Arguments for what consent is often appeal to its functions. For instance, some argue that because consent functions to express the consent-giver’s autonomous control over her normative boundaries, consent must consist in a mental state. In this paper, I argue that consent has an often-overlooked function and that its having this function has consequences for our views of what consent is. I argue that consent has a relationship-shaping function: acts of consent can alter and enable personal relationships. This function grounds (...) an argument for the following claim: some acts of consent cannot be morally transformative unless there is uptake, or acceptance, or cooperation, on the recipient’s part. At least some acts of consent need to be “cosigned” by both parties. This rules out what I call “unilateral” conceptions of consent, according to which consent can always be given by the giver alone and nobody else needs to enter the picture. (shrink)

The paper aims to explain how Paul Ricœur’s phenomenological and hermeneutic approach offers an original theory of the self as self-attestation. Considering useful an approach that combines the psychological uses of the notion of self with a reflection on one’s capacity to design himself/herself as a person, the paper offers a thorough analysis of Ricœur’s work Soi-même comme un autre / Oneself as Another. The main purpose of this analysis is to highlight that, drawing a clear distinction between two forms (...) of identity (la mêmeté/sameness and l’ipséité/selfhood) and proposing a dialectic between the self and the other, Ricœur grounds his theory on a notion of self which includes one’s acceptance of the other. In this chapter we introduce concepts for analyzing proofs, and for analyzing undergraduate and beginning graduate mathematics students’ proving abilities. We discuss how coordination of these two analyses can be used to improve students’ ability to construct proofs. -/- For this purpose, we need a richer framework for keeping track of students’ progress than the everyday one used by mathematicians. We need to know more than that a particular student can, or cannot, prove theorems by induction or contradiction or can, (...) or cannot, prove certain theorems in beginning set theory or analysis. It is more useful to describe a student’s work in terms of a finer-grained framework that includes various smaller abilities that contribute to proving and that can be learned in differing ways and at differing periods of a student’s development. We report on an exploratory study of the way eight mid-level undergraduate mathematics majors read and reflected on four student-generated arguments purported to be proofs of a single theorem. The results suggest that mid-level undergraduates tend to focus on surface features of such arguments and that their ability to determine whether arguments are proofs is very limited -- perhaps more so than either they or their instructors recognize. We begin by discussing arguments (purported proofs) regarded as texts and validations of (...) those arguments, i.e., reflections of individuals checking whether such arguments really are proofs of theorems. We relate the way the mathematics research community views proofs and their validations to ideas from reading comprehension and literary theory. We then give a detailed analysis of the four student-generated arguments and finally analyze the eight students' validations of them. (shrink)

This study focuses on undergraduate students' ability to unpack informally written mathematical statements into the language of predicate calculus. Data were collected between 1989 and 1993 from 61students in six small sections of a “bridge" course designed to introduce proofs and mathematical reasoning. We discuss this data from a perspective that extends the notion of concept image to that of statement image and introduces the notion of proof framework to indicate the top-level logical structure of a proof. For simplified informal (...) calculus statements, just 8.5% of unpacking attempts were successful; for actual statements from calculus texts, this dropped to 5%. We infer that these students would be unable to reliably relate informally stated theorems with the top-level logical structure of their proofs and hence could not be expected to construct proofs or evaluate their validity. In this largely theoretical article, we discuss the relation between a kind of affect, behavioural schemas and aspects of the proving process. We begin with affect as described in the mathematics education literature, but soon narrow our focus to a particular kind of affect – nonemotional cognitive feelings. We then mention the position of feelings in consciousness because that bears on the kind of data about feelings that students can be expected to be able to report. Next we introduce the (...) idea of behavioural schemas as enduring mental structures that link situations to actions, in other words, habits of mind, that appear to drive many mental actions in the proving process. This leads to a discussion of the way feelings can both help cause mental actions and also arise from them. Then we briefly describe a design experiment – a course intended to help advanced undergraduate and beginning graduate mathematics students improve their proving abilities. Finally, drawing on data from the course, along with several interviews, we illustrate how these perspectives on affect and on behavioural schemas appear to explain, and are consistent with, our students’ actions. A contribution to the history of a formerly hotly discussed, but short-lived scientific project: neurophenomenology , the proposal of weaving together Husserlian phenomenology of consciousness and the neuroscience of brain functioning, this article traces back the opening and closing of an apparent window of opportunity, both in phenomenology and in neuroscience, for the eventually unfulfilled realization of that project.

This article presents the results of research conducted with secondary school teachers in Quebec, specifically in the Mauricie region. The authors propose a reflection on the construction of professional identity in a context of institutional crisis. They argue that in this context, the teacher can not rely on stable and social frameworks to build up a strong professional identity and that work experience that becomes the primordial material from which that identity is developed. L'évaluation des écosystèmes est l'un des pivots essentiels pour l'élaboration de moyens adap- tés permettant de lutter contre la diminution massive de la biodiversité. Pour la première fois, elle a fait l'objet d'une analyse à l'échelle mondiale dans le cadre de l'Evaluation des écosys- tèmes en début de millénaire (EM). Le rassemblement de plus d’un millier de chercheurs et de plusieurs organismes internationaux durant quatre années ont permis de dessiner la carte nécessaire à toute action efficace. L'article expose les éléments (...) principaux de l'EM : l'évaluation des écosystèmes en tant que tels, mais surtout des services écosystémiques, dans toutes leurs dimensions, en ce que leur évolution affecte le bien-être humain. Il analyse ensuite les quatre points principaux de l'apport de l'EM, des avantages de l'utilisation croissante des services éco- logiques à sa non viabilité. Des scénarios, modèles et outils sont proposés pour inverser la courbe négative d'appauvrissement de la biodiversité et des services écosystémiques dans un premier bilan des retombées de l'EM. The success of the mission of the school based largely on teachers, it is important to understand exactly how they see their role in the actualization of this mission. So this article initiates a reflection on how secondary school teachers in Quebec think their educational mission. More specifically, we analyze how the educational mission takes shape in their professional practice. La réussite de la mission de l’école reposant en grande partie sur les enseignants, il importe de cerner avec précision comment (...) ces derniers conçoivent leur rôle dans l’actualisation de cette mission. Ainsi cet article amorce une réflexion sur la manière dont les enseignants du secondaire au Québec, pensent leur mission éducative. Abstract: We examine how trustworthy behaviour can be achieved in the financial sector. The task is to ensure that firms are motivated to pursue long-term interests of customers rather than pursuing short-term profits. Firms’ self-interested pursuit of reputation, combined with regulation, is often not sufficient to ensure that this happens. We argue that trustworthy behaviour requires that at least some actors show a concern for the wellbeing of clients, or a respect for imposed standards, and that the behaviour of these (...) actors is copied in such a way that it becomes a behavioural norm. We briefly suggest what such behavioural norms might need to be if trustworthy behaviour is to be achieved, and consider how they might be supported; we describe the research that is necessary in order to understand these norms in more detail. We argue that the norms of traders are different from the norms of those engaged in other activities, since they are inevitably self-interested, and we consider the risk that traders’ norms might undermine those of other actors. We analyse the task for governance in dealing with this problem, and the role which leadership by a corporate board and management might play in doing this. We describe the need for further research in to describe how this might be done. (shrink)

In this paper we will examine the influence digital media has had on political dialogue in the public sphere. We will explore the phenomenon through an example case, namely the global feminist #MeToo movement which started in 2017. Within the framework of the #MeToo Movement, we introduce and examine the challenges digital media poses to the political dialogue in the public sphere. We start by going through concepts and theories utilized in this research paper. Then we will discuss the relationship (...) between digital media and #MeToo, after which we will assess the negative and positive outcomes of the #MeToo movement. Finally, an overall assessment concerning the movement and phenomenon around it is given. Our main argument is that while making the public sphere more inclusive, digital media has also made public debate and political discussion more polarized and antagonistic. (shrink)

In this study we examine how different organizations communicate their commitments to sustainability and corporate social responsibility on their websites, and the different ways stakeholders could interpret this communication. We do this by examining several case studies and reflecting on those cases with the help of a theoretical framework. Our main findings are that there is a growing concern amongst stakeholders regarding environmental values and that unsubstantiated sustainability claims issued in corporate publicity can be interpreted as greenwashing. We identify a (...) conflict between goals of growth versus environmental sustainability in some of the cases. We also discover that organizations appear to be more transparent with their intentions by communicating their environmental values based on firm-serving motives rather than public-serving ones. I draw attention to how Annie Saumont’s “You Should Have Changed at Dol” provides a solution to the paradox. With appropriate background knowledge, Saumont’s story, despite its modern form, displays various convergences with Descartes’ meditations; likewise the Bisa dance may feature convergences with traditional dance.

If Carl Schmitt’s Political Theology (1922) serves as a sort of ‘ground zero’ of political theological questions, at least in the disciplinary framework of political and legal theory, today’s debate has managed to look beyond Schmitt’s analysis of political authority, public law and the prerogatives of sovereign power. Schmitt’s genealogical and analogical methods have thus been redeployed to trace not only the modern concept of power back to Christian theology between the second and the fifth centuries, but to expose a (...) systemic relation between the Trinitarian idea of ‘oikonomia’ and modern forms of biopolitical governance. This chapter contributes to contemporary reflections on economic theology. Drawing on Schmitt’s early attempts to elaborate a concept of ‘neutralization’, it makes the case for a theological-based analysis of ‘neoliberalization’ after the Great Crash of 2008. (shrink)

This essay investigates, via the concepts of the philosophy of orientation, Annie Duke’s decision-making theory in "Thinking in Bets" and scrutinizes as to what extent one can universalize the 'orientation skill' of decision-making with regard to our everyday and professional life.

This is a sequel to our dialogue "Che cosa c'è e che cos'è (2003), focusing on the interplay between what there is and what there could be—between actuality and possibility—from the perspective of Hylas (here: the realist philosopher) and from the perspective of Philonous (here: the conventionalist anti-realist).

Nel primo paragrafo sarà esaminato l’impianto normativo che regola le pubbliche amministrazioni, riformato dalle l. n. 142 e n. 241 del 1990, dal D.Lgs. 29/1993, dalle “leggi Bassanini” e dalla legge-quadro 150/2000, sia riguardo al diritto di accesso nei confronti dell’attività dell’amministrazione, sia in merito al radicamento di criteri di efficacia, efficienza ed economicità delle policies sia agli strumenti con cui gli Enti locali e cittadini possono comunicare. Gli anni ‘90 segnano l’inizio di un processo volto alla riorganizzazione delle PA (...) a partire dalla centralità della comunicazione istituzionale ma anche della concezione del “diritto all’informazione” nelle tre accezioni di diritto “di informare, “di informarsi” e “essere informati”. La Levi ha ben sottolineato “la rapidità inusuale nella storia nazionale” di tale riforma e la centralità assunta in essa dalle dimensioni dell’informazione, della comunicazione e della partecipazione: "In sintesi, si può ritenere legittimo concludere che le riforme del decennio 1990-2000 abbiano segnato il passaggio dal segreto alla trasparenza e dall’unilateralità alla partecipazione. Le politiche di modernizzazione in tema di comunicazione pubblica e di maggiore trasparenza dell’attività dell’amministrazione si sono mosse verso una più marcata tutela dei diritti dei cittadini e verso l’accentuazione del risultato dell’azione amministrativa" (2004, p. 16). Grandi ha ribadito che tale evoluzione costituisce nella cultura politica dello stato di diritto una «sorta di pre-condizione dell’emergere dei nuovi diritti di cittadinanza, intesi quale partecipazione consapevole e informata al processo decisionale pubblico» (Grandi 20022, 13). Nel secondo paragrafo verranno descritte gli ambiti di applicazione, le finalità, gli obiettivi e le strutture della comunicazione istituzionale disciplinate dalla legge n. 150/2000 e dai conseguenti regolamenti attuativi: il Portavoce, l’Ufficio stampa, l’Ufficio per le relazioni al pubblico. Come vedremo, si tratta di una normativa che rappresenta un punto di arrivo e un punto di partenza, in quanto, da un lato, se chiude il decennio delle riforme amministrative, d’altro lato, problematizza compiutamente per la prima volta il rapporto di comunicazione tra PA e cittadini e pone in evidenza tutte le difficoltà nell’implementare le norme nella realtà. Agli elementi critici della comunicazione istituzionale sono riservate le considerazioni conclusive: dal reclutamento e formazione del personale, al coordinamento delle strutture, dal persistere di mentalità burocratiche e autoreferenziale alla carenza di risorse. Il problema delle dotazioni organiche e finanziarie, in particolare, è molto sentito dalle amministrazioni di dimensioni più piccole, le quali spesso ricorrono alla “esternalizzazione” di attività degli uffici di comunicazione, non solo per la produzione editoriale, le campagne pubblicitarie e i servizi di gestione degli eventi, ma anche per il sito internet e i compiti di informazione più tradizionali. In tale situazione, la comunicazione istituzionale, pur dichiarata come strategica, rischia di rimanere un momento residuale dell’azione pubblica sia in termini di processo sia in termini di contenuto, slegata dagli obiettivi dell’organizzazione. L’articolo si propone di chiarire uno dei punti oscuri della biografia di Giordano Bruno. Nel 1571 il Capitolo generale dei Domenicani di Roma lo assegnò come studente formale allo Studio di Andria. Secondo i suoi più importanti biografi, il Nolano non ci sarebbe mai andato. Attraverso l’accurata analisi dei documenti relativi al corso di studi, e il riscontro delle citazioni contenute in alcune opere, l’ipotesi che Bruno abbia soggiornato ad Andria per circa un anno appare, invece, estremamente probabile. The article (...) tries to clarify one of the obscure points of Giordano Bruno’s biography. In 1571 the General Chapter of the Dominicans in Rome assigned him, as a formal student, to the Study of Andria. According to his most important biographers, the Nolan never went there. However, through the careful analysis of the documents relating to his course of studies, and the comparison of the quotations contained in some of his works, the hypothesis that Bruno stayed in Andria for about a year appears extremely probable. This paper responds to Shashi Tharoor’s criticism that “much of Narayan’s prose reads like a translation.” He does not name any writers in another language to back up his claim and without doing so there is an explanation for his impression, but one which leaves it looking misleading.

The article highlights the metaphysical approach that lies beneath Karl Jaspers' conception of history as an unstoppable flow of individual states into a world unity. The analysis is based on a reading of Jaspers' contribution to the Geneva conference of 1946 and his 1949 book "The Origin and Goal of History".

In 1893, three young men in their early twenties, Xavier Léon, Élie Halévy and Léon Brunschvicg, founded the Revue de métaphysique et de morale. This article explores the motives of this endeavour, and how they made the journal the centre of three great scientific enterprises: in 1894 they promoted the edition of Descartes’s Œuvres completes; in 1900, they organized the first international congress of philosophy in Paris; in 1901, they founded the Societé française de philosophie.

Here, however, a puzzle arises: Either doing what we ask is the best God can do or it is not. If it is, then our asking won’t make any difference to whether he does it. If it is not, then our asking won’t make any difference to whether he does it. So, our asking won’t make any difference (...) to whether God does it. Our asking is therefore pointless. Hunger strikes are commonly repressed in prison and seen as disruptive, coercive, and violent. Hunger strikers and their advocates insist that incarcerated persons have a right to hunger strike, which protects them against repression and force-feeding. Physicians and medical ethicists generally ground this right in the right to refuse medical treatment; lawyers and legal scholars derive it from incarcerated persons’ free speech rights. Neither account adequately grounds the right to hunger strike because both misrepresent the hunger strike as noncoercive and (...) nonviolent. I articulate an alternative, dual account of the right to hunger strike. On the remedial argument, the right to hunger strike should be legally protected as a right to petition for redress, in light of incarcerated people’s structural vulnerability to abuse and given inadequate grievance mechanisms. The constructive argument derives the right to hunger strike from the right to resist oppression and stresses the normative permissibility of the use of coercive tactics to defend one’s liberty interests in the face of carceral oppression. -/- . Unlike Derrida’s ‘there is no outside text, Lacan approaches the Real, that which lies beyond language, from two sides: the imaginary and the symbolic. In the first part of this work, by drawing upon the imaginary side of Lacanian Real, which is object petit a and by considering some literary and philosophical definitions of the pre-symbolic abyss, it is attempted to illustrate the non-representation artworks’ illustration of the pre-linguistic bodily urges and sensations. Next, by drawing upon symbolic side of (...) the Lacanian Real, which is sinthome, it will be shown how some artists create their own symbolic order and the New by approximating a point of idiomaticty just like what Lacan did with his mathemes. In the second part of the paper, Joe Weight’s Darkest Hour (2017) is analyzed to show how Winston Churchill first turns into an object petit a, and plugs the gap of the symbolic order by being elected as a prime minister; however, the impending fall of England by Nazi attacks strip Churchill of his self-confidence, then he resorts to people and by their hands, he rewrites himself anew turning himself into a sinthome and like Joyce and Lacan, who have created their own symbolic order, Churchill temporarily turns England into his own symbolic order to win the war. A window broke and Annie was involved. What’s of moral importance in a situation like this? Not whether Annie caused the window to break and not whether the window wouldn’t have broken if it weren’t for Annie. What’s morally important is whether Annie broke the window. In this thesis, I first generalise and argue for that claim; afterwards, I put it to work in ethics, applied ethics, and legal theory.

Alcuni anni fa, ho raggiunto il punto in cui di solito posso dire dal titolo di un libro, o almeno dai titoli dei capitoli, quali tipi di errori filosofici saranno fatti e con quale frequenza. Nel caso di opere nominalmente scientifiche queste possono essere in gran parte limitate a determinati capitoli che sono filosofici o cercanodi trarre conclusioni generali sul significato o sul significato a lungoterminedell'opera. Normalmente però le questioni scientifiche di fatto sono generosamente intrecciate con incomprodellami filosofici su ciò (...) che questi fatti significano. Le chiare distinzioni che Wittgenstein ha descritto circa 80 anni fa tra le questioni scientifiche e le loro descrizioni da parte di vari giochi linguistici sono raramente prese in considerazione, e quindi si è alternativamente stupiti dalla scienza e costerghi per la sua analisi incoerente. Così è con questo volume. Se si vuole creare una mente più o meno come la nostra, è necessario avere una struttura logica per la razionalità e la comprensione dei due sistemi di pensiero (teoria del doppio processo). Se si vuole filosofare su questo, bisogna capire la distinzione tra le questioni scientifiche di fatto e la questione filosofica di come funziona il linguaggio nel contesto in questione, e di come evitare le insidie del riduzionismo e dello scientismo, ma Kurzweil, come la maggior parte degli studenti di comportamento, è in gran parte all'oscuro. Egli è incantato da modelli, teorie e concetti, e dalla voglia di spiegare, mentre Wittgenstein ci ha mostrato che dobbiamo solo descrivere, e che le teorie, i concetti, ecc., sono solo modi di usare il linguaggio (giochi linguistici) che hanno valore solo nella misura in cui hanno un test chiaro (clear truthmakers, o come John Searle (il critico più famoso di AI) ama dire, chiare condizioni di soddisfazione (COS)). Ho cercato di dare un inizio su questo nei miei scritti recenti. Negli ultimi due anni sono stati pubblicati due importanti libri sul progresso morale: 'Moral Progress' di Philp Kitcher e 'A Better Ape' di Victor Kumar e Richmond Campbell. In questa nota critica, recensisco entrambi i libri e problematizzo il modo in cui cercano rispettivamente di legare tra loro il tema del progresso morale con la teoria dell'evoluzione.

All'inizio degli anni '90 nella pubblicistica tedesca emerge la tendenza a decretare la fine politica dell’istituzione partito. Tipicamente, il partito viene presentato come un dinosauro della democrazia ormai incapace di assolvere alle sue funzioni tipiche o come piovra infiltratasi illegittimamente in ogni ambito della vita civile. La tesi di quest’articolo è che, al contrario, i partiti tedeschi abbiano dimostrato una forte reattività alle mutate circostanze nazionali e internazionali e che siano riusciti a mantenere il loro tipico ruolo funzionale di mediatore, (...) rappresentante ed amministratore degli interessi degli elettori. Negli ultimi quindici anni la letteratura filosofico-linguistica ha registrato un rinnovato interesse per i meccanismi di implicatura, specialmente del tipo scalare. In buona parte, l’interesse stato suscitato dall’emergere di una prospettiva grammaticale, secondo la quale i fenomeni di implicatura scalare sarebbero conseguenza di un meccanismo interpretativo incassato nella logica delle lingue naturali, e quindi riferibile al componente semantico dell’architettura cognitiva umana. Inizieremo, (...) con una descrizione del fenomeno di implicatura scalare, sostanzialmente condivisa dai fautori delle diverse prospettive. Quindi, approfondiremo la nostra comprensione del fenomeno, pre- sentando alcuni punti fermi della prospettiva pragmaticista, e mostrandone i punti di debolezza individuati dai fautori della prospettiva grammaticale. Infine, presenteremo la prospettiva grammaticale, presentando da una parte i vantaggi che questo approccio presenta rispetto alla prospettiva pragmaticista, e dall’altra discutendo le sfide che attendono questa nuova prospettiva. It sounds small but actually is proportionally the biggest among all animals on Earth. -/- I became more aware of thinking at around 5th grade upon hearing about an ancient paradox. It (...) can be summarized as follows. -/- ¤ -/- Once upon a time, there was a stupid king. In his kingdom lived a sage who was highly respected for his intelligence. The King did not appreciate this fact. Maybe the Sage made fun of the King’s intellect, but I am not so sure. Anyway, one day, the King summoned the Sage, intending to kill him. -/- The King said, “Wise man, I heard you earn a living by thinking and arguing. Now I give you two options to die.” -/- The Sage said, “Please tell me the choices, Your Majesty.” -/- The King continued, “You live by your tongue, so I will let you say one sentence before you die. If what you say is true, you will die by hanging. If what you say is false, you will die by beheading.” -/- Little did the King know that this was a stupid order. After a short while, the Sage confidently spoke his “last words”, which actually were what saved his life: -/- “Your Majesty, I am about to be beheaded!” -/- ¤ -/- As a “wild animal” going out into life from a young age, my brain spent a lot of time and energy looking for food. But when food is served, the natural world returns to its peaceful, soothing silence. -/- This short book is in its own tidy infosphere, where each little story is also brief and self-contained. Despite this small appearance, I hope the content inside carries the value of tranquility and life observation. The book is petite, but pretty sure not malnourished. A not-too-small detail is that the way the content was shaped and distilled reflects some innovations of mine and my research team: the mindsponge theory, a new theory of serendipity, the bayesvl R package, the BMF analytics, as well as other experiences from working in the field of science. Vi è presentata un’indagine teorica e storica su che cosa sia la possibilità. Da Aristotele a Marx, passando per Averroè, Giordano Bruno e Hegel, lettrici e lettori ripercorreranno le proposte avanzate nella storia della filosofia per affrontare la questione del possibile, fino a scoprire la teoria della possibilità reale. Grazie alla sua particolare (...) struttura, che sviluppa l’argomentazione facendo emergere in ordine di complessità crescente i principali elementi dell’ontologia del non essere ancora, questo testo è una preziosa chiave per orientarsi nella lettura della filosofia di Bloch. The Theosophical Society, founded in New York in 1875, was, at the turn of the Twentieth Century, a global phenomenon with 100,000 members. New Age philosopher Dr Rudolf Steiner (1861-1925) was appointed as the first Secretary General of the German Section of the Theosophical Society on 19 October 1902. The Theosophical Society offered Rudolf Steiner a platform, a ready-made audience, infrastructure, and the insider experience of the world’s leading New Age spiritual society. The success of the Theosophical Society demonstrated that (...) there was a public appetite to hear about reincarnation, karma, maya, kamaloca, and other Eastern and alternative spiritual ideas. The Theosophical Society provided Rudolf Steiner a capable, multilingual, and determined personal assistant, Marie von Sivers (1867-1948). For Rudolf Steiner the Theosophical Society offered the perfect training ground for what would be, a decade later, his life’s work, the Anthroposophical Society. Rudolf Steiner grew the membership of the German Section of the Theosophical Society from 377 in 1905 to 3,702 in 1913. He earned cash from ticketing of his lectures and his Mystery plays, and from book sales of his personal publishing house, ‘Philosophisch-Theosophischer Verlag’. Another enterprise, the ‘Johannes-Bau-Verein’ (Johannes Building Association) was founded in 1911, independent of the Theosophical Society, to build a theatre in Munich to present Rudolf Steiner's plays. The building application was rejected by the Munich municipal authorities in 1912. The resistance to a build in Munich, provided impetus for the move to build in Dornach, Switzerland. The Anthroposophical Society was founded 28 December 1912 in Cologne, Germany. Most of the members of the German Section of the Theosophical Society members followed Rudolf Steiner into the Anthroposophical Society. The Theosophical Society expelled Rudolf Steiner from the Theosophical Society on 7 March 1913. The foundation stone for the Goetheanum (then still called the ‘Johannesbau’) was laid 20 September 1913. The Theosophical Society had served as the ideal prototype and springboard for founding and growing the Anthroposophical Society. (shrink)

The coronavirus disease 2019 (COVID-19) crisis ought to serve as a reminder about the costs of failure to consider another long-term risk, climate change. For this reason, it is imperative to consider the merits of policies that may help to limit climate damages. This essay rebuts three common objections to carbon taxes: (1) that they do not change behaviour, (2) that they generate unfair burdens and increase inequality, and (3) that fundamental, systemic change is needed instead of carbon taxes. The (...) responses are (1) that there is both theoretical and empirical reason to think that carbon taxes do change behaviour, with larger taxes changing it to a greater extent; (2) that undistributed carbon taxes are regressive but distributing the tax receipts can alleviate that regressivity (and, in many cases, make the overall effect progressive); and (3) that while small changes for increasing democratic decision-making may be helpful, (fundamental) change takes time and the climate crisis requires urgent action. What responsibilities do audiences have in engaging with artworks? Certain audience responses seem quite clear: for example, audiences should not vandalize or destroy artworks; they should not disrupt performances. This paper examines other kinds of resisting responses that audiences sometimes engage in, including petitioning the artist to change their works, altering copies of artworks, and creating new artworks in another artist’s fictional world. I argue for five claims: (1) while these actions can sometimes infringe on the rights of artists, the (...) rights of artists are not absolute; (2) the fact that such actions are based on mistaken interpretations of the artworks has no normative weight; (3) there can be reason to object to additions and alterations whose conception of the artwork is morally worse than the original (and so, there can be reason to support additions and alterations whose conception is morally better); (4) petitioning raises special moral problems; and, most important, (5) some of these actions are valuable because they involve creative and aesthetic activity. Those acts of audience resistance that are creative, morally improve on the original work, and that minimize the infringement of the artists’ rights are good, and should be encouraged. (shrink)

Solar radiation management (SRM) may help to reduce the negative outcomes of climate change by minimising or reversing global warming. However, many express the worry that SRM may pose a moral hazard, i.e., that information about SRM may lead to a reduction in climate change mitigation efforts. In this paper, we report a large-scale preregistered, money-incentivised, online experiment with a representative US sample (N = 2284). We compare actual behaviour (donations to climate change charities and clicks on climate change petition (...) links) as well as stated preferences (support for a carbon tax and self-reported intentions to reduce emissions) between participants who receive information about SRM with two control groups (a salience control that includes information about climate change generally and a content control that includes information about a different topic). Behavioural choices are made with an earned real-money endowment, and stated preference responses are incentivised via the Bayesian Truth Serum. We fail to find a significant impact of receiving information about SRM and, based on equivalence tests, we provide evidence in favour of the absence of a meaningfully large effect. Our results thus provide evidence for the claim that there is no detectable moral hazard with respect to SRM. [Open access]. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

L’objection la plus ancienne et la plus redoutable à la démocratie fait valoir que le gouvernement par le peuple dessert le gouvernement pour le peuple. Les citoyens manquant pour la plupart de sagesse ou de compétence, le bien commun serait mieux assuré en confiant le pouvoir à un individu éclairé ou à une élite experte. Une réponse commune à cette objection concède la prémisse mais affirme la priorité au gouvernement par le peuple sur le gouvernement pour le peuple : le (...) droit égal à la participation devrait l’emporter sur la promotion de la compétence, même si celle-ci est requise par le bon gouvernement. La démocratie se trouve alors réduite à un ensemble de procédures équitables, traitant les citoyens en égaux ; elle ne se définit plus par la poursuite du bien commun. Il est toutefois une autre réponse à l’objection, qui évite cette dérive vers un procéduralisme étroit. Elle consiste à nier la prémisse et à affirmer la sagesse politique du peuple. Il n’est pas vrai que le gouvernement pour le peuple serait mieux assuré en confiant le pouvoir à un petit nombre de sages ou d’experts, fussent-ils les meilleurs parmi les citoyens. Cette thèse remarquable peut paraître improbable. Sa défense peut pourtant s’appuyer sur l’un des arguments les plus intrigants élaborés par la philosophie politique aristotélicienne, qui inspire et éclaire les controverses philosophiques contemporaines sur la valeur du régime démocratique : l’argument de la sagesse de la multitude. [ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. La biologie synthétique vise à réduire les organismes vivants à leurs formes les plus simples en identifiant les composants minimaux d'une cellule et à créer de nouvelles formes de vie grâce à la reprogrammation génétique, à l'assemblage de biobriques ou à des protéines nouvelles. La notion de fonction, essentielle en biologie synthétique, est également difficile à définir. L'article met en évidence la nécessité de prendre en compte l'ensemble minimal de fonctions qui caractérisent la vie avant de déterminer les plus petits génomes qui codent ces fonctions. La nature arbitraire de la définition de la vie et de la fonction complique la compréhension et la classification de ces entités. L'article suggère que la dichotomie traditionnelle entre le vivant et le non-vivant pourrait ne plus être valable et que le concept même de vie ne nécessite pas une définition scientifique précise. À mesure que la biologie synthétique progresse, l'article souligne l'importance de redéfinir ou de construire de nouvelles catégories pour englober les possibilités et créations croissantes dans le domaine.
