There are various supernatural phenomena which hardly can be explained by the existing electromagnetic science, for instance non-locality interactions (may be associated with ESP etc), and also precognitive interdictions. And there are other problems such as how to include the Spirit in our consciousness. For example, it has been known for long time that intuition plays significant role in many professions and human life, including in entrepreneurship, government, and also in detective or law enforcement activities. Despite these examples, such a (...) precognitive interdiction is hardly accepted in established science. In this paper, we discuss non-locality interactions and also advanced solutions of Maxwell equations, and argue in favor of precognitive interdiction from classical perspective. We also discuss shortly on how “spirit” may be included in medicine, although we also make cautious remarks on the danger of “spiritism.” However, we admit that what we discuss here is quite rough, and more researches are needed to verify what we describe here. The paper compares dispositionalism about laws of nature with primitivism. It argues that while the distinction between these two positions can be drawn in a clear-cut manner in classical mechanics, it is less clear in quantum mechanics, due to quantum non-locality. Nonetheless, the paper points out advantages for dispositionalism in comparison to primitivism also in the area of quantum mechanics, and of contemporary physics in general.

For Humean atomists, cosmic contents supervene on a spatiotemporal mosaic of modally insulated, freely recombinable local qualities. One piecemeal subspecies of Humean atomism promises more than global supervenience—somehow or other—on a separable base; it constrains how exactly elemental inputs yield everything else. Roughly, the distribution of basic local qualities across elements in one part of our cosmos metaphysically suffices for the complete local physical state of that part: anything sharing this part’s basic elemental decoration should share its (...) more complete contents, regardless of what may be happening elsewhere. On a non-piecemeal alternative, derivative contents can be recognizably local to, or manifest within, one part of our cosmos while reflecting some more global elemental base. To develop this alternative, non-piecemeal Humeans can borrow inspiration from some critics of Humean supervenience, who already distinguish a broader notion of locality from strict Humean intrinsicality. In this chapter, Card suggests that the non-ideal part of Rawls’ Law of Peoples can be a resource for thinking about responding to evils when the subject is not state-centered. It is plausible that defense against great evils other than those of aggressive states should be governed by analogues of scruples that Rawlsian well-ordered societies observe in defending themselves against outlaw states. This essay explores those hypotheses (...) in relation to women’s self-defense and mutual defense against evils of misogyny, the term feminists apply to the most deeply hostile environments of and attitudes toward women and girls and to the cruelest wrongs to them/us, regardless whether perpetrators harbor feelings of hatred. The paper shows how the Bohmian approach to quantum physics can be applied to develop a clear and coherent ontology of non-perturbative quantum gravity. We suggest retaining discrete objects as the primitive ontology also when it comes to a quantum theory of space-time and therefore focus on loop quantum gravity. We conceive atoms of space, represented in terms of nodes linked by edges in a graph, as the primitive ontology of the theory and show how a non-local law in (...) which a universal and stationary wave-function figures can provide an order of configurations of such atoms of space such that the classical space-time of general relativity is approximated. Although there is as yet no fully worked out physical theory of quantum gravity, we regard the Bohmian approach as setting up a standard that proposals for a serious ontology in this field should meet and as opening up a route for fruitful physical and mathematical investigations. It is difficult to extract reliable criteria for causal locality from the limited ingredients found in textbook quantum theory. In the end, Bell humbly warned that his eponymous theorem was based on criteria that “should be viewed with the utmost suspicion.” Remarkably, by stepping outside the wave-function paradigm, one can reformulate quantum theory in terms of old-fashioned configuration spaces together with ‘unistochastic’ laws. These unistochastic laws take the form of directed conditional probabilities, which turn out to provide a hospitable foundation (...) for encoding microphysical causal relationships. This unistochastic reformulation provides quantum theory with a simpler and more transparent axiomatic foundation, plausibly resolves the measurement problem, and deflates various exotic claims about superposition, interference, and entanglement. Making use of this reformulation, this paper introduces a new principle of causal locality that is intended to improve on Bell's criteria, and shows directly that systems that remain at spacelike separation cannot exert causal influences on each other, according to that new principle. These results therefore lead to a general hidden-variables interpretation of quantum theory that is arguably compatible with causal locality. (shrink)

Roger Penrose is known for his proposals, in collaboration with Stuart Hameroff, for quantum action in the brain. These proposals, which are still recent, have a prior, less known basis, which will be studied in the following work. First, the paper situates the framework from which a mathematical physicist like Penrose proposes to speak about consciousness. Then it shows how he understands the possible relationships between computation and consciousness and what criticism from other authors he endorses, to conclude by explaining (...) how he understands this relationship between consciousness and computation. Then, it focuses on the concept of non-locality so essential to his understanding of consciousness. With some examples, such as impossible objects or aperiodic tiling, the study addresses the concept of non-locality as Penrose understands it, and then shows how far he intends to arrive with that concept of non-locality. In this short survey article, I discuss Bell’s theorem and some strategies that attempt to avoid the conclusion of non-locality. I focus on two that intersect with the philosophy of probability: (1) quantum probabilities and (2) superdeterminism. The issues they raised not only apply to a wide class of no-go theorems about quantum mechanics but are also of general philosophical interest.

The causal closure of the physical world is assumed everywhere in physics but has little empirical support within living organisms. For the spiritual to have effects in nature, and make a difference there, the laws of physical nature would have to be modified or extended. I propose that the renormalized parameters of quantum field theory (masses and charges) are available to be varied locally in order to achieve ends in nature. This is not adding extra forces to nature but rescaling (...) the forces which already exist. We separate metric time in 4 dimensions from process time as the order of actualization of potentialities. This is to allow iterative forward and reverse steps in metric time to influence intermediate variations in the vacuum permittivities to move charged bodies towards achieve specific targets at a later time. Then mental or spiritual influx could have effects in nature, and these should be measurable in biophysics experiments. The violation of Bell inequalities seems to establish an important fact about the world: that it is non-local. However, this result relies on the assumption of the statistical independence of the measurement settings with respect to potential past events that might have determined them. Superdeterminism refers to the view that a local, and determinist, account of Bell inequalities violations is possible, by rejecting this assumption of statistical independence. We examine and clarify various problems with superdeterminism, looking in particular (...) at its consequences on the nature of scientific laws and scientific reasoning. We argue that the view requires a neo-Humean account of at least some laws, and creates a significant problem for the use of statistical independence in other parts of physics and science more generally. Non-locality is one of the great mysteries of quantum mechanics (qm). There is a new realist interpretation of qm on the table whose notion of time incorporates both of McTaggart's A-series and B-series. In this philosophically motivated interpretation there is no fact of the matter as to whether the 'now' of one system is the 'now' of another system, until measurement. But this reproduces the idea that the spins of a Bell pair of electrons do not become definite 'until' measurement. (...) And this almost trivially allows for non-locality. (shrink)

Laws of nature have various roles in scientific practice. It is widely agreed that an adequate theory of lawhood ought to align with the roles that scientists assign to the laws. But philosophers disagree over whether Humean laws or non-Humean laws are better at filling these roles. In this paper, I provide an argument for settling this dispute. I consider possible situations in which scientists receive conclusive evidence that—according to the non-Humean—falsifies their beliefs about the laws, but which—according to the (...) Humean—does not falsify their beliefs about the laws. I argue that, in these possible scenarios, all law-related aspects of scientific practice would remain unchanged. In other words, scientists would treat the regularities “preferred” by the Humean as the laws of nature. On this basis, I conclude that non-Humean laws fail to align with scientific practice. The most part of the debates on Quantum Mechanics (QM) interpretation come out from the remains of a classical language based upon waves and particles. Such problems can find a decisive clarification in Quantum Field Theory (QFT), where the concept of “classical object” is replaced by an interaction networks. On the other hand, it is simpler to discuss about non-locality in QM than in QFT. We propose here the concept of transaction as a connection between theQM and QFT language as (...) well as the possibility to introduce quantum non-locality ab initio.We also mention the cosmological consequence of a non-local archaic vacuum here defined. Modern physics describes the observable – and proposed – relations between the phenomena in the microcosm and macrocosm. Unfortunately we cannot observe non-local space itself. Therefore we can only determine the dynamics of the mathematical structure of space with the help of the universal properties of phenomenological reality. It has consequences too.

In this brief paper, we argue about some epistemological positions about quantum non-locality.

A single-blind experiment was conducted on free-responsive spatially non-local perception of free-selective simple photographic targets. One author (the tasker) chose a photographic target not subjected to a priori compiling, and the other author (the perceiver) attempted to unconventionally perceive the target. Feedback was expected prior to a new target being selected. A hundred trials were completed over 11 months. Thirteen judges offered gradings that collectively projected an apparent information requisition yield (AIRY). The AIRY refers to two aspects of the (...) matching of a taskette (a target’s counterpart) with respect to the target based on fuzzy scales from 0% to 100%, graded with an increment of 10%. The type-I or “tangibility” aspect of matching assessed the extent of the resemblance of a taskette to the target in terms of the shape or structural details of the primary physical entity/event. The type-II or “intangibility” aspect of the matching assessed the degree of the reconstruction of a taskette to the target in terms of the feature or functionality of the predominant physical entity/event. A total of 6 taskettes received >50% grades in both type-I and type-II aspects of matching with their respective targets. This outcome may correspond to an effect size of 1.47 if the chance-expectation may give a benchmark proportion of 3 out of 100 trials producing >50% grades in both type-I and type-II aspects of matching. Patterns indicating target interference associated with two trials entail further investigation. The approaches offer new insights to quantifying the band-limited information throughputs of spatially non-local perception. (shrink)

In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about the (...) conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. Do theories of quantum mechanics and quantum gravity require spacetime to be a basic, ground level feature, or can spacetime be seen as an emergent element of these theories? While several commentators have raised serious doubts about the prospects of forgoing the standard spacetime backdrop, it will be argued that a defense of these emergent spacetime interpretations of quantum mechanics and quantum gravity hypotheses can be made, whether as an inference to the best explanation or using another strategy. Furthermore, the (...) idea that space and time can arise from a quite different, non-spatiotemporal level of reality will be shown to have various historical precedents, especially in the seventeenth and eighteenth centuries, a realization that may help dispel some of the mystery associated with these types of hypotheses. The goals of this paper are two-fold: I wish to clarify the Aristotelian conception of the law of non-contradiction as a metaphysical rather than a semantic or logical principle, and to defend the truth of the principle in this sense. First I will explain what it in fact means that the law of non-contradiction is a metaphysical principle. The core idea is that the law of non-contradiction is a general principle derived from how things are in the world. For example, (...) there are certain constraints as to what kind of properties an object can have, and especially: some of these properties are mutually exclusive. Given this characterisation, I will advance to examine what kind of challenges the law of non-contradiction faces; the main opponent here is Graham Priest. I will consider these challenges and conclude that they do not threaten the truth of the law of non-contradiction understood as a metaphysical principle. (shrink)

How, if at all, consciousness can be part of the physical universe remains a baffling problem. This article outlines a new, developing philosophical theory of how it could do so, and offers a preliminary mathematical formulation of a physical grounding for key aspects of the theory. Because the philosophical side has radical elements, so does the physical-theory side. The philosophical side is radical, first, in proposing that the productivity or dynamism in the universe that many believe to be responsible for (...) its systematic regularities is actually itself a physical constituent of the universe, along with more familiar entities. Indeed, it proposes that instances of dynamism can themselves take part in physical interactions with other entities, this interaction then being “meta-dynamism” (a type of meta-causation). Secondly, the theory is radical, and unique, in arguing that consciousness is necessarily partly constituted of meta-dynamic auto-sensitivity, in other words it must react via meta-dynamism to its own dynamism, and also in conjecturing that some specific form of this sensitivity is sufficient for and indeed constitutive of consciousness. The article proposes a way for physical laws to be modified to accommodate meta-dynamism, via the radical step of including elements that explicitly refer to dynamism itself. Additionally, laws become, explicitly, temporally non-local in referring directly to quantity values holding at times prior to a given instant of application of the law. The approach therefore implicitly brings in considerations about what information determines states. Because of the temporal non-locality, and also because of the deep connections between dynamism and time-flow, the approach also implicitly connects to the topic of entropy insofar as this is related to time. Using a ‘reformulation of Bell’s theorem’, Waegell and McQueen (2020) argue that any empirically adequate theory that is local and does not involve retro-causation or fine-tuning must be a many-worlds theory. They go on to analyze several prominent many-worlds interpretations and conclude that non-separable many-worlds theories whose ontology is given by the wavefunction involve superluminal causation, while separable many-worlds theories (e.g. Waegell, 2021; Deutsch and Hayden 2000) do not. I put forward three claims. (A) I challenge their argument for (...) relying on a non-trivial, unquestioned assumption about elements of reality which allows Healey’s approach (Healey, 2017b) to evade their claim. In an attempt to respond to (A), Waegell and McQueen may restrict their claim to theories which satisfy such an assumption, however, I also argue that (B) their argument fails to prove even the so weakened claim, as exemplified by theories that are both non-separable and local. Finally, (C) by arguing for the locality of the decoherence-based Everettian approach (Wallace, 2012) I refute Waegell and McQueen’s claim that wavefunction-based ontologies, and more generally non-separable ontologies, involve superluminal causation. I close with some doubtful remarks about separable Everettian interpretations as compared to non-separable ones. (shrink)

If the laws of nature are as the Humean believes, it is an unexplained cosmic coincidence that the actual Humean mosaic is as extremely regular as it is. This is a strong and well-known objection to the Humean account of laws. Yet, as reasonable as this objection may seem, it is nowadays sometimes dismissed. The reason: its unjustified implicit assignment of equiprobability to each possible Humean mosaic; that is, its assumption of the principle of indifference, which has been attacked on (...) many grounds ever since it was first proposed. In place of equiprobability, recent formal models represent the doxastic state of total ignorance as suspension of judgment. In this paper I revisit the cosmic coincidence objection to Humean laws by assessing which doxastic state we should endorse. By focusing on specific features of our scenario I conclude that suspending judgment results in an unnecessarily weak doxastic state. First, I point out that recent literature in epistemology has provided independent justifications of the principle of indifference. Second, given that the argument is framed within a Humean metaphysics, it turns out that we are warranted to appeal to these justifications and assign a uniform and additive credence distribution among Humean mosaics. This leads us to conclude that, contrary to widespread opinion, we should not dismiss the cosmic coincidence objection to the Humean account of laws. (shrink)

The law confers rights on non-human entities, namely nature, machines (AI), and animals. While doing so, the law is either viewed as progressive or sometimes as abstract and ambiguous. Despite the critique, it is undeniable that many of the rights of non-humans have come to solidify in statutory and constitutional rules of different systems. In the context of these developments, the article sheds light on the core justifications for advancing the rights of non-human entities. In addition, it discusses the conditions (...) for the emergence of these rights and the non-binding normative statements adopted by different stakeholders for advocacy. These include the Charter on the Law of the Living (2021), the Toulon Declaration (2019), and the Vienna Manifesto on Digital Humanism (2019), etc. The paper also discusses the relevant theoretical frames, namely post-humanism, digital humanism, and multi-species justice, followed by selective critical views on the subject. This paper objects to an explanation I extract from Jeanette Edwards, concerning a pattern she observes of questions asked and not asked. There are propositions accepted as axioms which apparently lead to that pattern. I present an axiomatization but it leads to different questions.

Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

The question of whether the Pyrrhonist adheres to certain logical principles, criteria of justification, and inference rules is of central importance for the study of Pyrrhonism. Its significance lies in that, whereas the Pyrrhonist describes his philosophical stance and argues against the Dogmatists by means of what may be considered a rational discourse, adherence to any such principles, criteria, and rules does not seem compatible with the radical character of his skepticism. Hence, if the Pyrrhonist does endorse them, one must (...) conclude that he is inconsistent in his outlook. Despite its import, the question under consideration has not received, in the vast literature on Pyrrhonism of the past three decades, all the attention it deserves. In the present paper, I do not propose to provide a full examination of the Pyrrhonist’s attitude towards rationality, but to focus on the question of whether he endorses the law of non-contradiction (LNC). However, I will also briefly tackle the question of the Pyrrhonist’s outlook on both the canons of rational justification at work in the so-called Five Modes of Agrippa and the logical rules of inference. In addition, given that the LNC is deemed a fundamental principle of rationality, determining the Pyrrhonist’s attitude towards it will allow us to understand his general attitude towards rationality. A new constructivist approach to modeling in economics and theory of consciousness is proposed. The state of elementary object is defined as a set of its measurable consumer properties. A proprietor's refusal or consent for the offered transaction is considered as a result of elementary economic measurement. We were also able to obtain the classical interpretation of the quantum-mechanical law of addition of probabilities by introducing a number of new notions. The principle of “local equity” assumes the transaction completed (...) (regardless of the result) of the states of transaction partners are not changed in connection with the reception of new information on proposed offers or adopted decisions (consent or refusal of the transaction). However it has no relation to the paradoxes of quantum theory connected with non-local interaction of entangled states. In the economic systems the mechanism of entangling has a classical interpretation, while the quantum-mechanical formalism of the description of states appears as a result of idealization of the selection mechanism in the proprietor's consciousness. I have received an e-mail from Google CEO stating that I have been selected as one of twelve winners from the pool of Google users. The award money is enormous which stalls me for some time. The authenticity and reliability have hit my head, and I utilized a verification service website managed by the team of lawyers. It costs five dollars and remaining 24 dollars would be processed upon the progress of interaction. I am waiting for an answer from the team. Abstract. As a general theory of reasoning—and as a general theory of what holds true under every possible circumstance—logic is supposed to be ontologically neutral. It ought to have nothing to do with questions concerning what there is, or whether there is anything at all. It is for this reason that traditional Aristotelian logic, with its tacit existential presuppositions, was eventually deemed inadequate as a canon of pure logic. And it is for this reason that modern quantification theory, too, with (...) its residue of existentially loaded theorems and patterns of inference, has been claimed to suffer from a defect of logical purity. The law of non-contradiction rules out certain circumstances as impossible—circumstances in which a statement is both true and false, or perhaps circumstances where something both is and is not the case. An ongoing mystery in sensory science is how sensation magnitude F(I), such as loudness, increases with increasing stimulus intensity I. No credible, direct experimental measures exist. Nonetheless, F(I) can be inferred algebraically. Differences in sensation have empirical (but non-quantifiable) minimum sizes called just-noticeable sensation differences, ∆F, which correspond to empirically-measurable just-noticeable intensity differences, ∆I. The ∆Is presumably cumulate from an empirical stimulus-detection threshold I_th up to the intensity of interest, I. Likewise, corresponding ∆Fs cumulate from the sensation at the stimulus-detection (...) threshold, F(I_th ), up to F(I). Regarding the ∆Is, however, it is unlikely that all of them will be known experimentally; the procedures are too lengthy. The customary approach, then, is to find ∆I at a few widely-spaced intensities, and then use those ∆Is to interpolate all ∆Is using some smooth continuous function. The most popular of those functions is Weber’s Law, ∆I⁄I=K. But that is often not even a credible approximation to the data. However, there are other equations for ∆I⁄I. Any such equation for ∆I⁄I can be combined with any equation for ∆F, through calculus, to altogether obtain F(I). Here, two assumptions for ∆F are considered: ∆F=B (Fechner’s Law) and (∆F⁄F)=g (Ekman’s Law). The respective integrals involve lower bounds I_th and F(I_th ). This stands in broad contrast to the literature, which heavily favors non-bounded integrals. We, hence, obtain 24 new, alternative equations for sensation magnitude F(I) (12 equations for (∆I⁄I) × 2 equations for ∆F). (shrink)

We can evaluate laws as better or worse relative to different normative standards. One might lament the fact that a law violates human rights or, in a different register, marvel at its ease of application. A question in legal philosophy is whether some standards for evaluating laws are fixed by—or grounded in—the very nature of law. I take Raz’s discussion of the distinctively legal virtues, those that fall under the rubric of the “Rule of Law” such as clarity, generality, and (...) non-retroactivity, as my starting point for exploring a very general puzzle about the relationship between law’s essence and its virtue. -/- The claim that there are some virtues that laws have qua laws invites a comparison between law and other “goodness-fixing kinds.” A kind is goodness-fixing if what it is to be a member of the kind fixes a standard for evaluating instances as better or worse. For example, if an object belongs to the kind CLOCK, whether it keeps time accurately provides a basis for evaluating it as better or worse as a clock. Furthermore, the relevant normative fact—if a clock does not keep time accurately, it is a bad clock—is at least partly explainable in terms of the nature of clocks (clocks are things that are supposed to be keep time accurately). Hence, for any goodness-fixing kind, K, that sets a standard, S, for evaluating Ks as Ks, we can ask: (1) How does the nature of Ks explain S? (2) Does being a K depend on meeting a minimum threshold of S-relative goodness? In the case of law and its constitutive standard defined by the Rule-of-Law virtues, these questions lack settled answers. Although Raz offers some discussion, I argue that his answers have the surprising upshot of rendering law sui generis relative to other goodness-fixing kinds, and that preserving continuity with other goodness-fixing kinds involves revising the general picture. One of the central topics in semantic theory over the last few decades concerns the nature of local contexts. Recently, theorists have tried to develop general, non-stipulative accounts of local contexts (Schlenker, 2009; Ingason, 2016; Mandelkern & Romoli, 2017a). In this paper, we contribute to this literature by drawing attention to the local contexts of subclausal expressions. More specifically, we focus on the local contexts of quantificational determiners, e.g. `all', `both', etc. Our central tool for probing (...) the local contexts of subclausal elements is the principle Maximize Presupposition! (Percus, 2006; Singh, 2011). The empirical basis of our investigation concerns some data discussed by Anvari (2018b), e.g. the fact that sentences such as `All of the two presidential candidates are crooked' are unacceptable. In order to explain this, we suggest that the local context of determiners needs to contain the information carried by their restrictor. However, no existing non-stipulative account predicts this. Consequently, we think that the local contexts of subclausal expressions will likely have to be stipulated. This result has important consequences for debates in semantics and pragmatics, e.g. those around the so-called "explanatory problem" for dynamic semantics (Soames, 1982; Heim, 1990; Schlenker, 2009). The principle of energy conservation is widely taken to be a se- rious difficulty for interactionist dualism (whether property or sub- stance). Interactionists often have therefore tried to make it satisfy energy conservation. This paper examines several such attempts, especially including E. J. Lowe’s varying constants proposal, show- ing how they all miss their goal due to lack of engagement with the physico-mathematical roots of energy conservation physics: the first Noether theorem (that symmetries imply conservation laws), its converse (that conservation (...) laws imply symmetries), and the locality of continuum/field physics. Thus the “conditionality re- sponse”, which sees conservation as (bi)conditional upon symme- tries and simply accepts energy non-conservation as an aspect of interactionist dualism, is seen to be, perhaps surprisingly, the one most in accord with contemporary physics (apart from quantum mechanics) by not conflicting with mathematical theorems basic to physics. A decent objection to interactionism should be a posteri- ori, based on empirically studying the brain. (shrink)

This chapter will argue that the criminal law is most compatible with a specific theory regarding the mind/body relationship: non-eliminative reductionism. Criminal responsibility rests upon mental causation: a defendant is found criminally responsible for an act where she possesses certain culpable mental states (mens rea under the law) that are causally related to criminal harm. If we assume the widely accepted position of ontological physicalism, which holds that only one sort of thing exists in the world – physical stuff – (...) non-eliminative reductive physicalism about the mind offers the most plausible account of the full-bodied mental causation criminal responsibility requires. Other theories of the mind/body relationship, including elminativism and non-reductive physicalism, threaten criminal responsibility because they do not offer satisfactory accounts of mental causation. Eliminativism, as the name implies, eliminates the mental or is skeptical that it can do the causal work necessary to responsibility; and non-reductive theories disconnect the mental from the physical/casual world such that the mental can no longer have reliable causal effects. This paper explores two non-standard supermajority rules in the context of judgment aggregation over multiple logically connected issues. These rules set the supermajority threshold in a local, context sensitive way—partly as a function of the input profile of opinions. To motivate the interest of these rules, I prove two results. First, I characterize each rule in terms of a condition I call ‘Block Preservation’. Block preservation says that if a majority of group members accept a judgment set, then so (...) should the group. Second, I show that one of these rules is, in a precise sense, a judgment aggregation analogue of a rule for connecting qualitative and quantitative belief that has been recently defended by Hannes Leitgeb. The structural analogy is due to the fact that Leitgeb sets thresholds for qualitative beliefs in a local, context sensitive way—partly as a function of the given credence function. (shrink)

For Humeans, many facts—even ones intuitively “about” particular, localized macroscopic parts of the world—turn out to depend on surprisingly global fundamental bases. We investigate some counterintuitive consequences of this picture. Many counterfactuals whose antecedents describe intuitively localized, non-actual states of affairs nevertheless end up involving wide-ranging implications for the global, embedding Humean mosaic. The case of self-undermining chances is a familiar example of this. We examine that example in detail and argue that popular existing strategies such as “holding the laws (...) fixed as laws” or “holding the laws fixed as true” are of no help. Interestingly, we show how a new proposal that draws on the resources of the Mentaculus can yield the right results—but only on the assumption that the Humean can make cross-world identifications. We go on to argue that the Humean cannot make such identifications. We conclude that the root of this trouble is deeper, and its reach broader, than the familiar cases suggest. We think it is very much an open question whether the Humean has sufficient resources to properly conceptualize macroscopic objects or to analyze these “local” counterfactuals. (shrink)

Non-Humean accounts of the metaphysics of nature posit either laws or powers in order to account for natural necessity and world-order. We argue that such monistic views face fundamental problems. On the one hand, neo-Aristotelians cannot give unproblematic power-based accounts of the functional laws among quantities offered by physical theories, as well as of the place of conservation laws and symmetries in a lawless ontology; in order to capture these characteristics, commitment to governing laws is indispensable. On the other hand, (...) ontologies that entirely exclude some kind of power ascription to worldly entities face what we call the Governing Problem: such ontologies do not have the resources to give an adequate account of how laws play their governing role. We propose a novel dualist model, which, we argue, has the resources to solve the difficulties encountered by its two dominant competitors, without inheriting the problems of either view. According to the dualist model, both laws and powers are equally fundamental and irreducible to each other, and both are needed in order to give a satisfactory account of the nomological structure of the world. The dualist model constitutes thus a promising alternative to current monistic views in the metaphysics of science. (shrink)

Mental causation, idea that it is us – via our minds – who cause bodily actions is as commonsensical as it is indispensable for our understanding of ourselves as rational agents. Somewhat less uncontroversial, but nonetheless widespread (at least among ordinary people) is the idea that the mind is non-physical, following the intuition that what is physical can neither act nor think nor judge morally. Taken together, and cast into a metaphysical thesis, the two intuitions yield interactive dualism: the view (...) that human persons and their minds are non-physical but can nonetheless interact with their bodies, most notably through their brains. This thesis has two main objectives: first, to defend interactive dualism against objections, and second, to show how it can blend in with a physical world in which laws of nature hold. The first part (chapter 1) consists in a brief motivation of interactive dualism as opposed to non-interactive dualism. I argue that non-interactive, epiphenomenalist dualism sacrifices so many crucial aspects of our human existence that interactive dualism is highly to be preferred to it, barring even stronger counterarguments against the latter. It is those putative counterarguments I address in parts II and III. Part II takes on the philosophical objections from the causal closure of the physical and from causal heterogeneity. The former takes the success of physics and physiology as basis for the doctrine of the causal closure of the physical (CCP). I argue against this that there is not only no convincing argument for CCP, but also that any science-based belief in CCP cannot be epistemically justified. As regards the causal heterogeneity objection, it is ‘weighed and found wanting’, because it relies on unwarranted assumptions about causation. In part III, I examine the objection from energy conservation. It roughly says that if interactive dualism were true, then energy would not be conserved, which physics taught us cannot be the case. My reply is that the underlying conception of energy (and momentum) conservation is wrong-headed and not the one that actual physicists use. Instead of being categorical and global, conservation laws are conditional and local, thereby making natural room for mental interaction. Some dualists, however, have sought to make interactive dualism conservation-friendly, notably by invoking quantum physics; I show that these attempts are unnecessary and create more problems than they solve. Finally, in chapter 9, I turn the tables on non-interactionists by investigating current neurophysiological literature on volitional actions, which, though not addressing the question directly, still encourages the interactive dualist picture more than a non-interactionist one. Part IV is about the interplay between interactive dualism and the laws of nature. The ultimate goal is, if possible, to come up with a theory of the laws of nature that explains the lawlike behavior of nature and at the same time makes room for interaction. I begin by pointing out that the laws of nature are or at least should be what physicalists worry about (chapter 10). I then proceed with a historical survey on the development of the notion of laws of nature (chapter 11) that sheds light on its theistic origin. This is followed by an inquiry into the question how a law of nature could possibly be broken (chapter 12) and a survey of the extant metaphysical theories of the laws of nature with special regard to their receptivity to interaction (chapter 13). Finally, in chapter 14 I develop a theory of the laws of nature both faithful to their divine origin and the possibility of mental interaction: dispositionalist divine decretalism, a synthesis of dispositionalism and Jeffrey Koperski’s divine decretalism. Non‐Humean theories of natural necessity invoke modally‐laden primitives to explain why nature exhibits lawlike regularities. However, they vary in the primitives they posit and in their subsequent accounts of laws of nature and related phenomena (including natural properties, natural kinds, causation, counterfactuals, and the like). This article provides a taxonomy of non‐Humean theories, discusses influential arguments for and against them, and describes some ways in which differences in goals and methods can motivate different versions of non‐Humeanism (and, for that matter, (...) Humeanism). In short, this article provides an introduction to non‐Humeanism concerning the metaphysics of laws of nature and natural necessity. (shrink)

Local miracle compatibilists claim that we are sometimes able to do otherwise than we actually do, even if causal determinism obtains. When we can do otherwise, it will often be true that if we were to do otherwise, then an actual law of nature would not have been a law of nature. Nevertheless, it is a compatibilist principle that we cannot do anything that would be or cause an event that violates the laws of nature. Carl Ginet challenges this (...) nomological principle, arguing that it is not always capable of explaining our inability to do otherwise. In response to this challenge, I point out that this principle is part of a defense against the charge that local miracle compatibilists are committed to outlandish claims. Thus it is not surprising that the principle, by itself, will often fail to explain our inability to do otherwise. I then suggest that in many situations in which we are unable to do otherwise, this can be explained by the compatibilist’s analysis of ability, or his criteria for the truth of ability claims. Thus, the failure of his nomological principle to explain the falsity of certain ability claims is no strike against local miracle compatibilism. (shrink)

Any explanation of one fact in terms of another will appeal to some sort of connection between the two. In a causal explanation, the connection might be a causal mechanism or law. But not all explanations are causal, and neither are all explanatory connections. For example, in explaining the fact that a given barn is red in terms of the fact that it is crimson, we might appeal to a non-causal connection between things’ being crimson and their being red. Many (...) such connections, like this one, are general rather than particular. I call these general non-causal explanatory connections 'laws of metaphysics'. In this paper I argue that some of these laws are to be found in the world at its most fundamental level, forming a bridge between fundamental reality and everything else. It is only by admitting fundamental laws, I suggest, that we can do justice to the explanatory relationship between what is fundamental and what is not. And once these laws are admitted, we are able to provide a nice resolution of the puzzle of why there are any non-fundamental facts in the first place. (shrink)
