Abstract The aim of this paper is to discern the subtitle on 2004 Marc Richir’s book, Phantasia, imagination, affectivité. Phénoménologie et anthropologie phénoménologique. Traditionally, Phenomenology has been elusive to link to Anthropology. However, Richir gives its importance including it into the title of his book. Husserl first, and then Richir, facing the Cartesian solipsist subjectivity outline, propose the concept of intersubjectivity. Community prevails over an individual and generalizing self. The other, then, becomes our incarnation, a live-­‐‑incarnation, it defines our own (...) self, as long as it is done from a de-­‐‑anchoring, that is to say, there is a union in distance, it is the intersubjectivity tissue. The community, therefore, shapes up, but it is not uniform yet it is always a whole. The concept of Phantasieleib plays a significant role in this community, this Richirianne concept is very important to grasp the movement between fantasy and language, also, it is very influential in actual phenomenologists as Murakami. This movement is also key in language and phenomena language, furthermore, is also relevant in the Inter-­‐‑subjectivity Foundation. Resumen El objetivo de este artículo es discernir el subtítulo de Marc Richir, del 2004, a saber, Phantasia, imagination, affectivité. Phénoménologie et anthropologie phénoménologique. Tradicionalmente, la fenomenología se ha mostrado reticente a vincularse a la antropología. Por el contrario, Richir le confiere una importancia al incluirlo en dicho título. Frente al planteamiento cartesiano de una subjetividad solipsista, primero Husserl y después Richir, proponen la intersubjetividad. La comunidad prevalece ante la individualidad de un yo generalizador. El otro se convierte en nuestra encarnación, una encarnación viva, define nuestro propio yo, siempre que se haga en un des-­‐‑anclaje, es decir, se produce una unión en la distancia, es el tejido de la intersubjetividad. La comunidad, por tanto, toma forma, pero, no es uniforme, aunque está siempre unida. El concepto de Phantasieleib juega un papel fundamental en dicha comunidad, este concepto richiriano es muy importante para comprender el movimiento entre phantasia y pensamiento, además, de suponer una gran influencia en los fenomenólogos actuales como Murakami. Este movimiento es también importante en el lenguaje y los fenómenos del lenguaje, a su vez, relevante también en la fundamentación de la intersubjetividad. (shrink)

Resumen: Husserl propone una teoría sobre la intersubjetividad que parte de la conciencia trascendental como inserta en el mundo de la vida donde están los otros y donde la comunidad se construye bajo una estructura de esencias que garantiza la comunalidad. El mundo de la vida es dado y compartido por todas las conciencias intencionales y trascendentales, es condición para intuiciones empíricas y eidéticas, la epoché y las reducciones eidética y trascendental. Cada momento del método fenomenológico se basa en la (...) existencia de un mundo de la vida independiente de la subjetividad. En este mundo, hay objetos reales y, entre estos, los otros, reconocidos por analogía a través de la empatía. Desde una perspectiva metodológico-epistemológico, el yo es anterior al mundo y a los otros yos. El yo constituye, en sentido fenomenológico, la realidad. La conciencia es el lugar de evidenciación de la realidad. No obstante, en la perspectiva ontológica, es lo contrario. El mundo de la vida es anterior a la conciencia individual. El mundo de la vida está ahí, disponible, existente, independiente del sujeto, funcionando con su propio orden, con sus leyes y reglas. Es el yo el que esta insertado en el mundo de la vida y que se esfuerza por desvendarlo. La realidad se impone y el yo es, sobre todo, miembro de una comunidad de otros yos. Aun así, ¿cómo compartir las experiencias? Las vivencias pueden ser diferentes, pero hay un límite en las variaciones, un límite dado por la esencia del objeto vivido y por las leyes que rigen las relaciones de tal objeto. Así, la constitución del mundo y de sus objetos está permanentemente en progreso. Es posible donarles nuevos sentidos, en los límites de su esencia. Para Husserl, la constitución comunal del mundo es la condición de posibilidad para la existencia de sujetos separados unos de los otros, y este entendimiento recíproco solo es posible a través de la constitución trascendental de la objetividad. Así, no hay una separación entre la intersubjetividad y la constitución del mundo, es la comunidad de yos la que dona sentidos a las objetividades. En el mundo de la vida con los otros en comunidad. -/- Abstract: Husserl proposes a theory on intersubjectivity that starts from transcendental consciousness as inserted in the lifeworld where the others and where the community are built under a structure of essences that guarantees communality. The lifeworld is given and shared by all intentional and transcendental consciousnesses, it is a condition for empirical and eidetic intuitions, the epoché and the eidetic and transcendental reductions. Every moment of the phenomenological method is based on the existence of a lifeworld independent of subjectivity. In this world, there are real objects and, among these, the others, recognized by analogy through empathy. From a methodologicalepistemological perspective, the self is prior to the world and the other selves. The self constitutes, in a phenomenological sense, reality. Consciousness is the locus of evidence of reality. However, from the ontological perspective, it is the opposite. The lifeworld is prior to individual consciousness. The lifeworld is there, available, existing, independent of subjectivity, functioning with its own order, with its laws and rules. It is the self that is inserted in the lifeworld and that strives to unveil it. Reality prevails and the self is, above all, a member of a community of other selves. Even so, how to share the experiences? The experiences can be different, but there is a limit in variations, a limit given by the essence of the lived object and by the laws that govern the relation of the object. Thus, the constitution of the world and its objects is permanently in progress. It is possible to give them new meanings, within the limits of their essence. For Husserl, the communal constitution of the world is the condition of possibility for the existence of subjects separated from each other, and this reciprocal understanding is only possible through the transcendental constitution of objectivity. therefore, there is no separation between intersubjectivity and the constitution of the world, it is the community of selves that gives meaning to objectivities. Este artículo aborda, desde la relectura del trabajo de Alfred Schütz “La ejecución musical conjunta” (“Makingmusictogether”), la idea de intersubjetividad como sintonía en las relaciones sociales explorando en los elementos señalados por el autor, como la dimensión temporal, el cara a cara y la sincronización con el Otro. Se abre así una posibilidad de comprensión de los procesos intersubjetivos, en la perspectiva del reconocimiento de la alteridad (Levinas) como constitutiva de intersubjetividad, y se plantea la pregunta de si es posible, (...) en contextos de exclusión, avanzar hacia la constitución de sintonía entre sociedad y Estado. Forests play fundamental roles in the Earth’s ecosystems. With the great capability of carbon sequestration, tropical forests are expected to contribute substantially to reducing the CO2 in Earth’s atmosphere. However, global tropical forest areas have declined drastically over the last few decades due to pressures from socio-economic development pursuit. The current essay aims to demonstrate the ongoing global deforestation crisis and its underlying drivers and discuss the vital roles of tropical forests in the socio-economic development in the face of climate (...) change when developed countries start to tighten the carbon emission control regulations (e.g., European Union’s Carbon Border Adjustment Mechanism). It suggests why developing countries in tropical regions, particularly Vietnam, should not sacrifice forests for short- and medium-term socio-economic goals but capitalize on them to leverage long-term development. Moreover, evidence of Vietnamese political leaders’ commitment to forest protection and sustainable development is also provided. (shrink)

Este texto analiza las concepciones que J. S. Mill y K. Marx defienden sobre la libertad, con el fin de establecer si entre ellas hay puntos de convergencia, a pesar de las diferentes motivaciones que las impulsan. En este sentido, la tesis que se propone es que ambos pensadores coinciden en la defensa que realizan de la libertad, dado que le otorgan un papel destacado a la autodeterminación, el libre desarrollo de la individualidad y a la existencia de condiciones materiales (...) para su concreción. Así las cosas, las distancias que las separan no constituyen ningún óbice al momento de abogar por lo que consideran como el valor fundamental del ser humano. (shrink)

El Tribunal de Justicia ha comenzado a utilizar la Carta de los Derechos Fundamentales de la Unión Europea como un instrumento con fuerza jurídica equivalente al Tratado, a la vez que amplía el ámbito de su control jurisdiccional y su posición como garante de los derechos fundamentales en la Unión Europea. Sin embargo, esto debería ir acompañado de una auténtica garantía de los mismos y una pormenorizada justificación de sus límites y restricciones, lo que no parece evidente en (...) todos los casos. En Europa vivimos inmersos dentro de una pluralidad de sistemas constitucionales: tanto los sistemas estatales como el sistema de la Unión Europea. Esto podía llevar a ciertas situaciones de conflicto, al menos en una perspectiva teórica en principio, y por ello se ha tratado de explicar y solucionar la tutela de los derechos fundamentales en la Unión Europea mediante la teoría llamada «pluralismo constitucional». Sin embargo, se plantean dudas que pueden llevarnos a considerar dicha teoría como una mera (...) «construcción artificial» que no haría sino ocultar los verdaderos problemas de la tutela de los derechos fundamentales en la Unión Europea. Resumen: En el presente artículo me propongo elucidar el significado del concepto “pathos de la distancia” y sus implicaciones ético-políticas, destacando, además, su sentido y coherencia con el conjunto del pensamiento nietzscheano. La tesis fundamental es que el pathosde la distancia, como característica básica del ideal noble, muestra cómo el concepto de preeminencia política en Nietzsche se diluye siempre en un concepto de preeminencia anímica. La reflexión se enmarca dentro de la crítica nietzscheana de la cultura, la política y la (...) educación, y su propuesta de reforma de los valores dominantes de la sociedad, entre ellos, los que configuran la subjetividad y la individualidad. Se estudian las diversas dimensiones del pathos de la distancia: como articulación jerárquica, como principio de individuación, como parte la Gran Política y como elemento del pensamiento de la cría. Pretendemos acercarnos a la posición que el Tribunal Constitucional ha desarrollado en su jurisprudencia respecto al Derecho de la Unión Europea. -/- La postura del Tribunal Constitucional español es compleja en sí misma por las dudas que plantea, dejando traslucir, se podría decir, cierta indecisión en cuanto a su propia naturaleza de juez comunitario. -/- Considerando la diferente perspectiva que mantiene el Tribunal de Justicia de la Unión Europea, se puede deducir una especie de relación en la arquitectura (...) judicial europea que está llamada a ser dialéctica y de equilibrio, máxime en una Unión Europea donde también el poder político reside en un sistema de equilibrios en diferentes direcciones. La protección de los derechos fundamentales en el sistema multinivel europeo exige de criterios hermenéuticos que posibiliten la delimitación del contenido y extensión del derecho fundamental en juego. Así, debemos considerar los derechos fundamentales reconocidos a nivel nacional (Constituciones), internacional (Convenio Europeo de Derechos Humanos) y de la Unión Europea (Carta de Derechos Fundamentales de la Unión Europea). -/- Es necesario delimitar los criterios de interconexión más adecuados para llegar a los criterios de interpretación de los que se (...) deriven las exigencias y garantías de los derechos fundamentales. En el marco de los países miembros de la Unión Europea, que son a su vez parte del Consejo de Europa, es donde se da este sistema multinivel a tres bandas, donde será necesario analizar los criterios de interconexión desde el derecho de la Unión Europea, que es el que consagra el criterio del máximo nivel de protección aplicable, tras la entrada en vigor del Tratado de Lisboa el 1 de diciembre de 2009, y que como veremos es compatible con los límites constitucionales consagrados en la doctrina constitucional de los Estados miembros, así como con el Convenio Europeo de Derechos Humanos (teniendo en consideración la futura adhesión de la UE), puesto que este criterio implica que a la hora de tutelar los derechos fundamentales habrá que buscar el nivel más alto de protección de los mismos. El principio de seguridad jurídica tiene, como una de sus manifestaciones características, dentro del Estado de Derecho, la fuerza de cosa juzgada (res iudicata) que se atribuye a las sentencias o resoluciones judiciales equivalentes firmes, y que implica tanto su impugnabilidad como su potencial influencia en litigios posteriores que guarden una conexión con el asunto ya resuelto en firme. Sin embargo, es posible que estas decisiones judiciales firmes de jueces nacionales, por diversas causas (error, omisión, interpretación manifiestamente contraria, etc.) vulneren (...) el Derecho de la Unión Europea y, por tanto, afecten tanto a su primacía como a su efectividad en sus relaciones con los ordenamientos jurídicos nacionales. El Tribunal de Justicia ha tenido oportunidad de enfrentarse al dilema de ponderar el principio de fuerza de cosa juzgada con las primacía y efectividad del Derecho de la Unión en diversas sentencias. Este trabajo tiene como objetivo realizar una aproximación y revisar la jurisprudencia más importante al respecto hasta la actualidad. (shrink)

Climate change has become one of the most pressing problems that can threaten the existence and development of humans around the globe. Almost all climate scientists have agreed that climate change is happening and is caused mainly by greenhouse gas emissions induced by anthropogenic activities. However, some groups still deny this fact or do not believe that climate change results from human activities. This essay discusses the causes, significance, and skeptical arguments of climate change denialism, as well as the roles (...) of scientists and science communication in addressing the issues. Through this essay, we call for the active participation of scientists in science communication activities with the public, the opening of new science communication sectors specified for climate change, and more attention to social sciences and humanities in addressing climate change issues. Parmi les psychanalystes, c’est principalement Donald Winnicott qui a aidé Marc Richir à éclaircir et à approfondir la phénoménologie génétique déjà amorcée par Edmund Husserl. Ce travail a pour but de montrer les usages que Richir fait de Winnicott dans ses recherches visant à prolonger le projet husserlien. Selon la lecture de Richir, Winnicott insiste sur « la primauté de la constitution de l’objet transitionnel » en termes d’accès au réel. À l’aide des propres mots de Winnicott, nous allons démontrer (...) dans quel sens Winnicott privilégie le rôle constitutionnel de l’objet transitionnel, et comment Richir a assimilé et réinterprété cette étude de Winnicott. Suivant notre exposé, l’objet transitionnel va ainsi dévoiler sa complexité avec une fonction à la fois facilitatrice et dérangeante dans le processus « d’hominisation ». (shrink)

Recientemente el Pleno de la Sala de lo Civil del Tribunal Supremo ha venido a resolver, en Sentencia de 18 de junio de 2012 (rec. núm. 489/2007), un recurso de casación en el que se planteaba la cuestión de la eficacia en España, a efectos registrales, de una escritura otorgada ante notario alemán, dándole validez, y, por tanto, estableciendo su aptitud para generar la oportuna inscripción en el Registro de la Propiedad español. -/- Los argumentos fundamentales de la sentencia que (...) comentamos son dos: en primer lugar, la libre prestación de servicios en el ámbito de la Unión Europea excluiría la posibilidad de interpretar que se pueda imponer la intervención en todo caso de un notario español lo que constituiría una restricción de la libertad fundamental antes citada; y en segundo lugar, entendiendo que los efectos de la escritura pública alemana debían regirse por lo previsto en el Derecho español, esto es, los previstos en el artículo 1.462 del Código Civil, y no los previstos en el Derecho alemán, donde se exige un segundo acuerdo de carácter dispositivo para que se produzca la transmisión de la propiedad. En la vida democrática moderna la participación ha adquirido una importancia fundamental. La idea de la participación indirecta y del papel inactivo de las personas y de las comunidades mostró su carácter insuficiente para resolver las complejidades de los asuntos contemporáneos y las necesidades de las naciones. Los cambios que se han dado en los últimos tiempos proponen un Estado que se relaciona de manera más directa con el ciudadano, con el cual toma además las decisiones a través de procedimientos (...) de incidencia real y eficiente. La participación pasa a ocupar un puesto muy importante en la gestión del Estado, no solo en lo que tiene que ver con la toma de decisiones, sino también con la cogestión, el seguimiento y la evaluación de las mismas. Sin embargo, no basta con que el derecho a la participación sea reconocido: también se hace necesario el establecimiento de escenarios para su ejercicio como una obligación por parte del Estado. La participación es el cimiento del Estado y de la democracia; un deber y un derecho que se sustenta en el principio de solidaridad y en la unión de las comunidades en pos de un objetivo o de la integración de todas las personas en la construcción de un mejor país. El derecho a la participación es un derecho de primera generación correspondiente a los derechos civiles y políticos. En temas ambientales, una regla importante para orientar la actividad del Estado es la incidencia ciudadana en todos los ámbitos, desde las acciones de ordenamiento ambiental hasta las que tienen que ver con la investigación, con programas de control y protección de recursos, en el otorgamiento de licencias y permisos ambientales y en la planeación ambiental, entre otros. De esto se ha tenido conciencia desde la expedición del Código de Recursos Naturales en 1974, cuando se señaló que la actividad del Estado debería inducir a un manejo participativo, por cuanto se postula como regla de administración que debe promoverse la formación de asociaciones y de grupos cívicos para lograr la protección de los recursos naturales renovables y su utilización adecuada, con base en el estudio de las relaciones de la comunidad con tales recursos. Climate change, primarily driven by human activities, is becoming one of the most urgent global challenges of our time. Despite lingering doubts about climate change in some research documents, strong consensus within the scientific community still affirms that global surface temperatures have risen in recent decades. Over the past decade, significant efforts have been made by humans to address the climate change crisis, resulting in certain impacts in combating climate change and raising awareness about its consequences. However, the question remains: (...) Are we heading in the right direction to effectively address this crisis, or do we need to reconsider our approach? This essay will examine some of major achievements in the fight against climate change, the increasing awareness of its impacts, the escalating severity of the climate crisis, and whether our actions are on the right track or require reevaluation. In Philosophy, it is well known that of the total faculty population, the proportion of women is significantly lower than men. This disproportion is odd for a discipline within the humanities; these numbers seem more compatible with what is found in STEM (Science, Technology, Engineering, Mathematics) careers. These proportions are in turn a product of the low female presence that exists from the previous levels of academic training in philosophy. What happens in the case of the philosophy student body? For (...) example, the report presented by BeeBee and Saul (2011), on women in philosophy in the United Kingdom, in the period 2008 and 2009, points out that in the first degrees of academic training, in the bachelor's degree, women occupy 45% of the student population, in the master's degree 38% and in the doctorate 35%. Thus, "it is notable that there is a reduction in the proportion of women from the bachelor's degree to the doctorate [...]. This has as a consequence that at the professional level women holding positions as professors represent only 19%" (BeeBee & Saul, 2011, p. 11). Recently, Torres González (2018), based on European Union studies, points out that in Spain, with respect to gender disparity in students, "the data yield as a result masculinized studies, where, contrary to what happens in the branch of the humanities to which it [philosophy] belongs, males outnumber females by 28 percentage points" (2018, p. 328). This disparity is reflected in philosophy at the professional level, "the indicators of vertical segregation show a reinforced glass ceiling, which presents one of the worst data of hierarchical discrimination in the university: the percentage of female professors in philosophy is 12% compared to 21% of female professors in higher education" (Idem). Although it is a fact that there are fewer women than men studying philosophy and, therefore, fewer women than men working professionally in this discipline, we do not yet have possible explanations for this phenomenon of gender disparity in the student body in philosophy. In some cases, even if the number of women entering the philosophy degree program is already low, the number of women graduating is even lower, which indicates that there is attrition along the way; the initial numbers of women entering the program tend to decrease by the time they graduate. Thus we come to the question that is the subject of this paper: What causes female students to drop out of the philosophy program? In this article we answer this question from the philosophy of science and supported by local empirical data, so we do not give a complete or even less exhaustive answer. We review two explanatory models that purport to answer the question of why there are fewer women in philosophy, both formatively and professionally. These are the Different Voices Model (DVM) and the Perfect Storm Model (PSM); we opt for the latter and give reasons for it. Regarding the empirical aspect of our research, our source of statistical data belongs to the undergraduate program in philosophy at the Facultad de Estudios Superiores Acatlán-UNAM, Mexico (FES Acatlán), obtained in the framework of the SWIP-Analytic Mexico workshops. Our analysis of these data shows that even when female students have better GPAs than male students and take fewer subjects while enrolled, female students graduate less than male students in the FES Acatlan degree program. Understanding requires the recognition of the other as a thou, the acceptance of the lack of distance from him and the openness to embrace what is said by him as a possible truth. Understanding has a dialectical structure which implies the cancellation of one’s own expectations and the access to a more comprehensive knowledge. Even though every understanding is historical, it discloses an aspect of the thing itself, which results from the interaction of the I and the thou during the process of hermeneutical conversation and constitutes a common truth with analogous characteristics to practical reason.] . La primacía y efectividad del Derecho de la Unión Europea se proyecta también sobre la Administración Pública y sobre sus actos. Esto obliga a la Administración, como sucede con el juez nacional, a aplicar el Derecho europeo de forma efectiva, lo que exige realizar una interpretación conforme del derecho interno y de la práctica administrativa. -/- Sin embargo, a diferencia del juez nacional, la Administración Pública carece de la guía interpretativa del Tribunal de Justicia. Esto hace muy necesario tener (...) en consideración la doctrina de este tribunal sobre la primacía y efectividad del Derecho europeo y su proyección sobre los actos administrativos, donde si bien la seguridad jurídica protege como regla general a los actos administrativos firmes, en algunos casos se deriva una facultad o una obligación de revisión de actos administrativos firmes. -/- El presente trabajo tiene como propósito realizar un análisis actualizado de la jurisprudencia del Tribunal de Justicia sobre la aplicación de la primacía y efectividad del Derecho de la Unión sobre los actos administrativos. El propósito de este artículo es presentar una aproximación fenomenológica a la experiencia intersubjetiva en contraste a las teorías de la mente y a como estas conciben dicho tipo de experiencia. Se identificará un supuesto esencial de estas teorías según el cual todo tipo de intersubjetividad supone una inferencia y, por lo tanto, elementos normativos. Se argumentará que las investigaciones de Husserl a propósito del concepto de “sentido noemático”, en relación con su concepción del horizonte experiencial, revelan un tipo de (...) experiencia constitutiva e intersubjetiva que es condición de posibilidad de la normatividad supuesta por los teóricos de la mente. Esto sugiere un camino a seguir para lograr encontrar soluciones a cuestiones escépticas tales como el solipsismo y la existencia del mundo exterior. -/- The purpose of this paper is to present a phenomenological approach to intersubjective experience contrasting it with the theories of mind and how them conceive such kind of experience. It will be identified an essential presupposition of these theories according to which all kind of intersubjectivity involve an inference, and therefore, normative elements. It will be argued that Husserl’s investigations regarding the notion of “noematic sense”, related with his concept of experiential horizon, disclose a kind of constitutive and intersubjective experiences which serves as a possibility condition of the normativity which is took for granted by the theories of mind. This suggests a road to follow when trying to find solutions to skeptical problems such as solipsism and the existence of the external world. (shrink)

Con la entrada en vigor del Tratado de Lisboa, la Carta de Derechos Fundamentales adquiere eficacia jurídica, y se prevé la posibilidad de que la Unión Europea se adhiera al Convenio de Roma. En este trabajo pretendemos acercarnos a los antecedentes que han justificado una huída de la tutela de los derechos fundamentales de base jurisprudencial desarrollada por el Tribunal de Justicia hacia una formalización de la misma, a través de dos caminos: la formalización a través de una declaración (...) de derechos que se ha concretado en la Carta de Derechos Fundamentales, y la adhesión al Convenio de Roma. Finalmente trataremos de esbozar las perspectivas que se abren en el horizonte constitucional de la Unión Europea, donde gozamos ya de un Tribunal de Justicia que ejercerá una función tan constitucional como la tutela de los derechos fundamentales, contenidos ya en una declaración con fuerza jurídica, cuya interpretación se vincula al Convenio de Roma. This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems of normativity due to the fact that (...) a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. El presente trabajo aborda el estudio de la ética de la responsabilidad en la función legislativa de la Cámara de Diputados del H. Congreso de la Unión, desde la perspectiva de la evaluación del trabajo de los diputados federales, y busca dar respuesta a la siguiente interrogante: ¿Es eficiente el trabajo de los Diputados Federales en la Cámara de Diputados? El propósito es ¿cómo medir y evaluar la actuación en la función legislativa de los Diputados Federales? y con ello, (...) aproximarnos a identificar si ¿es eficiente y ético el trabajo desempeñado por estos representantes públicos? El trabajo se integra en tres partes. En la primera se ubica el concepto de la ética de la responsabilidad y en la función legislativa. En la segunda sección se presenta la propuesta de un indicador para medir la eficiencia legislativa y se analiza el caso de los diputados federales de la LXI Legislatura que representan al Estado de Veracruz de Ignacio de la Llave. Finalmente, en la tercera parte se presenta una propuesta de acción ciudadana a partir de la información de la eficiencia legislativa y de la necesidad de exigir cumplimiento de la responsabilidad ética en la función legislativa. Como conclusiones importantes de la evaluación de la eficiencia legislativa de los diputados federales de la LXI Legislatura, nos muestra al menos dos resultados importantes: i) El índice de efectividad legislativa (IEL) muestra niveles muy bajos, tanto a nivel del pleno de la Cámara de Diputados, como a nivel del grupo de estudio de los diputados federales representantes del Estado de Veracruz. ii) En ambos casos, muestran un índice de rezago legislativo muy alto. Una alternativa es la exigencia ciudadana del cumplimiento ético de responsabilidad en la función legislativa al conocer la evaluación de resultados, misma que sirve como referencia para identificar escenarios de elección política basados en resultados. The traditional use of conventional media by businesses for audience targeting has shifted with the rise of influencer marketing, notably on platforms like TikTok, posing challenges in content adaptation and technological adaptation. Albert Bandura's Social Cognitive Theory examines factors shaping purchasing behavior, particularly relevant for young professionals. A quantitative correlational study focused on young professionals engaging with TikTok and influenced by Filipino TikTok creators, revealing education level as a key determinant of purchasing behavior. Extended TikTok engagement positively correlates with increased (...) purchasing likelihood. Filipino TikTok influencers significantly impact young professionals' purchasing decisions, emphasizing the need for tailored marketing strategies targeting this demographic. Academia is a competitive environment. Early Career Researchers (ECRs) are limited in experience and resources and especially need achievements to secure and expand their careers. To help with these issues, this book offers a new approach for conducting research using the combination of mindsponge innovative thinking and Bayesian analytics. This is not just another analytics book. 1. A new perspective on psychological processes: Mindsponge is a novel approach for examining the human mind’s information processing mechanism. Environmental activism is expected to improve society’s well-being and environmental sustainability. Nevertheless, some inappropriate ways of activism, like road blockage, art vandalism, assaults, etc., have been recently conducted and risked causing adverse repercussions, including violence escalation. The current study aims to explore which types of environmental activism are more likely to escalate violence between activists, affected citizens, and police. Bayesian Mindsponge Framework (BMF) analytics was employed to analyze a dataset of 89 blockage, vandalism, and harassment cases in 13 countries in (...) this exploratory study. We discovered that rallies and demonstrations, marches, event disruption, and art vandalism were less likely to escalate violence between protestors, other citizens, and the police. In contrast, road blockades and assaults are more likely to lead to violence escalation. Apart from those, sabotage was found to have an ambiguous relationship with the violence escalation. Based on these results, we suggest that climate activists should be more selective in adopting activism approaches to raise public awareness and support and avoid using tactics that might be counterproductive and reduce public backing, such as road blockage and assaults. Despite the negative impact of art vandalism on violence escalation, we also discussed why art vandalism should not be used since it can curb the effectiveness of artivism, showing misuse of artworks (e.g., paintings, music, films) for environmental activism. While consumption culture constitutes a significant proportion of greenhouse gas emissions, most of these emissions are caused by the consumption of the wealthiest. In this article, we will explore the challenges that consumer culture has exacerbated regarding climate change and propose that transitioning to a simpler and more sustainable lifestyle could be an effective solution in the fight against climate change. As society is still trying to transition to a new phase to adapt to technological changes, the AI revolution continues to unfold, necessitating a reconsideration of the trajectory of societal transformation as it could exacerbate the aforementioned information security risks. Specifically, how should society evolve to keep pace with the transformative impact of the current AI technology wave? The importance of addressing the existential threat to humanity, climate change, has grown remarkedly in recent years while conflicting views and interests in societies exist. Therefore, climate change agendas have been weaponized to varying degrees, ranging from the international level between countries to the domestic level among political parties. In such contexts, climate change agendas are predominantly driven by political or economic ambitions, sometimes unconnected to concerns for environmental sustainability. Consequently, it can result in an environment that fosters antagonism and (...) disputes over power and position and increases the risk of prolonged confrontations, hindering the collective global efforts to mitigate and adapt to climate change. Through the current discourse, we aim to provide a preliminary definition of the weaponization of climate change and environmental degradation and examine its risks and consequences on international relations, political dynamics, public perception, and the comprehensive integrity of climate action. We also recommend embracing a globally coordinated, scientifically substantiated approach to circumvent climate change by building an eco-surplus cultural value system. (shrink)

Vietnam, with a geographical proximity and a high volume of trade with China, was the first country to record an outbreak of the new Coronavirus disease (COVID-19), caused by the Severe Acute Respiratory Syndrome Coronavirus 2 or SARS-CoV-2. While the country was expected to have a high risk of transmission, as of April 4, 2020—in comparison to attempts to contain the disease around the world—responses from Vietnam are being seen as prompt and effective in protecting the interests of its citizens, (...) with 239 confirmed cases and no fatalities. This study analyzes the situation in terms of Vietnam’s policy response, social media and science journalism. A self-made web crawl engine was used to scan and collect official media news related to COVID-19 between the beginning of January and April 4, yielding a comprehensive dataset of 14,952 news items. The findings shed light on how Vietnam—despite being under-resourced—has demonstrated political readiness to combat the emerging pandemic since the earliest days. Timely communication on any developments of the outbreak from the government and the media, combined with up-to-date research on the new virus by the Vietnamese science community, have altogether provided reliable sources of information. By emphasizing the need for immediate and genuine cooperation between government, civil society and private individuals, the case study offers valuable lessons for other nations concerning not only the concurrent fight against the COVID-19 pandemic but also the overall responses to a public health crisis. The problem of universals remains a philosophical theme not only in ontology but also in epistemology. In Husserl, there are particular universals, the noematic ‘X’, the identical, and universals stricto sensu, atemporal universal names. In this paper, I present the theme as it is analyzed by Husserl in Ideas I. In the first section, I describe the trajectory to the universals highlighting the parallelism between noese and noema. In the second section, I draw the reflection of this problem on the (...) philosophy of language which is also affected by the noeticnoematic correspondence. In the third and last section, I show how the investigation about the universals moves in the noematic sphere, and conclude defending the possibility of reaching the universal strict sense departing from the noematic ‘X’. El alejandrino adopta y asimila numerosos aspectos de la doctrina y la terminología de los seguidores de Platón. Sin embargo, también toma distancia de ellos en algunos puntos neurálgicos de su concepción de lo divino (...) y de la creación del mundo. Se analizan especialmente los papeles que cumplen en la teoría origeniana las categorías académicas de lo absoluto y lo relativo, la noción mesoplatónica y filoniana del agente demiúrgico y una original adaptación del esquema causal derivativo neopitagórico. -/- The present paper intends to trace the influence of the Platonic tradition On first principles;, considering its different versions, on the philosophy of Origen of Alexandria. Origen's knowledge of the Platonists and his affinity with them are confirmed by the historical sources. The Alexandrian adopts and assimilates many aspects of the doctrine and terminology of Plato's followers. However, he also departs from them regarding some of the essential elements in his conception of the divine and of the world's creation. Particularly, the paper focuses on the roles played in Origen's theory by the Academic categories of absolute and relative, the Middle-platonic and Philonian notion of the demiurgic agent and an original reframing of the Neopythagorean derivative system of causes. Environmental activism is crucial for raising public awareness and support toward addressing the climate crisis. However, using climate change mitigation as the cause for blockage, vandalism, and harassment activities might be counterproductive and risk causing negative repercussions and declining public support. The paper describes a dataset of metadata of 89 blockage, vandalism, and harassment events happening in recent years. The dataset comprises three main categories: 1) Events, 2) Activists, and 3) Consequences. For researchers interested in environmental activism, climate change, and (...) sustainability, the dataset is helpful in studying the effectiveness and appropriateness of strategies to raise public awareness and support. For researchers in the field of security studies and green criminology, the dataset offers resources to study features and impacts of blockage, vandalism, and harassment events. Trong những năm gần đây, khái niệm phát triển bền vững đã trở nên phổ biến trong các ngành công nghiệp trên khắp thế giới. Người tiêu dùng ngày càng tỏ ra quan tâm đến tác động môi trường tạo ra từ các lựa chọn của họ, điều này đã thúc đẩy các công ty phải sử dụng các thông điệp và biện pháp thân thiện với môi trường. Mặc dù những nỗ lực thực sự hướng đến sự bền vững (...) là đáng khen ngợi, nhưng đã xuất hiện một xu hướng đáng báo động: hiện tượng "tẩy xanh" (greenwashing). Como es sabido el Tribunal de Justicia de la Unión Europea ha precisado que las relaciones entre el Derecho de la Unión Europea y el Derecho de los Estados miembros están regidas por el principio de primacía del primero sobre los segundos. Sin embargo, la autoridad formal que puede ostentar el Derecho de la Unión Europea en los sistemas jurídicos nacionales no va a depender en exclusiva de la jurisprudencia de dicho tribunal, sino que está condicionada, en (...) gran medida, por las características de cada ordenamiento nacional, y la jurisprudencia de los tribunales constitucionales o supremos nacionales. -/- De hecho, en gran parte de los Estados miembros, fundamentalmente en la jurisprudencia de los tribunales constitucionales o supremos de los mismos, se pueden encontrar ciertas reservas o límites a la aceptación de la primacía del Derecho de la Unión. In this paper, I argue that we face a challenge in understanding the relationship between the ‘value-oriented’ and ‘other-oriented’ dimensions of shame. On the one hand, an emphasis on shame's value-oriented dimension leads naturally to ‘The Self-Evaluation View’, an account which faces a challenge in explaining shame's other-oriented dimension. This is liable to push us towards ‘The Social Evaluation View’. However The Social Evaluation View faces the opposite challenge of convincingly accommodating shame's ‘value-oriented’ dimension. After rejecting one attempt to chart (...) a middle course between these extremes, I argue that progress can be made if we reject the widespread assumption that the other-oriented dimension of shame is best understood primarily terms of our concern with the way we appear to others. Instead, I outline an account which treats shame as manifesting our desire primarily for interpersonal connection and which elucidates the property of shamefulness in terms of merited avoidance. Deep Ecology, the Voluntary Human Extinction Movement (VHEMT), and Anti-Civilization Primitivism have frequently been labeled as radical environmental ideologies, owing to their relationship with activities conducted by environmental extremists. Nonetheless, given the serious concerns faced by climate change and biodiversity loss, it is critical to engage with a broad range of perspectives and techniques. Such participation allows us to have access to a greater range of perspectives and a more diverse pool of knowledge, boosting our capacity for creative problem-solving. The (...) purpose of this essay is to reconsider the underlying concepts and principles that drive these theories, as well as to assess their relevance in tackling modern environmental issues. We think that Deep Ecology, the Voluntary Human Extinction Movement (VHEMT), and Anti-Civilization Primitivism should be called "unconventional" or "distinctive" rather than "radical," because they primarily focus on the ontological perspective but do not urge extreme acts. Meanwhile, their distinctiveness helps increase public awareness about environmental issues and promote reflection on and rethinking of the ontological link between mankind and the natural world.
