In many jurisdictions, an offender’s remorse is considered to be a relevant factor to take into account in mitigation at sentencing. The growing philosophical interest in the use of neurointerventions in criminal justice raises an important question about such remorse-based mitigation: to what extent should technologically facilitated remorse be honoured such that it is permitted the same penal significance as standard instances of remorse? To motivate this question, we begin by sketching a tripartite account of remorse that distinguishes cognitive, affective (...) and motivational elements of remorse. We then describe a number of neurointerventions that might plausibly be used to enhance abilities that are relevant to these different elements of remorse. Having described what we term the ‘moral value’ view of the justification of remorse-based mitigation, we then consider whether using neurointerventions to facilitate remorse would undermine its moral value, and thus make it inappropriate to honour such remorse in the criminal justice system. We respond to this question by claiming that the form of moral understanding that is incorporated into a genuinely remorseful response grounds remorse’s moral value. In view of this claim, we conclude by arguing that neurointerventions need not undermine remorse’s moral value on this approach, and that the remorse that such interventions might facilitate could also be authentic to the recipient of the neurointerventions that we discuss. This is a bibliography of books and articles on consciousness in philosophy, cognitive science, and neuroscience over the last 30 years. There are three main sections, devoted to monographs, edited collections of papers, and articles. The first two of these sections are each divided into three subsections containing books in each of the main areas of research. The third section is divided into 12 subsections, with 10 subject headings for philosophical articles along with two additional subsections for articles in cognitive (...) science and neuroscience. Of course the division is somewhat arbitrary, but I hope that it makes the bibliography easier to use. This bibliography has first been compiled by Thomas Metzinger and David Chalmers to appear in print in two philosophical anthologies on conscious experience . From 1995 onwards it has been continuously updated by Thomas Metzinger, and now is freely available as a PDF-, RTF-, or HTML-file. This bibliography mainly attempts to cover the Anglo-Saxon and German debates, in a non-annotated, fully formatted way that makes it easy to "cut and paste" from the original file. Introduction Comparative psychology can generally be defined as the branch of psychology that studies the similarities and differences in the behavior of organisms. Formal definitions found in textbooks and encyclopedias disagree whether comparative psychologists restrict their work to the study of animals or include the study of human behavior. This paper offers an opinion on the major problem facing comparative psychology today – where we will find the next generation of comparative psychology students. Something must be done before we lose (...) access to an entire generation of psychology undergraduates. It is not enough to say that comparative psychology is being “absorbed” in other academic units such as “integrative biology”, “integrative study of animal behavior”, “evolutionary psychology”, “comparative cognition”, or “animal cognition.” Indeed, many of these topics are not primarily studied in psychology departments, wherein comparative psychology students have traditionally received joint training in the principles of behavior and comparative analysis, as applied to both humans and other animals. Consider, for example, the difference between comparative psychology and comparative cognition. Comparative cognition includes features of comparative psychology, but they are not identical. Motivationally unconscious (M-unconscious) states are unconscious states that can directly motivate a subject’s behavior and whose unconscious character typically results from a form of repression. The basic argument for M-unconscious states claims that they provide the best explanation to some seemingly non rational behaviors, like akrasia, impulsivity or apparent self-deception. This basic argument has been challenged on theoretical, empirical and conceptual grounds. Drawing on recent works on apparent self-deception and on the ‘cognitive unconscious’ I assess those objections. I argue that (...) (i) even if there is a good theoretical argument for its existence, (ii) most empirical vindications of the M-unconscious miss their target. (iii) As for the conceptual objections, they compel us to modify the classical picture of the M-unconscious. I conclude that M-unconscious states and processes must be affective states and processes that the subject really feels and experiences —and which are in this sense conscious— even though they are not, or not well, cognitively accessible to him. Dual process psychology and the literature on cold-hot empathy gaps partly support the existence of such M-unconscious states. (shrink)

This paper attempts to answer the question of what defines mnemonic confabulation vis-à-vis genuine memory. The two extant accounts of mnemonic confabulation as “false memory” and as ill-grounded memory are shown to be problematic, for they cannot account for the possibility of veridical confabulation, ill-grounded memory, and wellgrounded confabulation. This paper argues that the defining characteristic of mnemonic confabulation is that it lacks the appropriate causal history. Most theories and models of memory are based on two assumptions that contain theoretical problems. These problems are reflected in the memory-trace paradox, which consists in believing that the past is contained in the memory trace, and in the fallacy of the homunculus, which consists in assuming the existence of an unconscious intentional subject. We will discuss these and present an alternative hypothesis concerning the relationship between memory, consciousness and temporality. This holds that consciousness is not a unitary dimension, but (...) is the set of distinct and original modes to address the object. Among the modes of consciousness, a distinction is made between Knowing Consciousness (KC) and Temporal Consciousness (TC). KC describes the mode of addressing the object in order to know it. TC describes the mode of consciousness that temporalizes its object according the subordinate structures of temporality, the past, the present and the future. Finally it is shown how the hypothesis accounts for a variety of memory disorders and phenomena while avoiding the memory- trace paradox and the fallacy of the homunculus. (shrink)
