This is a short introduction to a book symposium on Paul Gowder's recent book, _The Rule of Law in thee Real World_ (Cambridge University Press, 2016). The book symposium will appear in the St. Luis University Law Journal, 62 St. Louis U. L.J., -- (2018), with commentaries on Gowder's book by colleen Murphy, Robin West, Chad Flanders, and Matthew Lister, along with replies by Paul Gowder.

Often ‘nationalism’ and ‘having a state proper to the nation’ are considered as inseparable. Relatedly, when these thoughts are applied to the reality of sub-state nations, such as Flanders, Catalonia Basque Country and Québec, sub-state nationalism (SSN) and separatism seem to be conceptually entangled in their aim for an independent state. This chapter considers sub-state nationalism and sub-state separatism as conceptually distinct, and aims at examining the relationship between sub-state separatist political parties and immigration policies. This requires, on the (...) one hand focusing on the integration policies, given that often immigration policies with regard to admission and removal lies beyond the competence of sub-state nations. On the other hand, it focuses on the two major Flemish pro-independence parties, namely the Nieuwe Vlaamse Alliantie (N-VA), and Vlaams Belang (VB). While sub-state separatist movements appear to be particularly opposed to increasing immigration, they operate under a particular ‘legitimacy dilemma’ with its paradoxical tendencies to both exclude and include immigrants. The chapter will show contextually that even the relatively more inclusive political party positions, such as the ones taken by the N-VA, are not sufficiently inclusive, when the normative distinction between ‘cultural assimilation’ and ‘cultural integration’ is taken seriously. Theoretically, it will engage with a renowned articulation of the legitimacy dilemma offered by Will Kymlicka, to argue that it is not sufficient to account for the normative necessity to respect the ‘autonomy of immigrants’. As I will demonstrate, this has to do with the inability of the dilemma to distinguish sufficiently ‘cultural assimilation’ from ‘cultural integration’. In other words, on the one hand the chapter contributes to the apparent absence of strong defenses for ‘moral autonomy of immigrants, by describing what such an autonomy might imply for designing of integration policies. On the other hand, it critically assesses Flemish pro-independence parties’ concrete policies with respect to integration. By offering a contextual political theory on these issues, it offers an example of how a moral principle might be implemented, and serve as a critical focal point to evaluate public policies. The Louvre Museum is the largest of the world's art museums by its exhibition surface. These represent the Western art of the Middle Ages in 1848, those of the ancient civilizations that preceded and influenced it (Oriental, Egyptian, Greek, Etruscan and Roman), and the arts of early Christians and Islam. At the origin of the Louvre existed a castle, built by King Philip Augustus in 1190, and occupying the southwest quarter of the current Cour Carrée. In 1594, Henri IV decided (...) to unite the palace of the Louvre with the palace of the Tuileries built by Catherine de Medicis. The Cour Carrée was built by the architects Lemercier and then Le Vau, under the reign of Louis XIII and Louis XIV. The Department of Paintings currently has about 7,500 paintings (of which 3,400 are exposed), covering a period that goes from the Middle Ages to 1848 (date of the beginning of the Second Republic). By including the deposits, the collection is, with 12,660 works, the largest collection of ancient paintings in the world. With rare exceptions, the works after 1848 were transferred to the Musée d'Orsay when it was created in 1986. Geheel in lijn met de rest van Europa-denk bijvoorbeeld aan de toegenomen populariteit van de radicaal-rechtse Zweden-Democraten (Sverigedemokraterna) en de verkiezing van de eerste naoorlogse radicaal-rechtse premier van Italië, Giorgia Meloni-maakt postpandemisch België een politieke draai naar (radicaal) rechts. Deze wending is vooral merkbaar in Vlaanderen: Uit een krantenpeiling van december 2022 blijkt dat 25,5 procent van de Vlamingen bij de volgende verkiezingen van plan is om op het Vlaams Belang te stemmen, die op de voet gevolgd worden door de (...) N-VA met zo'n 22 procent van de stemmen. Bijna de helft van de Vlaamse kiezers heeft dus een voorkeur voor een Vlaams-nationalistische regering, wat de federale coalitiebesprekingen en de politieke toekomst van België in 2024 wel eens negatief zou kunnen beïnvloeden. N-VA-voorzitter Bart De Wever verklaarde onlangs bovendien te willen samenwerken met het Vlaams Belang, op voorwaarde dat de partij zich zou ontdoen van haar meest radicale vertegenwoordigers. Dit alles betekent dat het zogenoemde cordon sanitaire-akkoord uit 1989-bedoeld om antidemocratische partijen uit politieke coalitiebesprekingen te weren-binnenkort wel eens zou kunnen sneuvelen. Petrus Nigri (Schwarz) se narodil západočeské Kadani (něm. Kaaden) kolem roku 1435 a spolu se svými třemi bratry vstoupil v Německu do dominikánského řádu. Během svého studia prošel velkou část Evropy (Německo, Itálii, Španělsko, Čechy a Maďarsko) a nakonec se stal rektorem generálního studia v Budíně (1481). Obecně je znám spíše jako význačný středověký hebraista. Do dějin filosofie se zapsal zvláště jako autor Clipeus thomsitarum (před r. 1474), což je filosofický komentář na Porfýriův Úvod (Isagoge) a na aristotelovské Kategorie, formou (...) otázek. Třebaže Nigriho práce není originální, představuje v zaalpských zemích významnou recepci pojetí pomyslného jsoucna (Clipeus, část I, ot. 3-4) tak, jak ho koncipoval Hervaeus Natalis († 1323) ve svém traktátu De secundis intentionisbus. -/- Petrus Nigri (Peter Schwarz, born in Kadaň/Kaaden before 1435, died in Buda 1483), is author of Clipeus thomistarum (printed 1481), a philosophical commentary on Porphyry's Introduction (Isagoge), and on Aristotle's Categories in the form of questions. While Nigri's discussion of the concept of being of reason (Clipeus thomistarum, part I, qq. 3-4) is not original, his work is important for contributing to this concept’s reception, and with it the teaching of Hervaeus Natalis (died 1323) in his treatise De secundis intentionibus, in the transalpine countries. Being of reason (ens rationis) is conceived as not a categorial being, nor is it an intellectual operation, nor is it caused, but is only identifiable by the human intellect. Nigri's being of reason has no subjective existence, but only an objective character, which differs both from categorial being and from mere nothingness. (shrink)
