By synthesizing the argumentation theory of new rhetoric with research on heuristics and motivated reasoning, we develop a conceptual view of argumentation based on reasoning motivations that sheds new light on the morality of decision-making. Accordingly, we propose that reasoning in eristic argumentation is motivated by psychological (e.g., anxiety reduction) or material (e.g., vested interests) gains that do not depend on resolving the problem in question truthfully. Contrary to heuristic argumentation, in which disputants genuinely argue to reach a practically rational (...) solution, eristic argumentation aims to defeat the counterparty rather than seeking a reasonable solution. Eristic argumentation is susceptible to arbitrariness and power abuses; therefore, it is inappropriate for making moral judgments with the exception of judgments concerning moral taboos, which are closed to argumentation by their nature. Eristic argumentation is also problematic for strategic and entrepreneurial decision-making because it impedes the search for the right heuristic under uncertainty as an ecologically rational choice. However, our theoretical view emphasizes that under extreme uncertainty, where heuristic solutions are as fallible as any guesses, pretense reasoning by eristic argumentation may be instrumental for its adaptive benefits. Expanding the concept of eristic argumentation based on reasoning motivations opens a new path for studying the psychology of reasoning in connection to morality and decision-making under uncertainty. We discuss the implications of our theoretical view to relevant research streams, including ethical, strategic and entrepreneurial decision-making. (shrink)

This paper makes an independent start with formalizing the rules for the argumentation stage of critical discussions. It does not deal with the well-known code of conduct consisting of ten rules but with the system consisting of fifteen rules on which the code of conduct is based. The rules of this system are scrutinized and problems they raise are discussed. Then a formal dialectical system is defined that reflects most of the contents of these rules. The aim is to elucidate (...) the way the rules work and to show how a formal approach can be useful to achieve this. It is also shown how the present method can be used to study the nature of circular argumentation. While, generally, the formalization follows closely the original rules for the argumentation stage of critical discussions, there will also be proposed some modifications of the original protocol. The thesis of the paper holds that some future developments of argumentation theory may be inspired by the rich logico-methodological legacy of the Lvov–Warsaw School (LWS), the Polish research movement that was most active from 1895 to 1939. As a selection of ideas of the LWS which exploit both formal and pragmatic aspects of the force of argument, we present: Ajdukiewicz’s account of reasoning and inference, Bocheński’s analyses of superstitions or dogmas, and Frydman’s constructive approach to legal interpretation. This paper (...) does not aim at exhaustive elaboration of any of these topics or their usefulness in current discussions within argumentation theory. Rather, we intend to indicate chosen directions of a potentially fruitful research program for the emerging Polish School of Argumentation which would consist in application of methods and conceptions elaborated by the LWS to selected open problems of contemporary research on argumentation. We submit a normative pragmatic theory of exhorting—an account of conceptually necessary and potentially efficacious components of a coherent strategy for securing a sympathetic hearing for efforts to urge and inspire addressees to act on high-minded principles. Based on a Gricean analysis of utterance-meaning, we argue that the concept of exhorting comprises making statements openly urging addressees to perform some high-minded, principled course of action; openly intending to inspire addressees to act on the principles; and intending that addressees’ recognition of (...) the intentions to urge and inspire creates reasons for addressees to grant a sympathetic hearing to what the speaker has to say. We show that the theory accounts for the design of Abraham Lincoln’s Cooper Union address. By doing so we add to the inventory of reasons why social actors make arguments, continue a line of research showing the relationship of arguing to master speech acts, and show that making arguments can be an effective strategy for inspiring principled action. We all seem to have a sense of what good and bad arguments are, and there is a long history—focusing on fallacies—of trying to provide objective standards that would allow a clear separation of good and bad arguments. This contribution discusses the limits of attempts to determine the quality of arguments. It begins with defining bad arguments as those that deviate from an established standard of good arguments. Since there are different conceptualizations of “argument”—as controversy, as debate, and as justification—and (...) since arguments in each of these senses can be used for different purposes, a first problem is that we would need a large variety of standards for “good” arguments. After this, the contribution focuses in particular on proposals made in the literature on how to assess the quality of arguments in the sense of justification. It distinguishes three problems of assessment: How to determine whether reasons are acceptable, whether reasons are sufficient to justify the conclusion, and how to identify arguments in real-world speech acts and texts? It is argued that limitations of argument assessment result from unavoidable relativism: The assessment of many—if not most—arguments depends on the epistemic situation of the evaluator. (shrink)

This paper argues that some words are so highly charged with meaning by a community that they may prevent a discussion during which each participant is on an equal footing. These words are indeed either unanimously accepted or rejected. The presence of these adjectival groups pushes the antagonist to find rhetorical strategies to circumvent them. The main idea we want to develop is that some propositions are not easily debatable in context because of some specific value-bearing words, and one of (...) the goals of this paper is to build a methodological tool for finding and classifying these VBWs. Our study echoes the importance of “cultural keywords” in argument, but is rather based on a German approach developed by,, and about “Miranda” and “Anti-Miranda” words that is expanded and refined here. In particular, our study tries to understand why some statements, fueled by appreciative or evaluative adjectives, have such rhetorical effects on a pragmatic level in the particular context of a vote on the Swiss popular initiative called “for more affordable housing”. This context is fruitful since two parties offer reasons for two opposing policy claims: namely, to accept or to reject an initiative. When one party uses arguments containing such universally unassailable adjectival groups to defend a “yes” vote, the opposing party cannot use a symmetrical antonym while pleading for the “no” vote. The methodological tool that is proposed here could shed light on the use of certain rhetorical and referential strategies in conflicting policy proposition contexts. (shrink)

The aim of this paper is to describe the way in which argumentative patterns come into being in plenary debate over legislative issues in the European Parliament. What kind of argumentative patterns are to be expected within this macro context? It is shown that the argumentative patterns that come into being in legislative debate in the European Parliament depend for the most part on the problem-solving argumentation that is put forward in the opening speech by the rapporteur of the parliamentary (...) committee report. This argumentation can be pragmatic problem-solving argumentation or complex problem-solving argumentation. The most important prototypical argumentative patterns are investigated in the argumentation put forward by the Members of parliament. This investigation is based on an inventory of the arguments that can in principle be used to support or attack the initial problem-solving argumentation put forward by the rapporteur. (shrink)

According to van Eemeren, argumentation theory is a hybrid discipline, because it requires a multidisciplinary, if not interdisciplinary approach, combining descriptive and normative insights. He points out that modern argumentation theorists give substance to the discipline by relying either on a dialectical perspective, concentrating on the reasonableness of argumentation, or on a rhetorical perspective, concentrating on its effectiveness. Both the dialectical and the rhetorical perspective are interpreted in ways related to how they were viewed by Aristotle, but in modern argumentation (...) theory the relationship between the two, captured in Aristotle’s term antistrophos, is lost. According to van Eemeren, this relationship, which he considers crucial to a full-fledged argumentation theory, has been recovered in extended pragma-dialectics with the help of the theoretical notion of ‘strategic manoeuvring.’. The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. There is an extensive scholarly literature on these topics, and it is a secondary aim of the chapter to provide readers the means to find their way in historical and ongoing debates.

Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. Philosophers of science have given up on the quest for a silver bullet to put an end to all pseudoscience, as such a neat formal criterion to separate good science from its contenders has proven elusive. In the literature on critical thinking and in some philosophical quarters, however, this search for silver bullets lives on in the taxonomies of fallacies. The attractive idea is to have a handy list of abstract definitions or argumentation schemes, on the basis of which one (...) can identify bad or invalid types of reasoning, abstracting away from the specific content and dialectical context. Such shortcuts for debunking arguments are tempting, but alas, the promise is hardly if ever fulfilled. Different strands of research on the pragmatics of argumentation, probabilistic reasoning and ecological rationality have shown that almost every known type of fallacy is a close neighbor to sound inferences or acceptable moves in a debate. Nonetheless, the kernel idea of a fallacy as an erroneous type of argument is still retained by most authors. We outline a destructive dilemma we refer to as the Fallacy Fork: on the one hand, if fallacies are construed as demonstrably invalid form of reasoning, then they have very limited applicability in real life. On the other hand, if our definitions of fallacies are sophisticated enough to capture real-life complexities, they can no longer be held up as an effective tool for discriminating good and bad forms of reasoning. As we bring our schematic “fallacies” in touch with reality, we seem to lose grip on normative questions. Even approaches that do not rely on argumentation schemes to identify fallacies fail to escape the Fallacy Fork, and run up against their own version of it. (shrink)

According to Douglas Walton, the concept of presumption relates to both logical and dialogical components. Logically, a presumption is the conclusion of a presumptive defeasible inference. Dialogically, the function of a presumptions to shift the burden of proof to the respondent in order to move the dialogue forward when the proponent, due to an objective lack of evidence, cannot present a sufficiently persuasive proposition. Presumptive status, assigned only at the argumentation stage of dialogue, is provisional: a particular presumption stands until (...) further counter-indications are found. This paper points out some possible difficulties pertaining to Walton’s dialogical model of presumption. Firstly, once a presumption's typical practical function is made precise, Walton’s idea of presumption starts to lose its conceptual cohesion, thereby becoming applicable in the opening stage of dialogue, as well. Secondly, cohesion is lost also in practical contexts, since Walton's "seat belts" example might indicate that presumptions are not evidentially defeasible if the practical stakes are raised high enough. Most importantly, contextual evaluation may reveal that presumptions do not shift the burden of proof in any specific or genuine way. (shrink)

That bootstrapping and Moorean reasoning fail to instantiate persuasive argumentation is an often informally presented but not systematically developed view. In this paper, I will argue that this unpersuasiveness is not determined by principles of justification transmission but by two straightforward principles of rationality, understood as a concept of internal coherence. First, it is rational for S to believe the conclusion of an argument because of the argument, only if S believes sufficiently many premises of the argument. Second, if S (...) doubts that a source O is reliable and believes that information i is delivered by O, then S rationally suspends judgment about the truth of i. This paper aims to accomplish two tasks. First, it provides a thorough analysis of why bootstrapping argumentation is not an instance of rational persuasion. Recent scholarship in the field of argumentation theory has shown an increasing interest in rethinking the relation between dialectic and rhetoric. In the debate concerning this issue, some scholars take the position of ‘isolationists’. They think that fundamental differences exist between the two disciplines and that it is impossible to translate insights developed within the one discipline in terms of the other. Other scholars can be characterized as ‘combinationalists’. They take the position that insights from dialectic and rhetoric can be (...) combined for the purpose of analyzing or evaluating argumentative discourse. In this paper a dialogue game for critical discussion is developed. The dialogue game is a formalisation of the ideal discussion model that is central to the pragma-dialectical theory of argumentation. The formalisation is intended as a preparatory step to facilitate the development of computational tools to support the pragma-dialectical study of argumentation. An important dimension of the pragma-dialectical discussion model is the role played by speech acts. The central issue addressed in this paper is how the speech act perspective (...) can be accommodated in the formalisation as a dialogue game. The starting point is an existing ‘basic’ dialogue game for critical discussion, in which speech acts are not addressed. The speech act perspective is introduced into the dialogue game by changing the rules that govern the moves that can be made and the commitments that these result in, while the rules for the beginning, for the end, and for the structure of the dialogue game remain unchanged. The revision of the move rules is based on the distribution of speech acts in the pragma-dialectical discussion model. The revision of the commitment rules is based on the felicity conditions that are associated with those speech acts. (shrink)

Information technology is so ubiquitous and AI’s progress so inspiring that also legal professionals experience its benefits and have high expectations. At the same time, the powers of AI have been rising so strongly that it is no longer obvious that AI applications (whether in the law or elsewhere) help promoting a good society; in fact they are sometimes harmful. Hence many argue that safeguards are needed for AI to be trustworthy, social, responsible, humane, ethical. In short: AI should be (...) good for us. But how to establish proper safeguards for AI? One strong answer readily available is: consider the problems and solutions studied in AI & Law. AI & Law has worked on the design of social, explainable, responsible AI aligned with human values for decades already, AI & Law addresses the hardest problems across the breadth of AI (in reasoning, knowledge, learning and language), and AI & Law inspires new solutions (argumentation, schemes and norms, rules and cases, interpretation). It is argued that the study of AI as Law supports the development of an AI that is good for us, making AI & Law more relevant than ever. (shrink)

This paper serves as an introduction to the special issue on argumentative patterns in discourse, more in particular on argumentative patterns with pragmatic argumentation as a main argument that are prototypical of argumentative discourse in certain communicative activity types in the political, the legal, the medical, and the academic domain. It situates the studies of argumentative patterns reported in these papers in the pragma-dialectical research program. In order to be able to do so, it is first explained in which consecutive (...) stages the pragma-dialectical theorizing has developed, what the study of argumentative patterns involves, and why the identification of argumentative patterns represents a vital stage in the development of pragma-dialectics. The description of the theoretical innovations that are introduced and the exposition of their relationship with the standard and extended pragma-dialectical theory create a conceptual and terminological framework for understanding the background and the rationale of the current research projects. The article focuses on the new rhetoric category of quasi-logical arguments, defined as arguments similar to logical or mathematical demonstrations, and therefore having an effect on the audience. Connecting the similarity of arguments to formal demonstrations with the claim of effect on audience is conceived in this article as the thesis of effectiveness of quasi-logical arguments. The components of the thesis are reconstructed and analyzed, and their precise definitions are proposed. The analysis shows that the category of quasi-logical arguments is (...) ambiguously defined and currently includes three different concepts based on a different understanding of similarity. Subsequently, it is showed that based on Perelman and Olbrechts-Tyteca’s works, the explanation of quasi-logical arguments’ effect on an audience can be offered in terms of socially shared standards of community or in terms of individual processing of arguments. It is shown that these explanations can be in conflict each other regarding the assumption of the addressee’s acquaintance with formal principles. (shrink)

Central to Perelman and Olbrechts-Tyteca’s philosophical revival of rhetoric and dialectic is the importance given to the temporal character of argumentation. Unlike demonstration, situated within the “empty time” of a single instant, the authors of The New Rhetoric understand argumentation as an action that unfolds within the “full time” of meaningful human life. By taking a broader view of his work beyond The New Rhetoric, I first outline Perelman’s understanding of time and temporality and the challenge that it poses for (...) the study of argumentation. Next, I emphasize the distinction between argumentation’s internal and external temporal structures, and then show how Perelman problematizes a static view of a number of basic argumentative concepts by bringing out their essentially temporal character. Finally, in clarifying what is at stake in Perelman’s account, I conclude by drawing attention to a number of issues in contemporary argumentation studies that may benefit from a reconsideration of Perelman’s analysis of time. France and New Caledonia are currently involved in an ongoing debate surrounding the independence of the latter from the former that will lead to referenda in 2018–2022. The main stakeholders in the negotiation process are France, the Caldoche population of the island agglomeration and its Kanak inhabitants. Most critical discourse studies analyse texts as expressions of power entrenched in monologues. In this paper, however, the debate between the social actors is seen as a plurilogue. The study argues that the dominant (...) interactants propagate a rhetoric of unity and homogeneity, aiming to further marginalise the Kanak people and other minority groups in New Caledonian society by rendering them invisible. It further argues that the French political power aims to persuade the other groups to accept the reality of a common destiny as a given truth. The paper combines Systemic Functional Linguistics and Pragma-dialectics, and incorporates postcolonial and poststructuralist perspectives into a critical study of discourse samples, taken from a larger corpus of French data, across various genres and registers. The analysis reveals that the French rhetoric of unity is built upon Republican principles inherent to neo-colonialist ideology. It also shows that the French rhetoric is being reproduced by local settler interactants, based on values that pertain to Caldoche nationalist ideology. Both French and Caldoche ideologies are in discord with Kanak socialist ideology. By exposing the existing power inequalities the study does not only contribute to defending the Kanak minority discourse, but also emphasises the rights for recognition and self-determination of the Kanak indigenous people of New Caledonia. Disagreements come in all shapes and sizes, but epistemologists and argumentation theorists have singled out a special category referred to as deep disagreements. These deep disagreements are thought to pose philosophical and practical difficulties pertaining to their rational resolution. In this paper, I start with a critique of the widespread claim that deep disagreements are qualitatively different from normal disagreements because they arise from a difference in ‘fundamental principles’ or ‘hinge commitments.’ I then defend the following two claims: All disagreements (...) are deep to the extent that they are actual disagreements. This first claim implies, I will argue, that disagreements typically regarded as normal can be explained away as misunderstandings or communicative mishaps. The resolution of a disagreement can be rational either through a joint experience of mutually recognized facts or through an exchange of arguments that leads to a reformulation of the disagreement that, in this new form, lends itself to a resolution through a joint experience of mutually recognized facts. I conclude with a reflection on the consequences of these two theses for the idea of deep disagreement and that of rational resolution. (shrink)

This article seeks to extend existing models of argumentation by considering an important dimension of real-life argumentative discourse: how complex argumentative discussions evolve over time. We define a complex argumentative discussion as a multi-issue discussion, in which the different issues are interrelated in the form of a hierarchy. We claim that justified reframing might be used to transform a single-issue argumentative discussion into a complex argumentative discussion. To illustrate this, we examine the Facebook discourse of the Rhodes Must Fall movement (...) in South Africa. We analyse how reframing is justified by means of arguments, allowing the protagonists to claim as legitimate their reframing of a single issue into a complex argumentative discussion. Our findings complement existing sociological research on social movements by highlighting how their goals are achieved by means of argumentative discourse. (shrink)
