The article elaborates an original intertwined reading of republican theory, deliberative democracy and political equality. It argues that republicans, deliberative democrats and egalitarian scholars have not paid sufficient attention to a number of features present in these bodies of scholarships that relate them in mutually beneficial ways. It shows that republicanism and deliberative democracy are related in mutually beneficial ways, it makes those relations explicit, and it deals with potential objections against them. Additionally, it elaborates an egalitarian principle underpinning the (...) resulting model that I label Equality of Access and Deliberation. The upshot of these considerations is a novel and mutually reinforcing interrelated three-tiered theoretical and institutional proposal. (shrink)

A defining feature of democracy is the inclusion of members of the political association. However, the corresponding right to exclusion has attracted undeservedly scant attention in recent debates. In this paper, the nature of the right to exclusion is explored. On the assumption that inclusion requires the allocation of legal power-rights to the people entitled to participate in the making of collective decisions, two conceptions of the right to exclusion are identified: the liberty-right to exclude and the claim-right to exclude. (...) The choice between them depends on the nature of the interests that justifies the power-rights of people included. The position is defended that if rights to democratic participation are power-rights, we must also accept that the people included have claim-rights to the exclusion of non-members. (shrink)

This paper addresses republican conditions of legitimacy for the constitution of the civic statuses of migrants. It identifies two legitimacy tests to which any civic status is subject, namely, that it does not make its bearers more vulnerable to the arbitrary exercise of private or public power and that the constitution of the person as bearer of this status is not itself the product of an arbitrary exercise of public power . It is argued that R1 puts significant constraints on (...) what can be legitimate migrant statuses and R2 links republicanism to cosmopolitanism in terms of a basic norm in respect of the production and allocation of civic statuses in that those who are subject to such a regime should have the effective power to ‘shape and contest’ the rules of this regime. The debate on political constitutionalism has entirely neglected the constitution-making dimension. This is probably due to the fact that constitution-making usually brings with it undesirable outcomes such as the entrenchment of rights or structures. These outcomes do not respect reasonable disagreement among citizens because they violate the only fair system for settling disagreement: majority rule and equal voting rights. This article argues that political constitutionalists may regret the absence of any claim about constitution-making. Either they are overlooking certain problems inherent (...) to the electoral process that is supposed to tackle disagreement or, even worse, they are downplaying the entrenching effect of ordinary political processes by ignoring the redemptive properties of constituent power. In both cases, their claims undermine the political dimension of constitutionalism. (shrink)

According to ‘global institutionalism,’ individuals who do not share a state have duties of justice to one another, and this is explained, in part, by the institutional connections that obtain between them. In this chapter, I defend this view against two challenges. First, I consider challenges raised by ‘non-institutionalists,’ who deny that facts about global institutional interaction bear on the nature of duties of justice that arise between particular individuals. Second, I address challenges posed by ‘domestic institutionalists,’ who accept the (...) claim that facts about institutional interaction bear upon the scope of justice but deny that the right sort of interaction necessary to ground duties of justice is found in the global domain. El presente artículo comienza reconstruyendo las razones por las cuales las teorías modernas se concentran en la ciudadanía como una garantía muy importante de legitimidad -arguyendo que la ciudadanía está intrínsecamente ligada a una forma republicana de orden político. La segunda parte del artículo muestra que, bajo las actuales condiciones de la globalización, la ciudadanía crea o mantiene un orden transnacional multinivel que impide que otras personas y políticas puedan realizar una ciudadanía (completa), y que incluso contribuyen a violaciones directas (...) de exigencias legítimas por parte de no-ciudadanos. La tercera parte discute críticamente las propuestas de Archibugi, Owen y Baubóck acerca de cómo repensar la ciudadanía transnacional o formas equivalentes de participación y control. En la parte final, el artículo aboga por una conexión entre la concepción de la ciudadanía constelación y una forma específica de democracia transnacional. Tal conexión permitiría a la ciudadanía seguir siendo el factor clave para la legitimidad. This article starts by reconstructing the reasons for the modern focus on citi-zenship as a major guarantee for legitimacy - arguing that citizenship is intricately linked to a republican form of political order. In its second part this paper shows that under the current conditions of globalization citizenships creates or maintains a transnational multi-level order which prevents other persons and polities from realizing (full) citizenship, and even contributes to direct violations of legitimate claims of non-citizens. The third part of the article critically discusses proposals by Archibugi, Owen and Baubóck, how to rethink transnational citizenship or equivalent forms of participation and control. And in its final part it advocates linking the conception of constellational citizenship to a specific form of trans-national democracy. With such a link citizenship could continue to be the key factor for legitimacy. (shrink)
