Reinach est connu pour défendre une théorie a priori du droit civil. Cette position, qui se dit inspirée de Husserl, est usuellement qualifiée de « platonisme » dans la littérature secondaire. Elle se comprend comme intuition des essences, projet de phénoménologie eidétique que Reinach fait remonter à Platon. Une position qui est rejetée par Reinach en philosophie du droit est le « psychologisme », thèse tendant à expliquer le droit par référence à la psyché. L’hostilité de Reinach à l’égard du (...) psychologisme semble être une hostilité à l’égard de lui-même : en tant qu’élève de Lipps, Reinach avait écrit une thèse sur la notion de causalité en droit pénal, dans laquelle il faisait jouer à la psychologie un rôle fondateur pour le droit. Dans mon exposé, je retracerai l’évolution de Reinach sur ces questions, en repartant de sa thèse et des travaux de Lipps sur lesquels elle se base pour la comparer aux écrits reinachiens plus tardifs et leur rapport tant à Platon qu’à Husserl. This paper argues that early phenomenologists used the concept of empathy not only to refer to the direct perception of the other’s experiences – as underscored by contemporary proponents of the Direct Perception Theory – but also to describe – in a sense close to Lipps’s theory and contemporary Simulation Theory – how, by virtue of imagining, we “feel into” animate and inanimate objects. Focusing on this second usage of the term, two kinds of imagination-based accounts of empathy in (...) early phenomenology are identified. According to “radical imaginationists”, empathy can be explained in terms of the series of imaginative processes entailed in the idea of “feeling into”, such as projecting oneself into the target, “imitating” its feelings, and resonating with it. Voigtländer’s account of empathizing with one’s own self in Vom Selbstgefühl (1910) and Geiger’s account of empathy with atmospheres in “Zum Problem der Stimmungseinfühlung” (1911) can in this sense be regarded as radical imaginationist theories. According to “moderate imaginationists”, empathy might (but need not) entail imagining. Stein’s account of empathy with others in On the Problem of Empathy (Zum Problem der Einfühlung) (1917/1989) as a three-step process which can involve imagination-like states is a good example of a moderate imaginationist account. Nietzsche is not known for his theory of empathy. A quick skimming of the Stanford Encyclopedia of Philosophy entry on empathy demonstrates this. Arthur Schopenhauer, Robert Vischer, and Theodor Lipps are among those whose views are considered representative, but Nietzsche has been simply forgotten in discussion of empathy. Nietzsche’s theory of empathy has not yet aroused sufficient interest among commentators. I believe that his views on this subject merit careful consideration. Nietzsche scholars have been interested in his naturalistic accounts (...) of other phenomena, but there seems to be relatively limited interest in his naturalistic account of a phenomenon that is so central to his disagreement with Schopenhauer, namely, empathic concern for others. This is surprising because Nietzsche makes a valuable contribution; he has views more in keeping with contemporary theories of empathy than others of his time. My goal here is to fill in this gap in the scholarship and provide the first thorough analysis of Nietzsche’s theory of empathy, which appears most clearly in Dawn. (shrink)

The article analyses the history of the Einfühlung concept. Theories of ‘feeling into’ Nature, works of art or feelings and behaviours of other persons by German philosophers of the second half of the nineteenth century Robert and Friedrich Vischer and Theodor Lipps are evoked, as well as similar theory of understanding (Verstehen) by Wilhelm Dilthey and Friedrich Schleiermacher, to which Dilthey refers. The meaning of the term Einfühlung within Edith Stein’s thought is also analysed. Both Einfühlung and Verstehen were (...) criticized as non-objective and naive methods consisting only in the identification of the subject with the object or the projection of feelings onto the object. The article refers to criticism by Georg Gadamer and Bertolt Brecht and proposes ways to restitute the concept of Einfühlung after this criticism, recalling the theory of empathy by Dominick Lacapra, in terms of its advantages for the historical enquiry, or the myth of Narcissus analyzed in the spirit of psychoanalysis by Julia Kristeva. The article proposes a reformulation of the concept of mimesis, connected to the Einfühlung, understood as the identification, analogy, imitation of feelings (as it was described by Lipss and Vischer). Mimesis does not necessarily mean a passive repetition and reconstruction of the feelings of the object, but serves only as a starting point for the interest of the subject for the outside world or for experiences of historical protagonists. Then there is no identification or projection of feelings, but the creative, active and critical reformulation of knowledge. It is stated that empathy is not a passive, uncritical process, but that it deals with the critical choice of the object of empathy and with an active approach to the perceived feelings and appearances. In addition to this cognitive aspect, empathy may also contribute to the analytical and valuable introspection. Furthermore empathy allows us to connect the analysis of the facts with a personal narrative and understanding of individual identity in historical knowledge. (shrink)

Vor etwa einem Jahrhundert entwickelte sich im deutschsprachigen Raum imRahmen einer allgemeinen Charakterisierung unserer ästhetischen Erfahrungvon Kunst eine umfassende Debatte über die Natur und die Möglichkeit vonGefühlen über fiktionale Charaktere und Situationen. Die damalige Debatteweist große Ähnlichkeit zur heutigen analytischen Debatte über das Paradoxonder Fiktion auf. Trotz des unterschiedlichen jeweiligen historischen Kontextesfindet sich in der analytischen Debatte und in der Philosophie zu Beginn des20. Jahrhunderts fast der gleiche Lösungsansatz. Gefühle über Fiktionen seienQuasi-Gefühle, d.h. ein gefühlsartiges Phänomen mit einer Realität sui (...) generis ,dem im Unterschied zu den wirklichen Gefühlen kein Urteil über die Existenzdes Objektes zugrunde liegt und dem die Verbindung zur Motivation fehlt. Zieldieses Aufsatzes ist es, eine Untersuchung der These der Quasi-Gefühle An-fang des 20. Jahrhunderts zu unternehmen sowie die Analogien zur heutigenDebatte zu zeigen. Der Aufsatz baut sich um drei thematische Achsen herumauf. Zunächst wird eine historische Darstellung der These der Gefühle über Fiktionen bei Groos, Lipps, Lange, Geiger und Külpe unternommen. Diese bil-det den Rahmen für die Debatte über die Quasi-Gefühle in der Grazer Schule.Anschließend wird die Aufmerksamkeit auf die Diskussion über Quasi-Gefühle bei Meinong, Witasek, Saxinger und Schwarz gerichtet. Zuletzt wer-den die Berührungspunkte zur heutigen analytischen Debatte im Ausgang vonsystematischen Fragen aufgezeigt. (shrink)

The aim of my paper is to show how the two concepts of psychology and anthropology are linked in the philosophical reflection of some german authors between the end of 19th and the beginning of the 20th century: I discuss in particular the theories of W. Dilthey, W. Wundt, T. Lipps, W. Windelband and H. Cohen. I find a line of demarcation that divides their theoretical positions and concerns the role that psychology should play in relationship to the investigation (...) on the human nature. In front of statements for which psychology represents the basis for an anthropological proposal there are philosophical assumptions according to which such an idea has to be comprehended as a form of anthropologism or psychologism. Instead of studying facts and connections of facts a well founded anthropological research should be transcendental and start from the Kantian question about the conditions of the possibility of the human nature. This entry presents Voigtländer's definition, characterization and taxonomy of the feeling of self-worth.

The article analyzes Petro Kudriavtsev’s historical philosophical conception in the context of basic tendencies and reference points of development of historical philosophical science in Europe in 19th – the beginning of 20th cent. For this purpose, the place and significance of reception of European philosophy in the P. Kudriavtsev’s historic philosophical works are identified. Furthermore, the article discusses the complex of philosophical and historical ideas that appeared to be productive for development of Kudriavtsev’s original historical philosophical conception. The latter is (...) proved to be formulated in the process of deep creative interpretation of European historical philosophical studies achievements (Hegel, Wilhelm Windelband, Kuno Fisсher), such as ethics and philosophical constructions of the European thought (Kant, Theodor Lipps, Friedrih Paulsen, Joseph Petzold, Ernst Mach, Herbert Spencer, Auguste Comte). The author finds out the particularity of the P. Kudriavtsev’s original approach to understanding of historical philosophical process, based on comprehension of rationalism and empiricism (positivism), two opposite models of historical philosophical knowledge. Besides, the author argues for the similarity in approach to the history of philosophy between P. Kudriavtsev and the representatives of historical-philosophical tradition after Hegel (Wilhelm Windelband, Kuno Fisсher). Reconstruction of P. Kudriavtsev’s historical philosophical conception allows the author to conclude, on the one hand, that conception reflected one of the central problems in Western European philosophy on the edge of 19 th – 20 th centuries – the problem of values. On the other hand, the conception was aimed to oppose the relativistic and nihilistic tendencies, which dominated in Modern European philosophy. (shrink)
