STANISŁAW BRZOZOWSKI – TO THINK RADICALLY Stanisław Brzozowski is one of the most radical philosophers. Radicalism of his thought involves not only the idea of fundamental social change, but also the reinterpretation of some philosophical concepts. Two main concepts are nature and history. They are reinterpreted in order to show their human origins. According to Brzozowski nature and history are human constructions, namely they are set by human praxis. Brzozowski’s understanding changed over the time. In my article I focus on (...) two phases of Brzozowski’s thought. The first is Kantian and Fichtean. The ethical Principle of Proportionality requires combatants not to cause collateral harm excessive in comparison to the anticipated military advantage of an attack. This principle is considered a major (and perhaps insurmountable) obstacle to ethical use of autonomous weapon systems (AWS). This article reviews three possible solutions to the problem of achieving Proportionality compliance in AWS. In doing so, I describe and discuss the three components Proportionality judgments, namely collateral damage estimation, assessment of anticipated military advantage, and judgment of “excessiveness”. Some possible approaches to Proportionality compliance are then presented, such as restricting AWS operations to environments lacking civilian presence, using AWS in targeted strikes in which proportionality judgments are pre-made by human commanders, and a ‘price tag’ approach of pre-assigning acceptable collateral damage values to military hardware in conventional attritional warfare. The article argues that application of these three compliance methods would result in AWS’ achieving acceptable Proportionality compliance levels in many combat environments and scenarios, allowing AWS to perform most key tasks in conventional warfare. According to the evaluativist theory of bodily pain, the overall phenomenology of a painful experience is explained by attributing to it two types of representational content—an indicative content that represents bodily damage or disturbance, and an evaluative content that represents that condition as bad for the subject. This paper considers whether evaluativism can offer a suitable explanation of aversive auditory phenomenology—the experience of awful noises—and argues that it can only do so by conceding that auditory evaluative content would be guilty (...) of widespread error. The thrust of this paper is to access the efficacy of establishing African Global Media channel to strike a balance in communication between Africa and the rest of the world. This paper is a reaction to the imbalance in communication flow as engineered by the global media. Global media has contributed greatly to cultural domination in Africa by Europe and the Western World. These channels of communication such as, Cable News Network (CNN), British Broadcasting Corporation (BBC), Deutse Welle Television (DWTV) (...) including a host of other transnational print media, transmit programmes with cultural values from Europe and America to Africa. Consequently local African media and their attempts to preserve African Culture are frustrated. This paper therefore recommends African governments' committed investment in local industrialization, restructuring information and communication industries to serve African development purposes and the establishment of a unified African Global Media Channels. Beniński filozof Paulin J. Hountondji jest autorem teorii systemu, która aspiruje do przynajmniej częściowego wytłumaczenia przyczyn złej kondycji afrykańskich społeczeństw i państw. Afrykański społeczno-polityczny stan rzeczy charakteryzuje, zdaniem Hountondjiego, przede wszystkim wadliwa organizacja struktur instytucjonalnych państw oraz codziennego życia Afrykanów. Hountondji krytykuje liczne wady afrykańskiej rzeczywistości - w tym inercję instytucji, działania pełne absurdów, marnowanie czasu, energii i zdrowia - i zarazem poszukuje ich ukrytych, „systemowych” podstaw. W rozumieniu Hountondjiego, system to zbiór wzajemnie ze sobą powiązanych elementów organizacji afrykańskich społeczeństw. (...) Istniejący system jest kontrproduktywny dla rozwoju. Myśl Hountondjiego wydaje się być adresowana przede wszystkim do samych Afrykanów, których filozof zapewne chciałby zachęcić do przemyśleń nad tym, dlaczego nie dążą oni wystarczająco skutecznie do zmiany rzeczywistości, w której żyją. Hountondji dostrzega u Afrykanów brak „woli racjonalnej organizacji, woli wykorzystania niewielu dostępnych zasobów w najlepszy możliwy sposób i dla największego możliwego zadowolenia każdego”. Zarazem wskazuje podstawowe i niezbędne, w jego opinii, działania, które mogą prowadzić do zmiany systemu, który kreuje i utrwala afrykański stan rzeczy. (shrink)

Efforts to ban Autonomous Weapon Systems were both unsuccessful and controversial. Simultaneously the need to address the detrimental aspects of AWS development and proliferation continues to grow in scope and urgency. The article presents several regulatory solutions capable of addressing the issue while simultaneously respecting the requirements of military necessity and so attracting a broad consensus. Two much stricter solutions – regional AWS bans and adoption of a no first use policy – are also presented as fallback strategies in case (...) achieving AWS’ compliance with the Laws of Armed Conflict proved elusive. Together, the solutions presented form an outline of a flexible regulatory strategy able to adjust to different technological outcomes and providing a sensible compromise to solve the current deadlock on the AWS issue. Many contemporary epistemologists take rational inference to be a conscious action performed by the thinker (Boghossian 2014; 2018; Valaris 2014; Malmgren 2018). It is tempting to think that rational evaluability requires responsibility, which in turn requires conscious action. In that case, unconscious cognition involves merely associative or otherwise arational processing. This paper argues instead for deep rationalism: unconscious inference often exhibits the same rational status and richly structured logical character as conscious inference. The central case study is rationalization, in which (...) people shift their attitudes in logically structured, reason-responsive ways in response to evidence of their own incompetence or immorality. These attitude shifts are irrational in a way that reflects on the thinker. Thus rationally evaluable inference extends downward into the unconscious. Many take the sole aim of belief to be truth (Velleman 2000) or knowledge (Williamson 2000), but the prevalence of rationalization suggests that belief updating often aims instead at preserving our positive conceptions of ourselves—that is, belief updating is part of a psychological immune system (Gilbert 2006; Mandelbaum 2019). This paper argues that the psychological immune system comprises a suite of distinct cognitive mechanisms, some (ir)rational and some arational, which are united by a common function of avoiding the maladaptive predomination of negative affect and maintaining stable motivation. Other aspects of the psychological immune system include (i) a domain-general positive bias in evaluative attitudes and (ii) “terror management,” i.e., the systematic strengthening of meaning-conferring beliefs to avoid death anxiety. The multiplicity of processes underlying the psychological immune system point toward an irrational but adaptive function of cognition to keep us motivated in a world rife with negativity and death. Student evaluations of teaching (SETs) have been used, researched, and debated for many decades. It is a common practice in higher education institutions, with the supposed purpose of improving course quality and effectiveness, but with unintended consequences of encouraging and motivating poor teaching and causing grade inflation. There is strong evidence that SET “effectiveness” does not measure teaching effectiveness. This paper reviews empirical research examining common concerns about the usefulness (positive and negative) and accuracy of SETs. The findings reveal that (...) student satisfaction relates to their anticipated/expected grades in their courses; hence, they want to get good grades and their instructors want to get a good rating of SET, and this results in grade inflation. The key points are that SETs (1) allow students to speak their “mind”, (2) have no compelling correlation between quality of teaching and learning effectiveness, (3) reward easy, less demanding, and lazy teachers with a positive rating, (4) are biased against gender, attractiveness, ethnicity, race, etc., (5) are weaponized against “some” faculty members, and (6) are like asking convicts awaiting sentencing to evaluate the judge or jurors who convicted them. This study is done in order to find the factor of depression among the college student in Malaysia. Depression among the college student are increasing as it come from many factor. This study used behavioural theory as the foundations theories for the model development. The study involved 406 respondents, selected through google form responses involving all the university students around Malaysia. A structured questionnaire was used for data collection. All variables were measured through scales previously used by other researchers. In (...) behavioural theory, state that depression people precisely those who do not know how to cope with the fact that they are no longer receiving positive reinforcement like they before. Results shows the data analysis described that respondents having a financial problem where did not what how to differentiate between wants and need with the overall mean (M=2.51) and students always spend their money on uncertain things. Sport continues to be one of the primary means through which notions of Englishness and Britishness are constructed, contested, and resisted. The legacy of the role of sport in the colonial project of the British Empire, combined with more recent connections between sport and far right fascist/nationalist politics, has made the association between Britishness, Englishness, and ethnic identity(ies) particularly intriguing. In this paper, these intersections are explored through British media coverage of the Canadian‐born, British tennis player, Greg Rusedski. This coverage (...) is examined through the lens of ‘performativity,’ as articulated by Judith Butler. Through a critical application of Butler's ideas, the ways in which the media seek to recognise and normalise certain identities, while problematising and excluding others, can be more fully appreciated. Thus, it was within newspaper framings of Rusedski that hegemonic notions of White Englishness could be performed, maintained, and embedded. (shrink)

Basic research focuses on economic diagnostics of socio-economic potential and financial results of economic entities, transition period in the economy of individual countries and ensuring their competitiveness, assessment of educational processes and knowledge management. The research results have been implemented in the different (...) models and strategies of supply and logistics management, development of non-profit organizations, competitiveness of tourism and transport, financing strategies for small and medium-sized enterprises, cross-border cooperation. The results of the study can be used in decision-making at the level the economic entities in different areas of activity and organizational-legal forms of ownership, ministries and departments that promote of development the economic entities on the basis of models and strategies for sustainable socio-economic development. The results can also be used by students and young scientists in modern concepts and mechanisms for management of sustainable socio-economic development of economic entities in the condition of global economic transformations and challenges. The article investigates the intuition that both scientific realism and scientific antirealism are turning into degenerating research programs. The evolution of realism in reaction to pessimistic (meta)induction has certainly led to its increased sophistication as it has given rise to various versions of selective realism. However, many current discussions seem either too focused on semantic niceties or are turning into endless quarrels over case-study refutations of particular forms of realism. The point of finding a better understanding of the relations of (...) scientific knowledge to the world seems to get lost in the process. Magnus, Callender, and Saatsi are among those who see the problem. Although drawing on different observations, they agree that the source of the problem is the wholesale approach according to which it is possible to resolve the realism debate in one move, by finding a single universal method of interpreting any scientific theory. Instead, they call for a more modest approach, based on case-by-case analyses. Particularly promising is Saatsi's idea of exemplar realism, according to which realism should be an attitude motivating detailed case studies rather than a specific account of science in general. Autonomous weapons systems (AWS), sometimes referred to as “killer robots”, are receiving evermore attention, both in public discourse as well as by scholars and policymakers. Much of this interest is connected with emerging ethical and legal problems linked to increasing autonomy in weapons systems, but there is a general underappreciation for the ways in which existing law might impact on these new technologies. In this paper, we argue that as AWS become more sophisticated and increasingly more capable than flesh-and-blood soldiers, (...) it will increasingly be the case that such soldiers are “in the power” of those AWS which fight against them. This implies that such soldiers ought to be considered hors de combat, and not targeted. In arguing for this point, we draw out a broader conclusion regarding hors de combat status, namely that it must be viewed contextually, with close reference to the capabilities of combatants on both sides of any discreet engagement. Given this point, and the fact that AWS may come in many shapes and sizes, and can be made for many different missions, we argue that each particular AWS will likely need its own standard for when enemy soldiers are deemed hors de combat. We conclude by examining how these nuanced views of hors de combat status might impact on meaningful human control of AWS. (shrink)

Kant's conception of autonomy presents the following problem. If, following Kant's explicit lead, we consider autonomy as the universal principle of morality and ground of the actions of rational beings (e.g. G 4:452), then self-legislation is best understood as a prescription by reason to itself. Applied to individual cases of willing, the term 'autonomy' describes the bringing of a set of practical attitudes under rational legislation. Agents may count as autonomous then, insofar as and only to the extent that they (...) are able to implement reason's prescription. This is the bare Kantian picture. The problem, as Schiller originally put it, is that this is also a picture of self-alienation, since parts of one's identity, feelings, emotions, and attachments, are kept at arm's length and treated with suspicion (e.g. AW XXb: 280). Schiller's point is that there must be something that makes autonomy different from mere rationomy. For Schiller this matters because he thinks that a rationalist prescriptive ethic is deeply unattractive and because, anticipating contemporary theories of personal autonomy, he wants to defend an integrative conception of autonomous agency. No such further commitments are needed, however, to see that the bare picture needs adding to it, to show how the principle of reason's self-legislation not only has a grip on individual agents, but also can express their autonomy. Tony Webster, the narrator of Julian Barnes’s The Sense of an Ending, poses a challenge to this commitment of ethics in his commentary on the instability of memory. But Barnes leads us past this difficulty by showing us that Tony’s real problem is his inability to make sense of himself—a failure of self-knowledge. I think that there is an awful lot wrong with the exclusion problem. So, it seems, does just about everybody else. But of course everyone disagrees about exactly _what_ is wrong with it, and I think there is more to be said about that. So I propose to say a few more words about why the exclusion problem is not really a problem after all—at least, not for the nonreductive physicalist. The genuine _dualist_ is still in trouble. Indeed, one of (...) my main points will be that the nonreductive physicalist is in a rather different position vis à vis the exclusion problem than the dualist is. Properly understanding nonreductive physicalism—and clearly recognizing that it is, after all, a form of _physicalism_—goes a long way toward solving the exclusion problem. (shrink)

Autonomous Weapons Systems (AWS) have not gained a good reputation in the past. This attitude is odd if we look at the discussion of other-usually highly anticipated-AI-technologies, like autonomous vehicles (AVs); whereby even though these machines evoke very similar ethical issues, philosophers' attitudes towards them are constructive. In this article, I try to prove that there is an unjust bias against AWS because almost every argument against them is effective against AVs too. I start with the definition of "AWS." Then, (...) I arrange my arguments by the Just War Theory (JWT), covering jus ad bellum, jus in bello and jus post bellum problems. Meanwhile, I draw attention to similar problems against other AI-technologies outside the JWT framework. Finally, I address an exception, as addressed by Duncan Purves, Ryan Jenkins and Bradley Strawser, who realized the unjustified double standard, and deliberately tried to construct a special argument which rules out only AWS. Autonomous Weapon Systems (AWS) are the next logical advancement for military technology. There is a significant concern though that by allowing such systems on the battlefield, we are collectively abdicating our moral responsibility. In this thesis, I will examine two arguments that advocate for a total ban on the use of AWS. I call these arguments the “Responsibility” and the “Agency” arguments. After presenting these arguments, I provide my own objections and demonstrate why these arguments fail to convince. I then (...) provide an argument as to why the use of AWS is a rational choice in the evolution of warfare. This article offers a normative analysis of some of the most controversial incidents involving police—what I call police-generated killings. In these cases, bad police tactics create a situation where deadly force becomes necessary, becomes perceived as necessary, or occurs unintentionally. Police deserve blame for such killings because they choose tactics that unnecessarily raise the risk of deadly force, thus violating their obligation to prioritize the protection of life. Since current law in the United States fails to ban many bad tactics, (...) police- generated killings often are treated as “lawful but awful.” To address these killings, some call on changes to departmental policies or voluntary reparations by local governments, yet such measures leave in place a troubling gap between ethics and law. I argue that police-generated killings merit legal sanctions by appealing to a relevant analogy: self-generated self-defense, where the person who engages in self-defense started the trouble. The persistent lack of accountability for police-generated killings threatens life, police legitimacy, and trust in democratic institutions. The article closes by identifying tools in law and policy to address this challenge. (shrink)

Immoralists hold that in at least some cases, moral fl aws in artworks can increase their aesthetic value. They deny what I call the valence constraint: the view that any effect that an artwork’s moral value has on its aesthetic merit must have the same valence. The immoralist offers three arguments against the valence constraint. In this paper I argue that these arguments fail, and that this failure reveals something deep and interesting about the relationship between cognitive and moral value. (...) Niniejszy artykuł traktuje o możliwościach i powinnościach procesu nauczania fonetyki na polskich uczelniach wśród studentów germanistyki. Zważywszy na bardzo dobrą podstawę poprawnej wymowy, jaką jest korzystna baza artykulacyjna Polaków, jak też rónorodność metod, które powinny być stosowane podczas uczenia fonetyki, nie ulega wątpliwości, że studenci są w stanie sprostać bardzo wysokim wymaganiom stawianym przez wykładowców. Zawarta w artykule baza pojęciowa jest jedną z metod, które winno się wykorzystywać, aby osiągnąć rzeczony cel. A zatem obok nader świadomej artykulacji niemieckich głosek na (...) zajęciach fonetyki na kierunku germanistyki jest również miejsce dla dwóch kolejnych zdecydowanie bardziej praktycznych metod. Chodzi tu oczywiście o metodę werbo-tonalną oraz metodę zmierzającą do automatyzacji jedynie okazyjnie poprawnie artykułowanych głosek. (shrink)

Istnieje spór w obrębie filozofii sięgający już starożytności i polemiki Platona z Sofistami, dotyczący ugruntowania metafizyki jako dziedziny autonomicznej, która byłaby zdolna do badania swoistych elementów rzeczywistości, przysługujących tylko i wyłącznie metafizyce. We wstępnych rozważaniach przedstawiamy sposób, w jaki ten spór można rozumieć oraz jak można go rozwiązać. Tezą metafilozoficzną naszych analiz będzie stwierdzenie, że w celu ugruntowania metafizyki musimy wskazać na swoiste doświadczenie, które mogłoby zapewnić bezpośredni dostęp poznawczy do abstrakcyjnego przedmiotu metafizyki. W niniejszych badaniach, rolę tego doświadczenia będzie (...) pełnić intuicja, którą utożsamiamy z poznaniem apriorycznym – ujmowanym jednak nie jako poznanie pojęciowe bądź dedukcyjne – lecz jako poznanie naoczne, które (używając języka fenomenologii) źródłowo (materialnie) prezentuje nam swoistą sferę przedmiotową. By lepiej zrozumieć zjawisko intuitywnego poznania do którego bardzo często filozofowie implicite się odnosili (rzadziej zaś wprost) zrekonstruujemy stanowisko E. Chudnoffa. W trakcie rekonstrukcji skupimy się na najistotniejszych cechach poznania intuitywnego, które będą kluczem zarówno do zrozumienia wielości tradycyjnych już odniesień i niejawnych odwoływań do intuicji, jak i sposobem poprzez który możliwe stanie się ustalenie warunków możliwości ugruntowania metafizyki jako dziedziny autonomicznego badania rzeczywistości. Unlike human soldiers, autonomous weapons systems are unaffected by psychological factors that would cause them to act outside the chain of command. This is a compelling moral justification for their development and eventual deployment in war. To achieve this level of sophistication, the software that runs AWS will have to first solve two problems: the frame problem and the representation problem. Solutions to these problems will inevitably involve complex software. Complex software will create security risks and will make AWS critically (...) vulnerable to hacking. I claim that the political and tactical consequences of hacked AWS far outweigh the purported advantages of AWS not being affected by psychological factors and always following orders. Therefore, one of the moral justifications for the deployment of AWS is undermined. (shrink)

David Benatar argues that coming into existence is always a harm, and that – for all of us unfortunate enough to have come into existence – it would be better had we never come to be. We contend that if one accepts Benatar’s arguments for the asymmetry between the presence and absence of pleasure and pain, and the poor quality of life, one must also accept that suicide is preferable to continued existence, and that his view therefore implies both anti-natalism (...) and pro-mortalism . This conclusion has been argued for before by Elizabeth Harman – she takes it that because Benatar claims that our lives are ‘awful’, it follows that ‘we would be better off to kill ourselves’ (Harman 2009: 784). Though we agree with Harman’s conclusion, we think that her argument is too quick, and that Benatar’s arguments for non-pro-mortalism deserve more serious consideration than she gives them. We make our case using a tripartite structure. We start by examining the prima facie case for the claim that pro-mortalism follows from Benatar’s position, presenting his response to the contrary, and furthering the dialectic by showing that Benatar’s position is not just that coming into existence is a harm, but that existence itself is a harm. We then look to Benatar’s treatment of the Epicurean line, which is important for him as it undermines his anti-death argument for non-pro-mortalism. We demonstrate that he fails to address the concern that the Epicurean line raises, and that he cannot therefore use the harm of death as an argument for non-pro-mortalism. Finally, we turn to Benatar’s pro-life argument for non-pro-mortalism, built upon his notion of interests, and argue that while the interest in continued existence may indeed have moral relevance, it is almost always irrational. Given that neither Benatar’s anti-death nor pro-life arguments for non-pro-mortalism work, we conclude that pro-mortalism follows from his anti-natalism, As such, if it is better never to have been, then it is better no longer to be. -/- . In this article, I set out Suárez's conception of the demon's obstinacy. For Suárez, the demons’ obstinacy is a divine punishment. It is the result of the free and awful choice to turn away from God that the demons have decided to make, the main consequence of which is the loss of the freedom to will and to do the good. Taking up Aquinas’s conception, Suárez considers that the demonic nature is irredeemably corrupt and obstinate in evil. Demons are provided (...) only with a miserable freedom, consisting of the possibility to choose between different evils. Perpetually sinful and eternally constrained to remain so, they are condemned to wretchedness, to complacency in evil, and to the unremitting torments of hell. (shrink)

In “Accepting Moral Responsibility for the Actions of Autonomous Weapons Systems—a Moral Gambit” (2022), Mariarosaria Taddeo and Alexander Blanchard answer one of the most vexing issues in current ethics of technology: how to close the so-called “responsibility gap”? Their solution is to require that autonomous weapons systems (AWSs) may only be used if there is some human being who accepts the ex ante responsibility for those actions of the AWS that could not have been predicted or intended (in such cases, (...) the human being takes what the authors call the “moral gambit”). The authors then propose several institutional safeguards to implement in order to ensure that the moral gambit is taken in a fair and just way. This paper explores this suggestion in the context of the institutional settings within which AWSs are most likely to be deployed. It raises some concerns as to the feasibility of Taddeo and Blanchard’s proposal, in light of the recent empirical work on the incentive structures likely to exist within militaries. It then presents a potential problem that may arise in case the accountability mechanisms are successfully implemented. (shrink)

In this paper, we develop an analysis of the structure and content of loneliness. We argue that this is an emotion of absence-an affective state in which certain social goods are regarded as out of reach for the subject of experience. By surveying the range of social goods that appear to be missing from the lonely person's perspective, we see what it is that can make this emotional condition so subjectively awful for those who undergo it, including the profound sense (...) of being unable to realise oneself, in collaboration with others. Subjects of ectogenesis—human beings that are developing in artificial wombs (AWs)—share the same moral status as newborns. To demonstrate this, I defend two claims. First, subjects of partial ectogenesis—those that develop in utero for a time before being transferred to AWs—are newborns (in the full sense of the word). Second, subjects of complete ectogenesis—those who develop in AWs entirely—share the same moral status as newborns. To defend the first claim, I rely on Elizabeth Chloe Romanis’s distinctions between fetuses, newborns and (...) subjects of ectogenesis. For Romanis, the subject of partial ectogenesis ‘is neither a fetus nor a baby’ but is, instead, a ‘new product of human reproduction’. In this essay, I begin by, expanding upon Romanis’s argument that subjects of partial ectogenesis are not fetuses while arguing that those subjects are newborns. Next, I show that the distinction that Romanis draws between subjects of partial ectogenesis and newborns needs to be revised. The former is a kind of the latter. This leads us to an argument that shows why different moral statuses cannot be justifiably assigned to subjects of partial ectogenesis and subjects of complete ectogenesis, respectively. As subjects of partial ectogenesis share the same moral status as newborns, it follows that subjects of complete ectogenesis share the same moral status as newborns as well. I conclude by considering implications that this essay may have for the research and development of AW technology and conceptual links between a subject’s moral status and birth. (shrink)

Pain, crucially, is unpleasant and motivational. It can be awful; and it drives us to action, e.g. to take our weight off a sprained ankle. But what is the relationship between pain and those two features? And in virtue of what does pain have them? Addressing these questions, Colin Klein and Richard J. Hall have recently developed the idea that pains are, at least partly, experiential commands—to stop placing your weight on your ankle, for example. In this paper, I reject (...) their accounts. Against Klein, I use dissociation cases to argue that possession of ‘imperative content’ cannot wholly constitute pain. Against them both, I further claim that possession of such content cannot even constitute pain’s unpleasant, motivational aspect. For, even if it were possible to specify the relevant imperative content—which is far from clear—the idea of a command cannot bear the explanatory weight Klein and Hall place on it. (shrink)

Recently, I argued that human subjects in artificial wombs ‘share the same moral status as newborns’ and so, deserve the same treatment and protections as newborns. This thesis rests on two claims: subjects of partial ectogenesis—those that develop in utero for at time before being transferred to AWs—are newborns and subjects of complete ectogenesis—those who develop in AWs entirely—share the same moral status as newborns. In response, Elizabeth Chloe Romanis argued that the subject in an AW is ‘a unique human (...) entity…rather than a fetus or a newborn’. She provides four lines of response to my essay. First, she argues that I have ‘misconstrued’ what birth is. Once we correct that error, it becomes clear that subjects of partial ectogenesis have not been born. Second, she argues that my claims imply that non-implanted embryos ‘would also be “born”’. But that is absurd. Third, she claims I fail to ‘meaningfully respond’ to distinctions she draws between subjects of ectogenesis and neonates. Finally, she criticises my essay for focusing on subjects of AWs rather than focusing on pregnant persons. I respond to each of these charges. In doing so, I reaffirm that some subjects of ectogenesis are newborns and all subjects of ectogenesis—even those that have not been born—share the same moral status as newborns. (shrink)

Planning organizes our actions and conditions our effective-ness. To understand this philosophical hint better, the author investigates and juxtaposes two important accounts in action theory. He discusses the concept of a plan proposed by Tadeusz Kotarbiński in his praxiology (theory of efcient action), and the so called “planning theory of intention” by Michael E. Bratman. The conceptual meeting of these two proposals helps to remove aws in Kotarbiński’s action theory, it also shows the way, in which we can enrich the (...) idea of plans in the frame-work of intentions. Generally, praxiology occurs to be still an important perspective in action theory, which particularly shows how we can improve our understanding of planning when confronted with infuentialcontemporary accounts. Predictions about autonomous weapon systems are typically thought to channel fears that drove all the myths about intelligence embodied in matter. One of these is the idea that the technology can get out of control and ultimately lead to horrifi c consequences, as is the case in Mary Shelley’s classic Frankenstein. Given this, predictions about AWS are sometimes dismissed as science-fiction fear-mongering. This paper considers several analogies between AWS and other weapon systems and ultimately offers an argument that nuclear weapons (...) and their effect on the development of modern asymmetrical warfare are the best analogy to the introduction of AWS. The fi nal section focuses on this analogy and offers speculations about the likely consequences of AWS being hacked. These speculations tacitly draw on myths and tropes about technology and AI from popular fi ction, such as Frankenstein, to project a convincing model of the risks and benefi ts of AWS deployment. One way to think about the philosophical significance of hatred is to consider doctrines that are characterised by feelings of hatred. A good candidate is misanthropy, which is often conceived as an attitude of hatred directed at humankind at large. I start by sketching a working account of misanthropy as a critical verdict or judgment on the contemporary condition of humankind as it has become. The criticism is directed at the array of vices and failings that are ubiquitous and entrenched (...) within the wider structures of human life, rather than those of individual persons. In one of its forms, misanthropy manifests itself in feelings of hatred for those entrenched failings and the patterns of awful behaviour which they motivate and sustain - for instance, the figure that Kant called the "enemy of mankind", or the radical eco-misanthropes who populated much American radical environmentalism of the 1980s, with their calls to 'tear down' the 'whole human world'. I then argue that such hateful 'enemies of mankind' represent only one among a set of modes of misanthropy. These have more peaceable affective and practical profiles that offer us forms of misanthropy without hatred. If so, we can think philosophically about hate in relation to misanthropy and about the potential scope of hatred. Thinking about the entrenched vices and failings constitutive of our life as it has become offers a way of intelligibly hating something as large as 'humanity'. But there are other responses to those vices and failings than hatred. I end by speculating that although hateful misanthropy tends to dominate discussions of misanthropy, historically it is the least common. That, itself, might tell us something about the sustainability of hatred. (shrink)

Technological progress has brought about the emergence of machines that have the capacity to take human lives without human control. These represent an unprecedented threat to humankind. This paper starts from the example of chemical weapons, now banned worldwide by the Geneva protocol, to illustrate how technological development initially aimed at the benefit of humankind has, ultimately, produced what is now called the “Weaponization of Artificial Intelligence (AI)”. Autonomous Weapon Systems (AWS) fail the so-called discrimination principle, yet, the wider public (...) is largely unaware of this problem. Given that ongoing scientific research on AWS, performed in the military sector, is generally not made available to the public domain, many of the viewpoints on this subject, expressed across different media, invoke common sense rather than scientific evidence. Yet, the implications of a potential weaponization of our work as scientists, especially in the field of AI, are reaching further than some may think. The potential consequences of a deployment of AWS for citizen stakeholders are incommensurable, and it is time to raise awareness in the public domain of the kind of potential threats identified, and to encourage legal policies ensuring that these threats will not materialize. The international debate on the ethics and legality of autonomous weapon systems (AWS), along with the call for a ban, primarily focus on the nebulous concept of fully autonomous AWS. These are AWS capable of target selection and engagement absent human supervision or control. This paper argues that such a conception of autonomy is divorced from both military planning and decision-making operations; it also ignores the design requirements that govern AWS engineering and the subsequent tracking and tracing of moral responsibility. (...) To show how military operations can be coupled with design ethics, this paper marries two different kinds of meaningful human control (MHC) termed levels of abstraction. Under this two-tiered understanding of MHC, the contentious notion of ‘full’ autonomy becomes unproblematic. (shrink)

STRESZCZENIE Opracowanie zmierza do udzielenia odpowiedzi na pytanie, czym – z punktu widzenia struktury procesu wykładni i struktury wchodzących w grę wartości konstytucyjnych – różni się ograniczanie wolności i praw w ramach stosowania „zwykłych środków konstytucyjnych”, od ograniczania wolności i praw dopuszczalnego w stanach nadzwyczajnych. Podjęta zostaje problematyka dotyczącą kwestii materialnych, a poza zakresem rozważanych zagadnień pozostają kwestie dotyczące formalnych warunków dopuszczalności ograniczeń, jak publiczne ogłoszenie zagrożenia czy możliwość wprowadzania ograniczeń w aktach podustawowych. Stawiane tezy są polemiczne wobec poglądów, że (...) zawieszenie wolności lub praw jest skrajnym typem ograniczania i następuje wtedy, gdy wolności czy prawa „już nie ma”, lub że zawieszenie zakłada ograniczenie istoty wolności lub prawa. Okazuje się, że można sensownie mówić o zawieszaniu wolności lub praw także wówczas, gdy są one ograniczane w niewielkim tylko stopniu. Ponadto, możliwe jest zawieszanie, które nie prowadzi do ograniczenia istoty wolności lub prawa. Argumentuje się, że istotą zawieszania wolności lub praw w stanach nadzwyczajnych jest zakwestionowanie podstawowego ich przymiotu, jakim jest – uznawana w prawie międzynarodowym – nienaruszalność „całych” poszczególnych praw człowieka, która jest czymś innym od nienaruszalności ich istoty. Przy okazji prowadzona jest refleksja teoretycznoprawna nad zagadnieniem zawieszania wolności lub praw. Zawieszenie okazuje się czymś istotnie różnym od czasowej utraty mocy obowiązującej przepisów dotyczących wolności czy praw. Ich ciągłe obowiązywanie znajduje wyraz, na przykład, w zasadzie proporcjonalności mającej zastosowanie do zawieszanych wolności lub praw. -/- Extraordinary Measures and Restrictions of Constitutional Freedoms and Rights ABSTRACT The study aims to answer the question on the difference between limitation of freedoms and rights in ordinary situations and their suspension (derogation) when extraordinary measures are introduced. This question is considered from the point of view of the structure of the interpretation process and the structure of the constitutional values. Consideration is given to issues relating to material aspects. However, issues relating to formal conditions for the admissibility of restrictions, such as public announcement of a threat or the possibility of introducing restrictions in sub-statutory acts, are not examined. The theses put forward are critical of the view that suspension of freedoms or rights is an extreme type of limitation and a freedom or a right "is no longer there", and of the view that suspension presupposes violation of the essence of freedom or right. It can be argued that it makes sense to talk about the suspension of freedoms or rights also when they are only slightly restricted. Moreover, it is possible to suspend a freedom or a right without violating their essence. It is argued that suspension of freedoms or rights leads to questioning of their basic characteristic that is their inviolability as recognized in international law. However, this inviolability of freedoms or rights is something different from the inviolability of their essence. In terms of the theory of law, the suspension of freedoms or rights turns out to be something significantly different from the temporary loss of the binding force of the respective provisions. Their continued validity is reflected, for example, in the application of the principle of proportionality to the suspended freedoms or rights. (shrink)

It is widely thought that stealing, trading and destroying cultural artifacts in time of war are inherently immoral actions, and that it is right that they be treated as war crimes, which, indeed, they currently are. But oppressive cultures have their heritage and cultural artifacts too, in the form of monuments, sites of worship, and so on; and for the oppressed, these things may be awful reminders of their subordination, and may even perpetuate it. This chapter suggests that, since cultural (...) objects can be both tools and symbols of unjust oppression, their theft and destruction ought to be seen as appropriate when this would be a means of overcoming oppression. Whatever current law may say, in these instances, it would be morally inappropriate to count such acts as war crimes. Furthermore, it is bizarre that theft and destruction of cultural property are counted as war crimes when soldiers killing each other is not (due to combatant immunity). Surely killing is worse than property destruction and theft. It is therefore argued that, where possible, it would be better for conflicts to be fought using the latter methods. Finally, the chapter responds to many objections to using theft and destruction of cultural property as a method of warfare. E.g. to the objection that such property has timeless, trans-cultural, aesthetic, historical and scientific value, it is replied that justice is a more important value; and to the objection that these practices amount to cultural genocide it is replied that unjust cultures have no right to exist unmodified. To many, the idea of autonomous weapons systems (AWS) killing human beings is grotesque. Yet critics have had difficulty explaining why it should make a significant moral difference if a human combatant is killed by an AWS as opposed to being killed by a human combatant. The purpose of this paper is to explore the roots of various deontological concerns with AWS and to consider whether these concerns are distinct from any concerns that also apply to long- distance, human-guided weaponry. We suggest that at least one major driver of the intuitive moral aversion to lethal AWS is that their use disrespects their human targets by violating the martial contract between human combatants. On our understanding of this doctrine, service personnel cede a right not to be directly targeted with lethal violence to other human agents alone. Artificial agents, of which AWS are one example, cannot understand the value of human life. A human combatant cannot transfer his privileges of targeting enemy combatants to a robot. Therefore, the human duty-holder who deploys AWS breaches the martial contract between human combatants and disrespects the targeted combatants. We consider whether this novel deontological objection to AWS forms the foundation of several other popular yet imperfect deontological objections to AWS. (shrink)

Artykuł, opublikowany po raz pierwszy w 1979 r., jest jednym z najczęściej cytowanych tekstów filozoficznych z drugiej połowy XX wieku. Tekst Bernarda Williamsa zainicjował kilka ważnych debat, toczących się do dziś w etyce i filozofii działania. Zaproponowana przez niego interpretacja pojęcia racji działania jest, z jednej strony, niezwykle wpływowa, ale z drugiej bardzo niejednoznaczna i często krytykowana. Williams broni stanowiska, które z czasem zaczęto określać jako internalizm racji: pewne względy są racjami działania dla danego podmiotu tylko wtedy, gdy mają ścisły (...) związek z "subiektywnym układem motywacyjnym" tego podmiotu, czyli z jakimiś aspektami jego psychiki, charakteru, celów, pragnień, planów, relacji z innymi itd. Stwierdzenie, że ktoś ma rację, by coś zrobić (a jeśli uznajemy, że jest to racja przeważająca - to, że powinien to coś zrobić), znaczy więc wedle tego stanowiska tyle, że ten ktoś jest w stanie być motywowany, by to coś zrobić. W przeciwieństwie do tego stanowisko określane obecnie ako eksternalizm racji głosi, że pewne względy mogą być racjami działania dla danego podmiotu także wtedy, gdy odwołują się do niezależnych od jego układu motywacyjnego własności świata. Williams wychodzi od modelu działania nawiązującego do koncepcji Hume'owskiej, następnie przedstawia jego bardziej rozbudowaną wersję, omawia rolę namysłu, naturę potrzeb, a także przedstawia argument za internalizmem racji, określany jako argument z wyjaśniania działania. Głosi on, że nawet gdyby istniały zewnętrzne racje działania, niezwiązane z subiektywnym układem motywacyjnym danego podmiotu, to odwołanie się do nich nie byłoby w stanie wyjaśnić, dlaczego dany podmiot postąpił tak, a nie inaczej, gdyż "nic nie jest w stanie wyjaśnić (zamierzonych) działań podmiotu za wyjątkiem czegoś, co motywuje go działania". We describe a prediction method called "Attractivity Weighting" (AW). In the case of cue-based paired comparison tasks, AW's prediction is based on a weighted average of the cue values of the most successful cues. In many situations, AW's prediction is based on the cue value of the most successful cue, resulting in behavior similar to Take-the-Best (TTB). Unlike TTB, AW has a desirable characteristic called "access optimality": Its long-run success is guaranteed to be at least as great as the most (...) successful cue. While access optimality is a desirable characteristic, concerns may be raised about the short-term performance of AW. To evaluate such concerns, we here present a study of AW's short-term performance. The results suggest that there is little reason to worry about the short-run performance of AW. Our study also shows that, in random sequences of paired comparison tasks, the behavior of AW and TTB is nearly indiscernible. (shrink)

Badania przy użyciu rezonansu magnetycznego sugerują, że przynajmniej niektórzy pacjenci w tzw. stanie wegetatywnym mogą być bardziej „świadomi”, niż to się do tej pory wydawało. W artykule zamierzam omówić te badania; następnie rozważę, o jakie rozumienie pojęcia świadomości może w nich chodzić; a wreszcie zastanowię się nad etycznymi implikacjami tych odkryć. Zamierzam też rozważyć, czy posiadanie wyższych form świadomości zawsze ma być dodatkową racją przemawiającą przeciwko zaprzestaniu podtrzymywaniu funkcji życiowych. Tym samym, w artykule chciałbym wskazać istotność badań z zakresu kognitywistyki (...) dotyczących pojęcia świadomości dla etycznej oceny pewnych praktyk medycznych. (shrink)

Would it be ethical to deploy autonomous weapon systems (AWS) if they were unable to reliably recognize when enemy forces had surrendered? I suggest that an inability to reliably recognize surrender would not prohibit the ethical deployment of AWS where there was a limited window of opportunity for targets to surrender between the launch of the AWS and its impact. However, the operations of AWS with a high degree of autonomy and/or long periods of time between release and impact are (...) likely to remain controversial until they have the capacity to reliably recognize surrender. This chapter considers how the adoption of autonomous weapons systems (AWS) may affect jus ad bellum principles of warfare. In particular, it focuses on the use of AWS in non-international armed conflicts (NIAC). Given the proliferation of NIAC, the development and use of AWS will most likely be attuned to this specific theater of war. As warfare waged by modernized liberal democracies (those most likely to develop and employ AWS at present) increasingly moves toward a model of individualized warfare, how, (...) if at all, will the principles by which we measure the justness of the commencement of such hostilities be affected by the introduction of AWS, and how will such hostilities stack up to current legal agreements surrounding their more traditional engagement? This chapter claims that such considerations give us reason to question the moral and legal necessity of ad bellum proper authority. (shrink)

Arguments concerning the nature of natural evil vary in their conclusions depending on the particular approach with which they commence inquiry; one of the most contested conclusions regards evil as privation, sourcing its justification primarily from Aquinas’ metaphysical conception of good as being and evil as non-being. It should be of no surprise, then, that the dismissal of natural evil’s privative nature comes about when the understanding of natural evil favours a phenomenological approach rather than a metaphysical one. Proponents of (...) said dismissal generally centre their claims around the notion of pain and suffering as substantially contentful – as in, non-privative – experiences of evil. On the other hand, theorists espousing the privation account generally argue that characterisations of pain and suffering as necessarily evil do not consider the context of orientation towards individual wellbeing within which pain/suffering experiences naturally function. Furthermore, some of the arguments for the privation account’s dismissal seem to disregard completely the Thomistic sense of the form and hierarchy of the good, which ends up straw-manning the privation account to a point where it can no longer reconcile the awfulness of experienced pain and suffering with these experiences not being necessarily evil. The importance of understanding this Thomistic sense is further emphasised in its capacity to explain why a divine and fully good Creator would involve the world with such evil. Thus, this paper first considers the account of evil given in question one of Aquinas’ De malo, along with contemporary arguments for the nature and purpose of evil as privation; second, these are then used as resources to help make sense of, one, the general nature of pain and suffering, and two, some of their specific expressions as found in disease and depression, and throughout evolutionary history. A review of David E. Cooper's book, "Animals and Misanthropy", which argues that reflection on awful treatment of animals justifies a negative critical judgment on human life and culture.

Obywatelstwo należy do najistotniejszych kategorii określających pozycję człowieka w państwie. W niektórych okresach dziejów pojęcie obywatelstwa istniało jedynie w sferze idei, w innych idea uległa urzeczywistnieniu, a członkostwo w państwie (lub mieście) oraz status obywatelski znalazły formalny wyraz na niwie prawnoustrojowej. Kształtowanie się obywatelstwa stanowi proces długi i wielofazowy. Obywatelstwo w Europie pozostaje bowiem już od starożytności w stanie permanentnego rozwoju i wciąż wzbogacane jest o nowe treści (lub też czasem zubożane o pewne elementy); tym niemniej jego rdzeń, nakreślony w (...) pierwowzorach antycznych, pozostaje w dużej mierze tożsamy. Sens obywatelstwa, czy też jego ładunek znaczeniowy ulega redefinicji w perspektywie historycznej w zależności od specyficznych warunków natury społeczno-politycznej. Na poszczególnych etapach ewolucji obywatelstwo obejmuje swym zasięgiem węższą lub szerszą część społeczeństw państwowych. (shrink)
