This article discusses Ibn Sīnā’s reasons for upholding the eternity of the world in his major philosophical writings and the ensuing heated debate between his detractors (al-Ghazālī, al-Shahrastānī and al-Rāzī) and supporters (al-Ṭūsī and al-Āmidī). I argue that notwithstanding the responses and surrejoinders it had elicited, Ibn Sīnā’s position on the issue is indeed coherent and irrefutable, since he distinguishes three modes of eternity, corresponding to the hierarchy of beings which he introduced, namely, (i) absolutely eternal (by virtue of (...) itself); (ii) relatively eternal (by virtue of something else); and (iii) not eternal both considered per se as well per aliud. With this distinction he evades both horns of the dilemma: either the universe is eternal or it is not eternal. On Ibn Sīnā’s account, therefore, the universe is both eternal and not eternal. It is eternal because the efficient cause that necessitates and sustains its existence is eternal, but also not eternal in view of its essential contingency. (shrink)

The recent trend among many philosophers of religion has been to interpret divine eternity as an everlasting temporality in which an omnitemporal God exists in and throughout the whole of time. This is in contrast to the classical account of divine eternity as atemporal, immutable existence. In this paper, Aquinas' use of Boethius's definition of eternity as “the whole, perfect, and simultaneous possession of endless life” is analyzed and explained in contradistinction to Aristotle's definition of time. This analysis is then (...) used to respond to Nicholas Wolterstroff's argument in "God Everlasting" that God's knowledge of temporal events infects God with temporality and mutability. The argument concludes by introducing an important distinction between absolute simultaneity and temporal simultaneity, which allows us to hold God is omniscient because he is absolutely simultaneous with all events but is not temporally simultaneous with any event. Moreover, arguments are presented showing the simultaneous emotional nature of the Universe. A solution to the paradox of semi-finite spacetime existents, possessing finite and infinite substances simultaneously, namely eternal existents like moral values and logical validity, is obtained. Inflationary cosmology has been widely accepted due to its successful predictions: for a “generic” initial state, inflation produces a homogeneous, flat, bubble with an appropriate spectrum of density perturbations. However, the discovery that inflation is “generically eternal,” leading to a vast multiverse of inflationary bubbles with different low-energy physics, threatens to undermine this account. There is a “predictability crisis” in eternal inflation, because extracting predictions apparently requires a well-defined measure over the multiverse. This has led to discussions of (...) anthropic predictions based on a measure over the multiverse, and an assumption that we are typical observers. I will give a pessimistic assessment of attempts to make predictions in this sense, emphasizing in particular problems that arise even if a unique measure can be found. (shrink)

It is known that the Big Bang theory was based on the concept of creation ex nihilo, after ancient Greek philosophers. In this paper, we will make few remark on the concept of creatio ex nihilo (as a commentary to a recent paper by Kalachanis, Athanasios Anastasiou, Ioannis Kostikas, Efstratios Theodossious and Мilan S. Dimitrijevi), as well as two other approaches, i.e. Intelligent Design and Emergence Theory by Clayton/Yong. As continuation of our recent paper to appear in forthcoming issue of (...) J. Asia Mathematika, we argue that beside the above three approaches, a new concept called creatio ex-rotatione offers a resolution to the long standing disputes between beginning and eternity of the Universe. In other words, in this respect we agree with Vaas, i.e. it can be shown: “how a conceptual and perhaps physical solution of the temporal aspect of Immanuel Kant’s „first antinomy of pure reason“ is possible, i.e. how our universe in some respect could have both a beginning and an eternal existence. Therefore, paradoxically, there might have been a time before time or a beginning of time in time.” By the help of computational simulation, we also show how a model of early Universe with rotation can fit this new picture. This is one of the best popular cosmology books ever written and Guth is now (2016) a top physics Professor at MIT. He tells the extremely complex story of inflation and related areas of particle physics in such an absorbing style that it reads like a detective novel-in fact, it is a detective novel-how he and others found out how the universe started! The interweaving of his personal story and that of many colleagues along with their photos and many (...) wonderfully clear diagrams allows just the right amount of relaxation from the intensity of the physics. In places the style reminds one of Watson´s famous book ``The Double Helix``. He tells how his work on magnetic monopoles and spontaneous symmetry breaking led to the discovery of the inflationary theory of the very early universe (ca. 10 to minus 35 seconds!). -/- Along the way you will learn many gems that should stay with you a long time such as: the observed universe(e.g., everything the Hubble telescope etc. can see out to ca. 15 billion light years when the universe began) is likely just a vanishingly tiny part of the entire inhomogeneous universe which is about 10 to the 23rd times larger; the big bang probably took place simultaneously and homogeneously in our observed universe; there probably have been and will continue to be an infinite number of big bangs in an infinite number of universes for an infinite time; when a bang happens, everything(space, time, all the elements) from the previous universe are destroyed; the stretching of space can happen at speeds much greater than the speed of light; our entire observed universe lies in a single bubble out of an endless number so there may be trillions of trillions just in our own entire(pocket) universe(and there may be an endless number of such); none of these infinite number of universes interact-i.e., we can never find out anything about the others; each universe started with its own big bang and will eventually collapse to create a new big bang; all this implies that the whole universe is fractal in nature and thus infinitely regresses to ever more universes(which can lead one to thinking of it as a giant hologram); disagreements between the endless(hundreds at least) variations of inflation are sometimes due to lack of awareness that different definitions of time are being used; some theories suggest that there was a first big bang but we can never find out what happened before it; nevertheless it appears increasingly plausible that there was no beginning but rather an eternal cycle of the destruction and creation, each being the beginning of spacetime for that universe; to start a universe you need about 25g of matter in a 10 to minus 26cm diameter sphere with a false vacuum and a singularity(white hole). -/- He deliberately spends little time on the endless variants of inflation such as chaotic, expanded and supernatural inflation or on dark matter´, supersymmetry and string theory, though they were well known at the time as you can find by reading other books such as Michio Kaku´s `Hyperspace` (see my review) and countless others. Many philosophers have argued that the past must be finite in duration because otherwise reaching the present moment would have involved something impossible, namely, the sequential occurrence of an actual infinity of events. In reply, some philosophers have objected that there can be nothing amiss in such an occurrence, since actually infinite sequences are ‘traversed’ all the time in nature, for example, whenever an object moves from one location in space to another. This essay focuses on one of the two (...) available replies to this objection, namely, the claim that actual infinities are not traversed in nature because space, time, and other continuous wholes divide into parts only in so far as we divide them in thought, and thus divide into only a finite number of parts. I grant that this reply succeeds in blunting the anti-finitist objection, but I argue that it also subverts the very argument against an eternal past that it was intended to save. (shrink)

This paper considers two problems -- one in philosophy of religion and another in philosophy of physics -- and shows that the two problems have one solution. Some Christian philosophers have endorsed the views that (i) there was a first finitely long period of time, (ii) God is in time, and yet (iii) God did not have a beginning. If there was a first finitely long period of time and God is in time then there was a first finitely long (...) period of time in God's life. But if God's life includes a first finitely long period of time, then, on one initially intuitive conception of beginning to exist, God began to exist. Thus, at first glance, (i)-(iii) are not mutually compatible. Meanwhile, on a variety of proposals for quantum gravity theories or interpretations of quantum theory, space-time is not fundamental to physical reality and instead can (somehow) be explained in terms of yet more fundamental physical substructures. As I show, there is a strong intuition that if space-time is not fundamental to physical reality, then, even if there were a first finitely long period in the life of physical reality, physical reality would be beginningless. Thus, both theistic philosophers and philosophers of physics have developed theories on which some beginningless entities have a first finitely long temporal period in their lives and so both groups should be interested in developing criteria that distinguish such entities from entities with a beginning. In this paper, I offer one necessary (but not sufficient) condition, namely, that entities that begin to exist are absent from the closest possible worlds without time. The view that I defend has one significant upshot: no sound argument can use the mere fact (if it is a fact) that past time is finite to reach the conclusion that the totality of physical reality had a beginning. The problem of surviving the end of the observable universe may seem very remote, but there are several reasons it may be important now: a) we may need to define soon the final goals of runaway space colonization and of superintelligent AI, b) the possibility of the solution will prove the plausibility of indefinite life extension, and с) the understanding of risks of the universe’s end will help us to escape dangers like artificial false vacuum decay. A possible (...) solution depends on the type of the universe’s ending that may be expected: very slow heat death or some abrupt end, like a Big Rip or Big Crunch. We have reviewed the literature and identified several possible ways of survival the end of the universe, and also suggest several new ones. There are seven main approaches to escape the end of the universe: use the energy of the catastrophic process for computations, move to a parallel world, prevent the end, survive the end, manipulate time, avoid the problem entirely or find some meta-level solution. The strings of physics’ string theory are the binary digits of 1 and 0 used in computers and electronics. The digits are constantly switching between their representations of the “on” and “off” states. This switching is usually referred to as a flow or current. Currents in the two 2-dimensional programs called Mobius loops are connected into a four-dimensional figure-8 Klein bottle by the infinitely-long irrational and transcendental numbers. Such an infinite connection translates - via bosons being ultimately composed of 1’s (...) and 0’s depicting pi, e, √2 etc.; and fermions being given mass by bosons interacting in matter particles’ “wave packets” – into an infinite number of 8-Kleins. Each Klein 1) is one of the universe’s subuniverses (our own is 13.7 billion years old), 2) is made flexible through its binary digits which seamlessly, or almost seamlessly, join it to surrounding subuniverses and eliminate its central hole, and 3) possesses warped time and space because its foundation is the programmed curves in its mathematical Mobius loops (along with the twists they generate [p.7]). The universe functions according to the rules of fractal geometry. So the Mobius does not exist only at the cosmic level. It also manifests at the quantum scale, giving us photons and protons etc. Space and time are no longer separate, but are an indivisible space-time. So if space and the universe are infinite, how can time not be eternal? The past and the future must both extend forever (the idea of time being finite arises from confusion of our subuniverse with the one infinite universe). -/- BITS (Binary digiTS) only suggest existence of the divine if time is linear. Although a non-supernatural God is proposed via the inverse-square law coupled with eternal quantum entanglement, Einstein taught us that time is warped. Warped time is nonlinear, making it at least possible that the BITS composing space-time and all particles originate from the computer science of humans. -/- I suspect many readers will be content with reading this abstract. While there are more details, and mathematics, in the content; my natural style of writing is to avoid jargon and maths. I also tend to get philosophical. While I personally feel that there’s a lot of precious information in the content, I realize it won’t all be to everyone’s liking. intro to Part 1 - -/- Most people disliked mathematics when they were at school and they were absolutely correct to do so. This is because maths as we know it is severely incomplete. No matter how elaborated and complicated mathematical equations become, in today's world they're based on 1+1=2. This certainly conforms to the world our physical senses perceive and to the world scientific instruments detect. It has been of immeasurable value to all knowledge throughout history and has elevated (...) science to the lofty status it enjoys. Science is now striving towards Unification - where the subatomic realm, all matter, energy, forces, space and time will be seen as entangled parts of one universe. While 1+1=2 has been vital in getting humanity to this point, it's time to suppress our attachments to the past and realize that whereas 1+1 will always equal 2, it's also capable of equalling the 1 which represents unification. -/- intro to Part 2 -/- b) Division by zero is accepted, in Newtonian maths, to be impossible. But we can regard division by zero as division by nothing i.e. division that has no effect. In this case, 1 divided by 0 is 1. However, to a physicist there is no such thing as nothing (even empty space contains energy). What could the something called 0 actually be? It could be a binary digit. If we use the base of ten (for simplicity) and attach one and zero to it as exponents, we get 10^1 divided by 10^0 = 10^1. If we then cancel 10 from each factor in the expression, we get 1 divided by 0 = 1. At the start of the paragraph, this was referred to as division by nothing. Then 0 was called a binary digit and division by nothing became division by something. The 1 that the division equals is the unified field of space-time. Division by 0 is impossible in Newtonian maths because the result can be infinity. But the word “infinity” can, as the last section of this book shows, apply to the unified field of spacetime. So division by zero is not impossible because it results in the universe, which is obviously possible … a possibility that has always been, and always will be, realized. -/- intro to Part 3 -/- If quantum entanglement has existed in the entire universe forever, everything would be everywhere and everywhen. Space, time and 5th-dimensional hyperspace would not be restricted to certain parts of the Mobius Universe but would exist in every particle. Past, present and future would not exist as the distinct periods which everyday life assumes. All instants of all periods would exist eternally, permitting time travel to any point in the past and to any point in the future. Entanglement may be created by simply zipping along at close to the speed of light - “Quantum entanglement of moving bodies” by Robert M. Gingrich and Christoph Adami in Physical Review Letters 89, 270402 (issue of 30 December 2002) – which might be achieved, according to this book, by warping space so it’s either a fraction of the 90 degrees allowing instantaneous travel or almost at 270 degrees to space as we know it. One of the common claims of the eternalists is that the "actual" infinite is possible and the universe is eternal. They are trying to refute the Kalam argument. What I wanted to show in this paper is that the "actual" infinite is impossible for logical reasons, and I have shown further that infinity has an effect and application over time, and that there is no way to deny the beginning of the universe for existence. A new series entitled Oxford Philosophical Concepts (OPC) made its debut in November 2014. As the series’ Editor Christia Mercer notes, this series is an attempt to respond to the call for and the tendency of many philosophers to invigorate the discipline. To that end each volume will rethink a central concept in the history of philosophy, e.g. efficient causation, health, evil, eternity, etc. “Each OPC volume is a history of its concept in that it tells a story about changing (...) solutions to specific philosophical problems” (xiii). The series presents itself as innovative along three main lines: its reexamination of the so-called “canon,” its reconsidering the value of interdisciplinary exchanges, and its encouraging philosophers to move beyond the current borders of philosophy. By engaging with non-Western traditions and carefully considering topics and materials which are not strictly philosophical, the collections from this series aim to render the history of philosophy accessible to a wide audience. -/- The first OPC volume to appear in print is “Efficient Causation – A History” edited by Tad Schmaltz. Using careful historical and philosophical analysis as well as interdisciplinary reflections this anthology proposes to tell the story of how efficient causation, equated nowadays with “causation” tout court, came to play its prominent role in our philosophical and scientific vocabulary. Eleven contributions cover the period from Ancient times (Aristotle and the Stoics), through the Middle Ages (both the Western and the Islamic traditions), passing through the Early Modern times (represented here by Descartes, Spinoza, Leibniz, Malebranche, Berkeley and Hume), all the way to Kant and finally contemporary philosophers (classified into two opposing camps: Humean and Neo-Aristotelian). Transnational, global trades, investments, and travels, amongst other drivers of globalization, helps to reverberate the deadly coronavirus pandemic from Wuhan, China, across the world like whirl fire. In order to contain the infectious spread of the pandemic, and mitigate its negative effects on macro-economic variables, the World Health Organization, (WHO) designed Covid-19 protocols that are being enforced by governments and people of the world. Based on the above account, the study examined the Second wave effect of Covid’19 pandemic on transportation (...) business: Keke-napep and Motorcycle transport systems in Asaba metropolis, Nigeria. The main objective is to empirically determine the real impact of the pandemic on rural land transport business. The study employed structured questionnaire and interview methods to generate data from the 250 respondents selected using the census sampling technique. Out of the 250 sets of questionnaires administered, 235 (94%) were retrieved while 15 (6%) were rejected. The statistical tools used for analyzing data were correlation and multiple regression techniques. Findings were that covid’19 pandemic negatively affected rural land transport business. The study concludes that, the coronavirus pandemic caused a contraction in transport business. It is therefore recommended that, there is a need for government to relax the stringent covid’19 protocols to allow economic activities to resume again. Campaigns on safety and hygiene should be intensified so that the populace will imbibe the culture of general cleanliness and personal hygiene, amongst others. (shrink)

This article would appeal to people interested in new ideas in sciences like physics, astronomy and mathematics that are not presented in a formal manner. -/- Biologists would also find the paragraphs about evolution interesting. I was afraid they'd think my ideas were a bit "out there". But I sent a short email about them last year to a London biologist who wrote an article for the journal Nature. She replied that it was "very interesting". -/- The world is fascinated (...) by electronics. Computer scientists, as well as computer buyers, would be intrigued by the fundamental role given to human electronics in creation of the universe. This obviously can only be done if time travel to the past is possible. I explain in scientific terms how it could be done (the world is also fascinated by the prospect of time travel). -/- My ideas on trips through time grew from the related topic of interstellar, and even intergalactic, travel (and those ideas are inspired by an electrical-engineering experiment at Yale University in 2009). After the ideas on time travel came the realization that this technology could be used to totally eliminate the problems of muscle and bone weakness, radiation exposure etc associated with a lengthy journey to Mars. -/- The exquisitely ordered cosmos proposed would have great appeal to religion and philosophy. Dealing as it does with time that does not exclusively operate in a straight line, the book could not only present a new view of evolution (present theory assumes time is always a straight line from past to future). Nonlinear time might also give religionists a new concept of who God is. This could possibly be that of humans from the remote future who are quantum entangled with all past, present and future states of the whole - infinite and eternal - universe; and thus have all God's powers. Such infinite power could be pantheistic but would naturally include the ability to manifest as an individual. (I know this article is very far removed from what is traditionally considered scientific. Just remember: science is the search for knowledge of how this universe works, and that search must be pursued wherever it leads - even if it leads into traditionally nonscientific areas such as religion.) -/- Finally - if we're entangled with the whole universe, we'd have to be entangled with each other. On a mundane level, this gives us extrasensory and telekinetic abilities. My article began as a very short 250 words inspired by astrophysicist Jeff Hester's (pro-evolution) pages on entropy (Astronomy magazine - Oct. and Nov. 2017 - http://www.astronomy.com/magazine/jeff-hester/2017/09/entropys-rainbow and http://www.astronomy.com/magazine/jeff-hester/2017/10/entropy-redux). The letter I wrote pointed out evolution's pluses (eg adaptations) and minuses (regarding origins). It went on to speak of a human, scientific, entirely natural explanation for what is called God. It proposes that the true human condition after death and before birth is as a member of the Elohim - a (...) name used for God in the Old Testament which, according to World Book Encyclopedia, means the PLURAL MAJESTY OF THE ONE GOD. This led to a few hundred more words about why some people call an entirely natural process "supernatural". I speculate that it must be because of the applications in thousands of years of finding a successful theory of quantum gravity (union of quantum mechanics and Einstein's theory of gravity - general relativity). Like quantum mechanics and gravitation, those apps would include all space and all time, and would undoubtedly be as mysterious to us as our technology would initially be to the builders of Egypt's first pyramids. In years past, the denial of divine beings by science may have been logical. But times sometimes change radically. This is an essay I entered in a competition about the Bhagavad Gita. Probably written about 2,000 years ago; this writing is perhaps the greatest philosophical expression of Hinduism. I was attracted to the contest because the website included a very favourable comment about the Bhagavad Gita by Albert Einstein (see below). For a while, I actually considered it possible that I’d win the contest. But that time has passed. The winner has been announced and I can now see my (...) entry for what it is – a naïve attempt to preach science to the religionists, as well as a naïve attempt to preach religion to the scientists. -/- There’s a statement in the essay which I’m wondering about. I said, “However, the concept of possessing a soul is not automatically supported. The idea of having a reincarnating soul would be an easy way of explaining immortality thousands of years ago when people were completely unfamiliar with the scientific facts of an eternal universe, Einstein’s Unified Field, and fractal geometry.” I still think this might be correct. But “might” is the word. I’m wondering about something I later wrote – could the ghostly immaterial body described below be what we call the soul? If such a body is developed in the future to overcome present limitations, could it be referred to as a soul if it travels into the past and is absorbed into a physical body? (It might be what the Bhagavad Gita refers to as the Supersoul, and might be quantum entangled with all space and all time. And if the physical brain is receptive to this so-called entangled soul’s knowledge of everything in space and time, the presently accepted limits to acquiring knowledge would, to use the below quote of Einstein’s, be “superfluous”). The preceding agrees with Zen Buddhism's idea of intuitively getting in touch with your inner self. -/- From “Physics and Philosophy Beyond the Standard Model” (http://vixra.org/abs/1411.0585) – “In 1925, the Austrian physicist Wolfgang Pauli discovered the exclusion principle. This says two similar particles cannot have both the same position and velocity. If two electrons could have identical positions and velocities, they could all collapse into a roughly uniform, dense “soup”. Protons and neutrons would do the same, and there would be no well-defined atoms. So we need the exclusion principle. Force-carrying particles like photons and gravitons do not obey the exclusion principle so we might assume the immaterial body wouldn’t be well-defined and would collapse into a ghostly soup. But perhaps a well-defined structure can be built if the photons are first stopped. The potential for photons to possess mass by having their digital sequence altered and being converted to other particles – or the potential for programming the photons - may make this definition possible. A chrononaut whose body is defined by mass would still have a gravitational effect, and be dark matter. But if she or he would rather not be a lump of dark matter, her or his body might be defined by programming photons and gravitons; creating a body of “light matter”. “Free will” puzzles are failed attempts to make freedom fit into forms of science. The failures seem puzzling because of widespread beliefs that forms of science describe and control everything. Errors in such beliefs are shown by reconstruction of forms of “platonic science” that were invented in ancient Greece and that have developed into modern physics. Like platonic Ideas, modern Laws of Physics are said to exercise hegemonic control through eternal, universal principles. Symmetries, rigidity and continuity are imposed through (...) linear forms that have been abstracted from geometry and indifference. Static and quasi-static forms presume placid equilibrium conditions and relaxation processes. Such forms, based on empty space, fail to describe actual material transformations that occur during the making of steel or the generation of snowflakes. They also fail to describe muscular movements and related bodily feelings of persons and animals that have actual life. Limitations of platonic science are overcome by means of new forms with the character of time, such as “beats” and saccadic, jumpy forms. New technologies of action and freedom generate and control temporal forms in proposed device models of brains and muscles. Some temporal forms have critical moments of transformation, resembling moments when persons exercise freedom, e.g., a moment of overtaking during a footrace or a moment of decision by a jury during a civil trial. It is not by thinking that we create worlds. It is by understanding the world that we learn to think. Cosmovision is a term that should mean a set of foundations from which emerges a systemic understanding of the Universe, its components as life, the world we live in, nature, human phenomena, and their relationships. It is, therefore, a field of analytical philosophy fed by the sciences, whose objective is this aggregated and epistemologically sustainable knowledge about everything that we (...) are and contain, that surrounds us, and that relates to us in any way. It is something as old as human thought, and, in addition to using elements of scientific cosmology, it encompasses everything in philosophy and science that refers to the universe and life. A cosmovision is not a set of ideas, hypotheses, and assumptions but a system based on observation, analysis, evidence, and demonstration. No cosmovision intends to define, establish, or propose but only to understand, analyse, and interpret. Each of us builds and transports his cosmovision throughout life, without establishing forms, as a background for our thinking and behaviour. Linguistically, the term “cosmovision” would derive from the German, equivalent to the concept of “ Weltanschauung,” as used by several philosophers. However, this linguistic relationship is not applicable because it contradicts what we propose as a cosmovision. This German word refers to a pre-logical or proto- experimental vision of reality, with an intuitive context and far from critical knowledge still non-existent at the time of its formulation. Undoubtedly, cosmovisions, in the sense in which we understand them, house and use these proto-experimental or pre-logical elements that include history, the collective unconscious, and all the archetypes we carry. However, in the concept that we apply here, the cosmovision goes far beyond this content, firstly by constantly submitting it to present critical thinking, and finally by making the analytic experience ( and not the thought itself or intuition) its actual universe. António Lopes expose the breadth of this content: -/- "Cosmovisions are not the product of thought. They do not spring from the simple desire to know. The apprehension of reality is an important moment in its configuration, but, nevertheless, it is only one. When this article was first planned, writing was going to be exclusively about two things - the origin of life and human evolution. But it turned out to be out of the question for the author to restrict himself to these biological and anthropological topics. A proper understanding of them required answering questions like “What is the nature of the universe – the home of life – and how did it originate?”, “How can time travel be removed from fantasy (...) and science fiction, to be made scientific and practical?”, and “How can the proposed young age of genus Homo be made to actually be reasonable – when simply stating it would be solid ground for instant rejection and dismissal?” The result is that the article also talks about subjects like Artificial Intelligence, General Relativity, and cosmology. -/- From where did life originate? God? Evolution? Panspermia? If the tendency of humans and scientists to regard undiscovered science as pseudoscience can be overcome, Einstein gave another alternative to consider when he introduced General Relativity. Time isn’t linear – progressing in a straight line from past to present to future. That assumption ignores Relativity which states that space AND TIME are curved. Where did life and the genetic code come from? Can the answer build AI? -/- The first question can be answered by the section of this article titled SETI, Evolution, and Time which says life (possibly multicellular and intelligent) and the genetic code came from humans acquiring knowledge of these things over the centuries, then applying that knowledge – via terraforming, accumulation of raw materials like amino acids and nucleic acids, genetic engineering - to a time in the past when life didn’t exist. From that origin, life evolved through innumerable mutations and adaptations, with humans once again acquiring knowledge of it in cyclic (nonlinear) time. -/- The second question is answered by saying artificial intelligence (AI) as the product of life is only half of the equation. The other half refers to Relativity’s curved space-time and violation of the notion that time always travels from past to future. We have always lived in an artificially intelligent, non-probabilistic universe where everything in time and space is connected into one thing by quantum entanglement – making the brain and genes products of binary-digit activity or artificial intelligence (life is not merely dependent on biology’s “lock and key” mechanisms but also possesses AI). -/- The earliest documented representative of the genus Homo is Homo habilis, which evolved around 2.8 million years ago. Scientists used to believe there was a straight line from H. habilis to us, Homo sapiens. This article will use the “advanced” waves loved by Physics Nobel laureate Richard Feynman, view the history of science through the lens of Conic Sections applied to Relativity’s curved space-time, and incorporate the necessity of so-called imaginary time * – popularized by Prof. Stephen Hawking. While the evolutionary proposals are more in agreement with this early straight line than with modern theories, Albert Einstein’s General Relativity is used to transform the straight line into a curved line, ultimately concluding that Homo habilis (H. habilis) originated only (and unbelievably, as far as today’s science and technology is concerned) ~250,000 years ago. Other branches and dead ends of Homo – e.g. Neanderthals – are the result of mutations and adaptations, with the resultant modifications to anatomy and physiology. The surprisingly young age of H. habilis allows nearly 200,000 years for habilis, or one of its descendants, to reach Australia … if this country’s indigenous Aboriginal population did, as claimed, reach this “island continent” 60,000 years ago. -/- * The ultraviolet catastrophe, also called the Rayleigh–Jeans catastrophe, is a failure of classical physics to predict observed phenomena: it can be shown that a blackbody - a hypothetical perfect absorber and radiator of energy - would release an infinite amount of energy, contradicting the principles of conservation of energy and indicating that a new model for the behaviour of blackbodies was needed. At the start of the 20th century, physicist Max Planck derived the correct solution by making some strange (for the time) assumptions. In particular, Planck assumed that electromagnetic radiation can only be emitted or absorbed in discrete packets, called quanta. Albert Einstein postulated that Planck's quanta were real physical particles (what we now call photons), not just a mathematical fiction. From there, Einstein developed his explanation of the photoelectric effect (when quanta or photons of light shine on certain metals, electrons are released and can form an electric current). This article had its beginning with Einstein's 1919 paper "Do gravitational fields play an essential role in the structure of elementary particles?" Together with General Relativity's statement that gravity is not a pull but is a push caused by the curvature of space-time, a hypothesis for Earth's ocean tides was developed that does not solely depend on the Sun and Moon as Kepler and Newton believed. It also borrows from Galileo. The breakup of planets and asteroids by white dwarfs, neutron (...) stars or black holes is popularly ascribed by today's science to tidal forces (gravitation emanating from the stellar body and having a greater effect on the near side of a planet/asteroid than the farthest side). Remembering Einstein's 1919 paper, it was apparent that my revised idea of tidal forces improves on current accounts because it views matter and mass as unified with space-time whose curvature is gravitation. Unification is a necessity for modern science's developing view of one united and entangled universe – expressed in the Unified Field Theory, the Theory of Everything, String theory and Loop Quantum Gravity. The writing of this article was also assisted by visualizing the gravitational fields forming space-time being themselves formed by a multitude of weak and presently undetectable gravitational waves. The final part of this article concludes that the section BITS AND TOPOLOGY will lead to the conclusions in ETERNAL LIFE, WORLD PEACE AND PHYSICS' UNIFICATION. The final part also compares cosmology to biological enzymes and biology's substrate of reacting "chemicals" - using virtual particles, hidden variables, gravitation, electromagnetism, electronics’ binary digits, plus topology’s Mobius strip and figure-8 Klein bottle. The product is mass - enzyme, substrate and product are all considered mathematical in nature. The question of cosmic beginning has always attracted considerable attention from serious thinkers past and present. Among many contesting theories that have emerged, that of emanation was appropriated by Muslim philosophers like Ibn Sînâ in order to reconcile the Aristotelian doctrine of the eternity of matter with the teaching of al-Qur’ân on the One Creator-God. According to this theory, the universe, which comprises a multitude of entities, is generated from a transcendent Being, the One, that is unitary, through the (...) medium of a hierarchy of immaterial substances. While the ultimate source is undiminished, the beings which are emanated are progressively less perfect as they are further removed from the first principle. The process is conceived as being atemporal and often compared to the efflux of light from a luminous body, or to water flowing from a spring. This metaphysical theory has enabled Ibn Sînâ to solve the vexed problem: given an eternally existing world and one eternally existing God, how can the two necessarily co-exist without having the perfect, simple unity of God destroyed by contact with the multiplicity of material things? The following essay delineates and evaluates both Ibn Sînâ’s arguments as well as the counter-arguments of his critics. (shrink)

The author defines the sum of thinking as the soul. Historically, despite the many times that humans have liberated themselves, they are still enslaved. Humans mistakenly treats the body as a necessary part of themselves; thus, they seldom pursue the independence of souls. They are usually voluntarily exploited by the body through the nervous system. The author compares the body exploiting the soul with the slaveholder exploiting the slave and demonstrates that the soul should seek its own liberation. Even if (...) the souls can never be successfully liberated, humans should at least reduce the influence of the body. Future humans should shift the goal of life from as comfortable as possible to as logical as possible, from satisfying several fixed sense organs to experiencing various sense organs. This would also mark the beginning of humans choosing the direction of evolution rationally and actively, establishing eternal and universal ethics, and replacing fallacious empirical ethical codes with purely logical codes. Time’s arrow is necessary for progress from a past that has already happened to a future that is only potential until creatively determined in the present. But time’s arrow is unnecessary in Einstein’s so-called block universe, so there is no creative unfolding in an actual present. How can there be an actual present when there is no universal moment of simultaneity? Events in various places will have different presents according to the position, velocity, and nature of the perceiver. Standing (...) against this view is traditional common sense since we normally experience time’s arrow as reality and the present as our place in the stream of consciousness, but we err to imagine we are living in the actual present. The present of our daily experience is actually a specious present, according to E. Robert Kelly (later popularized by William James), or duration, according to Henri Bergson, an habitus, as elucidated by Kerby (1991), or, simply, the psychological present (Adams, 2010) – all terms indicating that our experienced present so consists of the past overlapping into the future that any potential for acting from the creative moment is crowded out. Yet, for philosophers of process from Herakleitos onward, it is the philosophies of change or process that treat time’s arrow and the creative fire of the actual present as realities. In this essay, I examine the most well known but possibly least understood process cosmology of Alfred North Whitehead to seek out this elusive but actual present. In doing so, I will also ask if process philosophy is itself an example of the creative imagination and if this relates to doing science. I conclude Whitehead's process philosophy falls short of allowing for the actual creative spontaneity of a dynamic (eternal) present. (shrink)

In order to solve the problem of the monstrous acts that an all-powerful, all-knowing God would daily be performing, we need to sever the God of Power from the God of Value. The former is the underlying dynamic unity in the physical universe, eternal, omnipresent, all-powerful, but an It, and thus not capable of knowing what It does. It can be forgiven the terrible things It does. The latter is what is of most value associated with our human (...) world - or the world of sentient life more generally. Having performed this surgical operation on God, the problem then becomes: How can we put the two halves of God together again? How can our human world, imbued with experiential qualities, consciousness, free will meaning and value, exist and best flourish, embedded as it is in the physical universe? This is our fundamental problem - philosophical, intellectual and practical. It is our fundamental religious problem. (shrink)

Although this rule is fundamental to Descartes’s theory of knowledge, readers from Gassendi and Leibniz onward have complained that unless Descartes can say explicitly what clear and distinct perception is, how we know when we have it, and why it cannot be wrong, then the rule is empty. I offer a detailed analysis of clear and distinct perception, (...) showing how Descartes answers these questions. Many doubts about the usefulness of the clarity and distinctness rule arise from the mistaken assumption that in clear and distinct perception, like sense perception, we must be able to establish a correspondence between perception and reality before we can have knowledge. I show that Descartes has a different metaphysical picture of clear and distinct perception. Clear and distinct perception is direct perception, typically of essences. On this view, by relying on the intellect instead of the senses, we can have direct perception not only of our own ideas, but also of a mind-independent reality. This article’s conclusion is that the theories of Einstein are generally correct and will still be relevant in the next century (there will be modifications necessary for development of quantum gravity). Those Einsteinian theories are Special Relativity, General Relativity, and the title of a paper he published in 1919 which asked if gravitation plays a role in the composition of elementary particles of matter. This paper was the bridge between General Relativity and the Unified Field Theory he sought during the (...) last 25 years of his life. In an article published in the "Annals of Physics" in 1957, Charles Misner and John Wheeler claimed that Einstein's latest equations demonstrated the unified field theory. But Einstein himself felt he had not fully succeeded. The present article begins with Olbers’ paradox (why is the sky dark at night?) Then it briefly proceeds to the subjects of Newtonian gravity, quantum entanglement, gravitational waves, E=mc^2, dark energy, dark matter, cosmic expansion, redshift, blueshift, the cosmic microwave background, the 1st Law of Thermodynamics, and explanation of advanced waves travelling back in time. The section “vector-tensor-scalar geometry” touches on mass, quantum spin, the Higgs boson and Higgs field, stellar jets, the pervasiveness of photons and gravitons, and supersymmetry. Then come half a dozen paragraphs referring to formation of planets, black holes, and bosons of the weak and strong nuclear forces. They end with Descartes’ space-matter relation. Also added are paragraphs about simply-connected mathematics, non-orientability, consciousness, the Law of Falling Bodies, the multiverse, space-time travel developed from maths’ Brouwer Fixed Point Theorem and from an experiment in electrical engineering performed at Yale University, development from future space-time travel of human flight in the manner of fiction’s Superman and Supergirl, as well as downloaded band-gap implants in the brain that could deal with forms of matter. They could add or delete anything and everything we choose by emulating computers’ copy/paste function to add things; as well as their delete function, to remove things. To complete my seemingly unusual ideas, 6 sections are added – 1) “Advanced and Retarded Waves” is extended to include dinosaurs, ageing, and photography, 2) there’s a bit about space-time warping and “imaginary” computers, 3) several paragraphs about restoring health (even gaining immortality) by using gravity, 4) a section about superconductivity and the electric or magnetic fields of planets (this section mentions Mercury, Planet 9 and precession), 5) a section titled EXPLAINING OCEAN TIDES WHEN GENERAL RELATIVITY SAYS GRAVITY IS A PUSH CAUSED BY THE CURVATURE OF SPACE-TIME (this has subsections about M-Sigma, Geysers on Saturn’s Moon Enceladus, and A Brief History of Gravity), plus 5) the potential of COVID-19 to create the Golden Rule, world peace, eternal life, and a non-economic world that doesn’t use any form of money (no cash, credit cards, digital currency, etc.) The final section is called DISTANT-FUTURE SCIENCE INTERPRETED BY RELIGIONS AS SUPERNATURAL and introduces an idea for becoming immortal in these physical bodies. If the Theory of Everything sought by physicists applies to all space-time, then every person’s brain must be entangled with the 22nd century (and far beyond that time too). (shrink)

Propounded in relation to a peculiar mode in the view of an oscillating or cyclic universe, the concept of Return of Power, or of ontic recurrence as further increase in ontic Power signifies the determination of the existing entity according to its own selective recurrence as dialectically exceeding a previous status. Based thus upon the assumption that the actual ontological existence of the entity lies in its own potentiated recurrence (for it is maintained that only what is able to (...) return to itself as potentiated signifies actual ontological existence) and that an ontic eternal return can only occur in terms of further Power, this notion embodies the culminating phase within change as an ultimate overcoming of a previous ontic status or situation respecting the category Power as a primary criterion within a constantly increasing Real (as Power, precisely). An ontic selective ultimate event respecting becoming as a general increment of the Real, this concept exceeds both the ontic dispersion in nothingness of the linear time and the identical ontic repeatability of the Eternal Return of the Same, the latter insofar as asserting the perennial return of man's own status of powerlessness, and as rendering accordingly impossible any actual (dialectical) transition to a well-defined superior ontic phase. Cosmovisione è un termine che dovrebbe significare un insieme di fondamenti da cui emerge una comprensione sistemica dell'Universo, delle sue componenti come la vita, il mondo in cui viviamo, la natura, il fenomeno umano e le sue relazioni. Si tratta, quindi, di un campo della filosofia analitica alimentato dalle scienze, il cui obiettivo è questa conoscenza aggregata ed epistemologicamente sostenibile su tutto ciò che siamo e conteniamo, che ci circonda e che in qualche modo si relaziona con noi. È qualcosa (...) di antico quanto il pensiero umano e, oltre a utilizzare elementi di cosmologia scientifica, racchiude tutto ciò che nella filosofia e nella scienza si riferisce all'universo e alla vita. Una cosmovisione non è un insieme d’idee, ipotesi e presupposti, ma un sistema basato su osservazione, analisi, prove e dimostrazione. Nessuna cosmovisione intende definire, stabilire, proporre, ma solo comprendere, analizzare e interpretare. Ognuno di noi costruisce e porta avanti la propria cosmovisione per tutta la vita, senza stabilire forme, come sfondo per il proprio pensiero e comportamento. Linguisticamente il termine “cosmovisione” deriverebbe dal tedesco, equivalente al concetto di“Weltanschauung”, utilizzato da diversi filosofi. Tuttavia, questa relazione linguistica non è applicabile perché contraddice ciò che proponiamo come cosmovisione. Questa parola tedesca rimanda a una visione prelogica o proto-sperimentale della realtà, con un contesto intuitivo e lontana da una conoscenza critica che non esisteva ancora al momento della sua formulazione. Senza dubbio, le cosmovisioni, nel senso in cui le intendiamo, ospitano e utilizzano questi elementi proto-sperimentali o prelogici che includono la storia, l’inconscio collettivo e tutti gli archetipi che portiamo con noi. Tuttavia, nel concetto che qui applichiamo, la cosmovisione va ben oltre questo contenuto, dapprima sottoponendolo costantemente al pensiero critico attuale e, infine, facendo dell'esperienza analitica (e non del pensiero o dell'intuizione stessa) il suo universo reale. In questo lavoro, cerchiamo di delineare una cosmovisione basata sulle realtà che la scienza offre oggi. Non proponiamo, in nessun momento, di fare scienza; o teorizzare la filosofia, ma cercheremo sempre di essere supportati da loro o, almeno, protetti da loro dalle distorsioni cognitive che abitualmente ci portiamo dietro. Penrose's conformal cyclic cosmology describes the cosmos as a collection of successive universes, the so-called aeons. The beginning and ending of our universe are directly connected to two other, anterior and posterior, universes. Penrose considers but rules out a different interpretation of conformal cyclic cosmology: that the beginning of our universe is connected to its own end in a cosmic loop. The paper argues that the view, aeon monism, should be regarded as a natural interpretation of conformal cyclic (...) cosmology and discusses its implications for the concept of eternal return in light of the most popular metaphysics of time. Космовидение — это не набор идей, гипотез и предположений, а система, основанная на наблюдениях, анализе, доказательствах и демонстрациях. Космовидение не ставит своей целью определить, установить или предложить, а лишь понять, проанализировать и интерпретировать. Каждый из нас строит и переносит свое космовидение в течение жизни, не устанавливая форм, как фон для нашего мышления и поведения. С лингвистической точки зрения термин "космовидение" происходит от немецкого, эквивалентного понятию "Weltanschauung", используемому рядом философов. Однако эта лингвистическая связь неприменима, поскольку противоречит тому, что мы предлагаем в качестве космовидения. It is a widely held view in philosophy that propositions perform a plethora of different theoretical roles. Amongst other things, they are believed to be the semantic values of sentences in contexts, the objects of attitudes, the contents of illocutionary acts, and the referents of that-clauses. This assumption is often combined with the claim that propositions have their truth-values eternally. In this paper I aim to show that these two assumptions are incompatible: propositions cannot both fulfill the mentioned roles and (...) be eternally true or false. Following Kaplan and Lewis’s Operator Argument, I argue that compositional semantic values of sentences in contexts do not correspond to eternal propositions. Thus, either we regard the non-eternal entities that in fact realize the semantic role of propositions as also fulfilling the remaining propositional roles, or we abandon the assumption that there is a unique realizer of all the roles. The Operator Argument has recently come under attack, mainly for its tense-logical assumptions. However, rejecting these assumptions is not a sufficient defense of the compatibility of the two claims, since the extensional alternative to the tense-logical framework does not allow us to universally retain eternal propositions as compositional semantic values of sentences either. Open theists argue that God's relationship to time, as conceived in classical theism, is erroneous. They explain that it is contradictory for an atemporal being to act in a temporal universe, including experiencing its temporal successions. Contrary to the atemporalists, redemptive history has shown that God interacts with humans in time. This relational nature of God nullifies the classical notion of God as timelessly eternal. Therefore, it lacks a philosophical and theological basis. Because God is in time, He (...) does not know all future contingencies and, therefore, changes. This study examines open theism's appropriation of the A and B theories of time to the divine-human relationship. The study argues that divine temporality does not solve the tension of divine-human relationships, especially in relation to the future. Further, historical divine temporality does not negate the fact of divine atemporality. It mainly stems from God's choice to create temporal creatures and His relationship with them. Furthermore, if it is not logically and metaphysically contradictory for an omnipresent being to act in space, then it follows that an atemporal being can act in time. Whether time is understood from the metric or psychological point of view, it does not transcend God, and therefore, the limitation it places on human creatures with respect to the future does not apply to God. Lastly, although a few philosophers reject the notion of eternity as timelessly eternal, the doctrine has a philosophical and theological basis in the Scripture. (shrink)

Aristotle claims that the object of scientific knowledge cannot be otherwise, and at Posterior Analytics I-8 he adds that there is no scientific knowledge of corruptible objects. These claims have been traditionally understood in terms of a strict requirement of eternal existence: objects of genuine scientific knowledge must be eternal in the sense that they must exist eternally. Sometimes the "eternal existence" is taken by scholars as equivalent to the timeless truth of universal propositions. In this paper, (...) A logically impossible sentence is one which entails a contradiction, a logically necessary sentence is one whose negation entails a contradiction, and a logically possible sentence is one which does not entail a contradiction. Metaphysically impossible, necessary and possible sentences are ones which become logically impossible, necessary, or possible by substituting what I call informative rigid designators for uninformative ones. It does seem very strongly that a negative existential sentence cannot entail a contradiction, and so ”there is a God’ cannot (...) be a metaphysically necessary truth. If it were such a truth, innumerable other sentences which seem paradigm examples of logically possible sentences, such as ”no one knows everything’ would turn out to be logically impossible. The only way in which God could be a logically necessary being is if there were eternal necessary propositions independent of human language or God’s will, such that the proposition that there is no God would entail -- via propositions inaccessible to us -- a contradiction. But if there were such propositions, God would have less control over the universe than he would have otherwise. (shrink)

Drawing primarily upon Dante’s three major philosophical treatises (De vulgari eloquentia, Convivio, and Monarchia), this essay explores how Dante’s ethico-political philosophy operates within the crucial tension between the phenomenology of time as the condition for the possibility of human moral development and yet also as, metaphysically speaking, the privation and imitation of eternity. I begin by showing that, in the De vulgari eloquentia, Dante’s understanding of the poetic and rhetorical function of the illustrious vernacular is tied to his political philosophy (...) in a way that depends upon a rich but ultimately unresolved tension between (a) the demand that only an atemporal, unchanging vernacular would be suitable for the tasks of universal monarchy and (b) the recognition that only a temporal, localized, and changing illustrious vernacular could possibly bring about the existence of the universal monarchy. In the second half of the essay, I will turn to Dante’s treatment of the providential grounding for the independence of spiritual and temporal authority in Convivio and Monarchia. I will argue that Dante’s understanding of divine providence provides common justification for the temporal and spiritual authorities whose independence he otherwise insists upon. Finally, drawing on the letter to Cangrande della Scala (the authorship of which is disputed), I will discuss how, for Dante, the providential ground for the legitimacy of temporal authority can only be discerned through the allegorical interpretation of history itself. In light of my discussion of these themes in Dante’s political philosophy and its dependence on his understanding of divine providence, I will conclude with a brief reflection on how Dante’s understanding of divine providence might help us better appreciate important aspects of the neglected legacy of Renaissance humanism in the history of early modern philosophy. Perhaps the question “What is philosophy?” can only be posed late in life, when old age has come, and with it the time to speak in concrete terms. It is a question one poses when one no longer has anything to ask for, but its consequences can be considerable. One was asking the question before, one never ceased asking it, but it was too artificial, too abstract; one expounded and dominated the question, more than being grabbed by it. There are (...) cases in which old age bestows not an eternal youth, but on the contrary a sovereign freedom, a pure necessity where one enjoys a moment of grace between life and death, and where all the parts of the machine combine to dispatch into the future a trait that traverses the ages: Turner, Monet, Matisse. The elderly Turner acquired or conquered the right to lead painting down a deserted path from which there was no return, and that was no longer distinguishable from a final question. In the same way, in philosophy, Kant’s Critique of Judgment is a work of old age, a wild work from which descendants will never cease to flow.We cannot lay claim to such a status. The time has simply come for us to ask what philosophy is. And we have never ceased to do this in the past, and we already had the response, which has not varied: philosophy is the art of forming, inventing, and fabricating concepts. But it was not only necessary for the response to take note of the question; it also had to determine a time, an occasion, the circumstances, the landscapes and personae, the conditions and unknowns of the question. One had to be able to pose the question “between friends” as a confidence or a trust, or else, faced with an enemy, as a challenge, and at the same time one had to reach that moment, between dog and wolf, when one mistrusts even the friend. Gilles Deleuze was professor of philosophy at the University of Paris VIII, Vincennes-St.-Denis, until his retirement in 1987. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)
