  1. Virtue in Business: Morally Better, Praiseworthy, Trustworthy, and More Satisfying.E. T. Cokely & A. Feltz - forthcoming - Journal of Organizational Moral Psychology.
In four experiments, we offer evidence that virtues are often judged as uniquely important for some business practices (e.g., hospital management and medical error investigation). Overall, actions done only from virtue (either by organizations or individuals) were judged to feel better, to be more praiseworthy, to be more morally right, and to be associated with more trustworthy leadership and greater personal life satisfaction compared to actions done only to produce the best consequences or to follow the correct moral rule. These (...)

Understanding the folk notion of free will and moral responsibility is important for a host of applied and theoretical issues in psychology, philosophy, and ethics. The bulk of experimental research has focused on folk intuitions concerning determinism's relation to free will and moral responsibility. However, determinism is a difficult term for many folk to understand. Accordingly researchers often use comprehension questions to identify and exclude large proportions of participants who seem to struggle with relevant concepts. Here, we document some of (...)

Although it makes some progress, McKay & Dennett's (M&D's) proposal is limited because (1) the argument for adaptive misbelief is not new, (2) arguments overextend the evidence provided, and (3) the alleged sufficient conditions are not as prohibitive as suggested. We offer alternative perspectives and evidence, including individual differences research, indicating that adaptive misbeliefs are likely much more widespread than implied.

Hans Kelsen e o reconhecimento internacional das constituições nacionais.Rubin Souza - manuscript

This article focuses on issues relating to legal normativity, emphasizing the way these matters have been elaborated in the works of Kelsen and Hart and later commentators on their theories. First, in Section 2, the author offers a view regarding the nature of law and legal normativity focusing on Kelsen's work (at least one reasonable reading of it). The argument is that the Basic Norm is presupposed when a citizen chooses to read the actions of legal officials in (...)

If reification is the projection of a false, thing-like appearance onto society, what is de-reifying critique supposed to reveal? After distinguishing between versions of reification based on a social ontology of will from those that think of the social as a normatively constituted domain, I argue that Lukács’ work on reification fudges this distinction through his account of class. I then turn to the debate between Schmitt and Kelsen, where the will-versus-norm issue is central. I argue that the consonance (...)

This essay examines an ambiguity in Hans Kelsen’s theory of a norm. On the one hand, Kelsen claims to adhere to what he considers the ‘is/ought’ dichotomy. Kelsen claims that he is describing what really is. On the other hand, Kelsen seems to be understanding the is/ought dichotomy in a very different manner than that by which his contemporaries or, indeed, today’s readers understand the distinction. The clue to this ambiguity is Kelsen’s understanding of a (...)

Following Kelsen’s influential theory of law, the concept of validity has been used in the literature to refer to different properties of law (such as existence, membership, bindingness, and more), and so it is inherently ambiguous. More importantly, Kelsen’s equivalence between the existence and the validity of law prevents us from accounting satisfactorily for relevant aspects of our current legal practices, such as the phenomenon of “unlawful law.” This chapter addresses this ambiguity to argue that the most important (...)

I agree with the commentators who urge that more must be done to analyze the nature of normativity in general, and legal normativity in particular.

Each approach has associated justice with the foundation of the legal structure of rules, principles and the like.

What is positivism in legal analysis?Damian Wayne Williams - forthcoming - Forthcoming.
Legal positivism emerged in response to natural law, as an indictment on the latter’s metaphysical predilections. Natural law dominance created a yearning for empiricism, or even a ‘hard scientism’ in approach to understanding socially constructed phenomenon, including legal praxis. From its Benthamite origins, it has since been developed, with recent, spirited debate still undertaken among towering legal scholars. Although its validity is contested to some, it remains as an analytic point of view of the law. Yet, within its design, there (...)

  48. Democratic Constitutional Change: Assessing Institutional Possibilities.Christopher Zurn - 2016 - In Thomas Bustamante and Bernardo Gonçalves Fernandes (ed.), Democratizing Constitutional Law: Perspectives on Legal Theory and the Legitimacy of Constitutionalism. pp. 185-212.
This paper develops a normative framework for both conceptualizing and assessing various institutional possibilities for democratic modes of constitutional change, with special attention to the recent ferment of constitutional experimentation. The paper’s basic methodological orientation is interdisciplinary, combining research in comparative constitutionalism, political science and normative political philosophy. In particular, it employs a form of normative reconstruction: attempting to glean out of recent institutional innovations the deep political ideals such institutions embody or attempt to realize. Starting from the assumption that (...)
