which he based, rather than on the observation of accidental similarities of plants, on the discovery of their vegetative-generative principle. In philosophy, he attempted to conciliate the immortality of the soul (i.e., the form (...) of the body) with the existence of a unique immaterial intellect, which is individuated and multiplied in the singular souls that participate to it. This chapter uncovers a less investigated aspect of the relationship between the two most important scholastic schools of the Renaissance, Thomism and Scotism: the influence of Scotist literature on distinctions as seen in some sixteenth-century Thomists. The chapter has a primary focus on Chrysostomus Javelli’s engagement in his discussion of divine attributes with the Scotist doctrine of distinctions, but also considers other Thomist sources. First, the beginnings of the highly specialised Scotist literature on distinctions are traced back to the start (...) of the fourteenth century; I show how some early followers of Duns Scotus, in particular Francis of Meyronnes and Petrus Thomae, systematised Scotus’ ontology of the various grades of being by compiling lists of subtle distinctions to be applied to various levels of reality. I give some indications as to the later reception of these models of distinctions in the Scotist school. Special attention is paid to Étienne Brulefer, since his summary of Petrus Thomae’s model of seven distinctions was Javelli’s source for the Scotist doctrine. I then investigate how Javelli worked with Brulefer’s summary, and how he sought to integrate the Scotist doctrine into his own discussion of divine attributes. Thomists traditionally allowed only a rational or mental kind of distinction among divine attributes, and between them and the divine essence. Javelli, however, endeavours to show how the Thomist position may be reconciled with the Scotist doctrine of a formal or ex natura rei distinction. He did not always endorse this conciliatory approach; I hypothesise that he changed his mind on the subject over time. Finally, I show how other Renaissance Thomists reacted to the Scotist system of distinctions; in particular, I draw attention to the Thomists Andreas Bodenstein von Karlstadt, Bartolomeo Manzoli, and Mattia Gibboni da Aquario, who all wrote treatises on Thomist distinction theory modelled on the Scotist system of distinctions. In some of this literature, lists of distinctions based on Thomist metaphysics were compiled in order to replace the Scotist system. I argue that Javelli’s approach is more conciliatory and, in fact, has some overlap with the concordist thought of Giovanni Pico della Mirandola, who himself considered Scotus and Aquinas to be in fundamental agreement as regards the distinction between divine attributes. El ensayo ofrece una mirada histórico-crítica sobre las transformaciones que condujeron desde el kitsch de principios del siglo XX hasta el neokitsch contemporáneo: desde la génesis del kitsch hasta su afirmación como una de las manifestaciones más tangibles de la cultura de masas. Integrándose con (...) la estética posmoderna, el kitsch se transforma en neokitsch, una estética que utiliza el kitsch como su propia sintaxis en el complejo escenario de la estética contemporánea. /// -/- Kitsch is not just a category that has defined one of the possible aesthetic grammars of modernity, but also an anthropological dimension that has had different configurations in the course of historical processes. The essay offers a historical-critical look at the transformations that led from the early twentieth century kitsch to the contemporary neokitsch: from the genesis of kitsch to its affirmation as one of the most tangible manifestations of mass culture. Integrating with postmodern aesthetics, kitsch turns into neokitsch, an aesthetic that deliberately uses kitsch as its own syntax in the complex scenario of contemporary aesthetics. (shrink)

Open peer commentary on the article “Ethics: A Radical-constructivist Approach” by Andreas Quale. Upshot: The first of my two main goals in this commentary is to establish thinking of ethics as concepts rather than as non-cognitive knowledge. The second is to argue that establishing models of individuals’ ethical concepts is a scientific enterprise that is quite similar to establishing models of individuals’ mathematical concepts. To accomplish these two primary goals, I draw from my experience of working scientifically with von (...) Glasersfeld for 25 years while he was developing radical constructivism as a coherent model of knowing, and appeal to several of his basic insights to establish constructing models of ethical concepts as a scientific enterprise. Alongside the exponential development and application of machine learning algorithms, new ethical problems and solutions relating to their ubiquitous use in society have been proposed. Chapter 14. Andrea Timár engages with literary representations of the experience of perpetrators of dehumanization. Her chapter focuses on perpetrators of dehumanization who do not violate laws of their society (i.e., they are not criminals) but exemplify what Simona Forti, inspired by Hannah Arendt, calls “the normality of evil.” Through the parallel examples of Dezső Kosztolányi’s Anna Édes (1926) and Doris Lessing’s The Grass is Singing (1950), Timár first explores a possible clash between criminals and perpetrators of dehumanization, showing literature’s (...) exceptional ability to reveal the gap between ethics and law. Second, she examines novels focalized through perpetrators and the difficult narrative empathy they provoke, arguing that only the critical reading of these novels can make one engage with the potential perpetrator in oneself. As case studies, Timár examines Daniel Defoe’s Robinson Crusoe (1719), which may potentially turn its reader into an accomplice in the process of dehumanization, and J.M. Coetzee’s Foe (1986), which puts on critical display the dehumanizing potentials of both aesthetic representation and sympathy as imaginative violence. Third, she reads Jonathan Littell’s The Kindly Ones [Les Bienveillantes, 2006], which can make the reader question, through the polyphony of the voice of its protagonist, the notions of narrative voice and readerly empathy, only to reveal that the difficulty involved in empathizing with perpetrator characters lies not so much in the characters’ being perpetrators, but rather in their being literary characters. Eventually, Timár briefly touches upon the problem of the aesthetic and the comic via Nabokov’s Lolita (1955) to ask whether one can avoid some necessarily dehumanizing aspects of humor. (shrink)

This paper addresses the question whether future contingents are knowable, that is, whether one can know that things will go a certain way even though it is possible that things will not go that way. First I will consider a long-established view that implies a negative answer, and draw attention to some endemic problems that affect its credibility. Then I will sketch an alternative line of thought that prompts a positive answer: future contingents are knowable, although our epistemic access of (...) them is limited in some important respects. This paper explores an idea of Stoic descent that is largely neglected nowadays, the idea that an argument is valid when the conditional formed by the conjunction of its premises as antecedent and its conclusion as consequent is true. As it will be argued, once some basic features of our naıve understanding of validity are properly spelled out, and a suitable account of conditionals is adopted, the equivalence between valid arguments and true conditionals makes perfect sense. The account of validity (...) outlined here, which displays one coherent way to articulate the Stoic intuition, accords with standard formal treatments of deductive validity and encompasses an independently grounded characterization of inductive validity. .This paper discusses Aristotle’s thesis and Boethius’ thesis, the most distinctive theorems of connexive logic. Its aim is to show that, although there is something plausible in Aristotle’s thesis and Boethius’ thesis, the intuitions that may be invoked to motivate them are consistent with any account of indicative conditionals that validates a suitably restricted version of them. In particular, these intuitions are consistent with the view that indicative conditionals are adequately formalized as strict conditionals.

It is sometimes argued that certain sentences of natural language fail to express truth conditional contents. Standard examples include e.g. Tipper is ready and Steel is strong enough. In this paper, we provide a novel analysis of truth conditional meaning using the notion of a question under discussion. This account explains why these types of sentences are not, in fact, semantically underdetermined, provides a principled analysis of the process by which natural language sentences can come to have enriched meanings in (...) context, and shows why various alternative views, e.g. so-called Radical Contextualism, Moderate Contextualism, and Semantic Minimalism, are partially right in their respective analyses of the problem, but also all ultimately wrong. Our analysis achieves this result using a standard truth conditional and compositional semantics and without making any assumptions about enriched logical forms, i.e. logical forms containing phonologically null expressions. Earman and Roberts claim that there is neither a persuasive account of the truth-conditions of ceteris paribus laws, nor of how such laws can be confirmed or disconfirmed. I will give an account of the truth conditions of ceteris paribus laws in physics in terms of dispositions. It will meet the objections standardly raised against such an account. Furthermore I will elucidate how ceteris paribus laws can be tested in physics. The essential point is that physics provides methodologies for dealing (...) with disturbing factors. For this reason disturbing factors need not be listed explicitly in law-statements. In virtue of the methodologies it is possible to test how systems would behave if the disturbing factors were absent. I will argue that this suffices to establish the tenability of the dispositional account of ceteris paribus laws. (shrink)

Conventional wisdom holds that the von Neumann entropy corresponds to thermodynamic entropy, but Hemmo and Shenker (2006) have recently argued against this view by attacking von Neumann's (1955) argument. I argue that Hemmo and Shenker's arguments fail due to several misunderstandings: about statistical-mechanical and thermodynamic domains of applicability, about the nature of mixed states, and about the role of approximations in physics. As a result, their arguments fail in all cases: in the single-particle case, the finite particles case, and the (...) infinite particles case. (shrink)

It is often assumed that we are only blameworthy for that over which we have control. In recent years, however, several philosophers have argued that we can be blameworthy for occurrences that appear to be outside our control, such as attitudes, beliefs and omissions. This has prompted the question of why control should be a condition on blameworthiness. This paper aims at defending the control condition by developing a new conception of blameworthiness: To be blameworthy, I argue, is most fundamentally (...) to deserve to feel guilty. Being blamed by someone else is not necessarily harmful to the wrongdoer. The blame might not be expressed, or the wrongdoer might not care. But to blame oneself necessarily involves suffering. This conception of blameworthiness explains why the control condition should obtain: We are morally blameworthy for A only if A was under our control because to be blameworthy is to deserve to feel guilty, to feel guilty is to suffer, and one deserves to suffer for A only if A was under one’s control. The paper suggests that Samuel Taylor Coleridge’s arguments against sympathy after the French Revolution, Walter Benjamin’s claims against empathy following the traumatic shock of Modernity and the First World War, and Hannah Arendt’s critical take on compassion. after the Holocaust are similar responses to singular historical crises. Reconsidering Arendt’s On Revolution (1963) and its evocation of Hermann Melville’s novella Billy Budd (1891), I show first that the novella bears the traces of an essay by Samuel Taylor Coleridge, “The Appeal to (...) Law” (1809). Then, drawing on Walter Benjamin’s writings on trauma in Illuminations (1968, edited by Arendt), I discuss the political importance Arendt attaches to the proper way of telling a story, at a time when “the communicability of experience is decreasing” (Benjamin, Illuminations, 86). Through the analysis of Benjamin’s “The Storyteller” and Arendt’s “heartless” report on the Eichmann trial (1963), I equally show that, according to Arendt, testimonies must be narrated, or rather performed, in a dispassionate, dry, and compact manner so that they can be historically and politically relevant. The article deals with the position of Lutheran theologian Andreas Osiander sen. in the history of philosophy, history of science and philosophy of science. It works on humanistic foundation of Osiander’s thought and his elaboration of the tradition of the antient wisdom and Christian cabbala of Giovanni Pico della Mirandola in particular in the biblical exegesis. The article deals with Osiander’s edition of Nicolaus Copernicus’ book De revolutionibus orbium caelestium as well and with his edition of the mathematical work (...) of Girolamo Cardano. In the context of philosophy of science Osiander’s foreword to Copernicus is analyzed and its role in the controversy between instrumentalism and realism is assessed. Osiander’s instrumentalism is viewed as an anachronism. Finally, the influence of Neoplatonism and Paracelsism in Osiander’s theology is analyzed and judged as too general. (shrink)

This paper articulates in formal terms a crucial distinction concerning future contingents, the distinction between what is true about the future and what is reasonable to believe about the future. Its key idea is that the branching structures that have been used so far to model truth can be employed to define an epistemic property, credibility, which we take to be closely related to knowledge and assertibility, and which is ultimately reducible to probability. As a result, two kinds of claims (...) about future contingents—one concerning truth, the other concerning credibility—can be smoothly handled within a single semantic framework. (shrink)

What is professional integrity and what makes it so important? Policies are designed to promote it and decisions are justified in its name. This paper identifies two competing conceptions of professional integrity and argues that, on their own, both are deficient. In response, this paper develops a third, interpretive view, in which professional integrity is conceived as the virtue of being good on the word of the practice. Professions ask for the public’s trust and in doing so, generate a set (...) of legitimate expectations. Judgments of professional integrity are informed by an interpretation of practice that is sensitive to this normative situation. (shrink)

Do non-human animals have an interest in sociopolitical freedom? Cochrane has recently taken up this important yet largely neglected quest ion. He argues that animal freedom is not a relevant moral concern in itself, because animals have a merely instrumental but not an intrinsic interest in freedom (Cochrane 2009a, 2012). This paper will argue that even if animals have a merely instrumental interest in freedom, animal freedom should nonetheless be an important goal for our relationships with animals. Drawing on recent (...) work on the value of freedom, it will be argued that freedom is non-specifically instrumentally valuable. Accordingly, freedom is a means to other goods, but often it is not possible to identify those goods in advance or aim for them directly. Some of the reasons that make freedom non-specifically valuable for human relationships, it will be argued, also apply to relationships between humans and animals. Amongst other implications, it will be shown how this argument provides a response to those who fear that stricter animal protection policies might undermine people’s freedom: A concern for freedom actually requires stricter protection policies rather than speak against them. This paper claims that there is no such thing as the correct answer to the question of what is logical form: two significantly different notions of logical form are needed to fulfil two major theoretical roles that pertain respectively to logic and semantics. The first part of the paper outlines the thesis that a unique notion of logical form fulfils both roles, and argues that the alleged best candidate for making it true is unsuited for one of the two roles. (...) The second part spells out a considerably different notion which is free from that problem, although it does not fit the other role. As it will be suggested, each of the two notions suits at most one role, so the uniqueness thesis is ungrounded. (shrink)
