Modelling Competing Legal Arguments Using Bayesian Model Comparison and Averaging.Martin Neil, Norman Fenton, David Lagnado & Richard David Gill - 2019 - Artificial Intelligence and Law 27 (4):403-430.
Bayesian models of legal arguments generally aim to produce a single integrated model, combining each of the legal arguments under consideration. This combined approach implicitly assumes that variables and their relationships can be represented without any contradiction or misalignment, and in a way that makes sense with respect to the competing argument narratives. This paper describes a novel approach to compare and ‘average’ Bayesian models of legal arguments that have been built independently and with no attempt to make them consistent (...)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...)

    The Extra Ingredient.Richard Brown, Joseph LeDoux & David Rosenthal - 2021 - Biology and Philosophy 36 (2):1-4.
Birch et. al. see their model as incompatible with higher-order-thought (HOT) theories of consciousness, on which a state is conscious if one is in some suitable way aware of that state. They see higher-order (HO) awareness as an “extra ingredient”. But since Birch et al go on to say that “[t]his is not the place for a detailed discussion of HOT theories,” they don’t address why they take HO awareness to be an extra ingredient or why HOT theorists are convinced (...)

We designed an experiment to explore the learning effectiveness of three different ways of practicing dance movements. To our surprise we found that partial modeling, called marking in the dance world, is a better method than practicing the complete phrase, called practicing full-out; and both marking and full-out are better methods than practicing by repeated mental simulation. We suggest that marking is a form of practicing a dance phrase aspect-by-aspect. Our results also suggest that prior work on learning by observation (...)

Richard Rorty on the American Left in the Era of Trump.David Rondel - 2018 - Contemporary Pragmatism 15 (2):194-210.
This paper revisits some of the arguments in Richard Rorty’s Achieving Our Country, twenty years after the book first appeared. Not only are many of Rorty’s diagnoses and predictions eerily prescient in the wake of the rise of Donald Trump to the US presidency, but there is also perceptive political advice in Rorty’s book that I argue the contemporary American Left would do well to heed. While many post-election commentators have tended to read Achieving Our Country as an admonishment (...)

This article engages Richard Rorty’s controversial concept of ethnocentrism with the help of Randolf (Randy) S. David’s writings. The first section defines Rorty’s concept of ethnocentrism and responds to the general criticisms of relativism and divisiveness that have been made against it. The second section suggests a conceptual replacement for Rorty’s notion of a vicious ethnocentrism: egotism. Egotism is a kind of cultural ethnocentrism that is resistant to openness, creativity, and social transformation. Inspired by David’s work, the (...)

Richard Baxter and the Mechanical Philosophers.David S. Sytsma - 2017 - New York, NY, USA: Oxford University Press.
Richard Baxter, one of the most famous Puritans of the seventeenth century, is generally known as a writer of practical and devotional literature. But he also excelled in knowledge of medieval and early modern scholastic theology, and was conversant with a wide variety of seventeenth-century philosophies. Baxter was among the early English polemicists to write against the mechanical philosophy of René Descartes and Pierre Gassendi in the years immediately following the establishment of the Royal Society. At the same time, (...)

According to the PubMed resource from the U.S. National Library of Medicine, over 750,000 scientific articles have been published in the ~5000 biomedical journals worldwide in the year 2007 alone. The vast majority of these publications include results from hypothesis-driven experimentation in overlapping biomedical research domains. Unfortunately, the sheer volume of information being generated by the biomedical research enterprise has made it virtually impossible for investigators to stay aware of the latest findings in their domain of interest, let alone to (...)

We present a new understanding of Christ’s real presence in the Eucharist on the model of Stump’s account of God’s omnipresence and Green and Quan’s account of experiencing God in Scripture. On this understanding, Christ is derivatively, rather than fundamentally, located in the consecrated bread and wine, such that Christ is present to the believer through the consecrated bread and wine, thereby making available to the believer a second-person experience of Christ, where the consecrated bread and wine are the way (...)

According to Richard Gelwick, one of the fundamental implications of Polanyi’s epistemology is that all intellectual disciplines are inherently heuristic. This article draws out the implications of a heuristic vision of theology latent in Polanyi’s thought by placing contemporary theologian David Brown’s dynamic understanding of tradition, imagination, and revelation in the context of a Polanyian-inspired vision of reality. Consequently, such a theology will follow the example of science, reimagining its task as one of discovery rather than mere reflection (...)

We explore the ethics of deliberately exposing consenting adults to SARS-CoV-2 to induce immunity to the virus (“DEI” for short). We explain what a responsible DEI program might look like. We explore a consequentialist argument for DEI according to which DEI is a viable harm-reduction strategy. Then we consider a non-consequentialist argument for DEI that draws on the moral significance of consent. Additionally, we consider arguments for the view that DEI is unethical on the grounds that, given that large-scale DEI (...)

Specifically, we examine the features of community and stress its importance both for belonging and bonding around shared norms and practices and for fostering the necessary bridging essential for interacting and cooperating with others. In considering what it means to foster a community (...)

David Rosenthal is a well-known defender of a particular kind of theory of consciousness known as the higher-order thought theory (HOTT). Higher-order theories are united by what Rosenthal calls the Transitivity Principle (TP), which states that a mental state is conscious iff one is conscious of oneself, in some suitable way, as being in that mental state. Since there are various ways to implement TP and HOTT commits one to the view that any mental state could occur unconsciously it (...)

This highly technical book is densely packed with arguments and is an important addition to the literature. Even if one ultimately disagrees with Chalmers there is much to be gained in his exhaustive study, and he goes out of his way to show how one can accept limited or modified versions of scrutability. It is impossible for me to do justice to his argumentative rigor and comprehensive coverage of possible views in the space I have here. In the end I (...)

ABSTRACT In ‘Scorekeeping in a Pornographic Language Game’, Rae Langton and Caroline West borrow ideas from David Lewis to attempt to explain how pornography might subordinate and silence women. Pornography is supposed to express certain misogynistic claims implicitly, through presupposition, and to convey them indirectly, through accommodation. I argue that the appeal to accommodation cannot do the sort of work Langton and West want it to do: Their case rests upon an overly simplified model of that phenomenon. I argue (...)

When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

On Hume’s account of motivation, beliefs and desires are very different kinds of propositional attitudes. Beliefs are cognitive attitudes, desires emotive ones. An agent’s belief in a proposition captures the weight he or she assigns to this proposition in his or her cognitive representation of the world. An agent’s desire for a proposition captures the degree to which he or she prefers its truth, motivating him or her to act accordingly. Although beliefs and desires are sometimes entangled, they play very (...)

In this paper I examine the dispute between Hakwan Lau, Ned Block, and David Rosenthal over the extent to which empirical results can help us decide between first-order and higher-order theories of consciousness. What emerges from this is an overall argument to the best explanation against the first-order view of consciousness and the dispelling of the mythological notion of phenomenological overflow that comes with it.

Some of the most important developments of symbolic logic took place in the 1920s. Foremost among them are the distinction between syntax and semantics and the formulation of questions of completeness and decidability of logical systems. David Hilbert and his students played a very important part in these developments. Their contributions can be traced to unpublished lecture notes and other manuscripts by Hilbert and Bernays dating to the period 1917-1923. The aim of this paper is to describe these results, (...)

Pain, crucially, is unpleasant and motivational. It can be awful; and it drives us to action, e.g. to take our weight off a sprained ankle. But what is the relationship between pain and those two features? And in virtue of what does pain have them? Addressing these questions, Colin Klein and Richard J. Hall have recently developed the idea that pains are, at least partly, experiential commands—to stop placing your weight on your ankle, for example. In this paper, I (...)

Las Vegas, NV USA: Reality Press. pp. 258-267.

This paper argues that higher-order doubt generates an epistemic dilemma. One has a higher-order doubt with regards to P insofar as one justifiably withholds belief as to what attitude towards P is justified. That is, one justifiably withholds belief as to whether one is justified in believing, disbelieving, or withholding belief in P. Using the resources provided by Richard Feldman’s recent discussion of how to respect one’s evidence, I argue that if one has a higher-order doubt with regards to (...)

Among our conscious states are conscious thoughts. The question at the center of the recent growing literature on cognitive phenomenology is this: In consciously thinking P, is there thereby any phenomenology—is there something it’s like? One way of clarifying the question is to say that it concerns whether there is any proprietary phenomenology associated with conscious thought. Is there any phenomenology due to thinking, as opposed to phenomenology that is due to some co-occurring sensation or mental image? In this paper (...)

David Hilbert's finitistic standpoint is a conception of elementary number theory designed to answer the intuitionist doubts regarding the security and certainty of mathematics. Hilbert was unfortunately not exact in delineating what that viewpoint was, and Hilbert himself changed his usage of the term through the 1920s and 30s. The purpose of this paper is to outline what the main problems are in understanding Hilbert and Bernays on this issue, based on some publications by them which have so far (...)

In the 1920s, David Hilbert proposed a research program with the aim of providing mathematics with a secure foundation. This was to be accomplished by first formalizing logic and mathematics in their entirety, and then showing---using only so-called finitistic principles---that these formalizations are free of contradictions. ;In the area of logic, the Hilbert school accomplished major advances both in introducing new systems of logic, and in developing central metalogical notions, such as completeness and decidability.

  48. Rosenthal's Representationalism.Jacob Berger & Richard Brown - forthcoming - In Josh Weisberg (ed.), Qualitative Consciousness: Themes from the Philosophy of David Rosenthal. Cambridge.
David Rosenthal explains conscious mentality in terms of two independent, though complementary, theories—the higher-order thought (“HOT”) theory of consciousness and quality-space theory (“QST”) about mental qualities. It is natural to understand this combination of views as constituting a kind of representationalism about experience—that is, a version of the view that an experience’s conscious character is identical with certain of its representational properties. At times, however, Rosenthal seems to resist this characterization of his view. We explore here whether and to (...)

    The Frontloading Argument.Richard Heck - 2018 - Philosophical Studies 175 (10):2583-2608.
Maybe the most important argument in David Chalmers’s monumental book Constructing the World is the one he calls the ‘Frontloading Argument’, which is used in Chapter 4 to argue for the book’s central thesis, A Priori Scrutability. And, at first blush, the Frontloading Argument looks very strong. I argue here, however, that it is incapable of securing the conclusion it is meant to establish.

  50. “The Paradoxical Principle and Salutary Practice”: Hume on Toleration.Richard H. Dees - 2005 - Hume Studies 31 (1):145-164.
David Hume is an ardent supporter of the practice of religions toleration. For Hume, toleration forms part of the background that makes progress in philosophy possible, and it accounts for the superiority of philosophical thought in England in the eighteenth century. As he puts it in the introduction to the Treatise: “the improvements in reason and philosophy can only be owing to a land of toleration and of liberty”. Similarly, the narrator of part 11 of the First Enquiry comments.
