There are two primary traditions in philosophical theorizing about moral standing—one emphasizing Experience (the capacity to feel pain and pleasure) and one emphasizing Agency (complexity of cognition and lifestyle). In this article we offer an explanation for this divide: Lay judgments about moral standing depend importantly on two independent cues (Experience and Agency), and the two philosophical traditions reflect this aspect of folk moral cognition. In support of this two-source hypothesis, we present the results of a series of new experiments (...) providing evidence for our account of lay judgments about moral standing, and argue that these results lend plausibility to the proposed causal link between folk moral cognition and the philosophical traditions. We must resist thoroughly reframing climate change as a health issue. For human health–centric ethical frameworks omit dimensions of value that we must duly consider. We need a new, an environmental, research ethic, one that we can use to more completely and impartially evaluate proposed research on mitigation and adaptation strategies.

Many accounts of the morality of abortion assume that early fetuses must all have or lack moral status in virtue of developmental features that they share. Our actual attitudes toward early fetuses don’t reflect this all-or-nothing assumption: early fetuses can elicit feelings of joy, love, indifference, or distress. If we start with the assumption that our attitudes toward fetuses reflect a real difference in their moral status, then we need an account of fetal moral status that can explain that difference. (...) I argue that we can have or lack relational obligations to early fetuses in light of our own activities or choices, independent of the fetus’s own features or properties. Those relational obligations make the early fetus morally considerable to the persons who stand in a moral relation to it. Pregnant persons (and other participants in the procreative process) can come to have relational obligations to an early fetus just in virtue of their own decision to create a person, either by intentionally getting pregnant or by deciding to continue a pregnancy. That decision not only makes it appropriate for them to care about the fetus, but it also generates obligations to the fetus that they didn’t have before that decision. (shrink)

The topic of cruelty features regularly in discussions concerning animals’ moral status. Further, condemnation of cruelty to animals is virtually unanimous. As Regan points out, ‘[i]t would be difficult to find anyone who is in favour of cruelty.’ What is to count as cruelty is therefore important. My aim here is to gain a clearer understanding of one aspect of our moral landscape: cruelty to animals. I will start by analyzing the concept of cruelty in section II. In section III (...) I will examine some implications of this analysis. I will present two arguments for why we should reassess whether modern farming practices are cruel. First, farming practices have changed and our understanding of the concept of cruelty needs to change with them. Second, our application of the concept of cruelty is inconsistent: we would consider many routine practices involving farm animals to be cruel if they involved pets. This inconsistency presents a dilemma: either extending farming practices to pets would not be cruel, or continuing our current farming practices is cruel. In section IV I consider some objections. If someone abstains from meat-eating for reasons of taste or personal economics, no moral or philosophical question arises. But when a vegetarian attempts to persuade others that they, too, should adopt his diet, then what he says requires philosophical attention. While a vegetarian might argue in any number of ways, this essay will be concerned only with the argument for a vegetarian diet resting on a moral objection to the rearing and killing of animals for the human table. The vegetarian, (...) in this laense, does not merely require us to change or justify our eating habits, but to reconsider our attitudes and behaviour towards members of other species across a wide range of practices. Peter Singer famously argues that speciesism, like racism and sexism, is based on a preju-dice. As Singer argues, since we reject racism and sexism, we must also reject speciesism. Since Singer articulated this line of reasoning, it has become a widespread argument against speciesism. Shelly Kagan has recently critiqued this argument, claiming that one can endorse speciesism with-out doing so on the basis of a prejudice. In this paper, I defend Kagan’s conclusion (that one can endorse speciesism without being prejudiced). (...) However, many philosophers have found Kagan’s argument deeply unsatisfactory; so, I advance an alternative argument, different from Kagan’s, in support of his conclusion. My argument runs as follows: I argue that, if there is epistemic peer dis-agreement about a view, then the parties to this disagreement cannot reasonably label each other as prejudiced in their beliefs about this view. Then, I argue that there is epistemic peer disagreement about the truth of speciesism, from which it follows that the parties to this disagreement cannot rea-sonably label each other as prejudiced. Thus, one can affirm speciesism without being prejudiced. If I am correct that one can affirm speciesism without being prejudiced, then Singer’s argument (that if one rejects racism, one must reject speciesism) is unsound. (shrink)

ABSTRACTThis paper explores the international implications of liberal theories which extend justice to sentient animals. In particular, it asks whether they imply that coercive military intervention in a state by external agents to prevent, halt or minimise violations of basic animal rights can be justified. In so doing, it employs Simon Caney's theory of humanitarian intervention and applies it to non-human animals. It argues that while humane intervention can be justified in principle using Caney's assumptions, justifying any particular intervention on (...) behalf of animals is much more difficult – and in present circumstances impossible. If these claims are correct, a number of important conclusions follow. First, all states lack legitimacy because of the horrors that they inflict upon animals. Henry Sidgwick taught G.E. Moore as an undergraduate at the University of Cambridge. Moore found Sidgwick’s personality less than attractive and his lectures “rather dull”. Still, philosophically speaking, Moore absorbed a great deal from Sidgwick. In the Preface to the Trinity College Prize Fellowship dissertation that he submitted in 1898, just two years after graduation, he wrote “For my ethical views it will be obvious how much I owe to Prof. Sidgwick.” Later, in Principia Ethica, Moore credited Sidgwick with having (...) “first clearly exposed the [naturalistic] fallacy” – a fallacy putatively committed when one defines naturalistically or super-naturalistically “good” – which was one of the book’s main ambitions (PE 39; also 17, 59). It is therefore unsurprising that Moore remarks in the intellectual autobiography he wrote years later that “From…[Sidgwick’s] published works…I have gained a good deal, and his clarity and his belief in Common Sense were very sympathetic to me.” This influence did not, however, prevent Moore from registering disagreements with Sidgwick, the sharpest of which concern the viability of egoism and the nature of the good. The disagreements between Sidgwick and Moore speak to many important moral theoretical issues arising both within and without the utilitarian tradition in ethical thinking. Because the two share much in common, a critical comparison of them on a range of moral philosophical questions proves instructive. It will tell us in particular something about the general direction of ethical thinking in the utilitarian tradition at the dawn of the twentieth century. This chapter has four parts. Part I compares the versions of utilitarianism to which Sidgwick and Moore subscribed. Part II examines the arguments each provides for the view. This paper examines whether non-human animals have a moral right not to be experimented upon. It adopts a Razian conception of rights, whereby an individual possesses a right if an interest of that individual is sufficient to impose a duty on another. To ascertain whether animals have a right not to be experimented on, three interests are examined which might found such a right: the interest in not suffering, the interest in staying alive, and the interest in being free. It (...) is argued that while the first two of these interests are sufficient to ground animal rights against being killed and made to suffer by experiments, the interest in freedom does not ground a general animal right not to be used in experimentation. The article discusses burden of proof rules in social criticism. By social criticism I mean an argumentative situation in which an opponent publicly argues against certain social practices; the examples I consider are discrimination on the basis of species and discrimination on the basis of one's nationality. I argue that burden of proof rules assumed by those who defend discrimination are somewhat dubious. In social criticism, there are no shared values which would uncontroversially determine what is the reasonable presumption and (...) who has the burden of proof, nor are there formal rules which would end the debate and determine the winner at a specific point. One requirement for the formation of an Institutional Animal Care and Use Committee is that they include a community member who embodies the values of the general population. This study’s aim is to investigate whether community members use moral arguments when deliberating a case of nonhuman animals used in experimentation. To this end, we tested the responses of community members in a situation similar to those confronting members of IACUC. The participants’ evaluation of the protocol was consistent with the mandates (...) of IACUC. We also found that overall no moral argument played a significant role in their evaluation of a protocol. Only arguments based on loyalty to the human species played a moderate role in the evaluation of using animals in experimental research, in a way similar to using some moral arguments regarding the importance of human welfare to justify the use of animals in experimental research. abstract I distinguish between four arguments commonly used to justify experimentation on animals (I). After delineating the autonomy of the question of experiments from other topics within animal ethics (II), I examine and reject each of these justifications (III–VI). I then explore two arguments according to which animal‐dependent experimentation should continue even if it is immoral (VII). I close with the way in which liberationists’ strategic considerations modify the moral conclusions of my analysis.

An important strand in the debate on abortion focuses on the moral status of fetuses. Knowledge of the moral value of fetuses is needed to assess fetuses’ moral status. As Errol Lord argues, acquaintance plays a key role in moral and aesthetic knowledge. Many pregnant persons have acquaintance with their fetus that provides privileged access to knowledge about that fetus’ moral value. This knowledge is (a) very difficult to acquire without being pregnant and (b) relevant for assessing the moral status (...) of fetuses. This has implications for public debate on abortion and the research methods of philosophers working on abortion. (shrink)

Alongside in vitro studies, researchers are increasingly exploring the transplantation of human brain organoids (HBOs) into non-human animals to study brain development, disease, and repair. This paper focuses on ethical issues raised by such transplantation studies. In particular, it investigates the possibility that they might yield enhanced brain function in recipient animals (especially non-human primates), thereby fundamentally altering their moral status. I assess the critique, raised by major voices in the bioethics and science communities, according to which such concerns are (...) premature and misleading. I identify the assumptions underlying this skeptical critique, and mention some objections against them, followed by some possible replies. I proceed to argue that the skeptical position is ultimately implausible, because it presupposes an unreasonably high standard of full moral status. My argument appeals to David DeGrazia’s idea of a “borderline person”, and to the need for consistency with existing animal research regulations. I outline the practical implications of my view for the conduct of studies that might result in the development of full moral status in a transplanted animal. I also discuss some of the ethical implications of animal enhancement (particularly of rodents) below the threshold associated with full moral status. I conclude that far from being premature, further debate on these issues is urgently needed to help clarify the prospects that a neural chimera might attain full moral status in the foreseeable future, and the level of quality of life required to make it acceptable to knowingly create such a being via HBO transplantation. I first clarify the idea that blameworthiness requires consciousness as the view that one can be blameworthy only for what is a response to a reason of which one is conscious. Next I develop the following argument: blameworthiness requires exercising control in a way distinctive of persons and doing this, in view of what it is to be a person, requires responding to a reason of which one is conscious. Then I defend this argument from an objection inspired by Arpaly (...) and Schroeder according to which responding to moral reasons suffices for exercising control distinctive of persons. (shrink)

This article explores Peter Singer’s Animal Liberation thesis and examines the arguments against his work, particularly from certain moral philosophers in the late 1970s and 1980s who seriously engaged with his ideas. This article argues that due to the straightforward, minimalist nature of Singer’s preference utilitarianism, his arguments have remained highly defensible and persuasive. By advancing sentience, above characteristics like intelligence or rationality, as a sufficient criterion for possessing interests, Singer provides a justifiable principle for morally considering animal interests equal (...) to those of humans. Numerous moral philosophers have challenged Singer, but they have struggled to seriously counter his core principle and to resolve the argument of ‘marginal cases’—that is, why do infants and intellectually disabled humans have moral status and animals do not. Ultimately, Singer broadly challenged prevailing anthropocentric views of animals and, in some instances, persuaded some of his most intransigent opponents. (shrink)

According to a widely shared intuition, normal adult humans require greater moral concern than normal, adult animals in at least some circumstances. Even the most steadfast defenders of animals' moral status attempt to accommodate this intuition, often by holding that humans' higher-level capacities (intellect, linguistic ability, and so on) give rise to a greater number of interests, and thus the likelihood of greater satisfaction, thereby making their lives more valuable. However, the moves from capacities to interests, and from interests to (...) the likelihood of satisfaction, have up to now gone unexamined and undefended. I argue that context plays a morally significant role both in the formation of an individual's capacities, and in the determination of the individual's interests and potential for satisfaction based on those capacities. Claims about an individual's capacities and interests are typically presented as unconditional; but on closer examination, they are revealed to be contingent on tacit assumptions about context. Until we develop an understanding of how to account for the role of context within our moral theories, attempts to defend special moral concern for human beings based on their superior capacities are less firmly grounded than is commonly thought. We develop an anti-commodification defense of ethical veganism which holds that common defenses of ethical veganism can benefit from treating the commodification of non-human animals as a serious, distinct moral wrong. Drawing inspiration from Elizabeth Anderson’s account of commodification, we develop an account of commodification that identifies most uses of animals in developed countries as forms of problematic commodification. We then show that this position can make significant contributions to both welfarist defenses of ethical veganism and animal rights theories.

To aid neuroscientists in determining the ethical limits of their work and its applications, neuroethical problems need to be identified, catalogued, and analyzed from the standpoint of an ethical framework. Many hospitals have already established either autonomy or welfare-centered theories as their adopted ethical framework. Unfortunately, the choice of an ethical framework resists resolution: each of these two moral theories claims priority at the exclusion of the other, but for patients with neurological pathologies, concerns about the patient’s welfare are treated (...) as meaningless without consideration of the patient’s expressed wishes, and vice versa. Ethicists have long fought over whether suffering or autonomy should be our primary concern, but in neuroethics a resolution of this question is essential to determine the treatment of patients in medical and legal limbo. I propose a solution to this problem in the form of ethical dualism. This is a conservative measure in that it retains both sides of the debate: both happiness and autonomy have intrinsic value. However, this move is often met with resistance because of its more complex nature—it is more difficult to make a decision when there are two parallel sets of values that must be considered than when there is just one such set. The monist theories, though, do not provide enough explanatory power: namely, I will present two recently publicized cases where it is clear that neither ethical value on its own (neither welfare nor autonomy) can fully account for how a vegetative patient should be treated. From the neuroethical cases of Terri Schiavo and Lauren Richardson, I will argue that a dualist framework is superior to its monist predecessors, and I will describe the main features of such an account. Many philosophers have argued against Singer’s claim that all animals are equal. However, none of these responses have demonstrated an appreciation of the complexity of his position. The result is that all of these responses focus on one of his arguments in a way that falls victim to another. This paper is a critical examination of a possible response to the full complexity of Singer’s position that derives from the work of Carl Cohen, Kathleen Wilkes, and F. Ramsey. On this (...) response, a being’s moral status depends not on the capacities and abilities she does in fact have, but instead on the capacities and abilities normal for the members of her species. However, this response is ultimately unacceptable, for it depends on a faulty conception of loss and misfortune and its underlying moral principle is irrational at best and morally objectionable at worst. The failure of even this response to Singer gives us good reason to conclude with Singer that all animals are equal. (shrink)

The risk of creating cerebral organoids/assembloids conscious enough to suffer is a recurrent concern in organoid research ethics. On one hand, we should, apparently, avoid discovering how to distinguish between organoids that it would be permissible (non-conscious) and impermissible (conscious) to use in research, since if successful we would create organoids that suffer. On the other, if we do not, the risk persists that research might inadvertently continue to cause organoids to suffer. Moreover, since modeling some brain disorders may require (...) inducing stress in organoids, it is unclear how to eliminate the risk, if we want to develop effective therapies. We are committed to harm avoidance but hamstrung by a presumption that we should avoid research that might tell us clearly when suffering occurs. How can we negotiate this challenge and maximize the therapeutic benefits of cerebral organoid research? The author interrogates the challenge, suggesting a tentative way forward. (shrink)

This article provides a critique of the IWC's traditional focus on anthropocentric conservation in the governance of whaling. It is argued that this position, which relies on accepting the view that we have no direct moral duties to whales, is out of step with the moral status that now tends, in theory and practice, to be granted to animals. More specifically, anthropocentric conservation conflicts with the widespread acceptance, in theory and practice, that non-human animals such as whales have moral standing, (...) that what we do to them matters to them directly. This does not mean that whaling should necessarily be prohibited on ethical grounds, although the animal welfare analysis of whaling sketched in this article does suggest that, on balance, it is difficult to defend morally. Rather, it is being claimed that it is morally objectionable to deny, as the whaling nations do, that the IWC ought to be mandated to consider the welfare implications of whaling. (shrink)

Some critics have understood environmental egalitarianism to imply that human and animal lives are generally equal in value, so that killing a human is no more objectionable than killing a dog. This charge should be troubling for anyone with egalitarian sympathies. I argue that one can distinguish two distinct versions of equality, one based on the idea of equal treatment, the other on the idea of equally valuable lives. I look at a lifeboat case where one must choose between saving (...) a human and saving a dog, and using the work of Peter Singer and Tom Regan, I show why equality understood as equal treatment does not entail that lifeboat cases are moral toss-ups. But the view that all lives are equally valuable does entail this, and so egalitarians should reject this alternative account of equality. The upshot is that egalitarians need to be more careful about distinguishing between these two versions of equality. The failure to insist on this distinction has led many to believe that egalitarianism generally has counter-intuitive implications when in fact only one version of egalitarianism has this problem. The issue of how we ought to treat the nonhuman animals in our lives is one that has been growing in importance over the past forty years. A common charge is that discriminatory behavior based only on differences of species membership is just as wrong morally as are acts of racism or sexism. Is such a charge sustainable? It is argued that such reasoning confuses real differences with false ones, may have negative ethical consequences, and could tempt us to abandon (...) our responsibilities to the natural world. Finally, some benefits to human animal treatment that more humane nonhuman animal treatment may bring are considered. (shrink)

In this paper I explore a new approach to the ethics of animal experimentation by conceiving of it as a form of rescue. The notion of rescue, I suggest, involves some moral agent performing an action or series of actions, whose end is to prevent or alleviate serious harm to another party, harm that otherwise would have occurred or would have continued to occur, had that moral agent not intervened. Animal experiments that are utilized as a means to alleviate human (...) illnesses mirror the structure of rescue cases and this means that we can and should apply principles of rescue to illuminate the moral status of animal experimentation. To do this I consider various principles of rescue that might justify animal experimentation. I’ll argue that all of these rescue principles are either not independently plausible, or else they fail to imply that animal experimentation is morally justified. This suggests that it is quite difficult to morally justify animal experimentation when conceived as a form of rescue. (shrink)

. Luciano Floridi argues that every existing entity is deserving of at least minimal moral respect in virtue of having intrinsic value qua information object. In this essay, I attempt a comprehensive assessment of this important view as well as the arguments Floridi offers in support of it. I conclude both that the arguments are insufficient and that the thesis itself is substantively implausible from the standpoint of ordinary intuitions.

Humanism – in the sense that humans alonehave moral standing, or else a surpassing degree of it– has traditionally dominated all of ethicaldiscourse. However, its past formulations havesuccumbed to the temptation merely to stipulate sucha criterion, such as rationality, which nonhumans areoften deemed (without sufficient argument) to failwithout exception. Animal liberationistarguments do exist in counterpoint to traditionalhumanism, but one current difficulty seems to be asimple clash of basic assumptions, with an indecisiveresult. The theory is premised upon viewing humans asgenerally having and leading lives of greater value,in some relevant sense. This essay prefigures theauthor's refutation of humanism, more generally, inthe understanding that such a world view cannot trulybe refuted unless its best version is answered.Whatever the status of this paper's offering of``Obligatory'' Anthropocentrism, the theory can be seento have a great deal more success than itspredecessors in parrying, and apparently outdoing,contemporary animal liberationist philosophies. Peter Singer’s arguments against the morality of the typical American diet focus on the pain of animals, and lead to the conclusion that we must become committed vegans. His approach ignores the impact that different psychological capacities can legitimately have on our moral appraisal of the interests of beings. Although we ought to eat less meat because of the externalized environmental costs that factory farming inflicts upon future people, an ideal diet may contain some environmentally sustainably raised meat. Finally, the (...) perception of ethical puritanism in committed vegans may be an obstacle to achieving the real reductions in animal suffering that they advocate. (shrink)
