One of the main problems of Albania since the overthrow of the communist dictatorship and the beginning of the transition in 1991 has been the consolidation of a functional constitutional democracy. Having a functional and applicable constitutional order by all institutions and mechanisms has been a significant challenge for Albania. Political parties are one of these mechanisms or vital elements in maintaining and improving the constitutional order in Albania. In democratic regimes, political parties continue to be the most important bridge (...) between the state and the mass of society. Political parties are the institutions that hold the position of a political leader in society, and democratic states cannot survive if they do not have political parties that fulfill their functions in consolidating, preserving, and improving democracy. The object of this study will be political parties in Albania and their role in the consolidation or not of the constitutional order during the period of democratic transition. In this study, the three main parties in Albania are taken as case studies, namely the Socialist Party of Albania, the Democratic Party of Albania, and the Socialist Movement for Integration. In this essay, I attempt to measure various prevailing democratic theories against an argument that Carl Schmitt advances in the first chapter of his ‘Crisis of Parliamentary Democracy’. In practice, he claims there, democratic politics is compelled to introduce a distinction between ‘the will of the people’ and the behaviour of the empirical people, thus justifying the bracketing and unlimited suspension of the latter in the name of the former, even to the point of dictatorship. I argue that no contemporary (...) approach to democracy as a fundamental value is able to mount a compelling response to this critique and that we should therefore reconsider the status of democracy as a normative commitment. I proceed by carefully and closely reading Schmitt’s chapter and then by juxtaposing various currents of democratic theory (including liberal, deliberative, epistemic and various hybrids thereof) with the trajectory of Schmitt’s argument. This essay is therefore less of a contribution to Schmitt scholarship, in the sense that it does not take a panoramic view of his corpus to determine his final stance on democracy, and more of an intervention into contemporary democratic theory using Schmitt’s argument as a kind of lever. Decisions in democracy are binding not in virtue of being true or good, but on account of being an outcome of the majority voting procedure. For some, this is a proof of an intricate connection between democracy and moral relativism. The ‘militant democracy’ model, on the other hand, is premised on the idea that certain political actors and choices have to be banned for being fatally bad for democracy. This gives rise to the claim that protected democratic fundamental values of (...) freedom and equality enjoy the status of absolute moral standards. This article dismisses the intuition that justification of ‘militant democracy’ depends on unpacking the relation between democracy and meta-ethics. Instead, following Bernard Suits’ analytical exposition of the important features of games, it demonstrates, first, how democracy is like a game and, then, it argues that a plausible justification of ‘militant democracy’ stems from its game-like character. For over a decade now we live under an economic crisis, its metastases, and its effects. Since the turn of the century, we live under recurring security crises and state attempts to prevent them. This article examines the temporal horizons of the strategies the neoliberal state employs to combat the spectre of crisis in its two quintessential fields of action: the economy and security. It notes a pronounced contrast: whereas security strategy is pre-emptive, economic strategy is reactive. These two opposite (...) strategies aim to the same result: to cancel the future. Security strategy seeks to pre-emptively neutralise the possibility of non-liberal politics, canceling the possibility of political change. By not intervening proactively, economic strategy seeks to guarantee that the economy will remain as it is, averting economic change. This attempt of the state to cancel the future is symptomatic of a malaise affecting the capitalist class. Having fully conquered social resistance, the capitalist class tries to render the moment of its triumph permanent, fixing society in an eternal present. For the first time in its history, the capitalist class has neither vision nor appetite for the future. This signals its hegemonic implosion. (shrink)

This paper examines the theoretical ideas of Friedrich von Hayek, arguably the key progenitor of the global economic orthodoxy of the past two decades. It assesses Hayek's thought as he presents it: namely as a form of liberalism. Section I argues that Hayek's thought, if liberal, is hostile to participatory democracy. Section II then argues the more radical thesis that neoliberalism is also in truth an illiberal doctrine. Founded not in any social contract doctrine, but a form of constructivism, neoliberal (...) thought at its base accepts the paradoxical need to "discipline subjects for freedom", however this might contravene peoples' natural, social inclinations. The argument is framed by reference to Aristophanes' great comedy, The Birds, whose off shore borderless empire ironically prefigures the dream of neoliberal social engineers, and their corporate supporters.

I propose a principle of non-domination as a benchmark for assessing the justifiability of unequal residence statuses for non-nationals in liberal democracies. This has advantages over the principles of equality and rights alike, in accommodating both the inclusive and exclusive logics of liberal democratic citizenship. Non-domination requires the state to grant upon first admission a degree of inclusion in the social privileges of citizenship that is sufficient to guard against the most severe forms of domination in social relationships. However, as (...) resident non-nationals become more permanent and come to be in relationships open to other, if less severe forms of domination, it requires gradually increasing the degree of inclusion, over time, to protect non-nationals against these forms of domination also, and, finally, eventually giving them access to the sites of political decision-making that contribute to shaping the background conditions for independent action in social relationships. In Europe and other regions of the world public debate concerning how many immigrants should be admitted, which rights those admitted should have, and which conditions can be required for access to citizenship is intense and enduring, and these have increasingly become central electoral issues. On the one hand, the harsh treatment of migrants is often a matter of public criticism; on the other hand, states are concerned about problems of welfare, security and social unrest that they have come to (...) associate with large-scale migration. At its most fundamental level, this debate concerns the question of how best to balance particularist principles of democratic self-determination and state sovereignty and universalist principles of individual freedom and human rights. The articles in this special issue examine whether the concept of domination can cast a distinctive light on the normative issues arising in this tension between state sovereignty and universal principles with respect to migration and the position of non-citizens in contemporary liberal democratic states. These issues arise both externally insofar as foreigners are subject to migration controls, and internally insofar as migrants live in states of which they are not full members. The issue thus examines the potential of domination as a concept to bring to bear on issues of migration controls, differential residence statuses and access to membership. (shrink)

The article explores the connection between politics of democracy and current communication medium. Color revolutions, particularly the one experienced in Ukraine, raise an issue of the present day relation between public and political spheres in the new global communicative context. Following the detailed analysis of the modern formation of public sphere done by Charles Taylor the author concentrates on the influence of communication on democratization processes. Amongst others, he focuses on such principle features of the public sphere as domination of (...) rationality in its formation, its claims for providing accountability norms for power, and particularly on its extra-political status. In its turn, these key characteristics of the sphere include everyone as its potential legitimate participant. The field experience gained during the Ukrainian Revolution of Dignity make it possible to correct the view on interrelations of politics and the public sphere. Recent developments do increase dependence of powers that be on the public’s day-to-day feeling of their legitimacy. To elucidate the new state of interpenetration between two given spheres the author examines the issue of specificity of discourse that unites both. It allows to establish that it’s precisely the democratic ideals, concerning each and every one, that expand the frameworks of the sphere of political beyond its traditional meaning through inclusion of a broad spectrum of people’s cultural experiences. The author links current co-existence of liberal and conservative values within liberal democracies with people’s experiencing of their cultural identity. That conclusion gives the basis to clarify a phenomenon of rising conservatism inherent in today’s politics. (shrink)

After a recent spate of terrorist attacks in European and American cities, liberal democracies are reintroducing emergency securitarian measures that curtail rights and/or expand police powers. Political theorists who study ESMs are familiar with how such measures become instruments of discrimination and abuse, but the fundamental conflict ESMs pose for not just civil liberty but also democratic equality still remains insufficiently explored. Such phenomena are usually explained as a function of public panic or fear-mongering in times of crisis, but I (...) show that the tension between security and equality is in fact much deeper and more general. It follows a different logic than the more familiar tension between security and liberty, and it concerns not just the rule of law in protecting liberty but also the role of law in integrating new or previously subjected groups into a democratic community. As liberal-democratic societies become increasingly diverse and multicultural in the present era of mass immigration and global interconnectedness, this tension between security and equality is likely to become more pronounced.
