The most popular conceptions of democratic legitimacy incur in serious difficulties in dealing consistently with two dimensions of democratic legitimacy which seem to be naturally associated with it: the procedural dimension, associated with the fairness of the decision making process; and the epistemic dimension, associated with the correction of the outputs. In this paper I argue that such tension arises from the adoption of a “veritistic-consequentialist” social epistemology; it is possible to deal with that tension by replacing this problematic epistemological (...) conception with a pragmatist procedural social epistemology, and c) such replacement leads institutional design to an experimentalist orientation. Currently this is often done by trying to predict or anticipate social consequences and to use these as a basis for moral and regulatory appraisal. Such an approach can, however, not deal with the uncertainties and unknowns that are inherent in social changes induced by technological development. An alternative approach is proposed that conceives of the introduction of new technologies into society as a social experiment. An (...) ethical framework for the acceptability of such experiments is developed based on the bioethical principles for experiments with human subjects: non-maleficence, beneficence, respect for autonomy, and justice. This paper presents a case of severe uncertainty in the development of autonomous and intelligent systems in Artificial Intelligence and autonomous robotics. After discussing how uncertainty emerges from the complexity of the systems and their interaction with unknown environments, the paper describes the novel framework of explorative experiments. This framework presents a suitable context in which many of the issues relative to uncertainty, both at the epistemological level and at the ethical one, in this field should be reframed. My aim is to question whether the introduction of new technologies in society may be considered to be genuine experiments. I will argue that they are not, at least not in the sense in which the notion of experiment is being used in the natural and social sciences. If the introduction of a new technology in society is interpreted as an experiment, then we are dealing with a notion of experiment that differs in an important respect from the notion of (...) experiment as used in the natural and social sciences. This difference shows itself most prominently when the functioning of the new technological system is not only dependent on technological hardware but also on social ‘software’, that is, on social institutions such as appropriate laws, and actions of operators of the new technological system. In those cases we are not dealing with ‘simply’ the introduction of a new technology, but with the introduction of a new socio-technical system. I will argue that if the introduction of a new socio-technical system is considered to be an experiment, then the relation between the experimenter and the system on which the experiment is performed differs significantly from the relation in traditional experiments in the natural and social sciences. In the latter experiments it is assumed that the experimenter is not part of the experimental system and is able to intervene in and control the experimental system from the outside. With regard to the introduction of new socio-technical systems the idea that there is an experimenter outside the socio-technical system who intervenes in and controls that system becomes problematic. From that perspective we are dealing with a different kind of experiment. (shrink)

Hidden within the office of the Secretary of War during World War II was a little-known agency called the Advisory Specialist Group. Strategically located between the laboratory, the factory, the battlefield, and civilian bureaucracy, the ASG solved the complex problem of reconciling new technologies and new military operations. In doing so, it combined incongruous domains of activity, contributed to Allied victory, and opened a channel to the problem-solving state. It is easy to overlook or misunderstand the ASG, because it was (...) born in processes, addressed problems, and took a form unfamiliar to historical institutionalists. Drawing on Padgett and Powell’s networked theory of organizational genesis and pragmatist theories of experimentalist governance, this article explains the ASG’s emergence, networked form, and experimentalist procedures. A founding moment for the problem-solving state, this case provides empirical and theoretical guidance to study its historical and ongoing evolution. (shrink)
