We subsist under the law where we claim our rights and are obliged to do something enforced. What is a law? The question would be perplexing in history, and one of crucial themes with many lawyers or legal philosophers. As we know, two most important perspectives had earned a universal and historical forge in academics, to say, the natural law and legal positivism. The concept of natural law deals in its primacy for the humanity and natural order which often can (...) be traded as something inviolable or inalienable. The concept has strands in several aspects; (i) its anchor with the civil democratic revolution around 17 and 18 centuries (ii) its supremacy with the new constitutional states (iii) less quality as a realist law from ambiguities and lack of clear definition. The concept of public policy may be related with the social justice, ethics and administration. It generally pursues a justice and desired state of public or community where the tension and conflict always exist between the ruling class and citizens. Historically, the public policy could be mightier to address the society than law where the benevolent Kings or Sovereigns liked to address both their needs and social justice. They may abrogate, more in endowment and divinity, the laws or social customs. The tension between the public power and private interests could be one reason as well as offers a good dualism in understanding the rule of law concept and advent of modern democracy. In this dimension, the King would no longer be divine nor entitled to exercise a plenary power of state rule. Instead, the popular sovereignty in the US democracy or parliamentary type in the UK were to be established to resolve a feudal conflict within the class and society. Lighted to be in vein of influence could arise the two contexts which are a contractarian view and plutocracy desire of the founding fathers. They underlay the mood and philosophical ethos of US revolution. Hence, three concepts as a pillar in private law were sanctified in the very foundation of US constitutional state, sanctity of property right, freedom of contract and due limits for the civil liability. The governmental power should be limited to protect the life and limb of citizens which addressed the Hobbes’ evil, “war against all the rest.” The due process concept was expressed as a fundamental principle of constitution where the human rights are inviolable and inalienable. The separation of powers principle could serve the freedom and wealth of new civil class in the continent, and bicameralism was devised for the check and balance within the federal congress. They see the role of judicial branch is important to preserve their civil interest. Then we can derive some assumptions between the law and public policy. First, a law plays to protect the private interest while the public policy pursues the social justice and mediates the competing interests, “private v. private” and “public v. private.” The civil courts may address a first nature of conflict and the law of takings or regulatory laws may deal with the second aspect. Second, the public or administrative law can shape a legal plane of bureaucracies or public administration, and may guarantee the rule of law ideals. It plays as an enabling authority and, on the other, monitors an arbitrariness and unfairness in the bureaucratic government. In this context, the unresponsive and unfathomable bureaucracy in the Kafka’s could be remedied. Third, for the welfare state in the late 19th and 20th century, a law can well be seen as one of authoritative expression of public policy to redress the evils of capitalist states. Some public laws, such as the Sherman Act classically and Lanham Act recently, may act to regulate the monopoly or oligopoly while other laws were enacted to restore justice between the labor and employers. Through the chapters, the fundamentals of law and public policy will be considered to address their proper status. (shrink)

In metaphysics, the view that material constitution is transitive is ubiquitous, an assumption expressed by both proponents and critics of constitution views. Likewise, it is typically assumed within the philosophy of mind that physical realization is a transitive relation. In both cases, this assumption of transitivity plays a role in discussion of the broader implications of a metaphysics that invokes either relation. Here I provide reasons for questioning this assumption and the uses to which this appeal to transitivity is put. (...) The way in which vision represents objects as being the same despite movement and qualitative changes has been extensively investigated in contemporary psychology. However, the formal properties of the visual sameness relation are still unclear, for example, whether it is an identity-like, equivalence relation. The paper concerns one aspect of this problem: the transitivity of visual sameness. Results obtained by using different experimental paradigms are analysed, in particular studies using streaming/bouncing stimuli, multiple object tracking experiments and investigations concerning object-specific preview (...) benefit, and it is argued that the transitive interpretation of visual sameness is the most plausible given the current stage of knowledge. What is more, it is claimed that the way in which visual sameness is represented suggests that in some cases it should be characterized as a “primitive sameness”, similarly as in philosophical theories postulating “thisness”. This paper is an attempt to describe the rationale behind recent Chinese Political-Legal Reforms. The article proposes an alternate to the “Socialism with Chinese Characteristics”.

That parthood is a transitive relation is among the most basic principles of classical mereology. Alas, it is also very controversial. In a recent paper, Ingvar Johansson has put forward a novel diagnosis of the problem, along with a corresponding solution. The diagnosis is on the right track, I argue, but the solution is misleading. And once the pieces are properly put together, we end up with a reinforcement of the standard defense of transitivity on behalf of classical mereology.

If A is better than B and B is better than C, then A is better than C, right? Larry Temkin and Stuart Rachels say: No! Betterness is nontransitive, they claim. In this paper, I discuss the central type of argument advanced by Temkin and Rachels for this radical idea, and argue that, given this view very likely has sceptical implications for practical reason, we would do well to identify alternative responses. I propose one such response, which employs the idea (...) that rational agents might regard some options as incommensurate in value, and will reasonably employ a heuristic of status quo maintenance to avoid suboptimal choices from incommensurate goods. This paper establishes that the occasional identity relation and the contingent identity relation are both non-transitive and as such are not properly classified as identity relations. This is achieved by appealing to cases where multiple fissions and fusions occur simultaneously. These cases show that the contingent and occasional identity relations do not even satisfy the time-indexed and world-indexed versions of the transitivity requirement and hence are non-transitive relations.

The Rachels–Temkin spectrum arguments against the transitivity of better than involve good or bad experiences, lives, or outcomes that vary along multiple dimensions—e.g., duration and intensity of pleasure or pain. This paper presents variations on these arguments involving combinations of good and bad experiences, which have even more radical implications than the violation of transitivity. These variations force opponents of transitivity to conclude that something good is worse than something that isn’t good, on pain of rejecting the good altogether. This research explores the crucial role of leadership transitions in educational institutions, particularly at Immaculate Conception College of Balayan, Inc. (ICCBI). Recognizing the profound impact of leadership practices on organizational effectiveness, this study addresses nuanced aspects of employee engagement during transitions. Using a qualitative case study design involving face-to-face interviews, common themes emerge regarding the transition of leadership, such as inclusive decision-making, resistance to new policies, unclear communication, continuity in vision, mission, and commitment, and transparency. The findings underscore the (...) substantial influence of leadership transitions on the institution's dynamics, shaping its mission, vision, and commitment to both students and employees. Proactively addressing challenges is emphasized as crucial for maintaining a positive work environment and enhancing organizational effectiveness. At first sight, if A is all-things-considered better than B and B is all-things-considered better than C, the judgment that A is all-things-considered better than C seems to follow. This should be a straight-forward consequence of the transitivity of the \all-things-considered better than" relation. However, if we deny that transitivity is a logical axiom of those relations involving comparatives, then it might turn out that betterness is not transitive. Following Temkin's terminology, a relation R will be de ned as nontransitive (...) i either it is intransitive (i.e. aRb and bRc yet :(aRc)) or if transitivity cannot be applied, for there is no single relation R that holds between all the alternatives. More spefici cally, this could happen in a case where the obtaining of the better-than relation depends on different factors according to the nature of the relata. As a result, there are two main strategies available to question the axiom of transitivity: the rst is by providing an effective counterexample displaying cRa as well as (aRb ^ bRc), hence yielding a cycle. The second, more general way, is to show that all-things-considered betterness is a relation that conceptually involves comparison-dependent betterness relations, so that it is likely that transitivity fails to apply across different alternatives. The aim of this paper is to investigate part of the recent attack on the transitivity of better than, to conclude that there seems to be no cogent reason why this would not be a transitive relation. This paper proposes to introduce the study of theories of reasoning into a historiographic perspective because we assume that the answer to the previous question does not only depend of internal controversies about how reasoning performance is explained by current theories of reasoning. This study examines playgrounds as lenses on urban transitions to explain the link between urban transformations and changes in the discourse of play and childhood. Specifically, it compares Soviet public playgrounds and post-Soviet privatized playscapes in the city of Yekaterinburg, Russia, through primary observation and secondary data analysis. Using the framework of social reproduction developed by Cindy Katz and Saskia Sassen to explain how the local forces affect cities, my analysis shows that the shift in the discourse of play and (...) childhood in the post-Soviet period is hinged on global influences combined with local transformations, from the abandonment of Soviet ideals of communal play spaces to the embracement of today’s consumerist play places. Whereas the old Soviet playgrounds have uncertain purposes, in contemporary Yekaterinburg private playgrounds offer a narrative of play in terms of leisure, love, and convenience for parents. Children turn into consumers of private play, leaving most of the Soviet playgrounds as idle spaces in the city. This article argues that Yekaterinburg’s shift toward participating in the globalized economy combined with its transition from the Soviet ideals maintains social relations and reproduces social inequalities in childhood, as this condition favors consumerist narratives of play. I conclude that the playgrounds in Yekaterinburg are bystanders of new global ecologies whereby social, political, and economic transformations become an impetus to reproduce new ways of seeing the social importance and meaning of play and playgrounds. The counterfactual tradition to defining actual causation has come a long way since Lewis started it off. However there are still important open problems that need to be solved. One of them is the (in)transitivity of causation. Endorsing transitivity was a major source of trouble for the approach taken by Lewis, which is why currently most approaches reject it. But transitivity has never lost its appeal, and there is a large literature devoted to understanding why this is so. Starting from (...) a survey of this work, we will develop a formal analysis of transitivity and the problems it poses for causation. This analysis provides us with a sufficient condition for causation to be transitive, a sufficient condition for dependence to be necessary for causation, and several characterisations of the transitivity of dependence. Finally, we show how this analysis leads naturally to several conditions a definition of causation should satisfy, and use those to suggest a new definition of causation. (shrink)

Why should ‘better than’ be transitive? The leading answer in ethics is that values do not change with context. But this cannot be the entire source of transitivity, I argue, since transitivity can fail even if values never change, so long as they are complex, with multiple dimensions combined non-additively. I conclude by exploring a new hypothesis: that all alleged cases of nontransitive betterness, such as Parfit’s Repugnant Conclusion, can and should be modelled as the result of complexity, not context-relativity.

This paper proposes a novel answer to the question of what attitude agents should adopt when they receive misleading higher-order evidence that avoids the drawbacks of existing views. The answer builds on the independently motivated observation that there is a difference between attitudes that agents form as conclusions of their reasoning, called terminal attitudes, and attitudes that are formed in a transitional manner in the process of reasoning, called transitional attitudes. Terminal and transitional attitudes differ both in their descriptive and (...) in their normative properties. When an agent receives higher-order evidence that they might have reasoned incorrectly to a belief or credence towards p, then their attitude towards p is no longer justified as a terminal attitude towards p, but it can still be justified as a transitional attitude. This view, which I call the unmooring view, allows us to capture the rational impact of misleading higher-order evidence in a way that integrates smoothly with a natural picture of epistemic justification and the dynamics of deliberation. This article focuses on the epistemic transition to testimonial justice. It argues that the recognition of testimonial injustice in the context of reproductive rights may play a central role in this transition. First, I show how testimonial injustice undermines women’s legal protection against sexual violence and rights triggered by it such as the right to abortion. Second, I argue that the epistemic transition initiated by the #MeToo and #YoSiTeCreo movements call for transitional justice. In support, I review (...) the circumstances of transitional justice for cases like the transition to testimonial justice. Finally, I focus on the area of reproductive rights. I argue that policies of recognition contribute to epistemic transitional justice and complement other strategies aimed to overcome testimonial injustice such as the virtue of the responsible hearer and institutional compensatory virtues. The aim of this article is to show that, just like in recent years Cobreros, Égré, Ripley and van Rooij provided a non-transitive counterpart of classical logic (meaning by this that all classically acceptable inferences are valid, but Cut and other metainferences are not) the same can be done for every Tarskian logic, with full generality. In order to establish this fact, we take a semantic approach, by showing that appropriate structures can be devised to characterize a non-transitive counterpart of (...) every Tarskian logic, starting from the logical matrices that are usually taken to render them. We discuss the evolutionary transition from animals with limited experiencing to animals with unlimited experiencing and basic consciousness. This transition was, we suggest, intimately linked with the evolution of associative learning and with flexible reward systems based on, and modifiable by, learning. During associative learning, new pathways relating stimuli and effects are formed within a highly integrated and continuously active nervous system. We argue that the memory traces left by such new stimulus-effect relations form dynamic, flexible, and varied (...) global sensory states, which we call categorizing sensory states . These CSSs acquired a function: they came to act as internal “evaluators” and led to positive and negative reinforcement of new behavior. They are therefore the simplest, distinct, first-person motivational states that an animal can have. They constitute what we call basic consciousness, and are the hallmark of animals that can experience. Since associative learning has been found in many invertebrate taxa that first appeared during the Cambrian era, we propose that the processes underlying basic consciousness are phylogenetically ancient, and that their emergence may have fueled the Cambrian explosion. The paper studies Heidegger's reading of the poet Stefan George (1868-1933), particularly of his poem "Das Wort" (1928), in the context of Heidegger's narrative of the history of metaphysics. Heidegger reads George's poem as expressing certain experiences with language: first, the constitutive role of language, of naming and discursive determination, in granting things stable identities; second, the unnameable and indeterminable character of language itself as a constitutive process and the concomitant insight into the human being's dependency on language and her (...) incapacity to master in subjectively. Heidegger characterizes this experience as "transitional" (übergänglich). It is shown that in Heidegger's historical narrative, this places George's poem in the ongoing transition (Übergang) from the Hegelian and Nietzschean end of metaphysics to a forthcoming "other beginning" of thinking. Research on transition to higher education and young people with disabilities has increased in recent years. However, there is still limited understanding of transition issues and how digital technologies, such as social media and mobile devices, are used by this group of students to manage these issues. This article presents the findings of an empirical study that addressed this matter based on young people’s views and experiences. The qualitative study was conducted in the context of a group of (...) students with vision impairments transitioning to a New Zealand university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The study shows that, like their non-disabled peers, the students actively engaged with interactive and collaborative digital technologies to make sense, individually and collectively, of different transition issues before, during and after the first academic trimester of their university journey. All efforts undertaken so far to establish peace between Israel and the Palestinians have failed to seriously address the right of return of the Palestinian refugees. This failure stemmed from a conviction that the question of historical justice in general had to be avoided. Since justice is a subjective construct, it was argued, allowing it to become a subject of negotiation would only perpetuate the conflict. However, the experience of these peace efforts has shown that without solving the problem of (...) the Palestinian refugees an agreement cannot be reached. And the problem cannot possibly be solved without addressing the key Palestinian demand on this issue — the right of return. For both sides, the right of return, more than any other issue, touches on the essence of their history since the beginning of the conflict between them, and on their future. The national narrative of each side thus centers on its version of the history of the 1948 Arab-Israeli war, in the course of which the Palestinian refugee problem was created. And each side maintains the fundamental belief that its future national existence hinges on whether, and how, the issue of the right of return is resolved. For the Palestinians, the right of return is an inalienable right that defines their national identity and their struggle for liberation. For Israeli Jews, the right of return is perceived as an existential threat to the Jewish character of their society, if not to its very existence. It is not surprising, therefore, that within each of the two societies a national consensus has been built around this issue and that the position of each society seems to stand in complete opposition to that of the other. However, we argue that a morally and politically sound basis could and should be established for a workable solution and that such a basis can be provided by the notion of "transitional justice." Transitional justice stresses two major steps as necessary for reconciliation between parties involved in an historic conflict: recognition and restitution. Recognition entails revealing the historical truth about the injustices committed and according their victims dignity and respect as rights-bearing human beings. Restitution is meant to alleviate some of the material deprivation suffered by the victims and is also a form of recognition. In the Israeli-Palestinian case, recognition by Israel of the right of return would entail its assumption of responsibility for the uprooting of the majority of Palestinian society in 1948. This would satisfy a demand that has become a fundamental element in Palestinian national identity. Recognition would then enable the two parties to enter negotiations over restitution, in particular the implementation of the right of return. In these negotiations, as many Palestinian political leaders have indicated, the concerns of Israeli Jews with their national identity would be taken into account. Only if the fundamental concerns of the two parties, which center on the issue of the right of return, are met can the road towards reconciliation between them be opened. (shrink)

Against several recent interpretations, I argue in this paper that Immanuel Kant's support for enlightened absolutism was a permanent feature of his political thought that fit comfortably within his larger philosophy, though he saw such rule as part of a transition to democratic self-government initiated by the absolute monarch himself. I support these contentions with (1) a detailed exegesis of Kant’s essay "What is Enlightenment?" (2) an argument that Kantian republicanism requires not merely a separation of powers but also (...) a representative democratic legislature, and (3) a demonstration that each stage of a democratic transition can potentially be in an absolute monarch’s short-run self-interest. I conclude the paper by defending Kant's theory of democratization against charges of consequentialism and paternalism and by pointing out its similarity to other accounts of democratic transitions (for example, those of Samuel Huntington and Guillermo O'Donnell), suggesting a previously unnoticed opportunity for cross-fertilization between political philosophy and comparative politics. Principals’ transition in Colleges of Education in Ghana is critical to quality teacher education and training, but it comes with complexities and challenges to newly appointed principals. However, there is a seeming absence of research on strategies for smooth transitions in Colleges of Education in Ghana. This study was therefore conducted to establish strategies that promoted the College of Education principals’ transition management in Ghana. Phenomenological research design was used for the study. Ten (10) newly appointed principals of (...) public colleges of education were purposively sampled for the study. Interview protocol was the research instrument used. The data collected was analyzed using content analysis method. The study established that capacity building, relationship building, appropriate leadership style and maintenance of discipline were key among the coping strategies for smooth transitions. This study then provides a guide for new principals. It was recommended that this area should be further explored and a model for managing transition designed to support College of Education principals’ in transition. (shrink)

The transition of C. albicans from unicellular yeast form to filamentous form i.e., pseudohyphae and hyphae is referred to as morphogenesis. C. albicans has the ability to respond to environmental conditions and accordingly changing its cell morphology. Three main morphological forms of C. albicans are unicellular yeast, pseudohyphae and hyphae. The effect of different growth media (Horse serum medium, RPMI-1640, MSGB), incubation temperatures (34˚C, 37˚C, 40˚C) and pH values (5.4, 6.4, 7.4) on germ tube production by C. albicans was (...) evaluated. Horse serum medium noticeably promotes filamentation while RPMI-1640 medium shows moderate filamentation and MSGB media shows moderately low filamentation. The germ tube of C. albicans developed early in 1.5 hr at high temperature i.e., 40˚C. Incubation temperature of 37˚C was associated with highest germ tube formation while 34˚C shows low filamentation. A pH of 5.4 also induces low filamentation, pH 6.4 gives moderately lower than pH 7.4. A pH of 7.4 was best suited for germ tube induction. The peak of mycelium production appears between 1.5 and 6 hr after inoculation of C. albicans culture. These results suggested that environmental factors are important in selectively favoring yeast or hyphal form, most important being the growth medium, incubation temperature and external pH value. This article offers a conceptual framework for discussing the role of envy within processes of transitional justice. Transitional justice importantly includes the transformation of intergroup dynamics of interaction in the aftermath of societal conflicts and upheavals. Such transformation aims to realise “interactive” justice in transitional justice by reshaping belief and value systems, and by moulding emotional responses between the involved parties. A nuanced understanding of the emotions at play in intergroup antagonistic dynamics of interaction is thus essential to transitional justice. (...) Among the many emotions that we could address in such scenarios, we target envy. Envy, in its various forms, features prominently in many societal conflicts and upheavals, and has, therefore, the potential to undermine or, conversely, support just intergroup interactions. However, the ambivalent role of this emotion has been scantly analysed in the philosophical literature on transitional justice. We make a start on filling this lacuna by developing a conceptual framework which is necessary to appreciate how envy and its varieties are epistemically and practically relevant to realising interactive justice in transitional justice processes. This paper explores the value of benevolence as a cardinal virtue by analyzing the evolving history of virtue ethics from ancient Greek tradition to emotivism and contemporary thoughts. First, I would like to start with a brief idea of virtue ethics. Greek virtue theorists recognize four qualities of moral character, namely, wisdom, temperance, courage, and justice. Christianity recognizes unconditional love as the essence of its theology. Here I will analyze the transition within the doctrine of virtue ethics in the (...) Christian era and afterward since the eighteenth-century thinkers are immensely inspired by this Christian notion of love consider universal benevolence as the cardinal virtue. Later, Hume introduces an emotivist turn by considering the moral worth of sympathetic emotions in his ethical doctrine. In this paper, I aim to discover the cardinality of the virtue of benevolence following the evolutionary history of virtue ethics. (shrink)

Abstract:This article provides a novel interpretation of the so-called transition to self-consciousness in The Phenomenology of Spirit, where Hegel argues that the failure of the protagonist consciousness to formulate an understanding of the world in terms of forces and laws necessitates the shift to an investigation of its own self-conscious subjectivity. The author argues that we can make sense of the transition by attending to Hegel's account of the metaphysical structure of forces and laws, on the one hand, (...) and the structure of self-consciousness, on the other. Following this approach, she argues that the transition represents the realization by the protagonist consciousness that the object of phenomenological inquiry must be metaphysically self-determining (or "infinite," in Hegel's terminology). The standpoint of self-consciousness accordingly emerges because the protagonist consciousness takes itself qua subject to exhibit the requisite self-determining structure. In addition to making sense of the transition to self-consciousness, this line of argumentation illuminates Hegel's subsequent focus on the activity of "desire.". (shrink)

The writings and speeches of the Mexican president Andrés Manuel López Obrador (2018-2024) have been characterized by a constant reference to a teleological history. Using Karl Löwith’s proposals, I analyse the president’s liberal-progressive idea of history and I propose that in this respect he has followed a certain speculative philosophy of history, which I call philosophy of Trans-Historic-History.

The origins of the Transitional Programme in Trotsky’s writings have been traced in the secondary literature. Much less attention has been paid to the earlier origins of the Transitional Programme in the debates of the Communist International between its Third and Fourth Congress, and in particular to the contribution of its largest national section outside Russia, the German Communist Party, which had been the origin of the turn to the united-front tactic in 1921. This article attempts to uncover the roots (...) of the Transitional Programme in the debates of the Communist International. This task is important because it shows that the Transitional Programme’s slogans are not sectarian shibboleths, but the result of the collective revolutionary experience of the working class during the period under consideration, from the Bolshevik Revolution to the founding conference of the Fourth International. Inside the family, all individuals define their identity in relation to previous generations, the present ones, and the future ones. This intergenerational exchange plays important educational roles: it fosters a sense of belonging and identification, promotes dialogue, and guarantees the passing down of ethical orientations. In addition to feelings of security and reliance on others, family memory creates a matrix that gives people a placement in the world, a sort of existential code through which to be located in existence. Fostering (...) the habit of memory-making becomes therefore a major educational imperative, which however is not without challenges. The present contribution will consider those phenomena which can give rise to a weakening of bonds between generations and a growing exclusion of the ethical value of family heritage. Transitional Justice (TJ) focuses on the processes of dealing with the legacy of large-scale past abuses (in the aftermath of traumatic experiences such as war or authoritarianism) with the aim of fostering domestic justice and creating the basis for a sustainable peace. TJ however also entails the problem of how a torn society may be able to become a self-determining member of a just international order. This paper presents a minimal conception of TJ, which departs from Rawls' conception of normative (...) stability of the international order, which suggests disentangling the two goals of fostering democracy within torn societies and TJ itself. The scope of TJ is therefore limited to enabling these societies to create minimal internal conditions for joining a just international order on equal footing. This paper makes an original contribution to two different debates, namely normative research on TJ, and post-Rawlsian literature in general. First, it provides a new direction for normative theorizing about TJ which takes both its domestic and international dimensions seriously into consideration. Second, it extends Rawls' political liberal outlook to an area where it is not usually understood to apply. (shrink)

Archaeological facts have a perplexing character; they are often seen as less likely to “lie,” capable of bearing tangible, material witness to actual conditions of life, actions and events, but at the same time they are notoriously fragmentary and enigmatic, and disturbingly vulnerable to dispersal and attrition. As Trouillot (1995) argues for historical inquiry, the identification, selection, interpretation and narration of archaeological facts is a radically constructive process. Rather than conclude on this basis that archaeological facts and fictions are indistinguishable, (...) I identify a number of strategies that archaeologists rely on to make discerning use of “legacy” data – archaeological data recovered and curated over for decades, even centuries, often for very different purposes than those that animate contemporary archaeological inquiry. These include source criticism, secondary retrieval, repositioning and recontextualizing these data in ways that can, sometimes radically shift the “facts” associated with them. The construction of critical genealogies of these facts – the travels and transformations of the material, interpretive and narrative facts of archaeology – is a crucial condition for the successful exploitation of these epistemic possibilities. Nicholas of Cusa (1401-1464) was active during the Renaissance, developing adventurous ideas even while serving as a churchman. The religious issues with which he engaged – spiritual, apocalyptic and institutional – were to play out in the Reformation. These essays reflect the interests of Cusanus but also those of Gerald Christianson, who has studied church history, the Renaissance and the Reformation. The book places Nicholas into his times but also looks at his later reception. The first part addresses institutional issues, (...) including Schism, conciliarism, indulgences and the possibility of dialogue with Muslims. Biological sex should be “acknowledged” and “accepted”—but which responses to gender dysphoria might this preclude? Trans-identified people may factually acknowledge their biological sex and regard transition as purely palliative. While generally some level of self-deception and even a high level of nonlying deception of others are sometimes justified, biological sex is important, and there is a nontrivial onus against even palliative, nonsexually motivated cross-dressing. The onus is higher against co-opting the body, even in a minor and/or reversible way, to (...) make a false communication concerning one’s sex. Hardest to defend is the destruction of sexual–reproductive functions and causally downstream functions such as lactation: due to the transcendent nature of sexual–reproductive functions, an appeal to the “principle of totality” here is misplaced. This is not to say that social, and milder medical, transition is absolutely excluded even for severe unmanageable dysphoria, nor that subsequent to any transition, detransition is necessarily required. This is a expository and critical review of Arthur Schlesinger, Jr. 's last book, War and the American Presidency. The book collects and focuses recent writings of Arthur Schlesinger on the themes of its title. In its short Foreword and seven concise essays, the book aims to explore, in some contrast with the genre of “instant history,” the relationship between President George W. Bush’s Iraq adventure and the national past. This aim and the present work are deserving of wide (...) attention, both because of the contemporary need to deal with the extended war in Iraq and because Americans, in particular, need to attend to their own history, if we are to avoid past mistakes and make the best use of our ongoing political traditions and institutions. In order to know better where we might go in the future, we need an adequate picture of where we have been in the past. Schlesinger invites us to debate the war, the Presidency, and their relation to the American past. (shrink)

In the last decade, online learning has grown rapidly. However, the outbreak of coronavirus (COVID-19) has caused learning institutions to embrace online learning due to the lockdown and campus closure. This paper presents an analysis of students’ feedback (n=354) from the Centre of Pre-University Studies (PPPU), Universiti Malaysia Sarawak (UNIMAS), Malaysia, during the transition to fully online learning. Three phases of online surveys were conducted to measure the learners’ acceptance of the migration and to identify related problems. The result (...) shows that there is an increased positivity among the students on the vie of teaching and learning in STEM during the pandemic. It is found that online learning would not be a hindrance, but blessing towards academic excellence in the face of calamity like the COVID-19 pandemic. The suggested future research direction will be of interest to educators, academics, and researchers’ community. (shrink)

The Philippine government has been relentless in its counterinsurgency campaigns. From the colonial wars that vilified as insurgents and bandits the honored heroes of today, up to the anti-communist and anti-secessionist civil and military efforts of the postcolonial regimes, these campaigns have not only rolled out large state resources but also cost lives of innocent civilians. Patterned after the United States (US) of America’s principle of low-intensity conflict aimed at countering Marxist and anti-imperialist movements (Reed 1986), counterinsurgency campaigns have unleashed (...) a warfare that indiscriminately target its supposed opponents, including unarmed activists. In 2007, the United Nations Special Rapporteur Philip Alston examined the horrible political situation of the Philippines – characterized by political killings, abductions, and tortures – and identified how state elements, under the blanket protection of waging a counterinsurgency campaign, were responsible for the political repressions then (Sales 2009). Today, under the murderous Duterte regime, the counterinsurgency campaign has reached an unprecedented level of ferocity as it is waged through a militarist whole-ofnation approach composed by multi-level government and multi-agency responses. -/- Being greatly influenced by the US, counterinsurgency campaigns in the Philippines follow the paranoiac and hysterical communist witch-hunt of McCarthyism (Hutchins-Viroux 2008). The hysteria’s contemporary and local expression is the phenomenon called red- or terror-tagging.1 Terror-tagging is the systematic process of maliciously naming or identifying an individual or group as a communist and/or terrorist by its association with a supposed communist and/or terrorist group. Being a systematic process, it is initiated and sustained by state elements with the view of maligning or defaming political activists. Terror-tagging is aimed against activists, dissenters, and even the political opposition. The social activist Rhoda Dalang (2014) has noted how terror-tagging has been deployed by the Philippine state in its counterinsurgency efforts, from the Marcos up to the then Aquino regime. And until the previous Duterte regime, yet with increased intensity and fatality, terror-tagging continued to defame and liquidate activists. As terror-tagging has not received enough academic attention, this chapter aims to fill this gap by providing a preliminary analysis of it. The chapter will be doing a critical discourse analysis. It will take off from a revealing study done by Don Kevin Hapal and Raisa Serafica of Rappler, a media outlet in the Philippines. Through a separate discourse analysis of Facebook posts of the National Task Force to End Local Communist Armed Conflict (NTFELCAC),2 the chapter will also identify aspects of terror-tagging. The discussion will further be theorized using the Marxist analysis of the State and informed by interviews of Atty. Maria Sol Taule and Cristina Palabay. They are both human rights workers who have worked with terror-tagged activists and are themselves subjected to terror-tagging. (shrink)

It is commonly assumed that causation is transitive and in this paper I aim to reconcile this widely-held assumption with apparent evidence to the contrary. I will discuss a familiar approach to certain well-known counterexamples, before introducing a more resistant sort of case of my own. I will then offer a novel solution, based on Yablo’s proportionality principle, that succeeds in even these more resistant cases. There is a catch, however. Either proportionality is a constraint on which causal claims are (...) true, and the solution works, or it is not and causation is not transitive after all. I will argue that the first horn has unacceptable consequences and should be rejected, but that the second horn is less costly than it might initially appear. (shrink)

A growing number of young people with disabilities is pursuing university education. Available research on the impact of Information and Communication Technologies on this matter has mainly focused on assistive technologies and their compensatory role for the adjustment of this group of students to the tertiary setting. However, limited research has looked at the role played by digital technologies such as social media and mobile devices in the transition to university, a critical period of change for all students but (...) more challenging for those with impairments. This paper presents the findings of an empirical study that investigated the experiences of students with vision impairments aged 18 to 24 who were transitioning to a New Zealand university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The study found that new technologies play several enabling roles that help students to manage diverse transition challenges. These roles not only include aspects such as impairment compensation, communication, information, and learning but also support arrangement, collaboration, and social connection and participation. By incorporating in the analysis the potential of digital tools, the article updates and expands the understanding of the role of ICTs in higher education from experiences and views of young people with vision impairments. In this chapter I will argue against both of these interpretations and will begin to develop an alternate account of imagination in experience. Against those who minimize imagination’s role, I will highlight the distinctive contribution of the imagination to experience. In particular, I will foreground the specific role that the imagination plays in making possible the distinct mental act, intermediate between intuition and experience, that Kant calls “perception [Wahrnehmung]” as the “empirical consciousness [Bewußtsein]” of appearances (cf. B207). Because perception involves (...) images essentially (cf. A120), and because Kant understands experience itself to be a “synthesis of perceptions” (cf. B218), this strongly suggests (against minimalists) that experience, too, will incorporate images into the manner in which it allows us to cognize physical objects. By highlighting the contribution of imagination prior to experience, my own account, therefore, overlaps in part with the readings that seek instead to maximize the role of imagination. Against maximalists, however, I will argue that imagination contributes only in (and after) the transition from intuition to perception, rather than already being at work in the stage of intuition itself. More specifically, I will argue that Kant takes the activity of imagination to make perception possible by acting on already-formed intuitions in order to bring about the consciousness of them, rather than to bring the intuitions about in the first place. I will also argue that this synthesis of intuitions should be kept distinct from the activity of understanding. (shrink)

In 'Rethinking the Good', Larry Temkin makes two core claims. First, the goodness of a distribution is sometimes ‘essentially comparative’ – it sometimes depends on which alternative distribution(s) it is compared to. Second, such cases threaten the transitivity of ‘all things considered better than’. I argue that the goodness of a distribution may indeed depend on what other distributions are feasible. But contrary to Temkin, I also argue that transitivity holds even when the goodness of a distribution depends on the (...) feasible set of which it is a member. (shrink)

The aim of this paper is to show in what terms reality can be considered as a stratification of surfaces by developing Mario Perniola's philosophy of transit. The first part will deal with the etymology of the word transit, in order to explain its meanings and uses. As it will be clarified, the development of the notion of transit goes together with the conception of reality as deep in the sense of full, available, rich, as the realm of "difference" and (...) "enigmas". The second part will explain the particular conception of temporality implied in the transit. Together with Perniola's analysis, Nietzschean and Deleuzian reflections about "amor fati" and "eternal return" will be further explored. This concept is crucial to understand not only Perniola's overall philosophy by clarifying his position against postmodern thinkers; it also provides a theoretical framework from which the task and the challenge of the philosopher in the contemporary world emerge. On what I take to be the standard account of supererogation, an act is supererogatory if and only if it is morally optional and there is more moral reason to perform it than to perform some permissible alternative. And, on this account, an agent has more moral reason to perform one act than to perform another if and only if she morally ought to prefer how things would be if she were to perform the one to how things would be (...) if she were to perform the other. I argue that this account has two serious problems. The first, which I call the latitude problem, is that it has counterintuitive implications in cases where the duty to be exceeded is one that allows for significant latitude in how to comply with it. The second, which I call the transitivity problem, is that it runs afoul of the plausible idea that the one-reason-morally-justifies-acting-against-another relation is transitive. What’s more, I argue that both problems can be overcome by an alternative account, which I call the maximalist account. (shrink)

No USA president in history has received as much opposition as Donald Trump has from all three components of the Establishment, namely the financial establishment, the political establishment and the corporate media establishment. The election of Donald Trump to the office of presidency is marked with dozens of historical first events that are anything but lackluster, yet a bleak picture of Fascism has been painted to describe Trump. This is an extraordinary piece of disinformation, as no modern president has (...) been more consistent in plainly saying what he will do regarding US military and geopolitical goals, both outside and in office. This, even though his stated position is clearly opposite to the wishes of the dominant cabal, supported by both parties, and to US foreign policy since WWII. USA history is not very long, but Trump presidency and his inaugural speech marked a historic starting point for this 'democracy'. Every sentence of Donald J. Trump's inaugural speech was a departure from diplomacy. Knowing what diplomacy actually means, it's a great step toward transparency. It is the best thing that happened in US political history. It is no surprise the Media established completely flipped, the political establishment gasped, and the financial establishment started to conspire a different strategy (George Soros declaring he wants Trump presidency to fail). In the mean time, the typically apolitical science and technology establishment declared Trump completely unfit for the office that he has just been elected to. Trump’s inaugural speech that contained phrases like, "It's time to remember that old wisdom our soldiers will never forget, that whether we are black or brown or white, we all bleed the same red blood of patriots", was in sharp contrast to how Abraham Lincoln viewed America, when he said, "I, as much as any other man, stand in favor of having the superior position assigned to the white race… I have no purpose to introduce political and social equality between the white and the black races." Trump’s embrace of humanity and righteousness was reminiscent of Prophet Muhammad’s last sermon at the pilgrimage, where he said over 1400 years, "An Arab is no better than a non-Arab, and a non-Arab is no better than an Arab; a red man is no better than a black man and a black man is no better than a red man – except if it is in terms of piety." Yet, Trump took oath of office swearing on the bible used by Abraham Lincoln. In this two-part paper, the key research question answered is what Trump presidency stands for. In answering this question, the first part deconstructs some of the dominant theories of Fascism. Then, a delinearized history is constructed in order to understand how democracy, as applied in USA, has an inevitable outcome of achieving the same goals as a Fascist regime. The concept of religious extremism, including “Islamic terrorism” or “radical Islam” is also discussed with relevance to ‘war on terror’. The history of US presidency then shows that the office of presidency is used as a tool to advance a Fascist agenda, albeit being packaged as USA exceptionalism. The ground is set for part 2 that analyses the rise of Trump and the demise of DNC integrity, followed by deconstruction of various allegations against Trump. (shrink)

This paper aims to argue for, else illustrate the epistemological significance of the use of non transitive similarity relations, mapping only to "types", as methodologically being on a par with the use of transitive similarity relations (equivalence relations), mapping as well to "predicates". -/- In this paper the sketch of an exact but simple geometrical model of the above construct is followed by mentioning respective use cases for non transitive similarity relations from science and humanities. With the present paper I maintain that the group field theory (GFT) approach to quantum gravity can help us clarify and distinguish the problems of spacetime emergence from the questions about the nature of the quanta of space. I will show that the mechanism of phase transition suggests a form of indifference between scales (or phases) and that such an indifference allows us to black-box questions about the nature of the ontology of the fundamental levels of the theory. I (...) consider the GFT approach to quantum gravity which derives spacetime as an emergent property from abstract non-geometrical tetrahedra through a processes of phase transition. Because the physical interpretation of the tetrahedra is problematic in view of their (non)-spatiotemporal nature, I will apply the considerations about phase transitions to GFT and conclude that the fundamental ontology of the theory and the mechanism of spacetime emergence can and should be treated separately. With her new book, The Conceptual Foundations of Transitional Justice, Colleen Murphy has advanced novel, comprehensive and sophisticated philosophical accounts of both what severely conflict-ridden societies should be aiming for and how they should pursue it. Ultimately grounded on a prizing of rational agency, Murphy maintains that these societies, roughly, ought to strive for a stable and legitimate democratic polity committed to not repeating gross historical injustice and do so in ways that do right by victims. In this article, I (...) argue, contra Murphy, that achieving democratic rights to political participation should not be considered an essential aim of transitional justice, and that, in contrast, doing right by victims should be considered an essential aim of it, not merely an appropriate means to achieving other aims. In addition, I highlight an issue downplayed in Murphy’s book, namely, the need to make trade-offs amongst the aims of transitional justice, which becomes particularly pressing upon accepting that doing right by victims is one of them. Unconscious logical inference seems to rely on the syntactic structures of mental representations (Quilty-Dunn & Mandelbaum 2018). Other transitions, such as transitions using iconic representations and associative transitions, are harder to assimilate to syntax-based theories. Here we tackle these difficulties head on in the interest of a fuller taxonomy of mental transitions. Along the way we discuss how icons can be compositional without having constituent structure, and expand and defend the “symmetry condition” on Associationism (the idea that associative links and (...) transitions are perfectly symmetric). In the end, we show how a BIT (“bare inferential transition”) theory can cohabitate with these other non-inferential mental transitions. (shrink)
