This chapter surveys essentialist and anti-essentialist theories of sex and gender. It does so by engaging three approaches to sex and gender: externalism, internalism, and contextualism. The chapter also draws attention to two key debates about sex and gender in the feminist literature: the debate about the sex/gender distinction (the distinction debate) and the debate about whether sex and gender have essences (the essentialism/anti-essentialism debate). In addition, it describes three problems that theories of sex and gender tend to face: the (...) Inclusion Problem, the Definition Problem, and the Exclusion Problem. Examining previous discussions on how to construe the concepts of gender and race, we advocate what we call strategic conceptual engineering. This is the employment of a (possibly novel) concept for specific epistemic or social aims, concomitant with the openness to use a different concept (e.g., of race) for other purposes. We illustrate this approach by sketching three distinct concepts of gender and arguing that all of them are needed, as they answer to different social aims. The first concept serves (...) the aim of identifying and explaining gender-based discrimination. It is similar to Haslanger’s well-known account, except that rather than offering a definition of ‘woman’ we focus on ‘gender’ as one among several axes of discrimination. The second concept of gender is to assign legal rights and social recognitions, and thus is to be trans-inclusive. We argue that this cannot be achieved by previously suggested concepts that include substantial gender-related psychological features, such as awareness of social expectations. Instead, our concept counts someone as being of a certain gender solely based on the person’s self-identification with this gender. The third concept of gender serves the aim of personal empowerment by means of one’s gender identity. In this context, substantial psychological features and awareness of one’s social situation are involved. While previous accounts of concepts have focused on their role in determining extensions, we point to contexts where a concept’s role in explanation and moral reasoning can be more important. There are elements in Heraclitus that are enticing to modern readers in that they point toward a certain intimacy of consciousness. Having read the fragments of this philosopher, we propose a reading that harmonizes his assertions about universality with his assertions about self-knowledge, in which we believe we can glimpse the discovery of self-awareness. In Heraclitus’ view, humans possess a soul with an unlimited horizon and a capacity to access the logos. A person must pursue introspection, listen to the logos, (...) and find the unity of all things and himself. This will enable us to gain a deeper understanding of the interiority of self-awareness without sacrificing its connection to the universal. Furthermore, individuals must speak the logos to themselves to act according to it. By acting otherwise, one would be acting against his own inner self. (shrink)

Much attention has been drawn to the cognitive basis of innovation. While interesting in many ways, this poses the threat of falling back to traditional internalist assumptions with regard to cognition. We oppose the ensuing contrast between internal cognitive processing and external public practices and technologies that such internal cognitive systems might produce and utilize. We argue that innovation is best understood from the gibsonian notion of affordance, and that many innovative practices emerge from the external scaffolding of cognitive processes. (...) The public engageability that allows the disclosure of hidden affordances is not only –not even primarily– a property of cognitive products, but of cognitive processes. We elaborate on this claims by drawing on Dutilh Novaes’ account of formal languages as cognitive technologies and Hutto’s Narrative Practice Hypothesis. This paves the way to sketch some general principles on how to strategically seek for innovation by targeting hidden affordances. (shrink)

The fact that Internet companies may record our personal data and track our online behavior for commercial or political purpose has emphasized aspects related to online privacy. This has also led to the development of search engines that promise no tracking and privacy. Search engines also have a major role in spreading low-quality health information such as that of anti-vaccine websites. This study investigates the relationship between search engines’ approach to privacy and the scientific quality of the information they return. (...) We analyzed the first 30 webpages returned searching “vaccines autism” in English, Spanish, Italian, and French. The results show that not only “alternative” search engines but also other commercial engines often return more anti-vaccine pages (10–53%) than Google (0%). Some localized versions of Google, however, returned more anti-vaccine webpages (up to 10%) than Google. Health information returned by search engines has an impact on public health and, specifically, in the acceptance of vaccines. The issue of information quality when seeking information for making health-related decisions also impact the ethical aspect represented by the right to an informed consent. Our study suggests that designing a search engine that is privacy savvy and avoids issues with filter bubbles that can result from user-tracking is necessary but insufficient; instead, mechanisms should be developed to test search engines from the perspective of information quality (particularly for health-related webpages) before they can be deemed trustworthy providers of public health information. This study investigates the relationship between self-efficacy and resilience among 150 first-year college students. This study used a correlational research design. Thus, General Self-Efficacy Scale and Resilience Scale were utilized to measure the variables. Furthermore, the statistical analysis reveals that the r coefficient of 0.48 indicates a low positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between self-efficacy and resilience among (...) first-year college students. Implications were discussed in the study. (shrink)

Many current problems surrounding science revolve around the complex epistemological framework that shapes a new vision of knowledge about reality. The traditional epistemological positions are characterized by the explanation of nature by means of concatenated facts; that is, as bricks attached to each other giving shape to the edifice of science. A conception of this nature showed that the idea of certainty was nothing more than a mere illusion, opening the way, on the contrary, to the idea of the uncertainty (...) of knowledge based on the descriptions of quantum physics, also a product of the non-reductionist conception of reality, thus criticizing the specular representation. This article addresses the main problems surrounding the critical conceptions that the emerging epistemology reveals about knowledge, pointing towards a much more complex vision of reality. (shrink)

This paper aims to explore and offer different hypotheses that could account for an adequate understanding of the duty to die and its relation to biopolitics from two neglected approaches. First, death will be analysed from a biopolitical perspective to understand the crucial role it has in biopower. Second, the focus lies on the two-folded implication that death has in biopower, for it could be either a defiance of it or the final sublimation of its control. Similarly, the next section (...) addresses the relations between death and neoliberalism from a biopolitical perspective, exploring the possibility of understanding the duty to die as resistance to economic mandates or, on the contrary, as the fulfilment of neoliberal interests. Finally, as a continuation of the relations between the duty to die and neo-liberalism, the paper analyses a similar two-folded view of the former from a psychopolitical perspective. (shrink)

How does microbiota research impact our understanding of biological individuality? We summarize the interdisciplinary summer school on "Microbiota, Symbiosis and Individuality: Conceptual and Philosophical Issues" (July 2019), which was supported by a European Research Council starting grant project "Immunity, DEvelopment, and the Microbiota" (IDEM). The summer school centered around interdisciplinary group work on four facets of microbiota research: holobionts, individuality, causation, and human health. The conceptual discussion of cutting-edge empirical research provided new insights into microbiota and highlights the value of (...) incorporating into meetings experts from other disciplines, such as philosophy and history of science. El alcance de la epojé y la posterior reducción ha sido siempre uno de los mayores terrenos de disputa de la fenomenologı́a. Este ensayo tiene la pretensión de reflexionar en torno a este elemento metodológico esencial a la luz del problema del acceso al mundo. ¿Se ha perdido algo, una vez llevada a cabo la reducción? La respuesta será negativa. Para ello, en la primera sección se presentará cómo más bien hay una reapropiación originaria del mundo a través de la (...) reducción. En la segunda sección se revisará la noción de Jan Patočka de mundo como totalidad pre-dada. En efecto, ambas permiten acercarse a la conclusión de que la reducción encamina hacia un renovado acceso al mundo sin dejar nada de este fuera, permitiendo ası́ que el mundo aparezca qua fenómeno. Esto significa, finalmente, que la reducción permite reconocer de modo originario la relación de nosotros con el mundo, sin entenderla como una mera relación entre dos cosas. (shrink)

This paper straightforwardly addresses one of the strongest, from an ethical perspective, objections presented to the duty to die, the one concerned with the lack of a normative theory to support it, offered by Seay in his paper Can there be a “duty to die” without a normative theory? The aim of the paper is to provide strong metaethical grounds to support the duty to die without the need of a moral normative theory. First, the definition and main argument for (...) the duty to die will be presented. Second, Seay’s objection will be described and clearly explained. Third, our metaphysical assumptions and a preliminary metaethical discussion will be offered to situate and understand the context. Finally, we will show how the duty to die can be integrated within the metaethical approach previously presented, defending that there is no need of a normative theory to provide good justification and strong ethical grounds for the duty to die, because they will have already been provided by our metaethical argument. In ‘Excusing Mistakes of Law’, Gideon Yaffe sets out to ‘vindicate’ the claim ‘that mistakes of law never excuse’ by ‘identifying the truth that is groped for but not grasped by those who assert that ignorance of law is no excuse’. Yaffe does not offer a defence of the claim that mistakes of law never excuse. That claim, Yaffe argues, is false. Yaffe’s article is, rather, an effort to assess what plausible thought might be behind the idea that mistakes of (...) law often should not excuse. (Yaffe is interested in more than just the descriptive claim that in Anglo-American legal jurisdictions mistakes of law routinely do not, in fact, excuse.) More particularly, Yaffe is interested in what plausible normative justification there might be for this asymmetric pattern: -/- Asymmetry: False beliefs about non-legal facts often excuse, but false beliefs about the law rarely excuse. -/- Yaffe offers a complex argument in support of Asymmetry. This paper is organised around my reconstruction of Yaffe’s argument. I argue that Yaffe’s argument does not succeed, but that his argument provides a template for an argument that could succeed. Euthanasia and the duty to die have both been thoroughly discussed in the field of bioethics as morally justifiable practices within medical healthcare contexts. The existence of a narrow connection between both could also be established, for people having a duty to die should be allowed to actively hasten their death by the active means offered by euthanasia. Choosing the right time to end one’s own life is a decisive factor to retain autonomy at the end of our lives. However, (...) there is no definitive consensus on why physicians should be the ones performing the medical procedure to end a person’s life. The moral problems arising from such assertion are not to be taken lightly, for medical tradition has long regarded the duty not to kill, not to actively end a patient’s life, as the core moral obligation that gives meaning to the medical profession. Our concern is to question the moral justifiability of the arguments offered by physicians not to actively help patients die. (shrink)

El presente artículo analiza el fenómeno del mestizaje cultural que se da alrededor de la creación de la Virgen de Guadalupe. Se propone que la resignificación que se dio en torno al cerro del Tepeyac, donde originalmente se adoraba a Tonantzin, constituye un evento de creación de sentidos que se da en el contexto del mestizaje, y que incorpora la construcción discursiva de la hierofanía en torno a tres elementos: el objeto sagrado, el lugar del culto y el ritual de (...) adoración. Este evento tuvo una gran importancia, pues el guadalupanismo generó consigo una serie de sentimientos de pertenencia entre los criollos e indígenas, quienes encontraron en él una forma de entenderse como distintos al imperio español, lo que para muchos autores significó una de las primeras semillas de los ideales independentistas y la superación de la época colonial. "Thinking a university for the 21st century" is the name of the research group at San Dámaso University (Madrid) that promotes this book. Over the last few years this group has held regular meetings to discuss the raison d'être of the university: what is a university?, what is its purpose?, what episodes of academic life have been most inspiring in the past?, which difficulties does university life face today?, what will be the future of the university?, what do we want (...) it to become? These are some of the questions that have been asked over the years and which now take the form of writing. Several of the contributions contained in this book have a certain historical orientation: the authors examine the highlights of the search for and communication of knowledge, from antiquity to the present day. Great figures such as Socrates, Thomas Aquinas, Vitoria, Newman, Ratzinger and Ortega are featured in these pages. However, this is not a history of university life in the past, but a reflection on the future. The examples of the past set us on the road to the university of the future. Such is the intention of this group of researchers, linked to different Spanish universities and also experienced in other institutions outside our country: they have gathered here to discuss the university we want to build in our present, with an eye to the future. Learning to adapt to the new set of conditions that confound behavioral standards was made possible by the pandemic-driven change in the school system. Due to these conditions and the COVID-19 pandemic, students may experience behaviors like social media addiction and social anxiety that may affect their well-being or happiness. Thus, this study aims to investigate the effects of social media addiction and social anxiety on the happiness of tertiary students amidst the COVID-19 pandemic. The study was conducted on 316 (...) first-year college students utilizing Google forms to disseminate questionnaires. After utilizing Bergen Social Media Addiction Scale, Social Anxiety Scale, and Oxford Happiness Questionnaire, it was found that social media addiction (β = -0.30, p<.00) and social anxiety (β = -0.003, p<.00) has a significant negative effect on happiness. Therefore, the study recommended and designed a student wellness program that provides a range of recreational, healthimproving, self-esteem-boosting, and relationship-strengthening activities for students in order to mitigate the negative effects of problematic social media usage and social anxiety that negatively effect their happiness. This study thoroughly investigates the financial behaviors of financially independent, young, single professionals aged 24 to 35 in Balayan, Batangas, amidst a period of global inflation. Focusing on five industries—education, finance, government, healthcare, and retail—the research employs a mixed-methods approach. Quantitative analysis, involving 75 respondents through a 4-point Likert scale survey, is complemented by qualitative insights from in-depth interviews with 5 participants from each industry. The findings from numerical values revealed that demographics did not impact working professionals' saving habits and (...) buying behaviors during the global inflation surge. This suggests that despite differences in age, gender, industry, employment status, and monthly income or salary, all professionals prioritized robust, strong savings and reduced spending to ensure financial stability. The research underscores the significance for professionals in various industries to prioritize specific aspects of personal financial management during the prevailing global inflation surge. This study investigates the relationship between personality traits and coping styles among college students in private higher educational institution. Hence, employing correlational design to assess the relationship between coping styles and personality of 150 college students. En Argentina existió una poderosa influencia de origen francés que modificó profundamente las tácticas militares y la ideología del Ejército entre 1957 y 1963. Estas teorías extranjeras importadas al Cono Sur, tuvieron como origen los aprendizajes obtenidos por el Ejército francés en las guerras de Argelia e Indochina. A partir de tales experiencias, los oficiales franceses desarrollaron técnicas de combate contra la entonces novedosa ‘guerra de guerrillas’ de los grupos rebeldes, que fueron enseñadas posteriormente a los militares argentinos. Esta enseñanza (...) incluía importantes elementos de carácter doctrinario, como la idea de la guerra global contra el comunismo, la noción de enemigo interno, y la convicción de que sus acciones, incluido el uso de tortura como técnica de obtención de información, estaban justificadas por la búsqueda del bien mayor de la nación. Esta ideología influyó profundamente en el Ejército argentino y es posible notar su rastro en el radical proceder que tuvieron los cuerpos militares durante el Proceso de Reorganización Nacional. Voces de Carnaval: ritualidad festiva, resignificación cultural y mercantilismo, surge del interés de compartir experiencias de la ritualidad festiva en varias latitudes, especialmente latinoamericanas, para generar nuevos sentidos de encuentro cultural. Los trabajos reunidos en este libro tienen un propósito en común. Aspiran a clarificar las principales tesis de Mainländer y su relación con otros pensadores, por ejemplo, Freud, Schopenhauer, Albert Caraco, Manlio Sgalambro, Emil Cioran, Jorge Luis Borges, entre los más destacados. Enmarcado en sus aportes valiosos, este volumen es un hito cuya vasta sapiencia y rigurosidad resulta más que favorable para la recuperación y difusión de este pensador.

In his recent article in Philosophy and Public Affairs, 'The Paradox of Voting and Ethics of Political Representation', Alexander A. Guerrero argues it is rational to vote because each voter should want candidates they support to have the strongest public mandate possible if elected to office, and because every vote contributes to that mandate. The present paper argues that two of Guerrero's premises require correction, and that when those premises are corrected several provocative but compelling conclusions follow about the rationality (...) of voting and duties of elected officials: (A) Voting is typically rational for the members of a political party’s base; (B) Voting is often (but not always) irrational for “swing” voters (i.e. independent voters who are not affiliated with any political party, as well as “undecided” voters who are considering voting across party lines); and (C) Elected officials have a moral duty to respond to changing levels of popular support once in office, as indicated by properly monitored and corroborated public opinion polls of constituents, functioning more as delegates the lower their level of popular support. Finally, I suggest that the last of these conclusions has wide-ranging implications for political ethics. I illustrate these implications by focusing on the questions -- under debate in the 2016 US Presidential election cycle -- of whether a sitting President has a moral duty to nominate or not nominate a new Supreme Court justice during his or her final year in office, and similarly, whether US Senators have a moral duty to obstruct, or not obstruct, confirmation of the President’s eventual nominee. Este trabajo critica la categoría blanquitud, en la corriente iniciada por Bolívar Echeverría. El método que se utiliza es el transdisciplinario, como pretensión de disolución de las parcelas de conocimiento. Se toma tres campos filosóficos: la Teología de la liberación; la Filosofía de la liberación y la Filosofía indígena. En el análisis lingüístico se utiliza como herramienta, la poesía y novela de Rosario Castellanos, Elena Poniatowska, Gioconda Belli y Ernesto Cardenal. El lugar de enunciación es el pueblo kichwa Saraguro. (...) Se postula que el Sumak Kawsay es un más allá de los derechos de la naturaleza; como uno de los antónimos de la blanquitud. Empero, la blanquitud no es solamente el color del capitalismo; es decir, si las personas son las que construyen las instituciones, entonces, son estos sujetos quienes cargan con lo blanco. La blanquitud es también un fenotipo del racismo: complejo de superioridad e inferioridad. Racismo que se traduce en posesión o acaparamiento económico, académico, político, etc. La reversión filosófica o descolonización de lo blanco se postula desde una educación sin dominación, a través de la concreción, cuidado y reproducción de la vida Sumak Kawsay. Resumo: Sabe-se que a pecuária é uma parcela do agronegócio que move a economia do país, e incluso está a produção leiteira, que tem, a cada ano seu desenvolvimento elevado, de forma em que é priorizado a eficiência no aumento de sua produção, com o objetivo de suprir a demanda, e a maior rentabilidade do produtor. Diante disso, medidas de manejo reprodutivo e alimentar são adotadas, sendo estas capazes de elevar a produtividade com o menor custo possível. O trabalho objetivou (...) pautar acerca do conhecimento sobre o manejo nutricional correto e escore corporal, que afetam diretamente a produtividade do animal, o conhecimento acerca do ciclo reprodutivo de vacas, expondo a detecção de estro, bem como metodologias eficazes aplicadas na reprodução, e práticas de bem estar, que, quando ausente, é apontado como um dos precursores da ineficiência reprodutiva. Abstract: It is known that livestock is a part of agribusiness that drives the country's economy, and is even milk production, which has, every year, its high development, so that it is prioritizing efficiency in increasing its production, with the objective of supplying the demand, and the greater producer profitability. Therefore, reproductive and food management measures are adopted, being able to increase productivity with the lowest possible cost. The work aimed guide about knowledge about correct nutritional management and body score, which affect directly the animal's productivity, knowledge about the reproductive cycle of cows, exposing estrus detection, as well as effective methodologies applied in reproduction, and practices of well-being, which, when absent, is pointed out as one of the precursors of inefficiency reproductive. Devrions-nous remplacer les élections par des loteries ? Le célèbre livre de Bernard Manin sur le gouvernement représentatif a appris à beaucoup que les Grecs considéraient les élections comme un moyen aristocratique, et non démocratique, de sélectionner des personnes pour le pouvoir et l'autorité politique, en comparaison avec le tirage au sort, où chacun a une chance égale d'être sélectionné. (Manin 1997) Jusqu'à récemment, cependant, l'idée qu'un engagement envers la démocratie nécessite de remplacer les élections par le tirage au sort (...) a suscité peu d'intérêt parmi les philosophes politiques. This paper looks at Alexander Guerrero’s epistemic case for ‘lottocracy’, or government by randomly selected citizen assemblies. It argues that Guerrero fails to show that citizen expertise is more likely to be elicited and brought to bear on democratic politics if we replace elections with random selection. However, randomly selected citizen assemblies can be valuable deliberative and participative additions to elected and appointed institutions even when citizens are not bearers of special knowledge or virtue individually or collectively.

This paper responds to critical commentaries on my book, Perceiving Reality (OUP, 2012), by Laura Guerrero, Matthew MacKenzie, and Anand Vaidya. Guerrero focuses on the metaphysics of causation, and its role in the broader question of whether the ‘two truths’ framework of Buddhist philosophy can be reconciled with the claim that science provides the best account of our experienced world. MacKenzie pursues two related questions: (i) Is reflexive awareness (svasaṃvedana) identical with the subjective pole of a dual-aspect cognition or are (...) there alternative, perhaps better, ways of understanding this self-intimating character of mental states? (ii) Is perception constitutively intentional or is it representational? Vaidya argues that, in so far as Husserlian phenomenology and Buddhism differ in terms of their fundamental ontological commit- ments, they must be incompatible, thus rendering any cross-cultural philosophical project that seeks their rapprochement tenuous. One of my aims in Perceiving Reality is to show how accounts of perception informed by metaphysical realism can be problematic on both metaphysical and epistemological grounds, especially when relying on conceptions of consciousness that ignore its properly phenomenological features. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Our paper examines Gloria Anzaldúa’s critical appropriation of Mexican philosophical sources, especially in the writing of Borderlands/La Frontera. We demonstrate how Anzaldúa developed a transnational Philosophy of Mexicanness, effectively contributing to what has been recently characterized as the “multi-generational project to pursue philosophy from and about Mexican circumstances” (Vargas). More specifically, we recover “La Mexicana en la Chicana” by paying careful attention to Anzaldúa’s Mexican sources, both those she explicitly cites and those we have discovered while conducting archival research using (...) the Gloria Evangelina Anzaldúa Papers from the Benson Latin American Collection at the University of Texas at Austin. The three sections of our paper: 1) define the terms Mexican and philosophy in conversation with Anzaldúa’s work, 2) examine the Mexican philosophical sources that Anzaldúa cites in Borderlands/La Frontera, and 3) present the other major Mexican philosophical influences on Anzaldúa that we have found in her archive. The eight Mexican philosophical sources we discuss here include: José Vasconcelos (1882-1959), Miguel León-Portilla (1926-2019), Juana Armanda Alegría (1938- ), Octavio Paz (1914-1998), Samuel Ramos (1897-1959), Rosario Castellanos (1925-1974), Sor Juana Inés de La Cruz (1648-1695), and Jorge Carrión (1913-2005). José Hugo Burel Guerra nació el 23 de marzo de 1951 en Montevideo (Uruguay). Desde 2017 es miembro de número de la Academia Nacional de Letras del Uruguay (ANL), institución a la cual ingresó con su discurso titulado «Ismael». Es licenciado en Letras por el Instituto de Filosofía, Ciencias y Letras (que se conoce en la actualidad como UCUDAL) y la Pontificia Universidad Católica de Río Grande do Sul. Aparte de ser escritor, se ha desempeñado como músico, publicista, diseñador gráfico, (...) profesor y periodista. Dentro del ámbito literario, ha publicado cuentos, novelas y ensayos. Debido a la importancia de establecer mecanismos para proteger la biodiversidad y posibilitar la preservación de los conocimientos asociados especialmente al uso de la flora medicinal, la Línea de Investigación en Política y Legislación, del Grupo de Estudios en Sistemas Tradicionales de Salud de la Facultad de Medicina, y la Línea de Derecho Ambiental (...) y Grupos Étnicos, del Grupo de Derechos Humanos de Jurisprudencia de la Universidad del Rosario, desarrollaron este libro a través del cual la Universidad se propone profundizar en el panorama actual de la reglamentación y política –Internacional, nacional y local—respecto a la flora medicinal y al patrimonio cultural inmaterial asociado a ésta. Este proyecto responde a un momento histórico de gran importancia, que por supuesto no pudo ser más oportuno. Colombia celebra en el año 2006 los quince años de la promulgación de su Constitución Política, y los cambios de trascendentales surgidos a partir de su aplicación has sido prolíficos, Particularmente, el tema ambiental ha sobresalido dentro de las grandes transformaciones del país, y por ello no en vano hoy se afirma que tenemos una verdades Constitución ecológica. De igual forma, la Facultad (...) de Jurisprudencia de la Universidad del Rosario conmemora los die años de la creación de la especialización en Derecho Ambiental, y tal coincidencia histórica fue una motivación adicional para proponer la realización de un análisis de la evolución normativa surtida para proponer la realización de un análisis de la evolución normativa surtida en este decenio, una evaluación de la gestión ambiental colombiana y de sus distintos impactos en una sociedad que cuenta hoy en día con herramientas constitucionales legales para la defensa de sus derechos e interese colectivos. La Universidad del Rosario ha sido parte de esta evolución, desarrollando un rol activo con el cual se han abierto espacios de discusión y de proposición de alternativas, herramientas y experiencias en pro de la protección integral de la diversidad étnica, cultural y natural de la Nación colombiana. Así, se ha constituido como facilitadora del proceso de la formación de los nuevos actores y ha tenido gran posicionamiento en procesos de participación y de estructuración de proyectos institucionales ambientales. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del (...) ordenamiento jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. España no ha sido nunca una sola cosa. Pero este dato, que se reconoce fácilmente repasando los eventos más destacados de su historia, prontamente se olvida cada vez que los pueblos americanos de habla hispana queremos pensar y relatar nuestra historia. No resulta cómodo hablar de hispanidad en nuestros tiempos. Lamentablemente la expresión le recuerda todavía a muchos la defensa a ultranza de cierto recalcitrante nacionalismo español, cuyo mayor defecto fue haber fomentado, paradójicamente, el desprecio por las múltiples formas de (...) la hispanidad. Sin embargo, es necesario mirar de nuevo, con un lenguaje fresco y desprendido de prejuicios, las ricas y variadas tradiciones musulmanas, judías, conversas y cristianas que le dieron forma a la civilización hispánica. Quizás así descubramos hasta qué punto los hispanoamericanos, y en particular los colombianos, somos otra de esas “hispanidades”. Presentación del fragmento 5 del plato 1032 (b-366315) como siendo la confirmación de la existencia de testimonio documental para la variante conjetural propuesta por mí en la tesis (en el capítulo 4) referente a (...) la tradición observada en salmo 91:12. . .
