Recent global efforts of the United States and England to withdraw from international institutions, along with recent challenges to human rights courts from Poland and Hungary, have been described as part of a growing global populist backlash against the liberal international order. Several scholars have even identified the recent threat of mass withdrawal of African states from the International Criminal Court (ICC) as part of this global populist backlash. Are the African challenges to the ICC part of a global populist (...) movement developing in Africa? More fundamentally, how are the African challenges to the ICC examples of populism, if at all? In this paper, I show that, while there is considerable overlap between the strategies used by particular African leaders to challenge the ICC and those typically considered populist, as well as a discernible thin populist ideology to sustain them, there is insufficient evidence of a larger anti-ICC populist movement in Africa. Although Africa is not as united against the ICC as the populist narrative suggests, the recent challenges to the Court from Africa pose a significant challenge to the Court, as the institution is still in the early stages of building its legitimacy. In this article, I contribute to the debate between two philosophical traditions—the Kantian and the Aristotelian—on the requirements of criminal responsibility and the grounds for excuse by taking this debate to a new context: international criminal law. After laying out broadly Kantian and Aristotelian conceptions of criminal responsibility, I defend a quasi-Aristotelian conception, which affords a central role to moral development, and especially to the development of moral perception, for international criminal law. I show than an implication of this view (...) is that persons who are substantially and non-culpably limited in their capacity for ordinary moral perception warrant an excuse for engaging in unlawful conduct. I identify a particular set of conditions that trigger this excuse, and then I systematically examine it as applied to the controversial case of former-child-soldier-turned leader of the Lord’s Resistance Army, Dominic Ongwen, who is currently at trial at the International Criminal Court. This paper examines whether American parents legally violate their children’s privacy rights when they share embarrassing images of their children on social media without their children’s consent. My inquiry is motivated by recent reports that French authorities have warned French parents that they could face fines and imprisonment for such conduct, if their children sue them once their children turn 18. Where French privacy law is grounded in respect for dignity, thereby explaining the French concerns for parental “over-sharing,” I show (...) that there are three major legal roadblocks for such a case to succeed in US law. First, US privacy tort law largely only protects a person’s image where the person has a commercial interest in his or her image. Secondly, privacy tort laws are subject to constitutional constraints respecting the freedom of speech and press. Third, American courts are reluctant to erode parental authority, except in cases where extraordinary threats to children’s welfare exist. I argue that while existing privacy law in the US is inadequate to offer children legal remedy if their parents share their embarrassing images of them without their consent, the dignity-based concerns of the French should not be neglected. I consider a recent proposal to protect children’s privacy by extending to them the “right to be forgotten” online, but I identify problems in this proposal, and argue it is not a panacea to the over-sharing problem. I conclude by emphasizing our shared social responsibilities to protect children by teaching them about the importance of respecting one another’s privacy and dignity in the online context, and by setting examples as responsible users of internet technologies. Nicole Oresme cannot be counted among those late medieval philosophers who fostered a return to Augustine. Nevertheless, quotations from Augustine in Oresme’s works are not just tributes to one of the most outstanding thinkers. Indeed, in Oresme’s anti-astrological works Augustine’s De civitate Dei is one of the most relevant sources, while in his commentary on Aristotle’s Ethica (in its French translation) Oresme’s idea of freedom is largely inspired by Augustine.

Luck egalitarians think that considerations of responsibility can excuse departures from strict equality. However critics argue that allowing responsibility to play this role has objectionably harsh consequences. Luck egalitarians usually respond either by explaining why that harshness is not excessive, or by identifying allegedly legitimate exclusions from the default responsibility-tracking rule to tone down that harshness. And in response, critics respectively deny that this harshness is not excessive, or they argue that those exclusions would be ineffective or lacking in justification. (...) Rather than taking sides, after criticizing both positions I also argue that this way of carrying on the debate – i.e. as a debate about whether the harsh demands of responsibility outweigh other considerations, and about whether exclusions to responsibility-tracking would be effective and/or justified – is deeply problematic. On my account, the demands of responsibility do not – in fact, they can not – conflict with the demands of other normative considerations, because responsibility only provides a formal structure within which those other considerations determine how people may be treated, but it does not generate its own practical demands. According to Nicole Oresme (c. 1320–1382), human beings, unlike all other animals, consist of two substances: a thinking substance and a sensing substance. This paper presents and explores the arguments Oresme uses to arrive at this position, which is unusual in medieval philosophical psychology and which at least superficially – though their methods are completely different – resembles what Descartes concluded about the nature of the human soul and body two and a half centuries later. The paper also considers (...) some moments of ambivalence in Oresme’s presentation, as well as unresolved difficulties, several of which have theological as well as philosophical implications. Biological ontologies are used to organize, curate, and interpret the vast quantities of data arising from biological experiments. While this works well when using a single ontology, integrating multiple ontologies can be problematic, as they are developed independently, which can lead to incompatibilities. The Open Biological and Biomedical Ontologies Foundry was created to address this by facilitating the development, harmonization, application, and sharing of ontologies, guided by a set of overarching principles. One challenge in reaching these goals was that the (...) OBO principles were not originally encoded in a precise fashion, and interpretation was subjective. Here we show how we have addressed this by formally encoding the OBO principles as operational rules and implementing a suite of automated validation checks and a dashboard for objectively evaluating each ontology’s compliance with each principle. This entailed a substantial effort to curate metadata across all ontologies and to coordinate with individual stakeholders. We have applied these checks across the full OBO suite of ontologies, revealing areas where individual ontologies require changes to conform to our principles. Our work demonstrates how a sizable federated community can be organized and evaluated on objective criteria that help improve overall quality and interoperability, which is vital for the sustenance of the OBO project and towards the overall goals of making data FAIR. Egalitarians must address two questions: i. What should there be an equality of, which concerns the currency of the ‘equalisandum’; and ii. How should this thing be allocated to achieve the so-called equal distribution? A plausible initial composite answer to these two questions is that resources should be allocated in accordance with choice, because this way the resulting distribution of the said equalisandum will ‘track responsibility’ — responsibility will be tracked in the sense that only we will be responsible for (...) the resources that are available to us, since our allocation of resources will be a consequence of our own choices. But the effects of actual choices should not be preserved until the prior effects of luck in constitution and circumstance are first eliminated. For instance, people can choose badly because their choice-making capacity was compromised due to a lack of intelligence (i.e. due to constitutional bad luck), or because only bad options were open to them (i.e. due to circumstantial bad luck), and under such conditions we are not responsible for our choices. So perhaps a better composite answer to our two questions (from the perspective of tracking responsibility) might be that resources should be allocated so as to reflect people’s choices, but only once those choices have been corrected for the distorting effects of constitutional and circumstantial luck, and on this account choice preservation and luck elimination are two complementary aims of the egalitarian ideal. Nevertheless, it is one thing to say that luck’s effects should be eliminated, but quite another to figure out just how much resource redistribution would be required to achieve this outcome, and so it was precisely for this purpose that in 1981 Ronald Dworkin developed the ingenuous hypothetical insurance market argumentative device (HIMAD), which he then used in conjunction with the talent slavery (TS) argument, to arrive at an estimate of the amount of redistribution that would be required to reduce the extent of luck’s effects. However recently Daniel Markovits has cast doubt over Dworkin’s estimates of the amount of redistribution that would be required, by pointing out flaws with his understanding of how the hypothetical insurance market would function. Nevertheless, Markovits patched it up and he used this patched-up version of Dworkin’s HIMAD together with his own version of the TS argument to reach his own conservative estimate of how much redistribution there ought to be in an egalitarian society. Notably though, on Markovits’ account once the HIMAD is patched-up and properly understood, the TS argument will also allegedly show that the two aims of egalitarianism are not necessarily complementary, but rather that they can actually compete with one another. According to his own ‘equal-agent’ egalitarian theory, the aim of choice preservation is more important than the aim of luck elimination, and so he alleges that when the latter aim comes into conflict with the former aim then the latter will need to be sacrificed to ensure that people are not subordinated to one another as agents. I believe that Markovits’ critique of Dworkin is spot on, but I also think that his own positive thesis — and hence his conclusion about how much redistribution there ought to be in an egalitarian society — is flawed. Hence, this paper will begin in Section I by explaining how Dworkin uses the HIMAD and his TS argument to estimate the amount of redistribution that there ought to be in an egalitarian society — this section will be largely expository in content. Markovits’ critique of Dworkin will then be outlined in Section II, as will be his own positive thesis. My critique of Markovits, and my own positive thesis, will then make a fleeting appearance in Section III. Finally, I will conclude by rejecting both Dworkin’s and Markovits’ estimates of the amount of redistribution that there ought to be in an egalitarian society, and by reaffirming the responsibility-tracking egalitarian claim that choice preservation and luck elimination are complementary and not competing egalitarian aims. Garrath Williams claims that truly responsible people must possess a “capacity … to respond [appropriately] to normative demands” (2008:462). However, there are people whom we would normally praise for their responsibility despite the fact that they do not yet possess such a capacity (e.g. consistently well-behaved young children), and others who have such capacity but who are still patently irresponsible (e.g. some badly-behaved adults). Thus, I argue that to qualify for the accolade “a responsible person” one need not possess such (...) a capacity, but only to be earnestly willing to do the right thing and to have a history that testifies to this willingness. Although we may have good reasons to prefer to have such a capacity ourselves, and to associate ourselves with others who have it, at a conceptual level I do not think that such considerations support the claim that having this capacity is a necessary condition of being a responsible person in the virtue sense. This essay calls attention to an aspect of Confucius's notion of ren that has often been overlooked or even denied in much recent discussion of the topic. While the egalitarian aspect of ren, i.e., the idea that every human being has the potential to become a ren person, is frequently asserted, the leadership dimension of ren has for the most part been given short shrift. I argue that for Confucius, ren is the leadership virtue. Passages from the recently excavated Guodian manuscripts bear a surprising resemblance to a position ascribed to Gaozi and his followers in the Mengzi at 6A4-5, namely that righteousness is “external.” Although such a resemblance has been noted, the philosophical implications of it for the debate between Gaozi and Mengzi and, by extension, for Mengzian ethics have been largely unexplored. I argue that a Guodian-inspired reading of 6A4-5 is one that takes the debate to be about whether standing in certain family (...) relations makes a difference to whether one’s actions are righteous. Gaozi denies that it does, holding the view that one’s family relations, i.e., relations internal to the household, are irrelevant when it comes to matters of righteousness, while Mengzi disagrees, arguing that all relational properties, including family relations, are just as much reason-giving properties for performing righteous actions as they are in the case of performing benevolent actions. I argue that such a Guodian-based reading provides us a simple, yet explanatorily powerful reading of 6A4-5 that has broader implications for Mengzian ethics and our understanding of the early Chinese intellectual milieu in general. “Bodily autonomy” has received significant attention in bioethics, medical ethics, and medical law in terms of the general inviolability of a patient’s bodily sovereignty and the rights of patients to make choices (e.g., reproductive choices) that concern their own body. However, the role of the body in terms of how it can or does contribute to a patient’s capacity for, or exercises of their autonomy in clinical decision-making situations has not been explicitly addressed. The approach to autonomy in this paper (...) is aligned with traditional theories that conceive autonomy in terms of an individual’s capacities for, and exercises of rational reflection. However, at the same time, this paper extends these accounts by arguing that autonomy is, in part, embodied. Specifically, by drawing on phenomenological conceptions of the experience of autonomy, we argue that, in principle, the body is a necessary component of the capacity for autonomy. Secondly, through the presentation of two different cases, we highlight ways in which a patient’s body can contribute to the autonomy of treatment choices. Ultimately, we hope to encourage others to explore additional conditions under which a concept of embodied autonomy should be employed in medical decision making, how its underlying principles might be operationalised in clinical situations, and its consequences for approaches to patient autonomy in healthcare practice, policy, and law. In his commentary on Aristotle’s Physics, Nicole Oresme raises a question that he is apparently the first to ask in these terms, in such a context: do all beings have the desire to persevere into being? Before him, this question is not found in any of the medieval commentaries on Aristotle’s Physics. But after him it became canonical until at least the 16th century, since it can be found in Pietro Pomponazzi’s works for example. The novelty here consists in (...) questioning the validity of Averroes’ thesis, in his own commentary on the Physics, according to which all beings have the desire to persist into being, using the Augustinian analysis of voluntary death and suicide. How can we explain that one can freely put an end to his days if he is naturally inclined by a desire for life and even for eternity? Oresme’s solution consists in justifying not only the possibility, but also the moral obligation to accept death under certain conditions. In most cases, we do not really want to die. The desperate man wishes to cancel his misfortune and the heroic man who sacrifices himself for his country wishes to immortalize himself in the memory of other men. From a moral point of view, Nicole Oresme justifies only one case of voluntary death: that of individual sacrifice for the common good. The aim of this paper is to analyze precisely this important turning point in the long history of the notion of conatus in the West by comparing this quaestio from the commentary on the Physics with the glosses that accompany the French translation of the Nicomachean Ethics realised by Oresme at the court of Charles V. It was the emphasis of Søren Kierkegaard's railing against 19th-century Danish Christianity in all its ruthlessness that eventually led him to utterly reject and actively fight the majority of the contemporary as well as important aspects of the historical discourse on Christianity. One of the aspects that Kierkegaard distanced himself from sharply consists in the long tradition of Christian mysticism. Nevertheless his concept of the “knight of faith” reveals several deliberations that appear to be close to mystical Christian conceptions (e.g. (...) the meaning of suffering or despair for the leap of faith, an increasing awareness of sin and guilt as well as the conditions for the knight of faith's secular ministry). Thus, Kierkegaard's critique of mysticism suggests his misunderstanding of the mystical perspective's implications. This essay tries to solve said misunderstanding between Kierkegaard and christian tradition by interrelating the process of becoming a knight of faith with the mystical responsibility before the divine and the ethical responsibility before all of humanity. What are the freedom-relevant conditions necessary for someone to be a morally responsible person? I examine several key authors beginning with Harry Frankfurt that have contributed to this debate in recent years, and then look back to the writings or Søren Kierkegaard to provide a solution to the debate. In this project I investigate the claims of semi-compatibilism and argue that while its proponents have identified a fundamental question concerning free will and moral responsibility—namely, that the agential properties necessary for (...) moral responsibility ascriptions are found in scenarios where the agent acts on her own as opposed to her action resulting from freedom undermining external causes such as manipulation, phobias, etc.—they have failed to show that the freedom-relevant agential properties identified in those actual-sequence scenarios are compatible with causal determinism. My argument is that only a voluntarist-libertarian theory can adequately account for the kinds of cases that the semicompatibilist identify. I argue that there are three freedom-relevant conditions necessary for someone to be a morally responsible person: a hierarchical understanding of human desires [specifically and mental states generally], an incompatibilist (non-deterministic) understanding of human action, and a historical understanding of character development. The ability to reflect critically about one’s own desires and emotions, and thus to have a kind of self-knowledge and understanding with regard to the springs of one’s own actions, is required to make it possible for the agent to be the “source” of her own actions and character. The non-deterministic understanding of human action is needed for a similar reason: if determinism is true, then every action a person performs can be ultimately traced to and exhaustively explained in terms of factors outside the agent’s control, thus making the agent’s responsibility for his actions an illusion. And finally,human nature must be such that, over time, one’s choices leave a dispositional residue self-understanding and motivation in the person’s self, out of which, in mature understanding and motivation, the person acts as a fully responsible agent. In the introduction to her book-length study of Aristotle’s concept of “στάσις” (variously translated in English as civil war, revolution, faction, unrest, but which I will leave untranslated), Esther Rogan writes that “En France, un travail exhaustif et systématique restait donc à accomplir sur la stásis</i> chez Aristote, afin de prolonger et de faire se rejoindre les perspectives développées par Nicole Loraux et par Pierre Pellegrin, mais également afin d’inscrire les débats anglo-saxons dans le champ de la recherche française (...) et, ainsi, prendre position dans ces discussions” (24). Rogan’s book admirably accomplishes all those goals and much more. Although the book focuses on Aristotle’s account of στάσις, her inquiry is wide ranging with substantive insights about both the methodology of interpreting ancient Greek political thought generally and more specifically Aristotle’s political thought. The work engages so many different debates and such a broad range of Anglophone and Francophone scholarship that it should not be pigeonholed as “a book on στάσις”; rather, this is a substantive interpretation of Aristotle’s political thought as a whole, albeit through the fascinating lens of political unrest. This article aims to understand the views of three prominent figures in existential literature and philosophy: Albert Camus, Søren Kierkegaard, and Fyodor Dostoevsky. The analysis focuses on exploring and explaining fundamental concepts of their philosophies, such as morality, the meaning of life, and the relationship with the divine, in order to establish a dialogue among these three authors. The underlying thread connecting these thinkers is the Socratic figure of speech, irony. Through the examination of contradictions and ironic elements present in (...) their works, the article highlights the significance of irony as a central core in their ideas, encompassing both academic discourse and the realms of literature and symbolism. The comparative method employed goes beyond contrasts, also emphasizing points of contact between the ideas expressed through the stages of existence and the personalities of the protagonists in their novels. The initial sections for each author introduce the basic concepts for general understanding. Subsequently, the main ideas are explored through analysis of their masterpieces, leading to a comparative dialogue among them. Contrasts involve the perspectives embodied by characters like Alyosha Karamazov, Meursault, and Zosima, showcasing the authors' opinions, reflecting the zeitgeist, and highlighting their divergences, ultimately providing a comprehensive view of how they influenced and criticized each other within the philosophical tradition. This essay analyzes two diverse interpretations of Christian love in the writings of Søren Kierkegaard and Josiah Royce. Through the comparison of these two positions, I attempt to show not only the embeddedness of a conception of love in an entire theological vision but its usefulness as a lens for examining that position. I argue that Kierkegaard's interpretation of love tends to foster social inequality, a tendency rooted in his basic ontology. We argue for the possibility of validating the presence of consciousness in another person from a perspective that blends both, a third-person approach of coming close to, observing, and understanding the other; and a first-person assessment of how the experience of the other feels like. For this, we will need to explain how the line between the third-person and first-person approaches is blurred in some methodological approaches. We rest our position largely on the back of some seminal conclusions of the (...) meditations of Ren\'e Descartes and other theories concerning consciousness like Chalmers' naturalistic dualism and, to some secondary extent on Integrated Information Theory (IIT). Additionally, we describe fundamental contextual principles already developed in the literature and the arts (like Stanivlaski's Acting System), and then we use them for setting a suitable methodology that we feel can be used to validate the presence of others' conscious experiences in one's consciousness (at suitable periods of spacetime). Finally, we give general methodological guidelines for the construction of the concrete experiment and we explore very briefly the potential implications of this kind of research in other academic and non-academic settings. Søren Kierkegaard is well-known as an original philosophical thinker, but less known is his reliance upon and development of the Christian tradition of the Seven Deadly Sins, in particular the vice of acedia, or sloth. As acedia has enjoyed renewed interest in the past century or so, commentators have attempted to pin down one or another Kierkegaardian concept (e.g., despair, heavy-mindedness, boredom, etc.) as the embodiment of the vice, but these attempts have yet to achieve any consensus. In our estimation, (...) the complicated reality is that, in using slightly different but related concepts, Kierkegaard is providing a unique look at acedia as it manifests differently at different stages on life’s way. Thus, on this “perspectival account”, acedia will manifest differently according to whether an individual inhabits the aesthetic, ethical, or religious sphere. We propose two axes for this perspectival account. Such descriptions of how acedia manifests make up the first, phenomenal axis, while the second, evaluative axis, accounts for the various bits of advice and wisdom we read in the diagnoses of acedia from one Kierkegaardian pseudonym to another. Our aim is to show that Kierkegaard was not only familiar with the concept of acedia, but his contributions helped to develop and extend the tradition. (shrink)

Here, we give the first edition of a question De apprehensione rerum per visum disputed at Erfurt, probably around 1350–1355. It has the same title as a question by Oresme, and we can observe that it often borrows to this last one. It is situated in the frame of the perspectivist studies in the new eastern European universities. Above all, it is a rare testimony of the Nicole Oresme’s influence on the studies in these universities.

Kierkegaardovo misaono nadahnuće motivirano je dvama nezadovoljstvima: prvo se tiče spekulativne filozofije i njezine nemogućnosti da zahvati zbiljnost pojedinca u njegovoj egzistencijalnoj danosti, a drugo se tiče građansko-kršćanskog svijeta njegova doba koji je u rasulu i gdje je »individua« posve dokinuta prevlašću »gomile«. Kako postati samim sobom, »jedan jedini«, odnosno »individua« , pitanje je koje Kierkegaard postavlja u središte svog filozofskog interesa. Put od običnog opstanka do zbiljskog egzistiranja, odnosno od »gomile« do »individue« ostvaruje se kroz tri stadija. To su (...) estetski, etički i religiozni stadij egzistiranja. U ovom se radu analiziraju njihovi ključni konstituensi i suodnos iščitavanjem primarno tri Kierkegaardova djela: Ili-ili, Bolest na smrt, Strah i drhtanje. I dok je odnos između estetskog i etičkog stadija dijalektički, religiozno stoji naspram estetskog i etičkog u naddijalektičkom odnosu. Taj se nad-dijalektički odnos pokazuje ključnim za interpretaciju Kierkegaardova mišljenja. -/- Kierkegaard’s philosophical inspiration was motivated by two displeasures: The first one concerns speculative philosophy and its incapability to grasp the reality of an individual in their existential givenness, and the second one has to do with the contemporary bourgeois-Christian world that had been falling apart and in which the “individual” was quite abrogated by the domination of the “crowd”. How to become one’s self, “unique”, or an “individual”, is the question Kierkegaard places into the center of his philosophical interest. The path from a common survival to a real existence, i. e., from the “crowd” to the “ndividual” is realized in three stages, through the esthetic, ethical, and the religious stages of exiastence. This paper analyzes their key constituents and their interrelation with an analysis of thre of Kierkegaard’s works: Either/Or, The Sickness unto Death, and Fear and Trembling. While the relation between the esthetic and ethical stages is a dialectical one, the religious is in a supradialectical relation to the esthetic and the ethical. This supradialectical relation is the key to the interpretation of Kierkegaard’s thought. (shrink)

Alison Assiter has put together a work that has the potential to create an exciting and stimulating debate in Kierkegaard circles. Mostly because she portrays Kierkegaard as an idealist ontologist, that is, a philosopher of not just human nature (i.e. subjectivity), but also nature in its cosmic totality. Thus, what I find most admirable is that with Assiter we have a thinker who has the philosophical courage to suggest that the purported relationship between Schelling and Kierkegaard leads necessarily to bold (...) philosophical consequences. Since Günther Figal’s 1980 article, Schelling und Kierkegaards Freiheitsbegriff, which gave us the first clue of the Kierkegaardian connection to Schelling’s Freiheitsschrift, scholars have primarily focused on reemphasizing the actual possibility of (the early) Schellingean heritage in Kierkegaard, meanwhile forgetting to ask themselves what consequences this connection might have on our interpretation of Kierkegaard’s corpus. Assiter’s book is an attempt to draw such a long needed consequence. (shrink)

As robots increasingly find their way into the various spheres of human life, the question of religious robots becomes relevant. This article examines from a Catholic-Christian theological perspective whether robots can be used for religious purposes, and it asks how this may be done and what issues are important to consider. In addition, the study contributes to research on the theological engagement with robotics. It is argued that the use of religious robotics dif- fers significantly depending on the specific religion. (...) From a Christian perspective, the use of religious robotics is fundamentally plausible, especially since a wide variety of entities are used as religious media or representations of the divine. However, the use of religious robotics will ultimately be decided by different concepts (e.g. human, life), religious doctrines and culturally transmitted and subjective attitudes. This article places particular focus on the design of reli- gious robotics. It becomes clear that the reasons for accepting religious technology do not lie in the technology itself but in phenomenological preferences and various time- and culture-de- pendent ideas and concepts. It is likely that as robotics rapidly advances and our relationship with it develops, the use of religious robots also will change. In New Essays on Human Understanding, book II, chapter xxi Leibniz presents an interesting picture of the human mind as not only populated by perceptions, volitions and appetitions, but also by endeavours. The endeavours in question can be divided to entelechy and effort; Leibniz calls entelechy as primitive active forces and efforts as derivative forces. The entelechy, understood as primitive active force is to be equated with a substantial form, as Leibniz says: “When an entelechy – i.e. a primary or (...) substantial endeavour – is accompanied by perception, it is a soul” (NE II, xxi, §1; RB, 170). What about efforts, then? One is certainly the will. In NE, II, xxi, §5 Leibniz argues that volition is the effort (conatus) to move towards what one finds good and away from what one finds bad and that this endeavor arises from the perceptions we are aware of. As an endeavour results in action unless it is prevented, from will (which is always directed to the good) and power together follows action. However, this is not so simple. Leibniz argues that there is also a second class of efforts: “There are other efforts, arising from insensible perceptions, which we are not aware of; I prefer to call these ‘appetitions’ rather than volitions” (NE II, xxi, §5; RB, 173). Although there are appetitions of which one can be aware, usually these appetitions arise from the insensible petite perceptions and are consequently affecting us subconsciously. Now, although all minute perceptions are confused perceptions, they are always related to pleasure and displeasure and also to perfection and imperfection. From this follows that there can be different efforts present in the soul at the same time: the will which is directed to apperceived good and several separate appetitions which lead to different goals, both to those which bring about perfection and pleasure of the mind (joy) and those which bring about displeasure and imperfection (sorrow). These efforts are not only in conflict with each other but may also be in conflict with entelechy. A typical case is perceiving a sensual pleasure. Our entelechy which is always directed to final causes (perfection) may be in conflict with several different appetitions which are related in different ways to the sensual pleasure in question. If our understanding is developed enough, our will resists the temptation posed by the pleasure (agreeing with entelechy), but if the temptation is too strong, the appetitions outweigh the will and the resulting action bring about imperfection and sorrow as it is related to imperfection. In this paper I will argue that deliberation in the human soul is a battle of different endeavors described above: the entelechy in the soul strives according to its law-of-the-series towards its telos (perfection) and the will accompanies it by being automatically directed to the good. This thrust towards the apparent good is aided or hindered by the appetitions which can be thought as derivative forces in the Leibnizian dynamics. Depending on whether the predominant appetitions are related to good or bad desires, the deliberation succeeds or fails in achieving the real good which is the goal of human deliberation. The successs can be facilitated beforehand by developing our understanding so that we are less easily swept away by the derivative forces (NE II, xxi, §19). A central role in this task is played by strong willing. As Martha Bolton has noted in her recent paper, an essential feature of the basic, standing endeavors is that they are continuous – although the power balance in the soul changes from moment to moment, something lingers from our previous volitions. That is why Leibniz argues that we pave way for the future deliberations by our previous voluntary actions (NE II, xxi, §23). In contrast, the appetitions are temporary, fliegende Gedanken as Leibniz says in NE II, xxi, §12. Therefore there is a constant, always changing power balance between two kinds of endeavors in the soul: primitive active force versus derivative forces. I will argue that the behavior of the forces in the soul can be understood with a vectorial model which is related to Leibniz’s early ideas of calculus of variations and which was anticipated by Arnauld and Nicole’s Port-Royal Logic. The central idea in the model is that the options are in tension towards each other and the ratio between them at each moment determines the consequent outcome. The proper relationship between the endeavors is not a simple balance, two options which exhaust each other, but a case where different efforts complement each other: “Since the final result is determined by how things weigh against one another, I should think it could happen that he most pressing disquiet did not prevail; for even If it prevailed over each of the contrary endeavours taken singly, it may be outweighed by all of them together.” Leibniz continues : “Everything which then impinges on us weighs in the balance and contributes to determining a resultant direction, almost as in mechanics” (NE II, xxi, §40; RB, 193). The different endeavors can be understood as vectors leading to different directions and the end result is a certain direction that deliberation takes. The dynamical tension between the different endeavors presents a situation where everything affects everything and the following direction, the resulting volition follows more or less automatically. In Theodicy, §325 Leibniz describes the deliberation as follows: “One might, instead of the balance, compare the soul with a force that puts forth an effort on various sides simultaneously, but which acts only at the spot where action is easiest or there is least resistance” (Huggard, 322) This kind of dynamical tension can be understood in terms of the calculus of variations where there are several possible variations available but where the dynamics of the situation results in the decision taking the “easiest” route which is more or less objectively good depending on the level of the deliberator’s understanding. In his comments to Bayle’s note L of “Rorarius” Leibniz says: “The soul, even though it has no parts, has within it, because of the multitude of representations of external things, or rather because of the representation of the universe lodged within it by the creator, a great number, or rather an infinite number, of variations (Woolhouse & Francks (ed.), ‘New System’ and Associated Texts, 101). This kind of deliberation is comparable to God’s choice of the best world with the difference that God’s understanding is infinite which again results in the fact that the choice is the best possible. Whereas in nature the easiest route taken is always optimal as nature is God’s creation, in men the goodness or badness of men’s actions is dependent on their state of wisdom, that is, how developed their understanding is. The more wise men are, the more metaphysical goodness or perfection follows from their actions. (shrink)

1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding and (...) topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject. The aim of this paper is to look at Søren Kierkegaard's defence of an ethical way of life in the light of Harry Frankfurt's work. There are salient general similarities connecting Kierkegaard and Frankfurt: Both are sceptical towards the Kantian idea of founding morality in the laws of practical reason. They both deny that the concerns, which shape our lives, could simply be validated by subject-independent values. Furthermore, and most importantly, they both emphasize the importance of reflective endorsement of one's (...) way of life. This endorsement is understood by both not as an exercise of reason but as an exercise of our will without which boredom, anxiety and, ultimately, the dissolution of the self threatens. We can, the author of the paper argues, directly impose Frankfurt's hierarchical account of psychological attitudes on Kierkegaard in the sense that Frankfurt clearly helps us to elucidate Kierkegaard. This interpretation, however, also shows the limitations of any attempt, inspired by Kierkegaard, to justify moral rules without appealing to a religious foundation of morality. /// O propósito do presente artigo é, antes de mais, proceder, à luz da obra de Harry Frankfurt, a uma análise da defesa que Søren Kierkegaard faz do modo ético de conceber a existência humana. Com efeito, segundo o autor do artigo, são várias as similitudes existentes entre Kierkegaard e Frankfurt: ambos se mostram cépticos em relação ao projecto kantiano de fundar a moralidade nas leis da razão prática; ambos negam que as nossas preocupações existenciais possam simplesmente ser validadas por valores independentes do sujeito; acima de tudo, tanto Kierkegaard como Frankfurt enfatizam a importância de uma validação reflexiva do próprio modo de vida. Tanto um como o outro compreendem esta validação não como um exercício da razão, mas sobretudo como um exercício da vontade, sem o qual, na verdade, o sujeito se expõe não só ao tédio e à angústia, mas também, em última análise, ao perigo da auto-dissolução. Neste sentido, o artigo defende a possibilidade de se impor a Kierkegaard a narrativa de Frankfurt sobre as atitudes psicológicas, de modo que, conclui o autor, Frankfurt decididamente nos pode ajudar a elucidar Kierkegaard. Ao mesmo tempo, porém, esta interpretação mostra igualmente os limites de toda e qualquer tentativa, inspirada por Kierkegaard, de justificar as normas morais sem apelar aos fundamentos religiosos da moralidade. European Computing and Philosophy conference, 2–4 July Barcelona The Seventh ECAP (European Computing and Philosophy) conference was organized by Jordi Vallverdu at Autonomous University of Barcelona. The conference started with the IACAP (The International Association for CAP) presidential address by Luciano Floridi, focusing on mechanisms of knowledge production in informational networks. The first keynote delivered by Klaus Mainzer made a frame for the rest of the conference, by elucidating the fundamental role of complexity of informational structures that can be analyzed (...) on different levels of organization giving place for variety of possible approaches which converge in this cross-disciplinary and multi-disciplinary research field. Keynotes by Kevin Warwick about re-embodiment of rats’ neurons into robots, Raymond Turner on syntax and semantics in programming languages, Roderic Guigo on Biocomputing Sciences and Francesco Subirada on the past and future of supercomputing presented different topics of philosophical as well as practical aspects of computing. Manifold expressions of a particular critique appear throughout Søren Kierkegaard’s pseudonymous corpus: for Kierkegaard and his pseudonyms faith is categorically not a first immediacy, and it is certainly not the first immediate, the annulment of which concludes the first movement of Hegelian philosophy. Kierkegaard’s pseudonyms make it clear that he holds the Hegelian dogmaticians responsible for the promulgation of this misconception, but when Kierkegaard’s journals and papers are consulted another transgressor emerges: the renowned anti-idealist F.D.E. Schleiermacher. I address the extent (...) to which this particular indictment is justified; over-against Gerhard Schreiber, I argue that this characterization of Schleiermacher’s view of religion is indeed a de facto critique. I begin by presenting and demonstrating the ubiquity of the phenomenon at the heart of Schleiermacher’s conception of perfect God-consciousness, then proceed to apply criticisms raised by Kierkegaardian pseudonyms Judge William, Vigilius Haufniensis, Johannes Climacus, and Anti-Climacus, supplemented with concerns raised by Kierkegaard himself, in order to demonstrate that these criticisms do indeed apply to and problematize Schleiermacher’s view. El presente artículo tiene como objetivo determinar el fundamento teológico del concepto de soberanía propuesto por el jurista alemán Carl Schmitt. Según nuestra hipótesis, tal fundamento teológico se encuentra en la filosofía del pensador danés Søren Kierkegaard, quien, en diferentes obras, desarrolló los importantes conceptos de excepción, decisión y suspensión teleológica de la ética en relación a la experiencia religiosa de la repetición. Como veremos, tales conceptos forman parte del fundamento teológico de la famosa definición schmittiana de la soberanía: “soberano (...) es quien decide sobre el estado de excepción”, la cual define el decisionismo del jurista alemán. Así, por medio del concepto de decisión, extraído de la obra kierkegaardiana e introducido en la doctrina de la soberanía, Schmitt logra tres objetivos. Por un lado, no solo inicia la crítica al parlamentarismo liberal y al Estado burgués de Derecho, sino que revela el fundamento teológico-existencial de la unidad política del Estado moderno. En segundo lugar, en el marco jurídico-político, actualiza la teología fideísta desarrollada por Kierkegaard en su obra. Finalmente, en el marco teológico-metafísico, introduce el papel de la decisión como actualizador del rol público de la trascendencia en la modernidad secularizada frente a la reserva escatológica de la teología. Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

This chapter discusses ren 仁, a major term in the Confucian Analects. It analyzes the range of meanings of ren across different conversations, paying special attention to its associations with other key Confucian terms such as li (禮 behavioural propriety) and zhi (知 understanding). Building on this analysis, the discussion focuses on ren in terms of how it is manifest in a person’s life. In particular, it expresses ren in terms of an exemplary life—a life lived well. What constitutes illocutionary silencing? This is the key question underlying much recent work on Catherine MacKinnon's claim that pornography silences women. In what follows I argue that the focus of the literature on the notion of audience `uptake' serves to mischaracterize the phenomena. I defend a broader interpretation of what it means for an illocutionary act to succeed, and show how this broader interpretation provides a better characterization of the kinds of silencing experienced by women.

This thesis considers two allegations which conservatives often level at no-fault systems — namely, that responsibility is abnegated under no-fault systems, and that no-fault systems under- and over-compensate. I argue that although each of these allegations can be satisfactorily met – the responsibility allegation rests on the mistaken assumption that to properly take responsibility for our actions we must accept liability for those losses for which we are causally responsible; and the compensation allegation rests on the mistaken assumption that tort (...) law’s compensatory decisions provide a legitimate norm against which no-fault’s decisions can be compared and criticized – doing so leads in a direction which is at odds with accident law reform advocates’ typical recommendations. On my account, accident law should not just be reformed in line with no-fault’s principles, but rather it should be completely abandoned since the principles that protect no- fault systems from the conservatives’ two allegations are incompatible with retaining the category of accident law, they entail that no-fault systems are a form of social welfare and not accident law systems, and that under these systems serious deprivation – and to a lesser extent causal responsibility – should be conditions of eligibility to claim benefits. This paper is the written version of my contribution to the International Conference «30 years Logica modernorum» held in Amsterdam in November 1997 in honor of the late prof. Lambertus M. de Rijk. Research on Oresme’s modi rerum theory was in the first stage, while now we can read the critical edition of Oresme’s Physics commentary, where modi are introduced and widely used. In this paper I shall consider Oresme’s polemical use of modi rerum, trying to set it in the (...) larger context of both his ontology and his epistemology. Oresme’s challenge to either a realist or terminist ontology by means of modi rerum conceals probably an attack to William of Ockham; Oresme refers explicitly to Ockham concerning exclusive propositions, but I think that on many other occasions the polemical target of Oresme’s criticism can be reasonably identified in William of Ockham or in some unnamed followers of the Venerabilis Inceptor. Some hints are reserved also to the possible sources of Oresme’s modi rerum. (shrink)

Self-esteem can influence educational success, and educational success can also be influenced by self-esteem. Hence, high self-esteem has been recognized as a key predictor of academic success in students. Thus, this study investigates the relationship between self-esteem and anxiety of senior high school students. Employing descriptive-correlational design with 194 senior high school students enrolled in private schools during the school year 2021-2022. Based on the statistical analysis, there is a correlation between self-esteem and anxiety (r.=.125).

Various authors debate the question of whether neuroscience is relevant to criminal responsibility. However, a plethora of different techniques and technologies, each with their own abilities and drawbacks, lurks beneath the label “neuroscience”; and in criminal law responsibility is not a single, unitary and generic concept, but it is rather a syndrome of at least six different concepts. Consequently, there are at least six different responsibility questions that the criminal law asks—at least one for each responsibility concept—and, I will suggest, (...) a multitude of ways in which the techniques and technologies that comprise neuroscience might help us to address those diverse questions. In a way, on my account neuroscience is relevant to criminal responsibility in many ways, but I hesitate to state my position like this because doing so obscures two points which I would rather highlight: one, neither neuroscience nor criminal responsibility are as unified as that; and two, the criminal law asks many different responsibility questions and not just one generic question. Resumo: A crise na União Europeia e os programas de austeridade subsequentes fizeram emergir uma miríade de movimentos sociais, diversos na sua natureza e nos seus propósitos. O que se pretende aferir neste artigo é a relação e a conexão existentes entre o Estado, o poder económico, a sociedade civil e os movimentos sociais neste contexto específico de crise. Procuraremos, nesta breve abordagem, explanar alguns elementos de originalidade intrínsecos aos movimentos sociais hodiernos, patentes na sua forma de participação e organização, (...) assim como aplicar estas questões teóricas relevantes ao contexto português. A parte empírica, dada a escassez de estudos de caso existentes, será apoiada no último inquérito do European Social Survey, de 2012. Analisando um conjunto de perguntas aí explícitas, podemos compreender, de forma indirecta, algumas das dinâmicas que caracterizam estes movimentos. Abstract: The crisis in the European Union and the subsequent austerity programs have unleashed a myriad of social movements, diverse in its nature and purpose. The purpose of this paper is to assess the relationship and connection between the State, economic power, civil society and social movements in this specific context of crisis. We will try, in this brief approach, to explain some elements of originality intrinsic to modern social movements, evident in their form of participation and organization, as well as to apply these theoretical questions relevant to the Portuguese context. The empirical part, given the paucity of existing case studies, will be supported in the last survey of the European Social Survey of 2012. By analyzing a set of questions explicit there, we can, indirectly, understand some of the dynamics that characterize these movements. (shrink)

In "Torts, Egalitarianism and Distributive Justice" , Tsachi Keren-Paz presents impressingly detailed analysis that bolsters the case in favour of incremental tort law reform. However, although this book's greatest strength is the depth of analysis offered, at the same time supporters of radical law reform proposals may interpret the complexity of the solution that is offered as conclusive proof that tort law can only take adequate account of egalitarian aims at an unacceptably high cost.

Abstract: Alienation and slavery from Precious or what we don't want to see. It is our purpose to establish, in a parallel reading, these two films (highly rewarded), namely The Fence and Precious, that apparently being so different, are an illustration of the reality of life and the modern democratic world: the social uprooting and slavery. If in the movie of Phillip Noyce and Christone Olsen The Fence, is told a story of three young Aboriginal girls who are forcibly taken (...) to be transformed into domestic slaves, in the movie of Lee Daniels Precious, the young woman is already a servant in her own home and seeks the transformation of her life. Uniting these two stories, we find fundamental elements: illiteracy, ill-treatment, the idea of a migration (real or metaphysical), among others, but whose fundamental notion is the journey. If the film The Fence, the fence itself is used to conduct the three young Aboriginal to a real reunion with the family, in Precious, the metaphorical ‘fence’ is the limit of her world. From this interpretation, we will undertake our reflection about what we consider to be the alienation of the modern world and the silence we produce about them. (shrink)
