In 1924, the Munich-school phenomenologist Moritz Geiger argued that there are dynamic essences. His two examples are the tragic, and being human, his main ideas are that what it takes to be tragic varies over time historically and that what makes an organism human varies across different stages of its ontogenetic development. He hence points to two ways in which essences may be dynamic, that is, subject to change. The current paper takes Geiger’s view seriously and assumes that (...) it poses an explanatory challenge for the, then and now, standard view that essences are ‘Platonic’, i.e. cannot be subject to change. In the first part of the paper, I introduce Geiger’s view and a bit of its historical context. In the second, I first formulate the challenge it poses to the standard ‘platonic’ view of essence, then discuss how this challenge can be met by a contemporary view of essence discussing three potential responses. The first relies on a notion of relativized essence, the second on the distinction between determinables and determinates, the third and last one on multidimensional properties. Finally, I argue that the last of these three proposals may be preferable to the other two. (shrink)

This article proposes a unified solution to the mind-body problem, grounded in the philosophical framework of Ethical Empirical Rationalism. By presenting a mathematical model of the mind-body interaction, we oƯer a dynamic feedback loop that resolves the traditional dualistic separation between mind and body. At the core of our model is the concept of essence—an eternal, metaphysical truth that sustains both the mind and body. Through coupled diƯerential equations, we demonstrate how the mind and body are two expressions (...) of the same essence, interacting in a continuous and harmonious relationship. It has a long history for the exploration of the origin and essence of human consciousness with different definitions and explanations in various fields such as philosophy, medicine, sociology, biology, and psychology. However, all of them had not been recognized so far. The main reason is that the complexity of consciousness leads to the inability of various fields to understand its essence fully, reasonably, and comprehensively, and there are still significant differences for it, and which have become an (...) eternal mystery. So, it is necessary to delve deeper into it. Here we show that this article concludes that the origin of consciousness comes from natural matter, the essence of consciousness is material information, the ability of consciousness is the degree to which the complexity and orderliness of material information are utilized, and consciousness has the attributes of congenital, materiality, systematicness, complexity, dynamics, difference, and selfness according to the analysis, summary and induction of knowledge from various disciplines. In a recent paper, Tuomas Tahko has argued for a hybrid view of the laws of nature, according to which some physical laws are metaphysically necessary, while others are metaphysically contingent. In this paper, we show that his criterion for distinguishing between these two kinds of laws — which crucially relies on the essences of natural kinds — is on its own unsatisfactory. We then propose an alternative way of drawing the metaphysically necessary/contingent distinction for laws of physics based on (...) the central kinematical/dynamical distinction used in physical theorising, and argue that the criterion can be used to amend Tahko’s own account, but also that it can be combined with different metaphysical views about the source of necessity. The unreduced solution to the arbitrary interaction problem, absent in the standard theory framework, reveals many equally real and mutually incompatible system configurations, or "realizations". This is the essence of universal dynamic undecidability, or multivaluedness, and the ensuing causal randomness (unpredictability), non-computability, irreversible time flow (evolution, emergence), and dynamic complexity of every real system, object, or process. This creative undecidability of real-world dynamics provides causal explanations for "quantum mysteries", relativity postulates, cosmological problems, and the huge efficiency of (...) high-complexity phenomena, such as life, intelligence, and consciousness, giving rise to extended applications, far beyond the critical limits of usual science paradigm. Here we present an experimental model to be applied to the storage and retrieval of information based on an associative information system’s sensory and motor state change data, aiming to represent the dynamics of a dynamic perceptual system. The model and database implementation use a universal information storage structure holding both data and metadata within the same structure. This model is characterized by the emphasis on associative information about the represented system derived from raw data, which are in their (...) turn produced by the associative system’s interactions with the environment. Instead of defining objects using descriptive relations, this model stores relations between occurents where the represented system is not replicated in its various components, but defined by its relations when they occur. This model therefore represents the dynamics and interaction of systems such as human perception, rather than imposing artificial boundaries and qualities. In essence, the model is an alternative to perceptual knowledge accumulation, which, as we show, can be applied to a database design. (shrink)

Requirement specifications in software engineering involve developing a conceptual model of a target domain. The model is based on ontological exploration of things in reality. Many things in such a process closely tie to problems in metaphysics, the field of inquiry of what reality fundamentally is. According to some researchers, metaphysicians are trying to develop an account of the world that properly conceptualizes the way it is, and software design is similar. Notions such as classes, object orientation, properties, instantiation, algorithms, (...) etc. are metaphysical concepts developed many years ago. Exploring the metaphysics of such notions aims to establish quality assurance though some objective foundation not subject to misapprehensions and conventions. Much metaphysical work might best be understood as a model-building process. Here, a model is viewed as a hypothetical structure that we describe and investigate to understand more complex, real-world systems. The purpose of this paper is to enhance understanding of the metaphysical origins of conceptual modeling as exemplified by a specific proposed high-level model called thinging machines (TMs). The focus is on thimacs (things/machine) as a single category of TM modeling in the context of a two-phase world of staticity and dynamics. The general idea of this reality has been inspired by Deleuze’s ‘the virtual’ and related to the classical notions of Leibniz’s monads and Avicenna’s essence. The analysis of TMs leads to several interesting results about a thimac’s nature at the static and existence levels. (shrink)

In Sense-certainty, the being of the particular object of sense was found to belong to the universality - of consciousness. This relationship between the universal truth of the object and its sensuous determinate particularity is called the Thing of Perception, basically a Thing and its perceived properties. However, in perception it was concluded that the particular Thing is ultimately resolved into the unconditioned universality of the Understanding. Thus in both Sense-certainty and Perception the particular object or Thing proves to be (...) essentially universality. It is important to recollect the development that has taken place up to this point, i.e., the various moments and movements of thinking that constitute the activity, or dynamic essence, of what is called, in totality, consciousness or knowing. The full explication of what consciousness is in its completely developed form has not yet been reached, but only what may broadly be referred to as the first three stages (Sense-certainty, Perception, Understanding) in the complete activity that will be necessary and sufficient to adequately comprehend consciousness. This article explores the influence of Simmel and Pareto on the social theory of J. Freund (1921-1993). Recognized as an interpreter and promoter of the sociology of both authors in the French academic context of the last third of the past century, both play a fundamental role in the construction of his social philosophy, a central part of which is his theory of essences, developed especially in L’essence du politique (1965). However, this influence has not been yet sufficiently studied. (...) St. Maximus the Confessor claims that the logos of created beings represents their essence as an icon. This claim gives us the opportunity to understand the term essence as an dynamic reality and not as a static given. Essence is not something that the being is, but what it is supposed to be. The idea of icon is herein present as ultimately ontological. The icon is no mirror of reality, but rather its eschatological realization. That which (...) will be uncovers the truth of the being. This way, St. Maxius has founded a dynamic ontology, which is a fundamental step away from the Hellenic heritage. The equalization of the essence of beings and icon is only possible in an Eucharistic view of the world, wherein the Eucharist represents in an iconic way the presence of the eschatological truth in history. The Great Divide in metaphysical debates about laws of nature is between Humeans, who think that laws merely describe the distribution of matter, and non-Humeans, who think that laws govern it. The metaphysics can place demands on the proper formulations of physical theories. It is sometimes assumed that the governing view requires a fundamental / intrinsic direction of time: to govern, laws must be dynamical, producing later states of the world from earlier ones, in accord with the fundamental direction of (...) time in the universe. In this paper, we propose a minimal primitivism about laws of nature (MinP) according to which there is no such requirement. On our view, laws govern by constraining the physical possibilities. Our view captures the essence of the governing view without taking on extraneous commitments about the direction of time or dynamic production. Moreover, as a version of primitivism, our view requires no reduction / analysis of laws in terms of universals, powers, or dispositions. Our view accommodates several potential candidates for fundamental laws, including the principle of least action, the Past Hypothesis, the Einstein equation of general relativity, and even controversial examples found in the Wheeler-Feynman theory of electrodynamics and retrocausal theories of quantum mechanics. By understanding governing as constraining, non-Humeans who accept MinP have the same freedom to contemplate a wide variety of candidate fundamental laws as Humeans do. (shrink)

This work examines the unique way in which Benedict de Spinoza combines two significant philosophical principles: that real existence requires causal power and that geometrical objects display exceptionally clearly how things have properties in virtue of their essences. Valtteri Viljanen argues that underlying Spinoza's psychology and ethics is a compelling metaphysical theory according to which each and every genuine thing is an entity of power endowed with an internal structure akin to that of geometrical objects. This allows Spinoza to offer (...) a theory of existence and of action - human and non-human alike - as dynamic striving that takes place with the same kind of necessity and intelligibility that pertain to geometry. Leibniz criticizes the Cartesian conception of body and force and develops his own notion of matter, extension and his theory of forces. Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

Artificial intelligence (AI) profoundly influences a number of societal structures today, including religious dynamics. Using Bernard Lonergan’s critical realism as a lens, this article investigates the intersections of AI and religious traditions in their shared pursuit of the common good. Beginning with Lonergan’s principle that humans construct their understanding through cognitive processes, we examine how AI-mediated realities align with or challenge traditional religious tenets. By delving into specific cases, we spotlight AI’s role in reshaping religious symbols, rituals, and even creating (...) novel spiritual meanings. Using Lonergan’s insights on the balance between subjectivity and objectivity, I analyze AI’s potential to both create new sacred spaces and challenge religious orthodoxy. The crux of the discussion centers on the negotiation between religious values and technological innovation, assessing how AI can bolster religious life while maintaining its core essence. Ultimately, this article underscores the importance of the common good in the age of AI-driven religious evolution. (shrink)

We defend a view according to which Austrian economics rests on what can most properly be called an Aristotelian methodology. This implies a realist perspective, according to which the world exists independently of our thinking and reasoning activities; an essentialist perspective, according to which the world contains certain simple essences or natures which may come together in law-like ways to form more complex static and dynamic wholes, and an apriorist perspective, according to which given essences and essential structures are (...) intelligible, in the sense that they ca be grasped non-inductively in our thinking. We show the consequences of this view for an analysis of the thinking of Mises and Hoppe, both of which – we claim – incorporate what we believe to be foreign mixtures of Kantianism in their account of the foundations of Austrian economics. Cosmopolis A Review of Cosmopolitics -/- 2015/3-4 -/- Editorial Dominique de Courcelles & Paul Ghils -/- This issue addresses the general concept of “spirituality” as it appears in various cultural contexts and timeframes, through contrasting ideological views. Without necessarily going back to artistic and religious remains of primitive men, which unquestionably show pursuits beyond the biophysical dimension and illustrate practices seeking to unveil the hidden significance of life and death, the following papers deal with a number of interpretations covering a (...) wide field extending from belief to theory, from emotions to concepts, from the wisdom of personal experience to the most sophisticated doctrines. Spirit and spirituality are indeed many-faceted notions. They may refer to the intricate world of the interacting spirits which inhabit living beings in animistic traditions, without excluding a “grand force” linking human beings within a dynamic whole on which their very existence rely . They also bear upon more atomistic and either/or approaches of Western philosophy, which have become embodied in Cartesian dualism against a monotheist background, to the point of freezing the essence of individuals and culminating in the extreme individualism that characterizes our contemporaries. However, this equally refers to the opposite conception of materialism, across times and cultures, from ancient India and Greece (Cārvāka, originally known as Lokāyata, or some Buddhist doctrines for the former, Democritus or Lucretius for the latter) to more contemporary materialistic schools, whether modern or postmodern. -/- The following papers look at the contrasting forms of the philosophy and spirit of the human factor set into a whole, with no artificial disjoint between the psychical and the physical levels, as Wittgenstein put it: “And how can a body have a soul?”. This approach is not unrelated to the notion of anthropocene examined in a recent issue of Cosmopolis, with provides another comprehensive framework open to a spiritual life emerging from the very environment that generated it. -/- *** The first section of this issue was edited by Dominique de Courcelles, director at the National French Research Centre (CNRS), whom we wish to thank for collecting relevant studies relating to the religious and political questions, with a view to focusing on the war of ideas inevitably waged behind images, concepts and perceptions, taking an asymmetrical approach. To the extent that they are mindful of global/local interactions and include representations, opinions and beliefs, such disciplines as philosophy, philology, history and social sciences can provide useful studies accounting for new practices in geopolitics and a fair diplomacy. -/- In her introduction, Dominique de Courcelles first poses the question of how the religious and political spheres interrelate, with their corresponding religious demands and humanistic values. She then suggests that the right question today may be breaking with the philosophy of human rights concerned with the defense of human beings against the hazards of arbitrary politics or the instrumental use of religion, in favour of a fair philosophy of humankind, a new humanism. This would consist in recognizing a common loyalty of all towards one interhuman, not only interstate community, to protect it from both the autonomy demanded by individuals and the instrumental use of minorities. -/- Considering the fact of diversity, so important today in terms of both politics and religion, Abdelhai Azarkan looks at the conditions under which tolerance could obtain the double status of right and duty. He revisits to two philosophers, John Locke and Voltaire, who thought about it from the historical reality of religious wars. The former made tolerance into a right, basing his analysis on the political-legal level, while the latter saw tolerance as a duty, from an analysis based on ethical-political criteria. -/- Mathieu Guidère examines what he calls semantic denominationalism, a term which implies religious attributes and identities, whichever national loyalties or personal belonging they may have at the same time. Since the early 2000s, thie phenomenon has expanded tremendously, compounded by the “war on terror” and the over media-oriented terrorist actions. Denominational expressions act as formal names for ordinary and high-profile players in domestic and foreign policies of democratic states. These systems reveal a receding secularization, while the powerful comeback of religious identities signals the failure of nation-states and the weakening of the humanist spirit. -/- Barbara De Poli retraces the history of a contemporary jihadism claiming its Islamic essence and asserting the truth of genuine coranic principles via the war on infidels, with a view to restoring the Caliphate. After defining the term jihad, she shows that even if this contemporary jiadism is spreading in the Muslim world, it radically departs from Islamic law and the received use of the term jihad, in so far as it is rooted in the early radical thinking of Islamic ideologues in the 20th century, starting with with Hassan al-Banna, the founder of the Muslim Brotherhood. This current has been fueled by by international conflicts since the outbreak of the war in Afghanistan, in which the so-called Western countries bear a major responsibility. -/- Abderrazak Sayadi starts from the Tunisian experience to ask the question of humanist values and democracy within the relationships between the religious and political spheres. As a historian of religion, he is brought to demystify certain islamic principles and to paying attention to the reform of law, seeing the separation of religion and politics as a precondition to a successful democratic gamble and the establishment of a renewed humanism. -/- Dominique de Courcelles reminds us that getting a better knowledge of narrations and words makes it possible to better understand how logical and rhetorical thinking works for those who wage an asymetriccal war, re-enchanting and mystifying the world to better take control. As soon as 1932, an exchange of letters between Einstein and Freud made it clear that, in order to free man from fatality and war, education understood as culture was fundamental. Such illustrations as the exécution of Oussama ben Laden and the Caliph’s speech in Mossoul show that a premiminary analysis of images and words is essential to a fair diplomacy conducted by people from civil society, whose culture and wisdom allow justice and force to speak together and better resist war. -/- Marcel Boisard thinks that on the day the guns fall silent, exhausted by war, we will not return to the state borders that have prevailed for a century as an outcome of the Sykes-Picot agreement of 1916. It is time to prepare the “day after”, which will be a huge challenge. To this end, a summit of Middle-East nations is urgently needed to globally decide the fate of those peoples. On the condition that we know who the enemy is and accept to name it, to understand the history of the countries, groups and alliances, and to question any false or self-interested sense of certainty. -/- *** In the second section, Paul Schafer provides the author’s experiences to explain how culture, from the artistic to the biological, has the power to to open the doors to spirituality, from the inner self to the global environment. He asks himself whether a relative permanence of spirituality can arise from the specific moments that characterize it. Laurent Ledoux synthesizes the conclusion of a symposium held on 22 January 2015 on the links between philosophy and management, on the basis of the spiritual dimension conceived as “natural” and the answers it may suggest to the issues that face the organizations in a “contemporaniversal” world. Jacques Rifflet makes that question in a secular perspective, based on the wellsprings of personal commitment before it can be caught by any religious creed or scientific theory. In this sense spirituality, in alliance with reason, both inspires human consciousness and illuminates its destiny. Sami Aldeeb asks himself whether Islam can be reconciled with human rights. Caught between the belief in an absolute and final Word descended from the sky, and evidence showing that any religion is the creation of a given culture and a society situated in time and space, the Makkan and … contexts et médinois call for differentiated, if not opposite answers and exegeses. Bernard Carmona provides the outline of a dialogical framework, which is known to be a feature of debates between the various philosophical schools of classical India, exemplified here by the transdisciplinary perspective of debates within a Buddhist context. *** The articles not focused on the previous topic include a study by Landry Signé on China’s strategy, competing with the United States to control African resources. The author deals with the specific case of China’s rapprochement with Southern Sudan since Sudan was broken up. In the last paper, Goran Fejić and Rada Iveković, return to the essential role that women should play, and comments upon the role of some international legal instruments related in particular to the elimination of all forms of discrimination. The perspective is transnational and transethnic and is based on secular criteria, as regards nation-building and more generally society-building. Considering the persistence of widespread violence, whether in times of armed conflict or in times of peace, the question remains whether it is possible to fully implement rights and justice instruments. Sudden enlightenment is awakening to be attained all at once. Hyun-Eung, a Korean Buddhist monastic, has proposed a new interpretation that sudden enlightenment is the revolutionary awakening of the dynamical and indivisible structure of cognitive subject and objects. I argue that Hyun-Eung’s ‘revolutionary enlightenment’ is achieved through a ‘paradigm shift’ in Thomas Kuhn’s sense as presented in his The Structure of Scientific Revolutions. Enlightenment is obtained when one’s essentialist and realist worldview is replaced, through a revolutionary change of paradigm shift, (...) by a new perspective based on the Buddhist teaching of dependent arising and emptiness. Prior to enlightenment, each person views oneself as a separate and independent individual who has her own essence. However, when our perspective on self and the world changes with the understanding of dependent arising and emptiness, it becomes clear that no one and nothing can exist independently of conditions. Everything comes into existence, abides, and passes out of existence only in dependence on conditions. Sudden enlightenment requires a revolutionary change in one’s perspective of self and the world. I conclude that this concept of revolutionary enlightenment aptly explains the features of sudden enlightenment. (shrink)

The relationship between the One and the Multiple in mystic philosophy is a profound and central theme that explores the nature of existence, the cosmos, and the divine. This theme is present in various mystical traditions, including those of the East and West, and it addresses the paradoxical coexistence of the unity and multiplicity of all things. -/- In mystic philosophy, the **One** often represents the ultimate reality, the source from which all things emanate and to which all things return. (...) It is the absolute, the infinite, and the unchanging. The One is beyond all attributes and is often associated with the divine or the absolute truth. -/- The **Multiple**, on the other hand, represents the manifest world, the diversity of forms, and the realm of change and plurality. It is the world we experience through our senses, the domain of time and space, where differentiation and individuality are apparent. -/- The relationship between the One and the Multiple is not one of opposition but of emanation and unity. The Multiple is seen as a reflection, expression, or manifestation of the One. In this sense, the diversity of the world doesn’t contradict the unity of the One but rather demonstrates it in a myriad of forms. -/- Mystics seek to understand and experience this relationship through various practices and insights. They aim to transcend the illusion of separation and duality to experience the non-dual reality where the One and the Multiple are recognized as inseparable. -/- This concept can be illustrated by the metaphor of the ocean and its waves. The ocean represents the One—vast, deep, and all-encompassing—while the waves represent the Multiple—distinct, diverse, and ever-changing. Each wave is unique, yet it is not separate from the ocean. The wave’s existence is dependent on and made of the same substance as the ocean. In the same way, each individual entity in the Multiple is an expression of the One. -/- In summary, the relationship between the One and the Multiple in mystic philosophy is a dynamic interplay that challenges the conventional understanding of separation. It invites a deeper exploration of reality, where the apparent multiplicity of the world is a direct expression of the singular, underlying essence of all that is. -/- The relationship between the One and the Multiple in the context of mathematical philosophy is a profound topic that touches upon the very foundations of existence and knowledge. It’s a theme that has been explored by philosophers and mathematicians alike, often leading to the contemplation of unity and diversity within the structures of reality. -/- In mathematics, the concept of the One can be seen as the basis of unity from which all numbers derive. It’s the identity element in multiplication, the starting point in counting, and the foundation of dimension in geometry. The One is often associated with the concept of monism in philosophy, which posits that there is a single, underlying substance or principle that constitutes reality. -/- On the other hand, the Multiple represents the infinite variety and diversity of forms and numbers that arise from the One. It’s the embodiment of plurality and the complex interplay of different entities that mathematics seeks to understand and describe. This reflects the philosophical stance of pluralism, which acknowledges the existence of multiple realities or truths. -/- The interplay between the One and the Multiple can be seen in the mathematical concept of sets. A set can be thought of as a unity, a whole composed of distinct elements. Yet, each element within the set also retains its individuality, contributing to the diversity of the set’s composition. This duality is mirrored in the philosophical exploration of the universal and the particular, where the universal represents the One, and the particulars represent the Multiple. -/- In the realm of mathematical philosophy, this relationship often leads to questions about the nature of mathematical objects: Are they discovered as part of an objective reality (the One), or are they constructed by the human mind from a multitude of experiences (the Multiple)? Despite the notions of possible worlds and substances are very important subjects of contemporary metaphysics, there are relatively few attempts to combine these in a united framework. This paper considers the metaphysical model of the origins and the evolution of possible worlds that occurs from an interaction between substances. I involve Leibniz’s doctrine of the striving possibles that every possibility of substance has its own essence and tendency towards existence. It is supposed that the activities of substances are constantly (...) aimed at using this tendency in all possible ways. Only the consistent and stable interactions between the substances give birth to stable objects in one of many worlds. Thus activity of substances changes from the possible modality of being to the actual modality of being in form of existence of the worlds. I divide substance’s possibility into two aspects—dynamic (possible or virtual history) and static (possible or potential mutual state). Thanks to the summation of virtual histories, in the possible modality of being, the maximal number of virtual histories is combined into the actual history in the actual modality. (shrink)

Western philosophy has been defined through the exclusion of non-Western forms of thought as non-philo-sophical. In this paper, I place the notion of what is “properly” philosophy into question by contrasting the essence/appearance paradigm governing Western metaphysics and its deconstructive critics with the more fluid, dynamic, and participatory forms of encountering and performatively enacting the world that are articulated in Chinese thinking and made apparent in Chinese painting. In this hermeneutical contrast, Western and Chinese thinking themselves are interpeted (...) as co-relational rather than as discrete, mutually indifferent or ethnocentrically nativist traditions. Let us start by some general definitions of the concept of complexity. We take a complex system to be one composed by a large number of parts, and whose properties are not fully explained by an understanding of its components parts. Studies of complex systems recognized the importance of “wholeness”, defined as problems of organization (and of regulation), phenomena non resolvable into local events, dynamics interactions in the difference of behaviour of parts when isolated or in higher configuration, etc., in (...) short, systems of various orders (or levels) not understandable by investigation of their respective parts in isolation. In a complex system it is essential to distinguish between ‘global’ and ‘local’ properties. Theoretical physicists in the last two decades have discovered that the collective behaviour of a macro-system, i.e. a system composed of many objects, does not change qualitatively when the behaviour of single components are modified slightly. Conversely, it has been also found that the behaviour of single components does change when the overall behaviour of the system is modified. There are many universal classes which describe the collective behaviour of the system, and each class has its own characteristics; the universal classes do not change when we perturb the system. The most interesting and rewarding work consists in finding these universal classes and in spelling out their properties. This conception has been followed in studies done in the last twenty years on second order phase transitions. The objective, which has been mostly achieved, was to classify all possible types of phase transitions in different universality classes and to compute the parameters that control the behaviour of the system near the transition (or critical or bifurcation) point as a function of the universality class. This point of view is not very different from the one expressed by Thom in the introduction of Structural Stability and Morphogenesis (1975). It differs from Thom’s program because there is no a priori idea of the mathematical framework which should be used. Indeed Thom considers only a restricted class of models (ordinary differential equations in low dimensional spaces) while we do not have any prejudice regarding which models should be accepted. One of the most interesting and surprising results obtained by studying complex systems is the possibility of classifying the configurations of the system taxonomically. It is well-known that a well founded taxonomy is possible only if the objects we want to classify have some unique properties, i.e. species may be introduced in an objective way only if it is impossible to go continuously from one specie to another; in a more mathematical language, we say that objects must have the property of ultrametricity. More precisely, it was discovered that there are conditions under which a class of complex systems may only exist in configurations that have the ultrametricity property and consequently they can be classified in a hierarchical way. Indeed, it has been found that only this ultrametricity property is shared by the near-optimal solutions of many optimization problems of complex functions, i.e. corrugated landscapes in Kauffman’s language. These results are derived from the study of spin glass model, but they have wider implications. It is possible that the kind of structures that arise in these cases is present in many other apparently unrelated problems. Before to go on with our considerations, we have to pick in mind two main complementary ideas about complexity. (i) According to the prevalent and usual point of view, the essence of complex systems lies in the emergence of complex structures from the non-linear interaction of many simple elements that obey simple rules. Typically, these rules consist of 0–1 alternatives selected in response to the input received, as in many prototypes like cellular automata, Boolean networks, spin systems, etc. Quite intricate patterns and structures can occur in such systems. However, what can be also said is that these are toy systems, and the systems occurring in reality rather consist of elements that individually are quite complex themselves. (ii) So, this bring a new aspect that seems essential and indispensable to the emergence and functioning of complex systems, namely the coordination of individual agents or elements that themselves are complex at their own scale of operation. This coordination dramatically reduces the degree of freedom of those participating agents. Even the constituents of molecules, i.e. the atoms, are rather complicated conglomerations of subatomic particles, perhaps ultimately excitations of patterns of superstrings. Genes, the elementary biochemical coding units, are very complex macromolecular strings, as are the metabolic units, the proteins. Neurons, the basic elements of cognitive networks, themselves are cells. In those mentioned and in other complex systems, it is an important feature that the potential complexity of the behaviour of the individual agents gets dramatically simplified through the global interactions within the system. The individual degrees of freedom are drastically reduced, or, in a more formal terminology, the factual space of the system is much smaller than the product of the state space of the individual elements. That is one key aspect. The other one is that on this basis, that is utilizing the coordination between the activities of its members, the system then becomes able to develop and express a coherent structure at a higher level, that is, an emergent behaviour (and emergent properties) that transcends what each element is individually capable of. This paper examines the Hegelian moment of the for-another in its negative relation to the other moment of particularity: the for-itself. I identify the dissolving, fluidifying action of the for-another by examining figures within the Philosophy of Nature, particularly comets and moons, but also Hegel’s physics of light and sound. The dissolution of the lunar for-itself at the hands of the cometary for-another illustrates how the dynamic relation between the two moments of particularity participates in the presentation of (...) class='Hi'>essence, within the Hegelian syllogism, i.e. as mediating between the universal and the singular. The dynamic action of cometary negativity occurs throughout the Philosophy of Nature and therefore should be pivotal to how the work is read. (shrink)

The claim of this paper is to present Spinoza’s view on self-esteem and positive reciprocity, which replaces the human being in a monistic psycho-dynamical affective framework, instead of a dualistic pedestal above nature. Without naturalising the human being in an eliminative materialistic view as many recent neuro-scientific conceptions of the mind do, Spinoza finds an important entry point in a panpsychist and holistic perspective, presenting the complexity of the human being, which is not reducible to the psycho-physiological conditions of life. From a panpsychist point of view, qualities and values emerge from the world, in a situation similar to what could be seen in animism, or early childhood psychology, where the original distance between the mind and the exterior thing is reduced ad minima, and both can even interrelate in a confusing manner. Human reality is nevertheless a social reality, it supposes a basis for shared competencies, that we will present as grounded on the one hand of the sustaining character of the essence of the animal-man as will-to-power. Negatively speaking we all share same asocial tendencies and affects. This aspect is not only negative but it is also a will to develop and master the environment, because values have an onto-metaphysical immanent dimension in nature, not because there is an individual bottom-up will to survive, but rather a will to live in harmony with the surrounding world. On the other hand, we shall see that Spinoza understood and described perfectly the power of the mind over the power of the affects, as a co-constituting dimension, which is alienating natural dependencies, leaving an inner space for the objectification of ethical values, not related to mere compensation mechanisms. The goal of this essay is twofold. First, I will explicate the dynamic nature of Spinoza’s doctrine of virtue by discerning his reasons for defining virtuousness in terms of active power. Second, by taking this understanding of virtue as the point of departure, I will suggest a sense in which we can be said to be more or less eternal to the extent that we are virtuous and active. Spinoza’s specific brand of essentialism underpins both his doctrine of virtue (...) and that of eternity, and reaching these goals requires discussing the two kinds of essences which hold a prominent place in the Ethics: the formal and the actual essences. This, in turn, allows us to throw some new light on the relationship between eternal and durational existence, the distinction between which forms the very backbone of Spinoza’s system. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

In the last two sections, I (...) explore the essence of seeking knowledge, connecting it to human evolution, the dynamic nature of knowledge, and its profound impact on society and further probe the concept of Supreme Knowledge, questioning the limits of human understanding and contemplating the interplay between curiosity, cognitive capacities, and recognising the unknowable. In Chapter 1 I discuss the basic problem which made me undertake the issue of human death. That problem was the dualism in the depiction of human nature which has not been fully overcome yet, the dualism which leads to the emergence of new difficulties in contemporary attempts at adequately solving the problem of human death. They include the separation of soul from the body in the moment of death, and the borderline between the moment of death and the moment (...) of resurrection. Chapter 2 is devoted to the presentation of a new anthropological perspective, of an anthropology build “from the bottom up”, that is “from foundations”, and taking into account man’s rooting in the biological environment, and thus also in the genetic heritage taken over from our pre-human ancestors. That anthropology brings new aspects into traditional anthropology by extending it to include new ways of explaining the genesis of the human body and spirit, and new depictions of man’s death. In Chapter 2 I will also present the concept of evolution proposed by P.T. de Chardin, which I appreciate for its comprehensive evolutionary perception of the world. This concept has provoked various responses, but it certainly provides a creative inspiration for further attempts at applying the idea of evolution to various issues. The general framework of the evolutionary model proposed by the French researcher turns out to be useful also when applied to the evolutionary understanding of human death. Chapter 3 contains a discussion of the principal premises of the evolutionary concept of human death taken from analyses carried out by T. Wojciechowski concerning the issue of time, space, and the structure of variable material beings. A being is variable because it has a temporal structure, and the changes that occur are the derivatives of that structure. The temporal structure may be seen as endless, in which a being, even though its existence had a beginning, will exist for ever. Material substance should not be seen statically, but in dynamic and evolutionary terms. In evolution, time becomes a driver of development, an element shaping and directing the evolution of the entire cosmos. Man’s substance has been made capable of two levels of being and acting: the spatial and temporal level, and the endless and immanent level. Together, they form the one essence of man. Thus, the human person is partially immersed in the material cosmos, and partially elevated above it. Chapter 4 presents the evolutionary approach to the moment of man’s death. The views of T. Wojciechowski will be presented in which the moment of death is seen as a moment of transformation and perfection of the structure of the essence of human existence. Furthermore, the issue of the relationship existing, according to T. Wojciechowski, between man’s death and resurrection will be discussed. Understood in evolutionary terms, the moment of death is the time when the structure of human existence is transformed. Death transfers man fully into eternity and enables his life on a higher level of existential being. The element of flesh is retained, but changes its nature. Such view of death allows it to be understood as the moment of resurrection and the culmination of the evolutionary process of life. Death is therefore an “invention” of the evolution and should be seen as a natural and positive phenomenon. At this point, I also propose a solution to the question about reconciliation between temporal and endless existence. In Chapter 5 I take up the issue of consequences flowing from the postulated understanding of human death. They have been pointed to by T. Wojciechowski, but need to be further developed and clarified. He believed two lines in man’s development need to be recognized: that of natural and that of supernatural evolution. Both have the same direction, while occurring on different planes. In each of these lines, death is a natural element of life, pre-planned and, so to say, “encoded” in the cosmic matter. Therefore, the treatment of biological death as the consequence of sin is not only contrary to the evolutionary understanding of life, but in addition artificially combines that which is natural with that which is supernatural. Man’s authentic experience of his own present is a condition of his achieving full existential perfection in the moment of this death. Full engagement in the present is, in a way, a harbinger of the future; thus, the life “here” and “there” may not be inherently inconsistent. In the light of the evolutionary concept, death is not a punishment, but the most positive experience of man’s life in that it enables him to achieve full existential perfection. Chapter 6 is devoted to a substantiation of the possibility of evolutionary transformation of the structure of human existence in the moment of death. An adequate cause needs to be identified which could substantiate that transformation and achievement of perfection. I believe an appropriate substantiation can be found in God’s creative act, interpreted in evolutionary terms. The process of evolution, with its subsequent stages, is only a necessary condition for that “transformation” and “elevation”. The sufficient condition is fulfilled by the continuous creative intervention of God. The concept of God’s creative activity in the moment of man’s death finds its continuation in Chapter 7, where I present a detailed analysis of God’s activity at the time of man’s death. The concept of God’s creative activity extended over the entire process of evolution makes it possible to consider the moment of death as the moment of man’s resurrection. The moment of death is thus a moment of creation in evolutionary terms. Thus, as long as man is related to temporal and spatial elements, his development, or creation, continues. Death is only the completion of the final stage of creation, which may be painful and evoke fear, but in fact should give hope, for it involves resurrection. I also propose that the creative act in the moment of man’s death-resurrection be considered a basic action of God, which explains the manner in which God’s activity is contained within the framework of the creative act, encompassing also the moment of death-resurrection. The final Chapter 8 describes a didactic model illustrating the concept proposed here. I use the analogy of white light dispersion effect in the prism, and compare the incident ray to the creative act, and the dispersed rays going through the prism to the line of man’s natural and supernatural evolution. This model also shows the difference in the perspectives from which the phenomenon of death is seen by God and by man. (shrink)

This paper presents an investigation about the instant in Heidegger, articulating the analytics of Dasein by Being and Time with the thought of Ereignis. Therefore, it seeks to think, as a presupposition, the existence in his character of temporality. The human being is conceived as Dasein, i. e, in its fundamental relationship to the Being as such. The essence of Dasein is existence. The existence is grounded on Sorge (concern, care), which, in turn, is grounded on temporality. The most (...) own temporality brings together future, past and present in the dynamics of an anticipatory decision on which the man, accepting himself as being-unto-death, it becomes free for their power-to-be authentic, in a response of dedication and self-donation to the call of Being. This paper aims to provide a basic explanation of existence, fundamental aspects of reality, and consciousness. Existence in its most general sense is identified with the principle of logical consistency: to exist means to be logically consistent. The essence of the principle of logical consistency is that every thing is what it is and is not what it is not. From this principle follows the existence of intrinsic, indescribable identities of things and relations between them. There are three fundamental, (...) logically necessary relations: similarity, composition and instantiation. Set theory, mathematics, logic and science are presented as relational descriptions of reality. Qualities of consciousness (qualia) are identified with intrinsic identities of things or at least a certain subset of them, especially in the context of a dynamic form of organized complexity. Metaphysics, one of the most venerable branches of philosophy, investigates the fundamental nature of being and existence, as well as the structure and laws of reality. This field, significantly shaped by the works of Plato and Aristotle, attributes truth either to universals (Plato’s perspective) or to the essences of particulars (Aristotle’s perspective). This paper explores Neo-Aristotelian metaphysics, integrating and reinterpreting Aristotle’s classical metaphysical understanding in contemporary philosophical discussions. Neo-Aristotelian metaphysics reconfigures Aristotle’s classical concepts in light of modern scientific and philosophical (...) developments. In this context, the approaches of Ellis’s "Scientific Essentialism," Oderberg’s "Real Essentialism," and Bird’s "Dispositional Essentialism" are examined. Dispositional essentialism posits that the essences of entities can be defined by their dispositions and capacities. Alexander Bird argues that natural laws reflect the dispositions of entities, explaining how entities behave under certain conditions. Neo-Aristotelian metaphysics bridges metaphysical realism and naturalism by emphasizing the essences and natures of entities. This paper investigates the principles of dispositional essentialism and Neo-Aristotelian metaphysics, highlighting their contributions and significance in contemporary metaphysical debates. Furthermore, it underscores that the prominence of these approaches today results from their successful integration of modern scientific findings with classical metaphysical principles. By focusing on the essences and potentialities of entities, Neo-Aristotelian metaphysics and dispositional essentialism offer a more comprehensive and coherent metaphysical perspective. These approaches reflect modern philosophy's dynamic nature while revealing classical thought's timeless value. The mind thoughts of Wang Yangming come from long-term moral and spiritual practices. After the knowledge and action are honed, they fall on the level of conscience. In the early years, Yangming paid close attention to the mind. With the help of the concentrated observation amendments of law in Buddhism, Yangming looked at the ideas that have been developed and not developed from the perspective of the doctrine of the mean. Yangming believes that the essence of the dynamic (...) mind is natural. Therefore, it realizes the subtle purity of the mind from keeping one and settling down and from pure to spontaneous. At the same time, Yangming believes that the depth of Tao has a charm that is different from ordinary consciousness. However, Yangming criticized Buddhism for obtaining the silence of the no mind and the immobile mind through the practice of emptiness. Contrarily, Yangming paid more attention to the experience of "light" in moral practice, which made Confucianism standardize the practice of knowledge and action to the practice of mindfulness and doing instead of being in vain. Focusing on sin as a historical-cultural and socio-religious construction in a process that encompasses its mythical-religious aspects, the article points out that the concept that expresses its notion is rooted in the borders involving human failure to correspond to the paradigmatic framework and its system of taboos, laws and moral codes. Thus, converging on the etymological-literary and biblical-religious aspects of sin, the article emphasizes that, by ending the meaning of missing the mark, the translation of the aforementioned term as “sin” (...) corresponds to the textual transposition established by the Septuagintversion in a movement of abstraction from the notion of moral guilt. Based on Ricoeur's reading of the philosophical-theological aspects of sin, the article that points out that sin is not a term capable of exhausting the meaning of reality that it implies as a symbol of the rupture between essence and existence, converging to its characterization as a symbol of eviland “mythical grandeur” through a construction that marks sin as an intersection involving evil and the world and attributes its emergence tothe act and determines its identification as a product and simultaneously a cause. Thus, focusing on the biblical-theological aspects of sin in Tillich and on the construction of the concept as an alienation between “non-faith” and “non-love”, the articleemphasizes the irreducible character of the conception that, according to the Apostle Paul, encloses the condition of an almost personal powerthat controls this world, which implies the superposition of a state of affairs characterized by objectivity and the configuration of the event now designated as a rupture involving essence and existence in a movement that may represent the human separation from the “Being-in-itself” and expressing the element of personal responsibility imbricated in its existential dynamics. Установлено, що індивідуальний стиль професійної діяльності є комплексним особистісним утворенням, яке охоплює сталу систему методів і методик роботи та визначає певну стратегію поведінки в трудовій діяльності. Показано, що структуру індивідуального стилю можна уявити у вигляді змістового ядра й прибудови до нього, що формується внаслідок дії механізмів адаптації, компенсації й корекції під час опанування суб’єктом професійної діяльності. З’ясовано, що індивідуальний стиль професійної діяльності може бути охарактеризований через (...) своєрідність співвідношення в структурі орієнтовної, виконавчої та контрольної видів професійної діяльності та визначений як такий, що має процесуальність, особистісну своєрідність, продуктивність, розвивальнимй, коригувальний та адаптивний потенціал, умотивованість у виявленні й розвитку стилю. Акцентовано на тому, що стиль професійної діяльності є водночас фактором і наслідком індивідуального професійного розвитку індивіда, коли в процесі набуття професійного досвіду відбувається інтеграція вроджених властивостей нервової системи, набутих інтелектуальних, емоційних, поведінкових якостей та формуються відмітні риси й індивідуальні здібності людини, що забезпечують її ефективність і продуктивність у досягненні результатів. Виявлено та обґрунтовано педагогічні умови формування індивідуального стилю професійної діяльності майбутніх фахівців. Серед них: урахування індивідуально-психологічних особливостей майбутніх фахівців; запровадження засобів комплексної диференціації з метою розвитку адекватної самооцінки та настанов у виконанні трудових дій; цілеспрямоване формування системи раціональних трудових прийомів; створення на заняттях позитивного мікроклімату, атмосфери співтворчості та співпраці, що забезпечить закріплення оригінальних способів здійснення професійної діяльності. -/- The article studies the problem of the future specialist’s professional formation as a subject of professional activity, which is characterized by originality and peculiarity in the realization of labour functions. The aim of the article is to reveal the essence and content of the individual style of professional activity, its structure and formation mechanisms; determination of pedagogical terms that contribute to the shaping of the optimal individual style of future specialists’ professional activity during their professional preparation process. A complex of research methods has been used, namely: content analysis, generalization and specification in the provisions of the theory of activity and professional pedagogy regarding the essence of the individual style of activity, modelling of the structure of the individual style of professional activity, substantiating the pedagogical terms of its formation in future specialists during their professional preparation process. It has been established that the individual style of professional activity is a complex personal creation including a stable system of work methods and techniques, and determining a certain behaviour strategy in their labour activity. It has been shown that the structure of an individual style can be presented in the form of a content core and an extension to it; it is formed as a result of the action of mechanisms of adaptation, compensation and correction during the subject’s mastery of professional activity. It has been found that the individual style of professional activity can be characterized by means of the peculiarity of the ratio of the indicative, executive and control types of professional activity in its structure. It can be defined by way of procedural, personal originality, and productivity parameters, as well as one’s having the developmental, corrective and adaptive potential, and motivation in detecting and shaping the style. It has been emphasised that the style of professional activity, at the same time, is both a factor and a consequence of the person’s individual professional development. During the gaining professional experience process, the innate properties of the nervous system, and acquired intellectual, emotional, and behavioural qualities are integrated and a person’s distinctive features and individual abilities are formed ensuring their efficiency and productivity in achieving the results. It has been highlighted that such leading methodological approaches as systemic, personal-activity, axiological and acmeological ones are effective means to shape the future specialists’ individual style of professional activity. They make it possible to form not individual features or characteristics, but an integral dynamic psychological system of individual active adaptation to the conditions of the professional environment via involvement in the study and professional activities, taking into account personality traits and value attitudes and focusing on achieving the top of the professional mastery. Pedagogical terms for the formation of the future specialists’ individual style of professional activity have been identified and substantiated. They include taking into account the individual and psychological characteristics of future specialists, introducing means of complex differentiation to develop adequate self-assessment and attitudes in the performance of labour actions, purposeful formation of a system of rational labour methods, as well as creation of a positive microclimate and an atmosphere of co-creation and cooperation in classes, which will ensure the consolidation of original methods of carrying out professional activities. Progress in philosophy means to understand and accept one point and from there go on to develop the next. The whole is made up of many parts just as a building is composed of many floors – we cannot take out one or more of the beginning floors and expect that the building can thereby be erected. The overall system of Hegel’s philosophy requires an understanding of each of the parts within it, especially the beginning steps. In the earlier articles (...) on this subject the essential point has been made that the subjective and objective aspects of reality cannot be understood separately from each other. There is no meaning to concept without that of which it is the concept, as much as there is no meaning to an object without a subject. With that basic and simple principle of the “distinct but inseparable” notion of the two, further progress was made to the details of the relationship between subject and object. The subject-predicate proposition was introduced to show how thinking takes on a dialectical nature and described this dialectical unity as being the first basic form in understanding the Concept as a dynamic unity of subject and object. Further determinations lay hidden in this structure which have not yet been made explicit for understanding. Only some general ideas or an outline for a basic understanding of what the basic principles are has been presented thus far. A more detailed comprehension is required to go further. The experiences that consciousness goes through in its development in learning about itself display the entire system of the truth of consciousness or the realm of spirit. These are not mere abstract thoughts but appear in relation to consciousness as actual shapes or stages of itself. The development of these determinate moments constitutes consciousness as a whole in its true existence. At that point in the developement of consciousness when it is no longer burdened with itself as that which appears to exist merely for it and as an other, its alien nature is overcome and appearance becomes identical to its own essence. This marks the entrance to the platform of the genuine science of spirit in which consciousness grasps its own essence or is absolute knowing. (shrink)

The preconditions and features of the formation of post-industrial society are defined in the article. The distinctive role of active innovation infrastructure of the country in integrating into the European community and society based on knowledge are proved. The characteristic features of the economy of post-industrial society are the increasing role of intangible resources in ensuring social reproduction, “softization” and “servization” the subjects of innovation infrastructure. The essence of economic category “innovation infrastructure“ is defined in the article. It is (...) a dynamic self-regulating system of markets and subjects that entering these markets in certain economic relations and it provides the necessary conditions for implementation of the innovation processes. It is common to think of essence along modal lines: the essential truths, on this approach, are a subset of the necessary truths. But Aristotle conceives of the necessary truths as being distinct and derivative from the essential truths. Such a non-modal conception of essence also constitutes a central component of the neo-Aristotelian approach to metaphysics defended over the last several decades by Kit Fine. Both Aristotle and Fine rely on a distinction between what belongs to the (...) class='Hi'>essence proper of an object and what merely follows from the essence proper of an object. In order for this type of approach to essence and modality to be successful, we must be able to identify an appropriate consequence relation which in fact generates the result that the necessary truths about objects follow from the essential truths. I discuss some proposals put forward by Fine and then turn to Aristotle’s account: Aristotle’s central idea, to trace the explanatory power of definitions to the causal power of essences has the potential to open the door to a philosophically satisfying response to the question of why certain things are relevant, while others are irrelevant, to the nature or essence of entities. If at all possible, it would be desirable for example to have something further to say by way of explanation to such questions as ‘Why is the number 2 completely irrelevant to the nature of camels?’. A dynamic semantics for iffy oughts offers an attractive alternative to the folklore that Chisholm's paradox enforces an unhappy choice between the intuitive inference rules of factual and deontic detachment. The first part of the story told here shows how a dynamic theory about ifs and oughts gives rise to a nonmonotonic perspective on deontic discourse and reasoning that elegantly removes the air of paradox from Chisholm's puzzle without sacrificing any of the two detachment principles. The second part (...) of the story showcases two bonus applications of the framework suggested here: it offers a response to Forrester's gentle murder paradox and avoids Kolodny and MacFarlane's miners paradox about deontic reasoning under epistemic uncertainty. A comparison between the dynamic semantic proposal made in this paper and a more conservative approach combining a static semantics with a dynamic pragmatics is provided. (shrink)

I show that standard dynamic approaches to the semantics of epistemic modals invalidate the classical laws of excluded middle and non-contradiction, as well as the law of epistemic non-contradiction. I argue that these facts pose a serious challenge.

What is the relation between metaphysical necessity and essence? This paper defends the view that the relation is one of identity: metaphysical necessity is a special case of essence. My argument consists in showing that the best joint theory of essence and metaphysical necessity is one in which metaphysical necessity is just a special case of essence. The argument is made against the backdrop of a novel, higher-order logic of essence, whose core features are introduced (...) in the first part of the paper. The second part investigates the relation between metaphysical necessity and essence in the context of HLE. Reductive hypotheses are among the most natural hypotheses to be explored in the context of HLE. But they also have to be weighed against their non-reductive rivals. I investigate three different reductive hypotheses and argue that two of them fare better than their non-reductive rivals: they are simpler, more natural, and more systematic. Specifically, I argue that one candidate reduction, according to which metaphysical necessity is truth in virtue of the nature of all propositions, is superior to the others, including one proposed by Kit Fine, according to which metaphysical necessity is truth in virtue of the nature of all objects. The paper concludes by offering some reasons to think that the best joint theory of essence and metaphysical necessity is one in which the logic of metaphysical necessity includes S4, but not S5. Dispositional essentialists argue that physical properties have their causal roles essentially. This is typically taken to mean that physical properties are identical to dispositions. I argue that this is untenable, and that we must instead say that properties bestow dispositions. I explore what it is for a property to have such a role essentially. Dispositional essentialists argue for their view by citing certain epistemological and metaphysical implications, and I appeal to these implications to place desiderata on the concept of (...) class='Hi'>essence involved. I argue that the traditional modal theory of essence meets these desiderata, but that the resulting theory wrongly implies that certain dispositions essential to mass are essential to charge, thereby offering a new argument against modal theories of essence. I argue that dispositional essentialism requires a primitive notion of essence, and develop a primitivist theory based on Kit Fine's views. I show that the primitivist theory has all the virtues of the modal alternative, and none of the vices. I develop a novel way of thinking about the relationship between properties, laws and dispositions, and argue that it has distinct advantages over standard dispositional essentialist formulations. In a recent article forthcoming in *Mind*, Leech (2020) presents a challenge for essentialist accounts of metaphysical modality: why should it be that essences imply corresponding necessities? Leech’s main focus is to argue that one cannot overcome the challenge by utilizing an account of essence in terms of generalized identity due to Correia and Skiles (2019), on pain of circularity. In this reply, we will show how to use identity-based essentialism to bridge ‘epistemic’ and ‘explanatory’ understandings of this alleged (...) essence-to-necessity gap without circularity, Leech’s arguments notwithstanding. We do so by first presenting a novel proof that generalized identities imply corresponding necessities. We then propose several substantive identity-based explanations of how it is, exactly, that essences imply necessities. -/- . (shrink)

Discussions about the nature of essence and about the inference problem for non-Humean theories of nomic modality have largely proceeded independently of each other. In this article I argue that the right conclusions to draw about the inference problem actually depend significantly on how best to understand the nature of essence. In particular, I argue that this conclusion holds for the version of the inference problem developed and defended by Alexander Bird. I argue that Bird’s own argument that (...) this problem is fatal for David Armstrong’s influential theory of the laws of nature but not for dispositional essentialism is seriously flawed. In place of this argument, I develop an argument that whether Bird’s inference problem raises serious difficulties for Armstrong’s theory depends on the answers to substantial questions about how best to understand essence. The key consequence is that considerations about the nature of essence have significant, underappreciated implications for Armstrong’s theory. (shrink)

Fine is widely thought to have refuted the simple modal account of essence, which takes the essential properties of a thing to be those it cannot exist without exemplifying. Yet, a number of philosophers have suggested resuscitating the simple modal account by appealing to distinctions akin to the distinction Lewis draws between sparse and abundant properties, treating only those in the former class as candidates for essentiality. I argue that ‘sparse modalism’ succumbs to counterexamples similar to those originally posed (...) by Fine, and fails to capture paradigmatic instances of essence involving abundant properties and relations. A dynamic semantics for epistemically modalized sentences is an attractive alternative to the orthodox view that our best theory of meaning ascribes to such sentences truth-conditions relative to what is known. This essay demonstrates that a dynamic theory about might and must offers elegant explanations of a range of puzzling observations about epistemic modals. The first part of the story offers a unifying treatment of disputes about epistemic modality and disputes about matters of fact while at the same (...) time avoiding the complexities of alternative theories. The second part of the story extends the basic framework to cover some complicated data about retraction and the interaction between epistemic modality and tense. A comparison between the suggestion made in this essay and current versions of the orthodoxy is provided. (shrink)
