It is morally impossible, Locke argued, for individuals to consensually establish absolute rule over themselves. That would be to transfer to rulers a power that is not ours, but God’s alone: ownership of our lives. This article analyses the conceptual presuppositions of Locke’s argument for the moral impossibility of self-enslavement through a comparison with other classical social contract theorists, including Grotius, Hobbes and Pufendorf. Despite notoriously defending the permissibility of voluntary enslavement of individuals and even entire peoples, Grotius similarly endorsed (...) divine ownership of human life. He could do so coherently, we show, because he denied that despotic power gives rulers rights in the lives of their subjects. Masters do not own slaves in the way we own material things (which we may destroy at will). Reworking received Roman law categories, Grotius maintained that ‘perfect slavery’ consists in masters having a personal right to the slave’s perpetual service; a condition equivalent to what Locke called ‘drudgery’ and deemed permissible. Our analysis of this unpalatable set of ideas reveals that Locke’s argument is premised upon idiosyncratic conceptions of slavery and absolutism, disavowed by prominent defenders of absolutism in the classical social contract tradition. ABSTRACT This article draws attention to the reception that François Fénelon's Télémaque (1699) received in England in the first half of the eighteenth century. It overturns the historiographical assumption that the Jacobites were the leading disseminators of this continental bestseller on the other side of the Channel. Even though in the English intellectual context Télémaque's framework was unorthodox, many staunch supporters of the Glorious Revolution were fascinated by the book's portrayal of a virtuous king who respects laws, rights and liberties, (...) and sacrifices himself to improve the wellbeing of his subjects. Moderate Whigs - who included several Huguenot refugees - capitalised on the poem's esprit du roi in order both to celebrate the English kings and to construct the ‘Myth of Louis XIV' as an example of how a sovereign should not rule. The study of the book's reception thus presents a somewhat emblematic case study from which to view the genesis of ‘Englishness', that of an ideological discourse largely based on a process of overturning. In addition, the Télémaque responded to the thirst for ‘useful Knowledge' that distinguished the advocates of ‘politeness' and, not least, its mild pedagogical approach rendered it a precious resource for the ‘moderation’ of the youth. The present essay is the first part of an analysis regarding aspects of Aristotle’s ontology. Aristotle’s ontology is, in my opinion, a formal ontology that examines the fundamental structures of reality and that investigates the features belonging to entities such as substance, quantity, quality, universals. Aristotle’s ontology investigates, moreover, the reciprocal relations existing between these entities. Aristotle’s interpretation of universals is not, in my opinion, a nominalist interpretation of universals: I do not think Aristotle regards universals as being only mental (...) entities. Aristotle, rather, aims at the differentiation between the realms of reality to which individuals and universals belong. In this part of my investigation, I first expose my interpretation of the fundaments of Aristotle’s ontology. Thereafter, I concentrate my attention on chapter Metaphysics Zeta 13: I comment on Aristotle’s investigation regarding the ontological features belonging to the universal qua universal and to the substance qua substance. I analyse the ontological laws that Aristotle finds about universal and substance: substance and universals are considered by Aristotle as mutually incompatible entities. The analysis shows that a false interpretation of the features of the universals endangers the whole ontology. Moreover, the Third-Man-Regress, which is one of the consequences of the misunderstanding of the position of universals in the reality, is regarded as the key to the interpretation of one of Aristotle’s aims: Aristotle aims at the foundation of a typological ontology putting individual entities and universal entities on different levels of reality. The danger of the Third-Man-Regress is avoided through the introduction of a new ontology, that is, through the introduction of the typological ontology of the entities. (shrink)

In much of the literature on Hobbes, he is considered a proto-liberal, that is, he is seen as setting up the apparatus that leads to liberalism but his own authoritarian streak makes it impossible for liberals to completely claim him as one of their own. In this paper, I argue that, far from being a precursor to liberalism, Hobbes offers a political theory that is implicitly anti-liberal. I do not mean this in the conventional sense that Hobbes was too conservative (...) for liberalism. On the contrary, I will argue that in his writing, Hobbes evinces a concept of collective interpretation, theories of individualism and the nature and possibilities for democratic politics, that is radical and offers a completely developed alternative to liberalism even as it eschews conservative and reactionary models as well. I focus in particular on the idea of individualism and how the model offered by liberals and conservatives offers far less in terms of individual choice and justice than Hobbes’s own theory does, however paradoxical this may seem. Why did Locke exclude Catholics and atheists from toleration? Not, I contend, because he was trapped by his context, but because his prudential approach and practica ljudgments led him to traditiona ltexts. I make this argumentfirst by outlining the connections among prudential exceptionality, practical judgments, and traditional texts. I then describe important continuities betweenc onventional English understandings of the relationship between state and religion and Locke's writings on toleration, discuss Locke's conception of rights, and illustrate his use of prudential exceptions (...) and distinctions. I conclude by arguing that Locke's problems are relevant to assessingc ontemporary liberal discussions of tolerationa nd the separation of state and religion that lean heavily on practical justifications. This article aims to challenge the idea of a ‘balance’ between security and liberty. Set against the background of ever greater demands for security, the article argues that the idea of balance is an essentially liberal myth, a myth that in turn masks the fact that liberalism's key category is not liberty, but security. This fact, it is suggested, undermines any possibility of liberalism challenging current demands for greater security, as witnessed by the thoroughly authoritarian ‘concessions’ to security by some (...) contemporary liberals. More ambitiously, the article also suggests that attempts to develop a ‘radical’ politics of security are misplaced, and that what is needed is more a political critique of the concept. (shrink)

This paper demonstrates how Mary Astell's version of Cartesian dualism supports her disavowal of female subordination and traditional gender roles, her rejection of Locke's notion of “thinking matter” as a major premise for rejecting his political philosophy of “social contracts” between men and women, and, finally, her claim that there is no intrinsic difference between genders in terms of ratiocination, the primary assertion that grants her the title of the first female English feminist.

ABSTRACTThough responses to Stout's book, Democracy and Tradition, have touched on his discussion of rights, none has comprehensively examined his position on the subject. Having endorsed several objections Stout raises against some influential views on democracy and rights, this article proceeds to criticize Stout's description and theoretical account of the natural and human rights traditions. The central argument is that Stout cannot successfully both affirm the traditions and adhere to his account.

John Locke (1632—1704) and Georges Sorel (1859—1922) are commonly understood as representing opposed positions vis-a-vis revolution — with Locke representing the liberal distinction between violence and politics versus Sorel's rejection of politics in its pacified liberal sense. This interpretation is shown by a close reading of their works to be misleading. Both draw a necessary link between revolution and violence, and both mediate this link through the concept of `war'. They both depoliticize revolution, as for both of them `war' is (...) understood as extra-political. The revolutions of 1989 emphasize what actually is true of previous revolutions: they cannot coherently be thought of as extra-political. (shrink)

Over the last generation, American Business Ethics has focused excessively on the process of managerial decision-making while ignoring the collective impact of these decisions and avoiding other approaches that might earn the disapproval of corporate executives. This narrowness helped the field establish itself during the 1980s, when American management, under pressure from finance and heightened competition, was unreceptive to any limitations on its autonomy. Relying, however, on top-down approaches inspired by Aristotle, Locke, and Kant, while ignoring the consequentialism of Mill (...) and Rawls, made the field totally reliant upon the good will of these same corporate executives for generating any impact. Trends in employee compensation, finance, regulation, government procurement, and taxpayer subsidies suggest that Business Ethics has failed to significantly influence corporate behavior, a result that would have not surprised the realists of the post-war generation of Business and Society scholars. If Business Ethics is to prove relevant in the contemporary world, the field needs to acknowledge past failures and develop new approaches. The decline of American economic hegemony coupled to the increased internationalization of the discipline may create the opportunity to do so. (shrink)

The theoretical originality of John Locke's position concerning his doctrine of tolerance leads him on the one hand to raise the right to exist for "particular Churches" and on the other hand to erect the process of conviction above the intrinsic content of any belief. In the philosopher's reasoning, the Church is never rendered superfluous because only the practice of worship can demonstrate the sincerity of any spiritual approach. On the other hand, he refutes the postulates of clerical authority on (...) the truth in matters of faith since God would not have prescribed any model. Yet the tension between faith and knowledge is diminished by the Lockian demonstration that consciences, although and because they are weak, must never be violated. (shrink)

John Locke, long associated with the “standard” approach to fallacies and the “logical” approach to valid inference, had both logical and dialectical reasons for favoring certain proofs and denigrating others. While the logical approach to argumentation stands forth in Locke’s philosophical writings, a dialectical approach can be found in his contributions to public controversies regarding religion and toleration. Understanding Locke’s dialectical approach to argumentation not only makes his work more relevant to the contemporary discipline of informal logic, but this understanding (...) also prompts a reconsideration of Locke’s rhetorical purpose. He approached argumentation dialectically because he wanted to appeal to a universal audience of free rational subjects, people not unlike the real historical audience whom Locke addressed: radical Whigs, latitudinarian Anglicans, early-Enlightenment philosophes. Although John Locke’s theory of appropriation is undoubtedly influential, no one seems to agree about exactly what he was trying to say. It is unlikely that someone will write the interpretation that effectively ends the controversy. Instead of trying to find the one definitive interpretation of Locke’s property theory, this article attempts to identify the range of reasonable interpretations and extensions of Lockean property theory that exist in the contemporary literature with an emphasis on his argument for unilateral appropriation. It (...) goes through Locke’s argument point-by-point discussing the controversy over what he said and over what he perhaps should have said to make the most valuable and coherent argument. The result is an outline of Lockean theories of property: a menu of options by which one might use appropriation to justify property rights. Supporters only need to pick the version they find most plausible, but opponents should be aware of the entire menu. Anyone claiming to refute appropriation-based property rights must address not only one but all potentially valid versions of it. (shrink)

In the article, referring to the method of rational reconstruction described by R. Rorty, an analysis of some works of J. Locke has been made in order to identify new prospects in John Locke's philosophy researches. As a result, it’s been demonstrated the presence of silence as an argument and a manifestation of respect J. Locke’s research of realms of cognition, political philosophy and philosophy of education. This is not covered in modern John Locke's philosophy researches. The authors emphasize that (...) J. Locke, although not directly exploring silence as an argument, however, describes the argument ad ignorantiam, the wording of which in the work «An Essay Concerning Human Understanding» and his understanding of tacit consent in the work «Two Treatises of Government» are related to silence as an argument and a manifestation of respect. The position that silence as an argument is present in all four arguments described by J. Locke is substantiated. Additionally, the argument ad ignorantiam can be considered both as an argument from silence and as a kind of argument to silence. Considered arguments can serve as an argument to silence for the proponent and/or the third party, that is, anyone who is not directly involved in the dispute. Basing on J. Locke's explanation of the characteristic feature of tacit consent, that is, the absence of the expressed consent/disagreement, the possibility of distinguishing the indirect connection between tacit consent and the argument ad ignorantiam is demonstrated, since both tacit consent and the argument ad ignorantiam in J. Locke's works rely on the absence of expressed statements on the consent or disagreement of the opponent. It is established that the ideas of the education of children described by J. Locke also correlate with silence as an argument and a manifestation of respect. Applying the classification of the types of respect proposed by S. Hudson and complemented by R. Dillon to the use of the term «respect» to the various texts of J. Locke, it is substantiated that described by him respect covered almost all kinds of this classification. (shrink)

In his final collection of philosophical papers, Richard Rorty continued his attack on the traditional conception of philosophy by arguing that many of our debates should be thought of as matters of cultural politics rather than about ontology or truth. Consistent with that view, Rorty had argued that we come to see debates about human rights not as an attempt to ground rights in human nature but rather as attempts to expand our moral imagination. I extend this claim to an (...) account of human rights as political rather than metaphysical, an account that treats human rights as a political innovation to be justified in terms of the work of human rights. Some humanist theologians within the French Reformed Church in the 17th century developed the notion that a disability of the intellect could exist in nature independently of any moral defect, freeing its possessors from any obligations of natural law. Sharpened by disputes with the church leadership, this notion began to suggest a species-type classification that threatened to override the importance of the boundary between elect and reprobate in the doctrine of predestination. This paper examines the relationship between understandings of Indigenous government and the development of early-modern European, and especially British, political thought. It will be argued that a range of British political thinkers represented Indigenous peoples as being in want of effective government and regular conduct due to the absence of sufficiently developed property relations among them. In particular, British political thinkers framed the ‘deficiencies’ of Indigenous people by ideas of civilization in which key assumptions connected ‘property’, ‘government’, and ‘society’ as (...) the attainments of civilized polities and societies. Accordingly, Indigenous peoples in Australia and elsewhere were perceived to live in associations (rather than ‘societies’) bound by custom and tradition (rather than ‘government’). The paper will thus identify conceptual connections made between property, polity, and sovereignty in European and British political thought, and argue that such understandings provide a useful resource for understanding colonial attitudes to Indigenous people in Australia down to the present day. From the seventeenth to the mid?nineteenth centuries, the language of natural law and natural rights structured the commitment of liberalism to the development of both a market society and democratic political institutions. The existence of widespread poverty was seen, at various times, as a problem to be resolved either by an expanding commercial/capitalistic society or through democratic political reform. As Thomas Home shows in Property Rights and Poverty, liberalism as apolitical theory has, from its origins, been deeply committed to (at (...) least a minimalist) social welfare policy. Nevertheless, not only have the dimensions of the problem of poverty increased with the growth of democratic capitalist society, but also, viewed from an historical perspective, it is the problem of poverty that exposes the fundamental tensions at the heart of liberal political theory. This essay attempts to clarify the distinction between property and sovereignty, and to bring out the importance of that distinction to a liberal nationalism. Beginning with common intuitions about what distinguishes our rights to our possessions from the state's rightful governance over us, it proceeds to explore some historical sources of these intuitions, and the importance of a sharp distinction between ownership and governance to the rise of liberalism. From here, the essay moves into an exploration of group ownership, and (...) the ways in which group ownership can in practice turn into an illiberal kind of sovereignty The point is to shed new light on problems that nationalist states — states purporting to represent or foster a particular group identity — characteristically face. The apparent inconsistency between Locke’s commitment to legalism and his explicit endorsement of the extra-legal power of prerogative has confounded many readers. Among those who don’t ignore or dismiss it, the common approach is to qualify the role or scope of prerogative. The article advocates the opposite approach. It argues that Locke’s legalism should be understood within the context of his oft neglected conception of political liberty in terms of self-government. This not only allows for the reconciliation of Locke’s legalism (...) with his endorsement of extra-legal powers, but also provides a fuller, more accurate account of the role of law and of political liberty in Locke’s theory. Modern republican theory of the revolutionary conception of popular sovereignty had a fundamental link in the political philosophy of John Locke, who elaborated an argument in favour of the natural freedom and autonomy of judgment of individuals, and against the natural subjection and alienation of political freedom. He conceives of political authority as a fiduciary political power instituted for the end of public good. When the trustees act for ends other than those entrusted, arbitrarily or for his own interest, trust is forfeited and the exercise of political power returns to the hands of the free people. Various quantitative analyses have stressed the connection between lower socioeconomic status (SES) and low political participation. The general argument behind these studies was that since political participation is crucial for democracy, and since low SES compromises political participation, liberal democratic governments cannot afford such a compromise. This paper argues that presenting political participation as a democratic value, corresponding to a ‘positive’ right, places the implied argumentation of such studies in a potential conflict with classical liberalism and its contemporary ‘successors’, emphasizing (...) ‘negative’ rights alone. However, the tension can be reconciled by employing the political thought of John Locke, one of the forefathers of classical liberalism. Thus, the paper illuminates a strong bond in Locke’s thought between democratic political participation and liberal natural rights. In fact, I argue that it is precisely his advocacy of liberal rights that leads to a conception of political participation, converging with democratic theory and redistributive policies. (shrink)

This article offers a revised interpretation of the Scottish republican thinker and political activist Andrew Fletcher of Saltoun’s views on the issue of militias and standing armies. Reconstructing both its English and Scottish contexts, it is shown that Fletcher’s republicanism incorporated strong constitutionalist elements by engaging with several forms of political discourses and practices. On the one hand, his Discourse concerning Militias (1697) issued in London went much further than the moderate neo-Harringtonian propaganda of the anti-army camp, arguing for delivering (...) the right to use arms to the parliaments instead of the king. On the other, the second version of Fletcher’s tract published in Edinburgh in 1698 and his 1703 parliamentary ‘limitations’ enlarged the participation in the militia to landless subjects, transcending both the Buchananite ethos of the nobility in arms and James Harrington’s original agrarian model. As a result of this study, Fletcher’s idea of government emerges as much closer to English Civil War authors and the likes of Algernon Sidney and Henry Neville than to any of his contemporaries. The conclusions stress how Fletcher’s radical stance should be considered as the most important facet of his legacy, presenting some cases of reception in the age of revolutions. (shrink)

Ao longo da história da filosofia, John Locke tem sido frequentemente associado à tradição do liberalismo político, o que decorre, invariavelmente, de um modo peculiar de interpretação da noção de liberdade para o filósofo, que estaria estruturada em torno da ideia de não-interferência. Derivada frequentemente de propostas analíticas realizadas em um “vácuo histórico”, em que as ideias de Locke são tomadas como uma estática coleção, tal conclusão expressa uma perspectiva que não considera o caráter essencialmente discursivo da filosofia política e (...) o “campo problemático” em que os conceitos foram pensados pelo filósofo. Diante dessa perspectiva, o propósito deste artigo é o de realçar, na linguagem política utilizada pelo filósofo, os elementos contextuais que permitem a compreensão dos argumentos desenvolvidos pelo autor como parte de uma _performance_ – na acepção proposta por John Pocock –, a fim de destacar os aspectos que indicam a possibilidade de aproximação do conceito de liberdade de Locke da ideia de liberdade republicana, descrita por Philip Pettit a partir da ideia de não-dominação, sem descuidar da análise das evidências textuais que indicam a presença de argumentos na obra do autor que compõem o cerne da concepção republicana de liberdade. Abstract Inspired by Rawls?s admission that his twentieth?century contract theory builds in the parochial horizon of modern constitutional democracy, this essay critically examines two truisms about seventeenth?century contract theory. The first is the stock view that the English case is irrelevant to the logic of Leviathan and the Second Treatise. To the contrary, I argue that their political conclusions depend on introducing constitutional and legal ?facts?, in particular, facts about the constitution of the English monarchy. Second, I challenge the Whiggish (...) characterization of contract theory as an important step in the development of democratic sovereignty. I draw on Hume?s famous critique of the genre to make the case that seventeenth?century contract theory addressed a peculiarly ancien?regime issue ? namely, resistance to legitimate rulers. In both respects, Hobbes?s and Locke?s social contracts are properly regarded as ancien?regime theories of politics. They are, as Rawls would put it, ?political not metaphysical? theories. (shrink)

C.B. Macpherson's “Possessive Individualist” reading of Locke is one of the most radical and influential interpretations in the history of exegesis. Despite a substantial critical response over the past five decades, Macpherson's reading remains orthodox in various circles in the humanities generally, particularly in legal studies, and his interpretation of several crucial passages has unwittingly been followed even by his sharpest critics within Lockean scholarship. In order to present the definitive rebuttal to this interpretation, and so finally to lay it (...) to rest, I argue that every one of Macpherson's key pieces of textual evidence can be rejected entirely on its own terms; that is, by reference to no more than its immediate context.
