Tak-Lap Yeungs Arbeit verfolgt eine innovative Deutungsperspektive mit dem Versuch, Heideggers Kant-Adaption als Weg einer Umdeutung nachzuvollziehen, um eine neue Kant-Lesart stark zu machen und zugleich darüber hinaus einen von Hannah Arendt inspirierten eigenständigen Ansatz zu entwickeln, der die Rolle der Einbildungskraft als ontologische und konstitutive Instanz der Existenzorientierung zu bestimmen ermöglicht. The goal of this research is to strengthen a new reading of Kant while simultaneously developing an independent approach, inspired by Arendt, that allows the role of the imagination as an ontological and constitutive instance of existential orientation to be determined. In addition, Yeung shows in the appendix a comparison between Heidegger’s and Mou Zongsan’s interpretations of Kant. With the increasing degrees A.I.s and machines are applied across different social contexts, the need for implementing ethics in A.I.s is pressing. In this paper, we argue for a pluralist hybrid model for the implementation of moral A.I.s. We first survey current approaches to moral A.I.s and their inherent limitations. Then we propose the pluralist hybrid approach and show how these limitations of moral A.I.s can be partly alleviated by the pluralist hybrid approach. The core ethical decision-making capacity of an (...) A.I. based on the pluralist hybrid approach consists of two systems. The first is a deterministic algorithm system that incorporates different moral rules for making explicit moral decisions. The second is a machine learning system that calculates the value of the variables required by the application of moral principles. The pluralist hybrid system is better than the existing proposals as (i) it better addresses the moral disagreement problem of the top-down approach by including different moral principles, while (ii) it reduces the opacity of ethical decision-making compared with a bottom-up system by implementing explicit moral principles for moral decision making. This paper investigates the emotional import of literary devices deployed in fiction. Reflecting on the often-favored approach in the analytic tradition that locates fictional characters, events, and narratives as sources of readers’ emotions, I attempt to broaden the scope of analysis by accounting for how literary devices trigger non-cognitive emotions. I argue that giving more expansive consideration to literary devices by which authors present content facilitates a better understanding of how fiction engages emotion. As the title suggests, this collection addresses the very topical subject matter of environmental ethics by bringing together a host of unique voices. In the editor’s words, ‘[t]he essays collected here represent a joint effort in dealing with this problem [of global environmental conservation and protection]. All contributors to this volume agree that what we urgently need now is global awareness of the environmental crisis we are facing’ (9). While a thread of consensus weaves throughout, what is more striking is (...) the diverse and colorful tapestry of approaches these essays yield on a single theme. The first four essays articulate the ethical injunction to conserve and protect the natural environment in terms of various axiological and methodological commitments: normative, biocentric, aesthetic and empirical. In the final five essays, the thematic emphasis shifts ever so slightly. A plurality of perspectives on environmental conservation and protection emerges from different theological commitments, at times reflecting and at other times transcending individual—Christian/Western, Islamic/Middle Eastern, Buddhist/Eastern, and (in the final two essays) Daoist/Eastern—cultures. Nguồn lực và chất lượng giáo viên là một trong những mối quan tâm thiết yếu để phát triển giáo dục bền vững. Thông qua phân tích bộ dữ liệu “Khảo sát thói quen phát triển chuyên môn giáo viên các trường phổ thông ở Việt Nam năm 2019” với 464 quan sát về thói quen học tập của giáo viên phổ thông từ các trường công lập và tư thục trên cả nước, chúng tôi thực hiện nghiên cứu phân (...) tích thói quen phát triển chuyên môn của giáo viên. Nghiên cứu này là một phần kết quả của dự án nghiên cứu về năng lực chuyên môn giáo viên phổ thông Việt Nam giai đoạn 2020 – 2025 của Trung tâm nghiên cứu và Phát triển Giáo dục EdLab Asia. Bằng cách phân tích dữ liệu về số giờ tham gia hoạt động phát triển chuyên môn của giáo viên ở từng loại hình trường, nghiên cứu chỉ ra sự khác biệt về thói quen học tập của giáo viên các cấp phổ thông theo từng loại hình nhà trường. Nghiên cứu cũng chỉ ra rằng hoạt động phát triển chuyên môn giáo viên của trường tư thục tốt hơn trường công lập. Kết quả của nghiên cứu là gợi ý cho các nhà hoạch định chính sách, các nhà quản lý giáo dục tại các cơ sở giáo dục phổ thông, không kể công-tư tham chiếu và điều chỉnh các kế hoạch, chương trình phát triển chuyên môn giáo viên. We are affected by the world: when I place my hand next to the fire, it becomes hot, and when I plunge it into the bucket of ice water, it becomes cold. What goes for physical changes also goes for at least some mental changes: when Felix the Cat leaps upon my lap, my lap not only becomes warm, but I also feel this warmth, and when he purrs, I hear his purr. It seems obvious, in other words, that perception (...) (at least, and at least under ordinary conditions) is a matter of being affected by the agency of perceptible objects. Call this doctrine affectionism. Durand of St.-Pourçain rejects affectionism. The paper has three parts. In the first part, I sketch, briefly, what motivates Durand to reject affectionism. In the second part, I will take up the affectionist doctrine as defended by Durand's older contemporary at Paris, Godfrey of Fontaines, who holds that the object of all our mental acts (not just perceptions, but also thoughts and desires) is the efficient cause of those acts, or, in other words, all mental acts (not just perception) come about owing to the affection of the relevant mental faculty by the agency of the object. As it turns out, Godfrey develops a celebrated argument against the thesis that the object is not the efficient cause but a mere sine qua non cause. Hence his position offers a challenge to Durand's position, a challenge, I argue in the third part, Durand meets. (shrink)

Celem artykułu jest pokazanie konsekwencji przyjęcia longtermizmu w wersji skrajnej dla postrzegania obowiązku likwidacji skrajnej biedy w świetle zasady równego rozważania interesów. W artykule argumentuję na rzecz hipotezy, że konsekwentny zwolennik myśli etycznej Petera Singera skorygowanej o postulaty long- termizmu musi przyjąć, iż obowiązki wobec przyszłych ludzi uchylają obowiązki wobec obecnie żyjących ludzi, nawet znajdujących się w tak niekorzystnym położeniu jak skrajna bieda. W pierwszej części artykułu szkicuję argumenty Singera na rzecz moralnego obowiązku likwidacji skrajnej biedy za pomocą efektywnych metod (...) aż do znacznego obniżenia własnego poziomu życia. Przybliżenie tych szeroko znanych poglądów stanowi ramy argumentacji na rzecz hipotezy badawczej. Następnie krótko charakteryzuję efektywny altruizm, na gruncie któ- rego wyrosło nowe podejście w ramach konsekwencjalizmu: longtermizm. Postulaty i założenia longtermizmu w ujęciu W. MacAskilla i T. Orda zestawiam z myślą Singera, aby doprowadzić ich argumentację do logicznych wniosków, które wspierają hipotezę badawczą artykułu -/- Moral duties towards the poor and longtermism The aim of the article is to show the consequences of adopting strong longtermism for the perception of the obligation to eliminate extreme poverty in the light of the principle of equal consideration of interests. In the article, I argue in favor of the hypothesis that a consistent supporter of Peter Singer’s ethical thought adjusted to the postulates of longtermism must assume that obligations towards future people abrogate duties towards current people, even those in such an unfavorable situation as extreme poverty. In the first part of the article, I sketch Singer’s arguments for the moral obligation to eliminate extreme poverty using effective methods, up to significant decrease in one’s level of life. An outline of these widely known views constitutes the framework of arguments in favor of the research hypothesis. Then I briefly characterize effective altruism, which is the basis for a new approach within consequentialism: longtermism. I compare the postulates and assumptions of longtermism as presented by W. MacAskill and T. Ord with Singer’s thought in order to bring their argumen- tation to logical conclusions that support the research hypothesis of this article. (shrink)

La Logique ou L'Art de Penser (LAP), also known as the Port-Royal Logic, is generally presented as a "logic of ideas" in which the idea, the central epistemological entity, is the starting point of this logic based on Cartesian ontology. Structured around the four main operations of the mind - conceiving, judging, reasoning and ordering - the first part of the LAP contains "reflections on ideas". The idea, "the form by which we represent things [objects]", thus takes the place of (...) the concept in Aristotelian-inspired logic. Some of the chapters in this first part deal with the problems raised in scholasticism by the theory of _proprietates terminorum_, which means that it is also a semantics of terms. The word 'term' itself must be understood in its logical and grammatical dimensions. The analyses of the 'Messieurs' of Port-Royal often have a logico-grammatical character, because, according to the anthropology of the authors, men need to make their thoughts heard by one another through language (institutional signs) and, therefore, "it is necessary in logic to consider ideas joined to words, and words joined to ideas". In this text, we shall endeavour to show the importance and innovative character of the semantics of terms in this logic of ideas which makes LAP a pivotal moment in the evolution of the language sciences, reviving the tradition and allowing dialogue with future developments (extension vs. comprehension, explanation, determination of terms, etc.). We will pay particular attention to the chapters on definition, "a remedy for the confusion that arises in our thoughts and speech from the confusion of words". (shrink)

Khi xã hội vẫn đang cố gắng chuyển mình sang giai đoạn mới để có thể thích ứng với sự biến đổi công nghệ, cuộc cách mạng AI lại tiếp tục diễn ra đòi hỏi chúng ta phải suy nghĩ lại quỹ đạo của quá trình chuyển đổi xã hội vì nó có thể làm trầm trọng hơn các rủi ro an ninh thông tin được trình bày ở trên. Cụ thể, xã hội cần tiến hóa như thế nào để có thể bắt kịp với sự biến đổi mang tính đột phá tạo ra bởi làn sóng công nghệ AI hiện nay? Imagine you fly home from vacation with your one-and-a-half-year-old son who is traveling for free as a “lap child.” In the airport parking lot, you put him into his forward-facing car seat, where he sits much more contentedly than he did in the rear-facing one that was mandatory until his first birthday. After he falls asleep on the way home, you transfer him to his crib without waking him, lowering the side rail so you can lift him in more easily. (...) -/- Many parts of this idyllic parenting picture are deemed unacceptably risky according to recent child safety proposals. While these proposals all aim to improve child safety, their possible impact is unclear because there has been little discussion of the absolute risk and risk reduction involved in each. And while precise figures are lacking, rough estimates indicate that the magnitudes are quite small. I will argue that this risk and benefit data raises important questions about the proposals, including whether parents might reasonably believe that the small absolute risk reduction offered by the proposed changes does not justify the attendant burdens. This possibility—termed the “prevention paradox” in other contexts—highlights ethical and theoretical challenges in this area of public health. (shrink)

What were the true reasons of the second scientific revolution? – To answer the question, the epistemic model is applied, according to which radical breakthroughs in science were not due to the fanciful excogitation of new ideas ‘ex nihilo’, but rather to the tedious, long-term and troublesome processes of the mutual lapping, reconciliation, interpenetration and intertwinement of ‘old’ research traditions preceding such breaks. It is contended that Einstein's 'annus mirabilis' constituted an acme of the second scientific revolution. To fathom in (...) what felicitous ways Einstein's 1905 writings hang together one is bound to pay special tribute to his longed strive for unity evinced in incessant attempts to coordinate the profound research traditions of classical physics. Though Einstein's efforts sprung out of Max Planck's pioneering attempts to comprehend electromagnetic phenomena through the lenses of conceptual structures of statistical thermodynamics . It was Planck, who clearly realized the cross-contradiction between 'the physics of material bodies’ and ‘the physics of the ether' and outlined the sketch of its withdrawal: the paradigms 'must be modified to remain compatible'. And it was Planck who took the first step in modifying the physics of the ether and contending that 'not only matter itself but also the effects radiated from matter' possess discontinuous properties, which can be characterized by a new natural constant: the elementary quantum of action. Einstein's part consisted in that he took the second step in modifying the second component of the encounter – the physics of material bodies. Einstein’s foolhardy light quanta hypothesis and distinctive special theory of relativity turn out to be mere milestones of the unwinding of Maxwellian electrodynamics and statistical thermodynamics reconcilement research program. The notorious conception of luminiferous ether was a substantial obstacle for Einstein’s wayward statistical thermodynamics in which the pivotal lead was played by flagrant light quanta paper. Einstein was aware that his enticing light quanta hypothesis was too audacious to be taken literally and he laid out his version of 'electrodynamics of moving bodies' in a markedly Machian/ Duhemian, phenomenological way. As a result of the revision of the second scientific revolution key episode, the arguments are exhibited in favor of the necessity to modify the history of the genesis of general relativity; correspondingly, the process of unification of electromagnetic and weak interactions that took place in the second half of the XX-th century is scrutinized. Eventually, the encounter and interpenetration of the two dominating research traditions of modern physics – that of general relativity and quantum field theory – is elicited. (shrink)

Khi xã hội vẫn đang cố gắng chuyển mình sang giai đoạn mới để có thể thích ứng với sự biến đổi công nghệ, cuộc cách mạng AI lại tiếp tục diễn ra đòi hỏi chúng ta phải suy nghĩ lại quỹ đạo của quá trình chuyển đổi xã hội vì nó có thể làm trầm trọng hơn các rủi ro an ninh thông tin được trình bày ở trên. Cụ thể, xã hội cần tiến hóa như thế nào để có thể bắt kịp với sự biến đổi mang tính đột phá tạo ra bởi làn sóng công nghệ AI hiện nay? Làm sao để quản lý và tận dụng sức mạnh của chúng trong khi vẫn đảm bảo được an ninh thông tin khi không gian và thời gian sống trong thế giới ảo của chúng ta ngày càng tăng? Trung Quốc là nền kinh tế lớn hàng đầu thế giới, vận hành với hiệu suất cao để đáp ứng nhu cầu sinh kế của hơn 1,4 tỷ người dân, và cung cấp một lượng hàng hóa công nghệ, tiêu dùng và cả nông phẩm tới thế giới. Hệ quả tất yếu của quá trình tăng trưởng liên tục hơn 4 thập niên là việc sử dụng tài nguyên, và trong quá trình sản xuất, chế tạo, chế biến cũng sản (...) sinh ra một lượng khí nhà kính (GHG) tích lũy khổng lồ phát thải vào khí quyển. Trong một thống kê được đăng trên The Guardian năm 2017, thế giới đã nhận thấy trong giai đoạn 1988-2015, 100 tổ hợp công nghiệp hàng đầu thế giới chịu trách nhiệm cho việc phát thải tới 71% tổng tồn lượng GHG trong khí quyển. Dẫn đầu danh sách này trên phương diện quốc gia là Trung Quốc, với thống kê chỉ 5 đại công ty Trung Quốc đã chiếm tới gần 17% tổng lượng phát thải, trong đó tổ hợp ngành than có trách nhiệm lớn nhất, tới 14,32%. Sau những tiến bộ công nghệ vượt bậc cũng như tích lũy thặng dư nền kinh tế, quá trình hiện đại hóa ở Trung Quốc sang thời kỳ Chủ tịch Tập Cận Bình đã chuyển hướng sang bảo vệ môi trường với các mục tiêu phát thải nghiêm ngặt. Chẳng hạn như xác định nhóm ngành sản xuất gang thép với vai trò lớn trong mục tiêu giảm phát thải GHG, chính phủ và lãnh đạo công nghiệp liên tục tìm kiếm giải pháp cho sự hạn chế nguồn tài nguyên, thúc đẩy khuếch tán công nghệ, ứng dụng tiến bộ trong giảm phát thải và thu giữ, chôn lấp các-bon, thích hợp với ngành thép, dựa trên đánh giá bằng hệ thống phân tích hướng tới giải quyết mục tiêu biến đổi khí hậu có tên viết tắt “C3IAM/NET-IS.”. Nhằm tiến tới một xã hội nơi con người được đặt làm trung tâm đồng thời chung sống hài hoà với công nghệ ngày càng (...) thông minh, năm gợi ý cụ thể cho Việt Nam đã được đưa ra: Tầm nhìn lấy con người làm trung tâm; Góc nhìn đa chiều về mối quan hệ giữa người và máy; Lấy AI làm động lực phát triển kinh tế-xã hội; Cách tiếp cận từ dưới lên trên và thúc đẩy tính tham gia trong việc thiết lập tầm nhìn; và Tính bền vững và bao quát trong các ứng dụng của AI. In English: The aim of the article is to analyze the basic assumptions of Roman Ingarden’s ethics. His views are discussed from the perspective of questions about the source of moral oughtness. Therefore, the main analysis is focused on the relationship between moral values and the oughtness needed to realize them. Ingarden’s position is placed in a broader ethical context; the important question is whether it is in the idea of the particular value or in the experience of the particular (...) value in the past. The answer to this question reveals the nature of Ingarden’s ethical thought, in which there is no room for blind obedience to norms or principles. That is why, in order to properly understand Roman Ingarden’s ethics, it is so important to define what constitutes the source of moral duty and the oughtness to act. -/- Po polsku: Celem artykułu jest analiza podstawowych założeń etyki Romana Ingardena. Jego poglądy omawiane są z perspektywy pytań o źródło moralnej powinności. Dlatego też główne analizy skupiają się na relacji między wartościami moralnymi a powinnością potrzebną do ich realizacji. Stanowisko Ingardena zostaje umieszczone w szerszym kontekście etycznym. Istotne jest pytanie, czy tkwi ono w idei danej wartości, czy w doświadczeniu danej wartości w przeszłości. Odpowiedź na to pytanie ujawnia specyfikę myśli etycznej Ingardena, w której nie ma miejsca na ślepe posłuszeństwo wobec norm czy zasad. Dlatego dla dobrego zrozumienia etyki Romana Ingardena tak ważna jest odpowiedź na pytanie, co stanowi źródło powinności moralnej i powinności działania. (shrink)

Ngài tăng cường tìm hiểu, mà phải tin tức khoa học nghiêm chỉnh nhé. Một đội tinh nhuệ, thạo tin, gồm Cò, Chim Sâu, Chim Sẻ, Chào Mào, v.v.., được lập ra để báo cáo tình hình nguy cấp.

Hội thảo nhằm thiết lập mạng lưới các nhà nghiên cứu toán ứng dụng trong lĩnh vực khoa học xã hội và các chuyên gia có kinh nghiệm trong việc sử dụng công cụ toán trong nghiên cứu và giảng dạy. Nằm trong chuỗi hoạt động Hội thảo là tọa đàm và các bài giảng về các ứng dụng của Toán học trong lĩnh vực khoa học xã hội.

The pandemic of COVID-19 prompted several paradigm shifts throughout society, including in education. This study aimed to examine the relationships of students' engagement in online synchronous collaborative learning activities (OSCLA) with their self-efficacy (LSE), peer social support (LPSS), state of well-being (SWB), and level of academic performance (LAP). A total of 176 Filipino Grade 12 SHS students, 18 years old and older, from a private educational institution were purposively selected for this study. Data were generated using an online survey. Results (...) show that collaborative learning activities are frequently conducted (median = 4) in their synchronous online classes. It also revealed that their LSE is high (median = 4), their LPSS is high (median = 4), their LE is moderate (median = 3), their SWB is high (median = 4), and their LAP is high (median = 94.85). The results showed a statistically significant correlation of their LSE (r = 0.69, p 0.001) and LPSS with their OSCLA LE (r = 0.438, p 0.001). A statistically significant positive moderate correlation between LE and SWB (r = 0.536, p 0.001) was also found, however, no correlation was found between their OSCLA LE and LAP (r = 0.065, p = 0.393). Thus, the use of a well-designed OSCLA is strongly recommended as it positively impacts students' SWB but should be regularly reviewed for its effectiveness in sustaining improvement in the LAP of the students. KG, Alemania, 2012- about the meaning of the boundary situations in the philosophy of Karl Jaspers, as a turning point regarding Husserl's phenomenology and Kant's transcendental philosophy. For Jaspers, the meaning of the boundary situations as a structure (...) of Existenz underlines the possibility of risk in the individual historicity, which breaks the "flow" of the reflection and, at the same time, appeals to an opening of ethics -without sacrificing the universality of the categorical imperative. Các trường đại học nghiên cứu thường là nơi nảy sinh các tư tưởng, hệ tiên đề, từ đó thiết lập những nền móng căn bản của các ngành khoa học. Chính vì vậy, các trường đại học nghiên cứu có vai trò (...) nòng cốt trong hệ thống giáo dục đại học của mỗi quốc gia. Mục tiêu bài viết nhằm đề xuất một số kiến nghị để xây dựng nhóm nghiên cứu mạnh trong điều kiện tương thích của từng trường, góp phần đạt được mục tiêu và nâng cao chất lượng đào tạo, nghiên cứu của khối ngành khoa học xã hội. Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

Książka dotyczy trzech powiązanych z sobą zagadnień: internalizmu racji działania, internalizmu motywacyjnego i tzw. hume’owskiej teorii motywacji. Próbuje odpowiedzieć m.in. na następujące pytania: Czy wolno nam stwierdzić, że ktoś powinien coś zrobić, nawet gdy nie może być motywowany do tego działania? Czy można szczerze akceptować jakiś osąd moralny i nie być motywowanym do postępowania zgodnie z jego zaleceniami? Czy normy moralne służą tak naprawdę realizacji egoistycznych pragnień, czy może są fikcją wpajaną przez instytucje społeczne? Autor pokazuje, jak wiele współcześnie dyskutowanych (...) problemów metaetycznych można rozwiązać, sięgając do filozofii Davida Hume’a. Choć koncentruje się na najnowszych dyskusjach z dziedziny metaetyki, to zagadnienia omawiane w książce stanowią kontynuację klasycznych debat filozoficznych na temat takich pojęć jak wartość, dobro, obowiązek, racjonalność, relatywizm czy słabość woli. V dějinách filozofie se objevilo nespočetné množství snah překonat kognitivní nedostatečnost člověka. Většinový názor zněl, že zatímco vnější smyslové poznání podléhá nejrůznějším klamům, poznání vnitřní je mnohem jistější, či dokonce neomylné. Předpokládaná znalost sebe sama je ovšem iluzorní a stala se důvodem pro vznik mnoha chybných přístupů ke skutečnosti. Kniha se skládá ze tří částí. První kapitola se zabývá introspekcí, především jejím přijetím v dějinách filozofie a odmítnutím v psychologickém behaviorismu 20. století. Druhá kapitola pojednává o iluzornosti svobody rozhodování, která (...) je způsobena řadou nevědomých mechanismů, o jejichž fungování máme zatím jen dosti matnou představu. Ve třetí kapitole jsou domýšleny důsledky kauzálního determinismu pro etiku a právo, především ve smyslu odmítnutí koncepcí morální odpovědnosti a retributivní spravedlnosti. Autor se tak pokouší dokázat, že podstatná část názorů zdravého rozumu je chybná a měla by být nahrazena sadou nových, kompatibilních s dnešní vědou. (shrink)

Opracowanie dotyczy relacji konstytucyjnego pojęcia „dobro wspólne” z art. 1 Konstytucji RP, do pozaprawnych pojęć dobra wspólnego. Bezpośredni asumpt do jego przygotowania dało zdanie odrębne sędziego Trybunału Konstytucyjnego Zbigniewa Cieślaka do wyroku TK z dnia 20 kwietnia 2011 r. w sprawie Kp 7/09, dotyczącej zmian w prawie budowlanym. Jest to w ogóle najobszerniejsza wypowiedź w całym dotychczasowym orzecznictwie TK poświęcona wprost problematyce dobra wspólnego. Sędzia Z. Cieślak wyraźnie odróżnił prawne pojęcie dobra wspólnego – jego zdaniem właściwe dla interpretacji klauzuli dobra (...) wspólnego z art. 1 Konstytucji RP z 1997 r. – od pojęć pozaprawnych, uznając te ostatnie za źródło nieporozumień w prawniczych dyskusjach na temat rozumienia wyrażenia „dobro wspólne” w prawie i jako kategorii konstytucyjnej. Argumentować będę, że zrekonstruowane przez Z. Cieślaka prawne pojęcie dobra wspólnego nie nadaje się do interpretacji klauzuli dobra wspólnego z art. 1 konstytucji z 1997 r., i że pojęcia pozaprawne powinny być postrzegane nie jako źródło nieporozumień, ale jako nieodzowna pomoc w ustalaniu treści konstytucyjnego pojęcia dobra wspólnego. Problematyka ta prowadzi do podjęcia pewnego – kluczowego dla stosowania art. 1 – zagadnienia relacji między dobrem wspólnym a prawami człowieka (wolnościami i prawami człowieka), zagadnienia, które ostro zarysowało się w orzecznictwie trybunalskim po raz pierwszy właśnie w tym zdaniu odrębnym. Chodzi mianowicie o związki zachodzące między dwoma zasadniczymi tradycjami pojmowania dobra wspólnego i odpowiadającymi tym tradycjom dwoma typami pojęć dobra wspólnego – tradycji klasycznej, znajdującej swój wyraz w Konstytucji 3 maja z 1791 r., i tradycji, w której dobro wspólne pojmowane jest przede wszystkim jako dobro państwa i która znalazła wyraz w konstytucji kwietniowej z 1935 r. Dla pierwszej tradycji charakterystyczne jest uznanie praw człowieka za zasadniczy element dobra wspólnego – i tę tezę Z. Cieślak akceptuje. Analiza jego propozycji pokazuje jednak, że należy ona do tradycji konstytucji kwietniowej, a przyjęcie pojęcia dobra wspólnego należącego do tej tradycji prowadziłoby do niespójności z niektórymi fundamentalnymi rozstrzygnięciami ustrojodawcy, dotyczącymi tak interpretacji art. 1 konstytucji i przyjętej w nim koncepcji dobra wspólnego, jak i konstytucyjnej koncepcji wolności i praw człowieka. Idee ontologii formalnej zawdzieczamy filozofowi Edmundowi Husserlowi, który w Badaniach logicznych dokonał rozróznienia na logike formalna i formalna ontologie. Przedmiotem pierwszej sa wzajemne zwiazki pomiedzy prawdami (lub znaczeniami zdan w ogólnosci) relacje wynikania, niesprzecznosc, dowód i obowiazywalnosc. Przedmiotem drugiej sa natomiast wzajemne zwiazki pomiedzy rzeczami przedmiotami i własnosciami, czesciami i całosciami, relacjami i kolektywami. Tak jak logika formalna zajmuje sie własnosciami wynikania, które sa formalne w tym sensie, ze stosuja sie do poszczególnych przypadków wynikania jedynie ze wzgledu na ich forme, (...) tak ontologia formalna zajmuje sie własnosciami przedmiotów, które sa formalne w tym sensie, ze ich przykładami, co do zasady, moga byc przedmioty wszystkich materialnych sfer czy dziedzin rzeczywistosci. Idea powszechności legła u samych podstaw współczesnej ochrony praw człowieka i nadal jest często podkreślana w dyskursie typu praktycznego, na różnych płaszczyznach: politycznej, moralnej czy religijnej. Jednakże trudno o koncepcję praw człowieka pozwalającą pogodzić powszechność z właściwościami prawa, z postulatami respektu dla pluralizmu ugruntowanego tak w odmienności kulturowej, jak i wolności poszczególnych jednostek ludzkich. Wziąwszy pod uwagę, że powszechność jest fundamentalnym przy¬miotem praw człowieka, kłopoty z powszechnością są kłopotami ze zbudowaniem filozoficznej koncepcji praw człowieka w ogóle. Odrzucenie powszechności jest równoznaczne (...) z odrzuceniem podstaw współczesnej koncepcji tych praw. Opracowanie zmierza do identyfikacji rozmaitych aspektów powszechności praw człowieka i do uporządkowania argumentów przytaczanych w dyskusji nad powszechnością. (shrink)

Celem artykułu jest porównanie szczególnej odmiany teorii spiskowych, tzw. globalnej teorii spiskowej do sławnego eksperymentu myślowego autorstwa H. Putnama o mózgach w naczyniu. Uznanie istnienia złowrogiego spisku światowego stawia wierzącą weń osobę w podobnej sytuacji do tej, w której znajduje się człowiek próbujący rozstrzygnąć, czy jest mózgiem w naczyniu. Dzieje się tak, ponieważ conspiratio maligna ma niczym nieograniczoną moc wywierania wpływu, kontrolowania, a nawet tworzenia dowolnych aspektów naszego społecznego, politycznego i ekonomicznego życia. Wszechmoc tej tajemniczej organizacji jest powodem, dla którego (...) jej ofiary nie mogą nikomu ufać, ani rządowi, ani naukowcom, a nawet innym wyznawcom teorii spiskowych. Wszystkich – ludzi i instytucje – podejrzewa się o to, że są przekupieni, kontrolowani lub zastraszeni przez spisek. Zachować sceptycyzm wobec wszystkiego, to jedyne wyjście z tej sytuacji. (shrink)

Pseudovědecké teorie jsou uzavřeny vůči možnosti vyvrácení, ale s konspiračními teoriemi to tak jednoduché není, protože mnohé zprávy o konspiracích jsou pravdivé. Přijetí jedné konspirační teorie nicméně může vést k přijetí jiné, která je s ní v přímém protikladu. Co nás žene do pasti konspiračního myšlení?

Tato studie se zabývá zobrazováním alchymie v malbách, knižních ilustracích i v architektuře v období raného novověku. Na jednotlivých příkladech obrazů či ilustrací prezentuje různé aspekty alchymistova života i jeho práce. Nezabývá se symbolickou alchymickou ikonografií, ale zaměří se především na zobrazování prostředí a vybavení alchymických dílen i osobností samotných alchymistů. Soustředí se zejména na vyobrazení zařízení alchymických laboratorií, s nimiž se lze setkat jak u renesančních malířů, tak v ilustracích alchymických rukopisů a poměrně ojediněle i v české architektuře. Poskytuje (...) také pohled na vyobrazení vzniklá v souvislosti s literární kritikou alchymie. Alchymisté byli zejména v dílech předních evropských humanistů často záměrně zesměšňováni, kritizováni a označováni za blázny a zloděje. V závěru se zabývá vybranými příklady ze žánrového umění, kde byli rovněž alchymisté zobrazováni často satiricky, ale i s určitou úctou, jako vzdělaní učenci. Výtvarné umění raného novověku nám představuje různé aspekty života alchymistů a je v dnešní době jednou z možností, jak se přiblížit porozumění jejich vědeckým aktivitám. Jak však studie ukazuje, k těmto obrazovým materiálům je třeba přistupovat kriticky. (shrink)

The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, and (...) also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W sprawie tej skarżąca zarzucała, że okazywanie znaku krzyża w klasach włoskich szkół państwowych, do których uczęszczały jej dzieci, jest sprzeczne z zasadą sekularyzmu, zgodnie z którą chciała ona wychować swoje dzieci i dlatego stanowi naruszenie jej prawa do wychowania i nauczania zgodnego z jej religijnymi i filozoficznymi (moralnymi) przekonaniami, oraz stanowi naruszenie wolności religijnej, gwarantowanej art. 9 Konwencji. W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych.
