En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. Ejercicios decoloniales", el cual plantea un trabajo dialógico y decolonial entre relatos pasados y presentes, llevados a cabo por autores muy diversos en sus trayectorias, generaciones y nacionalidades de la Universidad Nacional de Catamarca y de la Universidad Nacional de La Plata.

Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

In most domains of human life, we are willing to accept that there are experts with greater knowledge and competencies that distinguish them from non-experts or laypeople. Despite this fact, the very recognition of expertise curiously becomes more controversial in the case of “moral experts”. Do moral experts exist? And, if they indeed do, are there ethical reasons for us to follow their advice? Likewise, can emerging technological developments broaden our very concept of moral expertise? In this article, we begin (...) by arguing that the objections that have tried to deny the existence (and convenience) of moral expertise are unsatisfactory. After that, we show that people have ethical reasons to ask for a piece of moral advice in daily life situations. Then, we argue that some Artificial Intelligence (AI) systems can play an increasing role in human morality by becoming moral experts. Some AI-based moral assistants can qualify as artificial moral experts and we would have good ethical reasons to use them. (shrink)

El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. Gorgias’ On Not-Being survives only in two divergent summaries. Diels–Kranz's classic edition prints the better-preserved version that appears in Sextus’ Aduersus Mathematicos. Yet, in recent years there has been rising interest in a second summary that survives as part of the anonymous De Melisso, Xenophane, Gorgia. The text of MXG is more difficult; it contains substantial lacunae that often make it much harder to make grammatical let alone philosophical sense of. As Alexander Mourelatos reports, one manuscript has a scribal note (...) that reads: "The original contains many errors; no one should blame me; I just copy what I see.". The treatise's state of preservation has aptly prompted Michael Gagarin to liken it to a black hole: "something we cannot see directly but know must exist because of certain effects it has on other objects.". The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. Even if this case is coherent, however, it does (...) not show that perceptual experiences are processes. (shrink)

This book explores a question central to philosophy--namely, what does it take for a belief to be justified or rational? According to a widespread view, whether one has justification for believing a proposition is determined by how probable that proposition is, given one's evidence. In this book this view is rejected and replaced with another: in order for one to have justification for believing a proposition, one's evidence must normically support it--roughly, one's evidence must make the falsity of that proposition (...) abnormal in the sense of calling for special, independent explanation. This conception of justification bears upon a range of topics in epistemology and beyond. Ultimately, this way of looking at justification guides us to a new, unfamiliar picture of how we should respond to our evidence and manage our own fallibility. This picture is developed here. I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter. In this paper I propose a new solution to the problem of change: situationalism. According to this view, parts of reality fundamentally disagree about what is the case and reality as a whole is unsettled (i.e. metaphysically indeterminate). When something changes, parts of the world irreconcilably disagree about what properties it has. From this irreconcilable disagreement, indeterminacy arises. I develop this picture using situations, which are parts of possible worlds; this gives it the name situationalism. It allows a B-theory endurance (...) view on which there is genuine incompatibility when things change. There are costs to the view, which are explored, but it is a novel approach which offers a distinct explanation of what happens when things exist through change. (shrink)

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Is it right to convict a person of a crime on the basis of purely statistical evidence? Many who have considered this question agree that it is not, posing a direct challenge to legal probabilism – the claim that the criminal standard of proof should be understood in terms of a high probability threshold. Some defenders of legal probabilism have, however, held their ground: Schoeman (1987) argues that there are no clear epistemic or moral problems with convictions based on purely (...) statistical evidence, and speculates that our aversion to such convictions may be nothing more than an irrational bias. More recently, Hedden and Colyvan (2019, section VI) describe our reluctance to convict on the basis of purely statistical evidence as an ‘intuition’, but suggest that there may be no ‘in principle’ problem with such convictions (see also Papineau, forthcoming, section 6). In this paper, I argue that there is, in some cases, an in principle problem with a conviction based upon statistical evidence alone – namely, it commits us to a precedent which, if consistently followed through, could lead to the deliberate conviction of an innocent person. I conclude with some reflections on the idea that the criminal justice system should strive to maximise the accuracy of its verdicts – and the related idea that we should each strive to maximise the accuracy of our beliefs. Si bien al hablar de igualdad y derechos colectivos nos situamos aparentemente en dos espectros distintos de los derechos humanos, siguiendo a VASAK y su teoría de las tres generaciones, de un lado en el rango de un derecho fundamental, y del otro, en toda una amplia gama de derechos de tercera generación, es en realidad, en una misma órbita en donde debemos ubicarnos: en la del Estado de Social Derecho. Y es allí, donde la capacidad que éste tenga para (...) hacer frente a los desafíos que trae consigo su cumplimiento -sin olvidar el de los derechos económicos, sociales y culturales-, se convierte en el mejor elemento de juicio para determinar su éxito o fracaso, en una sociedad fracturada por un sinnúmero de fenómenos que atentan cada vez más contra las garantías y libertades de los ciudadanos. En este contexto, en el marco del programa de actividades formativas del Doctorado en Estudios Interdisciplinares de Género y Políticas de Igualdad, se organizó un Foro Académico cuya pretensión no era otra sino la de presentar a la comunidad una serie de reflexiones sobre algunos de estos mencionados fenómenos, a partir de la visión aquí propuesta. In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.

The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

This work deals with the particular nature of consciousness in comparison to matter, as well as with the question of how conscious subjective experience can be possible at all. Based on a step-by-step derivation, a new approach is introduced and a theory for a possible explanation is proposed, named C-Pattern Theory. The statements and implications resulting from C-Pattern Theory reveal new perspectives on elementary aspects of reality and open up new possibilities with regard to fundamental questions.

In this note we shall argue that Milne’s new effort does not refute Truthmaker Maximalism. According to Truthmaker Maximalism, every truth has a truthmaker. Milne has attempted to refute it using the following self-referential sentence M: This sentence has no truthmaker. Essential to his refutation is that M is like the Gödel sentence and unlike the Liar, and one way in which Milne supports this assimilation is through the claim that his proof is essentially object-level and not semantic. In Section (...) 2, we shall argue that Milne is still begging the question against Truthmaker Maximalism. In Section 3, we shall argue that even assimilating M to the Liar does not force the truthmaker maximalist to maintain the ‘dull option’ that M does not express a proposition. There are other options open and, though they imply revising the logic in Milne’s reasoning, this is not one of the possible revisions he considers. In Section 4, we shall suggest that Milne’s proof requires an implicit appeal to semantic principles and notions. In Section 5, we shall point out that there are two important dissimilarities between M and the Gödel sentence. Section 6 is a brief summary and conclusion. (shrink)

Philosophers of logic are particularly interested in understanding the aims, epistemology, and methodology of logic. This raises the question of how the philosophy of logic should go about these enquires. According to the practice-based approach, the most reliable method we have to investigate the methodology and epistemology of a research field is by considering in detail the activities of its practitioners. This holds just as true for logic as it does for the recognised empirical and abstract sciences. If we wish (...) to systematically understand the aims and epistemology of logic, we are best placed achieving this by looking at what logicians do, rather than reflecting upon the nature of logic itself. In this entry, we outline the motivations for a practice-based approach towards the philosophy of logic and highlight its advantages over more “top-down” approaches, which attempt to infer conclusions about the nature of logic and its methodology on the basis of traditional assumptions about knowledge, metaphysics, or logic itself. We end by addressing several prominent concerns raised against the practice-based approach. (shrink)

There is a type of metaphysical picture that surfaces in a range of philosophical discussions, is of intrinsic interest, and yet remains ill-understood. According to this picture, the world contains a range of standpoints relative to which different facts obtain. Any true representation of the world cannot but adopt a particular standpoint. The aim of this paper is to propose a regimentation of a metaphysics that underwrites this picture. Key components are a factive notion of metaphysical relativity, a deflationary notion (...) of adopting standpoints, and two kinds of valid inference, one that allows one to abandon standpoints and one that does not. To better understand how theories formulated in terms of this framework are situated in dialectical space, I sketch a theory in the philosophy of time that admits both temporal and atemporal standpoints. In Groenendijk & Stokhof [1989] a system of dynamic predicate logic (DPL) was developed, as a compositional alternative for classical discourse representation theory (DRT ). DPL shares with DRT the restriction of being a first-order system. In the present paper, we are mainly concerned with overcoming this limitation. We shall define a dynamic semantics for a typed language with λ-abstraction which is compatible with the semantics DPL specifies for the language of first-order predicate logic. We shall propose to use this (...) new logical system as the semantic component of a Montague-style grammar (referred to as dynamic Montague grammar, DMG), which will enable us to extend the compositionality of DPL to the subsentential level. Furthermore, we shall extend this analysis also in this sense that we shall add new, dynamic interpretations for logical constants which in DPL were treated in a static fashion. This will substantially increase the descriptive coverage of DMG. (shrink)

Entitlement is defined as a sort of epistemic justification that one can possess by default – a sort of epistemic justification that does not need to be earned or acquired. Epistemologists who accept the existence of entitlement generally have a certain anti-sceptical role in mind for it – entitlement is intended to help us resist what would otherwise be compelling radical sceptical arguments. But this role leaves various details unspecified and, thus, leaves scope for a number of different potential conceptions (...) of entitlement. At one extreme there are conceptions that portray entitlement as a weak, attenuated epistemic status and, at the other, we have conceptions that portray entitlement as something potent and strong. Certain intermediate conceptions are also possible. In this paper, I shall argue that the weak and intermediate conceptions of entitlement do not survive careful scrutiny, and the stronger conceptions – while they do, in a way, strain credulity – are the only conceptions that are ultimately viable. ¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

The aim of this paper is to provide a proof-theoretic characterization of relevant logics including fusion and fission connectives, as well as Ackermann’s truth constant. We achieve this by employing the well-established methodology of labelled sequent calculi. After having introduced several systems, we will conduct a detailed proof-theoretic analysis, show a cut-admissibility theorem, and establish soundness and completeness. The paper ends with a discussion that contextualizes our current work within the broader landscape of the proof theory of relevant logics.

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. This paper has two aims. The first is critical: it argues that our mainstream epistemology of disagreement does not have the resources to explain what goes wrong in cases of group-level epistemic injustice. The second is positive: we argue that a functionalist account of group belief and group justification delivers (1) an account of the epistemic peerhood relation between groups that accommodates minority and oppressed groups, and (2), furthermore, diagnoses the epistemic injustice cases correctly as cases of unwarranted belief on (...) the part of the oppressor group. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

The standard of proof applied in civil trials is the preponderance of evidence, often said to be met when a proposition is shown to be more than 50% likely to be true. A number of theorists have argued that this 50%+ standard is too weak – there are circumstances in which a court should find that the defendant is not liable, even though the evidence presented makes it more than 50% likely that the plaintiff’s claim is true. In this paper, (...) I will recapitulate the familiar arguments for this thesis, before defending a more radical one: The 50%+ standard is also too strong – there are circumstances in which a court should find that a defendant is liable, even though the evidence presented makes it less than 50% likely that the plaintiff’s claim is true. I will argue that the latter thesis follows naturally from the former once we accept that the parties in a civil trial are to be treated equally. I will conclude by sketching an alternative interpretation of the civil standard of proof. (shrink)

The historical consensus is that logical evidence is special. Whereas empirical evidence is used to support theories within both the natural and social sciences, logic answers solely to a priori evidence. Further, unlike other areas of research that rely upon a priori evidence, such as mathematics, logical evidence is basic. While we can assume the validity of certain inferences in order to establish truths within mathematics and test scientifi c theories, logicians cannot use results from mathematics or the empirical sciences (...) without seemingly begging the question. Appeals to rational intuition and analyticity in order to account for logical knowledge are symptomatic of these commitments to the apriority and basicness of logical evidence. This chapter argues that these historically prevalent accounts of logical evidence are mistaken, and that if we take logical practice seriously we fi nd that logical evidence is rather unexceptional, sharing many similarities to the types of evidence appealed to within other research areas. In their 2010 book, Biology’s First Law, D. McShea and R. Brandon present a principle that they call ‘‘ZFEL,’’ the zero force evolutionary law. ZFEL says (roughly) that when there are no evolutionary forces acting on a population, the population’s complexity (i.e., how diverse its member organisms are) will increase. Here we develop criticisms of ZFEL and describe a different law of evolution; it says that diversity and complexity do not change when there are no evolutionary causes.

In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. This paper challenges the negative attitudes towards labelled proof systems, usually referred to as semantic pollution, by arguing that such critiques overlook the full potential of labelled calculi. The overarching objective is to develop a practice-based philosophical analysis of labelled calculi to provide insightful considerations regarding their proof-theoretic and philosophical value. To achieve this, successful applications of labelled calculi and related results will be showcased, and comparisons with other relevant works will be discussed. The paper ends by advocating for a (...) more practice-based approach towards the philosophical understanding of proof systems and their role in structural proof theory. (shrink)

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Marginalized people have used body aesthetic practices, such as clothing and hairstyles, to communicate their worth to the mainstream. One such example is respectability politics, a set of practices developed in post-Reconstruction black communities to prevent sexual assault and convey moral standing to the white mainstream. Respectability politics is an ambivalent strategy. It requires assimilation to white bourgeois aesthetic and ethical standards, and so guides practitioners toward blandness and bodily erasure. Yet, it is an aesthetic practice that cultivates moral agency (...) and helps communities avoid violence and meet social and economic goals. I contrast respectability politics with the anti-assimilationist body aesthetics of Chike Jeffers and Janell Hobson. Because these accounts do not seek to neutralize or erase the body, they fundamentally value black people. As such, they more effectively convey personhood than assimilationist strategies do and also demonstrate the positive role that body aesthetics can play in everyday ethical projects. (shrink)

Background Neuroimaging and lesion studies suggested that the dorsolateral prefrontal and posterior parietal cortices mediate visual metacognitive awareness. The causal evidence provided by non-invasive brain stimulation, however, is inconsistent. -/- Objective/hypothesis Here we revisit a major figure discrimination experiment adding a new Kanizsa figure task trying to resolve whether bilateral continuous theta-burst transcranial magnetic stimulation (cTBS) over these regions affects perceptual metacognition. Specifically, we tested whether subjective visibility ratings and/or metacognitive efficiency are lower when cTBS is applied to these two (...) regions in comparison to an active control region. -/- Methods A within-subjects design including three sessions spaced by one-week intervals was implemented. In each session, every participant was administered bilateral cTBS to either prefrontal, control or parietal cortices. Two concurrent tasks were performed, a real and an illusory figure task, stabilising objective performance with use of an adaptive staircase procedure. -/- Results When performing the replicated task, cTBS was found insufficient to disrupt neither visibility ratings nor metacognitive efficiency. However, with use of Kanizsa style illusory figures, cTBS over the dorsolateral prefrontal, but not over the posterior parietal cortex, was observed to significantly diminish metacognitive efficiency. -/- Conclusion(s) Real and illusory figure tasks demonstrated different cTBS effects. A possible explanation is the involvement of the prefrontal cortex in the creation of expectations, which is necessary for efficient metacognition. Failure to replicate previous findings for the real figure task, however, cannot be said to support, conclusively, the notion that these brain regions have a causal role in metacognitive awareness. This inconsistent finding may result from certain limitations of our study, thereby suggesting the need for yet further investigation. (shrink)

The discussion of collective agency involves the reduction problem of the concept of a collective. Individualism and Cartesian internalism have long restricted orthodox theories and made them face the tension between an irreducible concept of a collective and ontological reductionism. Heterodox theories as functionalism and interpretationism reinterpret the concept of agency and accept it as realized on the level of a collective. In order to adequately explain social phenomena that have relations as their essence, in this paper we propose a (...) relational, holistic account of collective agency and argue that functionalism and interpretationism can be integrated into such an account. Una de las características principales del mundo en que vivimos es lo que denominamos la presencia de un vitalismo metabólico. En este artículo queremos profundizar en el uso antropológico-cultural de este concepto al relacionarlo con los deseos humanos de felicidad y salvación y las implicaciones de la tecnología para, finalmente, llevar a cabo una conclusión a través de un posible escenario distópico. Sostenemos que la supremacía cultural de este tipo de vitalismo ha llevado al oscurecimiento de una visión natural y (...) unitaria de la experiencia de la caducidad del cuerpo humano y, por tanto, también de la necesidad natural del hombre de ser salvado. Desde un punto de vista antropológico, analizamos que en la base de todo este proceso se encuentra el recorte de los fines naturales de lo que definimos como intencionalidad corpórea, la cual es difícil de entender si no se produce una integración adecuada, teleológicamente, de los aspectos biológicos y espirituales del ser humano. There is something puzzling about statistical evidence. One place this manifests is in the law, where courts are reluctant to base affirmative verdicts on evidence that is purely statistical, in spite of the fact that it is perfectly capable of meeting the standards of proof enshrined in legal doctrine. After surveying some proposed explanations for this, I shall outline a new approach – one that makes use of a notion of normalcy that is distinct from the idea of statistical frequency. (...) The puzzle is not, however, merely a legal one. Our unwillingness to base beliefs on statistical evidence is by no means limited to the courtroom, and is at odds with almost every general principle that epistemologists have proposed as to how we ought to manage our beliefs. The view that contradictions cannot be true has been part of accepted philosophical theory since at least the time of Aristotle. In this regard, it is almost unique in the history of philosophy. Only in the last forty years has the view been systematically challenged with the advent of dialetheism. Since Graham Priest introduced dialetheism as a solution to certain self-referential paradoxes, the possibility of true contradictions has been a live issue in the philosophy of logic. Yet, despite the arguments (...) advanced by dialetheists, many logicians and philosophers still hold the opinion that contradictions cannot be true. -/- Rather than advocating the truth of certain contradictions, this thesis offers a different challenge to the classical logician. By showing that it can be philosophically coherent to propose that true contradictions are metaphysically possible, the thesis suggests that the classical logician must do more than she currently has to justify her confidence in the impossibility of true contradictions. Simply fighting off the dialetheist’s putative examples of true contradictions at the actual world isn’t enough to justify the classical logician’s conclusion that true contradictions are impossible. -/- To aid the thesis dialectically, we introduce a new position, absolutism, which hypothesises that it’s metaphysically possible for at least one contradiction to be true, contrasting with the dialetheic hypothesis that some contradictions are true in the actual world. We demonstrate that absolutism can be given a philosophically coherent interpretation, an appropriate logic, and that certain criticisms are completely toothless against absolutism. The challenge put to the classical logician is then: On what logical or philosophical grounds can we rule out the metaphysical possibility of true contradictions? (shrink)

I argue that, on Husserl's account, affectivity, along with the closely related phenomenon of association, follows a form of sui generis lawfulness belonging to the domain of what Husserl calls motivation, which must be distinguished both (1) from the causal structures through which we understand the body third-personally, as a material thing; and also (2) from the rational or inferential structures at the level of deliberative judgment traditionally understood to be the domain of epistemic import. In effect, in addition to (...) recognizing a “space of causes” and a “space of reasons,” Husserl’s account of affectivity and the epistemology of passive synthesis in which it is situated suggest that we should recognize a separate “space of motivations.” Within this space, on Husserl’s phenomenological picture, we can isolate two different sorts of epistemic import, one belonging directly to the passive-synthetic content of experience, as explained in Husserl’s account of association and his closely aligned notion of nonlinguistic sense, and a second—my primary focus—affectivity, which is still relevant for that content, albeit indirectly, and holds epistemic import in its determination not of what that content is but of how it comes to matter for us. Disjointism is the view that co-located objects do not share any parts. A human-shaped statue is composed from a torso, head and limbs; the co-located lumpof clay is only composed from chunks of clay. This essay discusses the tenability of this relatively neglected view, focusing on two objections. The first objection is that disjointism implies co-located copies of microphysical particles. I argue that it doesn’t imply this and that there are more plausible disjointist views of tiny parts available. The second (...) objection is that disjointism is at a loss to explain how material objects can be co-located and why the weights of co-located objects don’t add up. The standard pluralist account appeals to the fact that co-located objects stand in mereological relations and this account is not available to the disjointist. I sketch an alternative account that appeals to a notion of ‘material identity’: the statue is taken to be the same matter as the lump of clay. The resort to a new theoretical primitive may seem to invite a quick rejection on grounds of unnecessary theoretical complexity but I argue that an abductive comparison with rival forms of pluralism shows that such a rejection is misguided.
