Der akademischen Philosophie wird manchmal nachgesagt, sie suche Antworten auf Fragen, die außer Philosophen niemanden umtreiben. In diesem Band sind »zwölf philosophische Antworten« auf Fragen versammelt, die sich jeder irgendwann einmal stellt und über die professionelle Philosophen lediglich etwas schärfer und gründlicher nachdenken. This is a preliminary essay on the rhetoric of ‘obosen’ of President Rodrigo Duterte. The essay discusses how the President employed the term ‘obosen’ to show his leadership quality characterized by strenght, firmness, patriotism and courage. He used ‘obosen’ as a way to persuade his target audience. The essay explicates how he was able to excellently manipulate and control the Philippine social consciousness. Nancy Jecker and Andrew Ko (2017) wish to present an account of personal identity which captures what matters to the patient and places the patient at the center of medical decisions. They focus particularly on medical interventions in the brain that can cause drastic changes in personality; under what circumstances should we say the patient has 'survived' these changes? More specifically, how can we best understand the notion of survival in a way that captures what is of concern to the (...) patient? This goal is laudable, however, their chosen account of narrative identity is ill-suited to this task for one reason in particular; it does not give sufficient guidance in predicting which medical decisions are likely to be experienced as disruptive to identity. The History of Ideas is presently enjoying a certain renaissance after a long period of disrepute. Increasing quantities of digitally available historical texts and the availability of computational tools for the exploration of such masses of sources, it is suggested, can be of invaluable help to historians of ideas. The question is: how exactly? In this paper, we argue that a computational history of ideas is possible if the following two conditions are satisfied: (i) Sound Method . A computational history (...) of ideas must be built upon a sound theoretical foundation for its methodology, and the only such foundation is given by the use of models , i.e., fully explicit and revisable interpretive frameworks or networks of concepts developed by the historians of ideas themselves. (ii) Data Organisation. Interpretive models in our sense must be seen as topic-specific knowledge organisation systems (KOS) implementable (i.e. formalisable) as e.g. computer science ontologies. We thus require historians of ideas to provide explicitly structured semantic framing of domain knowledge before investigating texts computationally, and to constantly re-input findings from the interpretive point of view. In this way, a computational history of ideas maximally profits from computer methods while also keeping humanities experts in the loop. We elucidate our proposal with reference to a model of the notion of axiomatic science in 18th -19th century Europe. (shrink)

There is no uniquely standard concept of an effectively decidable set of real numbers or real n-tuples. Here we consider three notions: decidability up to measure zero [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382], which we abbreviate d.m.z.; recursive approximability [or r.a.; K.-I. Ko, Complexity Theory of Real Functions, Birkhäuser, Boston, 1991]; and decidability ignoring boundaries [d.i.b.; W.C. Myrvold, The decision problem for entanglement, in: R.S. (...) Cohen et al. (Eds.), Potentiality, Entanglement, and Passion-at-a-Distance: Quantum Mechanical Studies fo Abner Shimony, Vol. 2, Kluwer Academic Publishers, Great Britain, 1997, pp. 177–190]. Unlike some others in the literature, these notions apply not only to certain nice sets, but to general sets in Rn and other appropriate spaces. We consider some motivations for these concepts and the logical relations between them. It has been argued that d.m.z. is especially appropriate for physical applications, and on Rn with the standard measure, it is strictly stronger than r.a. [M.W. Parker, Undecidability in Rn: Riddled basins, the KAM tori, and the stability of the solar system, Phil. Sci. 70(2) (2003) 359–382]. Here we show that this is the only implication that holds among our three decidabilities in that setting. Under arbitrary measures, even this implication fails. Yet for intervals of non-zero length, and more generally, convex sets of non-zero measure, the three concepts are equivalent. (shrink)

The composition of a timeline depends on purpose, perspective, and scale – and of the very understanding of the word, the phenomenon referred to, and whether the focus is the idea or concept, an instance of an idea or a phenomenon, a process, or an event and so forth. The main function of timelines is to provide an overview over a long history, it is a kind of a mnemotechnic device or a particular kind of Knowledge Organization System (KOS).b The (...) entries in the timeline should be brief and indisputable. Therefore, timelines often identify the first occurrences rather than the most widespread or most qualified instances leaving the fuller and more complex, and possibly disputable story out. But even first occurrences are often difficult to establish. The first occurrence is most often only the first finding of an instance. Older instances may be found and competing definitions develop either within a field or in different fields. This is further complicated since the phenomena, their names, and their meanings may change over time. Former meanings may become redundant, or they must accommodate and coexist with new meanings. The time and place of the composition of the timeline are to be considered in interpreting the things listed. The following note will discuss these issues as they occur in the development of the notions of text, e-text and hypertext, and the origin of machine translation. (shrink)

Some have suggested that certain classical physical systems have undecidable long-term behavior, without specifying an appropriate notion of decidability over the reals. We introduce such a notion, decidability in (or d- ) for any measure , which is particularly appropriate for physics and in some ways more intuitive than Ko's (1991) recursive approximability (r.a.). For Lebesgue measure , d- implies r.a. Sets with positive -measure that are sufficiently "riddled" with holes are never d- but are often r.a. This explicates Sommerer (...) and Ott's (1996) claim of uncomputable behavior in a system with riddled basins of attraction. Furthermore, it clarifies speculations that the stability of the solar system (and similar systems) may be undecidable, for the invariant tori established by KAM theory form sets that are not d-. Die gegenwärtig unter dem Titel ›Realismus‹ geführten Debatten in der Philosophie befinden sich nach allgemeiner Ansicht in einem Zustand größter Verwirrung, so daß es nützlich erscheint, ein wenig Ordnung in die theoretischen Optionen zu bringen bevor man für die eine oder andere Auffassung Partei ergreift. In der vorliegenden Arbeit wird dafür argumentiert, daß sich ein systematisch zusammenhängendes Zentrum dieser Debatten mit Hilfe des Begriffes der Referenz ordnen läßt. Nach der Analyse einiger klassischer Positionen soll ein Rahmen erstellt werden, innerhalb dessen (...) die Positionen eingeordnet und die zentralen Probleme fruchtbar diskutiert werden können. Zu diesem Zwecke ist es erforderlich, für die Einordnung der Positionen theoretische Kriterien zu benennen, die sich an den Problemen orientieren von denen hier argumentiert wird, das sie zentral seien. Sehr knapp ausgedrückt wird hier die Auffassung vertreten, Realismus sei als metaphysische These aufzufassen, welche eine von menschlichen epistemischen und semantischen Möglichkeiten unabhängige Existenz behauptet; in den gegenwärtigen Debatten typischerweise die Existenz einer Art von Dingen, nicht die eines individuellen Gegenstandes. Diese metaphysische These wird jedoch in der gegenwärtigen Debatte mit semantischen Argumenten untermauert, bzw. angegriffen und jene semantischen Argumente wiederum verwenden epistemische Erwägungen – die Frage betreffend, was man wissen kann und was nicht. Der Beginn der gegenwärtigen Realismusdebatten mit der soeben skizzierten zentralen Stellung semantischer Argumente ist, der hier vertretenen Auffassung zufolge, die Kritik am traditionellen Fregeschen Referenzbegriff durch Kripke und den frühen Putnam um 1970 (Kap. 2). Aus dieser neu zu bewertenden Kritik und der von den Autoren daraus entwickelten externalistischen realistischen Semantik für Artausdrücke läßt sich das erste Kriterium für eine Position in einer Realismusdebatte ableiten und klären (Kap. 3): Hält man die fragliche Art für eine natürliche Art und meint also, sie habe ihren ›Zusammenhalt‹ von Natur aus? Wenn ja, dann ist die fragliche Position eine realistische (das Kriterium ist dank des engen Zusammenhangs von Realismus und Externalismus sowohl hinreichend als auch notwendig). Hält man die Art nicht für eine natürliche Art, ist man Antirealist. Damit geht jeweils not- wendig eine bestimmte Semantik für den auf die Art referierenden Ausdruck einher. Es zeigt sich zugleich, daß es zwei Varianten des Realismus zu unterscheiden gilt, die hier als klassischer bzw. als moderater Realismus bezeichnet werden. Im folgenden (Kap. 4.1) wird argumentiert, daß der Begriff der Wahrheit nicht eigentlich der zentrale Punkt in den in Frage stehenden Realismusdebatten sein sollte, wie vielfach behauptet wurde, sondern seine Brisanz vielmehr aus zugrundeliegenden semantischen Fragen gewinnt die also in der weiteren Aufdeckung der Kriterien die zentrale Rolle spielen müssen. In der Analyse der Kritik an der in Kap. 3 entwickelten Position des ›klassischen Realismus‹ läßt sich ein zweites unterscheidendes Kriterium für Positionen in Realismusdebatten entwickeln: begriffliche Relativität. Nach der Ablehnung von Putnams Auffassungen zu diesem Thema, werden zwei Varianten vorgeschlagen, starke und schwache begriffliche Relativität (Kap. 4.2). Die Anwendung dieses Merkmals zwingt, so wird argumentiert, in einigen Fällen zu einer Kombination einer realistischen Auffassung von Arten als natürliche mit begrifflicher Relativität. Diese mittlere Position zwischen klassischem Realismus und Antirealismus wird als »moderater Realismus« bezeichnet. Der im ersten Kriterium verwendete Begriff der natürlichen Art, und damit die Optionen in den Debatten, wird schließlich mittels einer Dis- kussion des Phänomens der Vagheit noch weiter verdeutlicht (Kap. 4.3). Purpose – The purpose of the research reported here is to improve comprehension of the socially-negotiated identity of concepts in the domain of knowledge organization. Because knowledge organization as a domain has as its focus the order of concepts, both from a theoretical perspective and from an applied perspective, it is important to understand how the domain itself understands the meaning of a concept. Design/methodology/approach – The paper provides an empirical demonstration of how the domain itself understands the meaning of (...) a concept. The paper employs content analysis to demonstrate the ways in which concepts are portrayed in KO concept maps as signs, and they are subjected to evaluative semiotic analysis as a way to understand their meaning. The frame was the entire population of formal proceedings in knowledge organization – all proceedings of the International Society for Knowledge Organization’s international conferences (1990-2010) and those of the annual classification workshops of the Special Interest Group for Classification Research of the American Society for Information Science and Technology (SIG/CR). Findings – A total of 344 concept maps were analyzed. There was no discernible chronological pattern. Most concept maps were created by authors who were professors from the USA, Germany, France, or Canada. Roughly half were judged to contain semiotic content. Peirceian semiotics predominated, and tended to convey greater granularity and complexity in conceptual terminology. Nodes could be identified as anchors of conceptual clusters in the domain; the arcs were identifiable as verbal relationship indicators. Saussurian concept maps were more applied than theoretical; Peirceian concept maps had more theoretical content. Originality/value – The paper demonstrates important empirical evidence about the coherence of the domain of knowledge organization. Core values are conveyed across time through the concept maps in this population of conference papers. (shrink)

Die Diversität von Nahrungspflanzen, ein Ergebnis Jahrtausende langer Zuchtbemühungen, ist in den letzten Jahrzehnten dramatisch zurückgegangen. Schätzungen zufolge machen von den über 7000 Nahrungspflanzenarten ganze 103 Sorten 90% der Nahrungsmittelproduktion aus. Dieser Verlust könnte in Zukunft gewaltige negative Auswirkungen auf die Nahrungsmittelsicherheit haben, da die Biodiversität eine zentrale Rolle bei der Absorbierung biotischer und abiotischer Stressfaktoren spielt, die auf die Pflanzen wirken. Darüber hinaus stellt der Verlust eine bedeutende Verarmung nicht nur des Pools genetischer Ressourcen dar, die zukünftigen Generationen zur (...) Verfügung stehen, sondern auch der kulturellen Diversität, indem die Nahrungsmittelvielfalt der Landesküchen eingeschränkt und sowohl Kulturlandschaften als auch Stadtgärten vereinheitlicht werden. Wegen der grundlegenden Funktion, die die Agrobiodiversität in der menschlichen Gesellschaft erfüllt, werden wir im Folgenden verschiedene Schwierigkeiten bei der Pflege der Agrobiodiversität als ein gemeinsames Erbe der Menschheit in einer stark ungleichen Welt erörtern. Zuvor jedoch möchten wir untersuchen, was Agrobiodiversität eigentlich ist und welche Funktion sie für das menschliche Wohlbefinden erfüllt. The foundation of truthful living in Sikhism is the concept of ‘Sat,’ which means truth or reality. Sikhism emphasizes the importance of seeking and living in harmony with the ultimate truth, which is believed to be embodied in the teachings (...) of the Guru Granth Sahib, the holy book of the Sikhs [1]. Truthful living involves aligning one's thoughts, words, and actions with this ultimate truth. Guru Nanak emphasizes the importance of truthful living as: ਸਚਹੁ ਓਰੈ ਸਭੁ ਕੋ ਉਪਿਰ ਸਚੁ ਆਚਾਰੁ॥ Sacẖahu orai sabẖ ko upar sacẖ ācẖār. Truth is the highest virtue, but higher still is truthful living. All languages have unique morphemes as distinguishing features from other languages. Unique morpheme is a morpheme with typical features divergent from other morphemes or language morpheme in general. This study aims to explain the unique morphemes in Malay Language of Makassar dialect. The finding is useful for linguistic studies especially morphological studies of morphemes. This study used descriptive method data collection method used was listening method. The techniques were listening and engaged in conversation and notes-taking. The role of researcher in (...) listening and engaged in conversation technique was not only as listener but also took part in the conversation. In note-taking techniques the researcher recorded the conversations from the research objects. The results found that the The Malay language of Makassar dialect has unique morphemes, such as ka, ta, nu, ki. Na, ko-, etc. Unique morphemes in form of words are such as pale (only), sedeng (again), bela (that’s it), and so on. More unique morphemes of particles are mine-, ji-, pi-, pa-, mo-, etc. Using these unique morphemes before words would make different in sense of the words from using them after words. (shrink)

Merriam-Webster dictionary defines an apostle as a person who initiates a great moral reform or who first advocates an important belief and system [1]. Similarly, the Cambridge Dictionary states that an apostle is someone who strongly supports a particular belief or political movement [2]. The Free Dictionary by Farlex describes an apostle as a person who pioneers an important reform movement, cause, or belief; a passionate adherent; or a strong supporter. In the light of the above meanings of the term (...) ‘apostle’, one can easily say that Guru Nanak was an apostle as he initiated great moral and social reforms in the Indian society of his times, as is evident from his life and works. He promoted an important belief system (moral code) of truthful living [4]. He states: Sacẖahu orai sabẖ ko upar sacẖ ācẖār. Truth is the highest virtue, but higher still is truthful living. (M. 1, SGGS, p. 62) The second part of the current topic is related to the term “Peace.” Peace has always been among humanity's highest values. The most popular (Western) view of peace is an absence of dissension, violence, or war. But peace is also seen as concord, or harmony and tranquility. It is viewed as peace of mind or serenity, especially in the East [5]. Peace of mind (also called inner peace) indicates a state of being mentally and spiritually at peace. It refers to having enough knowledge and understanding to keep oneself firm during discord or stress. We need some degree of inner peace in our own lives to be effective in helping to build peace in our organizations, communities, societies, and the world. (shrink)

Obtaining data on the results of the study of Ukrainian scholars on radical Jihadism is the purpose of this study. To achieve this goal, the study uses analysis and hermeneutics as its research methods. The research found that in the Ukrainian Islamic studies, there are now five main areas of research: theoretical, historical, social, economical and the area of security provision. In Ukraine, the problem of radical Jihadism is considered within the framework of the security research direction. The study showed (...) that the security trend in Ukrainian Islamic studies is still poorly presented. A few studies have been written on this topic. Among the authors dealing with this problem, it is necessary to name such researchers as M. Azarov, S. Zin’ko, M. Kiryushko, S. Kuzmin, O. Licarenko, V. Ostroukhov, and V. Petryk. In particular, V. Ostroukhov, O. Likarenko, and V. Petrik identified six signs that separate Islamist extremism from moderate Islam. S. Zin’ko argued that Europe has not yet developed a pan–European approach to counteracting radical Islam. The implementation of large–scale scientific research projects on the study of the dangers of radical Jihadism is still ahead in Ukraine. (shrink)

이 글은 전세계적으로 문제가 되고 있는 코로나19를 베트남이 어떻게 성공적으 로 대처할 수 있었는지에 대한 궁금증을 다루고 있다. 베트남의 코로나19 대응과정 을 좀 더 면밀히 살펴보면서, 전시상황과 견주 할 정도로 빠르고 강력한 봉쇄를 어 떻게 진행할 수 있었고, 전국민의 동의는 어떻게 얻을 수 있었는지 분석한다. 메타포, 과학저널리즘, 애국을 위한 사회적 격리와 감시는 베트남의 코로나19 대응에서 중요한 지점이다. 물론 봉쇄와 격리가 가져온 정치경제적 결과도 분명하다. 아세안의장국으로서의 지위와 국가위기를 성공적으로 이겨내고 있는 정부의 역할이 돋보 였지만, 마이너스 경제성장과 실업 문제는 해결이 시급하다. 또한 (...) 이러한 봉쇄조치가 한국인 격리 사건을 발생시키는 등 국가적인 외교문제로까지 커지게도 만들면서베트남 내 중요한 경제외교국인 한국과의 관계도 소원하게 될 뻔 하기도 하였다. 그렇지만 이러한 위기는 베트남 내 한국기업, 교민의 노력으로 일부 해소되는 등 코로나19로 인해 만들어진 이슈를 통해 한국기업의 역할을 다시 한 번 생각해 볼수 있는 계기가 되었다. 본 논문은 개혁개방정책을 통하여 체제 내 개혁을 시도하였던 베 트남의 체제변화 요인에 관한 연구이다. 경제개혁을 통한 베트남의 체제변화가 지속될 수 있을 것인지 그리고 이런 경제개혁이 정치체 제 개혁에 영향을 미칠 수 있을 것인지에 대한 관심에서 연구가 시 작되었다. 또한 베트남 사회주의가 어떤 길을 걷게 될 것인지에 대 한 해답을 찾기 위해서는 베트남 체제변화의 영향요인 파악이 우선 적으로 이루어져야 한다고 보았다.

이 연구는 현재까지 성공적이라 평할 수 있는 베트남의 코로나19 대응 상황 을 파악하고 그 원인을 찾는 데 목적이 있다. 첫째, 베트남의 코로나19 대응이 성공적일 수 있었던 이유와 코로나19 대응과정에서 나타나는 여러 특징을 살 펴봤다. 베트남의 코로나19 대응은 국경 봉쇄로 이야기되는데, 극단적이리만 큼 강력한 대처를 어떻게 진행할 수 있었는지 대응과정을 짚어봤다. 베트남의 코로나19 대응과정을 좀 더 면밀하게 살펴보면서, 전시상황과 견줄 정도로 빠 르고 강력한 봉쇄를 어떻게 진행할 수 있었고, 국민적 동의는 어떻게 얻을 수 있 었는지 분석했다. 메타포, 과학적 사실 공유, 애국을 (...) 위한 사회적 격리와 감시 는 베트남의 코로나19 대응에서 중요한 지점이었다. 둘째, 강력한 국경 봉쇄로 대변되는 베트남의 코로나19 대응전략이 사회경제적으로 어떤 영향을 미쳤으 며, 이러한 영향이 베트남의 코로나19 대응에 어떻게 반영되고 있는지를 살펴 봤다. 베트남의 코로나19 대응 방식과 관련해서 첨예한 갈등이 촉발되었던 사 건인 베트남의 ‘대구발(發) 비행기 탑승객 격리조치’가 베트남 내 한국 및 한국 기업에 대한 부정적인 반응을 확산시켰고, 이 문제를 해소하는데 베트남 현지 기업과 교민사회의 민간 연대가 중요한 역할을 하였다. 이 연구에서는 이러한 내용을 중심으로 국가 차원에서의 봉쇄가 국민적 합의를 얻어냈고, 그것은 베 트남 정부의 권위주의적 성향에 동조한다는 단순한 논리로 설명될 수 없음을 밝히고 있다. 이는 코로나19 상황을 해결하기 위한 국가의 리더십과 사회적 신 뢰가 바탕이 된 국가의 역량은 ‘감시’와 ‘통제’라는 권위주의적 성향의 아이디 어로만 평가되기에는 부족하다는 것을 의미한다. The psychological question: What can it mean for an incorporeal soul to utilise the motions of a body for an ethical and cognitive paradigm? [English abstract] In his last metaethical statement, Parfit revisits his earlier arguments for non-metaphysical normative non-naturalism , and points to the possibility of convergence between his view and Railton's non-analytical normative naturalism. I examine the basis of this convergence claim and find it unpersuasive, mainly because if their views converge on the same position, Parfit's non-natural norms exist only as predicates. In order to avoid this consequence, he needs to present a reason for believing in the existence of normative properties (...) . There is an indispensability argument implicit in his text, with concepts of sui generis normative ground and necessity at its centre. At the time in which quantum mechanics engages in talks of multiverses and quantum technologies helps to realize a concept of metaverse, the so-called ‘virtual life’ has become the extended reality. Chalmers in his book rejects a dichotomy of reality and illusion and consctructs a trichotomy by adding virtuality in order to offer a proposition that a virtual world is a part of the extended reality. The author sees new philosophical challenges in this new reality. For an example, as we (...) are bound to allow some form of consciousness to a robot in a context of simulation there are questions of status of personal agency or personal identity. Traditional subjects of ontology, knowledge, and value come to us as new challenges. Now it’s the time to hear lots of talks about crisis of philosophy and disappearance of humanities. One can assume that the trend of such dialogues is related to a culture that conviction on the modernistic absolute truth is waning and belief’s on postmodernistic pluralism gets strong. How could postmodoernism gain such a strong momentum? I could offer a hypothesis for the question, that is, that philosophy of quantum mechanics played an important role. In my mind, Zhang Hwe-Ik’s book explains (...) how postmodernistic quantum philosophy can replace Newton’s modernistic mechanics and it tries to offer a philosophical paradigm by his own Seoul interpretation on the quantum mechanics, paradigm which is comparable to the role of Kant’s philosophy toward Newton’s classic mechanics. The Western intellectual tradition is accustomed to the separation between the human sphere and the sphere of nature, whereas in the East Asian intellectual tradition the two are considered continuous. For good or bad, the Western dualist outlook, which considers mind and matter to be fundamentally distinct, received much philosophical attention in modern times. But how is the East Asian tradition of non-separation to be philosophically expounded? The idea that the human sphere and the sphere of nature are fundamentally connected (...) is attractive on many levels, but it appears to be in need of philosophical scrutiny. One of the key notions which any attempt to provide an adequate elucidation of the East Asian integrative outlook would have had to address is the notion of intentionality. For the idea of intentionality is placed at the center of discussions regarding the continuity — or lack thereof — of minds and bodies, and of nature and humanity. The present paper claims that the dualistic thesis according to which intentionality serves as a delineative mark which separates the mental from the physical and the human sphere from the sphere of nature is implausible (1st section). It further argues that the concept of intention, cheng(誠) of Zhungyong, can be taken to reflect the idea that all things have a mind as a capacity to process information at the appropriate level where they are placed (2nd section). Finally, it develops the view that the capacity for integration sustains a picture according to which integration is a case of yinyang intentionality (3rd section). (shrink)

They used “seed” to refer to humans or people on the one hand and placed the notion of seed in the holistic context of the Eastern Asian tradition on the other. Then, I seek to connect the anthropological notion and the holistic notion via cheng(誠) or integration. Zhungyong-The Doctrine of the (...) Mean, one of 4 Confucian texts, says that the ultimate integration(至誠) is to reflect the total nature of objects involved (盡性) so that it will show that self realization and all other realizations are one and not two(成己成物) and it will ultimately reach the stage of holiness(聖). Important elements of cheng intentionality can be read out of the two thinker’s various conceptual aspects. YU’s interpretation of history to be internalistic, his view of Hangul(Korean written language) as a revelational medium, his hermeneutics of Christian God as the emptiness cannot be understood on the dichotomous model of human-nature. HAM’s seed holism, his beliefs that humans’s minds are the heavenly mind and that all things under the heaven should come to be unified are best to be understood on the model of cheng intentionality of integration. With an aim to introduce these fundamental concepts into Korean philosophical literature, the study navigates through the debates surrounding the nature of scientific inquiries and the extent to which they accurately represent the reality of the world. Scientific realists contend that scientific theories aspire to uncover genuine claims about the natural (...) world, asserting the approximate truth of well-confirmed theories. On the other hand, anti-realists challenge the necessity of committing to unobservable entities postulated by scientific theories based solely on their empirical success. The paper also discusses influential arguments such as the "No Miracle Argument" put forth by realists and the "pessimistic induction" raised by anti-realists, shedding light on the historical context of scientific theories and their empirical success. As the study unfolds, it provides a nuanced perspective that transcends the dichotomy of scientific realism and anti-realism, emphasizing selective skepticism as a middle ground. By delving into the ontological and epistemological nuances of these philosophical positions, this paper seeks to contribute to the Korean philosophical discourse by presenting a comprehensive overview of scientific realism and anti-realism. The theory of universals faces two opposing demands. On the one hand, it must be explanatory. That is, certain kinds of statements found in our everyday discourse and the theories used to explain them seem to require the existence of universals for their understanding or acceptance. On the other hand, it must be ontologically appropriate. This means that theories that intervene ontologically without sufficient reasons for the existence of implausible entities or theories that result in an excessive proliferation of new (...) entities should not be embraced as theories of universals. The problem is that a theoretically sound theory of universals appears to inevitably involve a tension between explanatory and ontological appropriateness. This dilemma arises from the two aforementioned demands, and it is a genuine dilemma in that it is difficult to give up either demand. Philosophy, or metaphysics, fundamentally aims to explain the facts of the experiential world. If a philosophical theory fails to adequately satisfy our explanatory demands regarding the experiential world, it is not suitable as a philosophical theory. Conversely, it is also undesirable for a philosophical theory to impose excessive ontological burdens. The justification of a philosophical theory is a priori, and any a priori claims about the existence of entities should not be arbitrarily adopted. This article resolves this dilemma as follows: If the explanatory demand requires reduction from an ontological standpoint, it can be adequately addressed through unproblematic means. On the other hand, the apparent conflict between the explanatory demand and appropriate ontology only arises when it is understood as a demand for explanatory priority. However, such a demand does not necessarily require the introduction of any ontological priority. Therefore, there was no need for the dilemma to arise. Finally, I attempt to respond to the demands from natural kind predicates. (shrink)

It is natural to suppose the following three: factivity of knowledge, alda-know synonymy, and the univocity of alda. However, rago-knowledge attribution, expressed by “rago alda” sentences, seems to defeat to hold them at once. In this paper, I try to dissolve this predicament, analyzing “rago alda” sentence as a kind of hybrid language expression. And the theoretical advantages, which my analysis has over other possible, alternative approaches, are to be shown.

There are at least three interpretations that attempt to read from the Sense-Certainty Chapter a Hegelian theory of indexicals. First, the Impossibility of Singular Reference Reading understands Hegel as excluding in principle the possibility of any linguistic cognition of individuals. Second, the Theory of Reference Reading criticizes the first reading and interprets from Hegel the classical idea of direct reference theory. Third, Brandom’s Anaphoric Theory Reading suggests an alternative explanation while still defending the possibility of knowledge of individuals in Hegel. (...) I criticize the first two readings and argue that the third is the most exegetically and philosophically adequate interpretation. The first interpretation attempts to ascribe to Hegel a sort of skepticism, but this can be at most in a very restricted sense successful and the skepticism constructed in such a way is too trivial to refute Hegel’s position. The second reading is more adequate in that it does not fall into the error that the first one committed, but is still flawed because it introduces a subject-object or mind-world dualism that Hegel denies. The third reading has great advantages compared to the first two readings in terms that it provides a suitable account of indexical knowledge on individuals while avoiding skepticism and dualism which arise in the former readings. In the midst of rapid transformation and interstate competition within the global village, the effectiveness and prestige of national government should be any priority to measure a good order of constitutional democracy, especially for the nations to be called on service provision and public welfare. The times of ideology and philosophy had waned while the diverse civilizations clash, in which the technological advance and socio-economic environment inflict a tremendous change for the private and public mode of our contemporary livings. In (...) fact, the increasing diversity and volatility of community has brought the crisis and challenge against the constitutional tradition. In this backdrop, the paper examines the relationship of those two values embedded on the states of modern constitutionalism - limited toward the modern administrative state through this new millenium. The law or right and democracy as a political ideals is not futile merely with tweaks, but foundational or inseparably entwined into the value system of modern minds. We can be clear if to imagine of the times for the divinity of monarchy or feudal piety. The civil revolution for modern constitutionalism created a new order of society and nations began or manage to practice their national politics and administration on its basis. The recent tumultus in South Korea, stretching from the candlelight vigil through theimpeachment and incrimination of lady president, actually imprinted a deep wake for the politics of Koreans. In this line of thought alignment, the concept of democratic experimentalism engrafted with the rule of constitution was revisited that could give a lesson as a sedative meliorism for the radicalism or mob politics. Additionally, I presented some of brief evaluation about the Korean ways by gathering my thoughts on the candlelight vigil. Despite both of strengths and weaknesses on the theory of democratic experimentalism, I cordially suggest that it could work as a model to meet the increasing need of national competitiveness, participation, information sharing and learning as well as the protection of civil rights embedded on the constitutional tradition. The author surveyed the theory and practice of equal protection under the US constitutionalism.

This paper intends to articulate the jurisdictional issue of the Court of International Trade(CIT), particularly dealing with a legal dispute of the Anti-dumping law. While the international trade grows to be marshaled by a new institutional arrangement of WTO dispute settlement system, the role of CIT correspondingly plays a great deal of effect on this area of laws. It is considered that both arbitrating institutions have to drive a reasonable rule over the trade issues. This is particularly so in various (...) viewpoints. The law of USA has influenced significantly over WTO, and its take is fairly greater than other WTO members in economic terms. Under this background, I attempt to probe an attitude of CIT in dealing with jurisdictional issues including the extent of judicial activism and theoretical ground for resolving those issues while providing a comparative articulation to the general doctrine of administrative law. I also point out the significance as well as characteristics of jurisdictional issue in terms of the U. S. legal system, which, I hope, can provide a little guidance to the current Korean jurisprudence. Lastly, I stress the need for judicial reform within Korea as well as more affluent provision of legal counselling, which I think vital to accommodate a rapid development of trade environment. This paper surveys, not exhaustively but rather in summary, the development of legal philosophy surrounding the constitutional and international laws as corresponding that of world politics from the first world war through the formation of WTO governance. The world has changed gradually thus far while the westerners have long forge their hegemony through the recent US one. Before the dusk of new millennium, the political scientists entertained the version of US uni-pole in terms of world politics. Its version have confront (...) new development of world politics surrounding the rise of EU, China, and Japan. In this backdrop, they frequently mention bi-polar or multi-polar consequence of world politics. The politics are normally juxtaposed to the legal regime where the constitutional and international law reflect the fare of world politics. In other words, it subjugates in some form of legal regime whether the constitutional law surfaces strongly over international dimension for some superpower. In other dimension of power balance, the international law surges to legally govern the world politics. According to Rubenfeld, the first case represents a democratic constitutionalism while the later case, in legal terms, is related with the international constitutionalism. I would propose in thesis purpose to divide three stage of world politics. The first one is surge of the German empire to pursue world hegemony at the start of two world wars. In this period, the constitution has highlighted in ways of resolutionism, incorporatism or unilateralism. The second period runs from post world war to 190's while the pacifists or cold war dominate the world politics. In this era, UN works in the least as a symbol of world politics, and the international laws mater over the domestic laws. Hans Kelsen, a German legal positivist, led the post-war world politics in legal ways as demonstrated in his foundational influence over the formation of United Nations. In this flow, I suppose that the world politics turned on the pacificist road until the rise of US hegemony. As the bipolar system collapse upon the dismantlement of Soviet Union, US rise as a unitary world hegemony. In reflection, the unilateral constitutionalism enjoys an influential passion of that nation. As EU and China started to voice as political power in the international dimension, the international law and constitutionalism flourish while we cognize WTO as one of crucial products in such point of view. Hart, a European legal positivist is again contested to prove who governs the world in terms of legal theory adapted to the WTO's intrinsic and its function. (shrink)

The paper aims at rethinking the traditional understanding of commercial law, and tentatively provides its cosmopolitan concept under the backdrop of extended commercial exchange and corresponding development of the transnational trade laws. Given the influence of legal positivism over the source of law debate, the commercial law would be defined in a relatively narrower focus, which principally presumes the sovereign nature of legal community. The phenomenon and interactive reality in this global sphere through the mid-20th century and new millennium have (...) driven us to experience new ways of dealings, sometimes blurring or otherwise encroaching upon a conventional discourse about the true nature of laws. In one way of efforts to accommodate such new phenomena, the author likes to present a possibility of more systemic, comprehensive, reality-oriented construction of commercial law concept concerning the current wave of legal pluralism. It became increasingly pervasive in our daily experiences that the norms of various nature have a potential to govern the commercial relationship. These norms, unlike the traditional state laws, are observed to poses a distinctive feature requiring a coherent understanding among another. This conceptual work also could mater with the traditional concept of sovereignty-driven commercial law. The paper will begin with the theoretical essence of legal positivism propounded by Hart and Raz. Particularly, the five strands of legal system would provide the basis of analysis, and could be compared to the narrative of legal positivists. For the purpose of this thesis, they would be contested to favor the strengths of cosmopolitan concept of commercial law. For an illustration,the author would argue that the shared agency element as well as recognition process of norms can give us more genuine understanding of the commercial law and practices. In this way, the author discuses and proposes a new concept focusing on the contemporary commercial law. Finally, he pointed out the critical needs of this kind of definitional work notwithstanding the legal plane or global diversity. In many ways, the paper would be found tentative, epitomizing, less exhaustive as trade-offs for a comprehensive build-up. The author also regrets to curtail much potentials of opposing arguments against the cosmopolitan understanding of commercial law. 미합중국은 하나의 국가이다. 그리고 그 國家性에 관한 법적 성격은 우리나라와 같은 단 일국가의 경우와는 달리 연방국가이다. 정치적으로나 대외관계에 있어 하나의 국가로 행동하고 국제법적으로도 하나의 국가로 취급되고 있지만, 聯邦政府와 州와의 관계에 있어 어떠한 구도로 헌법체계 내지 국가체계가 이루어져 있는가는 헌법을 연구하는 학도로서 매우 궁금한 주제가 아닐 수 없다. 이 문제는 한 두 논문으로 해결할 수 없는 매우 광범위한 학문적 문제를 함유하고 있는 것이 사실이다. 물론 그 핵심에 위치하고 있는 것은 단일국가의 경우 와 같이 연방국가의 국가구성에 관한 합의를 담고 있는 연방헌법임은 물론이고, (...) 또 그것이 그 문제에 관한 유일한 권위이다. 이 복잡한 주제를 살펴봄에 있어 본고에서는 가장 소박하게 연방의회와 연방법원의 권한을 살펴 봄으로써 연방국가와 주간의 국가성의 문제의 일각을 해결하여 보려고 시도하였다. 쉽게 말하면 연방국가 내지 연방정부는 단일국가의 중앙정부와 같은 포괄적이고 최고인 통치권을 행사할 수 있는 것이 아니고, 주의 國家性에 배치되지 않는 한도내에서 일부의 통치권을 연방헌법으로부터 부여받고 있다. 물론 연방에 관한 사항에 관하여는 연방헌법 및 연방법의 최고성의 원칙에 따라 연방정부의 권력은 주의 권력에 우선하지만, 그 범위는 제한적이라는 것이다. 따라서 연방의회 및 연방법원의 권한의 범위를 확정하는 것은 연방국가의 통치구도를 이해하는데 있어 매우 중요하다 아니할 수 없다. 州行政府와 聯邦行政府의 권한의 문제는 각 행정부가 연방의회 및 주의회에 의하여 제정된 법률을 충실히 집행하면 되므로 연방의회의 권한을 살펴보면 그 문제는 자연히 해결되는 측면이 있다. 물론 연방대통령은 연방법률의 집행권한외에 연방헌법에 부여된 권한(예컨대 사면권, 법률안거부권 또는 국군통수권 등)을 행사할 수 있는 것은 물론이다. 따라서 연방행정부의 권한의 범위는 논의에서 제외하였다. 한편 연방법원의 권한을 본고의 대상으로 한 것은 연방대법원은 주법률에 대한 위헌심사는 물론이고, certiorari를 통하여 주의 최고법원에 대한 司法的 統制를 행한다는 점에서(따라서 연방대법원은 일반적으로 연방국가의 유지에 있어 중요한 위치를 담당하고 있다고 평가된다) 본고의 주제와 밀접한 관계가 있을 뿐만 아니라, 연방법원은 순수한 주 내부의 사법적 분규가 아닌 사항(예컨대 다른 주 시민간의 소송 등)에 관하여 사법권을 행사함으로 인하여 연방과 주의 권한의 한계점에 위치하고 있기 때문이다. 1994년 WTO의 탄생으로 세계는 국제통상에 있어 法의 支配를 실현시켜 나가 고 있다. 무역의 자유화와 확대를 통한 인류복지의 증진과 공정무역의 실현을 위 한 정의로운 競爭規則의 정립을 향하여 나아가고 있는 것이다. 통상과 관련하여 인류에게 다가오는 새로운 의제에 대한 논의(소위 New Round) 역시 WTO 및 OECD를 중심으로 한 세계 각국의 지혜가 요구된다. 그러나 국제통상질서에 관 한 인류의 업적과 향후의 동태적 발전에 있어 인권법적 시각이 부족한 것은 아쉬 운 일이다. 즉 경제적 實利추구를 위한 전략적·국제경제법적 시각과 함께 인권보 장을 위한 노력이 필요하다고 보며, 본고는 국제통상을 (...) 주도하는 다국적기업과 관련하여 인권보장의 문제를 제기한다. 다국적기업의 본질을 살피고, 국제사회에 있어 통상과 관련한 인권문제의 성격과 범주, 기존의 인권보장활동의 주요내용과 문제점, 인권보장에 있어 실효성 있는 모델을 試論的으로 살펴보고, 향후의 과제 와 관련하여 인권침해의 유형화를 시도한다. 世界化는 우리 경제의 현실이자 우리의 일상을 지배하고 있다. 그러나 기존의 세계화에 대한 우리의 관심은 경제영역을 중심으로 전개되고 있다. 세계경제의 밀도증가는 이를 관리할 수 있는 정치․경제적 패러다임을 요구하게 된다. 국제형사재판소의 설립 및 최근 우리 외교력의 신장과 함께 차제에 법학자로서 국제적 차원의 民主主義와 法治主義의 가능성을 살펴보는 것은 의미가 있다. 민주주의의 장으로서 국제사회는 국가사회와는 다른 다양한 변수가 있으며, 이를 이론적으로 체계화·제도화하는 것은 쉬운 일이 아니다. 또한 민주주의와 법치주의가 실현되는 것은 제도 이전에 시민의 자각을 필요로 한다. 세계시민의 자각과 참여가 전제된다면, 현재의 단계에서도 미흡하나마 국제적 (...) 차원의 민주주의와 世界法體制에 의한 법의 지배가 가능하다고 본다. 즉 신체의 자유, 소유권의 보호, 경제행위의 자유 등 기본적 인권이 보장되고, 다차원적인 국제통치 구조를 가지고 있다는 것이다. 본고에서는 法史的․法哲學的 觀點에서 가장 순수한 이론적 프레임워크인 켈젠의 주장을 시작으로, 정치․법제적 현실 및 이론적 문제점 등에 관하여 살펴본다. 즉 민주주의의 기본원리인 시민참여, 토론과 대화, 다수결, 소수자보호 등에 기초하여 이론과 현실을 고찰하는 한편, 국제법의 발전과 가칭 세계법체제의 메카니즘 및 그 역사적 발전 및 성격에 관하여 살펴보고, 그 의의를 규명한다.
