The Islamic finance industry is relatively new and vibrant. It is becoming a mainstream industry in the MENA. The industry is based on a number of Sharia’a maxims and in particular the prohibition of Riba. Islamic law scholars’ emphasis on the ethical dimension of this industry and how it can be seen as a solution to existing capitalism. The current financial crisis presented this industry with an unprecedented test and an opportunity to influence and merge into main stream finance. This (...) paper presents an evaluation of Islamic finance industry in the current financial crisis and whether the governance and ethical foundation of Islamic finance institutions distinguished itself from conventional finance. Thus, this paper begins with an overview of Islamic finance, then it discusses the governance framework structure of Islamic finance institutions and the role of its organs. In addition, this paper will compare between the ethical framework of the Islamic finance institutions and the conventional institutions. Finally, this paper will discover the ethical failure of the current global financial system and its relation with the current financial crisis. (shrink)

This paper explores whether natural selection, a putative evolutionary mechanism, and a main one at that, can be characterized on either of the two dominant conceptions of mechanism, due to Glennan and the team of Machamer, Darden, and Craver, that constitute the “new mechanistic philosophy.” The results of the analysis are that neither of the dominant conceptions of mechanism adequately captures natural selection. Nevertheless, the new mechanistic philosophy possesses the resources for an understanding of natural selection under the rubric.

: In this paper, we intend to discuss if and in what sense semiosis (meaning process, cf. C. S. Peirce) can be regarded as an "emergent" process in semiotic systems. It is not our problem here to answer when or how semiosis emerged in nature. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the conditions which should be fulfilled for semiosis to be characterized as an emergent process. The first step in this (...) work is to summarize a systematic analysis of the variety of emergence theories and concepts, elaborated by Achim Stephan. Along the summary of this analysis, we pose fundamental questions that have to be answered in order to ascribe a precise meaning to the term "emergence" in the context of an understanding of semiosis. After discussing a model for explaining emergence based on Salthe's hierarchical structuralism, which considers three levels at a time in a semiotic system, we present some tentative answers to those questions. One problem faced in discussions of the evolution of intelligence is the need to get a precise fix on what is to be explained. Terms like "intelligence," "cognition" and "mind" do not have simple and agreed-upon meanings, and the differences between conceptions of intelligence have consequences for evolutionary explanation. I hope the papers in this volume will enable us to make progress on this problem. The present contribution is mostly focused on these basic and foundational issues, although the last section (...) of the paper will look at some specific models and programs of empirical work. In this book, Katarzyna Kremplewska offers a thorough analysis of Santayana's conception of human self, viewed as part of his larger philosophy of life. Santayana emerges as an author of a provocative philosophy of drama, in which human life is acted out. Kremplewska demonstrates how his thought addresses the dynamics of human self in this context and the possibility of sustaining self-integrity while coping with the limitations of finite life. Focusing on particular aspects of Santayana's thought such as his conception (...) of the tragic aspect of existence, and the role of the doctrine of spirit in his philosophical anthropology and critique of culture, this book also sets Santayana's thought in substantial dialogue with other thinkers such as Heidegger, Bergson, and Nietzsche. U ovom radu razmatramo dvije različite kritike liberalne demokracije. Kroz analizu suvremene slovenske političke misli Slavoja Žižeka i nekih njegovih sljedbenika, koji u zadnje vrijeme revitaliziraju »ideju komunizma«, prvo ćemo kritički promisliti emancipacijski potencijal ove struje suvremene slovenske filozofije. Interludij se fokusira na uporabe i logiku nasilja te se zalaže za novu političko-etičku kulturu nenasilja. U drugome dijelu rada, uzimajući u obzir Levinasovu etičku kritiku liberalne demokracije i fokusirajući se na njegov pojam različite vremenitosti unutar političke etike, razmotrit ćemo neke (...) alternativne mogućnosti za budući napredak demokracije. This paper outlines aspects and dimensions of my ‘relationship’ with Richard Peters from 1966 onward. The underlying suggestion is that, while Peters’ contribution to philosophy of education was undeniably of major proportions, both that contribution and his legacy are institutional rather than substantive.

In this article Mare liberum is placed within the context of seventeenth-century European politics. It focuses on the development of conventional relations between European States regarding their interests outside of Europe and their importance concerning the status of Asian and African 'actors'. It turns out that in spite of Mare liberum's high-sounding proclamation of equality of non-European sovereigns with European States, Grotius's position as well as Dutch policy was inspired by self-interest and was essentially opportunistic. The Dutch Republic – as (...) well as other European States – used the 'liberal' principles of Freedom of trade and the Universality of the Law of Nations to attack the Portuguese/Spanish claims of monopoly. However, as the Dutch Republic, Great Britain and France developed their own 'Spheres of Interest' in Asia, Africa and the Americas, they effectively excluded would-be competitors. Indeed, in the eighteenth century the 'pacte colonial' constituted a distinctive characteristic of the conventional and customary 'European Law of Nations'. As non-European political actors in the eighteenth century relatively lost military and political power, the European States finally relegated them to an inferior position, beyond the charmed circle of full 'subjects of Public International Law'. The article also is a contribution to the ongoing discussion about the relation between European imperialism and the development of the doctrine of European International Law. (shrink)
