Activity theory has long been an influential framework in the field of education. However, its theoretical concepts are not easily grasped by scholars, mainly due to difficulties in translation from the original Russian works, the complexity of these concepts and multiple versions embedded within the tradition. The two major approaches within activity theory were established by Leontiev and another version proposed later by Engeström, and they have often been confused and conflated together in the literature. This paper provides a (...) much-needed theoretical comparison between these approaches in regard to the field of education. The criteria for comparison involve their theoretical foundations, central phenomena of interest, key theoretical concepts, units of analysis and explanatory mechanisms. Insights from this paper contribute to establishing a more refined understanding of activity theory and its variants, which in turn allows researchers to make more informed decisions when selecting and using these frameworks. Implications for practical research practices are discussed with examples from the area of teacher professional development. (shrink)

Non‐governmental aid programs are an important source of health care for many people in the developing world. Despite the central role non‐governmental organizations play in the delivery of these vital services, for the most part they either lack formal systems of accountability to their recipients altogether, or have only very weak requirements in this regard. This is because most NGOs are both self‐mandating and self‐regulating. What is needed in terms of accountability is some means by which all the relevant stakeholders (...) can have their interests represented and considered. An ideally accountable decision‐making process for NGOs should identify acceptable justifications and rule out unacceptable ones. Thus, the point of this paper is to evaluate three prominent types of justification given for decisions taken at the Dutch headquarters of Médecins sans Frontières. They are: population health justifications, mandate‐based justifications and advocacy‐based justifications. The central question at issue is whether these justifications are sufficiently robust to answer the concerns and objections that various stakeholders may have. I am particularly concerned with the legitimacy these justifications have in the eyes of project beneficiaries. I argue that special responsibilities to certain communities can arise out of long‐term engagement with them, but that this type of priority needs to be constrained such that it does not exclude other potential beneficiaries to an undesirable extent. Finally, I suggest several new institutional mechanisms that would enhance the overall equity of decisions and so would ultimately contribute to the legitimacy of the organization as a whole. In recent years we may observe increasing interest in the development of social innovation both regarding theory as well as the practice of responding to social problems and challenges. One of the crucial challenges at the beginning of the 21st century is population ageing. Various new and innovative initiatives, programs, schemes, and projects to respond to negative consequences of this demographic process are emerging around the world. However, social theories related to ageing are still insufficiently combined with these new practices, (...) social movements, organisational models, and institutions. Many scholars are still using notions and tools from classical theories of social gerontology or the sociology of ageing such as disengagement theory, activity theory, and successful and productive ageing. Such theories do not sufficiently explain ageing in the context of, for example, a broad use of the information and communications technologies including robotics and automation, new healthcare and long-term care models, advancements in the development and governance of age-friendly environments, and public engagement of older adults into co-production of services delivered by public, private, non-governmental as well as non-formal entities. There have long been calls from industry for guidance in implementing strategies for sustainable development. The Circular Economy represents the most recent attempt to conceptualize the integration of economic activity and environmental wellbeing in a sustainable way. This set of ideas has been adopted by China as the basis of their economic development, escalating the concept in minds of western policymakers and NGOs. This paper traces the conceptualisations and origins of the Circular Economy, tracing its meanings, and exploring its (...) antecedents in economics and ecology, and discusses how the Circular Economy has been operationalized in business and policy. The paper finds that while the Circular Economy places emphasis on the redesign of processes and cycling of materials, which may contribute to more sustainable business models, it also encapsulates tensions and limitations. These include an absence of the social dimension inherent in sustainable development that limits its ethical dimensions, and some unintended consequences. This leads us to propose a revised definition of the Circular Economy as “an economic model wherein planning, resourcing, procurement, production and reprocessing are designed and managed, as both process and output, to maximize ecosystem functioning and human well-being”. Thomas Pogge and Andrew Kuper suggest that we should promote an ‘institutional’ solution to global poverty. They advocate the institutional solution because they think that non-governmental organizations (NGOs) can never be the primary agents of justice in the long run. They provide several standard criticisms of NGO aid in support of this claim. However, there is a more serious problem for institutional solutions: how to generate enough goodwill among rich nation-states that they would be willing to commit themselves to (...) supranational institutional reforms. In the current international political climate, the implementation of such institutional reforms introduces several intractable problems, including difficulties of global coordination and enforcement. I defend the solution of NGO aid from the criticisms presented by Pogge and Kuper, and propose how it might be reformed. My main suggestion is that all practising NGOs should be required to be ‘accountable for reasonableness’ in the sense that Norman Daniels and James Sabin have outlined. (shrink)

Greatly aided by an information age in which protesting laborers in a remote offshore outpost can capture front page headlines around the globe, theSarbanes-Oxley Act of 2002 (SARBOX) has made corporate transparency the linchpin for good corporate governance. Under a SARBOX-enhancedregulatory framework, publicly traded corporations are required to rapidly disclose material changes in their financial conditions or operations—changes such as impairments to goodwill, a trademark, or some other intangible corporate asset. Especially challenging for multinational corporations (MNCs) with far-flung corporate empires (...) is the need to stay abreast of the ebb and flow of goodwill, at a time when transnational human rights groups are aggressively mobilizing world opinion against the sweatshop labor conditions that abound at the offshore production sites favored by MNCs. The author explains why the convergence of a digital age of free-flowing information and the advent of SARBOX, a legislative enactment of paraenetic design, is causing the boards of MNCs to more critically evaluate the long-term costs of their offshore operations. (PTOJ) - The cultural value system is one of the core and fundamental value systems in Vietnam and is part of the foundation to ensure the country's sustainable development. This article analyzes the building of a Vietnamese cultural value system in the context of the Fourth Industrial Revolution, which has a significant impact all aspects of social life, including the cultural sector.

This article takes up the idea of language as a home and dwelling, and reconsiders what this might mean in the context of diasporic bilingualism – where as a ‘heritage speaker’ of a minority language, the ‘mother tongue’ may be experienced as both deeply familiar yet also alien or alienating. Drawing on a range of philosophical and literary accounts (Cassin, Arendt, Anzaldúa, Vuong, among others), this article explores how the so-called ‘mother tongue’ is experienced by heritage speakers in an English-dominant (...) world. From navigating one’s being in-between language-worlds, to the experience of language loss and efforts of reconnection, I argue that bilingual dwelling involves many complex layers often overlooked by philosophical accounts of language that do not attend to the lived world of the migrant and racialised outsider. By turning to the example of bilingual parenting, I then examine how such an undertaking, while labour-intensive, offers opportunities to refresh and co-create language-worlds anew. (shrink)

It soon became the reason for life, the ideal, and the belief in the spiritual life of the Vietnamese people. The purpose of this paper is to provide a comprehensive and in-depth view of patriotism as a specific philosophy of the Vietnamese nation. It discusses the basic tenets of Vietnamese patriotism: the spirit of independence, self-reliance, the sense of national self-reliance, solidarity in national construction and defense and a humanistic spirit. As many scholars have written about the Vietnam War, this thesis, Forgotten Memories: Re-Constructing the Vietnam War in Films, explores a different approach to this topic by examining films. Historical films are becoming increasingly important in shaping the way the past is understood and remembered. After the war ended, many Hollywood films have continued to capture the atrocities of the war that affected the war narrative of the Vietnam War. American politics and the public suffered from the Vietnam Syndrome, and (...) they lost confidence in the military and government structures. These emotions are translated into Hollywood films about the Vietnam War. The victory of the Gulf War in 1991 finally helped them to get out of the shadow of that psychological fear in foreign intervention. The Vietnam War films have made its comeback after the September 11th attacks. Many scholars have compared the war against terrorism is similar to the war against communism in the 1950s. Over the years, Hollywood has produced many films that are either directly about or set against the backdrop of the Vietnam War. The different representations of the Vietnam War presenting in both American and Vietnamese films produced between 1979 and 2005 explain how the film war narrative reconstruct the memory of history. By examining both American and Vietnamese films about the Vietnam War, this study calls attention to the importance of the Vietnamese experience in our understanding of the Vietnam War and brings an international perspective to the study of this subject in cultural and film studies. By identifying trends and discussing similarities and differences in film-narrative tropes across both American and Vietnamese films about the Vietnam War, this research argues that the film industry has shaped the collective memory of the Vietnam War. In doing so, Hollywood has highlighted the memorable and traumatic events that occurred during the war to construct the film narrative and generate a widespread perception of v the war. Vietnam’s government, due to the war’s destruction, made it a top priority to rebuild the economy and used films to deliver only social propaganda, expressing its gratitude and sympathy to families who lost their loved ones in the war. Starting with the first international publication of Le Van Thiem (Lê Văn Thiêm) in 1947, modern mathematics in Vietnam is a longstanding research field. However, what is known about its development usually comes from discrete essays such as anecdotes or interviews of renowned mathematicians. We introduce SciMath—a database on publications of Vietnamese mathematicians. To ensure this database covers as many publications as possible, data entries are manually collected from scientists’ publication records, journals’ websites, universities, and research institutions. Collected data went (...) through various verification steps to ensure data quality and minimize errors. At the time of this report, the database covered 8372 publications, profiles of 1566 Vietnamese, and 1492 foreign authors since 1947. We found a growing capability in mathematics research in Vietnam in various aspects: scientific output, publications on influential journals, or collaboration. The database and preliminary results were presented to the Scientific Council of Vietnam Institute for Advanced Study in Mathematics (VIASM) on November 13th, 2020. (shrink)

At the social turn in education, Vygotsky's cultural-historical/sociocultural theory (VST) has become particularly influential. There are other cultural-historical traditions associated with VST, including Leontiev's and Engeström's versions of cultural-historical activity theory (CHAT). These approaches are frequently conflated, resulting in confusion that can be consequential in interpreting educational research findings. Unravelling these frameworks is thus an important and urgent task. In addressing this gap, the paper first provides an overview of the origins and fundamental tenets of these cultural-historical perspectives, followed by (...) a critical evaluation of and comparison among them. Vygotsky’s sociocultural theory (VST) has been increasingly utilised as an effective framework to account for the role of emotions in learning and development. Yet, within VST, emotion has neither been systemically theorised nor investigated. This paper contributes to the literature by offering a theoretical discussion of Vygotsky’s perspective on emotion and its relation to cognition. Employing a content analysis approach, three of Vygotsky’s key texts on emotions were closely read and analysed with emerging themes grouped into a system of interrelated (...) theoretical tenets. The insights gained from this paper benefit scholars who are interested in understanding and researching emotions from a VST perspective as well as provide important implications for educational practices. This paper is a response to Anthony Brueckner's critique of my essay "The Self-Defeating Character of Skepticism," which appeared in Philosophy and Phenomenological Research in 1992. In this reply I contend that the three main avenues by which one might plausibly account for one's self-awareness are unavailable to an individual who is restricted to the skeptic's epistemic ground rules. First, all-encompassing doubt about the world cancels our "external" epistemic access via perception to ourselves as material individuals in the world. Second, (...) one does not have direct cpistemic access to one's substantial self through introspection, since the self as such is not a proper object of inner awareness. Third, we cannot claim, as Descartes did, that we have indirect epistemic access to the substantial self by inference from the occurrence of experiences.The summary conclusion for which I argue is that, if we are to account for our self-knowledge, we cannot adopt the purely subjective epistemological stance that is at the heart of global skepticism. As part of this effort, the breast-milk substitutes industry is proposing to use renewable gas as a (...) substitute for fossil natural gas. However, decarbonising the industrial processing of breast-milk substitutes can increase social license for these products, potentially undermining breastfeeding. World Health Organisation nutrition targets aim to increase exclusive breastfeeding to at least 50% globally by 2025 to improve maternal, infant, and young child health and nutrition. This target will have implications for the energy transition. A weakness of existing energy models is that demands for end-use products such as breast-milk substitutes are typically not considered explicitly. This paper develops an analytical framework for explicitly representing infant feeding methods in energy systems models. We compare the emissions saved in Ireland from decarbonising the industrial processing of breast-milk substitutes with renewable gas with the emissions saved by an increase in exclusive breastfeeding to 50% in both Ireland and a key export market, China. We demonstrate that the emissions saved from achieving the minimum global breastfeeding target are greater than when renewable gas is used to displace natural gas in the production of breast-milk substitutes in Ireland. We discuss the decarbonisation of breast-milk substitutes in relation to the principle of justice as non-maleficence, a principle based on the commitment to avoid harm, a novel application of a principle of justice. We conclude that breastfeeding support can be considered a demand-side measure for mitigating climate change by reducing the demand for energy services to produce breast-milk substitutes. A key recommendation is to position breastfeeding support as both a public health and a climate justice issue that is relevant for a just transition. The framework developed for this paper could be applied to support the inclusion of a wider range of mitigation options with social justice outcomes in energy system models. [Open access]. (shrink)

To achieve herd immunity against Covid-19, the willingness of residents to get vaccinated and successful vaccination policies go hand in hand. This paper aims to understand the perceptions, acceptance, hesitation, and refusal of Covid-19 vaccines in Nghe An, Vietnam. We used an online survey to collect data during March of 2021. The Bayesian regression model (BRM) was used to identify the factors affecting vaccination decisions. The empirical results show that respondents’ livelihoods were considerably affected by the Covid-19 pandemic, and there (...) was a subtle difference in Covid-19 impacts on the lives of urban residents and their rural counterparts. In addition, respondents reported an overall positive attitude towards Covid-19 vaccination in which 84.28% were willing to get vaccinated, 14.85% were hesitant, and 0.87% refused vaccination. Their vaccination decisions were associated with vaccine side effects, information, income, job type, gender, and trust in government. Our findings offer policy implications for devising strategies for vaccine distribution in the study area and beyond. (shrink)

In recent decades, Vygotsky’s sociocultural theory (VST) has become particularly influential in the fields of education and educational psychology. Perezhivanie is an important concept in VST that stipulates a relative influence of environment on a person’s psychological development depending on their age or stage of development. However, perezhivanie has been differentially interpreted and applied in previous literature to suit the purposes of domain-specific research. The lack of a comprehensive theoretical understanding of the concept can undermine research findings and their implications (...) for educational practices. Drawing on a content analysis of Vygotsky’s key texts on perezhivanie, this paper provides a much-needed theoretical discussion that unpacks comprehensively the theoretical content of perezhivanie and the methodological principles guiding its application. The findings revealed that conceptually, perezhivanie can be defined as: (a) a theoretical relation between an individual and their environment, (b) an abstract experience of or attitude towards a life situation and (c) a concrete lived experience of an event within that situation. Four major discernible components of an individual’s perezhivanie include the environmental factor, personal characteristics mobilised, refraction prism and psychological influences. Five key methodological principles were conceived to assist the employment of perezhivanie in educational/psychological research: (1) utilising a perezhivanie as a unit of analysis, (2) analysing perezhivanie at different levels, (3) accounting for the perspective of the individual involved, (4) constructing the refraction prism and (5) determining the major personal characteristics mobilised in the perezhivanie. Responsible innovation (RI), also termed Responsible Research and Innovation, has emerged due to increasing concern over how to integrate ethical and societal values into research and innovation policy and governance (Von Schomberg 2013), in response to questioning of the societal role of science as well as populist resurgence in some countries (Long and Blok 2017a). Within a RI approach, innovators must consider three dimensions of responsibility, including the dimensions of (1) ‘avoiding harm’ to people and the planet, (2) ‘doing (...) good’ through the offering of innovations that foster sustainable development, and (3) the development of facilitative global governance schemes (Voegtlin and Scherer 2017). ChatGPT – a large language model – recently passed the U.S. bar exam. The startling rise and power of generative artificial intelligence (AI) systems such as ChatGPT lead us to consider whether and how more specialized systems could be used to overcome existing barriers to the legal system. Such systems could be employed in either of the two major stages of the pursuit of justice: preliminary information gathering and formal engagement with the state’s legal institutions and professionals. We focus on (...) the former and argue that developing and deploying publicly funded AI legal advisors can reduce economic and shame-based cultural barriers to the information-gathering stage of pursuing justice. Responsible innovation is a key response to the grand challenges faced by society, helping to develop innovations with society in mind, and limit any unintended consequences. Responsible managers with influence over innovations need knowledge and understanding of how responsible innovation applies to their roles and how as individuals they can manage innovation responsibly. But by rejecting only part of the traditional substratum theory instead of replacing it entirely, Bundle Theories perpetuate certain confusions which are found in the Substratum Doctrine. (...) I examine two major types of BT developed by Russell and by G. F. Stout with the intention of showing that (1) the seemingly innocuous concept of "a quality" employed by these versions cannot be used to state their theories coherently, and (2) the fatal problems that the BT encounters point to a more satisfactory and interesting alternative to both the Substratum Doctrine and the BT. This is a view that I call the Qualified Particulars Theory. In a final section I draw morals from this discussion that apply to the analogous Humean view that a mind is a "bundle of perceptions and sensations.". (shrink)

Luck egalitarians argue that distributive justice should be understood in terms of our capacity to be responsible for our choices. Both proponents and critics assume that the theory must rely on a comprehensive conception of responsibility. I respond to luck egalitarianism’s critics by developing a political conception of responsibility that remains agnostic on the metaphysics of free choice. I construct this political conception by developing a novel reading of John Rawls’ distinction between the political and the comprehensive. A surprising consequence (...) is that many responsibility-based objections to luck egalitarianism turn out to be objections to Rawls’ political liberalism as well. (shrink)

An important source of doubt about our knowledge of the "external world" is the thought that all of our sensory experience could be delusive without our realizing it. Such wholesale questioning of the deliverances of all forms of perception seems to leave no resources for successfully justifying our belief in the existence of an objective world beyond our subjective experiences. I argue that there is there is a fatal flaw in the very expression of philosophical doubt about the "external world." (...) Therefore, no such justification is necessary. The feature of skepticism which I believe renders it vulnerable is the assumption that each of us has a right to be certain of his own existence as a subject of conscious experience even in the face of comprehensive doubt about our empirical beliefs. The idea that we may continue to exist in a bodiless condition after our death has long played an important role in beliefs about immortality, ultimate rewards and punishments, the transmigration of souls, and the like. There has also been long and heated disagreement about whether the idea of disembodied existence even makes sense, let alone whether anybody can or does survive dissolution of his material form. It may seem doubtful that anything new could be added to the (...) debate at this late date, but I hope to show that this is not so. I will explore the problem of disembodiment from a somewhat different direction than has been tried before, one that leads to what seem to me more interesting and more definite conclusions about its unintelligibility. Furthermore, the approach I will be taking puts both the traditional mind-body problem and the competing claims of dualism and physicalism in a fresh light that can help us to understand better the nature of our embodied existence. Responsible innovation (RI), also termed Responsible Research and Innovation, has emerged due to increasing concern over how to integrate ethical and societal values into research and innovation policy and governance (Von Schomberg 2013), in response to questioning of the societal role of science as well as populist resurgence in some countries (Long and Blok 2017a). Within a RI approach, innovators must consider three dimensions of responsibility, including the dimensions of (1) ‘avoiding harm’ to people and the planet, (2) ‘doing (...) good’ through the offering of innovations that foster sustainable development, and (3) the development of facilitative global governance schemes (Voegtlin and Scherer 2017). In his Meditations Descartes concludes that he is a res cogitans, an unextended entity whose essence is to be conscious. His reasoning in support of the conclusion that he exists entirely distinct from his body has seemed unconvincing to his critics. I attempt to show that the reasoning which he offers in support of his conclusion. although mistaken, is more plausible and his mistakes more interesting than his critics have acknowledged.

Some bioethicists argue that a doctor may frame treatment options in terms of effects on survival rather than on mortality in order to influence patients to choose the better option. The debate over such framing typically assumes that the survival and mortality frames convey the same numerical information. However, certain empirical findings contest this numerical equivalence assumption, demonstrating that framing effects may in fact be due to the two frames implying different information about the numerical bounds of survival and mortality (...) rates. In this paper, I use these findings to argue that framing is presumptively wrong because it violates the duty of proper disclosure. Along the way, I highlight morally relevant features affecting the permissibility of framing, tackle three objections and draw some general lessons for the ethics of nudging. (shrink)

I argue in this paper that philosophers have not clearly introduced the concept of a body in terms of which the problem of other minds and its solutions have been traditionally stated; that one can raise fatal objections to attempts to introduce this concept; and that the particular form of the problem of other minds which is stated in terms of the concept is confused and requires no solution. The concept of a "body" which may or may not be the (...) body of a person, which is required to state the traditional problem, is, on close examination, incoherent and cannot be introduced into a reasonable philosophical discussion. Luck egalitarianism makes a fundamental distinction between inequalities for which agents are responsible and inequalities stemming from luck. I give several reasons to find luck egalitarianism a compelling view of distributive justice. I then argue that it is an incomplete theory of equality. Luck egalitarianism lacks the normative resources to achieve its ends. It is unable to specify the prior conditions under which persons are situated equivalently such that their choices can bear this tremendous weight. This means that luck egalitarians (...) need to become pluralists who understand equality not merely in terms of choice, luck, and responsibility. After developing my critical argument that luck egalitarianism is incomplete, I sketch a strategy for rehabilitating and filling out the theory. (shrink)

As the title of the article suggests, “The Burqa Ban”: Legal Precursors for Denmark, American Experiences and Experiments, and Philosophical and Critical Examinations, the authors embark on a factually investigative as well as a reflective response. More precisely, they use The 2018 Danish “Burqa Ban”: Joining a European Trend and Sending a National Message (published as a concurrent but separate article in this issue of INTERNATIONAL STUDIES JOURNAL) as a platform for further analysis and discussion of different perspectives. These include (...) case-law at the international level while focusing attention on recent rulings and judicial reasoning by the ECtHR and the ECJ; critical thought-experiments in religion, morality, human rights, and the democratic public space; a contextualized account of burqa-wearing interventions by federal and state governments and, moreover, various courts in the United States; and philosophical commentary and, in some instances, criticism of the Danish and/or European (French, etc.) approach. The different contributions have different aims. The section on case-law at the international level reports on those central judgments that, in effect, helped to pave the path for the Kingdom of Denmark’s burqa ban. Concerning the concurring judges at the ECtHR, the opinions served to uphold a preexisting ban and to grant a wide margin of appreciation to the national authorities, thereby limiting the Court’s own review. -/- As regards to the ECJ, the legality of company rules that contain a policy of neutrality for the workplace was examined, with a similar outcome. The authors who discuss religion, morality, human rights and the democratic public space are endeavoring to, respectively, appeal to ethics as a testing stone for law and to both challenge and address several forms of “expressivist worry” in connection with face veils. In doing so, the authors ask a number of thought-provoking questions that hopefully will inspire public policymakers to careful analysis. While the section that is devoted to American perspectives highlights a comprehensive survey of political and legal responses to, in particular, full-face veils like the burqa, the relevant author also incorporates public perceptions and, in the course of examining these, draws a parallel to “the fate” of the hoodie. The constitutionality of burqa-wearing in America, so it also appears, is partially an open question, but differentiating between religious, political, or personal reasons is a de jure premise. Given that the Danish legislators who drafted law L 219 to ban burqa-wearing in public places rely on a reference to political Islam, they relegate religious and personal reasons to the private domain, thereby also adopting secularism as a premise. This is explored in the last author response of the article, more precisely, in an account of the underlying materialism that, in turn, is applied to Muslim women. If policymakers and legislators engaged in Thinking Things Through exercises, they could, as a minimum, avoid law-making strategies that are not in the spirit of the theory they themselves invoke, albeit tacitly. While the aim of, as it were, arresting culturally self-contradicting legislators is unique for the section in question, all the authors who contribute to the joint research project have one end-goal in common, namely to inform about important perspectives while at the same time opening up for parameters for (more) fruitful, constructive and (if need be) critical debate in the future. With this in mind, four recommendations are presented by the research director for the project. Legally, politically, socially and culturally, conflict-resolution should not translate the relationship between rulers and the ruled into a separation ideology, an instance of controllers versus the controlled. All things being equal, that is the objective limit for a democratic society. (shrink)

A debunking argument contends that some target moral judgments were produced by unreliable processes and concludes that such judgments are unjustified. Debunking arguments face a regress challenge: to show that a process is unreliable at tracking the moral truth, we need to rely on other moral judgments. But we must show that these relied-upon judgments are also reliable, which requires yet a further set of judgments, whose reliability needs to be confirmed too, and so on. Some argue that the debunker (...) faces an insurmountable regress, which disables the debunking conclusion. In this paper, I explore and defuse this regress challenge. (shrink)

I defend the thesis that psychological states can be literally ascribed only to living creatures and not to nonliving machines, such as sophisticated robots. Defenders of machine consciousness do not sufficiently appreciate the importance of the biological nature of a subject for the psychological significance of its behavior. Simulations of a computer-controlled, nonliving autonomous robot cannot carry the same psychological meaning as animate behavior. Being a living creature is an essential link between genuinely expressive behavior and justified psychological ascriptions.

Antony Duff argues that the criminal law’s characteristic function is to hold people responsible. It only has the authority to do this when the person who is called to account, and those who call her to account, share some prior relationship. In systems of domestic criminal law, this relationship is co-citizenship. The polity is the relevant community. In international criminal law, the relevant community is simply the moral community of humanity. I am sympathetic to his community-based analysis, but argue that (...) the moral community must play a greater role in the domestic case and that the collection of individual political communities must play a greater role in the international case. Much mischief concerning the concept of a human body is generated by the failure of philosophers to distinguish various important senses of the term 'body.' I discuss three of those senses and illustrate the issues they can generate by discussing the concept of a Lockean exchange of bodies as well as the brain-body switch.

Investigation of neural and cognitive processes underlying individual variation in moral preferences is underway, with notable similarities emerging between moral- and risk-based decision-making. Here we specifically assessed moral distributive justice preferences and non-moral financial gambling preferences in the same individuals, and report an association between these seemingly disparate forms of decision-making. Moreover, we find this association between distributive justice and risky decision-making exists primarily when the latter is assessed with the Iowa Gambling Task. These findings are consistent with neuroimaging studies (...) of brain function during moral and risky decision-making. This research also constitutes the first replication of a novel experimental measure of distributive justice decision-making, for which individual variation in performance was found. Further examination of decision-making processes across different contexts may lead to an improved understanding of the factors affecting moral behaviour. (shrink)

This article provides a brief introduction to some contemporary challenges found in the intersection of bioethics and international criminal law involving genetic privacy, organ trafficking, genetic engineering, and cloning. These challenges push us to re-evaluate the question of whether the international criminal law should hold corporations criminally liable. I argue that a minimalist and Strawsonian conception of corporate responsibility could be useful for deterring the wrongs outlined in first few sections and in answering compelling objections to corporate criminal liability.

Over three decades ago, in a brief but provocative essay, Paul Ziff argued for the thesis that robots cannot have feelings because they are "mechanisms, not organisms, not living creatures. There could be a broken-down robot but not a dead one. Only living creatures can literally have feelings."[i] Since machines are not living things they cannot have feelings. In the first half of my paper I review Ziff's arguments against the idea that robots could be conscious, especially his appeal to (...) our linguistic usage. In the second half of the essay I try to provide a deeper ontological understanding of why we ought not attribute minds to nonliving artifacts. I argue that inanimate mechanisms are incapable of genuinely active and purposive behavior. They are importantly different in kind from living human beings and animals. (shrink)
