Self-control is deemed crucial for reasons-responsive agency and a key contributor to long-term wellbeing. But recent studies suggest that effortfully resisting one’s temptations does not contribute to long-term goal attainment, and can even be harmful. So how does self-control improve our lives? Finding an answer requires revising the role that overcoming temptation plays in self-control. This paper distinguishes two forms of self-control problems: temptation (the presence of a strong wayward motivation) and apathy (the lack of commitment-advancing motivation). This distinction makes (...) it possible to separate negative self-control (aimed at overcoming temptation) from positive self-control (aimed at overcoming lack of motivation). The paper argues that temptation should not play a central role in our conception of self-control, since overcoming temptation is neither necessary nor sufficient for successful self-control. This paper deals with Plato’s theoretical views on rhetoric, its value, its conditions, and its genuine ethical-political function. My goal is to show that, even from the theoretical and/or metarhetorical point of view (Gorgias and Phaedrus), Plato would admit the practice of arguing from probabilities (eikós) and opinions, and would accept as a legitimate part of rhetoric –in order to persuade the mob– devices such as appeals to emotion. As it is well known, concrete uses of these devices can be (...) found in the dialogues. I will refer, in this vein, to some passages of Plato’s political writings, esp. Republic and Laws, and to the role of some myths in the dialogues. Nonetheless, I sustain the necessity (and the possibility) of harmonizing this view, with Plato’s strong claim that knowledge of (and commitment to) an objective truth is essential to the true rhétor. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Descartes maintained substance dualism, the thesis that no substance has both mental and material properties. His main argument for this thesis, the so-called separability argument from the Sixth Meditation (AT VII: 78) has long puzzled readers. In this paper I argue that Descartes’ independence conception of substance (which Descartes presents in article 51 of the Principles) is crucial for the success of the separability argument and that Descartes used this conception of substance to defend his argument for substance dualism from (...) an important objection. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Recently, a strong hylomorphic reading of Aristotelian emotions has been put forward, one that allegedly eliminates the problem of causal interaction between soul and body. Taking the presentation of emotions in de An. I 1 as a starting point and basic thread, but relying also on the discussion of Rh. II, I will argue that this reading only takes into account two of the four causes of emotions, and that, if all four of them are included into the picture, then (...) a causal interaction of mind and body remains within Aristotelian emotions, independent of how strongly their hylomorphism is understood. Beyond the discussion with this recent reading, the analysis proposed of the fourfold causal structure of emotions is also intended as a hermeneutical starting point for a comprehensive analysis of particular emotions in Aristotle. Through the different causes Aristotle seems to account for many aspects of the complex phenomenon of emotion, including its physiological causes, its mental causes, and its intentional object. This paper deals with Aristotle’s concept of chance, such as it is presented in Physics II 4-6. The central section of the article concentrates on an analysis of Aristotle’s definition of chance and its essential peculiarities: the fact of being an incidental (efficient) cause and the fact of existing in the domain of what is for the sake of an end. According to Rossi, both characteristics would correspond to a causal aspect (in an incidental sense) and to a non causal (...) aspect (or just apparently causal) of chance. Finally, the author also tries to show the structural connection between the aforementioned aspects, taking as a key point the thesis of coincidence among the formal, final, and efficient causes. In this paper I address some aspects of the discussion of Aristotle against materialism. I take as a starting point the inaugural sentence of Phys. 2.4, where Aristotle refers to the endoxon that there are things which are (einai), and things which become or are generated (gignesthai) by chance. In the first place, I show that Aristotle would have ascribed to the materialists (especially Empedocles) the opinion that things like animals and plants can be (and not only become) by chance. (...) I shall argue that, in fact, this thesis implies that it is not only the compound that is generated, but also the form or eidos of the living being. To this extent, I propose that there are strong reasons for Aristotle to reject that living beings may be by chance, and to circumscribe chance to that which becomes or is generated. In other words: chance can occur within processes of generation but has nothing to do with the causes and principles of those processes. Thus, this repositioning of chance within the sole field of what becomes is closely connected to the causal priority of the eidos in the processes of generation. (shrink)

The text of Physics 2.8 has been recently interpreted so as to restore the reading that Aristotle holds an external, and even an anthropocentric, natural teleology. This reading has been defended by D. Furley, and especially by D. Sedley. In this paper I present several arguments against this interpretation of the text. Thus, I will argue that Aristotle does not claim, in this chapter, that it rains for the sake of the growing of the crop, against an opinion which is (...) currently somewhat extended among interpreters. Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

The subtraction argument, originally put forward by Thomas Baldwin (1996), is intended to establish Metaphysical Nihilism, the thesis that there could have been no concrete objects. Some modified versions of the argument have been proposed in order to avoid some difficulties faced by the original argument. In this paper I shall concentrate on two of those versions, the so-called subtraction argument* (presented and defended in Rodriguez-Pereyra 1997, 2000, 2002), and Efird and Stoneham’s recent version of the argument (Efird and Stoneham (...) 2005). I shall defend the subtraction argument* from Alexander Paseau’s (2006) objection that because a crucial premise of the subtraction argument* may have no plausibility independent from Metaphysical Nihilism, the subtraction argument* is not suasive. Although Paseau focuses on the subtraction argument*, I shall point out that Efird and Stoneham could reply to Paseau’s objection in the same way. Thus there are (at least) two suasive versions of the subtraction argument that establish Metaphysical Nihilism. But are those two arguments equally good? I shall argue that the subtraction argument* is preferable to Efird and Stoneham’s argument. (shrink)

We introduce the Bias Network Approach (BNA) as a sociotechnical method for AI developers to identify, map, and relate biases across the AI development process. This approach addresses the limitations of what we call the "isolationist approach to AI bias," a trend in AI literature where biases are seen as separate occurrence linked to specific stages in an AI pipeline. Dealing with these multiple biases can trigger a sense of excessive overload in managing each potential bias individually or promote the (...) adoption of an uncritical approach to understanding the influence of biases in developers’ decision-making. The BNA fosters dialogue and a critical stance among developers, guided by external experts, using graphical representations to depict biased connections. To test the BNA, we conducted a pilot case study on the "waiting list” project, involving a small AI developer team creating a healthcare waiting list NPL model in Chile. The analysis showed promising findings: (i) the BNA aids in visualizing interconnected biases and their impacts, facilitating ethical reflection in a more accessible way; (ii) it promotes transparency in decision-making throughout AI development; and (iii) more focus is necessary on professional biases and material limitations as sources of bias in AI development. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Resemblance Nominalism is the view that denies universals and tropes and claims that what makes F-things F is their resemblances. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Leibniz was a philosopher of principles: the principles of Contradiction, of Sufficient Reason, of Identity of Indiscernibles, of Plenitude, of the Best, and of Continuity are among the most famous Leibnizian principles. In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) Sufficient Reason (sect. 3), some attempts to demonstrate the Principles of Contradiction and Sufficient Reason (sect. 4), and one attempt to demonstrate the Principle of Identity of Indiscernibles (sect. 5). Whether Nietzsche’s genealogical critique of morality is best understood as an internal or as an external critique remains a matter of controversy. On the internalist interpretation (Ridley, Owen, Merrick ), the genealogical enterprise takes as its starting point the perspective being criticized, gradually revealing it to be untenable ‘from within.’ On the externalist interpretation (Leiter, and arguably Geuss, Williams, and Janaway ), this constraint is lifted; the starting point of the critique need not be the perspective being criticized, but may (...) be that of someone who already suspects the latter to be untenable. According to a common objection to ‘external critique’ interpretations, the limited-scope objection, since an external critique to a value-system could only work on an audience whose members were predisposed to abandon that system of values, ‘external critique’ interpretations impose a severe limitation on the transformative potential of Nietzsche’s project. ‘Internal critique’ interpretations, by contrast, can seem hard to reconcile with the polemical character of On the Genealogy of Morality (which lends the book its subtitle, Eine Streitschrift) and with Nietzsche’s frequent remarks to the effect his works were addressing a particular, ‘higher,’ kind of individual. -/- The overarching goal in this paper is to call into question the usefulness of the ‘internal-external’ or ‘immanent-transcendent’ dichotomy for understanding Nietzsche’s genealogical critique. I argue that the apparent usefulness of the distinction between external and internal critiques when approaching Nietzsche’s works rests on the assumption that any critique of values must itself be grounded on values that function as evaluative-critical standards. If the assumption is right, then one of two things, either the values that are deployed as standards coincide with those that are the target of critique, in which case the critique is internal, or they are not (etc.). Thus the assumption is liable to render us forgetful of a third possibility, that of a critical strategy that does not work by deploying (internal or external) values as standards of critical assessment, but by revealing something about the nature of value, and more precisely about the origin of any individual’s commitments to their values. -/- On the view that I defend, one of the crucial steps of Nietzsche’s genealogical method is to bring his reader to realize that any individual’s commitment to their values is expressive of and rooted in their commitment to preserve their way of life. Realizing this does not require that the reader abandon their own values. But it does require that they acknowledge that were they committed to a relevantly different way of life, they would subscribe to different values. And this, in turn, suffices to bring about a transformation in their understanding of and relationship to those commitments through the further realization that it is ultimately always up to them to undertake the project of taking distance from and ‘re-evaluating’ those values. Causation was an important topic of philosophical reflection during the Seventeenth Century. This reflection centred around certain particular problems about causation, one of which was the problem of causation between mind and body. The doctrine of the pre-established harmony is Leibniz's response to the problem of causation between mind and body. In this chapter I shall (a) explain the problem of mind-body causation; (b) explain Leibniz's pre-established harmony; and (c) assess his case for it.

This note argues that research in analytical philosophy broadly conceived should be published exclusively in English. Reasons are given for this and the thesis is defended against thirteen objections.

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. In this paper I present what I call the 'Metaphysical Problem of Truth', which consists in explaining in virtue of what all true sentences are true, and argue that a version of the Correspondence Theory of Truth is the most plausible solution to this problem.

The Parmenides has been unduly overlooked in discussions of hypothesis in Plato. It contains a unique method for testing first principles, a method I call ‘exploring both sides’. The dialogue recommends exploring the consequences of both a hypothesis and its contradictory and thematizes this structure throughout. I challenge the view of Plato’s so-called ‘method of hypothesis’ as an isolated stage in Plato’s development; instead, the evidence of the Parmenides suggests a family of distinct hypothetical methods, each with its own peculiar (...) aim. Exploring both sides is unique both in its structure and in its aim of testing candidate principles. (shrink)

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. Critical examination of Alchourrón and Bulygin’s set-theoretic definition of normative system shows that deductive closure is not an inevitable property. Following von Wright’s conjecture that axioms of standard deontic logic describe perfection-properties of a norm-set, a translation algorithm from the modal to the set-theoretic language is introduced. The translations reveal that the plausibility of metanormative principles rests on different grounds. Using a methodological approach that distinguishes the actor roles in a norm governed interaction, it has been shown that metanormative principles (...) are directed second-order obligations and, in particular, that the requirement related to deductive closure is directed to the norm-applier role rather than to the norm-giver role. The approach has been applied to the case of pure derogation yielding a new result, namely, that an independence property is a perfection-property of a norm-set in view of possible derogation. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. The Razor says: do not multiply entities without necessity! The Laser says: do not multiply fundamental entities without necessity! Behind the Laser lies a deep insight. This is a distinction between the costs and the commitments of a theory. According to the Razor, every commitment is a cost. Not so according to the Laser. According to the Laser, derivative entities are an ontological free lunch: that is, they are a commitment without a cost. Jonathan Schaffer (2015) has argued that the (...) Laser should replace the Razor. In Sections 2-4 we shall discuss and argue against Schaffer’s arguments for replacing the Razor with the Laser. Schaffer considers several objections to his views, and in Sections 5-7 we shall argue that Schaffer does not deal successfully with two of them. In Section 8 we shall present a probabilistic argument for the Laser. However, the argument has a limitation and does not support the replacement of the Razor with the Laser. Indeed, it supports only the claim that, given certain assumptions, the multiplication of explanatorily relevant derivative entities does not matter; but, as we argue in the same section, there is an argument that multiplying explanatorily superfluous derivative entities does makes a theory less rationally acceptable. Our conclusion is that the Laser cannot replace the Razor and that derivative entities are not an ontological free lunch. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

Emancipatory social movement solidarities are prefigurative associations. While pursuing broad-based social transformations, solidaristic agents attempt to model—in an incomplete and provisional way—the social relations they wish to bring into existence. Existing structures of domination, deep-set and overlapping as they are, pose an abiding challenge to the prefiguration of just relations, however. This article considers the challenge of prefiguration by developing a diachronic, goal-oriented, and epistemic account of solidarity. The author argues that solidarity is a collaborative process whereby agents prefigure relationships (...) of nondomination while working together to reach shared understandings about the political task at hand. The author examines two epistemologies that have not been traditionally connected to philosophical discussions of solidarity, philosophical hermeneutics and creolization, to elaborate the account. While both frameworks enable an understanding of solidarity as a properly transformative relation, creolization illuminates the possibilities and difficulties of collaborating under conditions of domination. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. El documento expone los antecedentes sugeridos por Paul Ricoeur sobre lo que podría denominarse “la polémica epistemológica en ciencias sociales”, referidos a la formulación de un método legítimo para la investigación en dichas ciencias que responda a las particularidades propias de su objeto de estudio. En este sentido, se rastrea la cuestión en la tradición hermenéutica romántica, concretamente en el pensamiento de Wilhelm Dilthey, pasando por la teoría estructural de estudio del texto escrito y la formulación de una teoría de (...) la acción anglosajona, para finalmente terminar en la ricoeurtiana consideración hermenéutica de la acción significativa, que asume al texto como paradigma y propuesta de superación de los escollos en torno a la referida polémica. De similar manera, la intuición opera en algunos visionarios, cuya propiedad de percibir lo que esta por venir, los acerca a la realidad de un modo distinto. Este es el caso de Víctor Jara, cuya canción “Las Casitas del Barrio Alto” es objeto de estudio a través de un análisis crítico del discurso. En el trabajo se aprecia que Víctor Jara tiene la capacidad (...) de anticipar el futuro con esta canción, enunciando las características de lo que seria el porvenir urbano de Chile post dictatorial. In this paper I discuss a passage from *Naming and Necessity* where Kripke assumes that the essential properties by means of which a definite description designates are a sufficient condition of its rigidity. I put forward two examples that show the falsity of this assumption. Then I examine the non-rigid character of definite descriptions that designate by means of properties that are sufficient conditions of identity of the objects designated by those descriptions. I conclude that the properties by means of (...) which rigid descriptions designate must be both necessary and sufficient conditions of the identity of the designated objects. (shrink)

The concern of this paper is a version of Resemblance Nominalism according to which resemblance classes, i.e. classes of resembling things, are determined by paradigms. I show that the theory is false, since paradigms do not generally determine resemblance classes. Although I concentrate upon the version of the theory which was delineated by H. H. Price, my results apply to any other theory constructing resemblance classes out of paradigms.
