This thesis, which is based on six peer-reviewed publications, is a theoretical and qualitative treatment of the ways in which social and contextual factors serve as a resource for understanding the particularities of ‘cybercrime’ that emanates from Nigeria. The thesis illuminates how closer attention to Nigerian society aids the understanding of Nigerian cybercriminals (known as Yahoo Boys), their actions and what constitutes ‘cybercrime’ in a Nigerian context. ‘Cybercrime’ is used in everyday parlance as a simple acronym for all (...) forms of crimes on the internet, whereas ‘cybercrime’ in a Nigerian context is rooted in socioeconomics and determined by it. In particular, the defrauding of victims for monetary benefit is the most significant theme that emerged from the analysis of Yahoo Boys. While all six publications are situated at the intersections of multiple fields of study, they all share a common endorsement of the constructionist/interpretivist position. The six published works comprise: [a] three conceptual publications; and [b] three empirical publications. The conceptual publications deconstruct the meanings of multiple taken-for-granted concepts in cybercrime scholarship and develop more robust conceptual lenses, namely: (1) ‘Digital Spiritualization’; (2) ‘The Tripartite Cybercrime Framework – TCF’; and (3) ‘The Synergy between Feminist Criminology and the TCF’. These new conceptual lenses represent the candidate’s contribution to developing theory in the field. Alongside this, the empirical section includes three sets of qualitative data, which include: (1) interviews with seventeen Nigerian parents; (2) lyrics from eighteen Nigerian musicians; and (3) interviews with forty Nigerian law enforcement officers. These diverse sources of qualitative data provide a more fully-developed understanding of ‘cybercrime’ in the Nigerian context (and elsewhere). All six-published works, while individually contributing to knowledge, collectively shed clearer light on the centrality of cultural context in the explanation of ‘cybercrime’. (shrink)

Abstract According to Habermas' colonization thesis, reification is a social pathology that arises when the communicative infrastructure of the lifeworld is 'colonized' by money and power. In this paper I argue that, thirty years after the publication of the Theory of Communicative Action, this thesis remains compelling. However, while Habermas offers a functionalist explanation of reification, his normative criticism of it remains largely implicit: he never explains what is wrong with reification from the perspective of the people (...) whose social relations are reified. As a result, Habermas cannot explain why only some forms of colonization lead to reification effects. In particular, he suggests that reification effects result from the juridification of communicatively structured domains of action but not from the commodification of labour power. I criticize this argument and suggest that if the normative dimension of the colonization thesis is made explicit, a more nuanced explanation of reification becomes possible. (shrink)

This thesis discusses how societies should allocate clinical care resources. The first aim of the thesis is to defend the idea that clinical care resource allocation is a matter for deliberative democratic procedures. I argue that deliberative democracy is justified because of its ability to implement equal respect and autonomy. Furthermore, I address several in-principle objections to the project of applying deliberative democracy to clinical care resource allocation. Most notably, I respond to the narrow view of the scope (...) of deliberative democracy and the critiques of explicit rationing. -/- The second aim of the thesis is to determine what is required by deliberative democracy in clinical care resource allocation. I identify the general requirements that resource allocation agencies should meet, namely public reason, public involvement, transparency, accuracy and revisability. I then examine what is required by deliberative democracy with regard to two particularly salient specific topics, namely the substantive values that should govern resource allocation and the involvement of scientific experts in decision-making. -/- I demonstrate that public reason imposes severe constraints on the substantive values that should be employed. Most of these constraints are rooted in the idea that, under a regime of scarcity, public reason requires that resources be allocated so as to minimise the strongest complaint anyone may have. Out of the variety of values that are commonly proposed as relevant, only priority to the worst-off, ability to benefit, specialness of clinical care and cost are consistent with public reason. Turning to expert involvement, I argue that deliberative democracy can overcome several formidable threats, such as the opacity of expert opinions to laypersons and the tendency to hide uncertainty and disagreement from the public. I also discuss how my proposals on substantive values and expert involvement could be implemented, in order to add to the plausibility of my theory. (shrink)

An embedded ideology of the religious-secular binary in its various forms has assumed currency in recent continental and Anglo-American political thought. This ideology highlights the difference between religion under modernization, broadly defined by the secularization thesis, and that of religious revival in a period characterized by postsecularism. It reflects the rise of new epistemologies and the dissolution of the antinomies between faith and reason characteristic of a postsecular culture. A common argument found in these writings is that enlightenment secularization, (...) which relegates the sacred to a private sphere, seems to have discovered its own parochialism as religion continues to provide…. Probably the leading exponent of W’s ideas on the language games of inner and outer (the ‘Two Selves’ operation of our personality or intentionality or EP etc. ) the prolific Daniel Hutto’s (DH) approach is called ‘Radical Enactivism’ and is well explained in numerous recent books and papers. It is a development of or version of the Embodied Mind ideas now current and, cleansed of its jargon, it is a straightforward extension of W’s 2nd and 3rd period writings (though Hutto (...) seems only intermittently aware of this). -/- The basic idea of the Embodied Mind or Enactivism is that much of behavior is automated and does not involve representations (basically S2 dispositions-see Hutto’s lovely dissection of the ‘representation rats nest’ in his online papers ). To me this is just another way of stating the fact that System 1 precedes the operation of System 2 which is a standard feature of contemporary psychology, which I have explained above and in further detail in my reviews of Wittgenstein (who was the first to see this and explored it in great detail) and Searle (who called it The Phenomenological Illusion in his superb essay of this name in his book Philosophy in a New Century which I have also reviewed). Since these are basic incontrovertible facts of animal behavior and I have already discussed them I won’t dwell on it here. -/- This book is a sustained argument against other similar ways of describing behavior which he calls CEC and CIC in favor of REC (Radical Embodied Cognition), which he characterizes as “the strongest reading of the embodiment thesis—one that uncompromisingly maintains that basic cognition is literally constituted by, and to be understood in terms of concrete patterns of environmental situated organismic activity, nothing more or less” (p11). This is clear as a bell if you understand the two systems view explained above but likely opaque if you don’t. Much clearer is Fodor’s characterization which he quotes as “abilities are prior to theories”, that “competence is prior to content” and that “knowing how is the paradigm cognitive state and it is prior to knowing that” (p10). That is, the unconscious automatisms of S1 are evolutionarily and behaviorally prior to the slow conscious dispositions of S2. -/- This is classic Hutto high level philosophical dialog, which is quite elegant, but somewhat too dense and a tad pretentious for the rest of us. I have not before encountered his coauthor Myin so can’t say how much of this text is really due to him. It is clear from this and the rest of Hutto’s work that (like everyone else) he has not quite kept up with the latest work in psychology nor really grasped the full power of W or S, even though he is one of the top Wittgensteinians alive and as bright as anyone in the field. His discussions of the language games of “information” and “representation” in his other papers and books (and much else including his deconstructions of Dennett and Fodor) should be required reading for anyone interested in behavior. So, I have the greatest respect for him, but one hopes that he will mellow with time and write descriptions of behavior (i.e., all we can really do as philosophers according to W) in more mundane prose such as this lovely summation on p15. “Hence, REC is nothing less than a fundamental rethinking of the very foundations of standard approaches to cognitive science and philosophy of mind.” Yes and what a pity that this great Wittgensteinian (and everyone else) does not realize that W laid it all out with great (and unmatched) clarity in his third period works over 60 years ago. -/- I have much less sympathy for the extended and scaffolded minds of Chap 7. I don’t see how one can lay the burden of explaining how the mind works at Searle’s door, nor how the convoluted prose about “decoupled contentful activities” etc helps at all. Why not just say that automated unconscious prelinguistic S1 feeds deliberate, conscious linguistic S2, which is axiomatically extended by public language into the myriad wonders of S3 culture? Beginning and end of story. -/- Their last chapter is about “regaining consciousness,” but I would say that if one has understood Wittgenstein and Searle, one has never lost it. And, though this is an excellent book by two of the brightest and the best, I suggest mulling over my thoughts in this and other reviews and reading Johnston and the latest from Searle, along of course with as much of 3rd period W as feasible, is an even better filter for folly. The aim of the article is to develop precise epistemic rules for good public political arguments, by which political measures in the broad sense are justified. By means of a theory of deliberative democracy, it is substantiated that the justification of a political measure consists in showing argumentatively that this measure most promotes the common good or is morally optimal. It is then discussed which argumentation-theoretical approaches are suitable for providing epistemically sound rules for arguments for such theses and for (...) the associated premises, rules whose compliance implies the truth or acceptability of the thesis. Finally, on the basis of the most suitable approach, namely the epistemological one, such systems of rules for the required types of arguments are presented that fulfil the conditions mentioned. Over the past decades, the idea that national sovereignty and the authority of the state have been increasingly challenged or even substantially eroded has been a dominant one. Economic globalization advancing a neo-liberal dis-embedding of the economy is seen as the major reason for this erosion. Concerns have increased about the negative consequences for the social fabric of societies, deprived of the strong shock absorption capacity that the welfare states had established in the time of the embedded liberalism to use (...) a term John Ruggie coined. The concerns have also helped nationalistic movements to gain power in many high-income countries, not at least in the United States, calling for putting their economy first. Accordingly, a number of commentators have announced a return of the nation state. In this special issue, we will show that the retreat-of-the-state thesis as well as the return-of-the-state thesis shares the same shortcomings. They conflate state and authority. As a consequence, both theses underestimate important transformations of authority that have taken place since the end of the “short 20TH century,” to use Eric Hobsbawm's periodization. With this special issue, we seek to contribute to a more nuanced analysis of the transformation of authority. The issue is the outcome of a conference that took place at the Copenhagen Business School in 2015, hosted by the research project ‘Institutional Transformation in European Political Economy: A Socio-Legal Approach’ and funded by the European Research Council. (2) Then, we will proceed to presenting three Epistemic Temporal logical frameworks creat‑ ed by Hoshi (2009) : TPAL (Temporal Public Announcement Logic), TAPAL (Temporal Arbitrary Public Announcement Logic) and TPAL+P ! (Temporal Public Announcement Logic with Labeled Past Operators). We will show how Hoshi stated the Verificationist Thesis in the language of TAPAL and analyze his argument on why (...) this version of it is immune from paradox. (3) Edgington (1985) offered an interpretation of the Verificationist Thesis that blocks Fitch’s paradox and we will propose a way to formulate it in a TAPAL‑based lan‑ guage. The language we will use is a combination of TAPAL and TPAL+P ! with an Indefinite (Unlabeled) Past Operator (TAPAL+P !+P). Using indexed satisfi‑ ability relations (as introduced in (Wang 2010 ; 2011)) we will offer a prospec ‑ tive semantics for this language. We will investigate whether the tentative re‑ formulation of Edgington’s Verificationist Thesis in TAPAL+P !+P is free from paradox and adequate to Edgington’s ideas on how „all truths are knowable“ should be interpreted. Excerpt (in lieu of abstract) My aim in this paper is to put the spotlight on the following questions: how do lay Christians understand the relation between science and religion, and what can this tell us about the relationship between science and Christianity in a more academic setting? My focus will be on lay Christians in the US, in particular White Evangelicals. I will argue that American lay Christians, as well as American laypeople more generally, view the relationship between science (...) and religion as one of conflict. By contrast, conflict is a minority view in the academic literature on science and religion, where most authors defend a harmonious relationship (such as independence, dialogue, and integration). This disconnect between the academic literature and public perception should lead us to reflect on the social role of the science and religion debate. (shrink)

The central thesis of this article is that populism is a side effect of liberal democracy and a reliable indicator of the relationship between liberal democracy and its polar opposite ‒ illiberal majoritarianism. As long as liberal democracy prevails over illiberal majoritarianism, populism remains dormant. Populism rises and becomes conspicuous only if certain manifestations of illiberal majoritarianism or illiberal elitism reach a critical point in terms of number and impact. More exactly, populism becomes active when there are too few (...) reasonable and effective responses to the growth of illiberal majoritarianism. Illustrating the defense mechanism of compensation, the rise of populism correlates with a cluster of exaggerated or overdone reactions to actions inspired by illiberal majoritarianism. These reactions vary sharply from one society to another according to (a) the specific challenges of illiberal majoritarianism, (b) the reactivity of people who bear the liberal democratic values, and (c) the credibility enjoyed by the mainstream liberal democratic forces in that society. In brief, although illiberal majoritarianism sets off a cluster of populist reactions in any society, the rise of populism always takes distinct forms. Thus, it is confirmed the status of populism as a chameleonistic phenomenon. The argumentative thread has four main parts. Firstly, it is developed a constitutive model of liberal democracy as an ideal political system that is underpinned by the following organizing principles or attractors: inclusiveness, political equality, political participation, predominance of concurrent majority, the containment and predictability of the government power, and the enforcement of the non-aggression principle. Secondly, the attractors of liberal democracy are contrasted against the recent state of affairs in the Euro-Atlantic space to illustrate the assertion presented here that today illiberal majoritarianism tends to prevail over liberal democracy. In the third step, it is argued that the countless definitions of populism only emphasize different symptoms of the rise of populism, depending on the particular circumstances in which society evolves. Finally, it is substantiated the claim that populism and populists can and should be integrated into the democratic political system, in particular into the democratic public sphere. (shrink)

This paper argues that practical reasons are essentially “public” in the following sense: If R is a reason for X to Φ, then R is also a reason for other people not to interfere with X’s Φ-ing. The paper derives the Publicity Thesis from an independently motivated non-cognitivist account of normative judgment that covers both should-judgments and judgments about reasons. This account “explains” the publicity thesis in the sense if the non-cognitivist view is correct, anyone who judges that (...) R is a reason for X to Φ is thereby committed to regarding R as a reason for others not to interfere. Hence practical reasons must be regarded as public by anyone who thinks about them, and so are essentially public, though in a sense somewhat different from Korsgaard’s (1996) or Nagel’s (1970). -/- . The urgent need to address climate change poses a range of complex moral and practical concerns, not least because rising to the challenge will require cooperation among countries that differ greatly in their wealth, the extent of their contributions to the problem, and their vulnerability to environmental and economic shocks. This thesis by publication in the field of climate ethics aims to characterise a range of national responsibilities associated with acting on climate change (Part I), and to identify (...) proposals for fulfilling those responsibilities through fair and feasible institutional arrangements (Part II). I aim not only to address substantive gaps in scholarly understanding of those responsibilities, but also to strengthen the ability of climate ethics to engage meaningfully with climate policy. Chapter 2 addresses the question of whether wealthy countries owe a “climate debt” to poor countries. It finds that even if climate debt (suitably interpreted) may provide a coherent and morally plausible concept, its political value as a discursive frame that can provide a basis for cooperation is limited. Chapter 3 investigates the role that equity may play in negotiations on a long-term climate change agreement. It argues that developed and developing countries may reach a “principled bargain” if both converge on a way of differentiating their responsibilities that places less emphasis on a rigid dichotomy between the two groups and more emphasis on objective criteria relating to their contribution to the problem and capacity to address it. Chapter 4 explores a question largely overlooked in climate ethics, namely whether wealthy countries owe compensation to those who are adversely affected by the climate policies which they enact. I find that enacting countries have responsibilities to compensate both domestic and foreign citizens who would suffer disproportionate losses from the effects of policies. Chapter 5 assesses whether wealthy countries may legitimately adopt unilateral (or “fragmented”) rather than multilaterally coordinated approaches to raising climate finance for developing countries. It finds that coordinated target-setting, effort sharing and oversight arrangements are essential, but that a mix of unilateral and coordinated approaches to raising funds will be necessary for securing legitimacy. In Chapter 6, through addressing the broader question of what should count as official aid, I consider whether wealthy countries may draw on aid budgets to support developing countries’ efforts to address climate change. I find that the current definition of official aid should be retained but supplemented by specified exclusions from eligibility in order to preserve the aid regime’s integrity. Nevertheless, some climate finance may justifiably be counted as aid provided that concerns relating to the diversion of aid funding are addressed. In addressing these research questions, the thesis seeks not only to make original theoretical contributions to climate ethics but also to strengthen broader scholarly understanding of the ways in which ethics and international public policy may inform one another, particularly by highlighting the role of framing considerations (Chapter 2), feasibility considerations (Chapter 3), and the ways in which principles of fairness and legitimacy map onto institutional functions (Chapters 4, 5 and 6). The limited access to public secondary education in rural regions of Haiti has impacted children who want to pursue their education beyond the primary level. This generic qualitative study aimed to explore the perceptions of informed Haitian educators and other educators who were knowledgeable about the lack of access to public secondary education in rural Haiti, specifically through the framework of polarities of democracy theory. Data were gathered by conducting semistructured interviews with 20 educators who were situated in both Haiti (...) and the United States. NVivo 14 was used to organize, code, and analyze the data. Thematic analysis revealed three themes: (a) the government prioritizes political and personal interests over rural residents’ education, (b) disparities need to be reduced between urban and rural areas, and (c) a revolution in education is needed to build more public secondary schools for rural residents. Public policy recommendations included investing in training rural individuals to create a database of academics who can meet local students’ educational demands. Positive social change can occur by enhancing governmental services, implementing strategies to revitalize the agricultural sector in rural regions, and promoting active participation of rural residents in shaping the design of public schools to ensure effective secondary education for their children. The vertiginous rise of right-wing populism, especially in its “nationalist, xenophobic and conservative form”, and some “racist, anti-Semitic, homophobic and sexist” drifts associated with this phenomenon – whether real or perceived as such – make the mainstream media play a double role. On the one hand, the mainstream media reflect the struggle for political hegemony between different vested interests; on the other hand, they engage in the fight against right-wing populism blasting both right-wing populist candidates and their voters or supporters. (...) Many mainstream journalists ask citizens to realize a “sanitary cordon”, a “wall” or a “republican front” to block far-right populism and preserve liberal democracy. Moreover, they urge people to be wary of all attempts to “dediabolize” or “normalize” some tokens of right-wing populism. The main idea of this article is that right-wing populism is more harmless than is generally believed and, if excessive, negative media coverage doesn’t baffle but feed it. Populism is essentially a latent side effect of liberal democracy. Populism rises and becomes obtrusive only if a significant part of society perceives a regime of illiberal majoritarianism instead of one of liberal democracy. Right-wing populists are chiefly frustrated “ci-devants” who feel dispossessed of their past, identity, properties, qualities, privileges or titles. Inasmuch as the causes of collective frustration are many and varied (e.g. the real or just perceived corruption of the elites, the “system”, the deep state, the relocation of jobs, immigration, national sovereignty, national identity, communitarianism, radical Islamism, the status of some traditional institutions, some chapters of official history, etc.), there will always be right-wing populists, whether they are self-declared or covert. By adopting David G. Hackett’s thesis that the media are “agents of hegemony”, we applied the critical analysis of discourse to a set of 346 media articles in order to reveal the discursive sources of power, domination, inequality and partiality. The articles appeared in The New York Times and Le Monde during the period 2016-2017, at the time when the presidential elections took place in the United States and France. The articles were selected according to the occurrence of the keywords “Donald Trump” – “populism” and “Marine Le Pen” – “populisme” within the titles. The analysis of these articles reveals a divisive discursive structure that correspond to a real political cleavage in society. It is true that populism presents a “Manichean outlook”, in which there are only friends and foes” and no compromise is possible. It is also true that mainstream media reinforce this Manichean perspective on society and make populists feel marginalized and politically disempowered. The mainstream media may appease right-wing populism if they treat its followers as legitimate and equal political actors. For this, they have to give up the narrative structures that underscore insurmountable divergences and irreconcilable interests. In a liberal democracy, mass media should chiefly play the role of mediator. They may not aim to defeat or re-educate certain categories of citizens just because they advocate “wrong” political solutions. (shrink)

A number of widely discussed court decisions on cases of insults against religious feelings in Russia, such as the relatively recent “Pokemon Go” case of blogger Ruslan Sokolovsky or the lawsuit filed against an Orthodox priest by Nikolai Ryabchevsky in Yekaterinburg for comparing Lenin with Hitler, make pertinent the question of why toleration becomes so difficult in matters concerning religion. In this paper, I revise the classical liberal concept of toleration (David Heyd, Peter Nicholson, and John Horton), arguing that it (...) is challenged by contemporary philosophers, who see no room for applying this concept in the “domain of identities”. The most prominent case of “primordial” identity, that is, the notion of identity as a given, is the claim of devoted believers for recognition. Should we replace the principle of toleration by the principle of recognition since the latter better corresponds to identity claims? To address this question, in the first part of the article I describe the mechanism of tolerant attitude (Nicholson, Heyd) and in the second part, I analyze the debates about the possibility or impossibility of inner religious toleration (Avishai Margalit, Cary Nederman, and Maxim Khomyakov) and further compare toleration and recognition as normative principles. In the light of the debates I took part in the conference hosted by the University of Southern Denmark in October 2019 as part of the project “Religious Majority/Minority in Public Space in Russia and Northern Europe: Historical-Cultural Analysis”, I come to the conclusion that the principle of toleration is preferable to the principle of recognition because the “second-order” arguments for toleration in a secular state will be universally acceptable (pragmatic argument) and, therefore, the principle of toleration is more logical (analytical argument). Following Peter John’s thesis about minimal recognition embedded in toleration, it may also be concluded that we need a normatively charged idea of citizenship, which could provide us with universal “second-order” foundation. This work shows that two problems—the reference class and the mental state of the agent—undermine the plausibility of the ‘blameworthiness tracks risk thesis’ (BTRT), which states, prima facie, an agent is more blameworthy for imposing a greater rather than smaller risk. The article first outlines core concepts. It then shows how the two problems undermine BTRT; namely, (1) no blame attribution based on risk imposition is unequivocal; (2) when the materialization of risk is subject to chance, an agent’s decision (...) can ground an equal degree of blameworthiness regardless of whether the risk is greater or lesser. In recent decades, several authors have claimed that an epoch-making change in the development of science is taking place. A closer examination of this claim shows that these authors take different – and problematic – concepts of an epochal break as their points of departure. In order to facilitate an evaluation of the current development of science, I would like to propose a concept of an epochal change according to which it is not necessarily a discontinuous process that typically begins (...) in a subarea of the sciences, has far-reaching consequences for the entire system of the sciences, and can be observed by contemporaries as early as during its initial phase. Taking this concept as my point of departure, I discuss various candidates for the status of an epochal transformation in the recent development of the sciences. Although there are sound reasons to doubt that an epochal break is currently taking place, one must concede that the sciences are probably in a profound transformation, which could unfold in various directions, perhaps even leading to epoch-making new characterizations of the sciences. Over the past decades, the idea that national sovereignty and the authority of the state have been increasingly challenged or even substantially eroded has been a dominant one. Economic globalization advancing a neo-liberal dis-embedding of the economy is seen as the major reason for this erosion. Concerns have increased about the negative consequences for the social fabric of societies, deprived of the strong shock absorption capacity that the welfare states had established in the time of the embedded liberalism to use (...) a term John Ruggie coined. The concerns have also helped nationalistic movements to gain power in many high-income countries, not at least in the United States, calling for putting their economy first. Accordingly, a number of commentators have announced a return of the nation state. In this special issue, we will show that the retreat-of-the-state thesis as well as the return-of-the-state thesis shares the same shortcomings. They conflate state and authority. As a consequence, both theses underestimate important transformations of authority that have taken place since the end of the “short 20TH century,” to use Eric Hobsbawm's periodization. With this special issue, we seek to contribute to a more nuanced analysis of the transformation of authority. The issue is the outcome of a conference that took place at the Copenhagen Business School in 2015, hosted by the research project ‘Institutional Transformation in European Political Economy: A Socio-Legal Approach’ and funded by the European Research Council. This literature review explores the issues and risks in non-conscious data collection and evaluates people’s attitudes towards it. In the modern world, data is one of the most valuable resources, yet studies focused on the potential negative implications of the new data-driven technologies are lacking. Therefore, this thesis conducts a comprehensive literature review to identify and assess risks in non-conscious data collection technologies that are most relevant and referenced in current literature. Accordingly, the most prominent risks are related to (...) privacy issues with personal data, bias in algorithms creating inequality, and the difficulties in creating adequate legislation. Subsequently, the thesis will explore existing studies about people’s attitudes towards non-conscious data collection and examine the most significant socio-demographic determinants of those attitudes. Therefore, despite socio-demographic factors such as age, gender, and economic status affecting the attitudes people have towards data collection technologies, this thesis argues how these approaches can be explained by varying external factors such as prior experiences with similar technologies. The intersection between virtue and care ethics is underexplored in contemporary moral philosophy. This thesis approaches care ethics from a neo-Aristotelian virtue ethical perspective, comparing the two frameworks and drawing on recent work on care to develop a theory thereof. It is split into seven substantive chapters serving three major argumentative purposes, namely the establishment of significant intertheoretical agreement, the compilation and analysis of extant and new distinctions between the two theories, and the synthesis of care ethical insights with (...) neo-Aristotelianism to generate a virtue ethical theory of care. In the first two chapters, I outline virtue ethics and care ethics, and argue for considerable agreement over central premises. Chapter 2 summarises the foundational commitments of care ethics, focusing particularly on their relational ontology and its links to the other ethical claims care ethicists universally ascribe to, namely particularism, partialism, the moral salience of emotions, and the rejection of hard public/private distinctions. Chapter 3 lays out the central concepts in neo-Aristotelian virtue ethics, including eudaimonism, virtue, and character traits, and drawing a number of comparisons between virtue and care ethics specifically with regard to relational ontology and the meta-ethical commitments it underpins. In addition to doing the necessary expository work for the remainder of the thesis, Chapters 2 and 3 also argue that care ethics and virtue ethics have much more in common than is typically acknowledged – the first major contribution of this thesis to the literature. Chapters 2 and 3 to provide at least a prima facie justification for pursuit of the questions I confront in the remainder of the thesis. In Chapter 4, I ask what differentiates these two ethical theories. I survey some of the differences which philosophers in either camp have identified and offer some of my own. I suggest that several of those differences either rest on misunderstandings of one ethic or the other, or that in erecting a divide between virtue and care ethics they also disunify ethics of care. I do, however, identify two differences which seem defensible. Specifically, they are that virtue ethics seems to lack an account of care, which I define minimally as a response or responsiveness to need, and that virtue and care ethics organise their meta-ethical and normative concepts differently. This chapter thus presents a second contribution to the literature: a study of the differences between virtue ethics and care ethics. It also serves to set the trajectory for the remaining chapters, where I respond to the claim that virtue ethics lack an account of care. I spend the remainder of the thesis constructing what I take to be a satisfying foundation for a virtue ethical theory of care. In Chapter 5, I offer three initially viable means of incorporating care into virtue ethics, all of which treat care as a virtue. These are the analogical approach, according to which care is analogous to an existing virtue; the additive approach, according to which care is a novel virtue; and the bundling approach, according to which care is a bundle of virtues. I also offer and evaluate reasons to reject the claim that care is a virtue, concluding that the claim is indeed a viable one so long as the concept of care is sufficiently thick, and I contend that analogical approaches, and particularly analogies with charity, outperform the others. Chapter 5 therefore serves two ends. First, it proffers a novel meta-analysis of concepts of care as a virtue, and thus makes a third contribution to the literature. In doing so, it makes an inroad into the second: the development of a neo-Aristotelian theory of care. Chapter 6 continues this project. I attempt to show how care can be construed as an act-type and a practice. I argue in this chapter that practices are a subcategory of actions, and that care qualifies as an Anscombean act-type which aims at the meeting of needs relating to the care-recipient’s flourishing. I go on to consider the implications of this account for ethics which deploy care as a moral concept, maintaining that it not only offers a better account of consequences than theories of care which include success criteria, but also that it affords us interesting insights into the distinction between ‘caring about’ and ‘caring for’ which allow us to make sense of certain tenets of neo-Aristotelianism. This represents a contribution to both discourses, since neither care nor virtue ethicists working at the intersection of their respective normative theories have delved very deeply into the philosophy of action. Chapter 7 discusses caring relations, suggesting that a virtue ethical theory of caring relations can lean on the work care ethicists have done, and adding some necessary refinements, such as a distinction between ideal and non-ideal caring relations, and a theory of caring relations as reasons for action. This final chapter also draws these three concepts of care together by arguing that virtuous caregivers who are invested in the flourishing of those for whom they care are also sensitive to the relations those care-recipients bear to their institutional environment. I argue that because they are caring participants in caring relations, virtuous agents are characteristically motivated by states of need and dependency to engage in certain sorts of conventionally political practices. In other words, the virtue or virtues of caring characteristically manifest in certain sorts of political or social practices, relating specifically to those areas of moral life. This allows us to build upon recent work in feminist virtue ethics of the sort offered by Tessman and Friedman. I also offer a novel analysis of migration, suggesting that the account of care presenting here is analytically useful both when it comes to historical cases of migration such as the underground railroads and escapes from Nazi-occupied Europe, but also for contemporary issues such as the migrations occurring in the Southern United States and in much of Europe. I thus conclude not only that virtue ethicists ought to incorporate care into their normative framework, and that the theory of care presented here is a coherent one, but that this leads us naturally into applied topics such as virtue politics. I conclude the thesis by considering some its implications and by identifying some further avenues for research. (shrink)

Mourad Wahba’s Fundamentalism and Secularization was first published in Arabic in Egypt in 1995. By the 1990s, Islamist thought had become hegemonic in Egypt, and it is this cultural context that informs Wahba’s concern with philosophy of culture as applied to the question of fundamentalism and its antagonistic relationship to secularization. As Robert Beshara notes in his interview with Wahba, which serves as a foreword to this new translation, the book was ahead of its time insofar as it was published (...) before the spate of publications on fundamentalism in the aftermath of the events of September 11th 2001, and it clearly predicted the coming clash of fundamentalisms which would go on to shape the first decade of the third millennium, namely, the clash between right-wing Christian fundamentalism in the U.S. on the one hand, and expressions of Islamic fundamentalism on the other. Wahba also rejects the framing of the conflict as a conflict of civilizations. For Wahba, there is in fact strictly speaking only one human civilization and many cultures (x). Wahba defines civilization as ‘a tiered singularity, the course of which goes from mythical thinking to rational thinking’ (32). It seems here that Wahba, in attempting to undermine the thesis of the clash of civilizations, ends up reintroducing an evolutionist account of a singular human civilization, akin to those endorsed by Victorian British anthropologists of the nineteenth century. -/- The first chapter deals with fundamentalism both historically and conceptually. On the conceptual level, Wahba argues that we can understand fundamentalism as essentially driven by the human propensity for unity, which for Wahba is essentially a yearning for the Absolute (7). According to Wahba, this is how humans attempt to overcome their alienation from the world. However, the problem is that absolutes seem to multiply as a function of time, and we do not have context-independent criteria which would allow us to decide between competing claims for opposing absolutes. For Wahba, the solution is to simply give up on the search for absolutes and to endorse a kind of relativism. However, it is important to recognize that for Wahba relativism does not imply that ‘anything goes.’ Wahba thinks of relativism in negative terms, i.e. simply as the rejection of the thesis that knowledge claims can ever be of an absolute, context-independent nature. What is especially interesting is that Wahba presents himself as a proponent of the Enlightenment qua universal project. However, unlike many participants in the contemporary ‘culture wars’ of the U.S., he seems to think that commitment to the Enlightenment project with its attendant secularization entails a commitment to the rejection of absolutism in epistemology. The commitment to relativism as defined above is presented by him as a requirement of enlightened rationality and not as a product of its rejection. (shrink)

There are different ways to study feminism. One of the ways is to study it by analyzing the waves of feminism. Though there are differences of opinion on how many waves of feminism have been so far, we would like to hold on to the generally accepted view that there are four waves of feminism so far and we try to research into one of the hallmarks of the fourth wave feminism, feminist hashtag. Though some people consider hashtags momentary and (...) frenzy, it’s a platform for feminist epistemology and feminist policy making. Moreover, it assists the development of social epistemology and reconsiders the notion of objectivity. The representative slogans of the first three waves of feminism were like the precursors of hashtags and the spokeswomen of the first three waves of feminism present the necessity of space for writing. The fourth-wave feminists make use of cyberspace as a space for addressing feminist concerns through hashtags. However, we recognize certain similarities of concerns in all the waves of feminism. The analysis of two epistemological theses, i.e., situated knowledge thesis and epistemic advantage thesis on developing the theme of how hashtags assist in knowledge production. The idea of situated knowledge explains how experiences specific to oppressed members of groups can serve as the basis of the development of important insights. Hashtags could be considered as a new way of understanding the links between gender and knowledge. Feminist slogans and hashtags are also media of testimonial exchange. When the issues of differential credulity and credibility arise the tenet of situated knowing comes to the aid of the feminist thinker. Building up the climate of trust generates knowledge of the forces and dynamics of the oppressed. Trust helps to overcome identity prejudice and testimonial injustice. Feminist policies make women visible in feminist public policies. Responsible interventions into epistemic practices by public policy-making can help move society in the direction of social justice. Hashtag testimony leads to consciousness-raising and protest movements which in turn leads to the public reasoning and policy that empowers women. The reflections of Miranda Fricker are of great advantage in disclosing feminist epistemology that revolves around feminist hashtags. Her doctrines enrich the feminist hashtags with new insights and new directions. A study on the epistemological relevance of hashtag feminism enhances the development of social epistemology. It invites our attention to re-reflect on the concept of objectivity and empowers feminist movements and women. (shrink)

The main thesis of this paper is that justice is not a natural law that (re)establishes equilibrium and order in the universe, but a disposition enforced by a fighting will to render to every man his due in line with a regime of rights, powers, or immunities to use, enjoy and control some external goods. Inasmuch as there is no sense, feeling or instinct of justice, it is reasonable to assert that people regulate their conduct under the authority of (...) a legislative authority according to certain ideas of justice, which they adopt and promote through a steady effort of knowledge and will. Critical analysis of the main types of justice − associative justice, punitive justice, corrective justice, restorative justice, functional justice, normative justice, commutative justice and distributive justice − from a liberal democratic perspective highlights the formal requirements of justice in different social arrangements and in relation to various aspects of personal and social life. Because it lacks a natural foundation of justice and people have strong interests in enforcing a certain idea of justice, public debates about justice entail a clash of militant wills. Debaters engage in a struggle for political hegemony trying to exclude from the public sphere the rival ideas about justice. In other words, all substantive debates about justice are carried out in an agonistic public sphere. The more civilized and reasonable the agonistic debates about justice are, the more likely the idea of justice is to fit the vital interests of individuals and society. (shrink)

The main thesis of this article is that Western societies risk becoming Balkanized if they confront the superdiversity issue without sound management of intolerance. The Balkanization process has some essential features that allow the use of this term outside the area of origin (namely the Balkan Peninsula). Thus: It always affects a diverse political unit that comprises an inextricable medley of racial, ethnocultural, religious, ideological, or gender identities. It emerges only where neither the hegemony principle nor the confederacy principle (...) can sustain a divided population’s peaceful coexistence. It entails “antagonistic and conflict-oriented relationships resistant to resolution” between the groups or classes dissociated from a diverse political unit. It increases the density of physical and psychological boundaries between the formerly associated parts. It is perpetuated by the great sponsors of the dissociated parts. Any diverse political unit can enter a process of Balkanization, regardless of its degree of culture and civilization. Balkanization does not have a fatal course. Just as there is no society immune to Balkanization, there is no diverse society doomed to Balkanization. Balkanization can be prevented, checked, stopped, or reversed, depending on society members’ individual and collective actions. To survive, the superdiverse liberal democracies from the Euro-Atlantic area need an agonistic public sphere, where actionable truths emerge from a genuine clash of educated opinions. If intolerance management is the first step in preventing the Balkanization of a superdiverse political unit, promoting social and political tolerance towards all people who express educated opinions is the best starting point to genuine tolerance. The return to Enlightenment rationalism values that underpinned our freedom of thought and expression will help us meet the challenges inherent in current and future superdiversity. By feeding enlightened conversations and debates with genuine, educated opinions, people learn to have tolerance for “unpleasant” pieces of knowledge. Then, they spread general tolerance – as a by-product – across the entire society. (shrink)

The thesis is: the “periodic table” of “dark matter” is equivalent to the standard periodic table of the visible matter being entangled. Thus, it is to consist of all possible entangled states of the atoms of chemical elements as quantum systems. In other words, an atom of any chemical element and as a quantum system, i.e. as a wave function, should be represented as a non-orthogonal in general (i.e. entangled) subspace of the separable complex Hilbert space relevant to the (...) system to which the atom at issue is related as a true part of it. The paper follows previous publications of mine stating that “dark matter” and “dark energy” are projections of arbitrarily entangled states on the cognitive “screen” of Einstein’s “Mach’s principle” in general relativity postulating that gravitational field can be generated only by mass or energy. Since the publication of Timothy Williamson’s Knowledge and its Limits, knowledge-first epistemology has become increasingly influential within epistemology. This paper discusses the viability of the knowledge-first program. The paper has two main parts. In the first part, I briefly present knowledge-first epistemology as well as several big picture reasons for concern about this program. While this considerations are pressing, I concede, however, that they are not conclusive. To determine the viability of knowledge-first epistemology will require philosophers to carefully evaluate (...) the individual theses endorsed by knowledge-first epistemologists as well as to compare it with alternative packages of views. In the second part of the paper, I contribute to this evaluation by considering a specific thesis endorsed by many knowledge-first epistemologists – the knowledge norm of assertion. According to this norm, roughly speaking, one should assert that p only if one knows that p. I present and motivate this thesis. I then turn to a familiar concern with the norm: In many cases, it is intuitively appropriate for someone who has a strongly justified belief that p, but who doesn't know that p, to assert that p. Proponents of the knowledge norm of assertion typically explain away our judgments about such cases by arguing that the relevant assertion is improper but that the subject has an excuse and is therefore not blameworthy for making the assertion. I argue that that this response does not work. In many of the problem cases, it is not merely that the subject’s assertion is blameless. Rather, the subject positively ought to make the assertion. Appealing to an excuse cannot be used to adequately explain this fact. (Nor can we explain this fact by appealing to some other, quite different, consideration.) Finally, I conclude by briefly considering whether we should replace the knowledge norm of assertion with an alternative norm. I argue that the most plausible view is that there is no norm specifically tied to assertion. (shrink)

This thesis explores the party system and political parties in the post-communist Albania. The overarching question of the thesis is what kind of party system has developed and what is the structure and organization of the Albanian political parties. The study analyses the period 1991-2013, that is the period between the first and the last general elections. I argue and test that the Albanian party system is stable and that the Albanian political parties are mass clientelist parties with (...) deep territorial penetration. The members of the parties have ceased to paly their traditional roles of the era of mass party and their attachment tot he party is not ideological but aims to ensure material benefits in return for the support provided to the party in elections times. As parties don't have many tools at hand they use their organizational structure to stabilize electorate, which explains the low level of electoral volatility in Albania and as consequence the stability of the party system. The thesis ahs an institutional embedded and a historically structured framework according to which party strategies are shaped by both the institutional context and the historical setting in which parties are created and operate. Following this line of reasoning, the weak societal roots of parties do not allow for party identification or voter alignment; the early access to public funding reduces the incentives of parties to create strong links with the members and society to collect financial resources and; in line with the features of the patrimonial communism which is characterized by clientelism and nepotism, the Albanian political parties develop the same relationships between the higher echelons of the party and the lower strata of the party structure. On the other hand the lack of media access in the early phase of organization and the need to stabilize the electorate, encourage the Albanian political parties to seek a deep territorial penetration which results in the creation of mass clientelist parties. In order to test the hypothesis I have undertaken three steps: a) the analyses of the Effective Number of Parties and Electoral Volatility; b) the internal distribution of power, the role of the membership and the relationship of the organization with society and; c) the identification of financial resources of the political parties. In this article I examine the main conceptions of public reason in contemporary political philosophy in order to set the frame for appreciating the novelty of the pragmatist understanding of public reason as based upon the notion of consequences and upon a theory of rationality as inquiry. The approach is inspired by Dewey but is free from any concern with history of philosophy. The aim is to propose a different understanding of the nature of public reason aimed at overcoming the (...) limitations of the existing approaches. This thesis examines the key moral principles that should govern decision-making by police and military when using lethal force. To this end, it provides an ethical analysis of the following question: Under what circumstances, if any, is it morally justified for the agents of state-sanctioned security institutions to use lethal force, in particular the police and the military? Recent literature in this area suggests that modern conflicts involve new and unique features that render conventional ways of thinking about the (...) ethics of armed conflict, and the use of lethal force, as inadequate or redundant. In particular, there is an increased concern with the moral difficulties created by “non-standard” cases. This is where the police or military are obliged to operate outside their conventional contexts. In such non-standard cases, on what moral basis can (or should) state actors – especially the police and military – use lethal force? One approach argues that there is nothing morally exceptional about the use of lethal force by police or military. This says the only available moral justification for using lethal force is killing in self-defence or defence of others. In contrast, I use an institutional approach to develop a moral framework for the state’s morally exceptional use of lethal force. The institutional approach is concerned with the ends (telos) or purpose of a social institution. It says that the moral purpose of a social institution alters the moral responsibilities of its agents; what is referred to as role morality. My analysis demonstrates that there is an important moral distinction between justified killing in self-defence and state-sanctioned uses of lethal force. My claim is that police and military uses of lethal force are not morally justified in the same way as the average person’s use of lethal force (i.e. self-defence or defence of others). Instead, I argue that the state-sanctioned institutional role of police and military give these state actors special moral duties, and therefore exceptional moral justification, for using lethal force. I argue that the institutional end of the police is the preservation of public safety. This includes using lethal force where it is necessary to protect life and prevent serious injury to jurisdictional inhabitants. In contrast, a morally responsible state uses military force to defend the “common good.” That is, when it is necessary to defend the peaceful functioning of a state from armed threats or other forms of political violence. I then conclude that non-standard cases require the addition of jus ad vim (or the just use of military force short-of-war) as a hybrid element to the moral framework for the state-sanctioned use of lethal force. This provides a better way of applying ethics to the use of military force when defending the common good against serious threats in non-standard cases. This is because jus ad vim complements the conventional military paradigm by permitting the use of military capabilities to defend the common good. But, at the same time, it inhibits the move towards the more destructive levels of violence characteristic of conventional warfighting. (shrink)

This thesis argues that a particular version of equal opportunity for welfare is the best way of meeting the joint demands of three liberal egalitarian ideals: distributional equality, responsibility, and respect for individuals’ differing reasonable judgements of their own good. It also examines which social choice rules best represent these demands. Finally, it defends the view that achieving equal opportunity for welfare should not only be a goal of formal public institutions, but that just citizens should also sometimes be (...) guided by it in their everyday life. The version of equal opportunity for welfare it defends differs from some well-known contemporary versions in the following ways. First, it rejects a definition of welfare as the degree of satisfaction of a person’s preferences, because, it argues, this conception of welfare cannot adequately deal with preference change. Instead, it suggests that we should adopt a conception of welfare based on a list of goods and conditions that are recognised as valuable from the perspective of a variety of different conceptions of the good. Second, it argues that individuals’ prima facie claim to an equally valuable share of the world’s resources—a claim which is based on their equal moral worth—is limited to situations in which giving one person a more valuable share means that someone else ends up with a less valuable share. It also argues that in situations where we can improve at least one person’s situation without worsening anyone else’s, we generally do not fail to respect each person’s equal moral worth by doing so, even if this leads to inequalities. Third, it defends a distinct view of responsibility, which justifies social arrangements that give people certain options with reference to the value that individuals can achieve (but don’t necessarily achieve) through their choices from these options. Public Libraries (PLs) continue to contribute a great deal to user education in local communities. This paper analyzes the importance of PLs in driving community literacy through promotion of user education for the progressive improvement of the society. The paper stresses the relevance and value of PLs by reassessing the benefits they accrue by analyzing the impact of PLs on community and social education. As indigenous knowledge repositories, PLs play a significant role as community information service providers by driving community (...) literacy. The goal of this paper is to analyze the role played by PLs in driving community education and promoting information literacy in the society. PLs, being storehouses of knowledge, support user education by undertaking active part in community information services. The model helps in explaining and analyzing the efficiency of information search and retrieval process in PLs and how it affects user education and community literacy. The paper also discusses the relevance and value of PLs in this age of digital technology. The findings reinforce the claim that PLs are relevant even in this digital age, and they indeed support user education for the progressive improvement of the society. (shrink)

Imagine you are the CEO of a hospital [. . .]. Decisions are constantly being made in your organization about how to spend the organization's money. The amount of money available to spend is never adequate to pay for everything you wish you could spend it on, therefore you must set spending priorities. There are two questions you need to be able to answer . . . How should we set priorities in this organization? How do we know when we (...) are doing it well? When people seek to achieve good public policy, the result will tend to be good public policy. In a collective choice process, public‐spirited individual participants produce good public policy by deliberating—talking with each other, listening to each other's arguments, and being willing to learn and change their minds based on such dialogue. –Steven Kelman (1992: 181) Public policy scholars agree that those persons (or agencies) vested with the authority to establish health care priorities should elicit public input before making rationing decisions. The two most common approaches are (i) consultation and (ii) deliberation. Though deliberation has obvious advantages over consultation, it falters in the face of the objection that ordinary citizens lack the cognitive resources for the extended, rigorous inquiry required of them in undertaking the priority‐setting task. To overcome this objection, I propose that deliberative forums for health care rationing should be designed so that they imitate the natural pattern of human experience. The experience of deliberation should encompass both prolonged periods of less‐demanding cognitive activity, in which citizens passively receive information, and briefer periods of more‐demanding cognitive activity, in which they engage in active problem‐solving. In arguing for this thesis, I rely on two theoretical sources and one practical case study, in the following order: (i) John Dewey's metaphysics of experience, (ii) cognitive science research on schemas and frames, and (iii) the Health Care Council in São Paulo, Brazil. Since the publication of Clark and Chalmers' Extended Mind paper, the central claims of that paper, viz. the thesis that cognitive processes and cognitive or mental states extend beyond the brain and body, have been vigorously debated within philosophy of mind and philosophy of cognitive science. Both defenders and detractors of these claims have since marshalled an impressive battery of arguments for and against “active externalism.” However, despite the amount of philosophical energy expended, this debate remains far from (...) settled. We argue that this debate can be understood as answering two metaphysical questions. Yet prominent voices within the debate have assumed that there is a tight relationship between these two questions such that one question can be answered via the other. We defend an alternative ‘wide’ view, whereby mentality is understood as constituted by wide social and cultural factors. Our wide view entails that the two metaphysical questions are separate and should be kept distinct. This suggests that active externalism as understood by prominent voices within that debate requires dissolution, rather than solution. However, if the debate were instead understood as only focusing on the second of the two questions, then there could be a possible future for this debate. (shrink)

This thesis consists of three substantive studies about the Vietnam stock market. In particular, I study the asymmetric information, corporate governance (CG) practices, and foreign investment of publicly listed companies in Vietnam, presented in Chapters 2, 3, and 4, respectively. In Chapter 2, I investigate the effectiveness of a market surveillance system (MSS) on improving the market quality of the Vietnam stock market, as measured by liquidity and informed trading level. I find that market liquidity decreased after the introduction (...) of the MSS, and that the effect is more pronounced for small firms. Although informed trading, on average, does not change significantly after the MSS, subsample analysis indicates a significant decrease in informed trading among large and liquid firms. In Chapter 3, I investigate the relationship between firms’ CG practices and informed trading. I find a negative relationship between the two variables. Firms with better CG practices have a lower level of informed stock trading. Moreover, a natural experiment on a shock of firms’ CG practices generated by the CG policies shows that the negative relationship between CG practices and informed trading is a causal one, in which a change in the former causes a change in the latter. In another analysis around the implementation of the MSS, I find that the implementation of the surveillance system affects the relationship between the two variables, and this effect is driven by large and liquid firms. In Chapter 4, I investigate whether foreign investors in the Vietnam stock market are informed about firms’ performance. Using the residuals of foreign investor ownership as a measure of the abnormal foreign investor holding, I find that the abnormal foreign investor holding is positively correlated with firm performance in the following one year. I also find a positive correlation between abnormal foreign investor holding and the stock returns in the next three quarters. These findings indicate that foreign investors are informed about the firms up to a one-year period. (shrink)

This thesis was shaped from Action 13 of the recent Base Erosion and Profit Shifting (BEPS) project adopted by the Organisation for Economic Co-operation and Development (OECD) and G20 countries to prevent profit shifting by multinational enterprises (MNEs). In response to the BEPS Action 13, New Zealand and Vietnam have recently introduced new transfer pricing rules. As little research has been done to examine the effects of the BEPS Action 13 on the transfer pricing landscape of respective countries, the (...) main objective of this study is to understand how the New Zealand and Vietnamese governments have reacted to and adapted the BEPS Action 13 and what tax consultants and taxpayers in both countries think about the new transfer pricing regulations. This study is exploratory in nature. As such, a qualitative case study approach has been adopted using institutional theory as a theoretical framework. Semi-structured interviews were conducted with two tax officers and ten transfer pricing consultants in both countries to identify the differences and similarities, and to draw conclusions. From Gadamer's Habilitation thesis, “Plato’s dialectical ethics. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will (...) become Gadamer's philosophical hermeneutics, fully emancipated from Heideggerian tutelage. Citizens are politically autonomous insofar as they are subject to laws that are (a) justified by reasons acceptable to them and (b) authorized by them via their political institutions. An obstacle to the equal realization of political autonomy is the plurality of religious, moral, and philosophical views endorsed by citizens. Decisions regarding certain fundamental political issues (e.g., abortion) can involve citizens imposing political positions justified in terms of their respective worldviews upon others. Despite citizens’ disagreements over which worldview is correct, (...) ‘political liberalism’ claims that there is a form of political autonomy that is realizable within pluralist societies. (Political liberalism differs from ‘comprehensive liberalism’ by, inter alia, being ‘freestanding’ vis-à-vis citizens’ different worldviews.) Citizens can be politically autonomous if they enjoy equal political power and justify its exercise with ‘public reasons.’ A political liberal education would aim at ensuring that all students can become politically autonomous citizens by teaching them how to exercise their democratic rights effectively and how to engage in public reasoning. Some political and educational theorists, however, argue that teaching students how to be politically autonomous amounts to teaching them how to be ‘comprehensively’ autonomous. If this is so, then the distinction between political liberalism and comprehensive liberalism collapses, at least with respect to education. This chapter outlines the main elements of political liberalism, summarizes the main requirements of a political liberal citizenship education, and surveys three arguments in support of and against the thesis that a political liberal education amounts to an education for comprehensive autonomy. In 1995, the publication of Marleen Rozemond’s paper, Descartes’s Case for Dualism, triggered the revival of the discussion on his argument in favor of the real distinction between body and soul among the Anglo-Saxon scholars. In particular, the discussion then resumed on the necessity of introducing a hidden premise (the so-called attribute premise) in order to regain its probatory character. This debate has reflected on the Cartesian studies in Brazil, and my objective in this text is to bring to (...) the debate two texts still unexplored in relation to this interpretative problem. My hypothesis is that the attempts to justify the thesis that the substance has exactly one principal attribute have not yet succeeded because they underestimated the contribution brought about by the transformation of the notion of nature entailed by the introduction of the concept of principal attribute. Understanding the Cartesian proof of substantial dualism, and more particularly the "attribute premise", would involve, I suggest, the thesis according to which the concept of principal attribute, insofar as it expresses the essence of the substance, is not, and cannot be, according to Descartes, an abstract universal, but rather one of a particular nature. Abstract: This paper restates the thesis of 'The Requirements of Justice and Liberal Socialism" where it was argued that liberal socialism best meets Rawlsian requirements of justice. The recent responses to this paper by Jan Narveson, Jeppe von Platz, and Alan Thomas merit examination and comment. This paper shows that if Rawlsian justice is to be met, then non-personal property must be subject to public control. If just outcomes merit the public control of non-personal property and this control is (...) not utilized, then justice has been subordinated to the objectively less important institution of private property. This dissertation addresses a debate about the proper relationship between democratic theory and institutions. The debate has been waged between two rival approaches: on the one side is an aggregative and economic theory of democracy, known as constitutional economics, and on the other side is deliberative democracy. The two sides endorse starkly different positions on the issue of what makes a democracy legitimate and stable within an institutional setting. Constitutional economists model political agents in the same way that neoclassical economists (...) model economic agents, that is, as self-regarding, rational maximizers; so that evaluations of democratic legitimacy and stability depend on the extent to which the design of institutional rules and practices maximize individual utility by promoting efficient schemes of collective choice. Deliberative democrats, on the other hand, understand political agents as communicative reason-giving subjects who justify their preferences and positions on issues that jointly affect them in a process of consensus-directed discourse, or deliberation; so that evaluations of democratic legitimacy and order depend on the degree to which institutional norms and practices promote deliberation and draw upon deliberated public judgment. I argue that despite the numerous incompatibilities between constitutional economics and deliberative democracy—which amount to a 'deep divide'—an opportunity to produce a genuine synthesis of the two approaches arises inasmuch as it is possible to overcome several points of opposition in their separate research programmes. The central thesis of the dissertation is that it is possible to construct a bridge spanning the divide between constitutional economists and deliberative democrats, and that Dewey and Bentley's transactional view can facilitate this bridge-building project. Pursuant to this end, the points of opposition between the v research programmes are mediated by way of five concepts which, on balance, favor deliberative democracy and its feasible institutionalization. The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how (...) the ambiguity of the terms ‘incompatibilism’ and ‘compatibilism’ took root as the classical analytic paradigm declined and why this matters to the contemporary debate. Among other things, I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to promote uncontentiously invalid arguments, and to equivocate in ways that keep the free-will debate mired in pseudo-stalemates). I also suggest a new framework for anyone looking for relief from the confusion and deadlock created by quixotic attempts to redefine classical narratives and jargon so that they adequately describe the dialectical contours of the contemporary free-will debate. The past few years has seen a resurgence in the public interest in space flight and travel. Spurred mainly by the likes of technology billionaires like Elon Musk and Jeff Bezos, the topic poses both unique scientific as well as ethical challenges. This paper looks at the concept of generation ships, conceptual behemoth ships whose goal is to bring a group of human settlers to distant exoplanets. These ships are designed to host multiple generations of people who will be born, (...) live, and die on these ships long before it reaches its destination. This paper takes reproductive ethics as its lens to look at how genetic enhancement interventions can and should be used not only to ensure that future generations of offspring on the ships, and eventual exoplanet colonies, live a minimally good life but that their births are contingent on them living genuinely good and fulfilling lives. The paper makes the further claim that if such a thesis holds, it also does so for human enhancement on Earth. (shrink)

Organisations are computing systems. The university’s sports centre is a computing system for managing sports teams and facilities. The tenure committee is a computing system for assigning tenure status. Despite an increasing number of publications in group ontology, the computational nature of organisations has not been recognised. The present paper is the first in this debate to propose a theory of organisations as groups structured for computing. I begin by describing the current situation in group ontology and by spelling out (...) the thesis in more detail. I then present the example of a sports centre to illustrate why one might intuitively think of organisations as computing systems. To substantiate the thesis, I introduce Piccinini’s restrictive analysis of physical computation. As I show, organisations meet all criteria for being computing systems. Organisations are structured groups with the function of manipulating medium-independent vehicles according to rules. Furthermore, I argue for the modal claim that this is a necessary feature of organisations. Having sketched the computational account of organisations, I compare it to other proposals in the literature. (shrink)

"Why are there 'transsexuals' but not 'transracials'?" "Why is there an accepted way to change sex, but not to change race?" I have repeatedly heard these questions from theorists puzzled by the phenomenon of transsexuality. Feminist thinkers, in particular, often seem taken aback that in the case of category switching the possibilities appear to be so different. Behind the question is sometimes an implicit concern: Does not the (hypothetical or real) example of individual “transracialism” seem politically troubling? And, if it (...) is, does not the case of transsexuality merit equivalent critique? Or, conversely, if one accepts transsexuals as people with legitimate demands (e.g., on medical resources or single-sex spaces), then would one not also be committed to accepting the putative transracial in analogous ways? Understanding the ontological constraints and possibilities with regard to transforming one’s identity is, I suggest, a project that should accompany ethical evaluation of those transformations. Under what circumstances is it (un)ethical to leave behind a gender or racial group with which one has once been affiliated? This question is, again, especially pressing for radical thinkers who endorse the claims that race and gender taxonomies are internally hierarchical and constituted through relations of oppression, domination, and normalization. Changing one’s identity under these circumstances will surely always be linked, however tenuously, to consideration of the larger political and cultural milieu in which such changes are advantageous or disadvantageous, complicit with oppressive norms and/or resistant to them. To illuminate these larger questions, in this paper, I first provide three examples of the analogy thesis in feminist thinking about race and sex change, each of which draws ethical conclusions about individual motivation, political strategy, or public policy, premised on the assumption that race and sex change are equivalent phenomena. None of these accounts consider the genealogy of each category as significant to contemporary possibilities. I next offer a descriptive analysis that highlights different norms at play in contemporary North American understandings: Sex–gender, I argue, is essentialized as a property of the individual’s body, while race is essentialized with reference to both the body and ancestry. This analysis, I conclude, shows politically significant disanalogies between the categories, and reveals the importance of genealogical accounts of race and sex in thinking ethically about changing ourselves. The theoretical underpinnings of public international law have taken the sovereign status of the nation-state for granted since the beginning of the modern era. After centuries of evolution in legal and political thought, the state's definition as a bounded territorial unit has been strictly codified. The legal development of the nation-state was an ideological project informed by extra-legal considerations. Additionally, the ever-narrowing scope of the juridical idea of sovereignty functioned as a boundary mechanism instrumental in colonising Africa and other regions. (...) While international law claims universal liberalism today, the current system based on sovereign nation-states represents not social inclusion but fierce and dangerous exclusion. -/- The central thesis of this book is that the development of legal sovereignty was, rather than part of the modernist progress narrative, a historically contingent evolutionary regression. While other social systems such as economics and science became globalised, politics and law counterintuitively became more territorialised. It is argued that the nation-state today is not only anachronistic but is dangerously ill-equipped for facing international problems such as the climate crisis or global pandemics. Finally, it also leaves African states and many other formerly-colonised territories at a particular disadvantage by regulating their political practices into a predefined mould. (shrink)

This study determined the challenges encountered by public secondary School Heads of Pangasinan II division during the Covid-19 pandemic and the coping mechanisms used by the School Heads to manage the challenges. It used the descriptive-correlational research design. -/- This study found out that in the profile variables of the respondent-School Heads, majority are females, 51 and above years old, Master’s degree holders with 11-15 years in service. Majority of the respondents are Principal III-IV who are mostly trained in leadership (...) and management relevant to the new normal. There are moderately high level of challenges encountered by School Heads during the Covid-19 pandemic along leadership and governance, curriculum and learning, and management of resources. A high level of challenges was encountered by School Heads during the Covid-19 pandemic along accountability and continuous improvement. -/- Findings also show that the level of coping mechanisms of the School Heads to manage the challenges of the Covid-19 pandemic along production of instructional/ modular materials, training of teachers, and provision of technological tools are high. A moderately high level of coping mechanism was also found on school Heads’ management during the pandemic along production, distribution and retrieval of modules. There is a significant relationship that exists on the level of challenges encountered by the School Heads along leadership and governance, and the profile variables, sex and position. A significant relationship also exists between the level of challenges encountered along curriculum and learning and the School Heads’ highest educational attainment. Further, a significant relationship exists between the level of challenges encountered along management of resources and the profile variable, age. (shrink)

The purpose of this thesis is to make explicit the specificity of the following themes: the Bildung (formation/cultivation), education (Erziehung) and experimentation [Experimentieren – Erlebnis (experience)] in Nietzsche’s thought. As for that, it sustains that Nietzsche’s abandonment movement of the formation concept in favor of the notion of education and the subsequent substitution of education by the theme of experimentation, revealed a wide process of conceptual modification through which the author develops a radical theory of the constitution of the (...) human being. There are three distinct, although connected, moments of this process: the first one (chapters 1 and 2) in which the formation theme, not only in Nietzsche’s but in all the German tradition of the eighteenth and nineteenth centuries, is linked to discussions on the educational and formative value of art. For this reason, after presenting a contextualization of the relation between art and formation in the German tradition (chapter 1), it is presented (chapter 2) Nietzsche’s relation – the way it happens in his first important piece of writing The Birth of Tragedy – with the German aesthetic theories that reflected on the Greek culture, more specifically, on the problem of tragedy. Besides showing the influence of these theories on Nietzsche’s idea of formation, it is also shown the particularity of this idea and the elements that enabled the author to criticize the image of Greek serenity. Such critique happened due to the acknowledgement of an irretrievable split between public, art and culture in the Germany of the nineteenth century; the second one, (chapter 3), situated between his first important piece of writing, The Birth of Tragedy, and the extraordinary change of his thought, represented by the work Human, All too Human, is concerned about the problem of the authentic personality formation. In this period, the reflection on the authentic personality formation or the genius formation occurs in two distinct, although complimentary, registers: the first one, of analysis and critique of German teaching institutions, carried out in the five conferences delivered by him in the University of Basileia; and a second one, in which Nietzsche, based on his own experience with Schopenhauer, shows the dangers, the difficulties as well as the peculiarities of the formative experience to which one is submitted in the presence of a true philosopher. At last, the third moment (chapter 4), in which, based on the works produced after Human, All too human, the transformations of Nietzsche’s idea concerning the constitution of the human being are presented, characterized by the abandonment of the notion of formation, by the temporary use of the notion of education and by the choice of the experimentation notion as the most adequate to express the radicalism of the human being constitution process. The experimentation theme is presented in two registers: in the first one (in the first three items of chapter 4), based on Human, All too human; The Dawn and The Gay Science, it is shown the relation between the formation theme and the metaphysics critique based on the valorization of history, psychology and moral analysis; in the second one (in the last two items of chapter 4), it is reached the most advanced and radical formulation of Nietzsche’s thought on the theme of the human being constitution. Since the breach of the novel of self-cultivation (Bildungsroman) in Thus Spoke Zaratustra, dealing with the training and selection theme in On the Genealogy of Morality, to the establishment of figures of the overman and the sovereign individual, it is always focused an imperious obligation, which is to refer the theme of the human being constitution to the notion of experimentation that shows up under the sign of the concept of time and the solitude experience. Semantic originalism is a theory of constitutional meaning that aims to disentangle the semantic, legal, and normative strands of debates in constitutional theory about the role of original meaning in constitutional interpretation and construction. This theory affirms four theses: (1) the fixation thesis, (2) the clause meaning thesis, (3) the contribution thesis, and (4) the fidelity thesis. -/- The fixation thesis claims that the semantic content of each constitutional provision is fixed at the time the (...) provision is framed and ratified: subsequent changes in linguistic practice cannot change the semantic content of an utterance. -/- The clause meaning thesis claims that the semantic content is given by the conventional semantic meaning (or original public meaning) of the text with four modifications. The first modification is provided by the publicly available context of constitutional utterance: words and phrases that might be ambiguous in isolation can become clear in light of those circumstances of framing and ratification that could be expected to known to interpreters of the Constitution across time. The second modification is provided by the idea of the division of linguistic labor: some constitutional provisions, such as the natural born citizen clause may be terms of art, the meaning of which are fixed by the usages of experts. The third modification is provided by the idea of constitutional implicature: the constitution may mean things it does not explicitly say. The fourth modification is provided by the idea of constitutional stipulations: the constitution brings into being new terms such as House of Representatives and the meaning of these terms is stipulated by the Constitution itself. -/- The contribution thesis asserts that the semantic content of the Constitution contributes to the law: the most plausible version of the contribution thesis is modest, claiming that the semantic content of the Constitution provides rules of constitutional law, subject to various qualifications. Our constitutional practice provides strong evidence for the modest version of the contribution thesis. -/- The fidelity thesis asserts that we have good reasons to affirm fidelity to constitutional law: virtuous citizens and officials are disposed to act in accord with the Constitution; right acting citizens and officials obey the constitution in normal circumstances; constitutional conformity produces good consequences. Our public political culture affirms the great value of the rule of law. -/- We can summarize semantic originalism as a slogan: The original public meaning of the constitution is the law and for that reason it should be respected and obeyed. The slogan recapitulates each of the claims made by semantic originalism, but it is potentially misleading because it does not clearly distinguish between the semantic claims made by the fixation and clause meaning theses, the legal claim made by the contribution thesis, and the normative claim made by the fidelity thesis. -/- Part I introduces the four theses. Part II is entitled An Opinionated History of Constitutional Originalism, and it provides the context for all that follows. Part III is entitled Semantic Originalism: A Theory of Constitutional Meaning, and it lays out the case for original public meaning as the best nonnormative theory of constitutional content. Part IV is entitled The Normative Implications of Semantic Originalism, and it articulates a variety of normative arguments for originalism. Part V is entitled Conclusion: Semantic Originalism and Living Constitutionalism, and it explores the broad implications of semantic originalism for living constitutionalism and the future of constitutional theory.
