In this paper, I give a reconstruction of the so‐called Reinhold–Sidgwick objection and show that Korsgaard‐style Kantian constructivists are committed to two key premises of the underlying argument. According to the Reinhold–Sidgwick objection, the Kantian conception of autonomy entails the absurd conclusion that no one is ever morally responsible for a morally wrong action. My reconstruction of the underlying argument reveals that the objection depends on a third premise, which says that freedom is a necessary condition for moral responsibility. After (...) mapping the common replies to the objection, I demonstrate that none of these replies is available to Kantian constructivists. But they need not be committed to the absurd conclusion that no one is ever morally blameworthy. Kantian constructivists who want to resist the Reinhold–Sidgwick objection are well advised to subject the third premise of the underlying argument to critical scrutiny. (shrink)

Contrary to Karl Leonhard Reinhold's theoretical critique of Kant's philosophy, his practical critique has been almost unknown. In my paper, I shall reconstruct Reinhold's practical philosophy after Kant. I will concentrate on the so‐called Reinhold's dilemma, which concerns the problem of moral imputability in the case of immoral actions in Kant. Also, I shall explain how Reinhold tried to escape this dilemma by introducing a new action theory and by sharply distinguishing between reason and will. Finally, I shall evaluate Reinhold's (...) practical significance by relating his conception of individual freedom to recent theories of volitional self‐determination. (shrink)

The purpose of this paper is to challenge the suggestion that Kant offers a solution to the Reinhold/Sidgwick Problem in his Metaphysics of Morals. The problem, briefly, is about how Kant can hold moral evil to be imputable when he also seems to hold that freedom is found only in moral actions. After providing a new formulation of this problem under the title ‘Objection R/S’ and describing the popular strategy for addressing it through reference to this text, the paper recounts (...) some of the history relevant to interpreting the passage in question. The paper then argues that this strategy is not supported by the text and indeed proves to be contrary to other arguments that are central to Kant's moral thought. Kant entwickelt in der Kritik der Urteilskraft eine philosophische Ästhetik, eine Theorie der organischen Natur. Die beiden scheinbar heterogenen Gegenstandsbereiche sind durch das Prinzip der reflektierenden Urteilskraft, die Idee der Zweckmäßigkeit, verbunden, die der Mensch sowohl bei der Reflexion über die schönen Gegenstände der Natur und der Kunst als auch bei seiner Erforschung der organischen Natur zugrunde legt. Immanuel Kant hat wie kein anderer Denker die Philosophie der Neuzeit geprägt. Aufgrund seiner überragenden Bedeutung liegen inzwischen mehrere Bände zu seinen Schriften in der Reihe "Klassiker Auslegen" vor. Kant ist im wahrsten Sinne ein universeller Denker, der sein Interesse auf nahezu alle Bereiche des menschlichen Lebens richtet. Nach ihm lässt sich dieses Interesse in drei Fragen bündeln: Was kann ich wissen? Wie soll ich handeln? Und: Was darf ich hoffen? Der Antwort auf die dritte Frage geht Kant in seiner (...) Schrift Die Religion innerhalb der Grenzen der bloßen Vernunft (1793) nach. Hier, in seiner Religionsphilosophie, setzt er, gemäß der Grundüberzeugung der Aufklärung, seine Moralphilosophie fort. Gott ist für Kant nicht mehr wie etwa in der mittelalterlichen Philosophie, auch noch bei Descartes ein Gegenstand des Wissens, sondern des Hoffens: Der moralisch handelnde Mensch hofft auf eine sinnvolle Ordnung des Weltganzen, auf einen Gott, dessen Existenz zusammen mit der Unsterblichkeit der Seele die notwendige Voraussetzung für das letzte Ziel des praktischen Handelns, für das höchste Gut, ist. Diese originelle Verbindung von zunächst als gegensätzlich Erscheinendem, von einer Moral der Autonomie mit dem Glauben an einen übernatürlichen Gott, bildet jedoch nicht das einzige Thema der Schrift. In this paper, I shall draw attention to an as yet unpublished excerpt of a part of Kant’s Religionsschrift (Religion within the Limits of Reason Alone) written by an unknown author that has been found in Schiller’s literary remains, labelled by the Goethe-Schiller-Archiv as ‘general working material’. A note on the excerpt itself marks it as pertaining to the first edition of Kant’s text. A few questions arise from that find: First, which parts of Kant’s text does the excerpt represent? (...) Secondly, does it really refer to the first edition of the Religionsschrift? Thirdly and fourthly, who authored it and how did it get into Schiller’s hands? I shall answer the first two questions by providing a tentative transcription based on which I am going to argue that the excerpt treats the first pages of the first part of Kant’s Religionsschrift and does not refer to the first, but indeed the second edition from 1794. As far as the last two questions are concerned, no definitive answer can be given. Instead I detail Schiller’s endeavours and personal contacts around the time of the publication of the Religionsschrift’s second edition, which might provide some clues as to the possible author for future investigations. Furthermore I outline the impact Kant’s discourse had on Schiller’s own philosophical works, i.e. his essay On Grace and Dignity. (shrink)

Among the most surprising claims in The Methods of Ethics is Sidgwick’s assertion that his key ethical axioms are corroborated by Kant. This article analyses Sidgwick’s claim that his axioms of justice and benevolence closely correspond to particular features in Kant. I shall argue that his claim of agreement with Kant was a serious overstatement. In particular, the restrictions which Sidgwick places on his acceptance of Kant’s universal law formula of the categorical imperative (FUL) seem to call into question whether (...) the alleged convergence with the axiom of justice has a solid basis. Further, Sidgwick seemed unaware of a crucial aspect of Kant’s conception of the humanity formula that constitutes a substantial divide between their views on benevolence. The upshot is that the divide between Kantian and Sidgwickian ethics appears deeper than Sidgwick seemed to realize. This analysis is confirmed by Sidgwick’s famous worries regarding freedom and the existence of God in Kant’s work. (shrink)

Kant is by no means the pure rationalist that Husserl and others represented him as being. To the contrary I claim that Kant is an ethical intuitionist when it comes to our recognition of the validity of the moral law. Interpreting Kant’s famous thesis about the “fact of reason”, I will first argue for three interpretative theses: 1. The factum theory explains our insight into the binding character of the moral law; it is a theory of justification. 2. In our (...) consciousness of the categorical imperative, the moral law is immediately given in its unconditional and binding validity. 3. The unconditional validity of the CI is given in the feeling of respect. Drawing on basic thoughts of Reformed Epistemology, I will then sketch a way to defend Kant’s theory. (shrink)

Many commentators hold that in addition to the categorical imperative of morality, Kant also posits an objective law of non-moral practical rationality, 'the' Hypothetical Imperative. On this view, the appeal to the Hypothetical Imperative increases the dialectical options that Kantians have vis-a-vis Humean skepticism about the authority of reason, and it allows for a systematic explanation of the possibility of non-moral weakness of will. I argue that despite its appeal, this interpretation cannot be sustained: for Kant the only objective, universally (...) valid a priori principle of practical reason that governs transcendentally free agents is the moral law. All non-moral practical rules are mere “precepts” that lack genuine objectivity, certainty, and intersubjective validity. I suggest that for Kant the rejection of the possibility of non-moral practical laws plays an important part in his argument for the supreme rational authority of moral norms over prudential precepts of happiness. La libertad tiene un valor sistemático fundamental en la filosofía de Kant. En la filosofía práctica, ella es condición de la acción en sentido eminente. Tanto en la _Fundamentación de la metafísica de las costumbres_, cuanto en la _Crítica de la razón práctica_, Kant intenta probar la libertad. La argumentación en ambas obras es distinta. El presente trabajo hace foco especialmente en la justificación de la segunda _Crítica_. En ella, Kant plantea que de la libertad sabemos gracias al hecho de (...) la consciencia moral o de una ley que vincula al sujeto incondicionadamente. Se intentará mostrar, a partir de una consideración de los textos de Kant, las obras de algunos intérpretes, así como en una reflexión sistemática, que la libertad, y el hecho de la consciencia moral, requieren de un acceso a la espontaneidad práctica por parte del sujeto, asunto que Kant deja sugerido en algunos pasajes. Intuition-based argumentation is ubiquitous across most philosophical subfields. Moral and political philosophers in particular frequently justify normative principles on the basis of thought experiments that evoke judgments about specific (hypothetical) cases. Lately, however, intuitions have come under attack and their justificatory force is being questioned. This essay asks whether we can acknowledge the epistemic fallibility of intuitions, while nevertheless reaching reliable normative conclusions. To that effect I investigate three different strategies of relating specific intuitions and more general normative principles: the (...) intuitionist, coherentist, and foundationalist methods. Showing that none of them succeeds in making up for the problematic epistemic status of intuitions in the justificatory process, I conclude that normative principles are unreliable to the extent that they are based on thought-experiments.
